Date: September 29, 1988
Attached you will find a resolution that will certify ta the County of
Anoka the levy requirement for property taxes. These taxes are the
payable 1989 taxes that are associated vith the bugetary process that
ve are working with currently.
Our levy requirement was prepared in accordence with the State of
riinnesota's levy limit requirements. The payable 1989 levy is 575,032
under the levy limit.

SUBJECT: CERTIFICATION OF DELINQUENT WATER AND SEWER
ACCOUNTS TO THE COUNTY FOR COLLECTION
DATE: SEPTEMBER 28, 1988
Attached is a resolution for the purpose of certifying delinquent
water and sewer accounts to the County for collection with the taxes
in the year 1989.
Al1 property owners have been notified of the fact that the utility
bills are being certified to the County and have been given an
opportunity to pay the bill. The penalty shown on this resolution
is in addition to the regular penalties that accrue on the utility
bills, This year we have approximately the same number of accounts
to be certified as last year. It appears that the growth we have
seen in delinquent water and sewer bills has apparently leveled off
at this number.

delinquent in payment, and
WHF.RFAS, Chapter 402, Water arld Sewer Achninistration, of the City Code, and
Section 1.02 of the City Charter pravides for the certifying of delinquent
charges to the County Auditor for Collecton with the taxes, and
NOW, THEREFORE, BE IT RE.SOLVID, that the City Qerk is hereby authorized and
directed to certify the following charges to the County Auditor for collection
with the 1989 taxes due and gayable in the year 1989, to wit:

The attached resolution is for the purpose of certifying unpaid weed
cutting charges to the County for collection with the taxes due in
the year 1989 (one installment).
Each property owner was billed and a reminder was sent. The last
notice sent to each property owner stated that if the bill remained
unpaid, it would be certified to the County and a 15$ penalty would
be added. Administrative charges in the amount of 25� or a maximum
of $10.00 were added to each bill.
The charges in this resolution are for work done in 1988.

to order at 7:33 p.m.

1. CONSIDERATION OF A SPECIAL USE PERMIT, SP ��88-13, BY JOHN KEPHART:

allow automobile agencies selling or displaying new and/or used motor
vehicles, on part of Lot 2, Bock 3, East Ranch Estates Second Addition,
an addition to Northtown Nissan's existing inventory, the same being
7810 University Avenue N.E.
Ms. Castle indicated that Northtown Nissan is applying for a special use
permit to allow automobile agencies selling or displaying new and/or used
vehicles at a location near University Avenue. This would be an
expansion of their existing storage of vehicles outside.
On the Location Map, Ms. Castle described the location of Northtown Nissan
as being south of 79th, west of University, north of Osborne, and east of
Ranche�s Road. Northtown Nissan would like to expand to an additional
parcel. The property is located in a C-3 district, general
shopping district, which does allow autobomile agencies selling new and/or
used motor vehicles by a special use permit and also allows outside storage

