On Juae 28� 1983, aayo 011 Co.� applied for a variance to install a neW
identification and price pylon aign at 7600 Qniversity Avenue N.E. This
aign would be erected along Oniversity Avenue with the existing pylon sign
Deing moved to Pace off Osborne Aoad.
The esisting identification and price aign vas erected in Septem ber, i978
and is 75 square feet. The new pyloa aign consista of an identification
aign and two price aign panels vith a total of 106 aquare feet. The total
of 183 aquare feet Sa in ezcess of the 80 square feet allowed Dy the City
Code.
Section 214.045 of tbe Sign Code permits one (1) free atanding pylon aign
per atreet frontage with a maximum of 80 �quare !'eet per develoment.
Although this portion of Lhe code is clear, there is a difference of
opinion about What portions of Lhe pylon aign ahould be included xhen
determining the total area of a aign. Section 214.045, paragraph 6, Cas
Stations� states that "One (1) gas price aign ia allowed in addition Lo one
(1) permitted as an integral part of the identification aign."
Some members of the City ataff and the Appeals Commission have interpreted
Lhis to mean that a business is alloxed 80 aquare teet of aignage and any
gas price aigns ahould not be included in the total. This aeems to be the
Appeals Commission'a decision oa this particular variance.
The otDer interpretation is that the 80 aquare feet is the maximum signage
permitted and would inelude any price aigns attached to the pylon. The
other limitation is that a aervice atation can display only two (2) sets of
price aigns on the premises. This ia the interpretation that was given to
the petitioner� 1Cayo 011 Co., wben they first applied for the variance. At
Lhis time, the atatf is looking for direction from the City Council.
The esisting Sign Code is Deiag reviewed to bring it
the ne�r Zoning Code and xhatever position Lbe Council
vill De incorporated iato the Sign Code.

He further stated that the company feels the need for an identification and pricinq
siqns for east and west traffic and �rould like a new siqn of 108 sq. ft.. Western
nam�e on top and two pricing panels (plastic-inner-lit) and their present sign is
75. sq. ft. He said they wuld like to move the present siqn to Osborne Road, which
would be back within the limits and put tt►e new siqn on the NE cornez of the property.

Ms. Gabel said the C�ission has several ooncerns and they feel the present sign is
v�ezy visible and they have recently turned down other gas stations that have asked
for additional siqns. She stated the station situated across from Western has a
60 sq. ft. siqn and they would nest probably ask for a variance foz a larger siqn
if this one is qranted. She also stated the Coaenission wa�s not clear on the hardship.
Mr. Ingram said �e marketing depart�ent of the company feels there is a lot of
tzaffic on Osborne th at does not get visi.bility from the pricing siqn. Ms. Gabel
stated the Wall sign is quite visible and asked if they investigated any alternatives.
l9r. Ingram said this is the way the company wants to go throughout their netionwide
operatinq area. Ms. Gabel asked about desiqning a different type of siqn, and if
they, have seen the Champlin station sign and if the price signs nre an inteqral part
of the desiqn they could be any size they want them to be. Mr. Clark said the Champlin
siqn is a four-sided siqn, each face abont 20-25 sq. ft and the price signs below are
the same. There was some discussion on the siqn code and Mr. Clark obtained copies
for the Commission membezs.
Ms. Gabel said the siqn code (214-9) read one gas price sign in addition to one
permitted as an integral part of the identification sign. Mr. Barna felt it meant
two gas pzice signs; one part of the a►ain siqn and an additional one. Mr. Clazk
said it could have an 80 sq. ft. ID siqn and attach gas price siqns along as part
of the identification siqn. Mz. Inqram said their present sign is 75 sq. ft. total
(identification and price signs). �lr. Clark stated that the recent zequest that
was denied for a�gas station was that their sign was a completely separate adver-
tising sign. Ms. C,abel said if the top of the western is only 22.8 sq. ft., granting
a 5 ft. variance should be enough based on their interpretation of the siqn code.
Mr. Clark said the City Council and the City Attorney's office will have to make
their awn interpretation. l�s. Gabel noted that the Champlin station sign was up
when the code �ras written.
Mr. Ingram said the shape of the siqn will stay the same and the face will chanqe
as they �rill charrqe them thzoughout the Metzo area. Mr. Barna asked if they are
allowed two pylons per lot and Mr. Clazk said yes, totaling 80 sq. ft. 1�Ls. Gabel
stated that the Commission's interpretation of tlie siqn code is that it does not
apply itaelf to the pricinq siqn.

