OOUNCIL MEETII ' AiIGUST 2, 1982 PAGE 2 Mr. Qureshi, City Manager, stated the total budget is $7,099,459 which is a 4.4$ increase aver the 1982 budget, and includes the General Funds and other Special Func]s. Mr. Qureshi stated the total General Fund budget, or operating budget for the City degartiaents, is $6,307,659 and represents a 3.9$ increase over the 1982 budget. Mr. Qureshi stated the budget includes $280,000 in revenue sharing funds to be used in the areas of City Management, Police, Fire, Naturalist, and Parks and Recreation. Mr. Qureshi stated it is anticipated there will be a sizeable decrease in revenues from Fec3eral and State funding and that is the reason a very tight, balanced budget is suxnitted. He stated it is estimated there will be a 20.7$ decrease in State grants and aids, and only $140,000 is anticipated in revenue sharing funds, and the balance for this account is being drawn fran the reserves. Councilman Schneider asked if the increases take into account the inflation rate. Mr. Qureshi stated if the inf lation is higher than the percentage increases, there would be an actual reduction in the capability to provide these services. Councilman Schneider stated the bargaining employees haven't reached a contract and asked if there are adequate provisions in the budget for any kind of settlement they might reach. Mr. Qureshi stated they have provided what is hoped would be the cost for these services, however, if oosts are higher, they have a number of choices. Ae stated the choices would be reduction of employees or cutbacks in other areas. Mayor Nee stated the budget is a very difficult task for the administration as it has to be preparec7 so far in advance of knawing what the actual revenues received will be, but it is required in the Charter that the budget be submited at this ti.me and is the official start of the budget review process until the final adoption in October. Mayor Nee asked if there was an estimate on what the mill rate would be. Mr. Qureshi stated it is difficult to project, but the estimated mill levy would be around 14.4 mills. Ae stated last year the Council adopted a mill rate of 14.9 and, at least, a 1/2 mill decrease is projected. He pointed out this is a very preliminary estimate as they have no information fran the County at this point in time. No persons ir, the audience spoke regarding this proposed 1983 buclget. Generally located at 5600 4th Street N.E. Any and all persons desiring to be heard shall be given an opportunity _ at the above stated time and place. - Publish: July 28, 1982 August 4, 1982 WILLIAM J. NEE MAYOR 1 oTE FROM SUBJECT DtRECTORATE OF puBc woRcs August 11, 1982 iW : SAV #82-02 Citv Council TO lA MEMO R A N D UM ACTfONI INFO• S& R Investment Company is requesting the vacation of approximately 6524 square feet of street right-of-way adjacent to Lots 13, 14 and 15, Block 4, Hamilton's Addition to Mechanicsville, to allow the construction of a 4-plex. Two setback variances are required to set the structure on the property. The Appeals Commission and Planning Comnission recorrmend approval of the front yard setback variance f rom 35 feet to 30 feet, and a side yard setback variance from 35.#eet to align with the structure on the East side of 4th Street, but not less than16.25 feet. The Comnissionsalso identified the fallowing variance stipulations: 1. The petitioner work with the City on the landscape plan. 2. Screen the refuse containers. 3. Stripe the outside parking stalls. 4. The City retain a 10 ft. boulevard easement along the service drive. The peitioner is desirous to start construction this surroner. Accordingly they have requested the City Council to allow them to obtain a building permit prior to the final publication of the Vacation Ordinance. If the City Council desires, we could issue a building permit after the first reading of the Vacation'Ordinance. JGF/de c 1 L PLANNING COMMISSION MEETING, JULY 14, 1982 PAGE 2 - - ____ isting garage being converted into living space and requested at both ga es.be used ns garage space. The petitioner had stated he had no problem with lowing the existing garage to remain a garage. This then required his coming for a special use permit, because the code doesn't allow second accessory ructures of 200 sq. ft. without a special use permit. Mr. Boardman s ed the petitioner is requesting a special use permit for the construction of a w garage and to allow the existing garage to remain a garage. He stated Staff has problems with this request. He felt it was appropriate since this house is at e end of the street and the setback variance in front was granted by the Appea Corrnission. The petitioner, Mr. James Cro stated this was the only location they had on the lot to build an additional age, and they really need the storage space. The only alternative would be to s e their vehicles in the yard or on the street. AlOTION BY J►2. KONDRICK, SECONDED BY AIR. SP l/B2-08 9Y JAMES X. CROSS. (Appeals Commission recomnended approval of variance on June 29, 1982) Mr. Boardman stated this property is ]ocated on 4th Street where the service drive connects intc 57th Ave. It is a corner property. He stated the State originally had control of the right-of-way all along the service drive, but the State recently turned al] that property over to the City of Frid]ey. The