Re: Aearing on Zmprovements
Street Improvement Project ST. 1983-1
Dear Mayor Nee:
Anoka County has received Exhibit A notifying us of an improvement
that is being contemplated for 66th Avenue, including grading, sta-
bilized base, hot-mix bituminous mat, concrete curb and gutter, side-
walks, storm sewer system, water and sanitary sewer services and
other facilities.
In reviewing these improvements on 66th Avenue we find that there
is no benefit to park property on Rice Creek that fronts Central
Avenue. In talking with your special assessment people they have
informed us that we could be assessed approximately $1,5U0 for this
project.
We would ask that you enter into the record at the hearing on February
7, 1983, Anoka County Park Department's objection to this assessment.
Again, the reason for our objection is that we can find no benefit
whatsoever to the park land. We would ask that we are informed of
any and all actions to be taken by the City of Fridley after the
hearing. Thank you for your consideration in this matter.
Sincerely,
!e?/",.

205.041-2 The City adapts the UBC in chapter 206 and by state
statute and the UBC criteria. it is the most restric-
tive standard which can be imposed. -Recommend no change.
205.043-2 Limits the upgrading of nonconforming structures to 500
of its value. This is in the existing code. -Recomnend
no change.
205.044-5&6 Sidewalks and Bikeway shelf easements were added by the
Planning Commission to the Draft. This formalized our
planning. -Recommend no change.
205.047 Payment for environmental testing is the same as in
the existing code. -Recommend no change.
205.076 50 Landscaping and tree replacement issue.
1. A landscape definition is being added "The improve-
ment of land by the addition of berms, trees, shrubs,
ground cover, crushed rock, wood chips, retaining walls,
and other functional, ornamental or decorative features."
2. This paragraph is removed from R-1 and R-2 districts.
3. In all other districts this paragraph is changed to
read: "It shall be the owners responsibility to see that
all re u_ired_ landscaping is maintained in an attractive,
well e-Tc pt condition:••".
205.076-66 Sidewalk cleaning should be the responsibility of the

not specifically speak to this issue since 1969, it
Certainly can be enforced now. This paragraph defines
the responsibility. -Recommend no change.

205.135-4E(2) This paragraph in all cormercial ad industrial
districts is changed to read: "No closer than five (5)
feet from any side lot line except for a conmon drive
approved by the adjoining property owners and the City."
205.135-4H The parking spaces have been changed in all commercial
and industrial districts from 50 to OQ vehicle requiring
interior landscaping.
205.136-2 This paragraph in all districts is changed to read:
"All open areas of any site. except for areas used for
parking, driveways or storage shall be landscaped...and
be incorporated in a landscape plan."
205.137-4G{1) The term M1 and M2 are replaced
205.183-4D with the word Industrial district.
The attachment pertaining to the industrial bildigs constructeo by Mr.
Paschke provides the percent of lot coverage and a comparison of existing
parking to the speculative criteria of 1 parking space for every 450
square feet of building.
If the above items are acceptable, I will incorporate them into the Draft
Zoning Code and present it to the City Council at the February 28th

MEMOAANDUM I
John G Flora TO ACTION INFO•
Dairy Queen Yariance Wasim M. Qureshi, City Manager
The Dairy Queen operation on University and Mississippi Street is requesting
five variances in order to construct a drive-thru window. The plans worked
out with the owner improves the tlississippi area by elimination of driveways
and increased landscaping.
The Appeals Comnission has recoended approval of the variance with one
stipulation "that a Do Not Enter sign be place upon the driveway at the
drive-thru." While the variance from the requirement for concrete curbing
was discussed, it was not included in their recommendation; they also
informed the petitioner that the request would be heard by the City Council
on February 7, 1983.
The owner indicates he is aware of the future development plans for this area
but feels that this construction cost would be justified within the next
two years. Accordingly, the City Council may want to consider a stipulation
pertaining to the future acquisition of this property.