An ordinance granting Minnegasco, Inc., a Minnesota corporation, its
sucoessors and assigns, a none�oclusive franchise to oonstruct, aperate, repair
and maintain facilities and equip�nent for the transportation, distribution,
manufacture and sale of gas enerc� for public and private use and to use the
public ground of the City of Fridley, Minnesota for such purposes; and
prescribing certain terms and vonditions thereof.

404.01 DEFIl�I�DO[1S

Minnegasvo, Inc., a`Minnesota corporation, its suooessors and assigns.
2. Gas.
Natural gas, manufactured gas, mixture of natural gas and manufacturea gas or
other forms of gas enerc�r.
3. Mimicig3lity, M�icipal Co�u�cil, M�icipal Qerk.
�Y►ese terms mean respectively, the City of Fridley, the Council of the City of
Fridley and the Clerk of the City of Fridley.
4. Public Gro�d.
All streets, alleys, public ways, utility easesnents and public grounds of the
l�icipality as to which it has the right to grant the use of the Canpany.
404.02 FR�I�ISE GII�tALLY
1. Grant of Franchise.
Zhere is hereby granted to the Canpany from the effective date hereof through
J�e 30, 2003, the right to i.mport, manufacture, transport, distribute and
sell gas for public and private use in the Munic�pality, and for these
purposes to o�nstruct, operate, repair and maintain in, on, over, under and
across the Public Ground of the Municigality, all facilities and equipment
used in oonnection therewith, and to do all things which are necessary or
customary in the accomplishment of these objectives, subject to zoning
ordinances, other applicable ordinances, permit procedures, customary
practioes, and the prwisions of tihis franchise.
2. EEfective Uate; Writt� Acceptance.
Zhi,s franchise shall be in foroe and effect ftom and after its gassage and
publication as required by law, and its acoeptance by the Company in writing
f iled with the Mtu�icipal Qerk within 60 days after publication.
3. Nonexclusive Franchise.

4. Franchise Fee.
'IIze Ca�any may be required to pay to the M�micipality, in the maizner and at a
rate prescribed by a separate ordinance, a fee determined by oollections f rom
sales of Gas, but not to exceed 5$ of the Cangany's gross revenues f rom the
sale of Gas within the M�icipality. Such ordinance tnay be adoP'ted► amended,
repealed or readopted at any time during the term of this franchise. The fee,
if required, shall be effective 90 days after written notioe of the ordinance
to the Company. No such fee shall be effective as to sales made bef ore
January 1, 1984. �he fee shall be separately stated on gas bills rendered to
c�stc�mers within the Mimicipality.
5. Publication Expense.
'�e e�ense of publication of this Cbapter shall be paid by the Cangany.
6. Default.
If the Canpany. is in default in the performance of ariy material part of this
franchise f or more than 90 days af ter receiving written notice ftom the
Municipality of such default, the Municipal Council may� by ordinance,
terminate all rights granted hereunder to the Company. 'lfie notice of def ault
shall be in writing and shall specify the provisions of this f ranchise under
which the c3efault is claimed and state the bases therefor. Such notice shall
be_served on the Carrpany by personally delivering it to an offioer thereof at
its principal plaoe of business in Minnesota.
If the Company is in default as to any part of this franchise, the
M�micipality may, after reasonable notice to the Company and the failure of
the Campany to cure the default within a reasonable time, take such action as
may be reasonably necessary to abate the aondition caused by the default, and
the Company agrees to reimburse the Mtimicipality for all its reasonable costs
and for its oosts of collection. including attorney fees.
Nothing in this section shall bar the Company from challenging the
Municipality's claim that a default has occurred. In the event of
disagreement over the existence of a default, the burden of proving the
default shall be on the M�icipality.
404.03 CCI�IDITIOt1S Og OSE
l. Use of Public Gramd.
All utility facilities and equipment of the Company shall be located,
constructed, installed and maintained so as not to endanger or unnecessarily
interfere with the usual and customary traffic, travel, and use of Public
Ground, and shall be subject to permit oor�ditions of the Municipality. The
permit oonditions may pravicie for the right of inspection by the MLmicipality,
and the Canpany agrees to make its facilities and equipment available for
inspection at all reasonable times and plaoes.
2. Pern�it Required.
Rbe Camp�any shall not open or disturb the surfaoe of ariy Public Ground for any
purpose without first having obtained a permit from the Municipality, for
which the M�icipality may imp�se a reasonable fee to be paid by the Company.
Ttie permit oonaitions imposed on the Canp�any shall not be more bur3ensane than
those im�osed on other utilities for similar facililties or work. The mains,
servioes and other property plaoed pursuant to such permit shall be located�as
shall be desi�ated by the M�icipality.

