Mayor Nee reapened this Boaxd of Revie�w meeting at 7:35 p.m. which had been
continued frcm April 18, 1988.

Mayor Nee stated at the last meeting there were several items which the
Council requested a report fran the City Assessor's Office.
MARY QOONEY, 5407 C�TrRAL AVIIVCTE N.E.:
Mayor Nee stated there was the potential for an increase in the value of
this pr�perty. He stated the property is a snaZl piece af land adj acent to
Menard's o� which a billboard is located. He stated it appears that the
value was too laa and the City Assessor was asked to review the property and
notify the aaner that this question would be raised at this meetirg.
N�. Madsen, City Assessor, stated he talked with Ms. Ooor�y last week af ter
a�etter was sent i.ndicating the Board of Review had a desire to increase
the value of this property. Neither Ms. Cboney n�r ariyone representing her
was present this evening. N�. Madsen stated Ms. Cooney had indicated she
didn't believe artyone wauld be present at this meeting.
Mr. Madsen stated in reviewing the property and af ter talking to Ms. Cooney,
he wauld recarmend an increase in the value from $5,500 to $10,800. He
stated this figure is based an the coriversation with Ms. Cooney where she
indicated at cne time $33 a month was received for the land lease to Naegele
Signs. He stated in figuring the value, a multiplier f ram 20 to 25 times
tY�e annual rent was used. He stated assuming a current rent of $40 per
month or $480 per year and an average multiplier of 22.5, this would
in+dicate a value af $10, 800.
I�. Madsen stated. in oonversations with a representative of the (�rmissioner
of Revenue's office, he also felt this figure was oorrect.
NDTION by Councilman Billings to support the amended appraisal by the City
Assessar for a value of $10, 800 on this property at 5407 C�entral Avenue N. E.
Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor
Nee declared the motion carried iu�animrnxsly.
HEI,E[�T KP,.SHLJBA - 6959 HICKORY QRCZE:
Nh�. N�dsen, City Assessor, stated the Kashuba's are not able to be present
this ever.ing. He stated he had been in contact with them and would
recatmend a decrease in value fr�cn $108,700 to $105,600.
N�. Madsen stated in reviewing his property, it was noted the deck is in

poor corbditian and has ci�y rot. He stated he wauld recammend the value of
the deck be r�anwed until it is rep�ired. He stated there was also an error
in determining the lot size, due to the amission of the lakeshore line on
the m1p the City was using. He stated the land value Y�as been recalculated
and taking this and the deck into consideratian, it is recanner�ded the value
of this praperty be reduced to $105,600.
MYI'ION by Councilman Fitzgatrick to concur with the recomanendation of the
Assessor's Office and reduce the value of this property at 6959 Hickor�•
Circle frcm $108,700 to $105,600. Seconded by �uncilman Billings. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.

Nk�yor Nee stated Ed Kaspszak has been a member of the Cable Television
CaYmission for marry years and has contributed a great deal of time and made
an important contribution in negotiations with the cable companies and
extending the media service to the public.

Mayor Nee stated Al C�bel has served an the Cc�munity Develc�ment and Parks
and Recreation Commissions. He stated he has been a very faithful and
c7,edicated menber of these catmissions.

Mayor Nee stated Maynard rielsen has served on the Environmental Quality
Commission and was instrur.tental in developing beautification in the
ca�nuzity which the citizens enjoy.

Mayor Nee stated Dick Star�la has served an the Human Resources Cammission
and forn�erly served on another citizen caimittee.

VEI'F�2AN' S BUDDY PUPPY DAY - N�Y 20. 1988 :
N�yor Nee read and issued a procl�nation proclaming Buddy Poppy Day on May
20 and urged all citizens af Fridley to recognize the merits of this cause
by contributing generously to its support through the purchase of buddy
pappies as symbols of appreciatian far the sacrifices of air Yx�nored dead.
Since no arre was present to receive this proclamation, Mayor Nee stated it
would be forwarcled to the Veterans af Foreign Wars.
NATIONAL PUBLIC WI�RKS WF�EK - MAY 15-21, 1988:
Mr. Hunt, Assistant to the City Manager, read a proclamation proclaiming
National Public Works Week. Mayor Nee stated in issuing this proclamation
he calls upon all citizens and civic organizations to recognize the
contributions which Public Works personnel nake every day to the citizens'
heal th, saf ety and cat�f ort.
Mayor Nee presented this proclamation to Ralph Vollnnan, Public Works
Superintendent. N�. Volkman thanked N�iyor Nee and the Cbuncil on behalf of
the Public Works personnel.
NATIONAL BARRIER AW�SS - N�,Y 6, 1988:
Mayor Nee read and issued a proclatna.tion proclaiming National Barrier
Awareness Day May 6, 1988. He encouraged the efforts of individuals,
arganizatians and ag�encies in the City to support programs and proj ects to
imprave the lives of disabled persons.
Ms. C�rol Taylar, Secretazy of the North Si�burban Consuner Advocates for the
Har,clicapped, vras present to receive this proclamation. Ms. Taylor stated on
behalf af people with disabilities all over the country, she wished. to thank
Mayor Nee for this procl�nation and for the support to ranove barriers that
keep them aFart fran their friends and neighbors.

ADOPPION OF AC�IDA:
The follawing item was added to the agenda: (28) Consideration of Change
Or�d�r No. 1 far the Satellite Fire Station.
MyI'ION by Councilman Schneider to adopt the agenda with the �bwe addition.
Seconded by Councilwanan Jorgenson. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.
OPEN F'ORLJM, VISITORS:
N�. Pat Ringold, re�presenting Northtown Nissan, appeared before the Council
to request pernu ssian to erect a tent on their property to be used as a
tenporary affice while they are renodeling the shaw floor and sales office.
He stated they would 1 ike thi s tent f ran May 7 through May 14 . He sta.ted in
talking with the Ccnmunity Devela��ent Departinent, he was advised what was
needed in order to obtain a permit and they wou2d meet all these
requiranents.
N�. Qureshi, City Manager, stated this can be handled administratively, but
because o� the sensitivity of using a tent for an office, he wanted the
Council to be aware of this request. He stated if the. Council has any
concern, this siwuld be made }mawn before any permit is issued.
Mr. Rd�ertson, Catmunity Devel�ment Director, stated his staff advised him
of the request this af ternoon. He presented a drawing showing the proposed
location of the tent. He stated the tent shr�uld be erected on the side of
the building to meet the criteria of outdoor storage. He stated he
imderstands that tenporasy tent permits have been issued by the staff in the
gast.
Councilman Billings stated he had rw objections if the tent was erected at a
location suitable with staff. He stated he hoped the tent would be of an
unabtrusive na.ture so it cloesn't becane an advertising vehicle.
NIr. Ringold stated there wauld be no advertising as a tent sale and would be
used strictly fc�r o�fice s�.ce.
Councilwrman Jorgenson asked where the custoqners would park. Mr. Ringol d
stated in an area � the used car side and signs would be used to direct
custaners to this parking area.
Councilman Schneider asked if there wauld be sanitary facilities available.
Mr. Ringold stated the restroans i.n the building wauld not be changed. He
stated th�� will have 27 workers working day ar�d night to complete the
renodeling as quickly as possible.
Cbuncilman Fitzpatrick stated there seens to be a great deal of parking on
the street and asked if there was an explanation. Mr. Ringold stated they
yave a�way sets aP diamonds so they had additional traffic for several days.
He stated also enployees �a.rked on the street while they were bringing in
their inventory and this has n�ot been curtpleted.

