Mayor Nee presented a plaque to Henry Peterson for his ten years of service
to the Fridley 49er Day Celebration. He stated Mr. Peterson, over these
years, has organized the p�rade for this celebration and the parade last
year was one of the best in the State.
Mayor Nee stated the Council recognizes that Mr. Peterson is one of those
citizens who has unselfishly given his time and effort to the betterment of
the comnunity. Mayor Nee and the Council members extended their thanks and
appreciation to Mr. Peterson for his services.
Mr. Peterson stated he accepted this plaque on behalf of the many persons
who have helped with the g�rade, including his sons, and John Dinsmore and
his sons who helped fram the beginning.
Mr. Peterson stated he came to Fridley in 1957 and has been active in the
coqnnunity since that time. He stated the only thing he didn't accomplish
was to bring a rodeo to Fridley and hoped this could be done in the future.
Mr. Peterson stated there are a lot of dedicated local people who work to
make Fridley No. 1 and he was proud to be a part of this team.

MOTION by Councilman Fitzpatrick to adopt the agenda with the above
addition. Secondec3 by Councilm-�n Barnette. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.

Senator pon Frank appeared before the Council regarding an update on what
was hap�ening in the Legislature.
Senator pon Frank also congratulated Henry Peterson for his service to the
Fridley 49er Days.
Senator Frank stated in 1980 and 1981, the State had a horrendous problem
with the budget shortfall and either had to raise taxes, cut the budget or
make shifts. He stated $560 million was actually shifted which means
�yments pramised to cities and school districts were deferred. He stated,
when the State budget is discussed to day and news is heard about a
surplus, this does not take into consideration putting back the shif t
�yments in proper sequence. He stated there is a motion in the House to
remove the ten percent surcharge and the Senate decided to propose to cut
part of the surcharge, but to reinstate the payment policies to the cities
and school districts which they had in 1980 and 1981. He stated if they
were to reposition the payments to local governments, it would cost $560
million.
He stated he is not saying they are going to reposition the total $560
million, but they want to start the payments in proper order which would
amount to approximately $120-5150 million. He stated the reason it would
be done in this order is because the projections in the last several years
have been so far off, they can't predict the projections for 1984 are going
to be more accurate and want to be a little more conservative. He stated
if there was another recession in 1985 and 1986, and if the payments aren't
repositioned, it would limit the position to maneuver if there is a
financial crisis. He felt the $560 million surplus just isn't reality and
has come to the Council to make sure everyone puts the budget surplus into
the proper perspective.
Senator Frank also stated there is a movement by a group of cities called
the S`mall City Group who are proposing to c�ange the local aid formula. He
stated their proposal is to take $19 million away f rom the core city of
Minneapolis and distribute it to cities who have been "losers" in reference
to the total Iocal aid doZlars. He stated Columbia Heights would lose,
however, Spring Lake Park, Fridley, and Blaine would gain. He stated he
really didn't feel this was the way to proceed and hoped the League of
Cities would cane up with a better approach.
Senator Frank alsa asked where Fridley stands in reference to the site in
Fridley designated as a potestial hazard waste processing facility.

Mayor Nee stated they are suing the Waste Management Board and he is ready
to go to the Minneapolis City Council for their support. He stated he
would like Senator Frank to raise the issue as, apparently, the Attorney
General's office is making the case there is not right to review of this
decision until there are ciamages. Mayor Nee stated he felt, in this case,
if you wait for damages, it would poison 300,000 people by water pollution.
Senator Frank asked that he be submitted same thing in writing and he would
be happy to pursue it further.

