Mr. Dale Hadtrath presented a check to the City in the amount of
$19,078.01 fram the Home Insurance tbmpany which is being paid due to the
City's improved loss ratio.
Mr. Aadtrath stated the loss ratio has been improved by the outstanding
work of Jim Hill, Sid Inman, Bill Aunt, and Nasim Qureshi, through the
awareness of job safety and accident prevention.

Cocuicilman Fitzpatrick nominated Brad Sielaff for appointment to the
vacancy created by the resi�ation of Rbdd Tessmer, and the term expiring
in 1985.

appoint�nent of Brad Sielaff, 6770 Plaza C1uve, to the Energy Commission.

Mr. Flora, Public Works Director, stated this request for variances was
before the Appeals Camiission at their June 28, 1983 meeting and approval
was recomnended with certain stipulations.
Mr. Flora stated the variances requested are to increase the size of a
free standing sign fran the maximinn of 80 square feet to 371 square feet;
to increase the height of one free standing sign from the maximum of 25
feet to 47 feet, and the second free standing sign from 25 feet to 36
feet; to increase the size of two directional signs from the maximum of 4
square feet to 7 square feet, and increase the size of a third directional
sign from 4 square feet to 24 square feet; and to decrease the setback
from right-of-way for a directional sign from the minimum of 10 feet to 2
feet.
Mr. Flora stated the major request is for an identification sign, a truck
products sign, and tw�o clirectional sic�s. He stated, after considerable
discussion by the Appeals Commission, they recommended approval to
increase the size of a free standing sign from the maximum of 80 square
feet to 241 square feet and to increase the height of that free standing
sic� frocn the maximtaa of 25 feet to 47 feet. �ey further reconmended the
size of the three directional sic,�s be increased f rom 4 square feet to 7
square feet and to decrease the setback from the zight-of -way for a
directional sic,� fram the minim�an af 10 feet to 2 feet, with stipulations
that the "Trucks" si� shall be eliminated; the 24 square foot directional
sic� shall be eliminated; and the "Parts � Service" directional sign shall
be retaved.

Mr. Flora stated, in reviewing this property, there are some code
deficiencies regarding landscaping to be placed along Viron Road and
Fireside Drive, repainting of existing signs on the front and sides of the
building, and construction of a handicap raanp for the truck sales of f ice.
He stated these itesns were not included in the stipulations by the Appeals
Qoamission, but felt they should be brought to the Co�mcil's attention.
l�lr. Peugh, representing Signcrafters, stated the sign they are proposing
would be about 10 feet higher than the existing sign which would be
ranwed. Ae stated the purpose of the wall signs were to screen the air-
conditioning units on the roof .
Oounci]mar► Schneider questioned how much signage was permitted on the
walls, and Mr. Flora stated they meet the requirements for the signs on
their walls, with the ones suggestec7 to be remwed.
Councilman Schneider questioned the square f ootage of the existing
"Vikinq" Sign.
Mr. Flora stated it is 331 square feet so the request is actually a
reduction in size, however, it would be higher.
Councilnan Schneider asked which signs would be removed f rom the walls.
Mr. Dooley, representing Viking Ct�evrolet, stated the sign stating "Body
Shop" on the north side of the building w�ould be renaved.
Council.nan Sc�neider stated he dic�'t have a problen with the proposal for
the new sic,� as he felt it would improve the area. He stated his only
thought was there seems to be a lot of clutter and felt it would be
advantageous to remave somie of the wall signs.
Mr. Dooley stated they could remove the two small signs, but would like
the one facing Fireside Drive.
Councilman Sc:hneider asked Mr. Dooley about the question raised by staff
regarding the landscaping. Mr. Dooley stated there are trees and shrubs
along Viron Road, Fireside Drive, and the highway. He stated they
received a request in the mail toclay regarding landscaping, and it looks
like they are being asked to spend $15,000 to 520,000 for shrubs and f elt
this was too much, however, there is no question there are some things
they can do to improve the landscaping.
Mr. Flora, Public Works Director, stated when the special use permit was
granted to pravide for van parking on the Strite-Anderson property, there
Was�a requirenent for a landscaping plan to be provided. He stated he
talked to Mr. Dooley this gast week regarding the submission of a plan for
landscaping the boulevards along Viron Road and Fireside Drive. He stated
staff has identified several different species of plants and trees which
oould be used for this landscaping.
Mr. Flora stated, in addition to the landscaping, the fence to the back of
the building should be screened; the existing signs on the building should
be repainted; and a handicap ra� be installed to the truck sales office.

