7:30 p. m. by Mayor Nee.

OPEN FORUP1, VISIT�RS:
P+ls. Luctlle Calguire, 5780 2-1/2 Street, requested a"Watch for Children"
s7gn s�nce a lot af children play in this street and vehicles travel quite
fast. S�e stated it is ne�ghborhood veh7cles that abuse the speed limit, and
felt she had to start somewhere and perhaps the sign would slow down the
traffic.
hir. Qureshi, City �lanager, felt the stgn may be inappropriate because it is
unenforceable and may have a negative effect on what the City wishes to achieve.
He felt staff should study this question to try and come up with some other
solut�on.
MOTION by Cd�anctlman Fitzpatrick to d�rect the staff to take this problem
urderad�n s�ment, wtth a report back to the Council at some future time.
Seconded by Councilman Schnetder. Upon a voice vote, all voting aye, Mayor

Mrs. Connie Metcalf, 860 West F1oore Lake Drive, stated three neigh6orhoods
have been surveyed to begin curb side pick-up for recycling purposes. She
stated they are �ust beginn�ng the pilot project and plan to continue th�s
for six months. She stated, by the end of this period, they hope to have
a complete report on how this pro,7ect is proceedtng in the Fridley neighborhoods.
Councilman Schneider stated he wished to thank Mrs. Metcalf for all the effort
and hours she has put into this pro,7ect.
Mayor Nee stated it seems Fridley is doing so many things that other
communities are �ust now talking about and that is because of Mrs. f4etcalf's
leadership.
PUBLIC HEARING.
The public hearing on the proposed amendments to the Zoning Code will be
considered later �n the meeting, as no one from the audience wished to offer
any comments at this t�me.

2, ORDINANCE NOf 732 ESTABLISHING A NEW CHAPTER 11
Mr l�ureshi, C�ty Manager, stated several ttems have been added relatina to
fees by the Fire Department for inspecttons which come under the Un�form
Fire Code
Councilwoman Moses questioned what had been decided regarding the penalty for
late payment of licenses and permit fees.
P1r. Herrick, City Attorney, stated he discussed this matter with staff and
was advised this has been in the code for some time. He felt, while the
penalty is rather high, Ctty usually doesn't have persons not complying.

Councilman Barnette clarifi ed this noise ordinance wouldn't have anything
to do with noise caused by the Anoka County Airport, if they were to update
this facility.
Mr. Herr�ck, City Attorney, stated he would like the opportuntty to review
thts ord�nance before the second reading and adoption. He stated if he had
any questzons or comments, he would 6ring them up at the time of the second
reading of the ordinance, as he had several items whtch he had a concern with.
It was pointed out that under Section 124.05, first line, either the word "may"
or "shall" should be used, and one or the other deleted.
Councilwoman Moses stated she is still not happy with the 7 a. m. hour, but
would go along with it.

Mr. Bob Aldrich, Ftre Chief, stated what they have done in thts proposed new
ordinance is, mainly, to put in a policy statement as far as the City's goals
and ob�ectives �n managing the fire problem in the City.
P9r. Aldr�ch stated Section 108.01 is a new sectton, as well as Sect�on 108.03,
which is the basis used to collect the fees He further stated in Section
103.042 there is a change which permits more management in the enforcement
of fire extingu�shers. He stated, in thts sectton, referenceis made to the
National Fire Protection Association Standard and persons who service the
extingu�shers are completely familiar with it.
Caunctlman Schneider stated the language is deleted that requires a warm ng
sign on power switches. Mr. Al�irtch stated this �tem should remain in the
ordinance and should be added before the second reading, under Section 108.072.
The Council questioned why certain items were underlined. Mr. Herrick, City
Attorney, stated the usual procedure is to underline new material and strike
out material to be deleted.
Mayor Nee stated he had no problem with the proposed ordinance, other than
the form in which it was presented. He requested it be brou9ht back at the
next meeting in a completed and proper form.

CONSIDERATION OF FIRST READING OF AN ORDINANCE TO REPEAL OLD CHAPTERS 18

Mr. Qureshi, C��ty Manager, stated in the old ordinance, the City was using
the Minneapolis schedule system. lie stated since the State has adopted the
Uniform Building Code, almost every community follows this schedule.
Mr. Qureshi stated since the old ordinance had a lot of language relating
to the f+linneapolis code, it took a lot of re-writ��ng of the ordtnance to
bring it in line with the Uniform Buildtng Code fee schedule and requirements.
Counctlman Schneider stated, as he ftgured it, the fees would be raised
considerably, taking into account a 1,000 square foot rambler. He stated,
under the old fee schedule, the building permit would be around $34.00, and
under the new fee schedule, it would be about $283.00 He indicated he would
like to see some comparisons to see what is being done.
Mr. Qureshi, City Manager, stated there hasn't been a change in the schedule
s�nce 1977 and felt the 22% increase for overall fee schedule, since that
time, is reasanable.
Mayor Nee felt the Council would ltke to see some comparison costs and costs
involved in issuing the permits.