�e Ca�any may, however, apen and disturb the surface of any Public Ground
without a permit where an emergency exists requirin9 the imQnediate repair of
its facilities. Rl�e Canpany in such e�vent shall request a permit not later
than the seconc3 working day thereafter.
3. Restoration.
Opon oompletion of any work requiring the o�ening of any Public Ground, the
Company shall restore the same, including paving and its foundations, to as
good condition as formerly, and shall exercise reasonable care to maintain the
sa�ne for two (2) years thereafter in good condition. Said work shall be
completed as promptly as weather permits, and if the Company shall not
pr�tly perform and vamplete the work, remwe all dirt, rubbish, equipment
and material, and put the Public Ground in good condition, the Municipality
shall have the right to put it in good condition at the expense of the
C�any; and the Canpany shall, upon cienand, pay to the Mtuiicip�lity the cost
of such work done for or performed by the Municipality, including its
ac�ninistrative expense and overhead, together with ten percent (10$)
additional as liquidated damages. This remedy shall be in addition to any
other remedy available to the Mtaiicipality.
4. Relocation of Utility Facilities.
Zhe Company shall pra�tly, with due regard for seasonal working conditions,
permanently relocate its facilities or equipment whenever the Municipality
orders such relocation. If the relocation is a result of the proper exercise
of the polioe power in grading, regrading, changing the location or shape of
or otherwise impzwing any Public Ground or oonstructing or reconstructing any
sewer or water systan therein, the relocation shall be at the expense of the
Canpany. If the relocation is not a result of the proper exercise of the
polioe power, the relocation shall be at the e�ense of the Mimicipality. If
such relocation is done without an agreenent f irst being made as to who shal l
pay the relocation oost, such relocation of the facilities by the Company
shall not be construed as a waiver of its right to be reimbursed for the
relocation oost. If the Canpany claims that it should be reimbursed for such
relocation oosts, it shall notify the Municipality within thirty (30) days
after receipt of such order. The Municipality shall give the Company
reasonable notice of plans requiring such relocation.
Nothing contained in this Subsection shall require the Company to r�nove and
repZaoe its mains or to cut and reoonnect its service pipe running from the
main to a customer's prgnises at its own expense where the removal and
replaoenent or cutting and reconnecting is made for the purpose of a more
expeclitious operation for the oonstruction or reconstruction of' underground
facilities; nor shall anything contained herein relieve any person from
liability arising out of the failure to exercise reasonable care to avoid
c3amaging the Canpany's faci2ities while performing any work in any Public
Gro�d.
5. Relocation WhPSi Public Ground Vacated.
�e vacation of ariy Public Gramd sha12 not aperate to deprive the Company of
the right to operate and maintain its facilities therein. Onless or�dered
under Section 404.03.4, the Canpany need not relocate until the reasonable
oost of relocating and the loss and e�ense resulting fran such relocation are
f irst gaid to the Company. i�hen the vacation is for the benef it of the
Municipality in the furtherance of a public purpose, the Company shall
.relocatQ at its vwn expense.