l�lr. Dooley stated they have every intention of repainting the wall signs
and they would install a handicap raa�p.
l�ayor Nee stated he dicbi't feel the question of the landscaping could be
settled at this time, however, if the same standards that apply for the
Datsun dealership are set for Viking, he asked Mr. Dooley if this would be
acceptable.
!!r. Dooley stated he didn't feel this would be a problem and some of the
landscaping could be done this fall and that a two year period would be
reasonable to �amplete the required landscaping.
M�TION by Counciln�an Schneider to concur with the recommendation of the
Appeals Caimission to grant the variances to increase the size of a f ree

petitioner wmplete w�ork on the handicap ramp to the truck sales office,
and work with the staff to provide adequate screen.ing for the storage area
in the back. FUrther, the petitioner is to work with staff to develop a
landscaping plan along Viron Road and Fireside Drive t� to a level similar
to other car dealerships in the City to be completed by September, 1984.

Mr. Herrick, City Attorney, stated this ordinance takes a longer period to
go into effect than a normal ordinance. He stated he believed it is 90
days after publication and administration should take this into
oonsideration.
!Ylr. Qureshi, City Manager, stated an opinion was received that staff may
proceed on the basis of what the Gouncil originally passed. He stated, in
essence, this ordinance is the same one as adop�ted earlier by the Council,
but the public hearing wasn't held, therefore, it was necessary to hold
the hearing and then have the Council take action again for adoption of
the ordinance.

Gbuncilman Sc�neider stated, at the first reading of this ordinance, he
did support it procec�rally, hawever, he has ciifficulty with Section 6.02
(b) which, in effect, renwes the o�ncurrence of the Cou�cil, as a Charter
requirenent, for the hiring or dismissal of City �loyees.
Councilman Schneider stated it has been his philosophy to bring
a000untability to the ��cil for actions by the City. Ae stated one of
�e first activities on which he spent a oonsiderable amount of time was
the code of ethics ordinance. He stated the Charter, as it stands,
significantly influences and restricts the ability of Council members to
interfere with daily work. He stated it is, therefore, vital for the
Gouncil to have a free flow of information with the administration and
this irrvolves who the City is hiring and who the City is dismissing. He
stated the proposed change would eliminate that information flow to the
Co�cil .
Councilman Schneider stated he has no distrust of the present
ac�ninistration and the way it has worked, there is no problem; however, he
felt the Council's function to oversee the hiring and dismissal of
enployees should be retained.
Councilman Sc�neider stated he would like to be aware af what is happening
and for the Council to oontinue with their concurrence in the hiring of
e�loyees, however, he stated the City Manager`s hands are somewhat tied
if he isn't free to dismiss employees.
Councilman Schneider stated he had discussed his concerns with the City
Manager and a compromise has been suggested in that the Council would
concur with hirings and would only be notified of any dismissals.
Councilnan Schneider suggested this ordinance be tabled so this compromise
oould be presented to the (harter Camiission.
MOTION by Councilman Schneider to table the second reading of this
ordinance �mtil October in order to submit the proposed compromise to the
next meeting of the Charter Commission for their consideration and
discussion. Seoorx�ed by Councilman Fitzpatrick.
Councilman Ha�nernik pointed out the Council reviews the budget and the
douncil is made aware at that time of changes in personnel. He felt the
Council has the opportunity and authority to either approve or disapprove
any positions c�uing the budget process. He stated if there isn't money
for salaries available, there woulcii't b2 ariy hiring.
Mayor Nee stated he was pregared to v�ote for the sec.ond reading as it now
etands, but di�'t feel it would pass.

Ms. Sue Jackson, a member of the Charter Commission, stated her first
reaction to the compromise is fairly positive. She stated the whole
thrust of the change regarding �loyees came after the change regarding
the City Manager. She stated the first oonsideration was to see that the
City Manager serves at the pleasure of the Gouncil. Ms. Jackson stated if
the City Manager is held acoountable for the way the City operates, he

City Manager having the right to choose the individuals.

