Hr. Robertson, Community Development Director, stated he understands the
petitioner, Mr. Jahnson, Wishes to construct a garage on tbe rear portion of
his lot to eover the West one-half of the vacated alley. He stated James
Robinsoa, Planning Coordinator, eent a letter to Mr. Ja�hnson on September 22
advising him approvals Would be neoessary from the utility companies, the
Council would have to suthorize encroachment iato the retained easement, and

Mr. Johnson, the petitioner, stated to vacate only the west one-half of the
alley is a change from his original intent to vacate the entire alley. He
stated when he submitted the petition to have the alley vacated, supposedly
everything was ehecked by staff and he would receive the entire 12 feet. He
stated after the last Council meeting, it was learned he would only get the
west half. Mr. Johnson stated if he cannot obtain the east half of the
alley, he will be unable to construct his garage and vacation of the west
half wouldn't berbefit him.
Councilman Goodspeed stated when ihe City vacates a street or alley, the
property reverts to where it Was originally platted. He stated if the
entire a11ey Frere to be vacated, the State Highway Department would receive
the easterly six feet. He stated it is not within the City's power to give
the entire 12 feet to Mr. Jahnson.
Mr. Johnson stated he felt he was misled when he applied for the vacation as
he thought he would be obtaining the entire 12 feet.
Mr. Herrick, City Attorney, stated the City has nothing to do With
determining who gets the land, as this is governed by State law. He stated
if the City vacates the alley, the usual rule is one-half of the property
would revert baek to the oKner of each property that is adjacent to the
street or alley assuming the original easement was given from the same plat.
He stated at the time this alley was platted, there were lots to the east
and west and the State had aequired the lots to the east. He stated this
being tYie case, it Would be his opinion that if tiie alley was vacated, the
west half would revert to the propertq adjacent to the west and the east
half would revert to the property adjacent to the east. He stated perhaps
it may be possible Por Mr. Johnson to obtain a quit claim deed from the
State, if they have no use for the property. He stated Mr. Johnson should
probably have his own legal counsel, if the alley is vacated, to determine
ownership since he has plans to construct a garage and he would want to be
sure of awnership.
Mayor Nee stated in the past, the State Highway Department has returned
property Por whieh they have no need and felt staff should eheck into this
further.
Mr. Jahnson stated his building was constructed with the assumption there
would be an alley constructed and he was surprised this never happened. He
stated if the alley had been construeted, it would have saved him some
problems. He stated he has paid a vacation fee and now Would have to pay

another fee for a variance. He stated he Would like for staff to contact
the State.
t�r. Herriek stated it may not be easy to get an immediate answer from the
iiighway Department and felt Mr. Johnson should be aware of this fact.
Mr. Johnson stated he didn't plan to construet a garage until next spring so
time Kould not be a problem. He requested he be notified when this item is
again on the Council's agenda. Mr. Johnson stated if he is not able to
receive the entire 12 feet, he Would Withdraw his request.
MOTION by Couneilman Goodspeed to table this item indefinitely and instruct
staff to try and obtain the State's interest on the east half of this alley.
Seconded by Couneilman Fitz patrick. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.
2. CONSIDERATION OF VARIANCE REQIJESTS, VAR #87-24 TO REDUCE THE MINIMUM

Mr. Robertson, Community Development Director, stated at the Septemer 14
Couneil meeting staff Was instructed to rework the pl an Por the Rapid Oil
building based on the neW building size, conduct appropriate traffic counts
on 73rd and 73-1/2 Avenues, and reviex possible options for Viron Aoad. He
stated the building has been reduoed in size to 1,216 aquare feet.
Mr. Flora, Public Works Director, stated he met with the property owner of
the trailer court and there �as no interest in providing easements for the
extension of Viron Road. He stated there are several residents in the
trailer eourt that have been there since 1965 and the owner does not xant
them displaced. He stated if these residents Were to relocate, the property
aWner xould be Willing to discuss t�his extension xith the City.
Mr. Flora stated traffic eounts Were completed along 73rd aad 73-1�2
Avenues. He stated there are a eonsiderable amount of vehicles using 73-1�2
Avenue to acoess onto Hi�way 65. He stated the Minnesota Department of
Transportation has advised they xill be closing the median at 73-1/2 in the
near future. He stated When this happens, it certainlq Will affect the
amount of cars that are currently using 73-1%2 for aecess onto Highway 65.
Mr. Flora stated based on agreements that have been xorked out xith Rapid
Oil, if they provide tbe right-of-x�r Por the Viroa Road service drive and
Widening of 73rd Avenue, adequate access ahould be provided Por_.-�rehicles to -
acoess xiBhWay 65 from T3rd.
Mr. Robertson stated sinoe aWners of tiie trailer court are not t�illing to