Mr. Rnbertson stated staff will work with Mr. Ringold so the temporazy

unanimously anci the public hearing apened at 8:06 p.m.
Mr. Burch, Assistant Public Works Director. stated as part of the 1988
street improvelent project, there is one project, the improveznent of 51st
Way, for which sane petitions have n�ot been received for those benefitting
praperties. He stated Anoka County and FMC have agreed to pay their share
for the impravanent, hr�wever, Burlington Northern and tihe owners of the East
River RQad Business Center have indicated apposition to the impravenent. He
stated another problen is that FMC is a tenant to the U.S. Navy and the
majority of the praperty on the south side is owned by the Navy. He stated
the Navy Departr�nt agreed in the past to support this groject, but there
has been sane cielay in the Navy's agreem�nt regarding whether or not they
will pay the cost of the project directly or work through FMC for paylr�ent.
Mayor Nee asked if the additional traffic was the result af the d�evelopmen�
of the East River Road Busir�ess Center. Mr. Bur�ch stated the City has not
done ariy specitic traffic counts in regard to this i�ravement. He stated
the proposal is to assess the properties according to the front footage and
benefits received fran the improvement. Mr. Burch stated Anoka County will
�y 35$ of the i�rwenent, the other 65� of the cost was spread equally
between FMC, the Navy property, the East River Road Business Center,
Burlington Northern and the City.
Mr. Burch stated the sarne approach was used in figuring the assessment for
the signal. He stated the County will pay 50$ of the cost of the signal and
the renaining cost will be spread �nonq the other benefittng properties.
Mr. Burch stated the estimated costs far this street in�rovenent project are
$164,600 for the street, $100,000 for the intersection, and $8'7,500 f or the
signalization.
I�. �Cn Weaver, representing Mr. Belgarde owner of the East River Road
Business Center, stated his client was apposed to this assessment because
there are several other businesses in the area who will benefit fr�n the
imprwenents whp are r,�t being assessed.
Mr. Qureshi stated the City consistently follows an established policy to
determine haw properties are assessed for improvements. He stated the
noxmal policy wauld be to assess for the street iur�rovanent and possibly an
exception oould be made for the signal. He stated the City has, in the
�st, f�ded all signals, with the exception o� the o�e at 69th Avenue and

University. He stated this was an exception because the residents wanted
the signal, however, the Highway Department weuldn't participate in the
cost. H�e stated. the other alternative would be to split the cost of the

Mr. Weaver stated th�y dr�n't question the need for the signal, but if they
are going to be assessed, the other prc7perties that would benefit frozn the
impravenent sh�ild alsc be assessed.
Mr. Herrick, City Attorney, stated the Council in assessing property has to
demonstrate the imprave�nent to the property is at least equal to the
assessnent. He stated the other criteria is equality among the properties
being assessed. He stated the City hasn't had a practice ot assessing for
signals, with the one exceptian at 69th Avenue where there were peculiar
circtanstances, which isn't the case in this instance. He stated he would be
ca�f ortabl e with Mr. Qureshi' s suggestion that the signal s be paid f ar other
than by special assessnent and the street be assessed in the ma.nner the City
has assessed streets for marry years.
Mr. Herrick stated he felt the qUestion of the Navy's p�articipation would
have to be resolved before a final decision can be made.

Cbuncilman Schneid�er asked about the Viron Road Lighting Project which is
proposed as an addendtan to this 1988 street improvenent project.
1�. Burch stated the C�nunity Develap�r�ent Department has worked with the
property aaners on Viron Road to develop a street lighting plan for this
area. He presented a map showing where the lighting would be located. He
stated.petitio�s were received f rom the six property awners in the area
indicating their concurrence with this pro;ject. He stated an addendum is
proposed to add this to the cyverall street impraveqnent project for this
year.
Mr. Rc�bertson, C�nunity D�velo�nt Director, stated this lighting project
was part of the plan when the Council approved the re-routing of the Viron
Road service drive. H�e stated lighting alternatives were received and this
lighting will be the same t��e prnposed for the project ca� Rice c�eek Rc�a.d.
N�yor Nee stated there was no background material supplied regarding this
lighting project so he had rw idea what it involved.

Corporation. He stated Federal Signal Corporation's bid was for their
electronic model 612 in the a¢�►ount of 574, 032 and they also subznitted a bid
on a new electro-mechanical DC back up system in the amount of $11,352. He
stated Alterting Communicators of America bid $70,827 for electronic
Alertronic 6000.

Mr. Hill stated a revelation was made at the bid apening that Fed�eral Signal
Corporation had come out with a new revolutionary system which is an
electro-mechanical systan which will be marketed. He stated there appears
to be a strong consensus among users of outdoor warning syst�ms that the
electro-mechanical systan is far more reliable and maintenance free tt�n ariy
electronic system. He stated in an attanpt to verify this opinion, staff
contacted one of the larger users of the outdoor warning systems, the
Tennessee Valley Authority. He stated acccording to their maintenance
forenan, Mr. Rube, out of 68 of their autdoor warning sirens, 30 consist of
the electronic type ranging fran three to eight years of service. He stated
they are replacing all electronic sirens with electro-mechanical sirens
because c� the high maintenance costs on the electronic sirens. Mr. Hi11
stated N�. Rube cited maintenance costs wer the last several years on the
30 electronic sirens was 95� and only 5$ an the z�enaining electro-rc�echanical
sirens.
Mr. Hill stated previously only electronic sirens provided the DC back up
until this information about the electro-mechanical DC system was made
available. He suggested the Council receive and reject the bids and
authorize advertising for bids for eight electro--mechanical battery back-up
outdoor warning sirens. He stated he talked to the laa bid vendor, Alerting
C.cnan�icators of �nerica and th�y expressed disappointment, but knew the
prablens and that they had an electro--mechanicaJ. systen in �velopment, but
didn't indicate they were in a position to bid.

Mr. Burch, Assistant Public Works Director, stated a petiti on was received
fmn Mr. Harris requesting the City construct a xnad on the east portion of
his property. He stated during the course aF the platting af the property,
the City encouraged Ms. Harris to abtain right-of-way on the east portion of
the property to service properties to the east. He stated Mr. Ha rris was
advised that the road could not be constructed until easements are obtained
to construct a street to City stanc3ards.
Cbuncilman Billings stated. the owners of Lot 1 agreed to give 25 feet of
right-of-way with the other 25 feet caning fran the trucking ca�ny.
Mayor Nee stated the City has the discretion to construct the road and
assess it even though it may not be full width. Mr. Herrick, City Attorncy,
stated N�.yor Nee was correct and the City has this discretion.
Cb�cilman Billings stated the annver vf th,e trucking car�pany may be wil l ing
to proceed in this direction, particularly if the assessment could be

Mayor Nee felt it was in the best interests of the City to construct a full
road, rather than a portion of it.
1�. Flora, Public Works Director, stated he talked to L1ave Harris about the
right-of-way and he indicated he had a hard time negotiating with Mr.
�rson, a�mer of the trucking cam�riy.
Mayor Nee asked if the City had contacted any of the other owners which
would be involved. Mr. Flora stated the City can pursue that, if the
Council desires.
N�. Flora stated 1�. Harris is only interested in developing a portion of
his abutting property. He stated the City originally layed out plans to
construct the road to Central Avenue wheth�er it be to the north or south of
Anderson Z`rucking. He stated if the road wasn't completed, a temporary
cul-de-sac could be prwided. He stated the issue with Anderson Trucking
may be where they want the road and haw to bring traf f ic aver to Central
Avenue .
Councilman Schneider stated he would like staff to review this matter as he
feels there should be a ccmprehensive plan so it is a lucrative industrial
develagnent. He stated he doesn't want to sacrifice the whoZe area by
constructing only a portion of the road.