Mr. Qureshi, City Manager, stated the �arter requires the City Manager to
submit the preliminary budget to the Council in order to set a public
hearing.
Mr. Qureshi stated the budget for 1984 is $7,357,113 which is a 3.79$
increase aver the 1983 budget. He stated the Council would be provided
with adjusted f igures as they becane available f rom the State and County .
He stated this is a balanced budget, as required by the City Charter, and
further details will be submitted at the public hearing on September 12,
1983 .

requested in order to oonstruct a garage in the flood plain at 640 Cheryl

Mr. Flora, Public Works Director, stated this is a request to reduce the
side yard setback fran the required five feet to three feet to permit the
oonversion of a single car garage to a dcwble garage.
Mr. Flora stated, at the Appeals Commisison meeting, there was
considerable discussion that the garage could be 20 feet instead of 22
feet and, therefore, a variance would not be required. He stated the
Appeals Camiission denied the variance as they felt the hardship had to be
based on more than just econanic reasons. Mr. Flora stated the vote by
the Appeals Commission was 2 in favor and 2 against the motion and,
therefore, this item was re£erred to the Council.
Mr. Mittelstadt stated the variance for which he is applying is really
only for one foot so he could make the garage 21 feet. He stated he
originally applied for a two foot variance in order to make the garage 22
feet.
Mr. Mittelstadt felt the variance would make a substantial difference in
the quality of the garage and indicated he intended to build the garage
whether or not a variance was granted.
Mrs. Ruhnly, 6747 Washington Street, stated the lots in this particular
area are angled and are 75 feet across the front and about 55 feet across
the back.
She stated the homes are pretty crawded and the majority of the homes in
the inn�ediate area have single attached garages.
Mrs. Kuhnly stated, when their home was built, it was too far north and
their driv�aay was on the Ixoperty line so they had to buy several feet of
land from their nei�bor in order to get out of their car. She stated the
only room they have is on the south side of their property where Mr.
Mittlestadt wishes to enlarge the garage, and s�he w�ould prefer not having
ariy m�re building than what is already there.
Mr. Richard Nord, 6805 Washir�gton Street, stated most of their area has
single attached garages and felt, if this variance is granted, other
requests will have to be granted which will �ke their area even m�re

crowded. Ae stated he built a two-car garage on the back of his lot so he

Q�uncilman Barnette stated Mr. Mittelstadt is going to add to his present

Councilman Aamernik stated he appreciated Mr. Mittelstadt trying to
upgrade his property by adding on to the garage, howevex, with the
objection of adjacent property awners, he f inds it diff icult to vote in
favor af the proposed variance.

Mr. Dick Aarris, Riverview Z�errace, asked where the ordinance now stands
regarding the requirenent for sprinkler systeans.
I4r. Qureshi, City Manager, stated the State has given cities an option to
adopt Appenciix E to the Dniform Building Code which would provide higher
standards for fire protection by requiring sprinklers in new buildings or
adciitions to buildings.
Ae stated most of the surrounding comanunities are considering adopting
this requirenent and Spring Lake Park, Mounds View, and Brooklyn Center
already have these ordinances.
Mr. Qureshi stated if this is adopted, it shifts some of the burden for
fire protection to the property owners. Mr. Qureshi suggested to Mr.
Harris that he contact Fire CY�ief, Bob Aldrich, since he does have some
oost oo�rq�arisons.
Mr. Qureshi stated the Council will be discussing this item further on
August 22, as there was a first reading of the ordinance on July 25, 1983.
Mr. Harris stated he saw some figures regarding the cost to install a
sprinkler system and felt perhaps it doesn't reflect the true costs, as
connection oosts may be higher than what an actual sprinkler system would
cost for a small building.
Mr. Harris stated he can't make an argument over the safety factor and
perhaps the burden of responsibility should be shifted to the property
vwners.
He suggested perhaps if it was such a good idea that City Hall should be
sprinkled and used as a test case. !�lr. Qureshi stated they are planning
to have the lawer level in the Caty Aall sprinkled.
Co�cilman Aaunernik stated, in discussions at the last meeting, it was
felt the options the State left c�en to local jurisdictions were somewhat
limited, and was one of the reasons the Council considered this option to
adopt appendix E.