MOTION by Councilman Hamernik to waive the reading of the public hearing
notice and open the public hearing. Seconded by Councilman Schneider.
Upon a voice vote, all wting aye, Mayor Nee declared the motion carried
unan�mously and the public hearing opened at 7:55 p.m.
Mr. Flora, Public Works Director, stated it has been found that two streets
in Fridley are inconsistent with the City's policy in that every east-west
road west of the track is a"Way" while all east-west road east of the
tracks are an "Avenue."
He stated, in order to be consistent, it is recarrunended that 77th Way and
79th Way lying between Main Street and the railroad tracks be renamed to
77th Avenue and 79th Avenue N.E.
t•lr. Flora stated the persons affected have been notif ied and the City is
working with the post office to allaw business to change to the new street
narr�e through attrition.
No persons in the audience spoke regarding the proposal to change the name
of these streets.

Mr. Flora, Public Works Director, stated the City had three orainances
c3ealing with animals and animal control and these three were given to the
Plarining Comnission to review. �e Planning Commisson has done this and
recomnends that they be developed into one ordinance. He stated there are
no significant changes in this ordinance which is a composite of the other
three ordinances.

Councilman Schneider guestioned Section 101.10 which required an}� person
who knows of someone bitten by an animal to notify the Animal Control
Officer or Police Departanent. He questioned if this required a person who
witnessed an animal bite to notify one of these authorities.
Mr. Flora stated in the strictest interpretation this would probably be
true.
He suggested gossibly the language could be changed from "shall" to
"should".
Mr. Newman, representing the City Attorney's Office, stated he f elt the
original intention was to require the vwner to contact these authorities
and if the word "shall" is changed to "should", it would not make it
mandaTory for the owner to do so.
Mayor Nee felt the ordinance probably should be lef t as written and that
discretion would i�e u�sed in these cases.
MOTION by Councilman Fitzpatrick to waive the first reading and approve the
ordinance upon first reading. Seconded by Councilman Schneider. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried

Mr. Flora, Public Works Director, stated this ordinance was a result of a
housekeeping procedure to correct some disparities in the ordinance, make
some grarm�atical changes, and correct those ite�r�s the City had difficulty
in enforcing in the previous sign ordinance. He stated there are no
substantial changes in the ordinance, but strictly clarifications.

Mr. Qureshi, City Manager, stated there is a problem with the "A" frame
because of a broken water pipe. He stated the City is assessing the ciamage
and, if possible, they will proceed with the agre�nent. He stated if there

Mr. Flora, Public Works Director, stated when this lot split was approved
by Council there were a number of stipulations. He stated these
stipulations have been satisfied and it would be appropriate for the

Mayor Nee stated the legal firm the City has engaged regarding the
litigation with the Waste Management Board felt an agreement could be made
with the Board for Fridley to withdraw the litigation at this time,
hawever, it wouldn't preclude the City from opening up the issue at a
future date.

Mayor Nee stated Popham, Haik, Schnobrich, Kaufman, & Doty, the �egal firm
representing the City, felt this would save the City some money and cbubted
if Fridley would have such a facility located in this area.
Mayor Nee stated he discussed the City's options with the City Attorney.
8e stated if the City lost the court suit, the reason for the adverse
juc3gement may have been the suit was brought at the wrong time.
Mayor Nee stated he felt they should still proceed with the action, but
w�ould like some feedback fram the Council m�ibers.
Mr. Newman, representing the City Attorney's office, stated if the City
proceeds with the litigation, at this point of time, and the court
dismisses the action because it is pre-mature, it wouldn't prejudice the
City in bringing action at another time. He stated if the case stands on
the merits of the claim, then the decision would be final.
It was the general concensus of the Council that the City Attorney should
pursue this case.
Mr. Newrrian stated the reason it wasn't pursued at the time the litigation
was brought was because of Mr. Herrick's position on the Pollution Control
Agency, however, he no longer serves on this board.
CounciLnan Schneider stated he felt the City hasn't been treated fairly and
would support expending some reasonable sLUn to protect the interests of the
citizens.
Councilman Fitzpatrick stated he would concur they should have the City
Attorney pursue the case.
Councilman Hamernik asked if the City Attorney has an opinion as far as the
success of the lawsuit.
Mr. Newman stated on the question of timeliness, the chances are probably
50/50. He felt the first thing the Waste Management Board would do is to
bring a motion for dis,missal because it was �timely.
Mayor Nee stated the Popham law firm stated the legislation prohibits
review, hawever, the City Attorney doesn't necessarily agree.
Mayor Nee stated in the opinion of the Attorney General's office there
wasn't any damages, and z.mtil there is a shawing of damages, there wasn't a
standing for litigation.
Councilman Barnette stated he felt they should proceed with the litigation
with the City's own attorney. He stated he didn't �nderstanci the Attorney
General's opinion that the designation is meaningless.
Mr. Newman stated the Attorney General's office is playing the role of
representing the agency and would do anything they can to prohibit it from
going to court.