N.�. Qureshi, City Manaqer, stated almr�st 25 years ago he joined the City's
service. He stated he came as a young person and, in 1974, the City Council
gave him the o�ortunity to serve as the City Manager and, recently, the
Council honored him by passing a resolutian f or services he has pravided.
He stated with the direction af the Council, help of the staff, and support
frcYn the citizens, a rn$nber of projects were acccmplished. He stated Y„e naw
feels that it may be the time to pravide the opportunity to a different
person to sezve as City Manager.
N�. Qureshi stated he wants to give credit to all the staff who have serv ed
with him in accomplishing these tasks in the community. He stated,
presently, there are a rnanber af projects that have been completed or the
mold has been set. He stated final plans have been developed far additional
pathways and ponding areas, and a major modification completed in the
Sprinc,�rook Nature Center. He stated plans are naw being completed f or a
maj or development at Moare Lake Clarmr�ns.
Mr. Qureshi stated his hope is that he can spend more time with his family,
take better care of his personal health and of family financial affairs. Fe
stated the reason far this advance notice is to provide a snooth transition
and he will continue to serve the City until a replacement is f ound. Mr.
�ureshi stated he wanted to thank present and past Councils for their
s�port and confidence in him. He stated he hopes the City continues to
grav and prosper.
Mayor Nee stated Nasim has every right to walk through this community and
look around and be proud. He stated a number o� good things have happened
in the c�n�ity and he can say to himself and family that he had sc�nething
to do with it. Mayor P1ee stated he is really proud of Nasim's total effort
including the interaction with staff, the public, and City Council. He
stated Nasim has developed a positive process with staff and the community
and made the Council's wark a lot easier and more productive. He stated he
was glad Nasim will be here to help the Council in the process which really
can't replace him, but canpliment what he has done. Mayor Nee stated Nasim
has thought ahead to an orderly transition and asked the Council to budget
for a consultant to search for a replacenent.

Councilman Fitzpatrick statec he has worked with Nasim the.25 years he has
been with the City. He stated Nasim was City Engineer before his
appointment as City Manager. He stated he has always admired the way
senrice was pravided to the caranunity. Councilman Fitzpatrick stated Nasim
ha� stated his energy is his dawnfall and damages his Ybealth and believes he
has every right to br�w out. He stated he has no further obligation to the
City and stated he came here as a young man and believes he is leaving as a
young man, fmn his perspective. He stated the City has been very fortunate
to have I�?asim and thanked him for his sezvices to the City.
Councilman Schneider stated he first met Nasim when attending the City
Council meetings and had an aportunity to work with him both as a resident
and of f icial of the carYnunity. He stated Na.sim is a man of integrity and as
honest as anyone can be in City govex�unent. He stated from the Council
perspective, whene�ver h,e hears af sane great ic�ea, Fridley has already tried
it and certainly the credit has to go to Nasim's leadership. He stated
Nasim is sensitive to the Council's needs, constitutents' needs, and staffs'
neec3s and walks a vezy fine line. He stated this isn't an easy job, but he
gets things done. He stated if there is a problen, he gets it solved, and
if there is a chance for development, it happens. He stated it will be
difficult to replace Nasim and tharilced him for what he has done for the City
and ]mows the citizens also thank him.
Councilwanan Jorgenson stated she has been on the Council just aver 15
months and has great respect for Nasim and for the assistance he has given
the Council in the financial managanent af the City. She stated Nasim has
placed the City in a very good position and thanked him and wished him good
luck in the future.
Councilman Billings stated, unfortunately, he cl�oesn't have the experience of
working 20 years with Nasim. He stated he has worked with Nasim only the
three years he was on the Flanning CarIInission and the short ture he has been
on the Council. He stated it certainly is a coRmendation to Nasim and his
experience that he has hired a capable staff and is what a good leader
shauld do. He thanked Nasim and stated even though he is moving on, he is
leaving the Council with a good staff to carry on the projects which have
begun. He stated he believes the resolution passed by the Council pretty
much states how he feels. He stated he views the selection of a new City
Manager as prabably the most difficult task he will undertake during his
tenure on the City Council. He thar�ked Nasim far his efforts in the past.
Mayor Nee stated Nasim has provided a list of potential consultants to
assist in f inding his replacement. He stated he has screened these f irms,
at the Council's request, and narrawed it dawn to basically tY�.ree firnls. F.e
stated he checked the references of these three firms and had long
discussions with �st clients of two af the firnzs. Fe stated based on this
revi�w, he would reca�¢c�end to the Council that the fizm of Paul Reaume of
Chicago, Illinois be hired as the consultant to conduct a national search
for a r�� City Manager. He stated this firm is the one who most recer.tly
sezved Coon Rapids and Brooklyn Park and he contacted the Mayors and several
Council members of both of these ccmmuiities regarding their perforniance.

which decreases the contract by $356.70.

Recreatirn and planning Ca�unissions. involves clearing the aarage. cleaning the
site and redesic�ing the principal structure as an open air oark shelter. Work

of the house. At this time, we have reoeived estimates for this work which
irivolves approximately 54.�00. Additional estimates are being sought for

Dear Jim:
As you know, the North Suburban Center for the Arts, together with
Anoka County, has been involved in the restoration of the Banfill
TaYern/Locke House in Fridley. [Ve are haApy to renort that the
restoration has been nrogressing and that if all goes well we
should be ooening at least �art of our Art Center in the Banfill/
Locke House by Labor Day of this year.
The Countv has all but comnleted the work on the exterior of the
house and the architect, Foster Dunwuddie, has let out bids for
nartial rehabilitation of the interior and hones to have that oart
underway by the £irst part of May.
Fortunately our agreement with the County allows us to proceed
with the interior at a nace we can manage. I am encZosing two cost
estimates we received from the architect: Al�ernate No. I and A1-
ternate No. 2. Realistically the NSCA Board felt that Alternate Vo.
2 would be the one we could manage at the moment, leaving the rest
of the work, as outlined in Alternate I for a Zater date.
Please note that in Alternate 2 the cost of paint, carpet and par-
titions must be added to the construction cost total, bringing the
grand total to $39,270. Our current finances fall short of this
total. iae are still in need of an estimated $16,270 to purchase
the Daint, carpets, partitions and Day for part of the construct-
ion cost.
It would be our hope that the City of Fridley, (and we are very
much aware and do appreciate your generosity toward this nroject
in the nast) would heln us with a financial contribution that would
allow at least the completion of Alternate 2 by the fall of 1988.
Ideally of course we would choose Alternate I.

At the May 2 Council meeting, a public hearing was opened for Street
Impra�enent Project No. ST. 1988 - 1& 2. At the public hearing, information
was reveived and discussion had on the oost distribution for the intersection
and sic�al portions of the Slst Way Street Imprwenent. As a result c� those
discussions, staff has redistributed the costs for the intersection and
sic�als to the Co�mty and City. Zbe renair.ing costs for entranoe and st reet
imprwanents renain distributed to all o� the parties.
Sinoe 1984, the City has been working with the Depsrtrnent c� the Navy and FMC
to obtain an easement and install an �derground water service line and
roadway impravenents along Slst Way. Last f all, we f inally obtained the
easenent and an agreement from the Navy for the waterline construction.
During those three years of discussion, it was �derstood that the roadway
impravenents would be handled sunilar to the waterline improvenertts. It now
appears that the Navy dlooses to redefine their funding mechanism for the
roadway imprwenents.
While all af the garties esser�tiatly support the improvane.nt c� 51st Way and
East River Road with permaner�t sic�►als and traff ic o�ntrols, it appears that
the Navy may take a consic�erable amount of time, through thei r rev iew
prooess, before a final decisior� is made on the cost garticipation. Since
the Navy ano�nts to 27 peroer�t of the project, it behowes the City to obtain
thei r f �mding agreement.
We are preparing the plans and specificatians to allaw the Slst Way project
to be added as an aQnenc�nent during the awarding process. Accordingly, I
would rev�mmend to the Co�mcil that they close the public hearing and staff
v�ntinue to work with the Navy prior to the Council taking final action to
award the street improvement project. If a Navy decision has not been
readled by J�ne 6, we would rec��nend the CA�cil not to include that work in
the Street Imprwenent Project No. ST. 1988 - 1& 2 award.

�e petitioner, Wayne Johnson, i.s requesting the City Couicil to approve the
first reading of an ordinanoe which vacates the alley in Block 5, Hyde Park
Acidition, lying north of the south 1 ine of Lot 22, extended easterly and
south of the north line of Lot 30 extended easterly, all lying east of and
adjoining Lats 22-30, Riock 5, Hyde Park Addition. Appraval of this request
would increase the petitioner's rear yard area allowing him to construct a
three car garage for his triplex.

