MEMOAANDUM
At the Planning Comnission meeting of July 29, 1981, as a result of
City Council direction, the Planning Comnission has recommended the
deletion of authorized parking of trucks in excess of 13,000 pounds
in residential districts. Attached is a copy of our ordinance which
incorporates the Planning Comnission's recommendation.
If the City Council desires to implement this recornmended change, we
can prepare a change to Ordinance 506. •

to state taw; nor shalt any owner or person having custody or control of any vehicle
knowlingly allow any other person to drive, operate or be in actual physical control
of a vehicle contrary to state law.

CAMPLIANCE
As used in this ordinance, the term "comnercial vehicle' means and includes a"truck" as defined in
Minnesota Statutes Section 168.011 Subdivsion 10, a'tractor" as defined in Minnesota Statutes Section
168.011 Subdivision 11, a"truck tractor" as defined i� Minnesota Statutes Section 168.11 subdivision
12, a"trailer" as defined io Minnesota Statutes Section 168.011 Subdivision 13, a"semi-trailer" as
defined in Minnesota Statutes Section 168.011 Subdividion 14, and a"bus" as defi�ed in Minnesota
Statutes Section 168.011 Subdivision 9.
Subdivision 3. As used in this ordinance, the term "residential district" means and incldues those
areas zoned single familydwelliog areas, two family dwelling areas, a�d general multiple family
dwelling areas. (Ref. 552)
506.02. OFF PAVEMENT
No person shall stop, leave standing or park a vehicle whether attended or
u�attended, upon the paved or improved or main traveled portion of a highway or
street when it is Dractical to stop, park or leave such vehicle off such portion of
said highway or street. In every suth event, a tlear and unobstruttea witlth of at
least fifteen feet (15 feet) of such highway or street opposite such standing
vehicle shall be left for the free passage of other vehicles.
506.03. UNATTENDED VEHICLES
No person sha11 stop, park or leave a vehicte unattended upon such street or highNay in
the City for a perioa in excess of 24 hours.

Whenever,it shall be found necessary to the proper direction control, or regulation of
traffic or for the plowing and/or the removal of snow, ice or waste, maintenance or im-
provement of any hi¢�way or street to remove any vehicle standing on a highway or
street in the City, then any police officer is authorized to provide for the removal
of such vehicle and have the same removed to the nearest convenient garage or other
place of safety. Any vehicle stopped, parked or left standing on any highway or
street in viotation of law and removed as provided herein above, may be removeo upon
order of a police officer and the cost of removal and storage of the same chargea to

Whenever any publit school lands or the lands antl areas of any public governing body or
authority customarity or usualty open to traffic by the public shall be posted by
oroer of the school board or other governing botly or authority in control of such lands,

vehicle on such lands contrary to such posting.

506.13. ILLEGAL PARKING
In any prosecution chargin9 a violation of any law or regulation governing the
standing or parking of a vehicle. proof that the particular vehicle described in the
complaint ras parked in violation of any such law or regulation together with proof
that the defendant named in the complaint Mas at the time of such parking the
registered owner of such vehicle shall constitute in evidence a prima facie
presumption that the registered owner of such vehicle was the person who parked or
placed such vehicle at the point where and for the time auring which such violation
occurred.
506.14. PENALTIES
Any violation of this chapter is a misdemeanor and is subject to all penalties provided
for such violations under the provisions of Chapter 901 of this Code.

In response to your request for different options regarding the above
subject, a survey has been made of the other jurisdictions in our area.
The findings of the survey are as follows:
ANOKA
No trucks in excess of three-quarters ton rated capacity shall
be parked or repaired on public streets or in the open on
private property in any of the residential districts, except
that trucks may make normal deliveries.�
BLAINE
,.(a) No motor vehicle bearing a commercial license and no
��� commercially licensed trailer shall be parked or stored in a
� platted residential district except when loading, unloading, or
rendering a service.
(bi This section shall not prohibit the parking or storing of
one motor vehicle rated one-ton capacity or less in a platted
residential district.
(c) No vehicle bearing a commercial license;shall be parked on
a street in a platted residential district except for short term
parking (two (2) hours or less), except when loading, unloading,
or rendering a service.
BROOKLYN CENTER