Mayor Nee stated the Attorney General's argument was the simple act of
designating the area has no consequence.
Councilman Fitzp�trick asked if there was any legislative approach the
Council could pursue. Mayor Nee stated he would certainly check into it
and this was why he raised the question with Senator Frank.
(buncilman Haanernik stated he would like to meet with the City Attorney and
have a few questions answered. He stated if they are going to proceed, he
would Iike the City Attorney to handle the litigation.

Councilman Hamernik stated public hearings are being held in the
� metropolitan area regarding Northwestern Bell`s tier system and rate
increase. He requested the Council's support by adoption of a resolution
and forwarding it to where the public hearings are being held.

Opposing Northwestern Bell's Tier System and Proposed Rate Increase for
adoption at the next Council meeting and forward to the appropriate
agencies at that time.

Councilman Hamernik stated this item was discussed at the last Suburban
Rate Authority meeting. He stated there were some interesting findings
coming out of the Gavernor's report and felt it would be in the City's best
interests to promote further action regarding the Waste Control Corra�r,ission.
MOTION by Councilman Hamernik to instruct the ac�ninistration to draw up a
resolution for the next meeting in support of the Governor's Report
regarding the Waste Control Ca�nission and to continue the work started and
pursue it further. Seconded by Councilman Schneider. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously.

In order to satisfy the Metropolitan Surface Water Management Act. the
Rice Creek Watershed District is establishing two advisory committees,
Technical Advisory and Citizens Task Force.
For the Technical Advisory Committee they are suggesting a city engineer
or city planner. For the Citizens Task Force they desire two be appointed,
an elected official and a concerned citixen.
Since Fridley is downstream of the Rice Creek Watershed it would be
beneficial for the city to appoint members to the two committees.
Recommend the City Council appoint:
a. Mark 6urch to the Rice Creek Watershed District Technical
Advi sory Corrmi ttee.
b. An elected official and a concerned citizen be appointed t�
the Rice Creek Watershed District Citizens Task Force.

in a park or on public land to possess a device for cleaning up after
the animal and to do so in a sanitary manner.

The folloWing definitions shall apply in the interpretation and application
of this Chapter and the following words and terms, wherever they occur in
this Chapter� are defined as follows:

may be oxned by the City or may be a co ntracted shelter service.
4. Animal Tag.
A tag provided to individuals who are issued a permit to maintain an
animal .

101.02. WILD ANIMALS AND BIRDS
It shall be unlaWful for any person to hunt, take, shoot, trap, kill,
injure or attempt to injure any Wild animal or bird Within the City of
Fridley by use of a firearm, bow and arroW, trap, poison or any other
means. This prohibition, hoWever, shall not prevent property owners or
their agents from eradicating rodents on their property hro�gh � he use of
traos,`� icnn3 or other sueh lawfLl means.