5. Street Impzavenents, Paving or R�esurfacing.
Zt�e Municipelity shall give the Canpany reasonable written notioe of plans for
street improvements where paving or resurfacing of a permanent nature is
involved. The notice shall contain the nature and character of the
impravements, the streets upon which the improvements are to be made, the
extent of the improvements and the time when the M�micigality will start the
work, and, if npre than ore street is invoIved, the order in which this work
is to proceed. The notice sha11 be given to the Catipany a suff icient length
of time in advance of the actual commencement of the work, considering
seasonable working conditions, to permit the Company to make any additions,
alterations or repairs to its facilities the Can�xiny deens necessary.
In cases where streets are at final width and grade, and the M�micipality has
installed undergro�md sewer and water mains and service connections to the
property line abutting the streets prior to a permanent paving or resurf acing
of such streets, and the Company's main is located under such street, the
C,ompany may be' required to install gas service connections prior to such
paving or resurfacing, wheneuer it is apparent that gas service will be
required during the f ive (5) years following the paving or resurfacing.
404.04 Il�IDF?QIIFICATDON
�e Company shall indemnify, keep and hold the Municipality, its elected
officials, offioers, enplayees, and agents free and harmless fran any and all
claims and actions on account of injury or death of persons or damage to
property occasiored by the construction, maintenance, repair, removal� or
operation of the Company's property located in, on, wer, imder, or across the
Public Ground of the M�micipality, �ml.ess such injury or c7amage is the result
of the negligence of the Municipality, its elected officials, employees,
offioers, or agents. Zl�e M�a►icipality shall not be entitled to reimbursement
for its costs incurred prior to notif ication to the Company of claims or
actions and a reasonable opport�mity for the Canpany to accept and undertake
the def ense.
If a claim or action shall be brought against the Municipality under
circ�nnstances where indemnif ication applies, the Company, at its sole oost and
expense, shall defend the Municigality if written notice of the claim or
action is pra�tly given to the Company within a period wherein the Canpany is
not prejudiced by lack of such notice. The Company shall have complete
o�ntrol of such claim or action, but it may not settle without the consent of
the Mumicipality, whic.h shall not be �mreasonably withheld. This section is
not, as to third parties, a waiver of any defense or immunity otherwise
available to the M�►icipality, and the Company in defending any action on
behalf of the Municipality shall be entitled to assert every defense or
inm�mity that the M�micipality oould assert in its awn behalf.
404.05 ASSIQ1�3�iP
The Company, upon notice to the Municipality, shall have the right and
authority to assi� all rights conferred upon it by this franchise to any
person. R�e assic�ee of such rights, by accepting such assignment, shall
beoome subject to the tern�s and pro�visions of this franchise.
404.06 C�3ANGE IId P� OF OOVF1�
Ariy change in the form of gaverrnnent of the Mimicipality shall not affect the
validity of this franchise. Any gaverrunental �mit suooeeding the M�micipality
shall, without the oonsent of tt�e Canpariy, autanatically succeed to all of the
ri�ts and obligations of the I�icipality pravic3ed in this franchise.
404.07 SEVF.RAB�I'1'Y •
If any portion of this franchise is found to be invalid for any reason
whatsoever, the validity of the rest of this franchise shall not be affected.
404.08 1�ICF�
Any notioe required by this franchise shall be sufficient if, in the case of

1. Zhe franchise is granted to the Canpany from the effective date of
this ordinance through J�e 30, 2003.
2. �e Company may be required by separate ordinance to pay to the
City of Fridley a fee not to e�cceed 5$ of the Company's gross revenues
fran gas sales within the City.
3. If the Canpany defaults in performing any material part of the
franchise for more than 90 days after written notification by the City
of Fridley of the default, the City Council may terminate all rights
granted to the Campany or cure the default with costs reimbursable by
the c,ompany.
8. CYJi�IDITIONS OF USE.
1. The Company's facilities shall not endanger or unnecessarily
interfere with the usual traffic and use of the public grounds.
2. �e Company is required to obtain a permit frcm the City of Fridley
before disturbing ariy public ground surfaoe, �less an energency exists
requiring repair of facilities.
3. The Company shall restore any public ground to its former
oondition, or otherwise pay the City of Fridley for the cost of the
work, administrative expenses and 10$ liquidated damages.
4. The Comgany shall relocate its facilites whenever the City of
Fridley orders so and will incur the expense if relocation is the
result of the proper exercise of polioe pawer.
5. Vacation of any public ground shall not deprive the Canp�any of the
right to operate facilities thereon. The Company shall not relocate
imtil the City of Fridley pays its reasonable expenses and costs of
relocation.
6. Zl�e City of Fridley shall give reasonable written notice to the
Company of street improvenent plans.
C. 0►II�iER PRWISIONS.
1. �e Company shall inc7emnify and hold the City of Fridley and its
officials and enplayees harmless fran claims on account of persons'
injuries or death or damage to property caused by the Company's
operations �mless such occurre�ce is due to the City's, its officials'
or its emplayees' negligence. �e Company shall defend the City of
Fridley against any claim or action for which the indemnification
applies. _
2. �e Canpany, upon notioe to the City of Fridley, has the right to
assic� all franchise rights to any person.
3. Changes in the City of Fridley's goverrunent shall not affect this
franchise's validity.