Q� September 14, 1987, the City Council approved the f irst reading of the
original ordinance vacating the west one half of the valley, with five
stipulations (see City Council minutes dated September 14, 1987) . The
Co�cil tataled the seoond reading of the ordinanoe on September 28, 1987 and
instructed staff to determine the State's interest in the east 1/2 of the
alley. Apparently, Mr. Johnson mis�derstood that upon appraval o� the alley
vacation, he would only obtain the west 6 feet and not the entire 12 feet.
In order to o�nstruct a garage, Mr. Jahnson feels he reeds the the enti re 12
feet o�' the vacated alley.
As requested, staff has determined the State's interest in the alley (see
letter frcm N1nDOT dated April 4, 1988). Upon vacation approval, MnDOT will
quit claim the alley's east 6 feet to the City. �en, the City may declare
the property excess and deed it to the adjaaent p�operty awr�ers to the west.
An ordinanoe determining that the pro�perty is excess will be placed on the
agenda uQon reoeipt o� a deed f ran MnDdr.
Sinoe the State has agreed to v�nvey the east L2 0� the alley to the City,
the petitioner is requesting the entire portion of the alley be vacated. 7�e
original puhlic hearing was for the entire alley. At this time it would be
appropriate to o�nsider a first reading to vacate the entire alley.
In addition to this vacation, Mr. Johnson has subanitted a variance request
which is being reviewed by the Appeals Commission for the proposed garage
reducing the sic3e yard and rear yard setback f rom 3 feet to 1 foot. Mr.
Johnson rias reveived letters f rom Nortel Cable and Nothern States Power
authorizing the encraad�ment on their easements by the proposed garage.

attached garage with a driveway. Since the proposed second accessory

Mr. Hetzold stated that preserYtly Mr. Lindner had a metal storage shed in

Mr. Betzald asked if there was anyone in the audienoe who wished to make any
oatments regarding this special use permit request.
Mr. Qenn Toru�eslan, 6538 C1wer Plaoe, stated he lived next cbor to M.r.
Lincher. He stated he objected to the building. This was a residential
neic�,borhood, and a structure o�f this size would be a cletriment to the
appearanae o� the reic,�ib�rhood. He stated it would also obstruct his view
of the r�ei�borhood. He stated it did not make muc:h sense to have a baat if
the boat was only g�ing to be taken in and out o� the building onoe a month.
He stated their bedroom windows are on the side of the house where the
bulding would be located, and he just felt it w�ould take �ay fran the value
of the surro�nding properties.
Mr. Lindner stated he had c3�ne a market analysis of his existing property
and the rei�bors' properties. He had two realtors out and both realtors
said that the o�nstruction of a storage building in this location would not
devalue the properties, either plus or minus. The property values would
renain the same.

Mr. Lee Wen�, 6545 Monrae Street, stated his praperty was located directly
behiux3 Mr. Lirx3ner. He stated his garage was Iocated in the rear yard and
was almast beck to b�ck to the proposed building.
Mrs. Wendt stated they did not abject to the storage building as pcoposed by
Mr. Lindner. It did affec* Mr. Zbnnaslan mare than it did them.

Mr. Robinson stated that in looking at the aerial �hato, it looked 1 ike Mr.
Lindner's building, if appro�ved, would be the 13�ird rear yard garage in the
i�enediate grouping of hanes.
Mr. Betzold stated he did not rec,all many other acaessory buildin9s simil ar
to this that have been denied.
Mr. Robinson stated that as far as the garage to the west, ti►at did not seem
to be an issue. He suggested the possibility a� a landscape buffer between
Mr. Linc�er's property and Mr. Tonnaslan's. A buffer would require a
little ait more setback - 8 ft. As far as Mr. Lir�er �ing the c�assy area
to mwe his boat in and out� the special use permit c�uld be reviewed again
at the end of the sum�er to see if there had been any d�anage to the turf .
Mr. Betzold asked Mr. Tonaslan how he felt aboat a buffer, landscaping and
stirubbery, between the two properties.
Mr. 7.bnnasla� stated there were already shrubs between the two properties.
He stated his main oonoern was what would happen in the future if Mr.
Lindner maied away and new aa►�ers used that building for a machine shop or
for the storage � a�tomobi].es. He stated he had a b�at for five years and
had it stored in the driveway. He agreed having a boat stored in the
driveway was an eyesore, and he had f inally moved his boat to the St. (�oix.
He stated he o�uld oertainly appreciate the problen of having a boat and
needing a plaoe to store it. He stated Mr. Lindner was a very nice
r�eic�bor, a�d he had nothing against Mr. Lindner personally. He was just
�naerred about that large a storage building in the rear yard.
Mr. Betzold asked Mr. LincY�er if he would have a problen if the Planning
Cannission reoosamended the City Co�ncil review the special use permit in a
f ew manths.
Mr. Lindler staed he would have no prot�lem with the City Council reviewing
the special t�se permit whenever they saw fit.
Mr. Betzold asked if Mr. Lin�er r�eeded a storage building qnite this large.
Mr. Linci�er stated the reason he was proposing a 20 ft. by 28 ft. building
was heca�e the boat he would be purchasing was 25-26 ft. Iong with the
tongue. A narrow structure, 9 ft. by 27 ft. , would not look very nice.
Another aption was a carport aEf the garage, and he did not think that would
look very nice. Another option was a semi-structure, a pole barn type
structure, and that would look worse yet. He stated the size of the
building would help him in the storage of a lot of lawn equipment in
addition to the boat. He did have two cars and those were kept in the
attad�ed cbuhle car garage.

Mr. Robinson stated that regarding Mr. Tonneslan's concern about the
�uilding being used for a machine shop in the future, this special use
permit, if apprwed, w�uld be filed against the p�roperty at the Gounty, and
the stipulation that the tuilding was to be �ed for the storage aE boat and
laan equipnent anly would be attached, so that any future owners would be
aware c� the special use permit and the stipulation.
Mr. Betzold stated it eo�nded lik�e there w�ould be an eyesore either way. If
the special use permt was denied, then there w�ould be the eyesore of having
the boat stored in the driveway. He stated he would be incl u�ed to vote in
favor af t�e special use permit, subject to a review by the City Co�cil in
six months and that the exi�ting metal shed be renwed, along with the two
stipulations remamended by staff.

JOINT POWERS AGREEMENT
THIS AGREEMENT made and entered into on ,
198 , notwithstanding the date of the signatures of the parties, between the COUNTY
OF�NOKA, State of Minnesota, hereinafter referred to as the "COUNTY", and the ClTY
OF FRIDLEY, hereinafter referred to as the "AAU�dICIPALITY".
WITPESSETH:
WI-�REAS, Minn. Stat. Section IISA.919 (1985), (hereinafter Surcharge Statute)
provides that:
A county may impose a fee, by cubic yard of waste or its equivalent, on
operators of facilities for the disposal of mixed municipal solid waste located
within the county. The fee in the metropolitan area may not exceed 25 cents
per cubic yard, or its equivalent. The revenue from the fees shall be credited
to the county general fund and shall be used only for landfill abatement
purposes, or costs of closure, postclosure care, and response actions or for
purposes of mitigating and compensating for the local risks, costs, and other
adverse effects of facilities.
WHEREAS, the County imposed a 25 cent per cubic yard fee effective January I,
1985, at all mixed municipal waste landfills located within its borders; and
WHEREAS, on Apri) 16, 1985, the Anoka County Board of Commissioners adopted a
poiicy whereby a certain portion of the fees collected under the Surcharge Statute are
available for distribution to municipalities within Anoka County to reimburse eligible
expenses for local ►andfill abatement activities; and
WHEREAS, Anoka County expects to apply for and receive Metropolitan Council
funds allocated to Anoka County pursuant to fvlinn. Stot. � 473.8441, Subd. 5(c), to be
distributed using a performance based funding formula for landfill abatement activities;
and
WHEREAS, on March I S, I 988, the Anoka County Board of Commissioners allocated
funds expected to be received from the Metropolitan Council, surcharge collections and
other sources for recycling/composting/waste reduction activities in the Municipality in
accordance with the Anoka County Solid Waste Master Plan and Metropolitan Council and
Legislative direction to have recycling and composting activities expanded at the local
level; and
WHEREAS, the Anoka County Board of Commissioners has adopted a policy whereby
the above allocation in excess of $2,500.00 that has not been requested by May I5, 1988 is
to be reallocated to municipalities within Anoka County for reimbursement of eligible
expenses for said activities; and
WHEREAS, the parties anticipate that this Agreement may be amended if the
County allocates additional funds to the municipality for new or expanded
recycling/composting/waste eduction activities; and
WHEREAS, as of May I, 1988, there is a balance of s 19,570.25 from the interim
funding program that will be spent in accordance with the interim funding work pla�,
attached as Exhibit A; and