During the 1963 Legislative session, the State Statutes were am�ded regarding
the hours of sale for intoxicating and norrintoxicating malt liquor. The
Legislature eliminated the pertion of the State Statutes which prohibits the
sale of liquor and narintoxicating malt liquor on the day of any Statewide
election. Since the Legislation is enabling only, it is up to the City
Co�cil of each individual City to c3etennine Wi�ether or not they cb, in fact,
vant to change their local ordinances and allow for the sale within their
City.
I reoannend that the City C'�cil adopt these changes based on the following
r easons.
1. T7�e State I�w has never prohibited the sale of intoxicating liquor and
norrintoxicating malt liquor on the days of a local election and the City has
alWays allowed its liquor establishments to sell on those days.
2. Adjacent cities to the City of Fridley are in the process of amending
their ordinances and not changing ours wculd allow our ndjacent city liquor
establisivnents to have an �aifair marketing advar�tage.
3. It would alla+► the City of Fridley's M�a�icipal Off-Sale Liquor Stores an
a3ditional oppc>rt�ity to produoe revenue for the City's taxpayers.
Additionally, Chapter 603.11 dealing with intoxicating liquor on-sale and
Chaper 605.13 dealing With intoxicating liquor--clubs, still contains
provisions disallowing the sale on Menorial Day. This item has been out of
the State Laws for a number of years and Was inadvertently overlooked in
amending the liquor ordinances. �erefore, I have included language in the
acclinances to eliminate the Men�rial Day provisions fran our City Code.
I have attached the ordinances r�ecded to effectuate those changes, copies of
the State I�w, and a copy of the City Attorney's opinion reqarding these
ordinance changes for your review. If the Council feels this is the direction
they want to go, I Wi11 plaoe these on the next agerx3a for formel action.

One of the major concerns we have always had in the past i6 how we Would
rnforae such ar� ordir�noe. I have discussed this matter vith both Town Taxi
and City of f icial s f rom other cities and it i6 thei r intent to sinply enf or ce
the ord.inar�ce after reoeiving oo�laints fram other taxi companies, or when
observations are made by conoerned citizeis or pclioe persorv�el. Using this
method, Mre would n�t be distupting the oraerly flcw of transportation through

(76th Avenue N. E. vacated by Ordinance �568), to allow the expansion
of the clinic at 500 Osborne Road N. E.
Irh�. Boazdman stated in order to construct dn addition to this building, it
will be necessary to expand across an existing right-of-va� and utilit�• ease-
ment. He stated the right-of-way is not being used for sticrt purnoses so
stsff has no problem with this request. However, it will be necessary to relocate
existing utilities and rededicate easement.
I�r. Boardmsn stated the agenda contains a dr�wing showing w!�ere they intend
to relocate the utflity lines and rededicate a utilfty eas�ment. He stated
the zequest is for the total vacation of the nublic right-of-way, but to retain
an easement for utilities.
Il�. Schnabel •sked if the utility companies had been contacted. T�. Boardman
stated the developer has talked to the utility companies and rerouting will
be done at the developer's expense.

2. CONSIDERATION OF RIGHT-OF WAY TURNBACK TO AFFECTED FROPERTY OWNERS:
l�r. Boardman stated a mimber of par[ial parcels have been released by
the state and quit clained to the City.
I�. Boardman stated this matter doesn't really require action by the
Planning Commission, but staff wanted it brought to their attention in
order to obtain their input regarding release of these exceas properties.
Mr. Boardman atated it is the intent of the City to deed back to the pro-
perty ownezs tho�e properties vhich the City doesn't need. He scated
the Commission must deter mine if this is the direction in which to �roceed
and if i[ is consistent wi[h the Comprehensive Plan.
Itr. Kondrick asked if there is enough land for any fu[ure expansion of
I-694 so it �:ouldi�'t be necessary to again acquire land for right-of-wa�•.
Mr. Boardman stated the freeway will eventually be expanded between In[er-
s[ete 35 and the Mississippi River bridge, hoWever, there is sufficient
land for this expansion.
I�. Boardman stated i[ has bren [he City's policy [o vaca[e property they
don't need and deed it back to [he property o�aner.
Ms. Gabel asked if these excess properties would be sold or turned back [o
the property owners. I�. Boardman stated he was not suze how it would be
handled, but probably would be deeded back to the ovners.
Ms. Schnabel stated in I�. Newman's mem� to I�. Moravetz regarding these
pzoperties, he sugges[s the purchase agreement should require the buyer to
provide a survey of the property prior to closing. Ms. Schnabel questioned
why the buyer would heve to furnish this information.
Ms. Schnabel stated she personally objects to this requirement as she didn't
feel i[ was the proper role of [he buyer to obtain a survey of the property.
Ms. Schnabel stated Mr. Newman's memo also pointed out that establishing a
policy at this time would only handicap the City in attempting [o get the
maximum price. She stated she has interpreted thfs to mean they shouldn't
set a prfce.
I�, Boardman stated I�. Newmen is saying the City should nut the oroaerties
up for sale to see what price they can get and whether [he Council wishes
to proceed in this direction, he didn't know at this time.
1�h. Boardmsn stated, in some cases, it might be worthahile to sell the nro-
perty; however, in other cases, the pro�erty probably wouldn't sell.