Mayor Nee stated he wanted to see that this ordinance, which had a fi rst
reading is available to the public for examination and comment.
Councilwoman Moses felt rn these tirnesof budget cuts, the City will have
to look more at the fee schedule and what it actually costs the City so
that the proper fees are collected, instead of ra�sing taxes. She felt
if the City isn't overcharging, she would be in favor of the fee schedule,
as a means of raising revenue, and the persons applying for the permits
covering the administrative costs.
Mr. Herrick, City Attorney, pointed out, in the past, certificates of '
occupancy haven't 6een requ�red for single family dwell�ngs so this would
be a ma,7or change.
Mayor Nee felt this ordinance should be placed on the agenda for the
Con�Ference Meeting for further discusston, before the second reading.

MOTIOrJ by Councilwoman P+loses to waive the reading and approve the ordinance
upon first reading. Seconded by Councilman Fitzpatrick.
Mayor Nee stated this ordinance changes the hours for refuse hauling from
6.30 a, m. to 8:30 p. m. to 7:00 a. m. and 9:Q0 p. m. on weekdays and
9 00 a n. and 9:00 p. m. on weekends and national holidays.
Councilwoman Moses quest�oned �f the material which is stricken would still
apply.
Mr. Flora, Publ�c Works Director, stated this was deleted becauae it was
felt the new hours in residential areas would accomplish what is neecled.
He pointed out the pick-up of refuse isn't restricted in commerr,�al and
industrtal areas so it may be appropriate to leave in the first sentence which
�ras deleted. '

should be left in the ord�nance so refuse haulin9wouldn't be a nuisance for
res�dential areas even wtth the new hours.

pointed out the insurance companies do not allow them to have rubbish on the
truck overmght.
Mr. Shutrop stated the City of Fr�dleyisriakin9 it tougher on the haulers
than �anyot.l5�:°ctties and pointed out they don't allow the garbage,onthe curb.
Mr: Shutrop stated, on hot days, they like to start early in order to be
working less in the heat of the day.
Councilwoman P�1oses asked what time their employees quit. P1r. Shutrop
stated they are usually done in six to eight hours, depending on the weather
and w�h�ther or not they have ai�y breakdowns w�th the equtpment. He stated
some days they may go over eight hours, tf they were to have a breakdown.
Counc�lwoman P4oses asked why the garbage can't be placed on the curb onthe
day �t was to be p�cked up.
P�1r. Qureshi, City Manager, stated residents have different days for their '
garbage pnck-up and a lot of complaints were received s�nce there was
always garbage on the curb.

P1r. Shutrop stated he felt they are not dealing with the issue of putting
the garbage on the curb, but the hours in which they must operate. He felt,
with the landitlls closing earlier, as they used to be open until 9 p. m,
they would like the extra half hour �n the morning as later hours are of no
value to them.
Mr. Larry Plessel, representing Pretzel Sa m tation, stated he has talked with
his customers and they are happy with the present hours and liked their rub6�sh
picked up early in the morni,ng.
� Mr. Plessel also felt it is better to get an early start in order to finish
earlie�r on the hot summer days, and extending the hours to later in the
even�ng doesa't help them at;al}.

A representative from Becker's Sanitation was also present and indicated he
concurred with the remarks made by Mr. Shutrop and Mr. Plessel.
Councilman Barnette felt their point was well-taken and the Council should
take th�s under advisement.
MOTION by Councilman Barnette to amend the motion to consider the first
reading of th�s ordinance by adding the following sentence: "Furthe�°more,
hauiin9 from commerc�al, business, industrial, or uther such establishments
shall not unreasonably tnterfere or create a nuisance for ad�acent residentlal
areas". Seconded by Councilman Fitzpatr�ck. Upon a voice vote, all voting
aye, 1layor Nee declare the motion carrted unanimously.

� RECEIVING PLANNING COMMISSION MINUTES OF JUNE 3, 1981•

Mr. Flora, Public Works Dtrector, stated this request for a special use
permit fis to allow for a second accessory building at 6535 Oakley. He
stated the owner plans to construct a 26 x 28 foot garage for storage of his
vehtcles.
Mr. Flora stated Mr Eisenzimmer was advised of the rules for any home
occupation, and the Planning Commission recommended approval of this
request wtth the following stipulations: (1) There 6e the suitable setback
requirements; and (2) The prohibition of the garage being used for a home
occupation,
Mr. Eisenzimmer stated he intends to use the garage for his oi��n vehicles and
may clo some repair on his vehicles and some woodworking, but strictly for
his own use.
Councilwoman Moses questioned the setback requirements as discussed by the
Planniny Commiss�on. Mr. Eisenzimmer stated a survey of h�s property
was presented to the Cornm�ssion.
MOTION by Cou,�cilwuttFar�Moses to concur with the recommendation of the Planning
�ommiss�on and grant special use permit, SP #81-OB, to allow construction
of a second accessory building, a 26 x 28 foot detached garage at 6535
� Oakley, with the stipulattons that the required setbacks be met and the
gar�age not be used for a home occupation. Seconded by Councilman Fitzpatr�ck.