101.03• LIVESTOCR CONTRO�i.
1. License Requirement.
No person shall engage in the keeping, raising, feeding or caring for
livestock Within the City limits of Fridley Without first having obtained a
license to do so. �,�e �a�� �,�xa x� xt,���e�t ���l��Id� f�E �1� ��E�'�t��d

2. License Procedure.
A. A license to keep livestoek shall be granted only after Written
application, signed by the applicant� is filed With the City. The
application shall state the applicant's full name and address, and
contain the number and species of the livestock to be kept and a
d��!lt��xi6�i.�caled site nlan of the premises shoWing the adjoining
property and fence lines.
B. The Council, in considering whether a livestock license should be
granted, shall reviex the applieation and site plan to consider the
nature of the livestock, the possible effect on adjoining properties,
housing facilities, sanitation control and the effect on the general
health, safetv and r+elfare of the public.
C. Any person keeping, raising, feeding or caring for horses, cattle,
goats, sheep or swine shall pravide no less than one (1) acre of open,
unused land for each animal.
3. License Fee.
The annual license fee and expiration date for a livestock license shall be
as provided in Chapter 11 of this Code.
4, Manure Removal.
Persons Who keep animals within the City shall not a11oW any odors which
are offensive to the people inhabiting the City �t��h that they constitLte a
;,uiJa„ce as defined in ChaDter 110, entitled "Public Nuisane�", of the Citv
Code• Organic matter shall not be allowed to accumulate for more than one
(1) Week at a time. HoWever, organic matter shall be removed more often
than one (1) time per week if it is necessary to eliminate any odors ��
constitute a nuisanee.
5. Housing.
Proper housing in the form of barns, coops or hutehes shall be provided in
any area Where livestock are permitted to roam. Such housing shall be
adequately fenced to insure that the livestoek remain on the owner's
premises. When livestock are kept in an area that abuts or adjoins a
residential area on Which draellings are erected, there shall be a atrip of
land at least thirty (30) feet Wide bet�aeen such abutting property and the
area on Which the livestock are kept.

6. Inspection.
Any authorized Animal Control Officer of the City shall, at any reasonable
time, be permitted upon the premises where livestock are kept for the
purpose of making an inspection to determine compliance With this Chapter.

property by adequate fencing or leashing.

is not under the control of the oWner or custodian by a Ieash. Such leash
shall not exceed eight (8) feet in length. This provision is not
applicable When dd� dt l�ilx �,n animal is in a motor vehicle.
3. The �dd� dl" ti�x �D,3�1 commits damage to the person or property of
anyone other than the oWner, or creates a nuisance, as defined in Ghis
�haoter or in Chanter 110 entitled "Public NuisaACP" of the Citv Code,
upon the property of one other than the owner. This provision is not

the oxner's family or the owner's property.

101.05. DOG REG LSTRATION
1. Permit.
A. No person shall own, keep or harbor any dog over the age of six (6)
months within the City unless a yearly permit xnEtfO�` has been secured.
Permit certificates shall be issued by the City upon proof of rabies
vaceination Within the preceding txo (2) years. If at the time of
initial registration, a dog is due to be vaccinated Withia the next six
months, a neW vaccination would De required before a permit is issued.
Issuanee of neW permits for the Iicense year shall bommence as set
forth in Chapter 11 of this Code. In April of each year, the City may
publish notice in the official nexspaper of the need to pay such permit
registration fee.

B. The applicant for permit must sign and agree that he or she is
prepared to comply With regulations established by the City. It shall
be the duty of each person o�ning, keeping or harboring a dog to pay
the permit fee established by the City on or bef ore the f irst day of
the permit year, or upon establishing residence in the City. Upon
payment of the permit fee, the City shall execute a receipt in
duplicate, the original of Which shall be delivered to the person who
pays the fee and the duplicate retained in the City recorda. As a
minimum, the receipt shall deseribe the dog as to breed, age� eolor,
oitner and owner's address.
C. No permit shall be required of any humane society, veterinary
hospital or laboratory.
2. Tag.
A. In addition to the permit, a tag, the shape or color of which shall
be different for each registration year, shall be issued by the City.
The owner shall affix the tag, by a permanent metal fastener, to the
collar or harness of the registered dog in such a manner sa that the
tag may be seen. The oWner shall see to it that the tag is constantly
Worn by the dog. In case any tag is lost, a duplicate may be issued by
the City upon representation of a receipt shoWing the payment of the
permit fee for the current year. A charge, as provided by Chapter 11
of this Code, shall be made for eaeh duplicate tag.
B. It shall be unlaWful to counterfeit or attempt to counterfeit a dog