as a special use. C-3 districts are located to the north, T. R. McCoy's
and a shopping center, and to the south, vacant property. To the west is
an M-2 district which is heavy industrial. There is an industr.ial building
there now. To the east there is a C-3 district, the Pannekoeken Huis
Restaurant. Across the street, in the City of Sprin� Lake Park, there is office,
commercial, industrial, and R-S multiple dwelling districts.
Ms. Castle reviewed the Site Plan showing the proposed expansion for the
storage of approximately 107 automobiles on the site which consists of
one acre. The plan shows the stripe at 9 feet by 18 feet which is used
for storing automobiles because they are not moved in and out daily. Ms.
Castle indicated that earlier today the petitioner had expressed a desire
to use some of this expansion space for employee overflow parking. There-
fore, we would need to re-evaluate the plan and put in some 10 feet X
18 feet or IO feet X 20 feet spaces. Landscaping is shown, has been
reviewed, and meets City Code. It provides screening as required. Along
the west edge of the site, several trees have been added along the drainage
ditch and also along the north end of the site.
Again referring to the Location Map, Ms. Castle indicated there is marked
a 30-foot street and utiIity easement which is the result of a lot split
in 1987. The purpose of the lot split was to gain access to the rear of
the parcels located along the University Avenue service drive. The City
has obtained an access/egress easement from the property owner along the
area so that in the event the street easement is vacated, this property
would not be landlocked.
Staff is recommending approval of the special use permit, SP ��88-13, which
would allow automobile agencies selling new and/or used cars on Lot 2,
Block 3, East Ranch Estates Second Addition, with the following stipulations:
1. Install landscaping as per City approved plan by September 23, 1989.
2. Install automatic irrigation by September 23, 1989.
3. Remove tires from northwest corner of lot.
4. All new and used cars must be stored on site (not on any adjacent
properties). '
S. The fee ocaner formally requests the City vacate the 30-foot street
easement on the site. The 30-foot utility easement would be retained.
6. Vehicles can not be displayed on the boulevard area between the
Northtown Nissan parking lot and University Avenue service drive.
Ms. Castle indicated that stipulation 4�4 was included because in the past
it has been found that Northtown Nissan has stored vehicles in the T. R.
McCoy's parking lot.
Mr. Barna asked for clarification on stipulation 4�4, what areas are included
when referring to "on site", and stipulation #6, what areas are included
when referring to the "boulevard area."
Mr. Castle indicated that on site refers to the current Northtown Nissan
lot plus the proposed expansion area. The boulevard area refers to the
sodded�area located between the actual Northtown Nissan parking lot and the
service road.

Mr. Dahlberg asked if the 30-foot easement as illustrated on the Site
Plan was entzrely on the parcel or if it was split.
Ms. Castle indicated the easement is entirely on the parcel. Some of the
easement is on the parcel�on which Northtown Nissan is currently located.
Mr. Dahlberg asked if all of the appropriate setbacks were met by the
proposed layout of the parking area.
Ms. Castle indicated that setbacks were met. A five-foot hard surface
setback from the side is required, which has been satisfied.
Mr. Dahlberg asked how the drainage system had been planned for the
expansion site.
Mr. Kondrick stated the drainage appeared to go toward the west edge of
the property.
Ms. Castle indicated that the Public Works Department had approved the
drainage plan.
Mr. Dahlberg indicated that the proposed expansion area appeared to be
much lower than the existing site, perhaps 3 to 4 feet up to S feet in
some areas. He asked if this area would have fill brought in to bring it
up to the level of the existing parking lot.
Mr. Robertson indicated that the expansion area would be raised only at
the entrance.
Mr. Kondrick asked if there was any chance that the entire lot would be
under water if there were a lot of rain.
Mr. Ringold, Northtown Nissan, presented to the commission a plan for the
proposed site which included a ponding area.
Mr. Dahlberg asked if the proposed outlet and control structure would be
tied into the storm sewer lines.
Mr. Ringold stated this was correct, as the water depth reaches a certain
level.
Mr. Ringold noted that the original request was for new and used cars only,
but now they wish to use part of the expansion area for employee parking
also. On the plan he provided, the drawing has been changed to the required
10-foot on center parking spaces to comply with City Code on three sides of
the perimeter, the north, west, and south.
Mr. Betzold asked the petitioner to reply to the stipulations as recommended
by staff.
Mr. Ringold indicated that stipulation 4�1, installing landscaping with one
year was not a problem. Stipulation 4�3, to remove tires, was also not a
problem. In�reply to stipulation �64, Mr. Ringold indicated that some sales
staff had parked demonstration vehicles in the T. R. McCoy's parking lot,

who are also restaurant patrons, and these persons have been asked not
to park in that lot in the future. Stipulation ��5 is not a problem.
Stipulation 466 should not be a problem. An agressive display person had
displayed a vehicle on the boulevard, but has been instructed not to do
so in the future.
Mr. Ringold had concerns with stipulation 462 regarding the irrigation
system. Northtown Nissan currently has an existing sprinkling system.
With trees being added on the east, west and north sides, the irrigation
can be handled by extending the current system. However, on the south,
there exists a mulchy, weedy area with no Iandscaping, and Mr. Ringold
questionned the necessity of having irrigation in that area. The proposal
is to attach to the current irrigation system to handle the east, west
and north sides. There will be some trees on the south.
Mr. Benson indicated that the current system is capable of irrigating
the east, west, and north sides of the property. The need for irrigation
near a ponding area is questionnable. To irrigate that portion of the
property would require adding extra irrigation lines and would require
cutting up the parking lot in order to do so. Until this area is fully
developed, the petitioner is asking not to have to do heavy landscaping
at this time. It would be better to keep the system operating at the
landscaped sides rather than the back side.
Ms. Castle indicated this would be acceptable to staff.
Mr. Dahlberg expressed concern about maintaining the landscape treatment.
There are several trees proposed for this area and recommended that there
be some means to water those trees when needed.
Mr. Ringold stated that the sprinkling system had gone down for several
weeks. During that time, watering was done by their commercial sprayer
that is used to wash cars. This could again be put into use for watering
the trees as needed.

