7he Regular Meeting of the Fridley City Council was called to order at
7:35 p. m, by Mayor Nee.
PLEDGE OF ALLEGIANCE:

MOTION by Councilwoman Moses-Martin to appr.ove the minutes as presented.
Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.
CANVASS OF VOTES MEETING, SEPFEMBER 17, 1981:
MOTION by Councilman Schneider to approve the canvass of votes from the
September 15, 1981 primary election. Seconded by Councilwoman Moses-Martin.
Upon a voice vote, all voting aye, Mayor Nee declared the motio� carried
unanimously.

OPEN FORUM, VISITIORS:
REPORT - INTERNATIONAL YEAR OF DISABLED PERSONS' BALLOON SALE PROJECT:
Ms. Barbara Terpstra reported on the International Year of the Disabled
Persons' balloon sale project. She stated a check is being sent to Fridley
in the amount of $390.56; $300 of which is the return of funds provided by
Fridley and the $90.56 is Fridley's share of the balloon project profits.
Ms. Terpstra stated their organization has naw sent a survey to every home
in Fridley to find out how many disabled persons there are in the !City.
She requested they be allowed to use the funds returned to the City to
cover the postage on these surveys. Ms. Terpstra stated a full report would
be given to the Council, after all the surveys have been returned.
Mayor Nee suggested their request, for the postage to be paid, be after
the surveys are rexurned. .
DEBRIS - LOCKE LAKE:
Mr. Ray Luniewski, 6959 Hickory Circle, stated branches and debris have
piled up since the City lowered Locke Lake and requested this be removed
or the Fire Department burn it.

Mr. Flora, Public Works.Director, stated the City submitted a request to
the Environmental Protection Agency to allow them to burn this debris, but
the permit was denied, h�wever, they are still working on trying to obtain
a permit.
Councilman Barnette questioned when the repairs would be coirpleted. Mr. —
Flora stated they had delays becuase of the weather, but hope to get the
water back by this weekend.
Mayor Nee stated staff would check into this further to try and resolve the
problem.
PUBLIC HEARING:
�� PUBLIC HEARING ON AN ORDINANCE CHANGE TO CHAPTER 506 OF THE FRIDLEY CITY
CODE "PARKING OF VEHICLES":
MOTION by Councilman Fitzpatrick to waive the reading of the public hearing
notice and open the public hearing. Seconded by Councilwoman Moses-Martin.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the public hearing opened at 7:45 p, m.
Mr. Flora, Public Works Director, stated this ordinance would restrict ''
those vehicles over 12,000 pounds from parking on a residential area
othe r than for official business.
The Council raised the question if vans or pickup trucks would be affected.
Mr. Flora stated it would not affect them because they would be under the
12,000 pound weight.
No persons in the audience spoke regarding this proposed ordinance.
MOTION by Councilman �arnette to close the public hearing. Seconded by
Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimousTy and the public hearing cTosed at
7:50 p, m.
OLD BUSINESS:

MOTION by Counciiman Fitzpatrick to waive the second reading of Ordinance
No. 739 and adopt it on the second reading and order publication. Seconded by
Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.
�, CONSIDERATION OF AGREEMENT BETWEEN CITY�
Mr. Qureshi, City Manager, stated these funds were made available to the
County, under a block grant, because of Anoka County becoming an urban county.
He stated all cities were advised to submit applications and Fridley
subm9tted two app7ications, one for the Center City project and one for the=
Riverview Heights area.
Mr. Qureshi stated funding was received for the Center City project, which
is being conducted by the Housing and Redevelopment Authority, and it would
be appropriate to contract with them to administer these funds for acquisition
in the Center City project.

MOTION by Councilwoman Moses-Martin to authorize the Mayor and City Manager
to enter into this agreement of cooperation with the Fridley Housing and
Redevelopment Authority for the administration of community developrr+ent
block grant funds. Seconded by Councilman Schneider. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously.

