unanimously and the public hearing opened at 7:45 p.m.
Mr. Flora, Public Works Director, stated the original plat p�esented to the
Council included develognent on both Blocks 19 and 20 of Fridley Park. He
stated, since that time, the petitioner has eliminated Block 19 from
o�nsideration.
Mr. Flora stated the request before the Council calls for seven buildings,
with a total of 28 units, based on the lof t home concept. He stated the
plat calls for a berm along 61 1/2 Way to reduce the impact on the R-1
property to the north. He stated access to the c7evelopnent would be on 61st
Way with an energency exit only to the north.
�uncilman Barnette asked if there was some signif icance in the fact that
the buildings are oontiguous to each other. Mr. DeGardner stated this makes
a nioe private oourtyard and if they w�ere separated, oertain setbacks would
probably be required.
Councilman Schneider asked if garages were required. Mr. Flora stated in an
�3 district, garking spaces are required, but not garages.
Mayor Nee asked Mr. DeGardner if he would be selling individual units. Mr.
DeGardner stated this is the glan and these units would be governed by an
association.
Mr. DeGardner stated in the original plan, they were going to install
garages as a buffer. He stated if the Council wishes, they can install
these garages, hawever, it would raise the prioe of the units about $3,500
which may make then unaffordable to some people.
Mr. Herrick, City Attorney, stated if Council required one- half garage per
unit, 14 garages would have to be wnstructed and space vould be designated
for an add.itional 14, if the demand is there.
Mr. DeGardner stated this would be possible as he stated there is space for
the garages.
Councilman Schneider asked if the property is rezoned to R-3, if there would
be a need for any variances for the density as proposed. Mr. Flora stated
there would not be a need for any variances, however, this is based on
adding one lot which was declared as excess by the CAUncil.
NJr. Laxy Mewhorter, 39 62nd Way, questioned where the lot came fran to which
Mr. Flora is referring. Mr. Flora stated it was City-owned property which
the Council has declared excess.
1�ir. Mewhorter asked where a park would be located in this area. He stated
he understood there would be money f rom this development going towards a

Mayor Nee stated either money or land is requried to be given and most of

the cievelopers give money.
Mr. Mewhorter stated Mr. Nielson, the owner of the property, has worked with
the residents on this plan and the density has been reduced. Ae stated his
�noern is the bernn �uld be higher, the anergency exit moved to the east a
little for better protection frcm headlights, and gark facilities should be
pravided. He stated children in the area used this property as a
playground, as they have no park facilities.
Mr. Richard Soj, 65 61-1/2 Way, stated he also felt the �nergency driveway
should be maved a little to reduoe the impact on the residents across the
street and that the berm should be extended farther.
Mr. Roger Berkholz, 6103 East River Rpad, stated it would be better if the
berm could be extended to the west and questioned where the children are
going to glay.
Mr. Qureshi, City Manager, stated the playground that serves this area is at
Stevenson School. He stated this was the purpose of putting in a stop sign
at the intersection to allow children to cross East River Rpad to get to the
school .

facilities for very young children, as older ones probably cross East River
Road to the g�rk areas.
Mrs. Betty Berkholz, 6103 East River Road, stated her concern is the play
area that will be lost with this develognent. She f el t they needed
playground facilities in their area for the young children.
Mayor Nee suggested they sutmit their request to the Park Board which makes
..,�reeonunenclations to the Oowlcil on haa to best serve each neiqhborhood with
�rk f acil ities.
�uncilman Fitzpatrick stated every neighborhood that has a gark today began
tr� going to the Park Board.
Mayor Nee stated he felt it would be beneficial to talk to the Park Board
and raise this issue.
No other persons in the audience spoke regarding this proposed plat.
MOTION by Councilman Fitz�xitrick to close the public hearing. Seconded by
Councilman Barnette. Upon a voioe vote, all voting aye, Mayor Nee declared
the motion carried unanimously and the public hearing closed at 8:17 p.m.
Mayor Nee stated he felt staff could work with the petitioner on the
oonoerns regarding extension of the berm and placement of the emergency
exit. .

unanimously and the public hearng opened at 8:17 p.m.
Mr. Qureshi, Gity Manager, stated the proposed budget is $?,635,948 which
represents a 3.79? increase wer the 1984 budget. He stated it is proposed
to oollect 1.7$ additional tax revenue fran property taxes and the rest of
the funds would come from fees, service charges, and intergoverrnnental
revenue.
Mr. Qureshi stated the operating portion of the budget is $6,807,943 or a
3.89$ increase. He stated there is some increase in legal services because
of the prosecuting for DWI's. He stated this, in turn, however is
vounterbalanoed with fines reoeived.
Councilman Scluieider asked if this budget proposes ariy increase or decrease
in staff. Mr. Qureshi stated so�ne permanent servioes may be cut, but would
be oangler►ented with tenp�rary or oontract �ervioes.
No persons in the audience spoke regarding this proposed 1985 budget.