WHEREAS, the following amounts have been allocated to the tvlunicipality under the
performonce based funding program for reimbursement of the hlunicipality's eligible
expenses listed in Exhibit B:
$ 1,076.00 for base recycling efforts
$19,399.00 for $ per ton recycled (including I Oao bonus)
$ -0- for community commercial/industrial recycling program
-0- for community yard wasfe program
�20,475.00 TOTAL Performance Based Funding Program; and
WHEREAS, the Municipa(ity wishes to achieve the goa( of recycling 629 tons
(including 10°6 bonus) of recycloble materials between July I, 1988 and June 30, 1989; and
WHEREAS, the parties are authorized and empowered to enter into this Agreement
pursuont to Minn. Stat. Sections 471.59 and 473.8) I, Subd. 7.
NOW, THEREFORE, in consideration of the mutual covenants and promises
contained in this Agreement, the parties mutually agree to the following terms and
conditions:
I. PURPOSE
The purpose of this Agreement is to provide for cooperation between the County and
the Municipality to implement landfill abatement programs in the Municipality.
2. TERM
The term of this Agreement is from through June 30, 1989, for
local landfill abatement activities performed rom May I, 1988 through June 30, 1989 as
outlined in Exhibit A and from Ju(y (, 198$ through June 30, 1989 as outlined in Exhibit B,
unless earlier terminated as provided herein.
3. PROGRAM
The Municipality shall perform landfill abatement activities substantially as set
forth in the landfill abatement work plans attached as Exhibit A and Exhibit B, which are
made a part of this Agreement.
The Anoka County Administrator or his designee shall have the authority to approve
modifications to Exhibit A as reqvested by the Municipality as Iong as the amount poyable
under this Agreement for eligible activities set forth in Exhibit A does not exceed
$ I 9,570.25.
The Anoka County Administrator or his designee shall have the authority to approve
modifications to Exhibit B as requested by the Municipality, as long as the amount payable
under this Agreement for eligible activities set forth in Exhibit B does not exceed
$20,475.25.
4. REPORTtNG
a. The Municipality shall, on a quarterly basis, submit to the County no later
than October 3(, 1988, January 31, 1989, April 30, I°89 and July 31, 1989,

an accounting of the amount of waste which has been diverted from landfills
as a result of the Municipality's activities and the efforts of other community
programs, redemption centers and drop-off centers. For community yard
waste programs, an estimate shall be provided of the number of cubic yards or
tons of yard waste brought to a composting site, together with a description of
the methodology used for caiculations. For recycling programs,
documentation shall be provided showing the number of tons of each
recyclable material which has been collected and the number of tons of each
recyclable material which has been marketed. For recycling programs run by
other persons or entities, the Municipality shall also provide documentation
showing that the materials were recycled by the Municipality's residents.
b. The Municipality agrees to furnish the County, on a quarterly basis no later
than July 3(, I 989, information regarding any revenue received from sources
other than the County for landfill abatement activities set forth in Exhibit A
and Exhibit B and an occounting of the use of said revenue.
c. The Municipality agrees to furnish the County with additional reports in form
and at frequencies requested by the County for finoncial evaluation, program
monagement purposes, and reporting to the Metropolitan Council.
S. BILLING AND PAYMENT PROCEDURE
The Municipality shall, on a quarterly basis, submit itemized invoices to the Covnty
for eligible abatement activities no later than October 31, 198$, January 31, 1989, Apri(
30, 1989, and July 31, 1989, in a form acceptable to the County. Costs not billed by July
31, 1989 will not be eligible for funding. The invoices shall be paid in accordance with
standard County procedures, subject to the approval of the Anoka County Board of
Commissioners.
6. ELIGIBILITY FOR FUNDS
a. Only those activities which are identified in Exhibit A and Exhibit B shall be
eligible for funding under this Agreement. Landfill abatement costs incurred
by the Municipality which are reimbursed by a source other than as provided
for in this Agreement are not eli�^ible for further reimbursement under this
Agreement. Any revenues received by Municipality from landfill abatement
activities identified in Exhibit A and Exhibit B shall be used only for landfill
abatement activities.
b. Notwithstanding any provision of this Agreement to the contrary, the
maximum arr�ount that the County will reimburse to the Municipality for
eligible activities listed in Exhibit A shall be S 19,570.25 and for eligible
activities listed in Exhibit B shall be 520,475.00.
c. The Municipality is entitled to receive reimbursement for eligible expenses
iisted in Exhibit B up to the project maximum of $20,475.00 only if it meets
certain performance standards. The actual project maximum for eligible
expenses listed in Exhibit B shall be computed as follows:
I. $1,076 as a base amount if it implements a residentia) recycling program
as set forth in Exhibit B;

2. Up to $19,399.00 at the rate of s30.83 per ton of residentiai materials
recycled between July I, 1988 and June 30, 1989, by the Municipality or
other community programs, drop-off centers or redemption centers to
the extent that the Municipality provides documentation acceptable to
the County that the recycled materials were recycled by residents of the
Municipality;
3. $-0- for the Municipality's participation in commercial/industrial
recycling efforts; and
4. $-0- for a community yard waste composting program sponsored by the
Municipality.
The Municipality sholl receive reimbursement for eligible expenses as set forth
in the Budget for Municipality's Landfill Abateme�t activities contained in
Exhibit B. The Municipality may request, and the Anoka County Administrator
or his designee may approve in his or her discretion, changes in the tine items
set forth in said budget so long as the project maximum computed as set forth
in this Section 6.c is not exceeded.
d. If landfill surcharge monies, Metropolitan Council Grant monies, a�d other
monies collected by the County and allocated to cities and townships for local
landfill abatement activities are inadequate to meet the County's allocation to
the Municipality under this Agreement, the County may reduce the maximum
amount reimbursable under this Agreement after giving written notice to the
Municipality.
7. RECORDS
The Municipality shall maintain financial and other records and accounis in
accordance with requirements of the County and the State of Minnesota. In accordance
with Minn. Stat. � 47t.59, Subd. 3, the Municipality shall maintain strict accountability of
all funds and mointain records of all receipts and disbursements. Such records and
accounts shall be maintained in a torm which will permii the tracing of funds and progrom
income to final expenditure. The Municipality shal) maintain records sufficient to reflect
that all funds received under this Agreement were expended in accordance with Minn.
Stat. � I I SA.919 and Minn. Stat. � 473.8441 for recycling/yard waste composting/waste
reduction landfill abatement purposes. The Municipality shall also maintain records of the
quantities of materials recycled or composted. All records ond accounts shall be retained
as provided by law, but in no event for a period of less than three years from the last
receipt of payment from the County pursuant to this Agreement.
8. AUDIT
Pursuant to Minn. Stai. 16B.06, Subd. 4, the Municipality shall allow the County or
other persons or agencies authorized by the County, Metropolitan Council and the State of
Minnesota, including the Legislative Auditor or the State Auditor, access to the records of
the Municipality dt reasonable hours, including all books, records, documents, and
accounting procedures and practices of the Municipality relevant to the subject matter of
the Agreement, for purposes of a�dit. In addition, the County shall have access to the
project site(s), if any, at reasonable hours.