Mr. Robertson indicated that staff attempts to provide the most current
information availab2e. In the particular case reviewed this evening, the
request for revision was made in the morning of the day of the meeting and
could not be included.
Ms. Sherek indicated that petitioners sometimes seem surprised that the
commission wants to know details. Petitioners should be informed to
expect questions.

PROPOSAL
Northtown Nissan is requesting consideration of a special use
permit to expand the exterior storage of automobiles at 7810
University Avenue N.E. The storage area will be expanded to the
south on a one acre parcel and store 107 vehicles.
PLANNING CONSIDERATIONS
The expansion area is located in a C-3 district which allows the
exterior storage of materials as a special use. The exterior
storage will be screened from public right of way and adjacent uses
through the installation of landscaping.
Three previous special use permits have been granted for this site
which relate to the operations of an automobile dealership:
l. SP #75-05; to permit the sale of new and/or used vehicles.
2. SP #75-25; to expand the sale of new and/or used vehicles.
3. SP #84-02; to allow autobody painting and refinishing.
The petitioner has not violated any of the terms of these permits.
This site has also been affected by a lot split, L.S. #75-04. The
reason for this split was to allow the future construction of a
road to the rear of the lots abutting the service road. As a
result, the site contains 30 foot street and utility easement which
was granted to the City of Fridley. Part of this easement was
vacated iast year, SAV #87-04, because of the ABRA Autobody
development. The easement has been retained on the expansion site.

RESOLUTION RENAMING THAT PART QF RICE CREEK ROAD B�TWEEN
HIGHWAY #65 AbiD CENTRAL AVENUE
Wi�REAS, this portion of Rice Creek Road runs generally in an east-
west direction; and
WHEREAS, this portion of Rice Creek Road ha� addre sses that are in
the 1200's; and
WHEREAS, the Police and Fire Departments of the City of Fridley concur
with the proposed name change for this portion of roadway; and
WHEREAS, the development owners have requested the name change for
this portion of the roadway,
NOW THEREFORE, BE IT RESOLVED, that
SECTION 1. That part of Rice Creek Road, lying between Highway #65
and Central Avenue be renamed East Moore Lake Drive N.E.
SECTION 2. The City Clerk is hereby directed to register said
street name change with the proper authorities for
Anoka County and notify the a�arpropriate postal
authorities and all other interested parties.

RE: East River Road and Osborne Road Opticom Installation
As part of the construction contract for the above project, the
specifications included installation of Opticom Emergency Vehicle
Preemption system equipment as a part of the contract. Federal
highway assistance programs do not allow blanket specifications of
specific equipment to be used. Accordingly, then the City of
of Fridley, as property owner of the Opticom system as manufactured
by 3M, is required to furnish the necessary equipment.
The equipment for this installation has been ordered from Verta
Corporation, the authorized Opticom distributor for this area.
Cost of the equipment for this intersection is $4920. These funds
typically have come from Capital Improvement Funds of the City.