4. RFSOLU'i'TON NO 98-1984 REORDERING ADVERTISEMENT FOR BIDS: MOORE LAKE

Mr. Flora, Public Works Director, stated the consulting engineers have
reviewed the bids prewiously received and talked to the contractors. He
stated it is believed more favorable bids oould be reaeived by breaking dawn
aertain pQrtions of the prooess.
Mr. Pete Willenbring, representing Hickok and Associates, stated two bids
had been reoeived for the Phase II restoration proj ect .of Moore Lake. He
stated this project is, basically, a number of sub-projects where these
subcontractors would be associated with the general oontractor. He stated
it was fo�d these general contractors were not familiar with areas which

weuld be oangleted by subcontractors and, oonsequently, the bids were much
higher than anticipated.
Mr. Willenbring stated he talked with these subcontractors on individual
items and felt, if they w�ere allowed to bid separately for each of their
specialties, a bid would be received that reflects the engineer's estimate.
Mr. Willenbring stated the dredging proposed is fairly minimal and which
mec,hanical dredging was oonsidered to be less oostly they are including an
option using hydraulic dredging.
Mr. Willenbring stated the EPA clean lakes grant would run through 1986 and
felt the project would be substantially complete by the fall of 1985 and
di.dn't believe an extension would be needed. He stated this time schedule,
rather than June 1, 1985, would also allow the contractors more time to
oamplete the work.
Go�cilman Schneider pointed out this was suppose to be oangleted in 1980 or
1981, but there has been a sicyzificant amount of delays. He asked if they
can't get the permits or the bids are too high, etc., if they can hold
Hickok and Associates resp�nsible for this task to �ane to oanpletion.
Mr. Willenbring stated he would prefer to see no more delays. He stated one
of the.reasons this project was delayed was to obtain the DNR permit which
took six months.
He stated, as far as making sure the project is f inished, a performance bond
is required f ran the oontractor. He also stated there is the possibility
the bid may not be within the engineer's estimate, as this isn't standard
work and marYy contractors are oaning in frcm out of state to do the project.
Mr. Willenbring presented sane facts shawing haw the quality of the lake has
imprwed sinoe the project began in 1978 and what data was necessary in
order to obtain the grant. He stated a Iot of monitoring of the lake has
been cbrie c7ver the last five or six years and based on these facts, it is
apparent the kind of reductions they anticipate.
Mr. Willenbring stated they hope to reduoe the phosphorus concentration to
about .03 in moore Lake which would give then a metamorphic level, or water
quality le�vel ooanp�rable with 4rhite Bear Lake. He stated their restoration
project addresses the cause of the problen which is the nutrient input to
the lake. He stated they have shawn phosphorus was the limiting nutrient
and broke it cbwn to where it was oorning fran and rec.cxn¢nended techniques to
handle the problem.
He stated these have been apprwed by the N�CA and the EPA and the lake will
be imprwed by renaving the nutrients.
Mr. Dave Ruecher�meister, representing Clean Flo Laba.ratories, appeared
before the �uncil to expalin their method for the restoration of Moore
Lake.

Mr . Ruechermeister explained thei r pr opo sal woul d be to instal l mul t i pl e
inversion oxyqenation equipnent to aerate the lake as well as using an altun
oocnpound and dye.
Mrs. Ingebrigtsen, 5811 W. Nbore Lake Drive, asked haw the dyes would affect
the lake and swinming. Mr. Ruechermeister stated it would tint the water
ar� would be put in the lake in small quantities. He stated it would be
i�arm,less to fish and swimners.
Mrs. Ingebrigtsen questioned if this would have to be done on an annual
basis.
Mr. Ruechermeister stated this prograan would prevent the weed growth so it
woulc�'t be neoessary to do ariy weed harvesting.
Mr. Ruechermeister explained they are el iminating the nutrients f ram the
sediment through oxygenation of the water f ran the top to the bottom of the
lake, and through biological. decomposition of the sediments, breaking down
nutrients that would be available for plant growth.
Mr. Kuechermeister stated the type of prograQn they have been implenenting in
a n�nber of lakes represents a long-term solution to the problem. He felt
this was important as opposed to short-term solutions, and the Council
should talk to representatives in other communities where they have
initiated their restoration prograQn.
Mr. Kuechernneister stated, basically, they are working with plant nutrients
i.n the lake and by installi.ng the inversion oxygenation equignent, it will
oxygenate the water and will eli.minate the nutrients and they will be
chenically changed to forms that are unuseable for glant grawth. He stated
by increasing the oxygen, it creates a 1 imiting f actor f or pl ant and al gae
growth and, in addition, an alu�n oanpound would be ac7ded to further reduce
the potential for glant grawth.
He stated the use of the dye would keep the nutrients in suspension so they
can be deactivated through the inversion oxyqenation process. He stated
their program is a combination of the inversion oxygenation process,
buffered al�n acmpound, dye and micro-organisms seeded in the lake which
began to work on the organic sediment and dec�ompose it.
�uncilman HaQnernik asked if the aeration would be an orrgoing prooess. Mr.
Ruechermeister stated it would be an orrgoing process, however, it may be
possible to cut back on this prooess in the winter months onoe water quality
is achieved. He stated there isn't a clear cut answer, but possibly it
oould be run on a limited basis in the winter and on a f ull sy stem in the
su�aner months.
Mr. Ruechenmeister stated the water quality could be improved and the
sediment in the bottan would be reduoed by six to twelve inches per year.
He stated once they oxygenate a lake, an environment is created that
supports organisms for a biological deoocnposition of the muck or sediment.
He stated what happens is they are establishing a food web which f avors the