I�ls. Gab41 stated the Commission recently had a request for variances where
this type of right-of-way was involved and, if the proper[y had been
turned back to the property o++ner, the variances wouldn't have been reces-
aary. -
Mr. Oquist asked how this whole matter relates to the Comprehensive Plan.
tfr . Boardman stated there is no specific ststement in the Comprehensive
Ylsn regarding this tyPe of property, but statemencs to the effect of
mtking [he msximum use of land, whenever possible, and turning back excess
property prvbably falls within this content.

3. CONTINUED: AN ORDINANCE ADOPTING A NEW CHAPTER 101 ENTITLED "ANIMr1L
CONTROL" AND REPEALING OLD CHA PTER 301 ENTITLED "LIVESTOCK COhTROL",
302 EA'TITLED "ANIMAL CONTROL", AND 303 ENTITLED "WILD ATIMALS AND
BIRDS" OF THE FRIDLEY CITY CODE IN ITS ENTIRETY (At�NDED ORDINANCE�:
I�. Deblon stated this proposed ordinance deals vith all animals in the City
and would zeplace Chapters 301, 302 and 303 vhich now covez "Livestock
Control", "Animal Concrol", and "Wild Animals and Birds".
I�. Oquist felt there was no reason [o allow livestoc'c in the City as there
is no logical place to keev them.
Irh�. Deblon sta[ed all existing livestoc�c in the City could come under a
grandfather clause. He scated, in some cases, versons keev goats because
the goat's milk is needed.
I`h. Oqufst also questioned if rabbits should be vut in the category of
livestock.
Ms. Gabel stated she would agree they shouldn't license livestock such as
cows or horses in the City.
Me. Schnabel asked if the Humane Society has certain size requirements for
keeping livestock, and felt this should be checked. She stated there may not
be any parcels of land fn the City large enough to accommodate cows and
horses.
ltr. Kondrick felt co�on sense should dictate that certain animals shouldn't
be allowed in the City.

I�. Boazdman stated certain setbacks have to be met in order to keen
livestock, therefore, the sise of the lot vould control ahat a person
can oz cannot do with regard to livestock. He sta[ed the question is
if they vant to eliminate livestock from the ordinance and then make a
determination on how to classify rabbits and goacs.
!t. Oqufst stated, by definition, a rabbit is really a rodent, and noc
livestock.
Ms. Kay Kunkel, the Legal Intern, then reviewed the proposed ordinance
with the Planning Comnission members. and the following changes were noted:
�ection 101.01, Definitions - A definition of "Birds" a:.d "�oocstic Pets"
was added. The definition of "Domestic Pets" is as follows: "Anv of various
ani�rals kept for pleasure rather than utility."
Under Item 6, "Cruelty or Torture," the word "both" wes changed to "d2ath".
Mr. rJquist stated the kennel definition refers to cacs end dogs and ques-
[ioned whether rabbits ahould be included or if it should be limited [o
cats and dogs.
Ms. Kunkel s[ated if there is a livestoc'� category and rabbits �re left in
this category, the kennel definition should probably sa�• [hree or more
animals.
Mr. Oquist stated kennels are allowed in an industrial zone and questioned
if there should be a cross-refezence in Chapter 205 regarding the kennel
license. I�. Oquist also stated he felt the definition of 'cennels should
be the same in both ordinances fn order to be consistent.
Ms. Kunkel stated, under Section 101.01, s definition of "Rodents" and "Wild
Animals" was included.
Ms. Schnabel asked about reptiles, hamps[ers and gerbils and if these animals
vould come under [he definition of 'bomestic Pets". Ms. Kunkel fel[ they
vould be classified as a domestic pet.
Section 10��03. Livestock Con_t�. - I�. Deblon stated additional verbage
was added in order to clarify the license Qroced�re.
Section 101.04�Dofi Sontrol -�his should be put updez the Animal.•Nuisance
section as Item 9. .Under Item 6, Ehe words "dog or cat" were changed to
"animal".
ection 101.06,�Dog ReRistration - This section should be moved so it follows
Sec[ion 101.03, Livestock Control.
Ms. Kunkel stated, undez Sec[ion 101.06 (2), the wording may have to be changed
to allow people to register their dog if they are getting a vaccination within
siac months .
Ms. Gabel suggested staff vork on this section because, in her case, she is
unable to obtain a license for her dog because it is su�pose to be vaccinated
every two years. She stated the ordinance provides a dog has to be vaccin-
ated in order to obtain a license which is issued on a yearly basis.