Mr. Flora, Public Works Director, stated this parcel of property is located
just to the east of Siverts Lane and the request is to split off the
southerly 100 feet� to make a 100 x 97 foot lot.
Mr. Flora stated the problem with this particular lot split is the question
of how to handle access to the other lots since there is no way, at the
present time, to service them. Mr. Flora suggested possibly an easement
be provided by all the property owners which would allow a private drive for
access.
Mr. Flora explained, if it were a private drive, it could be a narrower
street than normally would be required of a regular City street, and it
would probably be iess expensive.
Mr. Flora felt, if the lot split were to be granted, consideration should
be given on how to service the remaining lots.
Mr. Anderson, the petitioner, stated, as far as putting a road through
the back, he was certain everyone would not want it. He stated the only
reason he is splitting his property is that he borders Siverts Lane and
has easy access.
Mr. Qureshi, City Manager, stated he recognizes Mr. Andreson dces not want
to put a road through, but asked if ar�yone else was present that had lots
east of Mr. Anderson's property. Since there was no one at the meetinc�,
Mr. Qureshi felt these property owners should have the opportunity to voice
ther comments as to whether or not they want access provided to their
properties. -
Councilwoman Moses-Martin felt no decision should be made on the lot split
until the other property owners have the opportunity to attend a meeting
in order to determine if they want access for a future road and discussion
on where a future road might be constructed.
Mr. Flora, Public Works Director, stated there are also properties to the
west of Siverts Lane which do not allow for easy access to Old Central,
therefore, he felt whatever considerations were given to the property
owners on the east of Siverts Lane should also be given to the properties
on the west side of Siverts Lane.
MOTION by Councilwoman Moses-Martin to call for an informal meeting for
next week with the residents on the east and west of•Siverts Lane regarding
this lot split and discussion on future access to their properties. Seconded
by Councilman Schneider. Upon a voice vote, a]] voting aye, Mayor Nee
declared the motion carried unanimously.
Mayor Nee stated the decision on the lot split will be tabled until the
meeting next week.

Mr. Flora, Public Works Director, stated this request is to split Lot 6,
Auditor's Subdivision No. 89 in order to make two building sites each 66-1/2
by 133.97 feet for the construction of two duplexes. —
Mr. Flora stated the area is zoned R-3 and surrounded, to a degree, by
apartment houses, some quads, and duplexes.
Mr. Flora stated, in conjunction with the lot split, variances have also
been requested to reduce the lot areas and widths, and the Appeals Comnission --
has recommended approval of the variances, and the Planning Comnission
recommends approval of the lot split.
Mayor Nee asked if Mr, or Mrs. Caldien were present at the meeting as they
had some objections when this item was before the Planning Comnission;
however, there was no response from the audience.
Councilman Schneider questioned the comments made at the Planning Commission
meeting regarding the parking problem. Mr. Flora stated there were
discussions, at the Commission level. regarding this problem, however, the
Corrrnission probably feltthis use would be a better use of the property,
rather than a larger unit which could add additional parking problems.
MOTION by Councilman Schneider to concur with the recommendation of the
Planning Commission and grant Lot Split Request, LS #81-07. Seconded by
Councilwoman Moses-Martin. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimously.
t' RECEIVIN6 HUMAN RESOURCES COMMISSION MINUTES REGARDING FUNDING OF
� � ORGAPdIZATIONS:
Mr. Qureshi, City Manager, stated the Human Resources Commission has made
recommendations to the Planning Commission regarding funding of various
organizations. He stated their recommendation was to fund Southern Anoka
County Assistance and the Well Senior Citizen Clinic, with no restrictions,
which would amount to 100% of the budget request or �2,500 for Southern Anoka
County Assistance and �2,000 for the Well Senior Citizen Clinic.
Mr. Qureshi stated they further recommnded that the Central Center for
Family Resources and the Creative Play Center be funded to some degree,
as determined by the Council, and that the Family Life Center not be funded
due to overlapping services, they do not operate on a sliding fee scale,
and the amount requested seemed excessive.
Mr, Qureshi stated the Council also had the opportunity to hear from some
of these groups at their conference meeting.
Mr. Qureshi stated the following funding is proposed, which is essentially
what is recommended by the Human Resources Corrmission: $2,500 for Southern
Anoka County Assistance; $2,000 for the Well Senior Citizen Clinic; $4,000
for the Central Center for Family Resources; and $1,500 for the Creative Play
Center, for a total of $10,000.
Mr. Qureshi pointed out the Council has provided only $5,000 for service
groups and if they desire to commit the above amounts, additional funds
would have to be provided when the 1982 budget is adopted.
Councilwoman Moses-Martin stated she realizes another $5,000 will have to
be provided in order to provide the funding of these organizations, but
pointed out the Central Center for Family Resources has applied for a grant
next year and stands to receive this grant if the communities still support
this organization to the level they have in the past.