animal fooc9 chain over the glant food chain.
�uncilman Scfineider stated there is aonvincing evidenoe on the surfaoe that
aerating makes a dra¢nactic impact, hawever, he would like to see before and
after figures on what they feel is sic�ificant in their restoration prooess.
Mr. Qureshi, City Manager, questioned Mr. Ruechemneister on what chances
their proposal would have in obtaining f unding f rom EPA. Mr .
Ruechermeister stated he felt the odds are relatively high. He stated they
had two projects reoeive fu�ds through the EPA.
Mr. Qureshi asked about the time period to reoeive apprwal fran the EPA.
Mr. Ruechermeister stated this would depend on the 000peration reoeived f rom
the �onsulting engineer in revising the existing application to apply their
restoration techniques.
Councilman Schneider stated the N�CA does not seem to favor this proposal
and all grant applications must first go through this agency before going to
the EPA.
Mr. Kuechermeister stated this would be something that would have to be
dealt with.
Councilman Schneider stated he f elt the process f or the Moore Lake
restoration should not be delayed ariy further and the resoluton should be
adopted to readvertise for bids. He stated, hawever, by the time these bids
are reoeived, Mr. Kuechermeister may have actual data on results of their
other projects for lake restoration.
Mayor Nee statecl the Cotuicil's going out again for bids does not negate any
of this discussion with Mr. Kuechermeister.

Mr. Willenbring stated in their six years of m�nitoring data, it has shawn
that oxygen is not a problen in the shallvw areas of the lake and an aerator
would not supply acYy more oxygen. Ae stated, as far as decomposition of
plant material to limit the growth, micro-organisms do consume organic
material, however, he hasn't seen any documented studies indicating what
rates oould be achieved.
Mr. Willenbring stated an iriversion aerating devioe woul d 1 eave open water
in the winter which he felt was a oonoern of the City.

Qouncilman Schneider stated the Moore Lake restoration was begun on the
public portion on the east side of the lake, hawever, he feels something
should be done in the west basin. He stated he can sympathize with persons
living on the west side of Moore Lake, but is concerned with the specif ic
direction outlined in the petition. He stated there is not a simple answer
for a solution to the problen.

Mr. Earl Hoyne, 820 W. Moore Lake Drive, stated there is a far greater need
to clean up the west basin, as the east basin has a lot more shallaw water.
Mr. Hayne stated Connie Metcalf did most of the work in circulating this
petition and it was sicgied strictly by persons who live on the lake and have
a more direct interest.
He stated he felt the lake has been neglected and possibly one good weed �
harvest would be a beginning, as they completely oontrol the surface of the
water.
Mr. Hoyne felt the west basin should reoeive a test af the dye system as a
means of filtering the sunlight to retard weed grawth. He stated they need
to v�ntrol the heavy vine-like graath that comes f ram the bottom of the
lake.
(7ouncilman Schneider stated Connie Metcalf stated a n�anber of residents were
op�posed to any chenical treatment.
Mr. Hayne stated he believed you would fi.nd this among any of the population
where chenicals of any kind are used. He felt i.f they are used by persons
who knaw what they are cbing and appratal reoeived f ran the LrIR, he would be
in favor of it. '
Mr. Harols Unglaub, 830 W. Moore Lake Drive, felt the lake was dangerous to
high school students canpeing in the lake because if the canaoe would tip
over, they w�ould be�e entangled in the weeds.
Mr. Ingebrigtsen, 5811 W. Moore Lake Drive, stated he has lived on Moore
Lake for the last 29 years and when they first moved here, the lake was
clear. He stated a chenical was used on the lake several years ago making
the lake like thick pea soup. He stated this chenical killed a lot of the
wildl.ife. He stated whatever they do, chesnicals shouldn't be used. He
stated right naw the lake is clear.
Mrs. Ingebrigtsen, 5811 W. Moore Lake Drive, stated she questions what use

the Ci.ty wants for the west basin of Moore Lake. She stated they did not
sic� the petition as they felt there isn't a real problen.
�uncilman Sc.hneider stated he does not see the west side as any public use

indicates they want the west basin to be enjoyed for canoeing and
� sailboating.
Mr. Rawland Jaoobson, 5851 W. Moore Lake Drive, stated he felt the City
should be looking at the entire lake and not just the east basin. He felt
the problen of restoring Moore Lake involves the entire community and not
just the persons living on The lake. He stated the lake has been neglected
for 20 years and after this amount of time, it will cost to restore it.

