PLEDGE OF ALLEGIANCE: Mayor Nee led the Council and audience in the Pledge of Allegiance to the Flag. ROLL CALL• MEMBERS PRESENT: Mayor Nee, Councilwoman Jorgenson, Councilman Billings, Councilman Schneider and Councilman Fitzpatrick. MEMBERS ABSENT: None. Mayor Nee introduced Leon Madsen, City Assessor, and said that he would discuss the process and limits of the authority of the Board of Review to make adjustments and what the criteria for adjustments normally would be. Mr. Madsen, City Assessor, introduced representatives from the Anoka County Assessor's Office, Mr. Gordon Starkel and Mr. A1 Bark. Mr. Madsen also introduced Jeff Nienaber, the Fridley Appraiser. Mr. Madsen indicated that the City Council constituting the Board of Review has three possible options for dealing with each case. They may affirm the Assessor's decision, they may choose to reduce the Assessor's decision, or they may choose to increase individual assessments. Total Petroleum, 5300 Central Avenue N E• � Mr. Madsen stated that no one was present at the meeting to represent Total Petroleum. Mr. Madsen recommended that the $150,900 value established by the Assessor's office be affirmed. MOTION by Councilman Fitzpatrick to affirm the Assessor's value of $150,900. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. G.W. Paschke Properties, Inc., 7989 Main Street: Mr. Madsen stated that no one was present at the meeting to represent G.W. Paschke Properties, Inc. Mr. Madsen stated that the petition is basically for the building identified as Ron's Ice Co. Mr. Madsen recommended that the $933,600 value established by the Assessor's office be affirmed. MOTION by Councilman Fitzpatrick to affirm the Assessor's value of $933,600. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Lynwood Nursing Home 5700 East River Road• Mr. Madsen stated that no one was present at the meeting to represent Lynwood Nursing Home. Mr. Madsen indicated that his office had established a value of $829,502 for the property. Mr. Madsen indicated that the petition was received on Monday, April 5, 1993, and his office did not have time to study the comparables provided by the petitioner. Mr. Madsen recommended that the $829,502 value established by the Assessor's office be affirmed, with the understanding that further research regarding this petition would be conducted. MOTION by Councilman Fitzpatrick to affirm the Assessor's value of $829,502. Seconded by Councilmember Jorgenson. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. PUBLIC HEARING ON AN ORDINANCE RECODIFYING THE FRIDLEY CITY CODE1 CHAPTER 205, ENTITLED "ZONING" BY AMENDING SECTION 205.04.04.I• PUBLIC HEARING ON AN� ORDINANCE ESTABLISHING CHAPTER 208 ENTITLED "EROSION CONTROL" TO THE FRIDLEY CITY CODE: MOTION by Councilman Fitzpatrick to waive the reading of the public hearing notices and open the public hearings. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearings opened at 7:54 p.m. FRIDLBY CITY COIINCIL MEETINQ OF APRIL 5, 1993 PAQ$ 2 Ms. Dacy, Community Development Director, defined the difference between non-point source and point source pollution. She stated that it was the goal of the Minnesota Pollution Control Agency (MPCA) to reduce non-point source pollution by forty percent by 1996. She stated that the MPCA was acting under the requirements of Section 319 of the Federal Clean Water Act. She stated that the Metropolitan Council was assisting the EPA by requiring local adoption of water quality ordinances. Ms. Dacy stated that the amendment to Chapter 205 of the Fridley City Code adopts by reference the MPCA's best management practices requiring developers to submit grading and drainage plans. She stated it also requires a conservation plan (erosion control plan) along with a schedule of implementation. Additionally, it requires an ��as built" survey of detention facilities and provides that owners must execute a maintenance agreement for maintenance of detention ponds and other storm water facilities that are created for a given project. Ms. Dacy stated that the amendments to Chapter 208 of the Fridley City Code deal with erosion control. She stated that the amendments to this section of the Fridley City Code would adopt technical guidelines to be used for erosion control. She stated the ordinance requires submission of a conservation plan at the time of issuance of a building permit or a land alteration