9. COMPLIANCE WITH REQUIREMENTS OF Th� LAW
In performing the provisions of this Agreement, both parties agree to comply with
all qpplicable federal, state or locol laws, ordinances, rules, regulations or standards
established by ony agency or special governmental unit which are now or hereafter
promulgated insofar as they relate to performance of the provisions of this Agreement. In
addition, the Municipality shall comply with all applicable requirements of the
Metropo�itan Council for the use of funds provided to the M,unicipality by the County
under this Agreement.
10. AFFIRMATIVE ACTION
No person shall illegally, on the grounds of rQCe, creed, color, re�igion, sex, marital
status, public assistance status, sexucal preference, handicap, age or national origin, be
excluded from ful) employment rights in, participotion in, be denied the benefits of, or be
otherwise subjected to unlawful discrimination under any program, service or activity
hereunder.
The Municipality agrees to take affirmative action so that applicants and employees
are treated equally with respect to the following: employment, upgrading, demotion,
transfer, recruitment, layoff, termination, selection for training, rates of pay, and other
forms of compensation. The Municipality further agrees to take affirmative action to
include the participation of women and minority business enterprises (W/MBE) in the
performance of this Agreement, wherever possible. The Municipality agrees to obtain a
Metropolitan Council list of W/MBE's and to make a good faith effort to inciude
participation by W/MBE's for any contract to be let in performing the activities
contemplated by this Agreement.
11. PUBLICATIONS
The Municipality shall acknowledge the financial assistance of the Metropolitan
Council and the County on all promotional materials, reports and publications relating to
the activities described in Exhibits A and B.
I 2. INDEMNlFICATION
Both parties mutually agree to indemnify and hold each other harmless from all
claims, demands, and causes of action of any kind or character, including the cost of
defense thereof, resulting from the acts or omissions of their respective public officials,
officers, agents and employees relating to activities conducted under this Agreement.
13. ASSIGNMENT AND SUBCONTRACTING
The Municipality shall be responsible for the performance of all subcontracts and
shall ensure that the subcontractors perform fully the terms of the subcontract. The
Agreement between the Municipality and a subcontractor shall obligate the subcontractor
to comply fully with the terms of this Agreement.
14. ENTIRE AGREEMENT
It is understood and agreed that the entire Agreement is contained herein and that
this Agreement supersedes all oral and written agreements and neqotiations between the

parties relating to the subject matter hereof, including the Joint Powers Agreement
between the parties dated February 9, 1988, which is hereby terminated by agreement of
the parties.
I S. AMENDMENTS
Any amendments, alterations, variations, modifications, or waivers of this
Agreement shall be valid only when they have been reduced to writing, duly signed by the
part ies.
16. CONTRACTS AND PURCHASES
Contracts let and purchases made under this Agreement sholl be made by the
Municipality in conformance with all applicable laws, rules, and regulations.
17. TERMINATION
This Agreement shal! terminete under the following circumstances:
a. By mutual written agreement of the parties; or
b. By either party, with or without cause, giving not (ess than seven (7) days
wr+tten notice, delivered by mail or in person to the other party, specifying
the date of termination.
18. PROPERTY DISTRIBUTION
If this Agreement is terminated pursuant to paragraph 17, assets acquired in whole
or in part with funds provided under this Agreement shall be the property of the
Municipality so long as said assets are used by the Municipality for the purpose of a
landfill abatement program approved by the County.
In the event the Municipality discontinues use of the assets for said landfill
abatement purposes said assets shall, ot the County's discretion, ei ther be returned to fhe
County or sold and the net proceeds of the liquidntion returned to the County.
I9. SEVERABILITY
The provisions of this Agreement are severable. !f any paragraph, section,
subdivision, sentence, clause or phrase of this Agreement is for any reason held to be
contrary to law, such decision shall not affect the remaining portion of this Agreement.

Proposed Activities (Continued)
A Video, produced by the Saint Paul Neighborhood Energy
Consortiu�, entitled, RECYCLING WITHIN REACH, will begin
airing on f'ridley Cable Channel 13 in May 1988.
The City plansto place Area Designation Banners throughout
the City during the summer months. The banners will indentify
the area and the days for recycling within that area.
The City is proposing to run a demonstration project to determine
the effectiveness of bins in the month of July. The City
then proposes to acquire and distribute 4,000 bins over the late
summer and early fall.
7here is also the possiblity of running a short-term lottery
to coinside with the first three month of distribution of bins.
The total cost of the lottery to the City wouTd be $600.00

Mr. Robertson stated the petitioner was requesting a rezoning fraa R-3
(General Multiple Dwell ing) to Qt-1 (General Off ice ), for the purpose of
�mbining the lots and constructing a three-stsory multi-tenant office
building. The building would be built wer a surface parking area, so
essentially part of the building would be on stilts with parking underneath.
�tao paroels were involved: the most southerly Zot which was already zoned
Qt-1 and presently has the �rrill Lynch office building on it, and the
northerly garael whic� was zortied R-3 and has a boarded-up vacated single
fanily house on it.
Mr. Rot�ertson stated there have been three rezonings along Hillwind Road
from R-3 to CR-1 dating back before 1951. In addition, this specif ic lot
was the subject c� a rezoning prooedure whidz was terminated when the sewnd
reading of the ordinanoe was tabled at the City Council in 1982. At that
time, the petitioner, Ms. Stinski (Nybo), was �able to complete the
requirements for the land develognent.
Mr. Robertson stated that, aZong with the rezoning, the petitioner was
prooessing a variance request for reduction of a buffer area between a
oommercial and resideritial area from 15 feet to 5 feet. This petition was
heard by the Appeals Commission on April 26, 1988, at which time they
reromnended apprwat to the City Co�cil.
Mr. Robertson stated Ms. Stinski has also iriformally oommunicated with the
HRA and has sent the HRA a list c� proposed financial assistance she would
need for this project.
Mr. Robertson stated that should the Planning Cammission reconsnend apprcyval,
staf f revomnencis the f oll aw ing st ipul ati ons :
1. The vacated house on the rezoned paroel should be renwed f raa the site
prior to the publishing of the rezoning ordinanoe. (This would ensure
that this structure whirh has been a public safety nuisance would be
renaved ev� if the developnent did not prooeed. )
2. The proposed rezoriing is for the develognent as outlined on the attad�ed

3. �e petitiazer or her agent agrees to manage the leasing of the off ice

4. �titioner to work with staff on landscape ref inements and have an
agreed- upon glan prior to City Co�cil appraval.
5. Petitioner to supply a storm drainage plan which meets with staff

Mr. Betzold stated that the City had a long history of prohlens with the old
burned out house and getting any 000peration fran the owner. He asked Mr.
RQbertson if he had any }�ackgro�md informaton on that.
Mr. Robertson stated, yes, that information was included in the files.
TYiere was a history � letters to the haneawner going back to about 1981.
There were a series of code violations and nuisance violations which
culminated in a Criminal Action suit being f iled one year ago, aa�d the o�wner
pleading guilty.
Mr. Brian Hanson stated he and Ms. Stinski were willing to answer any
questi�s the C�aranission mic�t have.
Mr. Betzold stated he was a little concerned about the history of the
property where the awr�er was not very 000perative in working with the City;
yet t�he aaner is now requesting help frcm the City. What assuranoes does
the City have that the o�wr�er was now going to be 000perative when there has
been a long history of rbn�operation includinq a c�ilty plea to a criminal
charge.
Ms. Stinski stated she di.d not feel there was any lack of 000peration on her
gart. Et�ery time Darrel Clark, the City Building Inspector, called her
regarding the house, she would get a carperiter out right away to board it
�. It was very difficult because the house is in the back of the lot and
it is easy for teenagers to get back there and break into the house again.
She has boarded the building up 12-15 times. She stated the building was
burr�ed and c�atted prior to her aoquiring the property, but she felt she has
always 000perated with the City when she was notif ied to board the building
up again. She stated she had not torn the building down in the hope that it
would g� hand in hand with the developnent.
Mr. Betzold stated he j�st warited to be sure that, if something happens and
the developnerit cbes not go f orward, the house will be renoved.