all of Lots 4-10 and 14-20, Block 20, Fridley Park. This action requested
to allow the constrution of tWenty eight loft home units.
IN CONSIDERATION of this rezoning approval, the City and the
Owner/Developer, do hereby agree as folloxs:
1. The Owner/developer xill revise the berm layout on 61 1/2 Way so
as to bloek headlights from shining into the adjacent homes.
2. To accomplish Item #1 the Owner/Developer Will shift the Fire
Truck emergency egress to the east. A curb cut will be provided
in the parking lot and Class V xill be installed under this
emergency egress. No curb cut Will be provided in the street.
3. The Owrner/Developer agrees to construetion nine new garages with
the initial construetion of housing. These garages xill be
located in the southeast corner of the proposed lot. The garages
shall be finished in a similar fashion as the Loft Homes so as to
be consistent in character.
4. The Or�ner/Developer Will provide to the City and register With
Anoka County a copy of an executed Towhouse Protective Covenant.
5. The Ow►ner/Developer �ill submit for approval a complete landseape
and irrigation plan.
6. The Owrner/Developer Will submit for approval a drainage plan
7. The Ow►ner/Developer agrees to purehase and rezone to R-3 Lot 1 1,
Block 20, Fridley Park. Purchase price shall be �1,000.
8. The OWner/Developer Will provide a Performance Bond in the amount
of �10,000.
g. �The Owner/Developer agrees to pay the City a Park Fee of �500.00
per uuit, or �14,000 for the twenty eight units. Thia payment is
due prior to the issuanee of ar�► building permits.

10. The Owner/Developer agrees to build only the types of units
described as Loft Homes. These to consist of twenty eights units
of housing divided into the following arrangements: a. three
eonnected groups of four units each b. t�o connected groups of
four units each c. t�o groups of four units.

binding and enforceable against the parties hereto, their succeasora and

The Council of the City of Fridley does ordain as follows:
SECTION 1. Appendix D of the City Code of Fridley is amended as hereinaf ter
indicated.
SECTION 2. The traet or area within the County of Anoka and the City of
Fridley and deseribed as:
That part of Lots 3 and 21, not taken for highWay purposes, and

I am requesting a revised plan hearinq before the council
reqarding the rezoning and preliminary plat approval for the
Loft Homes of Fridley.
I have met with all the concerned neighbors and have
changed our original plan to meet their major objections.
l. Density- we have reduced the oriqinal over all
re�uest to 28 from 54 units. We have withdrawn our
proposal of building any units north of 61 1/•2 Nay.
I also reduced the number of units that we proposed
to build between 61st Way and 61 1/2 t+lay, to 28 from
32.
2. Traffic- we have progosed one main entrance to the
South and an emergency exit to the North which would only
be used in emergencies.
3. Screening- we propose to install 2 large 5 foot berms
to the North with planing for the purpose of �artially
screening the view of the buildings from the North.
Z hope the additional meetinq with the neiqhbors have
solved their major concerns.

Mr. Robinson stated they are basically talking about two parcels of land--
3.08 acres combined. The proposal is for eight 4-unit garden Loft Home
apartments on the southerly portion and five 4-unit garden Loft Home apart-
ments on the northerly portion.
Mr. Robinson stated Staff's biggest concern was the lot coverage. Because
it is a difference concept. it does not quite fit into anything they have in
the Zoning Code in terms of interpretation. If these were considered 4-