C. Dog tags shall not be transferable and no refunds shall be made on
a permit fee because of leaving the City or death of the dog.
101.06. REVOCATION
1. An animal permit may be revoked if:
A. The person holding the permit refuses or fails to comply with �,g.
provisions of this Chapter, any other regulations promulgated by the
City or any state or local law governing cruelty to anima2s or the
keeping of animals.
B. An owner fails to provide the animal With �t�tt��t�nZ ���d �1id

veterinary care and humane care and treatment.

animal.

D. An o�+ner causes or permits any dog fight� cock fight, Dull fight or
other combat betWeen animals or betxeen animals and humans.
E. An owner violates the terms of this Chapter three (3) times Within
one (1) permit year.
2. Any person whose permit ia revoked shall� within fifteen (15) days�
remove auch animal(s) permanently from the City or humanely diapoae of the
aniaal(a) cited in the violation as being vwned� kept or harbored by auch
peraon and no part of Lhe permit fee shall be refunded. In additio n� the
oti►aer aay be liable to ocurt action under this Code� State Statutes and
local laws for any of the actions cited aDove.
3. I.f a permit is revoked� no neri per�it may be issued for a period of one
(1) year from date the permit is revoked.

Section 101.05 of this Chapter requiring a per�it and tag shall not apply
to nonresidents of the City who are keeping only domestic pets, provided
that Lhe animals of such owners shall be kept in the City no longer than

101.08. FEES
The annual permit fee and expiration date shall be as provided in Chapter
11 of this Code. Neutered or spayed animals shall qualify for a reduced
permit fee as provided in Chapter 11 of this Code.
101.09. IMPOUNDING
1. Generally.
A. The Animal Control Officer shall Lake up and impound any animals
requiring permits or tags found in the City vithout the tags; or any
animals Which are in violation of any of the other provisions of this
Chapter. Animals shall De impounded in an animal shelter and confined
in a humane manner. Impounded animals shall be kept for not less than
five (5) days, including Sundays and Holidays, unless reclaimed by
their o�ners.
B. If an animal is found at Iarge and the oWner or custodian can be
identified, the Animal Control Officer may proceed against the oxner
for violation of this Chapter.

D. Upon taking and impounding any animal as provided in this Chapter,
the Animal Control Officer shall immediately notify the oWner� if
knoWn, and the City Police Department. The Animal Control Office r and
Police Department shall maintain a record of animals so impounded.
2. Claiming an Impounded Animal.
A. In the instance of animals for Which the orrner does not have a
required permit or tag, the Animal Control Officer shall not return
such animal to the oraner until a permit and tag have been purchased
from the City or from the Animal Control Officer. The Animal Control
Officer shall remit to the City the svm paid for the permit and/or tag

The Animal Control Officer shall turn over to the City any impounding
fees received. The City shall place such fees in the general f und of
the City.
C. If a rabies vaccination is required and the owner cannot produce
proof that the animal has had a raDies vaccination Within the preceding
two (2) years, the Animal Control Officer shall 76�t��E��lttLE ensure that
such dog or other animal is vaccinated for rabies as a condition of
release to the or+ner. The animal's owner shall pay to the Animal
Control Officer the cost of the immunization.
D. The or� er of Lhe imnounded animal shall also oav the Animal Control

shelter.
3. Unclaimed Impounded Animals.
Any animal which is not claimed Within five (5) days after having been
impounded, including Sundays or Holidays, may be requested and claimed by a
licensed educational or scientific institution under Minnesota Statutes
Section 35•71. If not so requested and claimed, the animal may be sold for
not less Lhan the amount of the total charges accrued against the animal in
aeeordanee xith the provisions of this Chapter. All sums received by the
Animal Control Officer, �xceDt the cost of feed and care and anv
vaeein?ttons or immunizations administered to �h� �rii��l, shall be remitted
to the City and placed into the general fund of the City. Any animal
�hich is not claimed by the rn+ner, a licensed educational or acientific
institution or sold, shall be painlessly put to death and properly disposed
of by the Animal Control Officer. The time of sale or other disposition of