Under Section 101.06, 2(B) - This should read as follows: "It shall be
unlawful to counterfeit a dog tag or remove a tag for any purpose."
Section 101.08, Exemptions - Change the reference [o Section 101.06 to
Section 101.04.
Section 101.10 Im undin - Item 2(B) - Begin this aection vith the words,
e awner of the impounded animal shall pay", etc.
Item 2(C) - Line 3- Add the words, "insure the vaccination of" after the
word "shall".
Item 2(D) - Begin this sec[ion vith the words, '7he owner of the im�ounded
animal shall also pay the�� and change [he word "confined" in the second line
to "impounded".
5ection 101.11, Animnl Bi[e� Quarancine - Item 1, Line 1- Add the words,

Preliainary reviev for the above proposal has been completed. It has
been determined that one of the items necessarp for construction of the
office addition was the vacation and rededication of a utility easement
along the northerly end of the property. The utilties in the easement (an
8" sanitary sewer line, a 6" water line, and telephone cable) apparently
onlq service this buildiag (see attached aerial photo). The vacation
proceeding takes about 2� soaths aad will cause an extensive delay of con-
struction. In order to start the project as soon as possible, the developer
will need permission froa the Citq Council to encroach into this easement.
Sncroact�ent could be granted provided the vacation process has been
initiated by the developer aad the utility companies are notified. I have
contacted the developer regarding this. fle has agreed to initiate the
vacation proceedings promptly and also contact the appropriate utility
companies. I see no probleas v3th grantiag encroachnent into this easement.

At the August lOth Planning Commission meeting the issue of disposing of excess highway
turnback was discussed and concurred with.
Since that time we have received an opinion from Mr. Newman reg arding disposal procedure.
Disposal is a City Council policy matter. It may be sold or giben away. Anything to
be disposed of must be defined by survey and does not need a public hearing. Conveyance
should be to the original or adjoining property owners and each parcel in its self
should be defined as unbuildable.
With the turnback of I694 property, it may be appropriate to release the individual
slivers to the original parcels and return that excess to the tax roles. In doing
this the Council may consider that the recipient provide the necessary survey for
legal description and combination into one tax statement.

You asked our office to provide you with a follow-up on our
earlier Memorandum on the subject. First of all, I would like
to remind you that as I pointed out in my earlier Memorandum,
we have not had an opportunity to review any of the documents,
by which the City has acquired their interest in this property.
I have been advised by the staff that they have received deeds
for this property and it is upon that information that 1 am
basing my recommendation. If in fact, the State only acquired
easements and that is all that is being conveyed to the City,
then my recommendations to you will need to be revised.
Your inquiry was to whether or not this property needed to
be sold by the City or whether the City could convey their
interest without receiving anything in return. As I pointed
out in my earlier Memorandum, the method of disposal is probably
more of a policy matter than it is a legal question. Although,
I previously recommended the sale of the property, you are
not necessarily bound by that procedure if the circumstances
warrant.
As I understand, almost all, if not all of the parcels are
in of themselves unbuildable. Admittedly, if these unbuild-
able parcels are joined with others, they may create a buildable
lot, but otherwise cannot be built upon unless they are combined
with adjoining property. In such a circumstance, it may be
very likely that for these parcels, there will be only one
or possibly two prospective buyers. You also may find that
in many of the circumstances, there is no one who is interested
in buying the property. As a result, with this type of market,
you may well find that the revenues generated from the sale
of these parcels are minimal ar►d may not even be enough to
offset the cost incurred in selling them.

