THE MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF APRIL 5, 1982
The Fridley City Cbuncil Meeting was called to order at 7:32 p, m, by
M�yor Nee.
PLEDGE OF ALLEGIANCE:
Mayor Nee led the Council and audience in the Pledge of Allegiance to
the F)ag.

0� REMEMBRANCE OF THE HOLOCAUST:
Mayor Nee stated he would issue a proclamation, and asked staff to
prepare it, designating the week o�' April 18 through 25 as Days of
Remembrance of the Holocaust.
PROCLAMATION - BUILDING SAFETY WEEKt APRIL 12 - 16:
A procTamation was aiso submitted for Mayor Nee's signature designating
the week of April 12 through 16 as Building Safety Week,
PRESENTATIOP� OF CERTIFICATES OF APPRECIATION:
Mayor Nee stated a lot of citizens put in time and service to the
�ommunity by serving on various citizen co�nittees. He stated the
Council is very grateful to those persons who have extended themselves
� to serve the City and, therefore, wished to present them with these
certificates of appreciation.

�layor Nee stated Dick Harris has probably put in ten or more years in
a very difficult job and had a substantial effective on how the community
developed as Chairman of the Planning Cormnission.
Mayor Nee stated Don Wa17 has served the community as a member of the
Energy Commission.
The Mayor stated 8arbara Hughes has been involved in a number of City
commissions and instrumental in the development of the first cable
television ordinance. She most recently has been a member of the
Parks and Recreation Commission.
� Mayor Nee stated Ed Hamernik was concerned with Police needs years
ago and offered to serve as a member of the Police Commission.
Since Don Hippen, Giles McConville, and Larry Chevalier were not
present at this meeting, it was requested their certificates be
forwarded to them.

OPEN FORUM, VISITORS:
Councilman Barnette stated this week Fridley has several visitors,
students and adults, from our Sister City, Fourmies, France, in and
around the City. He asked everyone who may come in contact with them
to please extend their greetings.

Mayor Nee stated this public hearing was continued from last Countil
meeting in order to give staff and Councilman Hamernik time to meet •
with the petitioners and neighborhood residents. He reopened the public
hearing at 7:45 p. m.
Councilman Hamernik stated he met with the petitioners and the residents
of the area last Thursday and discussed a number of issues that were of
concern. He stated they did get a tentative agreement on a proposal
that would allow for the development of the property with three R-1 lots
and five R-2 lots, with the understanding that the R-2 lots would be
developed with zero lot lines. He stated, at this meeting, they didn't
have an actual layout of the plan, but talked about the concept.
Mr. Qureshi, City Manager, stated there were a number of concerns from
the residents and during the discussion they were considered and minimized.
He stated the cul-de-sac is proposed to be shifted more to the East and
the R-1 lot, just North of the existing single family homes, has been
more oriented to the cul-de-sac. He further stated the proposed double
bungalow was quite a bit closer to the railroad tracks, in the original
proposal, and that has been moved to the East for a better alignment.
�1r. Qureshi stated the original proposal was to have only one single
family home and seven double bungalows. The proposal discussed at the
meeting would be to have three single family homes and five double
bungalows, with the u�derstanding that the double bungalows would be
developed as such that each side could be individually owned. Mr.
Qureshi stated to allow that type of use, the Council would have to
adopt a change in the zoning, and a variance to the setbacks would be
required.
Mr. Qureshi stated the residents wanted to make sure that the garages
on the double bungalows were attached or tuck-under, and a minimum
square footage required for the double bungalows. He suggested these
requirements be convenants on the plat, when it is approved, so it
guarantees that the present owners or any future owners meet those
standards.

Mr. Qureshi stated if the Council wishes to consider a rezoning, he wouid
suggest the rezoning and pTatting all be accomplished at the same time.
Councilman Hamernik stated they tried to save as many of the existing
trees as possible in this development, and felt this proposal does
accomplish this end.
Mr. Qureshi stated the residents were advised this proposal would be
submitted as a whole package and, unless all the conditions are complied
with, it would not be recommended for approval. He stated if there were
� to be any changes, the residents would be advised.
Mr. Wellner, the petitioner, stated he concurs with the new proposal for
development of this parcel.
Mr. �tike Larson, 6390 Starlite Blvd., stated he wished to thank the City
Manager, Mr. Qureshi, for his work in coming up with some real alternatives,
Also, he thanked Councilman Hamernik for co-chairing the meeting, and �
stated he cou7dn't speak for everyone here, but felt this proposal was a
vast improvement. He stated the residents' fear was the parcel would be
rezoned to R-2 and they wouldn't have any control over the development,
but with the new proposal, he is willing to give his own approval,
Mayor Nee felt the issue the Counc�l will now have to consider is the
matter of zero lot lines and asked if anyone in the audience had arly
problems with this proposal. There was no response fran the audience.
Councilman Hamernik thanked the residents for their patience and for
coming oat and meeting once again, and stated he felt it was a fruitful
meeting.
MOTION by Councilman Hamernik to close the public hearing. Seconded by
CounciTman Fitzpatrick. Upon a voice vote, all votingaye, Hayor Nee
� declared the motion carried unanimously and the public hearing closed
� at 7:55 p. m.
OLD BUSINESS•
,2 COP�SIDERATION OF LOT SPLIT REQUEST
t4r. Flora, Public Works Director, stated the staff has reviewed the lot
split requested, and the surrounding area and found a need for the City �
to provide access to the lois in the-rear and one of the lots wouid not
meet the minimum frontage requirenent, however, it would meet the square
footage requirement.
hir. Qureshi, City Manager, stated the plan submitted by the petitioner
for this lot split was in the Council's agenda book. He stated this
plan did not provide for access to the interior lots and creates one
substandard lot.
Mr. Flora stated the plan suggested by staff wou7d shift the line ten
feet to the West and reduce the side yard.
h1rs. �liller, the petitioner, stated she originally wanted to have two
� large lots with zero lot lines and was advised this probabiy wouldn't
be approved as the property is now R-1 and it would require a rezoning.

