Congress declared a national policy of providing fair housing throughout the United
States; and
WHEREAS, this laa makes discrimination Dased on race, sex, color� religion, or
national origin illegal in conneetion xith the sale or rental of housing; and
WHEREAS, the ANOKA COUNTY BOARD OF REALTORSR is a signatory to the Voluntary
Affirmative Marketing Agreement, a contraet �ith the Department Housing and Urban
Development, to implement Title VIII of the Civil Rights Act of 1968; and
WHEREAS, the ANOKA COUNTY BOARD OF REALTORSRand
RESOURCE BOARD are committed to a joint effort

We have been requested by the Anoka County Community Housing Resource Board and the
Anoka County Board of Reaitors to pass the �ttached proclamation declaring April as
the "Fair Housing Month".
These two organizations will be sponsoring programs during this month of April in
an effort to inform the public and prevent discriminating housing practices in
Anoka County. As a part of this program they are requesting all cities in the County
to take part in this proclamation.

for Street Improvement Project 1983-1 & 2.
Fourteen firms were interested in the project. Seven bids were
received ranging from �246,000 to $283,000.
The low bidder, Hardrives, Inc. from Maple Grove, had the low bid for
$246,206.70.
Recommend the City Council recieve the bids and award the contract for
Street Improvement Project ST 1983-1 � 2 to Hardrives, I�c.

The existing moratorium on condominium conversions expires Ma�• 14, 1983.
Either a new ordinance further extending the moratorium or a previousl��
existing ordinance requiring registration of conversion should be enacted.
It appears the council does not wish to extend the moratorium. For t}�is
reason, I have prepared the attached ordinance requiring registration of
condominiums. The ordinance contains provisions that will facilitate en-
forcement of State law and ensure protection of City's and resident's
interests. A fee for registration is required to cover the cost of
administering. The Ordinance should be in effect by May 14, 1983.

The Couneil of the City of Fridley deems that it is in the interest of the
health, sa�'ety and general welfare of the residents of the City that oWner(s)
of a multiple dwelling intending to convert to condominium units, register
that intent xith the City before such a conversion is initiated.
217 • 02. Dffi�IAITIONS
For the purposes of this chapter, except xhere the context indicates
otherrrise� the folloWing Words mean:
1. Condominium: A multiple dWelling in which portions are designated for
separate o�nership and the remainder of �hich is designated for common
or�nership solely by the or+ners of those portions. A multiple drrelling is not
a condominium unless the undivide� interests in the common elements are
vested in the unit orrners.
2. �?nversion Condominium: A multiple dWelling r+hich has been converted from
rental units to ownership units in accordance With the Uniform Condominium
Act. (M.S.515A)
3. Conversion Notice: A written notice of intent to convert a multiple
dWelling to a eondominium Which is given to the existing occupants of the
multiple dwelling by the oWner of the dWelling.
4. Declaration: A legal doc�ent required by State La�r that constitutes the
creation of a condominfum by the recording of in the county in Which the
condominium is located.
5. pisclosure Statement: A document required by State Lax that fully
discloses information such as declaration, by-laWS, etc. �+hich is intended to
protect the rights of purchasers of condominium units.
6. ��aellina Unit: A single unit providing complete independent living
facilities for one or more persons including permanent provisions for living,
sleeping, eating, cooking and sanitation.
7. Nulti�le DrrellinQ: A building or portion thereof designed for occupancy
bq families living independently of each other.
8. OWner: The person or body having an interest in a multiple dwelling.as a
fee or+ner or subordinate interest With the right to exercise control and
management of the premises.

Registration shall be required of any o�ner of a multiple dWelling located
within the City of Fridley Who intends to convert such building to
condominiums. At least 60 days prior to the conversion notice given to the
tenants, the owner of a multiple dvelling shall file With the City a
registration form, provided Dy the City, and pay the appropriate registration
fee.

The registration fee shall be provided in Chapter 11 of this code. This
section does not exempt any eWners association from obtaining the annual
condominium license as set forth in Chapter 220 of the Fridley City Code.

1. Description of ground areas by street address and legal description.
2. The number of dWelling units and size of the building.
3. The number of stories and height in feet/meters.
4. Total floor area of the building.
5. Information on existing water, gas and elecric metering and seWer
charges.
6. Amount of any remaining special assessments.
7. Floor plans pursuant to M.S. 515.2-110.
8. Site plan draWn to scale showing: Lot, buildings, off-street parking and
landscaping.
9. Disclosure statement (including declaration and by-lar�s).
10. Letter of notification to tenants.
11. The name and address of the individual to Which any notice or order
regarding the premises may be served or given during the conversion.
12. Title (and name, if possible) of contact person of Association.
13. Number of 1oW-and-moderate income households affected by the conversion.

xithin the City a significant shortage of suitable rental dWellings available
to lo�-and-moderate income individuals or families or to establish or

On March 22, 1983, at 1:30 p.m. in the Civic Center, we opened bids
for the Construction of the Center City Plaza and tandscaping.
55 firms were interested in the pr�ect. We recieved 11 bids for the
Construction portion and 12 for the Landscaping.
After reveiwing the base bids and including the necessary additions,
_ Noble Nursery is the low bidder for the Landscape planting at $43,891.
� Recommend the City Council receive the bids and award the contract to
'i Noble Nursery for the landscape planting.