Mr. Barna asked if the petitio�er has asked the Fire Degartment to da a test
f ire drill.
Ms. Stinski stated, yes, she had, but because o�E the close proximity to the
agartrnent buildings, it oould not be dore.
Mr. Hanson stated they do not have any problems with the stipulations as
reca�rmended by staff. 7�iey seem logical and appropriate and will make for a
well directed project.
Ms. Kathleen Philli�s stated she was the manager for the Merrill Lynch Real
Estate Building. She stated they are talking about renting space in this
new aEfioe building and are very much in favor of the projec�.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.03.D,(2), requires a side yard setback of 10 feet
between any living area and side property lines.
Public purpose served by this requirement is to maintain a minimum of
20 feet between living areas in adjacent structures and 15 feet between
garages and living areas in adjacent structures to reduce exposure to
conflagration to fire. It is also to allow aesthetically pleasing
open areas around residential structures.
Section 205.07.03.D,(1), requires front yard setback of 45 feet (as
set by City Council).
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right-of-way and also for
aesthetic consideration to reduce the building "line of sight"
encroachment into the neighbor's front yard.
B. STATED HARDSHIP:

The home to the west is set back 44 feet; the home to the east is set
back 59 feet. The lot is over 175 feet deep; therefore, if the home
were placed back at the 45 foot distance, the rear yard would be in
excess of 75 feet, where only 40 feet is required.

The proposed house is 30 feet deep and 65 feet long. The resulting
area is 1,950 square feet.
There was a request for a reduced side yard last year, VAR 4687-23,
which xas recommended for denial by the Appeals Commission on June 23,
1987, and apprQved by the City Council on July 20, 1987.
Mr. Clark showed the location of the property on the Location M�p �rtQ
Zoning Map. The property is to the west of East River Road and on the
north of 76th Way. Oak River Estates is a relatively neW plat which was
platted 3 or 4 years ago. Because an existing home has been built far
back on the lot, the City Council set a longer setback of 45 feet.
The Site Plan shows the garage to the front of the proposed home with a
21-foot setback from the curb. The proposed home is 65 feet wide across
the lot Hith 5-foot side yard setbacks. Last year another person
wanted to build a house on that property with 6-foot setbacks from the
property. The Appeals Commission denied the variance. The Petitioner
changed the layout of the proposed home which was then approved by the
City Council. However, the petitioner did not build on the site.
Mr. Buchli is noW requesting a variance to build on the same lot.
Mr. Kuechle asked if there was anything else regarding the property that
the commission should be aware of.
Mr. Clark stated there is a well in question that must be capped, but
this does not affect the variance as it is being requested. Mr. Clark
stated that this variance covers the front yard, side yard to the east,
and side yard to the west.
Ms. Savage asked if the house Was the same length as that proposed last
year.
Mr. Clark stated this house is uider measuring 65 feet.
Mr. Barna asked Mr. Buchli to explain the hardship.
Mr. Buchli stated this is the only property he could buy where he would
not be required to have someone else build for him.
Mr. Barna asked if Mr. Buchli had considered other plans.
Mr. Buchli stated he had looked at numerous plans, but this plan fit his
family's needs in a one-story home.
Ms. Savage asked if the home could be moved back.
Mr. Buchli felt it would look better if the bodies of the homes were in
line.
Mr. Barna indicated that the building criteria stated a building is to
have a 45 foot setback or take an average of the front yards of houses.
The norm is the front of the garage would have to be at the 45 foot
distance and the home behind the garage. He asked if Mr. Buchli would
still build the home if it were moved back.

Mr. Buchli stated he would still build. Others in the neighborhood
thought it would look okay but others said they did not like it. The
setback is a preference. The house itself is 29� feet deep and 65 feet
wide.
Mr. Barna indicated that, if the building was shifted back so the garage
was at the 45 foot setback, the side yard variance would not be as noticeable
as it is now; however, the new home would be behind the house on the west side.
Ms. Savage asked if there was any way Mr. Buchli could build a house to
suit the purpose without a variaace. A hardship must be established,
otherwise the commission cannot approve the variance.
Mr. Nick DeGroot, resident to the west of the property, indicated the
commission had waived the hardship for commercial construction and
questioned why the commission could not waive the hardship and say it
was good for the neighborhood. He feels there is a hardship.
Dr. Vos indicated to Mr. DeGroot that he would view the roof of the
proposed home if it were built as presently shown.
Mr. DeGroot was not opposed to the house being moved further back.
Mr. Sherek stated he wished to clarify that the spirit of the law was
needed in the particular situation of the commercial property. This
may or may not be the case in this particular situation.
Mr. Barna indicated that they were to determine that at this time. It
is the commission's desire to consider the economic needs of the
neighborhood and try to work out what is possible without a variance.
Dr. Vos asked to clarify the measurements on the east side of the property.
Mr. Clark indicated there is 5 feet from the building to the property
line to the east plus an additional 30 feet from the property line to
thi: house to the east. He added that it would be possible to build a
SS-foot house without a variance.
Dr. Vos noted that would mean a loss of I50 square feet of living space.
Mr. DeGroot stated that ramblers are no longer found because developers
and builders can fit more houses on the property if they build splits
and two-story dwellings.
Mr. Buchli stated he had purchased the property about two weeks ago
contingent upon getting a variance.
Mr. Barna received a petition from Rosie and Nick Degroot and a petition
from Robert Hinz stated they have no objection to the variance request
and recommend its approval. �

Mr. Barna asked for additional comments from the audience.
Mr. Michael Wocjik stated the garage as presently situated would block
the view from his residence. The proposed setback is half of What the
other houses have. Lot S is open.
Mr. Clark indicated that the setback for Lot S is 45 feet and Lot 4 is
59 feet. The house on Lot 4 was existing at the time the plat was
approved. The City Council stipulated the garage be built. If this
house were torn down, new construction would likely have a 45 foot
setback.
Mr. Jerry Boedigheimer also expressed opposition to the variance. He
thought the change in front setback would make the neighborhood appear
like a jigsaw puzzle and does not think it is right for the street. He
also expressed opposition to the side yard request as it would detract
from the appearance of other homes.
Mr. Wojcik agreed�adding that all houses are wide apart and then having
one house placed closely to the next does nc�t look right.
Ms. Mary Boedigheimer expressed opposition to the zigzagging effect of
the front. It is not consistent with the rest of the neighborhood. She
also felt the side variance Would detract from the neighborhood. The Code
was established for a reason and felt the Code neede� to be followed.
Mr. Boedigheimer stated there are empty lots which will be built on in
the future. Approval of this variance request could set a precedent for
future construction.
Dr. Vos stated the front variance had been discussed. However, a neighbor
had concern about the side yard setback and the neighbor to the west has
no objection to the S foot setback.
Mr. DeGroot had no objection to the 5 foot sideyard setback. His home is
13 feet from the property line and there would be 5 feet from the property
line to the proposed home for a total of 18 feet. He did not feel this was
close. The distance to the east would be 35 feet between buildings.
Mr. Barna asked if Mr. Buchli would like to retrack the request for a
front variance of 21 feet.
Mr. Buchli stated he was wil2ing to retrack the request for a 21 foot front
variance but he would still request the 5 foot side variance on the east
and west.
Mr. Barna asked for discussion regarding the side yard setback as requested.
Mr. Boedigheimer objected to the side yard variance. He feels it affects
the neighborhood and that the Code provides for a 10 foot side yard setback
for a reason and it should not vary.
Mrs. Boedigheimer agreed that the 10 foot side yard should be maintained.

Mr. Sherek stated he had no problem with the &etback to the east. The
home on Lot 4 is a sufficient distance from the property line. He asked
if it would be possible to adjust the house plans on the West side to make
it closer to code requirements.
Mr. Buchli stated this would take nearly 150 square feet off the home.
Mr. Barna suggested chan�ing the home's configuration somewhat to allow
for the side yard variance.

Mr. Kuechle stated he was inclined to vote no. He was not convinced that
a lot 75 feet wide could not have a good quality home built on it. He
felt a house plan could be found to fit the lot that the owner would still
be happy with.
Mr. Sherek felt a house of that size could make the neighborhood appear
cramped. The retraction of the front yard setback will help. He had no
problem with the side variance to the east but felt the west side was too
close. He requested the variance be voted on in parts.
Dr. Vos noted the front yard setback had been taken care of. He was not
concerned with the variance to the east because the existing house was
an adequate distance £rom the property line. The variance to the west
could have a crowding effect. He also requested the variance be voted on
in parts.
Mr. Savage stated she would have to vote no. The proposed house is wider
than that proposed last year which was not,approved. She did not feel a
hardship was articulated. It is necessary to work with the statute.
This is a nice neighborhood and certainly the neighbors would like to see
a nice home built there. However, she did not think the plan met the
spirit of the code. The houses are too close together.
Mr. Barna stated he was opposed to the variance presented the previous
year. Much thought and'planning has gone into the lot layout and setbacks
for the development. In new developments the developer must build the
right size homes without a variance. A house can be build on the lot
without a variance. The petitioner can find a plan he could live with
for that 2ot. Mr. Buchli can appeal to the City Council.
Mr. Barna indicated that the variance to reduce the front yard setback
of 45 feet to 21 feet had been withdrawn. The Commission will vote on
the request for the side yard setback to the east of S feet reduced from
10 feet anQ the request for a side yard setback to the west of S feet
reduced from 10 feet.

Fridley that recently went.forfeit as per Anoka County. The ma�:s are high-

attached Appraisal List 88-B (Exhi.bit E).
I would suggest the Council autYborize the appraval of tY�e sale of these 5
forfeited properties as follaws:
Ni.unt;e.rs 50 and 51 - Unbuildable - Parcels should be sold t�o property
awner abutting on the south (Ipt 1, Block I, Ostinan's Third Addition)
City should retain easemecit for drainage pt�poses twer entire area.

On April 28, w�e reoeived bids for our 1988 Joint Sealcoating Project with
Col�nbia Heic,hts. At the bid opening, we reoeived 3 bids for this work.
An item on the bid sheet for street sweeping before sealcoating in Col�anbia
Heic�ts caused vonsiderable v�nfusion to the bidders. Sinoe Colunbia Heic�ts
desires to inoorporate the presweeping in their contract, we do not feel
cnmfortable determining a law bidder. The Col�mbia Heic�ts City Co�.a�cil will
take action to reject the bic� at their next meeting. We should have the
Cocmcil also reject the bic3s at their May 16 meeting. In order to expedite
the advertising period, w�e will sutmit the notive for rebidding to the Focus
f or incl us ion in the May 18 pub�. ication.

legislation to aanend existing legislation governing volunteer fire fighter
pension retirement; and
WHERFAS, The Fridley Volunteer Firefighters Relief Association has proposed
special legislation to modify their retirement pension; and
WEIERF�S, �e Minnesota Legislature in session in 1988 has passed legislation
which authorizes the Fridley Volunteer Firefighters Relief Association to
convert their pension to a"Defined Contribution" plan; and
WBEREAS, Minnesota Statutes require approval of such legislation by the City
Council to become law;

RE: Special Legislation
You are aware that the Volunteer Firefighters Relief Association had requested
special legislation to be able to convert its retirement pension plan to a
"Defined Contribution" plan.
Legislation contained in Chapter 709 of the Minnesota Session Laws of 1988 has
included statuatory language to allaw this conversion.
One of the requirenents of the special local Zegislation is that prior to
becoming law it is necessary to abtain approval of the local governing body.
The attached resolution for approval by the City Council is for that purpose.
The legislation as passed has been approved by the members of the Relief
Association. They request a�roval of the City Council so that the coriversion
of the retirement program fran a"defined benefit" to a"defined contribution"
plan may be com�leted.

36 Notwithstanding any law to the contrarv, the FridleY
1 volunteer firefiqhters relief association may amend its articles
2 of incor oration or b laws to convert its deFined benefit
3 pension plan to a defined contribution pZan, The conversion
4 plan must provide for allocation of special fund assets amon
5 individual accounts to be established for each active
6 fireFi hters association member. Instead of providing furthe�
7 deFined ension plan beneFits, the association shall purchase

SELF-PROPELLED REGENERATIVE VAC[JIIM/AIR STREET SWEEPER
The City Council of the City of Fridley, Minnesota, will accept sealed bida
for Street Sweeper on June 15, 1988 until 11:00 a.m. on said date at the
�ridleq City Hall, 6431 University Ave., N.E., Fridley, Minnesota, 55�32
(telephone: 571-3�150). All bids must seet the minimum requirements of the
specifications. Failure to comply with this section can result in
disqualif ication of the bid.
F,ach bid shall be accompanied by a Certified Check, Cashier's Cheek, Cash
or Bid Bond and made payable without conditions to the City of Fridley,
Minnesota, in an amount of not less than five percent (5�) of the bid,
which cheek, cash, or bond shall be forfeited if bidder negleets or refuses
to enter into contract, after his bid has been accepted.
The City reserves the ri�ht to aceept the bid xhich is determined to be in
the best interests of the City. The City reserves the right to reject any
and aIl bids and waive any informalfties or technicalities in any bid
received without explanation.
The City Council aZso reserves the right to consider sueh factors as time
of delivery or performance, experience, responsibility of the bidder, past
performance, of similar types of items or materials, availability of
products or other simi].ar factors that it may determine to be in the best

SUBJECT: Street Sweeper
Based upon our discussion at this point in the City's posture. there is a
reed for two types of street sweepers:
1. A medzanical sweeper for the heavy spring and fall
cleanup plus sealooating.
2. A fast normal street sweeper.
�e mly major pieoe af equipnent which does a qood job with heavy debris,
leaves and sealo�ating is an Elgin Med�anical Conveyor-rtype sweeper, simil ar
to the 1972 model whic� we currently have. To auc�nent the normal street
sweeping activities, it would be appropriate to obtain a vacuum
reqenerative-type sweeper which can move rapidly, travel with a larqe load
and is self- supporting. Our FMC was originally purchased to f ill this
purp�se but it has not proved to be a dependable and economical piece of
ecluiuner�t.
In the 1987 and 1988 Budget� f�nds were ic3entif ied for the wrd�ase of a new
street sweeper. We had proposed to purci-iase a newer type Elqin �sing the FrlC
as a trade-in and the foZlawing year to trade in the F1gin for a used street
sweeper. Based upon a review o� the city ryeecls. equip�ent costs and future
priorities, it would be appropriate to purchase a new vacuum
regenerative-�type street sweeper at this time This is predicated on the
ass�►ption that we will wntinue to contract the early spring cleanup and
that we can Ludget the rebuilding of our 1972 Elqin in the 1989 Rudget.
The specifications have been Fxep3red and are ready to advertise for bids.
The bid will be awarded in J�ne cf 1988 with delivery o� a riew sweeper prior
to the fall street sweeping season-

With the construction scheduled to begin sometime in June, it
will be necessary to change the location for meetings of the
Fridley City Council. City Staff has contacted Fridley
Independent School District No, 14, and they have offered to
make the Community Education Center (the old Parkview
Flementary School) available for Council meetings and
commission meetings.
In ?ccordance with the Minnesota Open Meeting Law, it would
be appropriate for the City Council to pass a motion setting
the location for the June 27, 1988 Conference meeting and all
subsequent scheduled meetings of the City Council in 1988 at
the Fridley Community Education Center.