BROOKLYN PARK
No parking of semi-trailer trucks in residential areas.
COLUMBIA HEIGHTS
"Bus" means a vehicle designed for carrying passengers and having
a seating capacity of more than nine persons, but not to include
any such vehicle which has been altered for use for camping
purposes exclusively.
"Motor truck," "truck tractor," or "commercial vehicle" means a
vehicle having either a capacity of more than one (1) ton or
weight of more than 5,000 pounds or both, but not to include
vehicles which are designed exclusively for recreation purposes.
No person owning, driving, or in charge of any bus, motor truck,
truck tractor, or commercial vehicle shall permit the same to
be parked or stand longer than 24 hours continuously on, in front
of, or beside any property in a residential district, except for
the purposes of loading and unloading.
�� No person owning, driving, or in charge of any bus, motor truck,
• truck tractor, or commercial vehicle designed exclusively for
recreation or camping purposes, shall permit more than two of the
same to stand longer than 24 hours continuously on, in front of,
or beside any property in a residential district except for the
purpose of loading and unloadinq.
COOtt RAPIDS
(1) It shall be unlawful for any person to park, or permit to be
parked, on any public street, between one hour after sunset and
one hour before sunrise, a truck in excess of 9,000 aounds
licensed gross vehicle weight, a truck-tractvr, a semi-trailer,
special mobile equipr�ent, recreational equipment, mobile home,
house trailer, boat or boat trailer. This section shall not apply
to any motor vehicle which is actively loaded or unloaded or which
is being utilized to render a service.

j This City's ordinance is under review. It currently limits
� trucks in excess of one ton from parking in residential districts
� in excess of two hours. Off-street parking in residential
districts is allowed if 15 feet from the curb.
NEW BRIGHTON
No special truck restrictions.
SPRING LAKE PARK
The City Council of the City of Spring Lake Park finds that the
parking of large trucks, tractors, and other commercial vehicles
on the streets and rights-of way within the City, for other than
temporary parking for delivery or unloading, creates an unnecessary
risk of personal injury, creates ar. unsightly aopearance within
the City and often produces excess�.•:•� noise.
It is a violation of this ordinanc�•for any person to leave, park,
permit or allow any motor vehicle described below upon any public
street or right-of-way:
a. Commercial trucks with over one-ton carrying capacity;
b. Tractors used for hauling trailers;
c. Trailers (the type pulled by tractor);
d. Commercial buses.
Temporary parking of such vehicles for delivery or unloading is
excepted from this ordinance.
FRIDLEY
No person shall park or leave standing a commercial vehicle,
whether attended or unattended, having a gross weight of more
than 13,000 pounds upon public streets in any residential district
for a period of time longer than four hours, unless in the process
of loading or unloading and then only for such period of time
necessary to load and unload.
It should be noted that truck parking restrictions tend to be politically
controversial as evident form attached newspaper articles relating to
Mounds View.

Should our City Council feel that Fridley's ordinance be more restrictive,
I suggest the following factors be conside�ed:

3. Restrictions off-street in residential districts.
If City Council desires modifications in our tru�k parking ordinance,
I would be glad to draft a revised ordinance based on Council's desired

Subd. 2. Apptication for registratioa; listing for taxation. "Application for '`
registration" shall have the same meaning as "listing for taxation," and when a
motor vehicle is registered it is also listied.
Subd. 3. Highway. A"highway" is any public thoroughfare for vehicles, ,�
including streets in cities.
Subd. 4. otor vehicle. "Motor vehicle" means any self-propelled vehicle
not operated exclusive y upon railroad tracks and any vehicle propelled or "
drawn by a self-propelled vehicle and includes vehicles known as trackless trol-
leys which are propelled by electric power obtained from overhead trolley wires ;
but not..nperated upon rails, except snowmobiles and mobile homes. s�
Subd. 5. Owner. "Owner" means any person, �rm, association, or corpo-
ration owning or renting a motor vehicle, or having the exclusive use thereof, ;�'
under a lease or otherwise, for a period of greater than 30 days. :�
Subd. 6. Tax, fee. "Tax" or "fee" means the a�nual tax imposed on motor �
vehicles in lieu of all other taxes thereon, except wheelage taxes, so-called, '�"
which may be imposed by any city and except gross earnings taxes paid by com- ''
panies subject or made subject thereto. Such annual tax shall be deemed both a ��
property tax and a highway use tax and shall� be on the basis of the calendar �
year. `