permit. Ms. Dacy stated that they were currently working on a third piece of legislation--a shore land ordinance. She said staff was working with the Department of Natural Resources staff to develop an ordinance. Ms. Dacy stated that she included a proposed fee schedule that was to be used for implementing the conservation plan as part of the agenda. She stated that while no action was necessary by Council on the fee schedule at this meeting, she was providing the fee schedule in order to alert Council that it would be proposed in the near future. Councilman Schneider asked whether the proposed amendments to Chapter 205 of the Fridley City Code applied to single family homes and wanted to know if the proposed fee schedule also applied to single family homes. Ms. Dacy stated that it did not apply to single family lots unless the lots had a slope that was greater than twelve percent. She stated as a recent example that the Rainville property at the end of Anoka Street would have required an erosion fee. No persons in the audience spoke regarding the proposed amendments to Chapters 205 and 208. RESOLUTION NO. 28-1993 ORDERING IMPROVEMENT, APPROVAL OF PLANS AND ORDERING ADVERTISEMENT FOR BIDS: STREET IMPROVEMENT PROJECT NO. ST. 1993 - 10 (SEALCOAT) (TABLED MARCH 15 1993)• Mayor Nee removed this item from the table. Mr. Flora, PubZic Works Director, stated that the scope of sealcoating was reduced at the request made by Councilman Schneider at the City Council meeting of March 15, 1993. Councilman Schneider thanked staff for the modifications and asked whether any independent testing of the asphalt would be done as part of the 1993 sealcoating process. Mr. Flora stated that the Minnesota Department of Transportation will be doing independent testing. MOTION by Councilman Schneider to adopt Resolution No. 28-1993. Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 5. APPOINTMENTS TO CITY OF FRIDLEY COMMISSIONS (TABLED MARCH 15, 1993 : HOUSING AND REDEVELOPMENT AUTHORITY: MOTION by Councilman Billings to reappoint Duane Prairie to the Housing and Redevelopment Authority for a five-year term expiring June 9, 1998. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. ENVIRONMENTAL 4UALITY AND ENERGY COMMISSION• MOTION by Councilman Fitzpatrick to reappoint John Velin to the Environmental Quality and Energy Commission for a three-year term expiring April 1, 1996. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. HUMAN RESOURCES COMMISSION: MOTION by Councilman Schneider to table the appointment to the seat held by Susan Sherek. Seconded by Councilwoman Jorgenson. ESTABLISH A PUBLIC HEARING FOR APRIL 19 1993 FOR T.R. MCCOY'S FOR A LIOUOR LICENSE: Mr. Pribyl, Finance Director, stated that the ownership of the property changed, and the change required a public hearing for the liquor license transfer. Councilman Schneider asked if an extraordinary majority was required for the approval of a liquor license. Councilman Billings stated he thought it only took a majority vote. Councilman Schneider stated that he may not be able to attend the meeting on April 19, 1993. MOTION by Councilwoman Jorgenson to set the public hearing for. April 19, 1993, for the liquor license transfer for T.R. McCoy's. Seconded by Councilman Schneider. Councilman Billings asked if the new owners were going to change the name of T.R. McCoy's to Champs. Mr. Pribyl stated that they will not be changing the name. UPON A VOICE VOTE TAKEN ON THE MOTION, all voted aye, and Mayor Nee declared the motion carried unanimously. 7. FIRST READING OF AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO VACATE STREETS AND ALLEYS AND TO AMEND APPENDIX C OF THE CITY CODE (VACATION REOUEST SAV #92-03 BY BOB'S PRODUCE RANCH; 7620 UNIVERSITY AVENUE N E)• Ms. Dacy, Community Development Director, stated that the petitioners were requesting a vacation of a ten foot drainage and utility easement on the north property line of the property, and the vacation of a fifty foot street and utility easement on the east portion of the property. MOTION by Councilman Fitzpatrick to waive the reading an approve the ordinance on first reading. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 8. RECEIVE THE MINUTES OF THE PLANNING COMMISSION MEETING OF MARCH 14, 1993: A. SPECIAL USE PERMIT REOUEST, SP #93-03, BY RICHARD KEDROWSKI TO ALLOW ACCESSORY BUILDINGS OTHER THAN THE FIRST ACCESSORY BUILDING. OVER 240 S4UARE FEET, GENERALLY LOCATED AT 6584 ANOKA STREET• Ms. Dacy, Community Development Director, pointed out that this property is located at the intersection of Anoka Street and �RIDLEY CITY COIINCIL MEETING OF APRIL 5. 