the anima2 sha21 be at least 120 hours after notice has been given to the
animal's owner by the Animal Control Officer. The provisions of
notification to the rnrner do not apply When the or+ner cannot be reasonably
ascertained.
101.10. ANIMAL BITES, QUARANTINE
1. Aqy person biL,_.ten or knoxing of a human being �Sit Who as been bitten
by a dog, cat, racoon, skunk or other species susceptible to rabies shall
immediately notify the Animal Control Officer or Police Department.
ilhenever such an animal has bitten any person, the oxner or custodian of,
the animal, n�[1i�11� 16EfE�i after beiruz so notified by the Animal Control
Officer or the Police Department, shall immediately cause said animal to be
quarantined at the City of Fridley contract 1tEdnl�i t�E�IiZ� aT]{mal shelter
or at a licensed veterinary hospital or kennel for a period of fourteen
(14) days after such person has been bltten. During the quarantine period,
said animal shall be kept under observation Lo determine its condition and
if it is found to be sick or diseased, the operator of the quarantine
facility shall immediately report in writing to the Police Department and
the Fridley Animal Control Officer the condition of the animal. The Animal
Control Officer shall then take necessary steps to determine if the animal
is suffering from rabies.
2. During the quarantine period the animal shall not be removed from the
designated quarantine facility except by special xritten permission from
the Minnesota Livestock Sanitary Board and the Fridley Animal Control
Officer. The o�ner of an animal shall be responsible for the cost of
quarantine.
� The quarantine required by this section shall not be necessary and the
requirements shall be waived if the custodian or owner of the animal,
immediately upon ���EtpZ �t xilE d�lxiEE 1`Etlt�`!� r� �ik���►E noti f� cation that
his or her animal has bitten someone. presents to the Animal Control
Officer or Police Department, the eertificate of an authorized veterinarian
that the animal Was vaceinated for rabies on a date not less than two (2)
years prior to the date of �dt',Y! dtdZ�EE the bitina. Such animal so exempt
shall be quarantined on the premises of the oWner, under strict control,
for a period of fourteen (14) days for the purpose of observation for
symptoms of disease. The Animal Control Officer is authorized to conduct a
mid-term and terminal examination of the animal.
4. It shall be unlar+ful for any person, other than an Animal Control
Officer, to kill or destroy any animal found running at large in the City.
No Animal Control Officer or other person shall kill, or cause to be killed
any animal suspected of being rabid, except after the animal has been
placed in quarantine and the diagnosis of rabies made.

s Any person complaining to the Police Department that an animal is allegedly
running at large or otherWise constituting a danger or nuisance shall
ideniify himself or herself upon request and shall make every reasonable
attempt to assist the authorities in identifying the animal and its owner
or custodian.
101.13 • �ZZLIt�IG
Whenever the prevalence of hydrophobia renders such action necessary to
protect the public health, safety and welfare the Mayor shall issue a
proclamation ordering every person owning or keeping �i 0�� an animal
susceDtible to rabies z� confine� iZ securely on their premises unless it
is muzzled so that it cannot bite. No person shall violate the
proelamation, and any unmuzzled ��� �� running at large during the time
fixed in the proclamation shall be immediately put to death by the Animal
Control Officer Without notice to the oWner.
101.14. RSNNII.S
1. License Requirement.
No person shall keep or maintain a kennel in the City except upon obtaining
a kennel license consistent xith the zoning requirements of this Code.
2. License Application.
Application for a kennel license shall be made on forms provided by the
City. Sueh application shall contain the follo�+ing information:
A. Location, on the premises, of the kennel.
B. Location of structures for housing the dogs and/or cats. If the
dogs and/or cats are to be kept primarily within the home or other
building of the residence of the applicant or of any other pe rson, the
application shall so state.