Subd. 7. Passen er automobile. "Passenger sutomobile" means any motor
vehicle designe and use or the carrying of not more than eight persons but
excluding motorcycles, motor scooters, and station wagons.
Subd. 8. Mobile home and house trailer. (a) "Mobile home" means any
trailer or semi-trailer which is designed, constructed, and equipped for use as a
human dwelling place, living abode, or living quarters except house trailers. ;
(b) "House trailer" means any trailer or semi-trailer which is not more
than eight feet in width and not more than 35 feet in length and which is
designed, constructed, and equipped for use as a human dwelling place, living
abode, or living quarters. _
Subd. 9. Bns; intercity bus. (a) "Bus" means any motor vehicle designed
and use� for the carrying of more than eight persons.
(b) "Intercity bus" means any bus operating as a common passenger car- ,
rier over regular routes and between fixed termini, but excluding all buses oper- �:
ating wholly within the limits of one city, or wholty within two or more contigu- �`
ous cities, or between contiguous cities and a terminus outside the corporate
limits of such cities, and not more than 20 miles distant measured along the '
fixed route from such corporate limits.
Subd. 10. Tr� "Truck" means any motor vehicle designed and used for I
carrying things other than passengers. �
Subd. 11. Tr�. "Tractor" means any motor vehicle designed or used �
for drawing other vehicles but having no provision for carry.ing loads indepen-
dently. .
Subd. 12. Tr��k-trac±o ."Truck-tractor" means any motor vehicle +
designed and used primarily for drawing other vehicles and not so constructed as
to carry a load othe{ than a part of the weight of the vehicle and load so drawn.
Subd. 13. Tr_ aileT"Trailer" means any vehicle designed for carrying prop-
erty or passenger on its own structure and for being drawn by a motor vehicle
but shall not include a trailer drawn by a truck-tractor semitraiter combination.
Subd. 14. Sem" trai_,_ '°Semi-trailer" means a vehicle of the trailer type so
designed and used in conjunction with a truck-tractor that a considerable part of
its own weight or that of its load rests upon and is carried by the truck-tractor
and shall include a trailer drawn by a truck-tractor semitrailer combination.