She stated, after talking to the surveyor, in order to have access to
her garage and access off 64 1l2, she would need more room. She stated
she understands there is a requirement for a 75 foot frontage, but
exceptions have been approved. She felt that, in the future, if the
easement becomes necessary, then it could be considered, however, the
possibility of developing that land now isn't there. Mrs. Miller also
pointed out there is park property there and wondered if this couldn't
be used for easement purposes.
Mr. Qureshi, City Maneger, stated the City usually obtains the easements
when property is platted. •
Mrs. �4iller stated, by splitting the property as she has proposed, it
eliminates driveways on East River Road because entrances would be on
64 1/2.Way.
Mayor Nee asked �irs. Etiller how moving the lines would affect her. Mrs.
Miller stated if the lines were shifted, it would encroach on the front
of her hane and she wou7dn't have enough room to enter her garage.
Councilman Fitzpatrick stated when a lot split is brought before the
Council, it usually has the easements shown on it.
Mr. Qureshi stated the proper way to handle this would really be through
a plat because the lot split does not follow any straight lines, as the
ordinance normally requires.
Councilman Fitzpatrick felt the property isn't in a form this evening �
where it could be split, and more accurate drawings should be provi�ed.
Mr. Qureshi stated it should be determined if the Council wants to split
the property or have it platted. He stated platting would require addi-
tional expense for the petitioner, however, all the easements and other
necessary right-of-ways would be shown. If Council riishes to allow a
lot split, then staff wi11 briny a map that has all the stipulations
shown on it.
Mrs. Ptiller stated a new drawing was prepared and the north/south lines
were changed and the front footage of the lots as shown. These front
footages are 138 feet, 66 feet, and the easterly lot is 64 feet.
Mayor Nee stated he felt it would be better for Mrs. Miller to have the
split for only one additiona7 lot, instead of two. Mrs. Miller felt
she should give this further consideration and discussion before making
a decision.
Councilman Fitzpatrick felt the Council needed a more definite map before
any action could be taken. He stated even if they were to agree on
something, it would be hard to describe it.
Mr, Herrick, City Attorney, suggested perhaps the Planning Department
shou]d look at zero lot lines for this particular parcel.
MOTION by Councilman Fitzpatrick to continue this request until the next
meeting on April 19, 1982. Seconded by Councilman Hamernik. Upon a
voice vote, all voting c1ye, Mayor Nee declared the motion carried unanimously.

5 ORDINANCE N0. 748 REPEALING CHAPTER 1 OF THE F,C.C. IN ITS ENTI

MOTION by Councilman Schneider to waive the second reading of Ordinance_
P�o. 748 and adopt it on the second reading and order publication, with
tthe amendments indicated in the memo from Sid Inman, City Clerk. Seconded
by Councilman Fitzpatrick.
Councilman Hamernik stated at the time of first reading of this ordinance
he had some questions, and would like to propose the following amendments
to the ordinance:
MOTION by Councilman Hamernik to change the proposed Ward 2, Precinct 1
and make it Ward 1, Precinct 5 and was proposed as Ward l, Precinct 5,
to change it to Ward 2, Precinct 1. Seconded by Councilman Barnette.
Councilman Hamernik stated he fe]t this proposed amendment would give
more continuity to the wards. He stated another reason is that it gives
improved separation by school districts. He felt, although it wasn't
ideai, it gives a]ittle better distribution and provides better c�ntinuity.
Councilman Schneider stated the reason he would favor the original proposal
is because it does follow the line drawn by the State. Councilman Hamernik
stated it is left as a precinct line so they still have the seperation.
UPON A ROLL CALL VOTE TAKEN ON THE ABOVE AMEtJDMENT, Councilman Hamernik
and Councilman Barnette voted in favor. Mayor Nee, Councilman fitzpatrick,
and Councilman Schneider voted against. Mayor Nee decTared the motion
failed by a 3 to 2 vote.
UPON A ROLL CALL VOTE 7AKEN ON THE MAIN h�TIOP�, Councilman Barnette,
Councilman Schneider, Mayor Nee and Councilman Fitzpatrick voted in
favor. Counc�ilman Hamernik voted against. �tayor Nee declared the
motion carried by a 4 to 1 vote.
M07ION by Councilman Schneider to waive the reading and approve the
ordinance upon first reading. Seconded by Councilman Fitzpatrick.

Councilman Schneider reviewed sane findings of fact covering codominium
conversions. He stated there was a public hearing on March 22, 1982
regarding the matter of condominium conversions, with appropriate legal
notice. He stated the metropolitan area, in general, and the City of
Fridley, in particular, will need a substantial number of housing units
for renters in the low and moderate income levels during the 19E0's.
Councilman Schneider stated the number of new rental housing starts in
the City has declined substantially and the City needs to have 489
additional units for low and moderate incane families in the next ten
years. He stated the vacancy rete for low and moderate income renta7
units has declined from 9.1% in 1975 to 4.9% in 1981 and a vacancy rate
of less than 5% is generally considered to be an indication that rental
units within the City are in short supply.
Councilman Schneider stated that Fridley has 3,057 rental units and
that of these, 44� are contained in five sites having a total of
1,352 units at these five sites, Councilman Schneider pointed out
that if any one or more of the large apartment complexes were to convert
to condominium ownership, that conversion would have a very substantial
effect on availability of renta] units for low and moderate income people.
He stated residents, who are presently renting low and moderate income
units, have testified as to the shortage of rental units within the City.
Findings of Fact Conclusions of Law which was presented by Councilman
Schneider are as follows: .
FIWDINGS OF FACT
1. That the City of Fridley, Anoka County. Minnesota is a home
rule city.
2: That the City held a public hearing on htarch 22, 1982 at
7:30 P.hi. on "An Ordinance Establishing a t�ew Chapter 217 of tha Fridley
Code, entitled, "Conversion Condominium" and Repealing Present Chapter 217."
3. That notice of said hearing was given by publication in the
legal newspaper on March 3 and 10, 1982.
4. That the �tinneapolis-St. Paul metropolitan area, in general,
and the City of Fridley, in particular, will need a substantial number of
housing units for renters in the low and moderate income levels during the
1980's.
5. That the number of new rental housing starts in the City has
declined substantially; the number for the past four yea n is as follows:

CONCLUSIONS QF �AW

said shortaye of low and moderate rental units.
3. That the City of Fridley hereby adopts the attached
ordinance which prohibits the conversion of rental units to condominium
ownership for a period of eighteen (18) months.
That during said eighteen months, the City will attempt to
determine means of alleviating said shortage of renta] units and adopt
reasonable conditions for condominium conversions so as to lessen an
adverse impact on the availabi7ity of rentalunits for low and moderate
�ncome renters. "
Counci]man Schneider stated the conc7usion is that there presently exists
v�ithir+ the City a significant shortage of suitable rental units available
to low and moderate incane individuals or families and that the conversions
of any substantial number of these rental units to condominium ownership
would increase the shortage.
Councilman Schneider stated, with the first reading of this ordinance,
a moratorium is proposed which prohibits the conversion of rental units
to condominium ownership for a period of 18 months, and during this time,
the City will attempt to determine means of alleviating the shortage of
rental units and adopt reasonable conditions for condominium conversions
so as to lessen an adverse impact on the availability of rental units
for low and moderate income renters.
Councilman Hamernik stated he appreciated the findings of fact submitted
by Councilman Schneider, however, he felt Fridley has done very we11 in
providing rentals for low and moderate income persons and, therefore, it
shouldn't be stated that Fridley isn't carrying its load.
Councilman Hamernik stated he thought the Councii has to be concerned
about the welfare of the people renting the units, but also to consider
the long-range impact on housing units and rental property in general.
Councilman Hamernik stated he doesn't disagree with the need to further
evaluate this situation, but is concerned about putting the 18 month
moratorium on condaninium conversions. He feit, if they want a moratorium,
it should be for a shorter period of. time no Tonger than � year and perhaps
for only nine months. Councilman Hamernik felt the exist�nc�ofamora�orium
may have an impact on deveTopers obtaining financing and that potential
lenders would consider this as limiting their options.
Councilman Schneider stated he would have no objections to a 12 month
moratorium and would agree they should expedite the study.
MOTION by Councilman Hamernik to amend the above ordinance by changing the
Tength of the moratorium from 18 months to 12 months. Seconded by Councilman
Schneiuer. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously.

Mr. Jack Horner, representing the �linnesota Multi-Ho�sing Association,
appeared before the Council regarding this proposed moratorium on condanium
conversions.
Mir, Horner stated he has a great deal of fear in a condominium moratorium
and, as far as he can tell from reading the documentation, the Council is
dealing with a situation that hasn't been a prob�em so far. He pointed
out there haven'�:been any significant condominium conversions in Fridley.
Mr. Honer stated the persons who are displaced by condominium conversion "
have protection under the law. He felt if the concer� here is that people
will be displaced, they eventually will be anyhow if an owner converts to
condominiums. He stated in studies done by the t;niversity of Flinnesota
and HUD, it shows that 70% to 80% of the persons who are displaced by
condaninium conversion, end up better off than before they were displaced.
Mr. Honer stated he felt that condominium conversion creates a policy to
cure problems that might arise in the future. He stated no one wi17 invest
in housing developments in Fridley if this moratorium were to pass, He
stated it is often advantageous to build a unit for rental and then concert
it at some later period of time, and investors won't invest where there is
a risk.
F1r. Horner stated a 5% vacancy is an ideal range so this is not a crisis
situation. He felt this vacancy rate can't be compared with 1975, when
there was about a 9% vacancy rate, because there was an oversupply of
renta] units during this time. -
He stated there are pro�ections made that there will be a need for more
housiny, but one thing about those projections, they always project they
need more housing. Mr. Horner stated the on]y value judgment he saw was
there was a relative abundance of.units for low and moderate income persons
in Fridley.
He stated the law states the Council must make a finding there is a
shortage of low and moderate income housing and not an overabundance.
Mr. Horner felt the moratorium shouldn't be adopted, but to study the
needs without a moratorium.
Councilman Schneider stated, without the moratorium, the residents of
these rental units wouldn't have any protection on condominium conversions.
He stated h1r. Norner's comments about the housing projections not being
accurate is very interesting and he will remember this in the future.
Councilman Barnette stated this gets into the problem of what role the
government should play in private enterprise. He stated they have pla�yed
a role in awarding building permits to the owners of the rental units to
provide rental housing and now when it serves the owner's interests to
come back to change the use to condominiums, he felt this was benefitial
to the owner, but not in the interests of the renters. He felt the City
does �eed further study in this area and the moratorium is probably a
good decision.

Mr. Flora, Public Works Director, stated Mr. Perozzi applied for a
special use permit in 1979 which was approved by ihe Planning Commission
and City Counci7, however, no work was started or any extension applied
for and the permit has now expir.ed. Mr. Flora stated, therefore, Mr.
Perozzi has made another request for a special use permit for building
on his property.
Mr. Flora stated the Appeals Cormnission reviewed this request and granted