She felt if they don't support this organization to the degree they have in
the past, which is $5,000, they probably wouldn't receive the grant.
Councilman Schneider felt all the organizations are well-meaning and worthwhile
and pointed out there was another organization, the Family Life Center, which
was not recommended by the Human Resources Comnission for funding. He stated
there may have been some misunderstanding between them and the Comnission _
regarding the sliding fee scale. He stated he is not sure what to do about
this since they did request the Human Resources Cormnission to make recomnendations
regarding the funding of these organizations.
MOTION by Councilman Fitzpatrick to authorize the administration to provide
for a total of $10,000, at the 2nd reading of the budget ordinance, in order _
to fund the following organizations as reconrnended by the Human Resources
Cortmission and concurred with by the Planning Commission: $2,500 for Southern
Anoka County Assistance; $2,000 for the Well Senior Citizen Clinic; $4,000 for
the Centrai Center.for Famiiy Resources; and $1,500 for the Creative Play Center.
Seconded by Councilman Barnette.
MOTION by Councilwoman Moses-Martin to amend the above motion to increase the
funding to the Central Center for Family Resources from $4,000 to $5,000.
MOTION FAILED FOR LACK OF SECOND.
Councilman Barnette felt all the organizations have good reason and rationale
for the�City to support them, however, this was given to the Human Resources
Corrrnission for their recommendation and felt they used good criteria to arrive
at the recommended distribution.
Councilman Schneider felt if they start changing the figures, then the family
Life Center had a very persuasive argument, however, they have given the Human
Resources Commission the responsibility of submitting the recommendations for
funding and they should be followed.
Councilwoman Moses-Martin felt family resources are hard to measure and by
increasing this funding, it may save in other areas, such as the police
budget, and help reduce crime.
Ms. Lucy Mickman, 1631 66-1/2 Avenue, stated she is a nurse with the Family
Life Center and indicated the Central Center for Family Resources and their
organization are both doing about the same kind of service to the comnunity.
She pointed out, however, they had calls from persons who couldn't afford
to pay for their services and they were told �to come in and they would do
what they could for them. She stated they do service a lot of people in
Fridley and being a r,esident of Fridley for 28 years and being involved,
she felt she had to make a few camnents.
Mr. Dick Harris, Chafrman of the Planning Commission, stated the Human
Resources Commission labored very hard and long over their decisiorts for
the funding and tried to stay within the budget that was designated, and
felt their recommendations should be given consideration.
UP�1 A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee
declared the motion carried unanimously.
MOTION by Councilman Barnette to receive the minutes of the Planning Comnission
Meeting of August 19, 1981. Seconded by Councilman Fitzpatrick. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously.

Mr. Flora, Public Works Director, stated the City Flood Plain Ordinance
requires that in order to build in the flood fringe, a special use permi�
is required and other flood proofingmeasures.
Mr. Flora stated, in this case, the property is to be filled until it is
one foot above the flood elevation. He stated there was some concern by the
Planning Commission regarding the drainage and they recorrmended approval of
the special use permit with a stipulation that a drainage plan be provided _
to the City and the petitioner work with th e City to insure proper drainage
and proper placement of the house on the property.
Mr. Flora stated he has received a drainage plan this evening and it appears
a drainage system has been provided to satisfy this o�equirement.
MOTION by Councilman Fitzpatrick to concur with the recommendation of the
Planning Cortmission and grant Special Use Permit, SP #81-09 to allow
construction of a single family dwelling in a CRP-2 zone at 7919 Broad
Street, with the stipulation that a drainage plan be provided and that the
petitioner work with the City staff to insure proper drainage and proper
location of the house on the property. Seconded by Councilwoman Moses-Martin.
Mr. Lagesse, 7951 Broad Street, questioned the location of the house on
the property, as he had suggested it be moved farther to the west. He felt,
if this was done, it would take care of his concerns and wouldn't affect his
property whatsoever.
Mr. Lagesse was shown the diagram submitted by Mr. Hadtrath which indicated
the location of the house on the lot. He stated, from looking at this
diagran, it appears there is room for a swale so the water wouldn't come back
to his property.

Mr. Flora stated the Appeals Carmission has recomnended approval of the
variances, with the stipulation that the owner work with the City Planning
Department to establish a landscape plan and improvement schedule. Mr. Flora
, further suggested a bond to insure canpliance.

requires a 20 foot setback to aRy parking area and if they put another
driveway in, they wouldn't have the required 20 feet between the turn-
around and the street. He s.tated another variance would be needed in order
for them to provide this turn-around they are requesting.
Mr. Qureshi, City Manager, stated if they want to put in this turn-around,
they would need a variance from the required 20 feet to 4 feet in order for
it to be accomplished.