Subd. 15. Unloaded weight. "Unloaded weight" means the actual weight of
the vehicle fully equipped without a load.
Subd. 16. Gross wei ht. "Gross weight" means the actual unloaded weight
of the vehicle, either a truc c or tractor, or the actual unloaded combined weight
of a truck-tractor and semitrailer or semitrailers, or of the truck-tractor, sem-
itrailer and one additional semitrailer, fully equipped for service, plus the weight
of the maximum load which the applicant has elected to carry on such vehicle or
combined vehicles. The term gross weight applied to a truck used for towing a
trailer means the unloaded weight of the truck, fully equipped for service, plus
the weight of the maximum load which the applicant has elected to carry on
such truck, including the weight of such part of the trailer and its load as may
rest upon the truck. The term gross weight applied to school buses means the
weight of the vehicle fully equipped with all fuel tanks full of fuel, plus the
weight of the passengers and their baggage computed at the rate of 100 pounds
per passenger seating capacity, including that for the driver. The term gross
weight applied to other buses means the weight of the vehicle fupy equipped
with all fuel tanks full of fuel, plus the weight of passengers and their baggage
computed at the rate of 150 pounds per passenger seating capacity, including
that for the driver. For bus seats designed for more than one passenger, but
which are not divided so as to allot individual seats for the passengers that
occupy them, allow two feet of its length per passenger to detetmine seating
capacity. The term gross weight applied to a truck, truck-tractor or a truck used
as a truck-tractor used exclusively by the owner thereof for transporting unfin-
ished forest products c�r used by the owner thereof to transport agricultural, hor-
ticultural, dairy and other farm products including livestock produced or finished
by the owner of the truck and any other personal property owned by the fariner
to whom the license for such truck is issued, from the farm to market, and to
transport property and supplies to the farm of the owner, as described in suf�di-
vision 17, shall be the actual weight of the truck, truck-tractor or truck used as a
truck-tractor or the combined weight of the truck-tractor and semitrailer plus the
weight of the maximum load which the applicant has elected to carry on such
vehicle or combined vehicles and shall be licensed and taxed as provided by sec-
tion 168.013, subdivision lc. The term gross weight applied to a truck-tractor or
a truck used as a truck-tractor used exclusively by the owner thereof for towing
an equipment dolly shall be the actual weight of the truck-tractor or truck used
as a truck-tractor plus the weight of such part of the equipment dolly and its
load as may rest upon the truck-tractor or truck used as a truck-tractor, and
shall be licensed separately and taxed as provided by section 168.013, subdivi-
sion le, and the equipment dolly shall be licensed separately and taxed as pro-
vided in section 168.013, subdivision ld, which is applicable for the balance of
the weight of the equipment dolly and the balance of the � maximum load the
applicant has elected to carry on such combined vehicles. TPte term "equipment
dolly" as used in this subdivision means a heavy semitrailer used solely by the
owner thereof to transport his construction machinery, equipment, implements
and other objects used on a construction project, but not to be incorporated in
or to become a part of a completed project. The term gross weight applied to a
wrecker de�ned in section 169.01, subdivision 52, means the weight of the
wrecker fully equipped for service, including the weight of the crane, winch and
other equipment to control the movement of a towed vehicle, but does not
include the weight of a wrecked or disabled vehicle towed or drawn by the
wrecker.
Subd. 17. Farm truck. "Farm truck" means all single unit trucks, truck-
tractors, tractors, semitrailers, and trailers used by the owner thereof to trans-
port agricultural, horticultural, dairy, and other farm products, including live-
stock, produced or finished by the owner of the truck, and any other personal

house trailers, dump trucks, truck mounted transit mixers, truck mounted feed
grinders or other motor vehicles designed for the transportation of persons or
property to which machinery has been attached.
Subd. 23. Station_,wa +�o� "Station wagon" means a dual purpose vehicle
designed for tlie transportat�on of gersons and also designed in such a mannet
that the seats may be removed or folded out of the way for the purpose of
increasing the property carrying space within the vehicle. The term includes, but
is not limited to, types of vehicles which carry the trade names of station wagon,
estate wagon, ranch wagon, town and country wagon, country sedan, suburban,
travelall, and carryall.

Subd. 25. Recreational e ui ment. "Recreational equipmenY' means house
trailers including those whic te escope or fold down, chassis mounted campers,
house cars, motor homes, tent trailers, slip in campers, converted buses and
converted vans.
(1} House trailers, chassis mounted campers, house cars, motor homes,
tent trailers, slip in campers, converted buses and converted vans are units
designed and used for human living quarters and meeting the following qualifica-
tions: .
(a) Are not used as the residence of the owner or occupant.
(b) Are used for temporary living quarters by the owner or occupant while
engaged in recreationat or vacation activities.
(c) Are self propelled or towed on the public streets or highways incidental
to such recreational or vacation activities. _
(2) Slip in campers are mounted into a pickup truck in the pickup box,,
either by bolting through the floor of the pickup box or by �rmly clamping to
the side of the pickup box. The vehicle may be registered, at the owner's choice,
as either a recreational vehicle under this definition or may be registered as a
truck, defined by subdivision 10.
Subd. 26.�+Iot_ orcvcle_. "Motorcycle" means every motor vehicle having a
seat or saddle for the use of the rider and designed to travel on not more than
three wheels in contact with the ground, including motor scooters and bicycles
with motor attached, other than those vehicles defined as motorized bicycles in
subdivision 27, but excluding a tractor.
Subd. 27. �Ylotorized bicvcle. "Motorized bicycle" means a bicycle with
fully operatable pedals which may be propelled by human power or a motor, or
by both, with a motor of a capacity of less than �50 cubic centimeters piston dis-