System (EVP) on University Ave
We have been working with Fire Chief Bob Aldrich and the MnDOT to
coordinate the installation of EVP equipment on University Ave. at
the intersections of 49th Ave., 53rd Ave., and at I-694. MnDOT
has prepared the agreement necessary for the installation of the
EVP equipment at these intersections and we are forwarding a
resolution to the City Council for consideration at their October
3 meeting to authorizing entering into Agreement No. 65207 for this
purpose.
Please recommend to the City Council that they approve the
resolution entering into Agreement No. 65207 authorizing the
installation of EVP equipment on University Ave. so that we can
proceed with construction.

similar installations at various intersections along State Trunk
Highway No. 65; and
WHEREAB, MnDOT has prepared an agreement, No. 65207, authorizing
installation of the EVP system on State Trunk Highway 47
(University Avenue) at 49th Avenue, N.E., 53rd Avenue, N.E., and
at Interstate Highway No. 694 north and south ramps in Fridley,
Anoka County, Minnesota.
NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City
of Fridley hereby authorizes the appropriate City officers to
execute said Agreement No. 65207 between MnDOT and the City of
Fridley.

THIS AGREE�IENT made and ente red into by and between the
State of Minnesota, Department of Transportation, hereinafter
referred to as the "State", and the City of Fridley, hereinafter
referred to as the "City", WITNESSETA:
WHEREAS, the State has determined that there is
� justification and it is in the public's best interest to install
- er�ergency vehicle pre-emption systerns at the existing traffic
control signals on Trunk Highway N o. 47 (University Avenue) at
49th Avenue Northeast, 53 rd Avenue tlertheast, and at Trunk
Highway No. 694 North and South Ramps; and
WHEREAS, pursuant to Minnesota Statutes, Section
161.39, the C ommissioner of Transportation may upon request
provide technical and engineering advice, assistance and
supervision to any county or municipality; and
WHEREAS, the City requests and the State agrees to
pravide Emergency Vehicle Pre-emption Systems, hereinafter
referred to as the "EVP Systems," as a part of the existing
traffic control signals installations in accordance with the
terms and conditions hereinafter set forth; and
WHEREAS, the materials, equipment, labor and
miscellaneous items necessary to construct, operate, maintain,
revise and remave said EVP Systems shall be at the sole cost and
expense of the City; and

WHEREAS, the City and the State will share in the cost,
construction, revision, maintenance, operation and remwal of EVP
Systems as hereafter set forth;
NOW, TAEREFORE, IT IS AGREED AS FOLLOWS:
1. The City with its own f orces and equipment shall
pravide and install the cables, detectors and lights for the EVP
Systems for the existing traffic control signals on Trunk Highway
No. 47 (University Avenue) at 49th Avenue Northeast, 53 rd Avenue
Northeast, and at Trunk Highway No. 694 North and South Ramps,
all at its own cost and expense.
2. The ccst of all labor, materials, and equipment
rental required to complete the EVP System work, shall constitute
the actual "�onstruction Cost" and shall be so referred to
herein�ft�r.
3. The State with its own forces anc� equipment shall
pravide and install the EVP System control and interface
equipment for the existing traffic control signals on Trunk
Highway No. 47 (University Avenue) at 49th Avenue Northeast,
53 rd Avenue Northeast, and at Trunk Highway No. 694 North and
South Ramps. Estimated Ccnstruction Cost is $7, 000.00 ($1, 750.00
per intersection). City's share is 100 percent.
4. Upon execution of this agreement and a request in
writing by the State, the City shall advance to the State its
share of :estimated Construction Cost.

5. Upon final ccmputation of the City's share of the
actual Construction Cost, that amount of the funds advanced by
the City in excess cf its share will be returned to the City
without interest and the City agrees to pay to the State that
amount of its share which is in excess of the amount of the funds
advanced by the City.
6. The EVP Systems provided for in Paragraph 3 hereof
shall � installed, operated, maintained, revised or removed in
accordance with the follawing conditions and requirements:
a. All modifications, revisions and maintenance
of the EVP Systems considered necessary or
desirable, for any reason, shall be done by
State forces, or, upon concurrence in writing
by the State's Traffic Engineer, may be done
by othe rs all at the cost and expenses of the
rity.
b. Emitte r units may be installed and used only
on vehicles responding to an emergency as
defined in Minnesota Statutes Chapter 169.01,
Subdivision 5 and 169.03. The City will
provide the State's District Engineer or his
duly appointed representative a list of all
such vehicles with emitter units.