Councilman Fitzpatrick stated this petition is to look into the effect of
berming in the Corrmunity Park and the effect it has on noise fran the
railroad. He stated the staff has done some work on this and there is a
report inciuded in the agenda this evening.
Mr, Flora, Public Works Director, stated on September 11, they were advised
there was a considerable amount of noise in the area west of the Comnunity
Park by the Burlington Northern railroad tracks. Ne stated the sound leveis
wEre checked and tests taken at Hickory Circle and at 6699 Ashton Avenue, and
it was found there is not significant difference.in the meter readings at the
two different locations.
Mr, Ray Luniewski, 6959 Hickory Circle, stated he initiated the petition which
is before the�Council. He stated he realizes they will have noise in the
Community Park during the construction period, but the noise from the trains
will be forever. He stated it seems since they have been moving the mounds
of dirt around in the Community Park, it is making the noise from the trains
louder in their area. He felt the land should be left flat, as it was,
however, he stated they don't have any objection to the park.
Mr. Mike Pawltsmyn, 6969 Hickory Circle, stated he lives across from the
� railroad tracks and they can no longer leave their windows open and talk
on the phone. He stated it seemed the noise bounces off the hills or piles
of dirt in the Comnunity Park.
Councilman Fitzpatrick felt even though sound measurements have been taken,
they could probably look at it more closely. He suggested that the League
of Cities be contacted as they provide service to the cities in this area.
MOTION by Councilman Fitzpatrick to direct staff to make a more thorough study
of this problem and seek, if need by, the help of the League of Cities and
bring back the results of the study as soon as possible. Seconded by
Councilwoman Moses-Martin.
Mr. Dick Harris, Chairman of the Planning Comnission, stated he is concerned
with the material being used as fill in the Corrmunity Park. He stated the
material looks like sludge and was worried about contaminants.
Mr. Flora, Public Works Director, stated all materials were tested by the
State and Environmental Protection Agency and they found no toxic or
hazardous materials, He stated those materials that were sensitive, such
as broken bottles, are heavily encased in claty.
Mr. Flora stated the County Environmental Officer is supervising the filling
and the State is testing the materials used along the highway.
� Mr. Harris stated where the fill is coming from is an area of an old dump site,
and he can't believe there isn't any hazardous waste caning out of there.

Councilman Barnette stated he went to Mr. Flora with the same questions
raised by Mr. Harris as some residents also had concerns, but was told
the same answers.
Mr. Harris stated along University Avenue, it is all sludge. Mr. Flora
stated it is black dirt to be used for the base of the access road to the
Co�,munity Park. —
Councilman Schneider asked Mr. Harris how he knows it is sludge. Mr. Harris
stated he has been in the construction business for 25 years and knows sludge
when he sees it. He stated he can't believe Mr. Flora is getting the
correct information.
Mayor Nee suggested Mr. Harris and Mr. Flora go out together to look at
the site.
Mr. Harris also brought up the fact that the City has a noise ordinance
which restricts the private citizens and industry to keep noise levels down,
however, he couldn't belieNe over a 90 decibel reading along the railroad tracks.
Mayor Nee pointed out the railroads are exempt by State law.
Mr. Harris also stated Burlington Northern ties up the intersections for
great lengths of time and this would make it difficuLt for emergency vehicles
fran East River Road to reach the hospital. He felt they should be contacted
to see if they would work with the City to alleviate this situation.
Mr. Luniewski stated he would appreciate being notified when the Council
receives further information regarding the noise in their area.
4 DISCUSSION OF MOORE LAKE RESTORATIO�J PROJECT BY HICKOK AND ASSOCIATES:
Mr. Flora, Public Works Director, stated bids were opened for the Moore Lake
Restoration Project and ten bids were received ranging from $175,000 to
$250,000. Mr. Flora stated the low bidder was Crossings, Inc., with a bid
of 5174,624.20.
Mr. Flora stated Hickok and Associates have been reviewing the bid items
and have been in contact with Crossings, Inc. regarding some revisions which
would reduce the amount to $144,184.20.
Mr. Boyer, representing Hickok and Associates, appeared before the Council
regaroing this project. He stated there is a whole series of phases involved
with this project and they are now considering Phase II. He explained Phase
I was the preliminary work and filing applications for the funding.
Mr. Boyer reviewed the proposal for the Harris Lake tennis court diversions
and the beach storm sewer relocation.
Mr. Boyer stated the cost is about $74,000 over the original grant application
and after reviewing the bid, it was suggested two cbanges be made which would
amount to a$30,��0 saving. The changes would be to eliminate the 30 inch
pipe from Rice Creek Boulevard to the proposed pond and a revised jacking
detail which would reduce the cost from $260 per foot to $lE0 per foot.
Mr. Boyer stated, with these changes, they would still be about $43,000 or
$44,000 over the original grant application.
Mr. Boyer felt probably another $19,000 to $20,000 could be cut in the areas
of piping for the tennis court diversion and in sod, where seed could be used
and would be less expensive. Mr. Boyer stated another saving may be in the
location of the treatment unit, if property doesn't have to be purchased for
this, and it can be located on City-ownec; property.