B. STITED HAADSHIP:
"fde need the variances to provide a drive-thru xindow onto our building."
C. DliIiISTRATIVE STIIFF AEPIEY:
Staff bas met with the petitioner on aeveral occaion to work out a mutually
agreeable plan for conatructing a drivt-thru vindow onto the exiating Dairy
Queen Dusinea and bas tried to minimise the needed variance for thia
contruction.
The northvet driveay entrance will bt cloed to vehicle trsts'ic, ao all
vehicles vill enter the property trom the two eastern driveway. Locating the
drive-thru Vindow on the rrest side of the Duilding vill enhance trafi'ic tlox to

toot landcaped area vil be provided aouth of the north sidexalk and vill run
the width of tDe property. Temporary concrete Dlocks or concrete curbing vill be
used in lieu of the required 6 ineh high poured concrete curbing. Tbe
petitioner is aware that tbia property ia located in the Center City
Redevelopment District and the property may be purclased by the HRA in the
llture. Nowever, tbe petitioner feels s drive-thru vindox will increase the
Duaines Dy about 30 percent and can utify any contruction and Code
compliance costs by thia expected increase in aales over tDe nezt two yeara.
The Dusiness also ha to remain competitive rith aimilar operationa.
Mr. Clark said the code calls for 10'X20' stall size and that 9' X 18' is the
generally accepted national standard whicF the City has not adopted. He said
the sideyard from 30 ft. to 0 ft. is along the Westerly 6oundary where the drive-
thru windaw will be located, right on the 1ot line and it is that way now.
He said parking on the south line could be moved further south to make better
access for tbe drive coming off the east side. Mr. Barna asked if the stall size
was going to cfiange and Mr. Clark said it will be sforter. Mr. Fitch said their
stall size right now is 9' X 18' and has 6een tfat way for five years.
Ms. Gabel asked about wfiere tfie curb rolis up and Mr. Fitch felt that would actually
hlp them as it is an automatic barrier. He said they will 6e parking there so
nobody can come from the parking lot to the area and the driveway in the front
will be blocked off.

Appeals Commission Meeting - January 18, 1983 Page 3
•
Ms. Gabel a6out the num6er of parking stalls in the 6ack and Mr. Clark said
there would six parking stalls. Ms. Gabel asked if the shed was going to stay
and Mr. Fitch said it would stay as it is a storage sed. Ms. Gabel felt the
driveway was a little narrow and Mr. Clark said it is adequate for one-way
traffic. Ms. 6abe1 noted at some of te parking never seems to be utilized
while there is usually a traffic jam in te other parking area.
Ms. Gabel felt there should be some kind of barriers up and Mr. Fitch said they
will be planting shrubs and bushes across the full front of the lot and they
will be using landscaping timbers as borders with rock to maintain the shrubs
and bushes and 8" blocks as 6arriers.
Ms. Gabel said there is a lot of traffic in the summer and asked how long Mr.
Fitch thought a car would wait in the drive-thru. Mr. Fitch said they thought
this would help unclog the area by trying to get people to flow out the rear
driveway which would help that corner and that all of the parking would move
to the back. He said they figured that 50 percent of teir business would go
through the drive-thru. Ms. Gabel asked how wide the entrance driveway is and
Mr. Clark said it is 30 ft. wide. Mr. Fitch said someone could still pull into
the lot if there are cars in the drive-thru. Ms. Gabel asked about costs and
Mr. Fitch said tey could get the whole thing done for a6out 4,000 and that
they are minimizing their costs in view of what may happen in the area in the
next couple of years. Mr. Barna asked why they needed narrower stalls and Mr.
Fitch said they are narrower to maintain the num6er of stalls needed and the
existing stalls are 9 ft. He said they wuuld lack one stall if they expanded to 10 ft.
and they will 6e putting in a handicapped stall by the driveway which will be an
$ ft. stall. Ms. Gabel noted they will just meet the parking need if they are
granted the variance. Mr. Fitch said with 18 ft. there is still room for people
to drive through. Mr. Fitch said they hope to have this done by the time they
open the first of March.
Mr. Betzold said it seems inevitable that someone will bump into someone else.
Mr. Fitch said they have never had an accident in the 20 years they have been
there. Mr. Betzold asked about the lighting. Mr. Fitch said they have security
lighting over the 6ack door. Ms. Gabel said traffic has always been a problem
there and what a6out making an "entrance only" and an "exit only." Mr. Clark
suggested tiat tley try this first and if it is a problem they could make it
strictly an entrance (north) and exit (south. Mr, Fitch said usually people
cut across tfe top and go out the otber side and they will not be able to do
that anymore and tfese changes will keep people going at a proper flow and
they plan to put up tbe "one way, do not enter" signs. He also said the lot
is more like 155 ft. long. He further stated that they are not going to put •
up a speaker system, which runs a bout $3,500, as they don't know how the drive-
thru is going to work yet. if things go well and there is redevelopment in the
area then tfey will put up a speaker system. He felt this drive-thru would in-
crease 6usiness enough in the next two years to pay for the investment.