with the stipulation that the City staff oversee the proposed drainage

Mr: Boardman stated there are three Nousing & Redevelopment Authority redevelop-
ment districts in the City--the Center City Redevelapment District, the Moore
Lake Redevelopment District, and the North Area Redevelopment District. What
the City is attempting to do is establish a district similar to other special
districts that have been established in the City that will allow the development
of these redevelopment districts�by plan. Any development within a special
district or any property that is zoned an S-2 district would require a pian to
be presented to the Planning Commission and City Council. The purpose of this
special zoning district is to:
1. Allow mixed use development aithin special redevelopmeni districts.
Right now there is no zone, other than a PUD (planned unit develo,pment)
zone,which requires 20 acres for development. There is no special zone
that allows mixed use.
2. Allow the maximum flexibility in ihe promotion of the district.
Redevelopment districts ar� very difficult to develop and sometimes
there are a lot of special conditions in order to promote and get
a development.
3. Allow development by plan which is acceptable and in the best interest
of the City and overall district and development plan.
Mr. Boardman stated the process by which they would go through approval of an
S District is similar to the process they are following tonight. They would look
at what property they would want to rezone as an S-District, and then that
property would be.submitted on a rezoning process. The �lanning Commission and
City Councii would have the opport�nity to review any zoning issue and the
property-owners within 350 ft, would be notified. After that rezoning, the
Pianning Commission and City Council would be able to respond on particular plan
and plan elements in that zone.
Mr. Boardman stated that included in the plan would be all site plans showing the
location of buildings, off-street parking, street and utility locations, access to
and from the project, grading plans, storm water plans, and landscape plans. These
would come to the Planning Commission and City Council, along with a written staff
review and a report from the NRA on any special conditions or considerations.
Mr. Boardman stated they are referring to this as the "redeve7opment district
ordinance" that would a]low them to establish with special consideration in those
districts that are presently redevelopment zones or those districts that have the
potential of becoming future redevelopment districts.
Mr. Oquist stated the ordinance "atlows for the mixed use development�within
special redevelopment districts". How do they contro] ihat mixed use? Are they
going to put any limitations on the kinds of things they are going to allow in
an S-2 district3 .
Mr. Boardman stated the city attorney has reviewed this ordinance, and he felt
they were pretty weli covered. The ordinance states that the uses permitted are
"those uses which are acceptable to the overall redeve7opment plan and specific
development plans as approved by the City". It also states that it excludes uses

unecceptable to the overali development plan as determined by the City. So, it
does give the Planning Carmission and City Council fuil contral on the types of
uses that wili be al]owed within that p1an. It is a planned unit development
and is not a zoning issue. They are rezoning by plan because they wan� the flexi-
bility that is not built into the.normal zoning code. That flexibi7ity is a
mixed use type of deve7opment.
Mr. Saba asked what happens five years from now when someone gaes in and buys a
building and then wants to convert that building for a different use. Would the
City go through the approval process at that leve7, because it is aiready Zoned
a special district?
Mr. Oquist stated there needs to be some boundaries on the ordinance under "Uses
Permitted".
Mr. 8oardman stated that was a very good point, and there sFiould be some change
in the language. He stated he would work out some new wording.
Mr. Oquist stated he felt the ordinance shou7d be recommended for approval, with
the wording change, because it does give the City the capability of classifying
areas.
Mr. George Meissner, 373 Mississippi St. N.E., stated he was also concerned about
the section on "uses permitted". which states: "Those uses which are acceptable
to the overal] redevelopment plan and specific development plans as approved by
the City." Ffe stated the statement does seem very vague. Ne did not know how
the City was ever going to determine what uses were acceptable or were not
acceptable, if they were ever put to a real test on what would or would not be
permitted. He stated if Staff can get that clarified adequately, he would be
satisfied.
Mr. Boardman stated that what is meant in that statement is that,in the approval
of the plan, if they approve a shopping center, that is a shopping center use
and not each individual use within the building itself. Then each of the individua7
uses within the shopping center must comp7y with the shopping center use. He
stated he will be adding some wording to the effect that, "each individual use
must comply with the overall use (such as a shopping center)".
Mr. Meissner stated the concept sounds good as presented; he just hoped it works
out as well as it sounds. _

Mr. Boardman stated that at this point in time, the HRA is going to be hTring a
landscape architect by competition. That 7andscape architect will do the detailed
design for the area with conceptual designs and tie it through the who7e district.
In order to be cons�stent with the area, they are 7ooking at rezoning this area,
because it currently consists of 5-6 zones. The City is requesting the rezoning
of this area to S-2 to allow them the flexibility to develop this concept. When
actual detailed plans are available, they wi�l be submitted to the Planning
Commission and City Council for approval.
Mr. Boardman stated that in the next 3-4 weeks, they will also be hiring a traffic
designer who will be looking at the whole traffic design. �
Mr. Boardman stated the Fridiey State 8ank has requested they not be included in
the S-2 District.
Mr. Don Savelkoul, 6315 University Ave. N.E., stated he.is the attorney for
Fridley State Bank and the owner of the property. When they heard of this
rezoning request, they met with Mr. Boardman and Mr. Qureshi, the City Manager.
The Board then met, and they advised the City that they did not want to be a part
of the S-2 District. He stated they have no opposition to the district or to the
plan� but at this particular point, they do not want in any way to be included in
the district. They have been in their location since 1962. They have 12,000
depositors and 50 employees. He s�ated they are in a very competitive industry.
Over the past 20 years they have had to expand twice--they have had to revamp
the parking lot and their drive-in facil�ties, and probably will have to do it
again. He stated their traffic pattern requires every inch of ground they have.
7hey would have complete confusion if they had to integrate the bank property
with the parking lot for the clinic. Their responsibility as a banking institution
is to operate effectively and competitively. They want to handle their own traffic
the way they want to hand?e it. They will be happy to meet with the City and
Mr. Boardman on any car�mon problems, but they would very much appreciate it if
the Planning Commission would exclude the bank property from this rezoning request.
Mr. Haggerty stated he agreed with Mr. Savelkoul about the bank property being
excluded. Mr. Hag9erty stated he represented ali the private owners of the building
north of City Hall, and he is also the developer of the office building. He
stated that from their perspective, the type of zoning being proposed and which
is used in a number of other cities for redevelopment purposes is rea]ly the oniy
way to go. He stated it makes sense to exclude the bank Property , because it
is not realiy going to be redeveloped as such, while all the other land included
is going to be redeveloped. He stated the new zoning could save a lot of time
and possibly some legal problems in the development of, not on7y the office
building, but also the clinic.