plexes, they would have to have 15�000 sq. ft, of lot per 4-plex. As such,
the southerly portion would only allow for five units as opposed to the
. eight being propased. The northerly portion would allow for three units
� as oppoed to the five being proposed, for a total of eight (13 being proposed).
�� Mr. Robinson stated Mr. DeGardner feels these are not 4-plexes, but are
garden-type apartment dwellings. If this was a townhouse development which
would fit under a special single family district, he would be required to
have five acres. With that, if it was rezoned to R-3, he could build
3,000 sq. ft. per unit or 12,000 sq. ft. per 4-plex. On the southerly
portion, he would be allowed six units as opposed to eight. On the northerly
portion, he would be allowed four units as opposed to five. for a total of
ten.
Mr. Robinson stated that if these units are considered apartments. since
they are attached, he wou]d be allowed to build as proposed� 2.500 sq. ft.
per unit or 10,000 sq. ft. per 4-plex for 8 units on the south and 5 on the
north.
Mr. Robinson stated City Staff felt it was really a townhouse-type develop-
ment and, as such, should follow the townhouse density which is 12,000 sq, ft.
with a variance to allow for the new concept.
Mr. Robinson stated Staff had some concerns on parking as laid out in the
proposal. The petitioner shows 9 ft, stalls. The City requires 10 ft. stalls.
The petitioner meets the minimum amount of parking stalls, but thev are
substandard and they would have to rework the parking with additional
setback requirements.
Mr. Robinson stated another Staff concern was the petitioner needs a 15 ft.
buffer space between the hard surface area and the adjacent R-1 zoning.
Presently, only 5 ft, of buffer space is shown.
Mr. Rubinson stated a concern expressed by Engineering was that Ashton Ave.
may require additional easement for possible widening if this project
progressed. That was something that was not clearly defined at this point.
Ms. Schnabel asked if the sewer and water were adequate for a development of
this type. .
Mr. Robinson stated he believed that because of the industrial zoning
nearby, that the water and sewer were sufficient to handle a development of
this type. However� this was something the Engineering Dept. should check
into.
Mr. DeGardner stated that when he first brought this concept ta Coon Rapids,
they expressed the same concerns being expressed at this meeting--whether
it is a 4-plex or townhouse development. After discussions and looking at
the concept, the Coon Rapids Planning.Carmission concurred that this concept

was far superior to the box-type apartments. He stated this concept meets
all codes. -
. Ms. Schnabel stated that where the Loft Homes are located in Coon Rapids.
: it is a much more open area, and there isn't any residential around it like
• there is in Fridley. She felt there was a big difference between the two
sites.
Ms. Gabel stated she did go to Coon Rapids to look at the development there.
She, too, liked the concept, but did not think it was correct for this piece
of property.
Mr. Saba asked about the storage of a boat, tent trailer, etc.
Mr. OeGardner stated the owners can have 1-2 garages built if they want.
The code requires 12 stalls per unit for parking. If an �wner has a boat,
it is usually stored off the property. The association would regulate such
things as outside storage, parties, etc., so these units would be self-
governing. Actually there is more control than there is with single family
homes.
Mr. Minton asked about the height of the buildings since that seemed to be
a concern expressed by the neighbors.
Mr. DeGardner stated each unit was a 2-story unit with a peak, It would be
similar to an expansion-type house with a peak. He would guess the height
at the peak was 26-28 ft.
Mr. Robinson stated the limit on height in R-1 zoning is 30 ft.

in the northeast corner of the lot and is intended for hobby use and storage
only. Total square footage of the footprint of all the buildings on the lot
is 2,325 sq, ft. The lot is 10,950 sq. ft., so the lot coverage is 21% which
is considered acceptable by .city standards. He stated Staff had no stipulations,

Mr, Robinson stated this property was located on the northeast corner of
63rd Ave. and Highway 65. The zoning was C-2, It was rezoned to C-2 in
1979, and in conjuction with the special use permit, there was an allowance
made for a garden center on the south end of the property. Since that time,
the owner has also stored boats on the north side of the property with
additional outside storage of canoes and boats. Staff felt there should be
a special use permit on this also as it was not covered in the �original
conditions of the rezoning aad special use permit.
Mr. Robinson stated there has been some significant improvements to the
property since Mr. Holmer has taken over, but there are some additional
things Staff would like to see done with this special use permit:
1. Wooden fence around property in need of maintenance and staining
2. Provide a screened dumpster location with a solid wood fence
on all sides.
3. Mulch all planting beds
4. Plant vines on chain link fence where possible.
5. Stripe parking lot.
6. Provide a timetable pertaining to the provision of finalized site plan

Mr. Robinson stated the property was located on the southwest corner of
Fairmont and East River Road. It was a vacant service station and was
zoned C-1. At this time, a special use permit was being requested because
a special use permit was required for fuel dispensing. Adjacent land use
consists of commercial to�the north and single family housing on all other sides.
Mr. Robinson stated the vacant service station is in rather a grim state
of disrepair. The petitioners are going in with tiie knowledge that there
are a significant number of code requirements. They have agreed to do
extensive landscaping along Fairmont and East River Road. Major remodeling
is needed to the station itself for a corrmercial/retail "stop and shop"
type of outlet. The plans for the facade are preliminary with new siding
and new signage display on top.
Mr. Robinson stated Staff would recomnend the following stipulations:
1. Applicant to work with the City on finalization and approval of
landscape/site plan.
2. Test and/or replace all underground tanks.
3. Provide interior concrete Curbing.
4. Extend fence along residential area on the south to east
property line (to be 4 ft, high in front yard, 6 ft. in
other yards)
5. Provide 17 ft. road easement along East River Road for possible
future use by the County.