Mrs. Gerou felt the plans were well thought out with everything taken into
consideration. Mr. Betzold said the only thing that bothered him were the
narrow parking stalls. Mr. Barna said he had no problems with the changes and
that closing off the driveway on Mississippi Street would be an improvement.
Ms. Gabel said she could see their need to do this to compete with other busi-
nesses and there is a large demand for drive-thrus and this may also be a way
to facilitate traffic and free up the corner and that the petitioner fully
understands that there may be redevelopment in the future. Mr. Betzold felt
there should be a stpulation a6out the signs for the drive-thru.
MOTION by Mrs. Gerou, seconded by Mr. Barna, that the Appeals Commission recommend
to the City Council, through the Planning Comnission, approval of the variance
request to reduce the parking setback from the required 5 feet to 0 feet;
reduce the sideyard set back from the required 30 feet to 14 feet, and reduce
the parking stall size from the required 10 feet by 20 feet to 9 feet by 18 feet,
located on the Easterly 75.1 feet of the North Half of vacated 64 - 1/2 Avenue N.E.,
and the Northerly 125 feet of Lot 3, Block 1, Sylvan Hills Plat 5, the same
being 280 Mississippi Street N.E., Fridley, Minnesota, 55432, with the stipulation
that a"Do Not Enter" sign shall be placed upon the driveway for the drive-thru.

PARKS b RECREATION COMMISSION MEETING, JANUARY 24, 1983 PAGE 4
b. Recor.mendation - 1983 Diseased Tree Program
Dr. Boudreau stated it is again time to look at the Diseased Tree Program.
He stated last year the program was somewhat reduced with the hoMeowners
paying for the removal of diseased trees on their property and the City
was not being reimbursed from the State for the tree removal program.
Dr. Boudreau stated that on June 30, 1982, the City received a letter
from the Dept, of Agriculture stating the Shade Tree Program has bpen
eliminated by the Minnesota Legislature. He stated a decision was needed
for the Parks b Recreation Department for the year 1983 as far as providing
a shade tree program according to the City's local ordinance. By ordinance,
the City must provide a program, stating the homeowner will bear the cost
of removal of trees on the homeowner's property and the City will bear 50%
of the cost of removal of trees on the boulevard. Onpublic lands, the
City removes the trees at City expense.
Dr. Boudreau stated that in reviewing the total program last year, monies
spent were 41,746. Out of that, they took in 14,800 and certified for
payment on the taxes 516,100 for a total of 30,900. The program had a
direct cost to the City of close to $11000. In view of the ecnomic times
and since there is no reimbursement program from the State, he felt it
would be prudent for the City to eliminate or cutback its shade tree program
for 1983, yet try to encourage the citizenry to be aware there is still a
problem and to try to make it a voluntary program in the City of Fridley.
When people have problems with their trees, they can ca11 the Citv, and
the tree inspector will go out and advise them on possible actions. On public
lands, the City should try to remove what they can in-house with their
own personnel.
Mr. Young stated that from what he has seen and read, no amount of money
is going to stop Dutch Elm disease, and this is probably money that is just
being wasted. He would rather see the money spent in some other areas
that better benefits the citizens of Fridley or even in reforestation
within the community.
NOTIDN BY MS. SEEGER, SECONDED BY MR. YOUNG, TO RECOMMEND TO CITY COUNCIL
THAT THE Z983 DISEASED TREE PROGRAM BE REPEALED, BUT TD CONTINUE TO PROVIDF.
A TREE INSPECTOR WHO WDULD BE ON CALL FOR INSPECT7017S AND TO HAVE A PUBLIC
R£LATIONS PROGRAH TO ENCOURAGE VOLUNTARY PARTICIPATIDl IN THE REIIOVAL OF
DISEASED TREES AND TNE REPLANTING OF THOSE TI2EES.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KONDRZCK DECLARED TXE
NOTION CARRIED UNANIMOUSLY.
e. Request - Fridley Park Aquatic Swim Club
Or. Boudreau stated the Fridley Park Aquatic Swim Club is asking for
support from the City for its swim club in the form of advertisinq. He
stated he did not think the City wished to get into paid advertising
for programs as the City sends out its own programning brochures.