c. The City shall maintain and require others
using the EVP Systems to maintain a 1 og
sh owing the date, time and type of emergency
for each time the traffic signals cavered
hereby are actuated and controlled by the EVP '
Systems, and that sa id 1 ogs shall be made
available to the State upon request.
Malfunction of the EVP Systems shall be
r�ported to the State immediately.
d. In the event said EVP Systems or co�nponents
are, in the opinion of the State, being
misused or the conditions set forth in
Paragragh b abcve are violated, and such
misuse or violation continues after receipt
ty the City of written notice thereof from
the State, the State shall remave the EVP
Systems. Upon remaval of the EVP Systems
pursuant to this Paragraph, the field wirino,
cabinet wiring and other camponents shall
became the property of the State. All
infrared detector heads and indicator lamps
mounted external to the tr3ffic signal
cabinet will be returned to the City. The

cabinets, which if rem aved will not affect
the traffic control signals operation, will
be returned to the City.
e. All timing of said EVP Systems shall be
determined by the State through its
Cammissioner of Transportation.
7. Upon proper execution by the City and the State,
the EVP Systems for the existing traffic control signals on Trunk
Hiqhway No. 47 (University Avenue) at 49th Avenue l�ortheast,
53 rd Avenue Northeast, and at Trunk Highway No. 694 North and
South Ramps shall became a part of Signal Maintenance Agr2ement
No. 1887-R between the City and the State covering operation,
revision, maintenance and remcval of EVP Bystems by State forces
at the cost and expense of the City.
8. Any and all pe rsons engaged in the af oresa id work
to be performed by the State shall not be considered employees of
the City and any and all claims that may or might arise under the
Worker's Campensation Act of this State on behalf of said
empl oyees while so engaged, and any and all claims made by any
thi rd party as a consequence of any act or anission on the part
of said employees while so engaged on any of the work
contemplated herein shall not be the obligation and
responsib�ility of the City.

REGARDING: Resolution Requesting the State of Minnesota
Provide Funding to Support Solid Waste Abatement
Activities Sponsored by Local Governments
As per your request, staff has developed for your approval a
resolution regarding State funding of local recycling efforts.
Issues highlighted in the resolution are: the City of Fridley's
performance; the Waste Management Act prohibitions; Anoka County
perfonaance goals; costs to the City associated with its abatement
activities and the decline in funding at the State level to
municipal programs.
The resolution requests the State of Minnesota provide local
governments with 80� of the funds required for City sponsored solid
waste abatement activities. The resolution supports a packaging
fee on plastic packaging and a bottle deposit as methods of revenue
generation for local solid waste abatement activities.
Staff recommends approval of the attached resolution. If approved,
the resolution should be forwarded to:

A RESOLUTION REQUESTING THE STATE OF MINNESOTA
PROVIDE FUNDING TO SUPPORT SOLID WASTE
ABATEMENT ACTIVITIES SPONSORED BY LOCAL
GOVERNMENTS
WHEREAS, the City of Fridley in 1985 implemented a comprehensive
residential recycling program including: curbside collection; a
drop-off site for recyclables; yard waste (compost) and waste oil;
and office paper recycling.
WHEREAS, the City of Fridley has abated 1,272.15 tons since 1985;
and
WHEREAS, the Minnesota Waste Management Act of 1980, as amended,
prohibits unprocessed waste and yard waste from the landfills by
1990; and
WHEREAS, the County of Anoka's Solid Waste Master Plan requires the
City of Fridley to abate 5,435 tons by 1992; and
WHEREAS, the City of Fridley will not meet the 1991 and 1992
abatement goals without further program initiatives; and
WHEREAS, the City of Fridley will incur increasing costs for
contract services for curbside recycling in excess of $30,000
annually; and
WHEREAS, the City of Fridley must provide staff to implement the
Solid Waste Abatement activities required under the Waste
Management Act of 1980; and
WHEREAS, the City of Fridley must publicize City sponsored solid
waste abatement activities; and
WHEREAS, the City of Fridley has previously funded its solid waste
abatement programs through grants; and
WHEREAS, the City of Fridley has previously staffed portions of its
abatement activities with volunteers; and
WHEREAS, grant monies disbursed to local governments from the
Metropolitan Landfill Abatement fund are declining; and
WHEREAS, the State of Minnesota continues to approve further
mandates under the Waste Management Act of 1980; and
WHEREAS, the City of Fridley does not have sufficient General Fund
Revenue to provide long term support for the solid waste abatement
activities required under the Minnesota Waste Management Act of
1980; and