7. Provide a$5,000 performance bond prior to issuance of building

Ms. Schnabel asked if the petitioners had any questions regarding the
above stipulations.
Ms. Patricia Holcomb stated she questioned the 17 ft. road easement since
this would run into existing islands on the property.
Mr. �obinson stated it has been the City's policy to acquire easement in
conjunction with the County for possible widening of East River Road. This
was consistent with requesis of.other-businesses along East River Road.
Ms. Gabel asked about the hours of operation.
Ms. Bernadette Benson stated they did not know what hours the store would be
open at this time. This could be discussed with the City Council. She
stated they had originally planned to be open from 6 a.m. to 12 p.m., but
were approached by some neighbors asking that they stay open 24 hrs. a day.
She stated they certainly would like the option of staying open 24 hrs. a day.

Ms. Schnabel stated that regarding lighting of the building and the property,
one of the Planning Commission`s concerns was that the lighting not be
focused into adjacent property's homes.
Ms. Holcomb stated they have been looking at a type of lighting that shines
down onto the lawn rather than out into the street or adjacent properties.
She stated there is good screening of the homes of the adjoining properties
and there are streets on two sides of the property.
Ms. Schnabel asked if anyone in the audience would like to comnent about
this special use permit request.
Mr. Larry Miskowiec, 440 Ely St., stated that because this business would
increase the amount of traffic going in and out of the station, he was
concerned about the children getting off the school bus at the bus stop on
Fairmont. He questioned whether there would be a need for a stoplight
because of this new business. He stated a lot of people try to make it in
the gas station business, and it was his concern that this business may not
go and the property would be vacant again. His last question was that if
this business was to remain open 24 hrs. a day, would this become a hang-out
for kids and video machines?
Ms. Holcomb stated she currently runs a store for a major oil company and
has been in the business for 18 years. She stated video games are the worst
thing they could put into a store like this. As far as it becoming a hang-out
for kids, there is no problem as long as they set the rules right away--that
this is a store and they are to go in and out. There will be no reason for
the kids to hang around, and they will make sure of that, because kids hanging
around a store is the worst thing they could have for a business.
Ms. Myrna Kostuch, 8027 Fairmont Circle, stated she would also be concerned
for the children who get off the bus on Fairmont Circle. She s;ated she
would like to present to the Comnission two petitions with signatures of those
against this special use permit for the following reasons:

Ms. Kostuch stated that because of more people going in and out of this
new business, there would be more traffic criss-crossing East River Road
rather than going straight. She stated they have no trouble with what is
existing. �
Ms. Holcomb stated the County is already reviewing the possibility of
putting lights at Fairmont and East River Road.
Mr. Robinson stated the City has talked to the County and has asked the
County to comment on the possibility of a traffic light. The County intends
to do traffic counts to see if this intersection warrants a light.
Mr. John Wright, 563 Ely St., stated he has lived in this area for 26 years.
He stated if the petitioners want to put in a gas station and convenience
store, it is not going to hurt the other stores in the area, because this
store will not have the room to carry as many goods as the other two stores.
He stated having a station open 24 hrs, a day with lights will help cut down
on crime. He did not think there would be any noise that would affect the
neighborhood. He felt this station would be an improvement to the City
of Fridley.
Mr, Fred Meinke stated he owned Meinke Foods just to the south on East River
Road. He was opposed to another store in a neighborhood where there were
already two stores. He asked about the underground tanks.
Ms. Holcomb stated the Fridley Fire Chief has approved their keeping the
tanks in the ground if they test out successfully. She stated two of the
three tanks are steel and have been in the ground a long time, so they have
chosen to take those out and replace them. They have had soil tests taken
to make sure there is no soil contamination in the soil, and those tests
have come back o.k. The other existing tank is fiberglass and is about 5
years old. If it tests out correctly, it will be left in the ground. If
not, it will be pulled out and replaced also.
Mr. Paul Beecroft stated the Commissioners had already received a copy of
his letter dated Sept. 6, 1984, in their agenda. He stated he was represent-
ing BASEnterprises, and was one of the owners of 8154 East River Road, which
was the Fridley Food Market. He stated he had nothing to do with the opera-
tion of the food store. He stated he would like to read his letter:

3. Traveling north on East River Road, one encounters a
bend in the road at Liberty St. Traffic is normally
moving quite fast at this intersection and it is a
somewhat blind approach to the intersection at Fairmont
which is the proposed site.
4. During the evening rush hour traffic. it is almost
impossible to make a left hand turn onto East River Road
northbound from the west intersections of Glencoe.
Fairmont, and Liberty.
5. I believe an indepth study should be made into the
feasibility of stop lights at the above three intersections
to determine the impact of the potential additional traffic
flow.
6. The appropriate safety steps to the elimination of road
hazards should be made rather than the compounding of the
problem.
Ms, Schnabel stated that with regard to the traffic light problem, this was
a County road, and it was really a county traffic problem. It was not a
problem the City has any control over, even though some of the traffic is
city traffic. She stated it will be the County's decision whether or not a
traffic light is needed in this area.
Mr. Robinson stated a copy of Mr. Beecroft's letter was provided to the
County Engineering staff, and the City has asked the County for comments on
Mr. Beecroft's concerns.
Ms. Schnabel stated that hopefully these comnents would be available for
the City Council meeting.
Mr. Oquist stated he appreciated the concerns expressed about the traffic,
but this new business was not going to bring traffic in from other areas.
It would be traffic that travels the road every day now. The only problem
it may cause is the traffic going into the store and getting back onto
East River Road.
Mr. Oquist stated that regarding the school bus situation, the children do
not cross East River Road, so he did not see that as a problem, A school
bus actually helps to stop traffic.
Mr. Oquist stated he would like to know what the neighborhood would like to
see done with this property. It is a piece of property that is in bad
disrepair. It needs something. No single family homes will go in on that
site; and at some point, something has to be done with the property, so they
need to look at what would be the best use of the property to clean it up
and make it a useful piece of property.
Mr. Minton stated he thought the traffic question had to be focused. The
only difference in the traffic will be the traffic going in and out of
this location, but there will be the same number of cars.

Mr. Minton stated that many of the concerns reised by the neighbors were
valid. He was more concerned about the stop and go traffic and the congestion
that might cause. However, he was not convinced they should stop the
development of this property for that reason. He was also not convinced
about the argument over the school bus situation, noise, or some of the other
reasons, so he was urging the approval of this special use permit.
Ms. Schnabel stated she was concerned about the school bus stopping, but
not in relationship to this special use permit request, because those school

over 10 years ago. This seemed a viable use for the property. She felt

is a lot of interest in roof-top mounting of smaller discs. KSTP will be
going into this, selling sateilite TV, similar to Spectrum.
Mr. Oquist stated he definitely thought this was something the Comnunity
Development Cortmission would like to look at. As Mr. Saba had mentioned,
if they are in fact going to start having some kind of smaller discs, the
City might want to look at this in advance because all of a sudden there
could be a lot of those discs on rooftops, and what would it do as far as
the aesthetics? He asked that Staff put this on the next Canmission agenda
and give the Commission members a little r.�cre information, if possible.

Mr. Minton stated that before their meeting on Thurs., Sept. 6, the
Comnission met at the Banfill Tavern and had a tour conducted by
Mary Beverage,a merr�er of the Anoka County Historical Society. He
stated an article had appeared in the Mpls. Star & Tribune that week
so there were some other people who went on the tour who were
interested in the Banfill Tavern.
Mr. Minton stated after touring the building, one of the conclusions
he had come to was that the building was rapidly deteriorating, and
there are some huge holes in the boards that cover broken windows.
One ceiling has fallen in one of the upstairs bedrooms. The second
conclusion he had come to was that it was relatively a large building
with a lot of good potential.
Mr. Plinton stated that as a result of the article in the paper, they
have had at least three serious calls from people interested in having
their businesses located in the Banfill Tavern--two of these people
went on the tour and attended the Commission meeting. One woman was
very interested in a"bed and breakfast" type of establishment and would
also live there. Another person was interested in some kind of boutique
arrangement and would live there. The third inquiry was from an arts
society in the north suburban area located in the Apache Plaza shopping
center incerested in having an art gallery and art center in the
building.
Mr. Minton stated a man attended the Commission meeting a�ho had
established a barbershop and home in an old school house in arooklyn
Center. He was interested in looking at the Banfill.Tavern for a
similar purpose.
Mr. Minton stated that right now, the Conunission is looking at the
possibility of making recorr�nendations which will probably give a number
of alternatives:
l. It could be financed by grants from the Minnesota Historical
Society.
2. It could be sold to a private individual who could take tax
advantages because it is a historical building and restore it.
3. A separate foundation could be established. The foundation
could accept contributions as well as grants for this purpose.
4. Or, there could be a lease-back arrangement with the County.
Mr. Minton stated the Comnission wants to explore these various alter-
natives, formulate their recomnendations with stipulations and bring
them before the Planning Commission and City Council before forwarding
them on to Anoka County for Anoka County to take the next step.