lot split with Mrs. Miller this week. She is not de-
compliance frontage lots and an easement along the
7he most recent plan is to split off two lots, one paralleling East River
Road and a sixty-six foot lot (see Option A).
Option 6 satisfies the City Code by providing an eighty foot frontage corner
lot paralleling East River Road, and a seventy-five foot lot adjacent to it.
This leaves an eighty-four foot lot with the existing building on it and pro-
vides for a thirty foot street and utility easement for future access to the
large properties to the south. Access to the existing garage could be pro-
vided by establishing a joint driveway easement along the split property line,
or by converting the existing garage to home use and constructing a new garage
behind the exi.sting house serviced off 642 Way.
This lot spiit requested by.Mrs. Mi11er is essentially a replatting of the pro-
perties. Normally, a piat would have to be surveyed, presented to the Planning
Commission and to the City Council for approval prior to recording. At this
time, all easements, street, utility and drainage, would be required to be
identified. Mrs. Miller's request to split off her property is a simple means
of circumventing our platting ordinance.
Regardless of what the finai��configuration of the split lots is, if a lot split
is approved by the City Councii, consideration should be given to establishing
a larger corner lot off East River Road because of the traffic and congestion
associated with the highway; and in addition, a street and utility easement
should be obtained for future development and support of the larger properties
to the south. Deferral in obtaining this easement would only result in future
costs to the City and the residents in this area for right-of-way purchase.
In addition, the existing six foot utility and drainage easements running
through the property will have to be vacated if a iot spiit is approved.
Mrs. Miller should understand that a vacation request must be submitted upon
lot split approval.

7he Planning Commission, at their March 10, 1982 meeting, made a recommendation to the
City Council for approval of L.S. #82-03 subject to a check on suitable raad easement
for East River Raad across the eastern part of Lot 26, Auditor's Subdivision No. 23 Rev.
We have checked with Anoka County to get an indication on the East River Road easement
affecting this property. We have found that the County does in fact have a road easement

In determining fair market value of public areas for land subdivision for
cash payment, as required by Ordinance 633, the following values will be used:
Residential subdivision
$1,000.00 per iot
Residential lot sp7it � 500.00 per lot
Commercial/Industrial subdivision or lot splits � 0.015 per sq. ft.
This fee is to be paid at the time of final plat or lot split approval. The
City Council may �efer callection to the time a buil�ing permit is requested

Tt�e City Camcil of the City of Fridley cleens that there exists in the City a
signiffcant ehortage of suitable rental dwellings available. to low and
moderate income individuals or families. Therefore, it is in the best
interest of the City to impose tenporary restrictions on the conversion of
- �isting r�tal miltiple awellings to a cordanini�an form of o�wnership.
217.02 DEFINIT�OIiS
As used in this Ordinance the terms defined shall have the meanings ascribed
to them.
1. 'Conaomini�mn' means a multiple dwelling in which portions are designatec]
fot separate ownership and the renafnder of which is 3esignatea for coamion
ownershig solely by the arners of these portions. A multiple dwelling`is not
a condaniniwn �mless the imdivided interests in the oommn elenerits are vested
in the �mit owners.
2. •Conversion Condominium' means a multiple dwelling which has been
convertec7 from res�tal units to ownership units in acoordance with the Uniform
Conc3ominiwn Act (CH. 582 - 1980 sessio�). y
3. 'Dwelling IInit' means a single �mit praviding carq�lete indepen3ent living
facilities for one or more persons includ�ng pecmanent provisions for living,
sleeping. eatinq. 000kin9 and sanitation.
4. "Multiple.Dwelling• means any building or structure containing therein tw�o
or more dwellu�g units whether used solely or exclusively for residential

5. 'Existing Multiple Dwelling' means any multiple dwelling existing at the
effective date of this ordinance.
6. "Owner" means the person or body hav�'c�g an interest in a multiple dwelling

Mr. Boardman stated the property is located on East River Road and Mississippi St.
That is the area where there is a gas station, the #] Health Club, and a vacant
property to the north. The present zoning is C-]5.
Mr. Boardman stated when the #1 Health Club came in, it was Staff's determination
that a health club was allowed in a C-1S zone. After the building was up and
operating, it came to the City's attention that there was another operation going
on, other than the health club, and that operation was a massage. He stated-a
massage parlour is not atlowed in a C-1S zone.
Mr. Boardman stated since that time, the City Council has passed an ordinance called
a"Sauna License Ordinance" which restricts a massage parlour in a C-1S zone and
aliows it only in a C-2S zone. At this time, Mr. Schroer is making an application
for a rezoning of that particular area to C-2S.
Mr. Boardman stated there are three properties involved--Tract B, Tract C, and
Tract D. Tract B is the vacant property. Tract C is the #1 �1ea7th C]ub, and
Tract D is the gas station. Tract D is also a non-conforming use because a gas
station is not allowed in a C-7S zone, although it has been in that operation
for quite some time. 6lhen the gas station was built, it was an allowed use, but
with the changes in the code, it has been grandfathered in and exists as a legal
non-conforming use.
Mr. Boardman stated Mr. Schroer owns Tract B and Tract C, and the owner of Tract D
(gas station) is in agreement to the C-2S zoning which is being proposed at this
time. Staff fee]s if they are going to rezone two of the properties, they should
rezone all three at one time to make the area consistent.
Ms. Gabel asked what would happen to the massage parlour operation if this
rezoning request was denied.
Mr. Boardman stated they would not be able to operate a massage parlour in that
location. A health ciub operation would be allowed, but not a massage parlour.
He stated the City allowed a health club with the idea it was going to be a health
club, but the use was changed after the building was purchased by cantract for
deed from Mr. Schroer and renovated.
Ms. Schnabel asked Mr. Schroer if he had a written agreement from the owner of
Tract 0(gas station) that the owner is in agreement with this rezoning request.
Mr. Schroer stated the owner of,�ract D is in agreement with the rezoning, but
he did not have a letter of agreement.
Ms. Schnabel stated she felt that from a legal standpoint as far as the City is
concerned, they should have that proof of agreement. If the Planning Commission
approves this rezoning request, one of the stipulations should be that a letter
be on file.