Mr. Boyer stated the end result is that they feel there will be no prnblem
in adhering to the original constructian costs.
Councilman Schneider asked if they are going to have the same project now
they anticipated five years ago, as far as the quality of the lake is
concerned.
Mr. Boyer stated they are making no changes from the grant application and no
changes in the philosophy, but it is piping vs. an open ditch.
Mr. Qureshi, City Manager, stated if the Council wishes to proceed with the
project, they should receive the bids and award the contract to the lowest
bidder, Crossings, Inc. in the amount of $174.624.20.

Mr. Dick Harris, Chairman of the Planning Conenission, asked where the money
comes from if there are cost overruns on the project. Mayor Nee stated part
it is from the City funds and part can be assessed to the drainage district.
Mr. Qureshi, City Manager, stated the grant received provides 75� funding
from the Federal and State governments and 25°6 is the City's contribution
which is from assessments and the City's General Fund.
Mr. Harris asked if public hearings were held since some of the cost would
be assessed to the drainage district, and the Council indicated that hearings
were held.
Mr. Harris asked Mr. Boyer how this project would improve the water quality of
Moore Lake and what effect it would have on the swimming beach. Mr. Boyer stated
with the work they are doing in Phase II, not all that much. He stated there
would be an application made for Phase III and that would be to clean-up Moore
Lake itself.
Mr. Harris asked if all they are handling now is Phase I and II. Mr. Boyer
stated Phase I was paperwork and filing of applications; Phase II is what is
happening now; and Phase III, they haven't even applied for as yet. Mr. Boyer
stated, as of now, it appears there won't be any funds for Phase III. Mr. Boyer
stated unless there are some funds the government puts into the Clean Lakes
Program, it will pretty mu di die.

Mr. Harris asked what effect this project would have on the water quality
as far as swimming and to reduce swimmer's itch. Mr. Boyer stated, at the
present time, it would be quite minimal. He stated they would be reducing
the nutrients going to the lake, but there is a lot of phosphorous in there.
Counci7man Schneider stated if the nutrient content is reduced,,it is,
indirectly, causing reduction of swimmer's itch. —
Mr. Boyer stated this project would stop ar�y future degeneration of the lake,
but it wouldn't substantially improve it.
Councilman Schneider asked if they didn't proceed, if the deterioration of
the lake would be more rapid, and Mr. Boyer stated that was correct.
MOTION by Councilman Schneider to find Crossings, Inc. the low bidder for
the Moore Lake Restoration Project and award the contract to them in the
amount of $174,624.20. Seconded by Councilwoman Moses-Martin.
Councilman Schneider stated this has been a long drawn out activity and
over the last several years, he has seen the quality of the lake diminish.
He stated he would like to see it improved, substantially, but didn't
know what the future plans would be, however, he felt this project could
help prevent the further deterioration of the lake.

r' Mr. Harris stated, contrary to popular opinion in Washington, there still
is an energy crisis. He felt, with the economy today, and where old buildings
are expanded, it is more important to have them properly insulated rather than
putting this money into landscaping. He felt this is something the Council—
will have to think about in these times of inflation to determine where the
priorities should lie.