Onan Corporation has submitted another request for temporary trailer office placement
on their property.
The desire to make internal changes in their major plant and office building requires
temporary offices during that work. They desire to install a total of six trailers
configued in two groups of three for a three year period.
We have previously submitted these temporary request to the City Council for their review
and approval.
For some time we have attempted to obtain a 15 foot bikeway/walkeay easement along 73rd
Avenue from Onan. I gave another copy of the easement agreement to Mr. Nelson at Onan
yesterday, but have not been successful in receiving an executed copy.

Onan is presently preparing to renovate approximately 2,500 square feet
in our existing facilities in order to increase technical research for
development of new electrical products.
This renovation will require office personnel to be relocated, consequently
utilization of temporary office structures is necessary.
The location of these structures will be to the north of our existing
engineering building and will house approximately 50 people (see attached
plot plan).
Onan will require a three year trailer permit for the above mentioned
structures. As timing on this project is critical, Onan appreciates the
expeditius response from the council.

1. RECEIVE UPDATE REPORTS FROM STORER: �
a. System Ownership Status
Ms. Nughes stated she would like�to introduce to the Carmission
Walt Berdnik, who has replaced Tom MacColl as District General�Manager
handling Fridley, Bloomington, St. Cloud, and St. Louis Park.
Mr. Belgum asked Mr. Berdnik to give a brief summary of his background.

Mr. Berdnik stated he was born and raised in Pittsburgh, Pennsylvania.
From there he moved to Ft. Myers, Florida. which he consider6 home.
Around 1969 he started in cable 7V and has been in cable TV ever since,
He started with Storer a little over four years ago in Hollywood,
Florida, as an instruction coordinator. He built a new system in
Hollywood, Florida. At that location he was promoted to project manager
and, upon completion of the Hollywood system, was asked to transfer to
Bonebrink, Kentucky. Again he built a new system there. From there
he was transferred to Little Rock, Arkansas, where he again built a
system as project manager� carrying a dual roll of plant manager. Upon
completion of that system, he was asked to consider a transfer to
Minnesota. He and his family moved to Minnesota, where he was put in
charge�of building up the northwest suburbs and trying to get their
systems on scale on time. This was in October 1982. He was also put
in charge of the construction of the Minneapolis system at that time
and overseeing the Fridley district as area plant manager and area con-
struction coordinator. He served in that capacity until Tom MacColl
elected to leave Storer. He was offered the position of District
General Manager and he accepted the promotion and came to Fridley.
Mr. Berdnik stated that� as far as the system ownership status, Rogers
has not elected at this time to pick up on their option to buy the
Fridley district. They reviewed them all, and they have closed on the
Minneapolis system. The closing took place on Wednesday afternoon.
What Rogers has at this point in time is a one-year option in the form
of a"put and take" contract. Rogers can "take" the Fridley district
at a certain percentage of gross revenues, provided all the cities are
agreeable to such a sale or at the close of one year at a date specified
(Aug. 15), they can "put" tre systems. In other words, they can tell
Rogers they are going to have to buy the sys,te� on that date and they
have to buy at a lesser percentage than what was offered at the "take"
price.
Mr. Berdnik stated that at this point, he did not feel Rogers was overly
concerned with the Fridley district. He thought Rogers would like to
have bought, but they looked at their financial capabilities and the
burden of building in Minneapolis was very substantial.
Mr. Berdnik stated this doesn't mean that if someone else comes along
and makes an offer that they might not consider that offer. Their
corporate policy at this point and what he has been instructed to do
is to conduct business as usual only on a much more upbeat kind of
arrangement.
Mr. Weaver asked what the price was or how the structure was set up on
the "take". Was it a f]at price or based on percentage of revenues?
Mr. Berdnik stated it was based on a percentage of revenues and also
based on the entire district. All four were bundled together, and
Northwest has been excluded from that bundle.

Mr. Weaver asked if there was any possibility this would change in the
future.
Mr. Berdnik stated he did not think so for two reasons: (1)the size of
the system is not soe►ething that would link very well with Rogers'
current holdings; and (2) the size of the system and the subscriber `
count already makes it almost cost-prohibitive to be bought at this
juncture.
Ms. Hughes stated she would appreciate Mr. Berdnik sharing whatever
information he has with the Comnission and the Corrmission will do
the same.
Mr. Kaspszak stated that, personally, he has been very disappointed that
the local programning channel 3 is not better today than it was one year
ago. He felt kind of reassured at the time the franchise was renegotiated
that this would improve. The programning has not improved. He can
understand why with three managers in nine months. If the instability
continues, then he did not foresee any improvement. Assuming the stability
does improve, can they look forward to some improvement in terr�s of the way
some of the things are spelled out in the new ordinance or new contract?
Mr. Berdnik stated they have already taken one step. He stated he was
not an expert in that field, so the one thing they have done is to search
within the "area", which includes Northwest, to single out the most
knowledgeable person they have. That person is Tom Stark. Mr, Stark
will be named very shortly to the area past in Fridley. The purpose of
doinq this reorganization will be to go ahead and better utilize the studio
they now have. The studio in Fridley has the capabi7ity to do almost
everything WCCO does. Their hope is that by sharing all the five systems'
equipment and knowledge and getting people more motivated, they will be
able to do a quality program which is what they should be able to expect
with the equipment they have. They are going to have *o De aggressive
about searching out what the community wants. They have had discussions
on how they are going to find out what the community wants in prograrrming.
One idea that was shared was to have a show called "Talk Back to Cable".
Another idea is a telephone marketing campaign. He stated they would also
like to have ideas on prograrmiing f rom the commission members.
Mr. Kaspszak stated this cortmission as a group has pretty well identified
what they would like to see in terms of local origination. He suggested
that the Comnission's local origination concerns be transmitted to
Mr. Berdnik in written form.
Ms.-Hughes stated they have an outline of a report on education that
was really supported. There are some good suggestions in that. There
have been other things the Corrmission has talked about., and they will
gather that information and get it to Mr. Berdnik. This topic should be
the major item of business at their October Commission meeting.

b. System Up-Grade Schedule
Mr. Berdnik stated they are very much ahead of schedule. Mr. MacColl
had forecast Oct. 1 as the date of completion. They have experienced
some minor difficulty, something that i� rather unique, in that they
have had a little bit too much signal in two ]ocations. They have had
to order some additional pads. He stated they should be 80-90� complete
by Oct. 1, if not 100%.
Ms. Hughes suggested the Corrmission have a tour of the cable TV
studio at their October meeting. '
Mr. Berdnik stated that was a very 9ood idea.
2. FORMATION OF A CONSORTIUM:
Mr. Weaver stated a few weeks ago, he had ta�ked to John Gibbs, an attorney
friend of his who is one of the attorneys working cable and who is also
Chairperson of the Bloomington cable comnission. In their discussion, they
found they were both having the same problems, and thought it might be a
�ood idea to form a consortium with a representative from each of the cities
Frid7ey, Bloomington, St. Louis Park, and St. Cloud) that are up for sale
in order to keep track of one another and see how things are going.
Mr. Weaver stated maybe the word "consor'tium" seemed a bit strong, but to
him it just meant a gathering of people with a common interest. He stated
he was looking for a general feeling from the commissioners that a consortium
wouid be beneficial to the communities involved. He thought the consortium
could serve as a very effective early-warning system. If they see things
starting to drift the wrong way, they can call an emergency commission meeting
and do all kinds of things. It would give the Commission one more source of
information so they can do a little better job of tracking where this whole
process is going.
Ms. Hughes stated she did not see this group doing anything beyond exchanging
information.
Mr. Kaspszak stated he had no problem with their being part of an information
system. Maybe this is something that should have been done a long time ago.
Mr. Belgum stated that if Mr. Weaver has the interest, he should take the
initiative and proceed informally.
Ms. Hughes stated she would be ir+terested in knowing what issues they should
be concerned about other than the uncertainty.
Mr. Kaspszak stated the only concern he had at this time, because they only
have a five-year ordinance and one year is almost gone, is that Storer update
the local origination. He is willing to give Mr. Berdnik time to turn the
job around.