C. The maximum number of dogs, cats or any combination thereof, to De
kept on the premises.
D. The distance of any d�� t`dtSd run areas or housing for dogs �nd/or
cats from any building structures suitable for human habitation, or a
public place Where food is bought, stored or eaten. This distance
shall be a minimum of 200 feet.
E. The premises for any keeping of dogs and/or eats shall be fenced and
a simple plan shoWing the location of fencing shall be furnished. The
fencing must be of such quality 1�� x� and desiAn so that it will
contain the dogs and/or cats.
F. Method to be used in keeping the premises in a sanitary condition.
G. Method to be used in keeping the dogs and/or cats quiet.
H. An agreement by the applfcant that the premises may be inspected by
the City at all reasonable times.
3. Issuance of License.
The City shall have discretion in determining �rhether or not to issue a
license. In making such determination, the City shall take into
consideration the adequacy of the housing, the runs for the animals, the
method used for sanitation� the method used to keep the animals quiet, the
facilities for containing the animals and with partieularity, any
violations during the previous license period.
u. Kennel License Fee.
The annual license fee and expiration date shall be as provided in Chapter
11 of this Code.
5. License Revocation.
If a license is granted and the applicant thereafter f ails to comply With
the statements made in the application or any other conditions reasonably
imposed, or violates any other provisions of this Chapter, the licensee
shall be notified by mail and given ten (10) days to remedy any defects or
defaults. If such condition is not remedied in ten (10) days, a hearing
shall be held �tLtt at least ten (10) days �'ter mailed notice to the
licensee. �n� The licensee and all other interested partiea shall have the
Qpo�ftt�i�y to be heard. If it shall appear that said kennel is not being
properly maintained, the City may revoke the kennel license and the keeping
of three (3) or more dogs, three (3) or more cats, or any combination of
three (3) or more dogs and cats shall be immediately discontinued.

101.t5. ANIMAL CQNTROL OFFICER
1. Appointment.
The City may appoint such person, persons or firm as the City may deem
necessary and advisable as Animal Control Officer. Such appointees shall
Work under the supervision of the Fridley Police Department and shall be
responsible for the enforcement of this Chapter.
2. Duties.
Animal Control Officers are authorized to enforce the provisions of this
Chapter and other related ordinanees, Chapters and statutes pertaining to
animal control, including the issuance of citations.
3. Unlawful Acts.
It shall be unlawful for ar�y unauthorized person to break into an animal
shelter, or attempt to do so, or to take or set free any animal taken by
the Animal Control Officer in the ���h�I�ddE� g�iforcement of this Chapter,
or in any way interfere With, hinde.r or molest such Officer in the
discharge of his or her duty under this Chapter.

101.16. GOARD DOGS
1. Businesses located xithin the City and maintaining a guard dog for
security purposes shall post notice at the entranee to the premises xarning
of the presence of said dog.
2. Businesses maintaining a guard dog shall file With the City a release
authorizing the police or fire departments to shoot said dog in an
emergency situation, if necessary, in order to allox the police or fire
fighters to gain admittanee to the premises in the performance of their
duties.
101.17. SEEING EYE DOGS
Whenever a blind person accompanied by a°seeing eye" or guide dog presents
� himself/herself for accommodation or service on any public E��Sf��� 1!E!
�,ransit v�hicle or to any ��ltE,� restaurant, store or other place of
business open to the publfe, it shall be unlaWful for the �S�"d�t�EZOI"�
owner, manager, operator or anv emolovee of such vehicle or place of
business to refuse admission to the dog or service to the blind person.
101.18. CRUII.TY TO ANIMALS
Minnesota Statutes 346.20 through 346.34 are hereby adopted by reference
and shall be in full force and effect in the City of Fridley as if set out
here in full.
101.19. RII.ATZON TO OTHER LAW
The prohibitions contained in this Chapter shall be in addition to any
State or Federal law regarding the same or related subjects.
101.20. PENALTIES
Any violation of this Chapter is a misdemeanor and is subject to all
penalties provided for such violation under the provisions of Chapter 901
of this Code.