provide easements to extend Viron Road, staff would recommend the vacaiion
of 73-��2 Avenue not proceed, unless the City �rished to condemn property for
the right-of-waq.
Mr. Qureshi, City Manager, stated he would suggest a 15 foot triangular
easement on the southeast corner be dedicated Por road right-of-way and be
included in the stipulations.
Mr. Robertson reviewed some of the minor revisions to the site plan whfeh
affect several of the variances and vary slightly from the Appeals
Commission recommendation.
Mr. Robertson stated in conjunction with these variances, there is a request
for a special use permit. He stated there are stipulations associated with
the variances, as well as the special use permit, and perhaps the
stipulations should all be included as part of the variance request.
Mr. Qureshi, City Manager, stated the reason staff is suggesting the
stipulations be included as part of the varianoes is because it provides the
City with more control.
MOTION by Couneilman Schneider to eoncur with the recommendation of the
Appeals Commission and grant varianees, VAR �87-2� and VAR #87-26 to reduce
the minim� allowable lot area for one main building from 0.75 acres of 0.54
acres; to reduce the side yard setback on the street side of a corner Iot
from 35 feet to 19 feet on the east and from 35 feet to 28 feet on the west;
to reduce the distanee that the edge of the curb opening may be from a
street right-of-Way intersection from 75 feet to i 9 feet on the north and
from 75 feet to 55 feet on the southeast; to reduce the parking and hard
surface setback from a street right-of-�►ay from 20 feet to 19 feet on the
east and from 20 feet to 10 feet on the west; and to reduee the side yard
setback on the street side of a corner lot from 35 feet to 21 feet on the
north, to allow the eonstruetion of an autamobile service station on Lots 1
and 2, Block 2, Central View Manor, the same being 7315 Highway 65 N.E.,
with the following stipulations: (1 ) developer agrees to eovenant, as a
condition oP approval of these varianees, that the proposed development �till
be utilized as a Rapid Oil Change facility and any future reuse oP the
structure for uses other than that comparable to a Rapid Oil Change will be
subject to Couneil approval; (2) developer will further covenant that the
site will be developed and maintained consistent with approved plans; (3)
the restrictive covenant referred to above Will be executed and filed at the
County prior to a building permit being issued; (4) petitioner to provide a
storm drainage plan and receive approval from Public Works prior to building
permit; (5) building facade to be constructed with faoe brick as depicted in
elevations received by City on September 2�4, 1987; (6) all doors, metal trim
and Window framing to be pafnted or color clad to compliment building
facade. Color treatment to be approved by City staPf prior to building
permit; (7) landsaaping to be installed as depicted in plan proposed by City
staff dated July 22, 1987, including vacated street portion when vacation is
approved. Plan to be revised by City to reflect revised site plan; (8)
automatie lawn irrigation to be installed for all green areas, inc2uding
vacated street portion when vacation is approved; (9) petitioner agrees to

provide an additior,al seven (7) foot street easement over the east seven
feet of the xest 27 feet of" Lot 2, Block 2, Central Viex Manor, and all over
the south 20 feet of Lot 1 and the Westerly 27 feet oP Lot 2, Block 2,

Mr. Robertson, Community Development Direetor, stated Central Roofing
applied for a special use permit for outside storage and there Was a delay
in Couneil aetion due to the eoncerns about potential odor problems. He
stated the President of Certral Roofing hired 1�rin City Testing to conduct
an odor test and the results shoFred that there Was an odor from the trucks
which lasted seneral aecon�s when they passed on the street. He stated when
the trucks were parked, odors were not noticed, unless s�eone xas Within 50
meters oP the trueks earrying hot aspiial t.
Mr. Robertson stated the eompanq duplicated the test to allo�,r members of the