B. STATED HARDSHIP:
"Need a side yard setback variance to allow the proposed addition to
line up with the current building as the production flow in manufac-
turing would be seriously impaired with a jog in the production line
and the lot is too narrow to economically set the addition back 20 feet
along the south side yard setback."
C. ADF1IP�ISTRATIVE STAFF REVIEW:
This will be an extension to the wall of the existing building. If
the Board recommends approval, it should be stipulated that the new
wall be a four-hour rated fire wall with protected openings.
Mr. Burch stated the petitioner plans to add a small addition to the back of
the building, and it makes sense to line up the building as proposed.
Mr. Jim Faulkner stated he was the architect who prepared the plans for
Gerald Johnson. Mr. Johnson was requesting to continue on the new addition
in line with the existing building line. As stated in the Administrative
Staff Report, they need the side yard setback variance to allow the proposed
addition to line up with the current building in order to get the manufacturing
flow of the facility to work.
Ms. Gabel asked Mr. Faulkner to explain what he meant in terms of "manufac-
turing flaw".
Mr. Faulkner stated Johnson Wood Products was a manufacturer of custom wood-
working for commercial, residential, and institutional buildings. Part of
their building plan was to add new machinery,new equipment, and redesign
their manufacturing process from the point where material comes in the build-
ing, goes through the building, and back out through the loading docks. To
make that manufacturing flow work, the products have to come in and go all the
way down a manufacturing line and then come back around. With a jog in the
building, it would cause a problem trying to bring the materials around and
then bring them back through. It was kind of standard in any manufacturing
process to want product lines to run straight through and make a loop, and
that was the reason for Mr. Johnson's request.
Ms. Gabel asked about the exterior of the proposed addition.
Mr. Faulkner stated the addition would be brick--the same material as the
rest of the building.
Mr. Plemel asked how wide the lot was next to the praperty on the south. He
was wondering if by granting this variance they wouid be creating a hardship
for someone eventually buiiding on the adjacent lot.
Ms. Gabel stated that, after looking at the aerial photo, it was just specu-
lation as to what would go on that lot. She stated there was a lot of room

on that lot. There are some existing problems, and by granting this variance,
she did not think they would make the problems any worse.
Mr. Barna asked if the south wall in the existing building was a�-hour
rated wall.
Mr. Faulkner stated it was a 12-inch masonry wall, and under Uniform
Building Code, it does have a 4-hour classification up to about 15 ft. He
�ated this wall does have a door in it now to the boiler room. The tentative
plan was to take out that boiler room completely and block up the door. He
stated he thought the only hindrance on the 4-hour rating on the wall was the
fact that the door into the boiler room was probably just a 2-hour rated door.
If the door does not come out, it will be replaced with a 4-hour rated door.

Mr. Barna stated he could see where setting back the addition 20 ft. would
disrupt the manufacturing flow. With no new construction to the south at
the present time and the fact that this was just extending an existing wall,
as long as all the fire ratings are met and there was continuity with the
visual wall, he would have no objections to granting this variance.
Mr. Betzold stated that since the existing building was already in its
position and was probably closer to the lot line than it should be, that
can't be changed. He stated he thought this demonstrated some of the problems
that can be created by allowing this type of construction to go too close to
the lot line, but as long as the situation was not being worsened and as long
as there was a demonstratable hardship for the manufacturing line, the variance
should probably be approved.
Ms. Gerou and Mr. Plemel agreed with Mr. Barna and Mr. Betzold.
Ms. Gabel stated she also agreed. She thought part of the hardship was the
existing building being located where it was, and that added to the problem
of the flow of the product line. She would also be in favor of granting the
variance, but she would definitely like to see the Comnission add on a stipu-
lation that the door in the existing south wall be either upgraded to a 4-hour
rated door or be removed.

within the next couple of weeks. It would be very advantageous if this

Ms. Gabel stated she believed the Appeals Comnission had no problems with
this going directly to City Council on Sept. 10 and not going through the
Planning Comnission since the Planning Comnission only receives the minutes;
however, it was not the normal procedure. She suggested Mr. Burch convey
to the City Manager that there was a time problem with this item, realizing
that fall and winter are not too far away. She stated Mr. Faulkner should
call Mr. Burch to find out if this item was going to the Sept. 10 or Sept. 24
meeting.

As you are aware, Well and Pump No. 9 failed and has been pulled for inspection.
The bowls of the pump had disintegrated due to electrolysis of the well. Bacon
Electric Company was called and discovered a short in a ground wire and corrected
the problem of electrolysis.
Well and Pump No. 9 was scheduled for repair in 1986. However, due to the electrolysis
problem, the pump must be repaired imnediately. Also, it would be an opportune time
to increase the capacity of this well from 900 GPM to 1500 GPM. This was accomplished
on Wells #6 and #8 with excellent results. Therefore we completed the specifications,
calling for a complete repair and modification to the pump to increase the capacity
to 1500 GPM.
Hopefully this will elii,�inate the need to pull and repair this well for five more
years. Upon approval from Sid Inman, City Treasurer, to expend utility funds for
this project, we recommend that the City Council approve the advertisement to bid
for repair of Well and Pump No. 9. �
