Mr. Stan Leino, 7397 Memory Lane, stated he sent a letter to the City
Nl�r�ger rec�rding the rar wash on University and 73rd Avenues. He stated he
felt there was a safety problem that exists at this car wash on Tuesday
afternoons when there is a special and a person can wash their car for 25
cents. He stated on Tuesdays from 3 to 5 p.m., it creates chaos on the
servioe road hecause of the vehicles waiting in line. He stated he had no
intention of putting the aaner out of business, but felt this is a safety
problen.
Mr. Qureshi, City P�nager, stated Mr. Leino's letter has been forwarded to
the Public Works and Fblice De�artments for their response.

recprding the ric�t-of-way. He stated the Council may want to review the
facts of this rezoning request and h�r any mmments, but the public hearing
should 6e mntinued. He also suggested the special use permit and variances
related to this r�oning be tabled and �nsidered at the same time as the

Mr. Robertson, Coimnimity Developnent Director, stated this item was tabled
fran the last Cotmcil meeting in order to give the petitioner tame to rEVic�a
some options regarding the use of tl�is �ZOperty for a less intense purpose.
He stated there are 14 stipulations reoomnended b� staff in wnjimction with
this special use permit and are outlined on Paqe 2L of the agenda. Mr.
Rnbertson stated it is reoo�nend°d that the d3te, in stipulation No. 6, for
prwiding the ooncrete curbing anc7 gutter be changed frcm Jtme 15 to August
15, 1987. He stated this would give the petitior�er the opporttmity to apply
for a rehabilitation loan. He pointed out that staff, in no way, is
guaranteeing he would reoeive such a la3n.
t7r. Walcbch stated he mntacted the person interested in a video store at
this location and he is willing to look at the site. IIe stated there is
sufficient Farking and felt the building would meet the code requir�nents.
Mr. Walc�ch stated if the building on this property could be used for a
video store, it would solve a lot of problens, haaever, he did not know if
it oould be cbne right away.
Mr. Qureshi, City Manager, stated he wanted tc make sure Mr. Waldoch
imderstood that the City isi't �anising he would reoeive a rehabilitation

� Mr. E7ora, Public Works Director, stated on Novenber 3, 1986, the Council
held the first reading of this ocdiranoe to vacate a portion of the 30 foot
easement of Viron Road for construction of a loopback around Dr. Dahl's
Chiropractic Office. He stated, subsequent to that meeting, Dr. L�ihl
requested rpzaning of his Farcel based upon plans to construct a secand
offioe building; haaever, he withdretn+ his request for redevelognent of the
property, Mr. E'lora stated in the meantime, the vacation of the old Viron
Road portion stopped and Viron Road loopback assessnents were levied on the
property,
Mr. F7.ora stated in negotiations for obtaimng the necessary right-of-way
for the loopback, the City agreed not to levy any asses�ment for the
improvenerrt against Dr. Dahl's property, as long as he did not exceed a
total of 3,600 s3uare feet of building sp�ce. He stated in order to
wmplete and cle3r the files on this property, staff is recommending the
seoond readinq of the vacata.on and defer oollection o£ assessments on this
property. He stated the resolution to defer these assessments appears as
Iten 20 on the Coimcil's agenda this evemng.

Mr. Robertson, Community Development Director, stated the City is
ac3ninisterinq a rehabilitation program in oon7unction with the MEiFA. He
stated because the process is so time mnsuning and staff doesn't have the
tesouroes to ansaer the technical questions, the CAimty has a�ntracted with
a oonsultant to aid cities in Anoka County in acbninistering the program.
Mc. Rnbertson stated staff feels the use of this o�nsultant, Luey Beckwell,
will rel.ieve the City of the task of ac3nimstering the progr�n anc] wi11, in
turn, speed up the prooess of implenentation. He stated there would be no
charge to the City for services performed tr,� Ms. Beckwell and she would keep
the City informed and updzted as to the project status results.
Mr. Robertson stated in order to provide this service for Fridley, the
Coimty and MHFA require authorization !x the Mayor and City Manager to
execute the agreanent between Ms. Beckwell, Anoka County and the City of
Fridley.

