RESOLUTION NO. 56 - 1992
' RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIDLEY, MINNESOTA, AUTHORIZING THE
ACQUISITION OF AN EMINENT DOMAIN PROCEEDING TO
ACQUIRE FEE SIMPLE
WHEREAS, the City Council of the City of Fridley has determined
that there is a need for the expansion of Moore Lake Beach Park
within the corporate limits of the City to provide additional park
and open space facilities within the City; and
WHEREAS, the City Council believes that the acquisition of the
property described below is reasonably necessary and convenient to
the furtherance of these objectives and will promote the health,
safety and welfare of the City's residents and is in accord with
the public purpose and provisions of applicable State and local
laws; and
WHEREAS, the City has been unable to successfully negotiate the
acquisition of the following described property, located in the
City of Fridley, County of Anoka, State of Minnesota, to -wit:
The North 250 feet of the East 830 feet of Government
Lot 1, Section 24, Township 30, Range 24, except that
part of said Government Lot 1 lying East of County State
Aid Highway No. 35, which is also known as Central Avenue
Northeast, in Anoka County, Minnesota, and except that
part of Government Lot 1 described as follows: Beginning
at an intersection of the Northwesterly right -of -way line
of County State Aid Highway No. 35, also known as Central
Avenue Northeast, and the North line of said Section 24;
thence West along said North line to a point that is 830
feet West of the Northeast corner of Government Lot 1 of
said Section 24; thence South on a line parallel to the
East line of said Government Lot 1 to a point 250 feet
South of the North line of said Section; thence East and
parallel to the said North line a distance of 239.5 feet;
thence North at right angles to the last described line,
a distance of 100 feet; thence East and parallel to the
said North line to the said Northwesterly right -of -way
line of County State Aid Highway No. 35, which is also
known as Central Avenue Northeast, thence Northeasterly
along said right -of -way line to the point of beginning.
NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby
authorizes the acquisition of said land by eminent domain pursuant
to Minnesota Statutes, Chapter 117.

' BE IT FURTHER RESOLVED, that the City Attorney is requested to file
the necessary petition therefore and to prosecute such action to
a successful conclusion or until it is abandoned, dismissed or
terminated by the City Council or the Court.