Mr. Bill Sledz, 321 University Ave, S.E., stated he currently has a purchase agree-
ment on Tract B. He stated he is buying Tract B for the purpose of putting in a
garage or just to enhance and protect the property they own behind it (the 144-
apartment complex - 6540 East River Road). They would also have purchased Tract C
if they had moved a little faster, but they learned a health club was going in there,
and a health club was fine with them. He stated it was his understanding that the
gas station would not be affected if the zoning did not change because of the
grandfather clause.
Mr. Sledz stated that if this operation is going to exist in this 7ocation, they
would like to see it return to a health club and not a massage parlour. Tfiey do
have a purchase agreement on Tract 6 that is binding and can be exercised, and for all
practical purposes, they are just waiting for title. If the owners of the health
club bought the building from Mr. Schroer and it was Mr. Schroer's understanding
that it was going to be a health club, he felt those people should abide by that
and not change their operation. He stated he has an investment in his property,
and if Tract C ever became available, he would be interested in purchasing it.
Ms. Schnabel stated she had a problem in that she cou7d not recall where the City
has rezoned a property to make it consistent with the use of the property, usually
the property has to be consistent with the zoning.
Mr. Boardman stated it has been done in situations where they are making non-
conforming uses into conforming uses. If nothing else, he would recommend the gas
station be rezoned to C-2S because the gas station is allowed in C-2S. He stated
� he also has a problem with a rezoning in a situation like this where a property
was developed under a C-1S zone for a specific use and then that use, whether right
or wrong, has changed. He did not feel the Planning Comnission was necessari7y
obligated to rezone just because a use is there that was created illegally.
Mr. Schroer stated the City had determined the zoning was right for a health club,
but when the operation was changed to a massage parlour, there was no zoning for
a massage parlour, and there was no one in the City who knew they needed a new
license for a massage parlour. The point he wanted to make was that the operation
did not have to fit into a C-1S or a C-2S zone at that time, because no zoning
existed for it.
Mr. Boardman stated this is an interesting situation. The way the code was set up,
there was no zone that sa3d a health club was allowed or a massage parlour was
allowed. When the healih club came in on this site, Staff made the determination
that a health club was a local business and, therefore, would be allowed in a
C-1S zone. A massage parlour is no� necessarily a local business. The codes were
very vague and left it to the discretion of City Staff to decide what was allowed
or what was not allowed. At that point in time, Staff did allow a health club,
He thought that if a massage parlour fiad been proposed on t�is s�te, there would
have been some discretion as to the type of zoning where it would be a7loa�ed. At
that time, a massage par7our would not have been a7lowed in a loca7 business zone.

Ms. Gabel stated the fact was that Staff had made the determination to allow a
health club, regardless of whether there was any zoning at that time that allowed
a massage parlour. What they have now is after the fact when they are being asked
to change the zoning to meet the need when it is normally done the other way
around. She stated she had a real problem in doing that. She stated she was
not interested in changing the zoning of the gas station as=there isn't really a
need for it. It can exist there as a legal non-conforming use. If the owner of
that property wants to have an official rezoning, that person can make the request.
She felt that in some ways, Staff was mislead in seeing this as a health club
anci it turned out different7y, and she did not see that a�s a reason to change the
zoning.
Mr, Saba stated he agreed with Ms, Gabe1.
Ms. van Dan stated she also agreed with Ms. Gabe7. There was also the fact that
neither �hc: owners of the health c7ub or the gas station were present at this
meeting to speak their wishes, and she did not think the Planning Commission
should recommend any changes unless they were present.

Mr. Boardman stated this is an application for a special use permit for a nursery/
Christ►nas tree lot located in Menards' parking lot. In 1978, a permi� was issued
to Menards for a garden-type use in the parking 7ot for a one year period of time.
At that time, the City Councit suggested that if there were ever any more requests
for this type of use, it was not to be located in the parking iot. He thought
discussions at that time with Menards was that any use should be a7ong the
building itself as it would be a more appropriate place than in the parking lot
area.
Mr. Kondrick asked why the City Council felt it was not a good idea to put any
future garden areas in the parking lot.
Mr. Boardman stated they have a]ways tried not to increase �hese temporary types
of uses that are not well maintained, that are put up temporarily and are not a
year-around facility. By putting it in the parking 7ot, there is no possibi]ity
of any landscaping or screening to make it more attractive, other than the plants
that are brought in and sold.
Mr. Mark Haggerty stated he is the attorney representing Nob1e Nursery, Inc. Ne
stated Mr. Henry Sandbulte and Mr. Leo VanderBroek, principles of Noble Nursery, Inc.
are also in the audience. He stated Noble Nursery's primary ]ocation is just north
of Fridley in Blaine on Highway 65, and that is where they would maintain most of
their inv�entory. �
Mr. Haggerty stated he would like to give the Comnission a litt7e background on
how this came about. When Noble Nursery, Inc., entered into the 7ease agreement
with all the Menards in the Twin Cities area, they were told there would not be
any probiems. There was money paid t'or that arrangement. He stated they did not
realize there were any problems or any restrictions until after the lease arrange-
ment was signed. They a7so did not know about the previous one year special use
permit.
Mr. Haggerty stated he has talked to Mr. Boardman and the neighbors who live
behind Menards. He stated he hoped to reach a compromise that would be workab7e
for everyone. One of the objections is the traffic flow and the size of the
nursery area, and that is why they have designated a 50' x 75' area. Nob]e
Nursery, Inc., is intending to put a nice wooden fence around the area, and there
will be a very small portab7e wooden A-frame shelter in case of bad weather.
They will try to make the area as attractive as possib7e. Ne stated if the Commission
members wished to drive by Noble Nursery in 6laine, they wouid find it is a very
atLractive operation. They would keep the bulk of their stock at the main nursery.
They would primariiy have display trees and for people who wanted to make big
orders, they would take delivery at their Blaine operation. That was pari of the
compromise when they discovered there might be a problem. The operation would
only run from whenever the City Counci] approved the request until the end of