If, in fact, this fs the situation, then I would have no diffi-
culty with the City conveying these parcels for no consider-
ation. Mind you, before this is done, I would suggest that
the City staff prepare some data by which this assumption could
be documented. The primary restriction on the City is that
it cannot waste assets. Consequently, if these parcels do have
a marketable value, they should be sold; but if they are of
little or no value, and the benefits received from giving them
away outweigh any nominal revenues that may be received from
their sale, then there is no restriction on the City giving
these parcels away.
If the City elects to give away these parcels, they should
first verify what type of ownership interest that the City
has received from the S[ate.
Secondly, a legal description will need to be ascertained for
each parcel. Thirdly, these parcels may be disposed of without
public hearings and review by the Planning Commission if the
City Council determines by a two-thirds vote that the proposed
disposal has no relationship to the City's comprehensive plan.
Fourth, the City will have to ascertain who the recipient of
each of these parcels should be. I would advise you that wher-
ever possible, a parcel should be returned to its original
fee owner. If this is not the case, then the parcel should
be conveyed to the adjoining property owner. In those cases
where there is more than one adjoining property owner, then
it may be necessary to review those instances on a case by
case basis.
Fifth, all deeds conveying any of these parcels should note
that the parcels are unbuildable in and of themselves and that
by conveying these parcels, the City is not implicitly or explic-
itly representing that the conveyed property is buildable.
It is also my understanding that you are contemplating requiring
those individuals who are receiving the more profitable parcels,
to prepare a survey of all of the properties involved. I do
not have any difficulty with this approach, assuming that the
parcels which are being conveyed do not have a value significant-
ly greater than the value of the surveying services which are
being rendered in exchange.

disposing af this turnback property. 7he considerations involved in this matcer are
as much questions of policy as they are questioas of law.
In revieving this mat[er. there are cer[ain legal considerations vhich you must
keep in mind. First. you must determine vfiether the State acquired the property in
fee title or if the State only obtained an easement. If the interest is that of a►�
easement, then the City cannot convey that ease�ent for a use other than contained
in the easement. Consequently. as a practical matter an easement interest can only
be conveyed to the underlying ovner.
Secondly, you should reviev the title vhich the State acquired in order to
insure that there are no restrictions on how the proper[y can be used in the future.
Third. no property can be disposed of until the plan of disposal has been
revieved by the planning commission and found to be consis[ent vith the City's
Comprehensive Plan. This requirement may be vaived if the C1ty Council finds by
a two-thirds vote ihat the proposed disposal has no relationship to the comprehensive
plan. MSA Section 462.356. Subd. 2.
In disposing of the property, the City need not comply vith the uniform
municipal contracting lav since it excludes real property. Consequently, the
pTOperty nw y be sold through private negotiations. Hovever. all sales must be
confirmed by the City Council.
In addition, the property must be sold at a reasonable price. In this situation.
this will of course be more difficult since many of the parcels are on their ovn,
unbuildable. Consequently, in many cases the only perspective buyer may be an
adjoining property ovner vho may vant the parcel in order to expand his existing
property. This lack of competition may reduce the selling price of the parcels.
On the other hand, even if the selling price is belov the fair market value, it
may still be in the City's interest to consumate the sale since it will enable the
property to be back on the tax tolls. As a result, the council vill have to
determine, on a case by case basis. what a reasonable selling price is for each parcel.
Further. the docuIDents conveying any parcel should clearly state that the
property is unbuildable, if applicable, so that buyers may not later use the City's
tole in the fale of the property as a basis for obtaining a variance.

It is probable that offers vill not be received for the sale of all parcels and
some offers may be unreasonably lov. At some time in the fu[ure. the benefit of
having these properties oa the tax rolls may justify accepting a belov market price.
Hovever. any establishment of a policy at this time of hov the City intends to
handle those situations vill only handicap the City in attempcing to get the
maximwn price at this time.