In reviewing this problem, we initially considered placing a street midway be-
tween the 1ot splits, tying into Siverts Lane and the access road to the
future County bikeway/walkway park. Mr. Tarkiidson from the County Park Oepart-
ment indicated that this cannot be supported since the property was obtained
strictly for County park purposes with Metro funds, plus this would seriously
effect Lhe the development and security proposed for this park complex.
Constructing an access road at the south end of the properties with the cul-
de-sac in the vicinity of 1400 - 69th Avenue, will reduce the residential area
to be developed and be serviced by one s�de anly, since the County pl�ans on berm-
ing aTong the rear of all properties in question. Constructing a road along

Due to the questionable development of this area and the fact that there are
only five properties invoived, it may be prudent to require access easements

REPEAL.ING CHAPTER 506 OF THE FRIDLEY CITY CODE IN
AND ADOPTING A NEW CHAPTER 506 ENTITLED "VEHICLE
The City Council of the Ciiy of Fridley does ordain as fo�lows:
506.01. S7ATE LAW COMPLIA NCE
No person shall drive, operate or be in actual physical control
of any vehicle contrary to state law; nor shall any owner or
person having custody or control of any vehicle knowingly alTow
any other person to drive, operate or be in actual physical
control of a vehicle contrary to state law.
As used in this ordinance, the term "commercial vehicle" means
and includes a"truck" as defined in Minnesota Statutes Section
168.011 Sub�ivsion 10, a"tractor" as defined in Minnesota
Statutes Section 168.011 Suboivision 11, a"truck tractor" as
�efined in Niinnesota Statutes Section 168.011 subdivision 12, a
"trailer" as defined in Minnesota Statutes Section 168.011
Subdivision 13, a"semi-trailer" as defined in hiinnesota
Statutes Section 168.011 Subdivision 14, and a"bus" as defined
in Minnesota Statutes Section 168.011 Subdivision 9.
As used in this oroinance, the term "residential Gistrict"
means and inciudes those areas toned single family dwellir�g
ar�as, two family dwelling areas, and general multiple family
dwelling are as. (Ref. 552)
506.02. OFF PAVEh1ENT
No person shall stop, leave standing or park a vehicle whether
attended or unattended, upon the paved or improved or main
traveled portion of a highway or street when it is practical to
stop, park or leave such vehic�e off such portion of said
highway ar street. In every such event, a clear and
unobstructed width of at least fifteen feet (15 f eet) of such
highway or street opposite such standing vehicle shall be left
for the fr•ee passaye of other vehicles.
506.03. UNATTENDED VEHICLES
No person shall stop, park or ieave a vehicle unattendeG upon
such stre et or highway in the City for a period in excess of 24
hours.

506.04. SNOW REMOVAL - VIOl.ATION AND TOWING
During the winter months, commencing on the first day of
November of any year, to anG including the first day af May of
the following year, it shall be a violation for any person to
stop, park, or leave standing a vehicle on any street or
highway in such a manner as to impede the plowing and/or
re moval of any snow, ice, or waste on such street or high4ray.
Whenever it shall be found necessary to the proper direction
controi, or reguiation of traffic or for the plowing and/or
the removal of snow, ice or waste, maintenance or improvement
of any highway or street to rerrbve any vehicle standing on a
highway or street in the City, then any police officer is
autnorizeo to provide for the removal of such vehicle and have
the same removed to the nearest convenient gara9e or ather
place of saf ety. Any vehicle stopped, parked or left standing
on any highway or street in violation of law and removed as
provided herein above, may be removed upon oraer of a police
officer and the cost of removal anc; storage of the same charged
to the ewner of the vehicie, as weli as tF�e person causing such

506.05. SCHOOLS
Whenever any public school lands or the lands and areas of any
public governing body or authority customarily or usually open
to traffic by the public shall be posted by order of the school
board or other governing body or authority in control of such
lands, then it shall be unlawfui to drive or operate or stop,
leave standing and park any vehicie on such lands contrary to
such posting.