1993 PAGB 5 66th Avenue. She stated that the property is zoned R-1, and described the history of the property from 1988 to present. She said that at that time a single family home building permit was issued. At the time the new home was being constructed, an existing detached garage was in place on the property. She pointed out under the City's codes, the second garage requires a special use permit. The special use permit request was approved by the Planning Commission, subject to the stipulation that the existing garage be painted. Mayor Nee asked if there would be driveway access for the second garage. Ms. Dacy replied said that it would not. She said that the detached garage would be strictly for storage. Councilman Schneider asked Mr. Kedrowski to confirm that there would be no driveway to the detached garage. Mr. Kedrowski confirmed that and indicated that the garage would be used strictly for the storage of motorcycles. MOTION by Councilman Schneider to grant Special Use Permit Request, SP #93-03, subject to the stipulation that the existing garage be painted. Seconded by Councilwoman Jorgenson. RECEIVE AN ITEM FROM THE APPEALS COMMISSION MEETING OF MARCH 2, 1993• A. VARIANCE REOUEST. VAR #93-01 BY SIGNART FOR PLYWOOD MINNESOTA. INC., TO ALLOW THE CONTINUANCE OF A VARIANCE GRANTED PRIOR TO NOVEMBER 21 1977 TO ALLOW THE REMODELING OF A SIGN. GENERALLY LOCATED AT 5401 EAST RIVER ROAD N E• Ms. Dacy, Community Development Director, indicated that the property was zoned M-2 and that under the City's ordinances, pre-1977 variances for signs require the approval of Council. Ms. Dacy stated that in 1970, Plywood Minnesota was given a variance for a 300 square foot sign located along I-694. Recently, the petitioner requested that while changing the name from Plywood Minnesota to Home Valu that the company be allowed to keep the 300 square foot sign. Ms. Dacy indicated that when this item came before the Appeals Commission in February, 1993, the Appeals Commission tabled consideration of this request. Subsequently, a representative of the applicant reduced the size of the proposed sign from 300 square feet to a total square footage of 186.25 square feet. This included 140 square feet for the Home Valu portion of the sign, 32.75 square feet for a time and temperature portion, and 13.5 square feet for another segment that would read "Open Tonite." Ms. Dacy stated that the Appeals Commission felt that a hardship did exist. She stated that the Appeals Commission also indicated that even if a special use permit for the time and temperature portion of the sign were not approved, they were willing to support the other two sign segments that were being requested. Mr. Brottland, a representative from SignArt, provided a brief rationale for the variance. Councilman Fitzpatrick pointed out that the sign is a large sign. Mr. Brottland said that the main sign is less than fifty percent of the size of the existing sign, and that the total sign square footage is only about two-thirds of the size of the original sign. He stated that the speed of traffic, the existence of trees and shrubs, and the size of the Wickes sign justify a larger sign for Home Valu. Councilman Fitzpatrick asked where the sign would be located. Ms. Dacy stated that the sign would be located on the subject property just east of the frontage road that is located along the south side of I-694. FRIDLSY CITY COIINCIL MEETING OF APRIL 5. 1993 PAGB ? Councilman Schneider asked how the proposed size of the Home Value sign compares with the variances granted for Menards and Embers. Ms. Dacy stated that both of the signs are only 120 square feet. Mr. Brottland stated that he felt that I-694 was a different situation from the Highway 65 situation. He also said that he hoped Council would give some consideration to the fact that Plywood Minnesota has been a member of the community for thirty years. He said that it was important for Plywood Minnesota when changing its name to present itself well. Councilman Fitzpatrick.stated that he felt that this would set a precedent in that area. Mr. Brottland stated that he felt that Council needed to take each situation into