NOW, THEREFORE, BE IT RESOLVED, that the City of Fridley request
the State of Minnesota provide to local governments 80$ of the
funds required for City sponsored solid waste abatement activities;
and

1) Once each month individual contractor invoices will be
submitted to BCC for approval and payment.
2� Invoices will be due at the end of each month.
3) BCC will prepare three (3) pay applications - one (1) each
for the Fire Station, Civic Center and Plaza Ramp. The
pay application form will be the AIA Form G702/703 (see
example attached). Appropriate copies will be submitted
for disbursem�nt to all interested parties.
4) BA and BCC vill review the completed pay application and
when approved, BCC will submit it to the City for payment.
5) The City shall receive the original invoices and any copies
required. An invoice summary prepared by BCC shall accompany
the it�voices (example attached).
6) The COF Will submit the total pay application amount to the
City Council for disbursement approval. Note: timing�of
pay application preparation and Council Meetings must be
worked out each month. The last meeting every month Would
be desireable.

7) The COF vill issue payments to the individual contractors.
The checks will be sent to BCC for disbursement so 2ien
waivers may be attached.

1) BA will prepare a written Proposal Request based on an Owner/
Architect directive indicatinq a change requiring contract
amount revisions - add or deduct. �
2) BA will issue the Proposal Request to BCC for pricing.
3) BCC will issue the Proposal Request to all contractors involved.
4) Following receiving all of the costs associated vith the
Proposal Request, BCC will present the cost to BA and COE'.
5) BCC will draft correspondinq change orders to each individual
contractor pertaining to the specific Proposal Request.
6) The COF staff will present the lump sum Proposal Request
as well as the individual contractor change orders to the
City Council for approval.
7) The Council Will then act on the Proposal Requests;
a. Approve - Work will proceed and change orders will be
executed
b. Reject - vork will not proceed and the change orders
will be voided
8) Folloving approval of the Proposal Requests/Change Orders,
each change order will be added to the pay application for
payment procedures.
All change orders will be numbered sequentially.
I!lMSDIA?B AC?ION PROCBDURE
1) A site condition may arise that requires additional work
(originally not in the contract documents) due to various
unknovn conditions. Example: Fire Station - during the
roof tear-off it vas found that due to a leaky roof, the
roof framing members are rotted and require replacement.
Situation: the roof is open and the building is not-water-
tight. Action: the Architect and Construction Manager
recommend the required repair work.

Approval to proceed: the repair work must be performed, a
delay in approval would be seriously detrimental to the
remaining structure, therefore, COF representative given the
go-ahead.
2. While the immediate action work is underway, the change order
process will start and in the interim, the associated costs may
be applied against the project contingency funds.
3. The Council may confirm the immediate action work at its next
meeting and the contingency fund may be reimbursed and the
change order be considered a bonafide scope revision.
4. Note: the key is to have available a City representative with
the authority to take immediate action. Additional work will
not proceed without City approval.
5. This type of procedure will need to be implemented should
omitting the additional work result in potential additional
building damage, job progress delay, or potential personal
injury.
Copies and examples of all forms referred to above are enclosed.

SUBJECT: CITY MANAGER'S DISCRETIONARY AUTHORITY IN APPROVING
CHANGE ORDERS
At the last Council meeting, Mayor Nee requested that I write a
memo to the Council defining my discretion in City building change
order matters. I would interpret my discretion in these matters
as meaning that I have the authority to spend up to $10, 000 for
unforeseen change orders that require immediate action. All other
change orders including those that do not require immediate action
and those that change the scope of the project will require Council
approval prior to their implementation. It is understood that any
change orders implemented as a result of the use of my discretion
will be reported to the Council in the form of a memorandum by the
end of the week in which the change order is implemented.
At the next regular Council meeting, the change order will be
presented for formal Council approval. In the event there is a
problem with the $10,000 ceiling, I would opt to call the entire
Council together for an emergency meeting to consider the proposed
change order.