Council, Commissions, and staff to take part. He stated, essentially, the
same results Were found as those oP 11ain City Testing. Mr. Robertson stated
the company submitted an Environmental Assessment Worksheet and the Planning
Commission noted there �ould be little or no errvironmental impacts from tha
husiness. He stated stafP is, therefore, recommending approval of the
special use permit.
Councilman Fitzpatrick asked if the petitioner xas aware of all the
stipulations to Which both Mr. Robertsoa and the petitioner answered in the
affirmative.
MOTION by Councilman Fitzpatrick to grant apecial use permit, SP #$7-17 to
allow exterior storage of materials and equipment at �500 Main Street, With
the follawing stipulations: (1) all tar tanker trueks and kettles Will be
parked (for both long and short term durations) on the northWest eorner of
the site as indicated on the site plan dated September 16, 1987; (2)
emissions of tar odors from Central Roofing aite and aDutting right-of-way
to be managed in such a Way as not to exceed the levels stated in odor
emission test report by Twin City Testing dated May 4, 1987; i3) there Will
be no beating of tar in tankers or kettles oa the Central Roofing site or
abutting right-of-xay; (4) the Environmental Assessment Worksheet (EAW),
prepared by Central Roofing dated September 16, 1987, will be considered
findings of fact related to the granting of this special use permit,
environmental impacts due to Central Roofiag operations, beyond those
described in said EAW, may be cause for revieta and revocation of the special
use permit; (5) storage of materials and equipment shall be managed so as
not to be visible from the public right-of-t�ay or residential view; (6)

HENLEY:
Mr. Robertson, Communitq Development Director, stated this proposal is to
split a lot at 6300 Baker Street. He stated the lot Would be 60 feet wide
and 9,000 aquare feet in area. Mr. Robertson stated the code requires lots -
be 75 feet xide, therefore, this proposed lot Would not meet the minimLmm lot
width. He atated staff felt this lot could possiblq be 68 feet xide,
harever, the petitio�r did aot xant to ehange his request due to concerns

about access to his rear yard. He stated other lots in the area are 90 feet
wide and felt the 60 foot wide lot Kould be inconsistent with the

Mr. Robertson staied the lot is a natural depression whieh colleets and
pereolates water from adjacent properties and there is concern that a
struciure placed in this area would create drainage problems.
Mr. Robertson stated two letters oP objection to this 1 ot spl it were
received by the Planning Commission. He stated the Planning Commission
unanimously voted to derry this lot split and asked staff to bring to the
Council's attention that the Commission feels even a 68 foot wide Iot �ould
be ineonsistettt with the neighborhood.
MOTION by Councilman Sehneider to concur with the recommendation of the
Planning Commission and deuy lot split, L.S. �87-08. Seconded by Couneilman
Goodspeed. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously.
Councilman Schneider stated even if a lot split was submitted for a 68 foot
wide lot, he would not support it. �

Mr. Aldrich, Fire Ct�ief, stated this agreement is identical to the first
phase of the Opticom system approved last year, except the Department of
Transportation has noW requested a log on the use of the interseetion. He
stated the installation of the EVP system will be on Highway 65 at Osborne
Road, 73rd Avenue, Rice Creek Road, West Muore Lak�e Drive and 53rd Avenue.
Mr. Qureslii, Citq Manager, asked iF the Police Uepartment xould also keep a
log. Mr. Aldrich stated this was his understandfng and it may be more of a
problem for the Police Department than it �ould for the Fire Department.
Mayor Nee asked When this spstem Would be installed at University and

Osborne Road sinoed this intersection is near the hospital.
Mr. Aidrich stated some of the control equipment handling the semaphores
isn't upgraded �here it would receive the automated system. Ae atated MnDOT
Would install the system at any time, if the City purchased the new
eontroller. Ae stated a timetable Was established When MnDOT Would upgrade
the controllers at their expense and the City chose to upgrade according to
this plan.
Mr. Aldrich stated there are still some gaps on IIniversity Avenue and East
River Road, and IIniversity Avenue should be finished next year. He stated
the County has ndicated they Would work toWards completion of the
intersections on East River Road.