No person shall stop, stand or park a vehicle, except when
necessary to avoid conflict with other traffic or in compliance
with law or the directions of a Police Officer or
traffic-control device, in any of the foilowing places:
1. On a sidewalk;
2. In front of a public or private driveway or directiy across
theref rom in such a manner as to impede the access to said
driveway;
3. Withir+ an intersection;
4. Within 10 feet of a fire hydrant;
5. On a crosswalk;
6. Within 20 f eet of a crosswalk at an intersection or within
20 feet of a mid-block crosswalk properly marked;
7. Within 30 f eei upon the approach to any flashing beacon,
stop sign or traffic-control sic,�al located at the side of a
ro adway;
8. Between a safety zone and the adjacent curb or within 30
feet of points on the curb irt�mediately opposite the ends of a
5afety zone, unless the City has ind�cated a different length
by signs or markings;
9. Within 50 feet of the nearest rail of a railroad crossing;
10. Within 20 feet of the driveway entrance to any fire station
and on the side of a stre et opposite the entrance to any fire
station within 75 feet of said entrance when properly posted;
11. Alongside or opposite any street excavation or obstruction
when stopping, stan�ing or parking would obstruct traffic;
12. On a roadway side of any vehicle stopped or parked at the
edge or curb of a street;
13. Upon any bridge or other elevated structure upon a highway
or within a highway tunnel or underpass;
14. At any place where official signs prohibit stopping;
15. On any boulevards;

constitute in evidence a prima facie presumption that the
registered owner of such vehicle was the person who parked or
placed such vehicle at the point where and for the time during

Dear Councilmembers:
We are currently planning our fall and winter work program and would appreciate
an indication that we may be invited to conduct the 1981 audit of the City as
we have in past years.
We would perform an audit of the combined balance sheet of the City as of
December 31, 1981 and the related combined financial statements for the year
then ended. The audit would be performed in accordance with the procedures
established by the State Auditor and the American Institute of Certified Public
Accountants. These procedures are compatible with the pronouncements of the
National Council on Governmental Accounting.
The audit which we would perform would include tests, rather than a detailed
examination, of all transactions and, therefore, it should not be considered
that irregularities, if any, will necessarily be disclosed. However, they may
be disclosed as the result of one or more of our audit procedures.
As in previous years, we plan to do as much work before the year end as possible
so that we may present our report at an early date.
We have enjoyed our relationship with the City during the past years and hope
that we may be allowed to conduct the 1981 audit.

WHEREAS, There will be a General Election in the City of Fridley on
November 3, 1981, and
WHEREAS, There is a requirement to hold an election for the office of
Councilmember for Ward i for a three year term and Councilmember for Ward
IIf for a three year term.
NOW, THEREFORE, BE IT RESOLVED, That pursuant to the Charter of the City
of Fridley (Chapter 4, Section 4.02), the Council hereby provides for an

The attached resolution is for the purpose of certifying unpaid weed
cutting charges to the County for collection with the taxes dues in
the year 1982 (one installment).
Each property owner was billed, and a rer�inder was sent. The last
notice sent to each property owner stated that if the bill remained
unpaid, it would be certified to the County and that an 8% penalty
would be added. Administrative charges in the amount of 25%, or a
maximum of $10.00, was added to each bill.

The attached resolution is for ihe purpose of certifying delinquent
water and sewer accounts to the County for collection with the taxes
due in the year 1982.
All of the property owners have been notified of the fact that their
utility bills are being certified to the County, and have been given
an opportunity to pay.
The penalty shown on this resolution is in addition to the regular
penalties that accrue on utility bills.
The larger bills, for the most part, are apartment buildings and
commercial accounts.
All of the delinquent charges were certified one year ago, and if
taxes on the praperties are being paid, the City is receiving that
money. All of the charges on this resolution are for one year or
less of utility service.

We are requesting that the Council approve the resolution splitting
the special assessments on Lot 2, Block 1, Paco Industrial Park
Plat. The Council has previously approved this lot split and the
split has been recorded at Anoka County.
We are also requesting that the Council approve the splitting of
assessments on Parcels 5400 and 5850, Section 2, and replatting
into University Industrial Park Plat. The Council has previously
approved this plat and the plat has been recorded at the County.
The assessments for this plat has been divided to concur with the
request of the two owners of this plat. Attached are copies of
their request letters.

improvemente to IIniveraity Induatriel Park. As you recall, I tiras in
attendance at the public hearing to eaopt the assessment rule. At that
time, I raised eome questions regarding theae assessmente. It is nox

We have been informed by the Contractor, Bud Johnson Construction and Design
Consortium, Incorporated that all of the construction items have been com-
pleted on the Spring Brook Nature Center Buildirtg.
Siah St. Clair and Or. Boudreau have informed me that all repairs have been
made and the construction is completed.
The percentage amounts retained by the City pending completion of construction
can now be released.
Recorrn�nd the City Council authorize the final payments to Bud Johnson Cons-
truction and Design Consortium, Incorporated.
The City has the warranty and guarantee of the manufacturers and installers
for the various mechanical and performance items within the structure.