Mr. Haggerty stated Mr. Boardman had mentioned the problems with temporary uses.
He stated the point that should be looked at in a situation like this is that
the only time they can sell this type of nursery stock is ear7y in the year, and
presumably the people who are buying the nursery stock live witE�in the City of
Fridley and are beautifying the City of Fridley in their yards. He felt there
was a residual benefit to the City of Fridley and to the citizens of Fridley by
having this conveniently located in Menards'parking loi.
Mr. Haggerty stated that, as far as location, they would prefer to have the
location they have proposed (southwest corner of the parking lotj, but they are
willing to work with any stipulations the Planning Commission and City Council
might make. They will keep the area as small as possible and will clean up the
area after they are done. He stated Menards has indicated they do not want them
located next to the fenced area, because Menards feels there could be more of a
traffic flow problem in that area. _
Mr. Leo VanderBroek, 11861.Flintwood Ave., stated it would be a very nice, attrac-
tive operation. There will actually be two structures, the A-frame she7ter, and
a greenhouse-type structure to protect the bedding plants in case of freezing
weather.

Mr. Boardman stated there are three Housing & Redevelopment Authority r.edevelop-
ment districts in the City--the Center City Redeveiopment District, the Moore
Lake Redevelopment District, and the North Area Redevelopment District. What
the City is attempting to do is establish a district similar to other special
districts that have been established in the City that will allow the development
of these redevelopment districts�by plan. Any development within a special
district or any property that is zoned an S-2 district would require a plan to
be presented to the Planning Commission and City Council. 7he purpose of this
special zoning district is to:
1. Allow mixed use development within special redevelopment districts.
Right now there is no zone, other than a PUD (p7anned unit development)
zone,which requires 20 acres for development. There is no special zone
that allows mixed use.
2. Allow the maximum flexibility in the promotion of the district.
Redevelopment districts are very difficult to develop and sometimes
there are a lot of specia7 conditions in order to promote and get
a development.
3. AlTow development by plan which is acceptab7e and in the best interest
of the City and overall district and development plan.
Mr. Boardman stated the process by which they would go through approval of an
S District is similar to the process they are following tonight. They would look
at what property they would want to rezone as an S-District, and then that
property would be,submitted on a rezoning process. The Planning Commission and
City Council would have the opportunity to review any zoning issue and the
property•owners within 350 ft. would be notified. After that rezoning, the
Planning Commission and City Council would be abie to respond on particu7ar plan
and plan elements in that zone.
Mr. Boardman stated that included in the plan would be all site plans showing the
location of buildings, off-street parking, street and utility 7ocations, access to
and from the project, grading plans, storm water plans, and landscape plans. These
would come to the Planning Commission and City Council, along with a written staff
review and a report from the HRA on any special conditions or considerations.
Mr. Boardman stated they are referring to this as the "redevelopment district
ordinance" that would a]low them to establish with special consideration in those
districts that are presently redevelopment zones or those districts that have the
potential of becoming future redevelopment districts.
Mr. Oquist stated the ordinance�"al7ows for the mixed use development within
special redevelopment districts". How do they control that mixed use? Are they
going to put any limitations on the kinds of things they are going to allow in
an S-2 District?
Mr, Boardman stated the city attorney has reviewed this ordinance, and he felt
they were pretty weli covered. The ordinance states that the uses permitted are
"those uses wtrich are acceptab7e to the overall redevelopment plan and specific
development plans as approved by the City". It also states that it excludes uses

unacceptable to the overall development plan as determined by the City. So, it
does give the Planning Comnission and City Council full control on the types of
uses that will be allowed within that plan. It is a p]anned unit development
and is not a zoning issue. They are rezoning by plan because they want the flexi-
bility that is not built into the normal zoning code. That flexibi7ity is a
mixed use type of deveiopment.
Mr. Saba asked what happens five years from now when someone goes in and buys a
bui]ding and then wants to convert that building for a different use. Would the
City go through the approval process at that leve7, because it is already zoned
a special district? "
Mr. Oquist stated there needs to be some boundaries on the ordinance under "Uses
Permitted".
Mr. Boardman stated that was a very good point, and there sfibuld be some change
in the language, He stated he wou]d work out some new wording.
Mr. Oquist stated he felt the ordinance should be recommended for approval, with
the wording change, because it does give the City the capabi]ity of classifying
areas.
Mr. George Meissner, 373 Mississippi St. N.E., stated he was also concerned about
the section on "uses permitted", which states: "Those uses which are acceptable
to the overall redevelopment plan and specific development plans as approved by
the City." He stated the statement does seem very vague. Ne did not know how
the City was ever going to determine what uses were acceptab]e or were not
acceptab]e, if they were ever put to a real test on what would or would not be
permitted. He stated if Staff can get that clarified adequately, he wouid be
satisfied.
Mr. Boardman stated that what is meant in that statement is that,in the approval
of the plan, if they approve a shopping center, that is a shopping center use
and not each individual use within the building itself. Then each of the individual
uses within the shopping center must comply with the shopping center use. He
stated he will be adding some wording to the effect that, "each individual use
must comply with the overall use (such as a shopping center)".
Mr. Meissner stated the concept sounds good as presented; he just hoped it works
out as well as it sounds.