City of Fridley does not need the property so at the request of the petitioner, Staff is recommending this property be turned over to the property owner, but that the City maintain a 10 ft. boulevard easement. PLANNING COMMISSION MEETING, JULY 14, 1982 PAGE 3 Mr. 8oar-dman stated the proposal is for n 2-levet, 4-plex with tuck-under garages. This proposal went ta the Appeals Commission on June 29 for approval of two variances--a front yard seiback from 35 ft. -0 30 ft. and a sideyard setback from 35 ft, to 25 ft. Both variances were approved by the Appeals Comnission and are t ng submitted to City Counci7. Mr. Boardman stated it was Staff's recommendation to approve the vacation and turn the property back to the property owner to make a more usab]e ]ot. Ms. Gabel stated the Appeals Comnission has approved variances before for the development of this piece of property; but because of financing falling through and other things happening, no development has taken place. She felt that if there is now someone who can do something with that lot, it would be a good thing for the City. MOTION BY 1KR. SVANDA SECONDED SY XR. REVIEW OF SECOND DRAFT OF PROP4SED ORDINANCE TO REPLACE CHAPTER 21] L 7TING BY CHAPTER 2, SUBDIVISION: Mr. Boardman stated the Planning Commission is not required to take any actifln on anything other than Section 205 of the City Code; however, Staff did want to bring this to the Planning Commission for their review and comments priar to its going to the City Co uuil on August 16. Mr. 8oardman stated the Platting Ordinance is controlled sorewhat by Minnesota State Statutes on platting. There were some changes that were recommended by the State Statutes, and with those in mind, Staff went through the platting ordinance. He stated Staff is in the process of going through all the codes. the platting ordinace being one of those ordinances. Whi1e they were making modifications according to the state law and modifications according to the zero 1ot line, they went through the rest of the ordinance and tried to clean up the language so it was easier to read and easier to clarify what a subdivision is. They are saying a subdivision is any platting of land, any registered land survey. or any iot split. He stated that in the old ordinance, there was a lot of con- fusion in the language, so they tried to set it up in an order where they first have some related definitions, and, secondly, have a lay-out of what a subdivision is and ueer what condit:ons are required to follow this ordinance as far as a subdivision. Mr. Boardman stated that before. any time anyane split a parcel of land that was under 2 acres, that person was required to go through a platting process. According to state 1aw, that has been changed to 5 acres on any commerial/ industrial property and 20 acres or larger on any residential property. 4A PLANNING COMMISSION MEETING, AUGUST 4, 1982 __ PAGE 2 Ms. Schnabel stated that under "Lot Split" on page 211-05, she oticed the elimiation of the notification of adjacent neighbors. It seemed ta fier that a lot sp]it sometimes fias a very great impact on adjacent neighbors. Mr. Boardman stated that under state 1aw, a pub]ic hearing is not required for a lot sp]it. Ms. Schnabel stated she thought there should be notification on a lot split for the neighbors' protection. Mr. Boardman stated if a lot split doesn't meet City Code, it requires a variance, and a variance requires notification. But if the lot split meets all the qualifi- cations of the City Code, then the question is why should a lot split affect the neighbors and why should there be a notification to the residents? Ms. Schnabel stated she thought with a lot split they double the neighborhood density on that particular parcel of tand, ad it happens unbeknownst to the existing neighbors. She just felt that notification to the neighbors would be the proper thing to do. Mr. Svanda stated that in laoking at the timing of the platting process, they are looking at a minimum of six months to go through the process. He felt that process was too long. ,,_ Mr. Boardman stated state ]aw allows them 120 days to go through the process. Mr. Svanda stated he would just like to see that process little shorter, just to speed it up for the project propoer wh typically has a lot at stake. He felt that the more time you allow, the more time you take. Ms. Schnabel noted that under "Application" on page 211-08, no fee was mentioned. Was there a plat filing fee? Mr. Boardman stated there is a fee. He stated he would check into that and be sure that it is stated somewhere in the ordinance. ' '.' Mr. Boardman stated there are some modifications being done rigfi t now to the Platting Ordinance. He stated they have gone through and relooked at the Qro- visions that have all been crossed out in this draft. The reason they re7ooked at the provisions was because none of these provisions are in the state code, and these provisions are things the City of Fridley requires. He states some of these provisions will be put back in; however, they did leave out "alleys" as they are not trying to promote ateys. DISCUSSION OF VIRGIL HERRICK'S MEMORANOUM ON SPECIAL US_E PERMIVARIANCES Xn nrnurun neunrr_ -- - - Ms. Schnabel stated one of the key statements in Mr. Herrick's memo of Aug. 2, 1979, that the Planning Commission