consideration. Councilman Fitzpatrick asked if the ordinance requires or limits the size of detached signs to 80 square feet. Councilman Schneider stated that Mr. Brottland was using the size of the Wickes sign as rationale for the Home Value sign. Mr. Brottland stated that the wall sign that they have is not really effective in attracting traffic. He stated that there is a sign in Bloomington similar to the sign being requested. He also said that the Home Valu logo does not lend itself to being strung out in consecutive words. Councilman Fitzpatrick asked how big the sign would be without the time and temperature portion. Mr. Brottland stated that it would be 153 square feet. Councilman Billings commented on the location of the building near the freeway and the distance of the building from the freeway. He stated that there are some unique circumstances at that location that are different from those on Central Avenue. He said these circumstances help to explain the need for a larger sign. He suggested that perhaps Home Valu should be willing to deny themselves the wall signage as a trade-off for a larger detached sign. Councilman Fitzpatrick indicated that he felt that this was the occasion when we were supposed to be getting rid of big sign problems. Councilman Schneider indicated that he agreed with Councilman Fitzpatrick, and in order to be consistent, he would only support a sign that would be in the range of 140 square feet to 150 square feet. FRIDLBY C TY C IINCIL MEETING OF APRIL 5 19 3 PAGE 8 Councilwoman Jorgenson, concurred with Councilman Schneider's comments, and stated that she would remove the time and temperature portion of the sign. She did not seem to feel that this was pertinent to advertising the business. Mr. Brottland asked Council how many times they have been by retail establishments that have time and temperature signs, and whether or not they look at them. He stated he thought it was a very important way to draw attention to retail properties. Councilman Schneider stated that the code requires an 80 square foot sign. He stated that we were offering Home Valu a 153 square foot sign. He stated further that the petitioner could use the 153 square feet any way the petitioner wanted to, including incorporating the time and temperature portion of the sign, within that dimension. Mr. Brottland stated that this was not practical. He said that Council should consider the current economic climate in making their decision. He said that Council should also consider that Home Value has a similar sign on I-394. MOTION by Councilman Billings to tabZe this item until. the May 3, 1993, City Council meeting, to allow the Boschwitz family to express their points of view. Seconded by Councilman Schneider. RESOLUTION NO. 29-1993 APPROVING A SUBDIVISION LOT SPLIT L.S. #93-02, BY MILDRED KING, TO CREATE TWO SEPARATE PARCELS PARCEL A AND PARCEL B. GENERALLY LOCATED AT 71 - 63 1j2 WAY N.E. Ms. Dacy, Community Development Director, stated that the property is on the north side of 63 1/2 Way N.E., and the lots being proposed by the lot split met the minimum lot requirements. She stated that the setback requirements for an existing house on the second lot fell one foot short of the legally required frontage width for the newly created lot. The lot would be 74 feet wide rather than 75 feet wide. Ms. Dacy stated that creating a side yard variance would have required two processes--a side yard variance, and a lot split. She also pointed out that Council through the subdivision ordinance was the power to allow a lot width variance as part of the lot split process. MOTION by Councilman Fitzpatrick to adopt Resolution No. 29-1993. Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 12. APPROVE 1993-1995 RECYCLING SERVICES AGREEMENT WITH SUPER CYCLE. INC.