Mr. Hunt, Assistant to the City l4anager, introduced Hs. Ann Wallerstedt,
Executive Director of Mediation Services for Moka County.
Ms. Wallerstedt stated she was here this evening to make a speeial request
for additional funds for Mediation Services. She stated the funds are
needed dne to a cash florr shortage for the last several months in 1987. She
stated raitii their �23,000 budget for 1987, they expected funding to come
frem three basic souroes and some of this funding has not yet materialized.
Ms. Wallerstedt stated their budget for 1988 is �27,000 and they Will be
receiving some funding from the County. She stated they will continue to
seek funds from organizations such as the YF�1, American Legion, Lion's Club,
Rotary, etc., as xell as from corporatioas and foundations.
Ms. Wallerstedt stated ahe believes it will be easier to raise funding Por
next year because of their past achievements. She stated they are now
handling 65 cases and their caseload nearly doubled the last several months.
She stated about one-fourth of the people aerved were Fridley residents and
9 out of 10 eases ti�ey heard resulted in a eettlement.
Councilman Schneider asked xhat types of cases Were handled. Ms.
ilallerstedt stated property line, landlord/tenant, and community disputes,
as t�ell as situations involving name calling and children not getting along.
Councilman Goodspeed stated several years ago, he responded
that xas an on-going feud betWeen tWO neighbors and after
files, found this resulted in about 20 police calls. He

two additions, so I therefore would like to canbine both into a two-
level addition, one level being basement."
C. ADt4It�ISTRATIVE STAFF REVIEtJ:
The present code does allow for a five foot encroachment into the
required front yard setback of 35 feet if the total area of the
addition does not exceed 50 square feet. Secause the petitioner
wants more than just a 50 square foot vestibule, he has petitioned for a
variance to build a 10 foot by 15 foot room. 7he present setback from
East River Road right-of-way is 135 feet; however, on the 35 feet from
his e xisting home is a 50 foot right-of-way for the future extension
of ,�sliton Avenue. This would serve as a service road and would eliminate
the private driveway access onto East River Road from the east side.
There are no irmediate plans for this to take place; however, our
Engineering Dept. states that this could happen at some later date.
If tl�e 8oard approves this request, the Staff has no stipulations to
suggest.
Ms. Canpbell stated the extension of Ashton Avenue was projected to go all
tlie way to the A& W site on Osborne Road.
The petitioner, Mr. Oavid Fox, stated he had sat in a public hearinq regarding
A��oka County's plans to widen East River Road 40 feet. If the County widens
East River Road 40 ft., there would not be roa� for Ashton Avenue.
t1s. Campbell stated a hardship was allowed for solar energy, but there
have not been any precedences set for weather barriers. This addition was
for 150 sq, ft., far in excess of 50 sq, ft.
�1r. Fox stated his wife has a silk flower business. He recently ha�i to change
professions and was now in graphic arts with a commercial art business on the
side as «ell as working in the commercial art field. He stated they need room
for his wife's silk flower business, his computers, and drawinq tables.
Right now ,all these things are in the family room, and it was very cluttered.
They would like to make a separate area so it would look nice and vrould fit
their needs.
Mr. Betiold asked if there was any way Mr. Fox could add on to the back of
the house.
Mr. Fox stated that t►vo years ago, without thinking of his changing professions
or the success of his wife's business, he put on a very extensive deck which
covers almost the full length of tlie house in the back. If they were to add
on to the back of the house, they would have ta tear down almast the entire
deck.