Mr. Robertson, Community Develognent Director, stated this special use
permit is to allow for outside storage related to the expansion of an
existing auto salvage yard at 3737 East River Road. He stated the expansion
will be to the rnrth on Burlington Northern's property and would 6e used for
storage of disabled vehicles. Mr. Robertson stated this isn't the
traditional jimk yard, but these vehicles have been damaged and are being
stored 1� insurance oomFenies prior to auction or r�sale.
Mr. RoUertson stated there are a niunber of stipulations recommended by
staff, in oonatuiction with this special use permit request, anc3 outlined on
Page 15N of the Council's agenda. He stated these generally relate to
lanciscaping and screening.
Mr. RoUertson stated a letter was reoeived frcm Mr. Norman, Regiorril Nhnager
for Burlington Northern, in reference to stipulation No. 9 regarding the
billboard He stated Mr. Norman questioned the authority to impose this
regulation since the billboard isn't physically located on the property in
question. He stated staff has requested the City Attorney to review Mr.
Norman's letter.
Mr. Newman, Assistant City Attorney, stated Burlington Northern has taken
the position that sinoe the applicant isn't leasing the land, the City is
attanpting to regulate property beyond the area o�vered by the special use
permit application. He stated fran a lec�l standpoint, there may be some
validity in Burlington Northern's �oncerns anc7 would recommend that this
stipulation be deleted

requested to oorrect norrwnforming setbacks as follows: (1) reduce the
side yard setL�ck of an existing garage fran 5 to 2.9 feet; (2) reduce the
sic� yard setback of an existing apartment buildinq f rom 25 to 23.5 feet;
and (3) reduoe the front yard setkxlck of an existing a�artment tuilding fran
35 to 34 feet. Mr. RDbertson stated the e�sisting garage that rec�uires the
side yard setiack is located across a ten foot utility easement and the
utility oomFanies have indicated they are iu�willing to vacate this easement.
He stated the petitioner understands the liabilities relating to their
garage being located on this easement. He stated the utility �mpanies are
not willing to put in writing they have no objection to the c}srage being on
the �sement, therefore, it is the City Attorney's opinion the City should
not grant the variance for the garage.
� Mr. Bissonett, representing the petitioner, stated the utility easement
cannot be vacated, hawever, the utility aom�anies have not asked the garage
be moved. He stated he can see the justification for denial of this

Mr. Robertson, Comn�mity Developnerit Director, stated on October 17, 1983,
the Cotmcil apprwed special use permit, SP #83-10, for the operation of an
autanobile rep�ir garage at 7948 University Avenue. He stated this permit
was issued to the a�ner, Gerald Paschke, and the petitioner Fred Lyons, with
four stipulations which he outlined. He stated on Nov �nber 3, 1986, the
Cotmcil reviEwed this special use permit and, at that time, the operator had
vacated the �xanises and Cotmcil directed staff to notify the petitioner
that the special use permit had expired.
� Mr. Roberteon stated a new operator, Mr. Shanlc�, is req uesting permission
to take wer the operation of an automobil e reFair garage at this same
location. He stated he has contacted the City Attorney's office on this
matter and in as much as special use permits are issued both to owner and
operator, the City oould simgly reinstate the r�ew petitioners with the same
stipulations.

storage of garbage containers; (2) no outside re�ir of cars; (3) no

Mc, E7.ora, Public Works Dlrector, statea plans and specifications were
received for modifying and upgcading the filters at the Commons Park
filtration plant. He stated, in order to expedite the work without
affecting the water distribution system, it would be appropriate to
ac}�ertise for bids for the project.
Mr, Flora stated TI� would be willing to mnduct the inspections during the
construetion period for an estimated cost of $24,5�� and the total
wnsulting fees would be less than 8� of the werall m nstruction project.
He stated some special materials, large pipes and krypass valves, would be
installed in this project which is not of a routine nature, therefore, he
felt it would be appropriate to have a mnsultant cb the inspection, rather
than the City personnel.
Mr. Flora stated the issue of a mnsulta�. for the insFection work coulcl be
addressed when the contract is awarded, but would like for the Council to
cvnsider the resolution at this time so staff can proceed to advertise for
bic�s.

Mr. Flora, Public Works Director, stated the property avner, Wayne ik�hl, has
requested the Coimcil defer the assessment placed on his property under
Street Im�crvenent Project ST 1986-1 until such time as the property is
sold, seplatted, or is developed in excess of 3,600 sqtaare feet. He stated
this relates to the vacation of Viron Road and the aaner has withdrawn his
glans for additional oonstruction, therefore, it wou] d be appropriate to
abate the assessnent.
Mayor Nee asked if there was a problen with the word "abate". Mr. Pribyl,
Finance Director, stated the Council is actually abating the priot
assessnent and c�ferring it imtil a later c�te.