SUBJECT: RESOLUTION AUTNORIZING CHANGES IN APPROPRIATIONS FOR THE
GENERAL FUND AND THE SPECIAL REVENUE FUNDS FOR 1982

The first four changes in the Dudget are for special revenue funds. This is
a requirement of the generally accepted accounting principles for budgeting
special revenue funds. It has been the practice in the past to wait until
the end of the year when expenditures are determined for budgeting special
revenue funds. These funds are not considered during the normal budgeting
process. An explanation follows:
1. REVENUE SHARING FUNO
In 1982, we budgeted $255,000 for both revenues and expenditures for the
Revenue Sharing Fund. This year we began charging minor personnel expenses
for the administration of that fund, which is allowed by law, in the amount
of $171. This amount was not budgeted, therefore, in order to show a
favorable balance, we are requesting an increase in the appropriations of
�171 and an increase in the estimated revenue from surplus in the amount
of $171.
2. HOMEOWNERSHIP FUND
The Home Ownership Fund is used as a clearing account for Home Ownership
expenditures for the HRA. We do not set up budgetary authority until the
end of the year, after we have determined what expenditures had taken placP.
Therefore, we are requesting authorization to set up an expenditure of
�374 in the Nome Ownership Fund 8 and the source of revenue is S374 from
the HRA for services rendered.
3. CABLE TELEVISION
41ith the mid-year creation of the Cable TV Fund, it missed the normal
budget cycle, we would, therefore, like to set up appropriated 352enditures
totaling �87,900. The detail is 535,000 for personal services, 000 for
supplies and S900 for capital outlay. Additionally, we wou1d like to have
the Cauncil approve setting up revenues in the amount of $87,900 with
$3,000 from accrued interest and the remainder of g84,900 from licenses
and fees.

4. GENERAL FUND
Planniny
Planning has been historically used as a holding account for expenditures
for the HRA. Each year at year end when we know the actual expenditures, we
bill HRA and adjust the appropriations and expenditures for Planning in the
General Fund. Therefore, we are requesting that the appropriations be
set up for Plannin9 in the amount of 535,000 and the source of revenue is
from the Emergency Reserve. In the future, HRA will no longer be carried
in the General Fund as to better clarify ���A expenditures.

Our legal expenditures exceeded the budget by 517,500. In reviewing these
legal expenditures� the excess charges are based on work for the Hassage
Parlors for 510,000, the Osieczanek case for $2,500, and work done on the
new DWI law in excess of 55,000. We are asking, therefore, that an
appropriation of 517,500 be allocated fro� Emergency Reserves.

ACQUISITION OF EASEMENT ON 5TH STREET FROM BANREIN, INC.
�
Banrein, Inc. is a corporation which owns the facilities where the Fridley
State Bank is housed. I met with Don Savelkoul and Bill Beery of the
Fridley State Bank who are also officers of Banrein, Inc. regarding the
improvement of 5th Street and improved traffic flow next to their property.
This improvement necessitates a small road easement from Banrein, Inc.
Banrein, Inc. was willing to give the City an easement subject to certain
conditions and they wrote up an agreement laying out these conditions.
I had no problem with Items 1, 2 and 3 of this agreement, but in their
proposed Item 4, they wanted the City to quarantee they would be able to
rebuild their facility to the original form if it was damaged by any cause.
I feel the proposed improvement actually is enhancing the traffic flow for
the bank, and they should give this easement to the City without any strings
attached.
In the negotiations, Item 4 was modified. Instead of guaranteeing that the
Banrein, Inc, would be able to rebuild to its original form, they have the
right to request rebuilding before the City Council and the Council would
review their request. I indicated to the gentlemen that anyone can request
any item before the Council, but Mr. Savelkoul said he knows that, but he
would rather leave this item in the agreement as modified just to satisfy
his members of the board.
With this understanding, I recommend that the City Council approve this
agreement.

AGREEMENT
THIS AGREEMENT made and entered into this day of
, 1983, by and between BANREIN, INCORYORATED, a corpora-
tion existing under and by virtue of the laws of the State of
Minnesota, and CITY OF FRIDLEY, a municipal corporation.
WITNESSETH:
wHEREAS, the City of Fridley desires to undertake certain street
impzovements on Sth Street between 63rd Avenue and Mississippi Street
N.E., and,
WHEREAS, the City of Fridley needs a portion of the propert}•
owned by Banrein, Incorpozated in making such improvements, and,
WHEREAS, Banrein, Incorporated desires to cooperate insofar
as possible with the City of Fzidley in this connection,
NOW THEREFORE, it is mutually agreed by and between the parties
hereto as follows:
1. Grantor shall quitclaim deed wittiout consideration to the Cit}�
of Fridle}• premises described as follows:
A Street and Utility Easement over and thzough
that part of Lot 1, Au3itor's Subdivision No. 59,
lying easterly of the following des^ribed line:
Commencing at the Northeast corner of said Lot 1;
thence t+est along the North line o: said Lot 1 a
distance of AO feet to the actua] point of beginninq;
thence South along a line parallel with and 40 feet
i:est of the East line of said Lot 1, as measured
at right angles to, a distance of 129.48 feet;
thence deflect to tne aest 4�° 00' to the South
line of said Lot 1. Subject to easements of zecorP.
2. City of Fridley agrees that the said conveyed premises shall
be considered and treated as part of Banrein's premises for its
future use, construction, or reconstruction of its remaining prerises
in determining or applying set-backs or othez similar building
and zoning requirements.
3. No special assessments shall be levied against Banreir,
propezty for any street and/or related wozk with respect to the al-
terations to be undertaken by the City of Fridley on Sth Street betwee-•
63zd Avenue and Mississippi Street N.E. in accordance w-ith Street
Impro�•emeat Project ST. 1983-1 and 2.

4. Banrein's present buildings and other structures, includ-
ing signs and drive-up facilities, are recognized as legal uses
of the premises under existing laws aad ordinances and considera-
tion will be given to suc6 uses ior the repair or reconstruction
of the same in the event of damage by fire, wiad, ilood, storm, riot,
insurrention, vandalism, or any other accidnt or casualty.