Ms. Hughes stated they cannot do much about staff turn-over.
Mr. Kaspszak stated maybe they should just address the general non-conformance
with some of the provisions in the ordinance and be prepared to address that
when they talk about local programning.
Mr. Weaver stated another thing they could find out about is the service .
response time in Bloomington, for instance, and how it is handled.

The Comnission members concurred that they would share whatever information
they received, with Mr. Moravetz and Ms. Nughes serving as the central
persons responsible for seeing that the City and the other commissioners
are informed.
3. CONTINUE DISCUSSION OF BUDGET APPROPRIATI0�1 RECOMMENDATIONS FOR 1984:
a. Promotional Activities & Program Development
Ms. Hughes stated the Comr�issioners had a copy of the breakdown of the
employee salary-related dollars the Corrmission had requested. She
stated the reason for requesting this breakdown was to see if there
were amounts of money large enough that could be reallocated for
promotional activities. �
Ms. Hughes stated this was for the Commission's information. At this
meeting, they are to just receive the information, and she thought they
needed to keep in mind that there was $9,718 spent on employees and
when they talk about promotional activities, that is how much money is
available.

Ms. Hughes stated that in the Aug. llth minutes. she was instructed to
convey to the City Council and the Mayor the CATV Advisory Commission's
interest in discussing more promotiona] activities. She stated she
had not been able to contact them personally; however. they have
received the Aug, llth minutes, and she has not received any reaction
from that. She stated she Nould get in touch with the City Council
merr�ers and the Flayor early next week to formalize this.
Ms. Hughes stated that at this meeting, they should further discuss
what kinds of promotional activities there could be or should be, parti-
cularly if they learn anything from the personal services.
Mr. Belgum stated he has talked several times to Paul McCarron about
the idea of experimenting with a program which would interpret County
government. Paul McCarron stated that if he was asked, he would try
it. Mr, Belgum asked if it would be appropriate for the Commission to
invite McCar-ron to try a limited run of 12 weekly one-half hour programs.

Mr. Weaver stated he has had a long-standing complaint with the technical
reporting Storer has been doing. Basically, what they have been getting

is raw data. With a few notable exceptions, the raw data is really raw.
During the time they have been negotiating, they had some sort of loose
agreement with Storer that in the future the information would be presented
in a finalized form, accompanied by a cover letter stating that the data
contained herein is compliant with all known FCC regulations and signed by
someone carrying an FCC license.
Mr. Weaver stated the second part of that agreer.►ent was that the Commission
Nould have base line data imnediately prior to the switch-over. They
want to be able to track the system. He was specifically interested in
siy�ial to noise data, and he wanted calibrated instrumentation.
Mr. Berdnik stated he had no problem with furnishing that information or
any other`information that may be of more benefit to the Comnission.
Mr. Weaver stated that rather than sitting dorm and trying to formulate
some high powered writing, if he cou7d just talk to the technical man and
get this across, he felt that was really what they were looking for. _
Mr. Berdnik stated some other things that might be helpful are pictures of
the signal sweep and trunk termination points. He thought they should also
have the design parameters of the system.
Mr. Berdnik stated they are definitely making some changes in Fridley.
He introduced Tracy Schulte. who is the new Office Manager at Storer. He
stated he wanted the Comnission members to feel free to contact any of his
staff when they had questions or comments. He did not want the Comnission
members to feel that he was the only one they could talk to.
5. OTHER BUSINESS:
Mr. Belgum stated he would like to cortmunicate the Comnission's good
wishes to Clyde Moravetz and his wife. Mr. Moravetz could not be at the
meeting because his wife was in the hospital. Mr. Belgum stated this was
the first time Mr. Moravetz had missed a Cor�nission meeting in 11 years.