For each vehicle with a gross weight in excess of 81,000 pounds an addi-
� tional tax of $36 is imposed for each ton or fraction thereof in excess of 81,000

� Provided however, that on all trucks, except those in this chapter defined
� as farm trucks and urban trucks, having a gross weight in excess of 18,000
; pounds but less than �7,001 pounds, the tax shall be:
? (a) For the registration year 1976, 70 percent of the applicable Schedule I ,
or Schedule II of this subdivision;
i (b) For the registration year 1977, 80 percent of the applicable Schedule I
' or Schedule II of this subdivision;
(c) For the registration year 1978, 90 percent of the applicable Schedule I

$90 plus an additional tax of $15 per ton for each ton or major portion in excess
of 20,000 pounds. Where the gross weight of the vehicle is more .than 24,000
pounds and not more than 28,000 pounds, the tax shall be $120 plus an addi-
t�onal tax of $25 per ton for each ton or major portion in excess of 24,1)00
pounds. Where the gross weight of the vehicle is more than 28,0(� pounds, the
tax shalt be $110 plus an additional tax of $30 per ton for each ton or major
portion in excess of 28,000 pounds.
During each of the fourth, fifth and sixth years of vehicie life, the tax shall
be 80 percent of the foregoing scheduled tax but in no event less than $20 per
vehicle.
During each of the seventh, eighth and ninth years of vehicle life, the tax
shall be 60 percent of the foregoing scheduled tax but in no event less than S16
per vehicle.
During the tenth and succeeding years of vehicle life, the tax shall be 40
percent of the foregoing scheduled tax but in no event less than $12 per vehicle.
Subd. lg. Rp rpational vehi i �_ Selfpropelled recreational vehicles shall be
separately licensed and taxed annually on the basis of total gross weight at 100
percent of the Minnesota base rate prescribed in subdivision le under Schedule I
during each of the first six years of vehicle life, but in no event less than $14,
and during the seventh and succeeding years of vehicle life as taken from Sched-
ule II, but in no event less than $8. Towed recreational vehicles shall be sepa-
rately licensed and taxed annually on the basis of total gross weight at 30 per-
cent of the Minnesota base rate prescribed in subdivision le under Schedule I
but in no event less than $5.
The annual tax on a s(ip-in camper as defined in section 168.011, subdivi-
sion 25, shall be as provided for selfpropelled recreational vehicles unless such
owner elects to register such slip-in camper as a truck. If the owner elects to
register such slip-in camper as a truck, the annual tax shall be either the tax
imposed for selfproQelled recceational vehicles or the tax imposed for trucks on
the basis of grQSS weight in subdivision le, whichever is higher. Notwithstanding
any law to the contrary, all trailers and semitrailers taxed pursuant to this sec-
tion shall be exempt from any wheelage tax now or hereafter imposed by any
po(itical subdivision or political subdivisions.
Subd. lh. Motorized bicycles. On motorized bicycles the tax is $3, which
includes the surtax provided for in subdivision 14.
Subd. 2. Prorated fees. When a motor vehicle first becomes subject to tax-
ation during the registration period for which the tax is paid, the tax shall be for
the remainder of the period prorated on a monthly basis, 1/12 of the annual tax
for each calendar month or fraction thereof; provided, however, that for a
vehicle having an annual tax of a5 or less there shall be no reduction until on
and after September 1 when such annual tax shall be reduced one-half.
Subd. 3. Application; cancelation; excessive gross weights forbidden. The
applicant for all licenses based on gross weight shall state in writing upon oath,
among other things, the unloaded weight of such vehicle or trailer and the ma�ci-
mum toad the applicant proposes to carry thereon, the sum of which shall con-
stitute the gross weight upon which the license tax shall be paid, but in no case
shall the declared gross weight upon which the tax is paid � be less than 1-1/2
times the declared unloaded weight of the vehicle or trailer to be registeted,
except recreational vehicles taxed under subdivision lg, school buses taxed
under subdivision 18 and wreckers defined in section 169.01, subdivision 52. The
gross weight of a wrecker is the actual weight of the wrecker fully equipped, but
does not include the weight of a wrecked or disabled vehicle towed or drawn by
the wrecker.