Please be advised that the Board of Appeals held a Public Hearing on August
16, 1983 to hear a request to reduce the required side yard setback for an
attached garage from 5 feet to 1 foot.
The Petitioner had written letters of consent from each �f his six closest
neighbors.
The Board moved to approve the request by a 4 to 1 vote with Betzold voting
nay to approve the motion.
The motion included a stipulation that the new East wall be of one hour
fire-resistance construcion with no openings and that there be little or
no roof projection on that side.

In response to your questions of August 4, 2983, I offer the
following informations
1. Twenty-one communities that are members of the Suburban Rate
Authority (S.R.A.) have ordinances that expire during calendar
1983 that deal with tl�e franchise agreement with rtinnegasco,
Inc.
2. Of the twenty-one, ten have passed the ordinance as written
and agree8 to by the S.R.A. Committee, the S.R.A. Attorneys,
and t�finnegasco.
One community completely eliminate�l the Section that dealt
with a"possible" francl�ise fec. T1�is was agreeablc with
Minnegasco.
3. The remaining communities are all in various stages of
acceptance and to my best knowledge all intend to use the
S.R.A. model in its entirety.
Please remember that if there are any changes proposed in this model,
Minnegasco must be contacted.
After passage, two sections will need attention. I will need the
following to comply with Sections 2.2 and 2.5:
1. A copy of the ordinance
2. A copy of the Affidavit of Publication
3. A copy of the Acival printed article
4. The invoice for publication expenses

WHEREAS, Frank Shear Associates, a Minnesota general
partnership (the 'Company"� has presented the City Council
(the "Council") of the City of Fridley, Minnesota (the
"City"), with information concerning a proposed project (the
"Project") within the City; and
WHEREAS, the Company has requested that the City issue
industrial development revenue bonds or �otes to provide
financing to the Company for the Project:
NOW, THEREFORE, BE IT RESOLVED BY TIiE FRIDLEY CITY
COUNCIL AS FOLLOWS:
1. This Council will conduct a public hearing on the
proposal to undertake and finance the Project, as described
in the Notice of Public Hearing attached hereto as Exhibit A
(the "Notice").
2. The City Clerk-Treasurer is hereby authoriZed to
cause the Notice or a notice in substantially the same form
thereof to be publisbed in the City's official newspaper and
in a newspaper of general circulation in the City not more

Notice of Public Hearing
Industrial Development Revenue Bonds
City of Fridley, Minnesota
Notice is hereby given that a public hearing will be
conducted by the City Council of the City of Fridley, Minne-
sota, at the Fridley City 8a11, 6431 University Avenue NE,
Fridley, Minnesota, at a meeting of the City Council to be
held on Monday, September 12, 1983, commencing at 7:30
o'clock p.m., C.T. At the public hearing the Council will
consider a proposal that the City assist the financing of an
industrial development project by issuing its bonds pursuant
to Minnesota Statutes, Chapter 474.
The proposed project is a commercial printing facility
to be located at 40 �7th Way NE, Fridley, Minnesota, and
consists of the acquisition of land, the construction of a
building thereon, and the acquisition and installation
therein of equipment by Frank Shear Associates, a Minnesota
general partnership, as Borrower. It is proposed that the
City make a loan to the Borrower to assist financing the
Project from the proceeds of an issue of the City's indus-
trial development revenue bonas or notes in an amount not to
exceed S4,300,000. If issued, such bonds would be payable
solely from loan repayments to be made or secured by the
Borrower.
A draft copy of the proposed application to the Minne-
sota Energy and Economic Development Authority for approval
of the project is available for public inspection in the
office of the Fridley Clerk-Treasurer.
All persons appearing at the public hearing will be
given an opportunity to present their oral or written com-
ments on the proposal that the City undertake and finance
the project.

On August 3, 1983, we opened the bids for the four wheel drive tractor loader. Only
one bid was received. It appears that some of the venders are in opposition
to providing total cost bid figures.
Recommend that Council receive the bids and reject them and authorize the City to
readvertise for a four-wheel drive tractor loader in order to obtain comparison bids.
We have rewritten the bid notice to provide for optional total cost figures rather
than mandatory as was previously specified.