Mr. Boardman stated that since ]978, they have had a Center City Redevelopment
District. which includes Holly Center, the property across from Holly Center,
10,000 Auto Parts, all the way down to 61st Ave. With these properties, it is
the City's intent to develop a Center City cohesive development. They developed
a six-stage deveTopment program within the district. This went through public
hearings in 1978, and the district was approved and set up by the City Council.
Mr. Soardman stated that since 1978, they have worked on several developrr�nts.
They tried to pull in an office building north of City Hal] which did not work.
They tried a retail development across from Holly Center which did not work. One
reason is that the financing has been very difficult. At this point, they are
putting a proposal together south of City Hail for a 28,OOQ sq. ft. medica]
clinic facility with a possible expansion by 1986 of an additional 28,000 sq. ft.,
and also a 30,000 sq. ft. office_building.
Mr. Boardman stated it is their intent with this development to narrow 64th Ave.
from 40 ft, ta 26 ft, for circulation, do some landscaping, and create a public
plaza development. That public plaza development with the landscaping will be
cons�stent throughout the area and will start the developmeni of their theme
throughout the entire Center City area.

Mr. Boardman stated that at this point in time, the HRA is going to be hTring a
landscape architect by competition. That ]andscape architect will do the detai]ed
design for the area with conceptual designs and tie it through the whole district.
In order to be consistent with the area, they are looking at rezoning this area,
because it currently consists of 5-6 zones. The City is requesting the rezoning
of this area to S-2 to allow them the flexibility to develop this concept. When
actual detailed plans are available, they will be submitted to the Planning
Commission and City Council for approval.
Mr. Boardman stated that in the next 3-4 weeks, they will also be hiring a traffic
designer who will be looking at the whole traffic design.
Mr. Boardman stated the Fridley State Bank has requested they not be included in
the S-2 District.
Mr. Don Savelkoul, 6315 University Ave. N.E., stated he is the attorney for
Fridley State 8ank and the owner of the property. When they heard of this
rezoning request, they met with Mr. Boardman and Mr. Qureshi, the City Manager.
The Board then met, and they advised the City that they did not want to be a part
of the S-2 District. He stated they have no opposition to the district or to the
plan, but at this particular point, they do not want in any way to be included in
the district. They have been in their location since 1962. They have 12,000
depositors and 50 employees. He sxated they are in a very competitive industry.
Over the past 20 years they have had to expand twice--they have had to revamp
the parking lot and their drive-in facilities, and probably will have to do it
again. He stated their traffic pattern requires every inch of ground they have.
They would have complete confusion if they had to integrate the bank property
with the parking lot for the clinic. Their responsibility as a banking institution
is to operate effectively and competitively. They want to hand]e their own traffic
the way they want to handle it. They will be happy to meet with the City and
Mr. Boardman on a�y common problems, but they would very much appreciate it if
the Planning Commission would exclude the bank property from this rezoning request.
Mr. Haggerty stated he agreed with Mr. Savelkoul about the bank property being
excluded. Mr. Haggerty stated he represented all the private owners of the building
north of City Hall, and he is also the developer of the office building. He
stated that from their perspective, the type of zoning being proposed and which
is used in a number of other cities for redevelopment purposes is really the only
way to go. He stated it makes sense to exclude the bank property � because it
i"s not really going to be redeveloped as such, while all the other land included
is going to be redeve7oped. He stated the new zoning could save a lot of time
and possibly some legal problems in the deve7opment of, not on7y the office
building, but also the clinic.

We advertised and opened the bids for Street Improvement Project
No. St. 1982-10 (Sealcoating) on Apri1 13, 1982 at 11:00 a.m. at the
Civic Center. Six bidders had shown interest in the project. We re-
ceived four bids. The lowest bid was submitted by Allied Black Top
of Osseo, Minnesota for $62,210.68. This is the same company that did
the sealcoating project for the City last year.
ACTIONI INFO.
The current project consists of sealcoating approximately eight miles
of streets. Included, are the portions shared with Columbia Heights on
53rd and 45th Avenues. Colunbia Heights will be opening their bids
next month, at which time we will award those streets to be sealcoated
by the lowest bidder.
Recommend that the City Council receive the bids for St. 1982-10 and
award the contract to Allied Black Top.

On April 14, 1982 at 11:00 a.m., the City of Fridley's Public Works Depart-
. ment opened bids for a new 1982 Chassis-Mounted Pothole Patcher. Three com-
panies bid--RGS Industries, Inc., MacQueen Equipment, Inc. and Stepp Manu —
facturing Company, Inc. The bid included optional equipment consisting of a
sanding attachment and side board brackets.

Of the three companies bidding, only RGS Industries bid the unit that met the
City specifications, with the Thermo-Lay Model TM375-200 and the optional
equipment for a total bid of $23,142.15. The pothole patcher unit was included
in the 1982 Public Works Capital Outlay Budget.
To improve the pothole patching operations, I recommend that the City of Fridley
purchase the 1982 Chassis-Mounted Pothole Patcher and optional equipment from
RGS Industries for a total cost of $23,142.15.

ACTION I INFO•
The State Legislature passed a bill dealing with surface water management
in the metropolitan area, this past season. This bill requires establish-
ment of surface water management districts within the entire metropolitan
area by December 31, 1983s or directs the County to do so. The bill pro-
vides guidance in how the districts can be organized; what the plan should
consist of; how the plan is staffed, reviewed, approved and amended; and
how the costs are to be levied or bonded.
The Metropolitan Council is preparing to adopt its own storm water manage-
ment plan which accelerates the formation of watersheds, establishes more
Metropolitan Council control over plan preparation, review, amendment and
organization, and calls for an increased levy limit to support centraliied
storm water planning, administration, publicity and construction.
It appears that,the Metropolitan Council's proposal results in increased
costs to the taxpayer, expecially to those who have already established a
watershed district, and extends State Law to provide greater Council police
power.

I have proposed a resolution objecting to the plan and supporting the exist-
ing law. _
Recommend the City Council`consider the attached resolution for submittal
prior to this April 29th Metropolitan Council Pubiic Nearing on the draft