P4r. Fox stated that the way the house was built, when the front door was
opened, all the cold air rushes into the house. He would like to get away
fror� that by buildinq an air lock so it takes two doors to get into the
hous e.
Mr. Barna asked if there would be any business people comina to the house,
or would this just be an air lock for �he house and then additional work
space for the petitioner and his wife.
fdr. Fox stated there v�ould not be people coming to the house per se. If •
there ever was, it would only be one person at a time.
Mr. Betzold stated the argument about an air lock makes sense, but that
could probably be accomplished without a variance by adding an addition that
would not exceed 50 sq. ft. which was permitted by code. Was it fair to say
that the petitioner was now coming to the City asking for a variance for a
larc�er addition because he did not plan ahead when he built the deck on the
back?
Mr. Fox stated, yes, that was a correct statement.
Mr. Barna stated that the deck was a walk-out to the rear. tJould there be
space under the deck for a room addition?
Mr. Fox stated the deck was a three-level deck. There was an upper level,
middle level, and then the screened in porch under the upper level, with a
walk-out to the side of the deck on both ends. He would have a hard time
seeing an addition co�ing off the back because he ►•�ould have to attach
it to the family room and eliminate a �valk-out, and he would end up extending
the upstairs bedroom that doesn't need to be extended. The design of the house
was such that across the back was the kitchen, bathroom, and bedroom on the
upper level, and laundry room, bathroom and far�ily room on the basement level.
Mr. Fox stated he has talked to his neighbors, and on the back of the
petition, he had his neighbors sign a statement that they agreed to this
addition. He planned on changing the brick that lines the front of the house
with granite from St. Cloud, leaving the gray cedar above the brick and then
the gray/green granite rock on the front. He felt he would be improvinq the
face of the house and, in turn, the whole area.
Mr. Barna stated that as far as a precedent being set for a weather barrier,
a precedence has been set for air lock entry ways. Some of the variance
requests the Commission has had are for combination solar/air lock, but
variances have been granted for an air lock entry way.
Mr. Fox stated the design of the front was all glass to the south entry way,
and he was planning on using dark green marble on the floor to attract and
hold the heat from the sun. He was changing the entry way from the west to
the south. The house was built without any southern windows.

��Ir. Sarna stated he had a 10 ft. x 12 ft. air lock entry way in his house
and even with only two children still at home, it was not enou4h room for
boots, coats, hats, etc. There needs to be room to get everyone into the
entry way room before having to open the second door; otherwise, both doors
are open, and they lose the air lock. He could see the additional size
from 50 sq. ft. to 150 sq. ft. As far as being worried about the East River
Road expansion or Ashton Avenue extension, he was ter�pted to not even take
tliose into consideration at this time, because that was in the future.
There have been variances granted up and down East River Road, especially
on Nugo St., for structures much closer to-the� pro��ed East River f;oad
expansion than this request. He stated he would have no objection to the
variance.
Ms. Savage stated her initial impression �•�as that this was a close case,
because she was not really clear tF�at there was a hardship. As they have
been discussing this, she had become in favor of granting the variance because
it did seem that the hardship was shown by the need for the weather barrier.
She did have concerns about the future �ridening of East River Zoad; neverthe-
less, she would still be in favor of the variance.
Or. Vos stated he looked at the site and no matter what was done with
Ashton Avenue or East River Road, this house, even with the addition, would
still be set back more than a lot of other hauses on the west side of East
River Road. He did not see the hardship, but he did see the inconvenience
of iiving on East River Road, and he would be in favor of grantinr� the variance.
Mr. Betzold stated he did not know whether or not the size of the air lock
entry way as proposed by the petitioner was an adequate size, and he did not
kno►r wi�ether it could be accomplished by something smaller without the
variance. He was concerned about the fact that the petitioner was askin�
for a variance primarily because he did not plan ahead and put the deck on
the back a couple of years a,qo. He stated he was not really happy when the
Appeals Commission gets these kinds of requests.
Mr. Betzold stated the Ashton Avenue/East River Road matters are the policy-
type of decisions that he was not comfortable r�aking, and he felt the final
decision should be made by the City Council. It was his intention to vote
against the variance, primarily so this variance request would go on to the
City Council for their final decision. He would also like to knor� hov� the
City Council feels about these kinds of requests.

Attached is a resolution for the purpose of certifyng delinquent
water and sewer acoounts to the County for vollection with the taxes
in the year 1988.
All property awners have been notified of the fact that the utility
bills are being certified to the County and have been given an
opporttmity to pay the bill. The penalty shc�m on this resolution
is in addition to the regular penalties that accrue on the utility
bills. Zliis year we have approximately the same n�uaber of accounts
to be oerti,fied as last year. It appears that the growth we have
seen in delinquent water and sewer bills has apparently leveled off ,
at this ntnnber.

�he attached resolution is for the purpose of certifying un�aid weed
cuttinq charges to the County for oollection with the taxes due in
the year 1988 (one installment).
Each property awner was billed and a reminder was sent. The last
notice sent to each property awner stated that if the bill remained
ung�id, it would be certified to the County and a 15$ penalty would
be added. Ac�ainistrative charges in the amount of 25$� or a maxim�►
of $10.00 was added to each bill.
�e charges on this resolution are for work done in 1987.