TWO BUILDING
Mr. Flora, Public Works �irector, stated this is a request to split Lot 10,
Block 6, Fridley Park, in order to make two building sites. Mr. Flora stated
this would make over 8,OD0 square feet per lot and does conform to the code
requ�rements.
Mr. Flora stated the Planning Commission has recor,imended approval of the lot
split, w�th no stipulations.
MOTION by Counctlman Ficzpatrick to concur with the unanlmous recommenda-
t�on of the Plann�ng Commisston and grant lot split request #81-05. Seconded
by Councilwoman Moses. Upon a voice vote, all voting aye, Mayor Nee declared

Mr. Qureshi, City Manager, stated Mr. McGinley, Anoka County Administrator,
would be here shortly on this item, as he had anotherrmeeting to attend in
Coon Raptds. The Council then proceeded with the other agenda items until
Mr. McGinley's arrival.

CONTIPdUED PUBLIC HEARING TO AMEND CHAPTER 205 OF THE FRIDLEY CITY CODE KNOWN
AS THE FRIDLEV ZOPdING CODE
Mayor Nee stated there is presently an open public hearing on revisions of
tne Zoning Code and it would be his �ntent to close the hearing and refer
the matters to the Conference Meeting and then placed on the agenda for
cons�deration at the �uly 13, 1981 meeting. No persons in the audience
spoke regarding these proposed amendments.

and densities may be of interest to the public He also requested more
legible copies of the staff's comments concerning the R-1 zom ng.
Mr. Herri�k, City Attorney, felt he should attend the Conference P9eeting when
these amendments_to t�e Zon�ng Code are discussed, as he assumed at the July 13
meeting the Council wouldn't be going into a lot of detailed discussion.
Councilwoman Moses also requested the Council receive an outline of remarks
su6mitted hy Bob Hartman. P10TION by Councilwoman Moses to receive an outline

Mayor Nee stated the public hearing on the amendment tb Chapter 205 of the
Zoning Code has been continued, however, there are two other ordinances for
the Council's cons�deration on which action could be taken or tabled.
Mr. Qureshi, City Manager, felt the ordinances are rn con�unction with the
Zoning Code amendments and should be discussed at the same time.

continue the matter concerning an ordinance to amend Chapter 205 of the
Fridley City Code by adding paragraph 2D5.051, 5. Seconded by Councilman

MOTION by C�ouncilwoman Moses to discuss at the Conference Meeting and cont�nue
the matter concerning an ordinance to amend Chapter 205 of the Fridley City
Code by delet�ng Sections 205.051-3D and 205.054-2G. Seconded 6y Councllman
6arnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously.
RECEIVING ANOKA COUNTY UPDATE OF RICE CREEK BIKEWAY/IdALKWAY SYSTEM:
Mr. Ralph McGinley, Anoka County Admi m strator, appeared before the Counctl
regarding the establishment of a Citizens Task Force to assist the County
regard�ng the reg�onal tra�l through the City of Frtdley.
Mr h1cGinley stated, since the County announced the final plans for the
development of this trail, a imumber of questions have been raised.
Mr. McG�nley referred to a letter from the County, dated June 12, 1981, and
a resolut�on, which is expected to be passed by the County Board on June 16,
regarding establishment of the Task Force.

Mr, f1cGinley stated the Task Force will be charged to review and advise the
County Parks Department and Consult�ng Engineers on the citizens concerns;
to review and adv�se on the final plans of the bikeway/walkway trail; review
the plan proposed by the successful bidder in order or minimize the construction
impact, and to provide a liaison to various citizen groups.
Mr. McGinley stated the County Board looks forward to working closely with
the cit�zenst9 rece�ve their input to protect the concerns of the citizens
of Fr�dley. `
Mr. Ing Siverts, representiny the Concerned �2esidents for Environm�ntal Quality
thanked Mr. McGinley for suggest�ng this compromise and formation of the Task
Force, wh�ch they support. ,
Mr. Siverts presented a letter to the Council which contained a list of names
reconmended for appointment to the Task Force and requested that Counctlman
Barnette be appointed as a liaison to the group.
MOTION by Councilman Barnette to receive the letter submitted by Mr. Siverts

� �s WELL - WEBB PUBLISHING:
Mr. Qureshi, City Manager, stated the staff is having discussions wrth Webb
Publishing regarding installation of a well and for them to purchase water
from the City at a rate of 19.5 cents a gallon after the first 200,000 gallons.
He explained the first 200,000 gallons is charged at the normal rate.
Councilman Barnette asked tf the water would be reused. Mr. rlora, Public
Works Director, stated they will reuse it in the winter when they are able
to cool it, however, it will be lost in the summer months
Councilman Barnette asked if any pollutants would be involved in the vaater
and, Mr. Qureshi stated tt is merely used for cooltng, therefore, there
wouldn't be any pollutants.
Mr. Quresh�, City Manager, felt this would be a good arrangement as the
City would have an extra well and Webb would have more back-up then if they
had the�r o�an well.
Mayor Nee felt there should be any energy clause where the rates can be
increased.