must remember when they are recomnending approval or denial of a special use permit was on page 3, bottom of page: "Where zoning ordinance expressly authorizes a proposed use by special use permit in the discretion of the governing mody of a municipality, a denial of the permit must be for reasons related to public health, safety, and general wefare." Ms. Schnabel highlighted the fo]lowing statements from Mr. Herrick's memo: Page 4-"In short, a denial would be arbitrary, if it ts established that all of the standards specified by the ordinance as a condition to granting the permit have been met." "Where a special use permit is issued subject to conditions, the conditions must conform to the following standards: '.,.to protect the public fiealth, safety, convenience and welfare, or o avoid traffic congestion or hazard. or other dangers, or to promote conformity of a proposed use with the character of the adjoining property and uses, and the district as a whole, or to protect such character.' Section 205.196." Page 5•"The applicant for a special use permit fias the burden of proving that the proposed use would meet the standards required by the ordinance for issuance of a special use permit." Page 6-"Failure of governing body to record contemporaneously the facts and legally sufficient reasons for its denial f special use per- mits constitutes a prima facie showing of arbitrariness in the denial." Under II. Yariance: Page 8-"The applicant fias the burden of proving undue hardship due to unique circumstances and that the granting of a variance will be in keeping with the spirit and intent of the zoning ordinance. The Court of tylka v. City of Crystal. supra, noted that an appli- cant for a variance has a much heavier burden of proof than an app]icant for a special use permit." Under III. "A rezoning is confiscatory where it results tn the tnking of a private property right for a public purpose Mithout due process and without compensation.M Page 12 -"Rezonings. therefore, have been challenged on the groud that property areas tn the area affected invested in their property in reliance upon its then existing zoning as well as upon the zoning classification in force in neighboring properties or in neighbor- ing areas. and that a rezoning which changes that zoning depreciates the value of the land and is unconstitutional as confiscatory. There is, however. no merit to this contention." 3. RECEIVE JULY 20, 1982, APPEALS COMMISSION MINUTES: JIOTION BY KS. CABEL, SECONDED BY MR. He stated he has been told that the City of Fridley does not have zero ld lines for 4-unit buildings. Ms. Gabel stated that was correct; however, the City is in the process right now of drawing up a townhome or that type of zoning, but they don't have it at this time. Mr. Wiggin stated he has been developing land and building in the Twin Cities, mostly in Richfield, 6]oomington, Burnsville, and for the last 15 years in Shakopee. He stated he was on an ad hoc committee that helped design a zero lot line. He thought it was going to be the coming thing, because the big problem the last 5-10 years is there have been very few apartment buildings built because there are only 4-unit mortgages. He stated the money has somewhat determined the building. Mr. Wiggin stated this will be a 4-unit building, 3 bedrooms in each unit, with tuck-under garages. Each unit will have a 2-car garage with 2 parking stalls in front of the garage, for a total of 16 parking stalls. Mr. & Mrs. Andrew Veres submitted a petition to the Appea7s Comnission. Ms. Gabel read the petition into the record: ~ "Petition to stop the consideration of a variance request pursuant to Chapter 205 of the Fridley City Code t reduce the front yard setback on a corner lot from the required 35 feet to 30 feet, and the sideyard setback on a corner lot from the required 35 feet to 16.25 feet, at 5600 - 4th St, N.E., Fridley" Ms. Gabel stated there were two identical petitions--one with four signatures and one with two siynatures. MOTION BY MR.PLEMEL, SECONDED BY 1yR. BARNA, TO RECEIVE THE PETITION. UPON A VOICE VOTE, ALL VOTING AYE CHAZRPERSON GABEL DECLARED TXE MOTION CARRIED UNANIMOUSLY. Mr. Veres stated it was the neighbors' concern that a]1 the houses, including the 4-plex be even, so they did not want the variance approved for the front yard setback from 3 feet to 30 feet. Ms. Gabel explained that the proposal is to leave the 4-plex in line with the houses, and that was the reason for the variance to 30 ft. All the houses along the block are 30 ft. from the street, and the 4-plex would then be consistent with the houses. M 4G APPEALS COMMISSION MEETING, JUpE 29,]982 PAGE 4 Mrs. Veres stated the neighbors would have no objection to the building as long as it was even with the houses, as that was their only major concern. She stated they are in favor of the building because the area as it is now is an eyesore. 1IOTION EY MR. BARNA, SECONDED BY MR. PI.MEL, TO CLOSE THE PUBLIC HEARZNG. He stated he thought the building would be a nice addition to the area. He did not think the variance to the south would cause any visibility problem as it is lined up with the building across the street. Mr. Barna stated both variances seem to be what the neighbors want, and he did not see any objection from the neighbors. MOTION BY JNR. BARNA, SECONDED BY MR.