RESOLUTION CONFIRMING ASSESSMENT FOR 1983 WATER AND SEWER MAINS, LATERALS, ANO
SERVICE CONNECTIONS
BE IT RESOLVED by.the City Council of the City of Fridley, Minnesota, as follows:
1. The City Clerk has with the assistance of the engineers heretofore selected by
this Council for such purpose, calculated the proper amounts to be specially
assessed for the
1983 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS
in said City against every assessable lot, piece, or parcel of land in
accordance with the provisions of law, and has prepared and filed with the
City Clerk td.bulated statements in duplicate showing the proper description
of each and every lot, piece, or parcel of land to be specially assessed and
the amount calculated against the same.
2. Notice has been duly published as required by law that this Council would
meet in regular session at this time and place to pass on the proposed
:assessment.
3. Said proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity has
been given to all interested persons to present their objections, if any, to
such proposed assessment, or to any item thereof, and no objections have been
filed, except
4. The amounts specified in the proposed assessment are changed and altered as
follows:
5. This Council finds that each of the lots, pieces, or parcels of land enumer-
ated in said proposed assessment as altered and modified was and is specially
benefited by the
1983 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS
in the amount in said proposed assessment as altered and modified by the
corrective roll in the amount set opposite the description of each such lot,
piece, or parcel of land, and that said amount so set out is hereby levied
against each of the respective lots, pieces, or parcels of land therein
described.

6. Such proposed assessment as altered, modified, and corrected is affirmed,
adopted, and confirmed, and the sums fixed and named in said proposed assess-
ment as altered, modified, and corrected, with the changes and alterations
herein above made, are affirmed, adopted, and confirmed as the proper special
assessments for each of said lots, pieces,•or parcels of land respectively.
7. Said assessment so affirmed, adopted, and confirmed, sha11 be certified to
by the City Clerk and filed in his office and shall thereupon be and con-
stitute the special assessment for
1983 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS
8. The amounts�asses5ed against each lot, piece, or parcel of land shall bear
interest from the date hereto until the same have been paid at the rate of
nine and three-fourths (9-3/4) per cent per annum.
9. Such assessment shall be payable in fifteen (15) annual instaliments payable
on the first day of January in each year, beginning in the year 1983, and
continuing until all of said installments shall have been paid, each install-
ment to be collected with taxes collectible during said year by the County
Auditor.
10. The City Clerk is hereby directed to make up and file in the office of the
County Auditor of Anoka County a certified statement of the amount of all
such unpaid assessments and the amount which will be due thereon on the
first day of January in each year.

the City Clerk tabulated statements in duplicate showing the proper des-
cription of each and every lot, piece, or parcel of land to be specially
assessed and the amount calculated against the same.

Attached is a resolutiori for the purpose of certifying delinquent water
and sewer aco��ts to the Co�uity for oollection with the taxes due in
the year 1984.
All property awners have been notified of the fact that the utility
bills are being certified to the County and have been given an
opport�mity to pay the bill. �e penalty shown on this resolut�on is
in addition to the regular penalties that accrue on the utility bills.
T�is year we have approximately the same n�nber of acoounts that we are
certifying, the difference being an increase in�dollars due to more
delirquent billings for apartments. It appears that the growth we have
seen in deliriquent watet and sewer bills has scn�.what leveled off this
year, except for the increase in apartrnen� ut2lity billings.

A RESOLUTION CERTIFYIN6 CERTAIN DELINQUENT WATER AND SEWER
CHARGES TO THE COUNTY AUDITOR FOR COLLECTION WITH THE 1984
TAXES
WHEREAS, certain water and sewer charges for the City of Fridley
are delinquent in payment, and
WHEREAS, Section 7 of Ordinance Number 113, Section 1.02 of the
City Charter provides for the certifying of delinquent charges to
the County Auditor for collection with the taxes.
N0�1, THEREFORE, BE IT RESOLVED that the City Clerk is hereby auth-
orized and directed to certify the following charges to the County
Auditor for collection with the 1984 taxes due and payable in the
year 1984, to wit:
All these noted in Exhibit "A" attached hereto and made a part
hereof by reference.

and Co�cilm�iber-at-Large for a three year term.
N�w, �III�tEFt�RE, BE IT RE�VID, that pursuant to the Charter of the City of
Fridley (Chapter 4. Section 4.02), the Camcil hereb� provides f or and calls
the General Election of the City of Fridley to be held in the City of Fridley
on Z�esday, the 6th day of Novenber 1983, at which election, electors of the
City shall vote and cast a ballot with respect to the offices of Mayor and
Co�cilmenber-at-Large and thereafter the candidates receiving the highest