Rel'�ab. Recall that az March 28, l9gg the City Cbun�il reallocated S8,181 of the
1987 CY��mercial gPhab. funds for the Rivezvi�v Heiqhts Project (Hunger residence,
Sum�er of 1988) leaving a ba],ance of 524,544. In addition to this money, City
Caur�cil allocated S6, 302 of the 1988 QEG funds fo�r Cananercial Rehab. The total
fund balance fo� q��enial Rei�. for 1987 - 1988 is 530, 846.
Locke House Restoration
T� �� S�'�an C�tex' fo�' the Arts (IZSCA) is r�ow requesting additi�al funding
for the Locke House Restoration project. The City's 1986 and 1987 CDBG
contributions to ths effort total S23, 000. NSCA's cammitment to the lease
aQz�eenent with Ar�oka County is for 555, 000 of oontributirns. Mr. Harry Rosenbaum,
n�e�er °f the Board of Di�'ectars and C�airperson of the Fluid Ra,ising Canni t tee f or
KSCA. has prepared the attached proposal which asks the Council to provide an
additia�al $16,270 of fundinq tc c�onplete the interior restoration of the first
floor this staimer. Work on the second floor would be accomplished in a later
Phase. The proqram activities for the C�+nter shoutd begin arourrl Labor Day.

On Maxch 28, 1988, we informed the Council that additional fundings would be
re4uired in �der to clear and refur�iah the Fir�dell house. (This pznperty is the
brick and stone �iilcting which is c�or�sidered to have significant architectural and
htstorical character). Our proposal, which has been approved by the Parks and
Recreation and PlanninQ Ctmnissict�s, involves clearing the qaraqe, cleaning the
site and redesi�iinq the p�ir�Cipnl stn�cture aB an open air park shelter. Work
alla�eci Lax3er the CCBG criteria would be the clearing of the qara�e and disnantling
of the h�ouse. At this ti.me, we have received estimates for this work which
irn►olves approximately 54,000. Additional estimates are beinq souqht for
d1sl�iltliDQ the btiildli�p lteelf. I wo�tld zeoamnend that the r�,.,9nir' funds in the

proposals which involve the reallocation of the remaining Community
Development Block Grant (CDBG) funds designated for commercial
rehabilitation. ile stated in March, 1988, the C'otmcil reallocated $8,181 aF
these funds for the Riverview Heights pz+o�ject, leaving a balance of $24,544.
He stated in addition to this anount, the Council allocated $6,302 of the

Mr. Robertson stated the North Suburban Center for the Arts (NSCA) is

the Fluxling Raising Coatnnittee for NSCA, has prepared a proposal and is
requesting an additional $16,270 in order to complete the interior
restoratiori of Lock,e House. Mr. Rabertson stated the Riverview Heights
project requires additi��al funding in o�der to clear the garage, clean the
site, and redesign the principal structure of the Firr�ell house as an open
air park shelter. He stated work allaaed Lmder the (DBG criteria would be
clearing the garage and dis�r�tling the inuse. He stated it is recoRmnended
the ranaining funds, $14,576 if the Council allocates the S16,270 to the

outsid�e has been refurbished, but the $16,270 they are requesting would
allaa then to furnish and finish the first floor interior and they would be
able to c5pen to the public. He felt the Ftiuid Raising Catmittee could raise
the balance of the f�ds necessax�, within their own aperation. He stated
they had a successful fund raising last week that enabled them to raise
52,000. Mr. R,�senbau� stated rnce Locke House is open to the public, he
felt it wvuld be easier to raise the additional funding that is needed in
order to make it a good place for the whole cannunity.
No other persons in the audier�ce spoke reg�rding the reallocation of these