City. These provisions establish permitted signs, temporar��

Use Permit.

Specific Pravisions pertain to the Residential: CR-1; C-1. C-2, C-3;
N�1. M-2; and P, Pud Districts; and Shopping Centers and Multi-L'se
Buildings. Former specific rewlations for C-1S and C-2S Districts
have been el iminated.
D. SIGN PER!•�IT RD�iJIR�'!E[VTS
1. The sign erector must apply for a permit before displaying any
sign unless such sign is exempted. Exempt signs must conform with
the other provisions of this Chapter.
2. Application for the permit is made on forms pravided by the City.
3. A permit is void unless the sign is erected within 90 days of
issuance or an extension is granted.

No person or finn shall erect signs as a business unless the City
Co�cil has appraved a lioense to do so.
F. I�DGAI, N�]4�NFORMING SIGNS
Arry sic� not conforming with this Chapter is permitted if it was
covered by a sign permit or. if no permit was required, it cor�plied
with former applicable law. Such si� loses its legal nonconforming
desic�ation if it becomes less in conpliance with this Chapter, is
relocated or replaced, or is damaged at more than 50$ of its value.
G. VIOLATIONS
1. Ariy si� that does not cor�ply with this Chapter or that is a
hazard is a violation of this Chapter.
2. A written notice of the violation shall be issued by the City to
the property owner. A copy shall be sent to the permit holder if
different than the property awner.
3. �e property awner has 20 days to remove the sign or bring it
into compliance with this Chapter. Otherwise. the City may remove
the sic�. Renaval exgenses shall be assessed against the property.
4. Any sign which is an ir�nediate public hazard may be renoved by
the City after a reasonable attg^pt to have the property owner r�,ove
the sign.
5. Any violation of this Chapter is a misuemeanor. Each day the
violation continues is a separate violation.
H. APF�LS
Permit applicants may appeal the City's interpretation of this
Chapter by filing a variance application an� requesting a hearing
before the Appeals Commission. The Commission will make its
recom¢nendation to the City Council on the variance when it is alleged
the City has errored in its interpretation or where the strict
enforcement of this Chapter would cause undue hardship.

effect of shifting the revenue burden of telephor�e service among metropolitan
custaners with little or no regard to the cost of the service provided or

WHERF�S, the effect of these rate territories could have a detrimental effect
on future mutual 000perative efforts of inetropolitan communities because of
the differential cost burden these "tiers" establish,

opposes the establishment of telephone rate territories (Tiers) by

WHEREAS, the Gavernor's Connnission to review the Metropolitan Waste Control
Canmission has made certain investigations and conclusions based on these
irivestigations which should improve the servioe and responsibility of the NWCC
to the m�nber co�nmunities which it serves; and
WHERF,AS, the City of Fridley is or�e of the cammunities serviced by the MwCC
which would like to have more input into the decision making process which
effects the rates Fridley residents pay for sewer service.
NOW, �iEREFORE. BE IT R�SCGVID, that the City Council of the City of Fridley
urges the Gavernor to pursue the findings of the commission delega�ted to
investigate the Metropolitan Waste Commission policies and operating
procedures to help the NBn1CC become more efficient and responsive to the

The demand for increased mechanical research and development on Onan's
current and future products presents an immediate space requirement to
house the research engineers and technicians immediately adjacent to the
mechanical laboratories. This space will take the configuration of two
24 by 60 modules and one 12 by 60 module (existing). Our current esti-
mate would indicate this space will be required through mid 1986.
As the attached piot plan indicates, these structures would be immediately
south of the J.C. Hoiby Technical Center and will provide work stations
for approximately 30 people.
Therefore, Onan wiil require a trailer permit for the above mentioned
sturctures through mid 1986. The approximate date for installation is
May 1, 1984.
I will be in attendance at the council meeting on February 6 to answer
questions they may have regarding this matter.