The attached revised proposal (Option 8) for the use of 1988 Block Grant
F1a�c1� includes 3� fu�ding for h�nan services. The total allocation for
Anoka Cb�nty Hunan Service F1�nding is 15t. Should all cities within the
Co�nty e�aceed this aocunulative 15� cap, then the cities would be forced to
revise their budgets a000rdingly.
Regarding the Riverview Heights budget, this budget for 566,959 fB a
preliminary estimate for aoquisitian and relocatian eerviaes associated with
FYarcel 6, the Morin residence (see map). Upon approval of the 1988 (�BG
Proposal, by Anoka County in July of 1988, we will proceed to obtain
appraisals for the praperty and also to determine the relocation assistance
which will be reoessary. At that time this budget may have to be revi.sed.
Lastly, regarding the Camnerciat Rehab. Loan and/or a�quisition grogram, the
56,302 desic�ated with the 1988 f�nds when added to the 532,954 1987 f�ds
totals 539,256. Staff will be reviewing the potential projects for use of
these f�nds over the next few weeks and will return to Council later this
spring with a proposal for their use.
Finally, the sutrnittal date cf this 1988 p�aposal
than March 29, 1988. Beyond this date there i
allocated f�nding would be in jeopardy. Suggest
proposal at thei r March 28, 1988 meeting by m�tion

statutes ard any State ntles ado�pted to impl�ent the Aat, as w�e11 as State
statutes arid Federal regulatioa�s on data privacy. Tt�e Provider agrees to
abide by these statutes, rules, ar�d requlations arid as they may be amended.

A RESOLUTION TO THE KINHESOTA CONGRESSIONAL
DELEGATIOH IN SUPPORT OF CERTAIN AKENDMENTS TO HR-2530
WHEREAS, the House of Representativea adopted HR-2530 which
Nationalizes control of certain lande adjacent to the Kississippi
River for 80 miles in the Twin City area, and
WHEREAS, HR-2530 transfers to the Secretary of Interior certain
powere of zoning, development regulation and condemnation in
districte adjacent to the Mississippi River in a dimension to be
determined by the Secretary of Interior, and
WHEREAS, the State of Minnesota has charged local and county
governments with priority responsibility for development of these
lands, and provided for Coordinated Planning and oversite by
various State agencies and the Metropolitan Council, and
WHEREAS, the Metropolitan River Corridors Study Commission
r_onducted a definitive study of river development issues as
directed by Title IX, Public Lav 96-607, and identified the
problems addressed in HR-2530, but specifically did not recommend
a Federal preemption of State and local authority, and
WHEREAS, at all Public Hearinge on the Bill, no objective
evidence or data has been presented to demonstrate a"need" for
Federal preemption of State and Local powers, and
WHEREAS, on March S, Senator Durenberger convened a meeting of
more than 40 State, Regional and Local government officiale to
consider local objections and to offer amendments which could
accommodate conflicting vieMe while leaving the central elemente
of HR-2530 intact. All municipal officials present opposed HR-
2530 as adopted by the House and most or all supported it with
the flurenberger Amendments. That includes cities such as
Kinneapolie, St. Paul, Fridley and others.
WHEREAS, on Monday, September 26, the House of Representatives
voted to combine HR-2530 into an "Omnibus Parke Bill" vithout
providing for the Durenberger Amendments Which vrould make the
legislation acceptable to those affected.
NOW, THEREFORE, BE IT RESOLVED THAT the City of Fridley supporte
Amendmente to HR-2530 proposed by Senator Durenberger and urges
the Minnesota Congressional Delegation to MithdraW HR-2530 fron�
the Omnibus Parks Bill to more easily incorporate the Durenberger
Amendments.

hearing before the City Council on June 6, 1988. He stated Conmission members

members might have. The more �bers represented at the meeting, the m4re
effective the presentatian will be.
Mr. Hunt stated he had included in the agenda a copy of the article in the City
Newsletter regardi.ng the proposed Charter changes which w�ould be coming out either
at the end of the week or early next week. He stated it has been their c�al to
get as much publicity out as possible to make the citizens aware of these upcardng
changes ar�d� of the public hearing.

4. UPDATE ON LDGISLATIVE ACTION RIIATING TO LEVY LIMITS MAI�IDATID BY SDCTION 7.02
OF 'THE FRIDI�Y CITY CI�,FrTER:
Mr. Hunt stated that for 1989, as he understood it, they are basically going to
roll ahead with the systrem they already have. Ttie changes that go into effect
in 1989 for 1990 will basically go tvward market value for assessments. So,
they are talking about going to true maxket value approach instead of the
assessed value approach and then working the assessment on that. Of �ourse,
that means a smaller mill rate will raise the same amount of money. So, at the
present time, it did not appear that anything the Legislature has done so far
would cause the City to have to change the 16 mill limit.