• Ms. Dacy, Community Development Director, stated that under the proposed contract, the per unit costs for single family homes would be $1.43 and multiple family units would be $1.99. She also said that the new contract provides for the collection of magazines and catalogs. She explained further that as of June 1, 1993, the City expected to include 727 multi-unit dwellings in the contractor's service area. Ms. Dacy also explained that under the proposed contract, Super Cycle, Inc., would provide a recycling brochure. She said it also provides for a penalty clause for such things as missed pick-ups, throwing of containers, and missed blocks. She indicated that she expected the contract to cost approximately $300,000, and that we could anticipate offsetting revenues of $327,000. Ms. Dacy stated that Lisa Campbell, the Recycling Coordinator, was present to answer questions. She introduced Nancy Healy from Super Cycle, Inc., who was also present to answer any questions. Councilwoman Jorgenson stated that pop cans are still falling off Super Cycle's recycling trucks in front of her house. Councilman Schneider stated that he is pleased to see the penalty clauses, but he questions how they will be enforced. Ms. Campbell stated Super Cycle completes a conveyance form that is sent to her. The form contains a list of late set outs. Ms. Campbell stated that she also calls and asks individuals when they put out their recyclables. Councilman Schneider asked if the truck came by at 7:15 a.m. and he puts his materials out at 7:30 a.m., how can we prove that the material was set out late. Ms. Campbell stated that they assume that the customer is always right. Ms. Campbell stated that its service for magazines and catalogs bound with staples began on April 1, 1993. She also stated that we will not be accepting glue-bound catalogs. Councilman Schneider asked if Super Cycle would take broken glass. Ms. Healy stated that they will take broken glass if it is bagged. If it zs not bagged, it is Zikely that it will not be picked up. She also stated that she would check on Councilwoman Jorgenson's complaint regarding cans dropping from Super Cycle vehicles. She stated that Super Cycle would be more than happy to accept the challenge of the penalty clauses. Councilwoman Jorgenson asked if the drivers were ever penalized. Ms. Healy stated that the demerit system with their drivers allows up to twenty demerits before the driver is dismissed. If the driver gets ten demerits, he is sent home. If the driver receives fifteen demerits, the punishment is more severe, and at twenty demerits, the driver is dismissed. MOTION by Councilman Dennis Schneider to approve the contract between the City of Fridley and Super Cycle, Inc., for recycling services from 1993-1995. Seconded by Councilwoman Jorgenson. APPROVE CONTRACT WITH AYRES AND ASSOCIATES FOR THE DESIGN OF LOCKE LAKE DAM: Mr. Flora, Public Works Director, said that the City received responses to our request for proposal from six firms. He stated that Ayres and Associates was judged by staff to have the best proposal. He explained that under the tenas of the proposal the costs for designing the Locke Lake Dam are not to exceed $70,000, and the project cost was not to exceed $500,000. Mr. Flora said that several changes were suggested by City Attorney Virgil Herrick. The changes involved field office facilities. The second change added a phrase that the consultant will carry $1 million of professional liability insurance. Councilman Schneider asked what happened if the dam collapsed. Mr. Flora stated that the $1 million liability clause has been added to cover this eventuality. Mr. Greg Herrick, City Attorney, responded that it would cover payment if it was determined that there was a design defect. MOTION by Councilman Fitzpatrick to approve the contract with Ayres and Associates for the design of Locke Lake Dam. 15. RESOLUTION NO. 30-1993 ORDERING PRELIMINARY PLANS SPECIFICATIONS. AND ESTIMATES OF THE COSTS THEREOF FOR STREET IMPROVEMENT PROJECT ST. 1993-1 & 2: Councilman Schneider asked about the status of the petitions for the street improvement project. Mr. Flora, Public Works Director, responded that he had received all the petitions except for Regis Lane. He stated that those petitions were still circulating. Amendments to Chapter 113 require owners who are serviced by the City to pay $0.83 per unit per month to the City (SWAP fee) and require owners who do not receive service from the City to contract for services. This amendment also requires recycling collectors to report materials collected in the City to the City. Amendments to Chapter 220 require owners of multi-units not serviced by the City to contract for recycling services and submit with a copy of the contract with their annual residential rental license application. Amendments to Chapter 11 extends the solid waste abatement programming fee to 5 through 12 multi-unit dwellings. Page 2 Request The petitioner has filed a plat application to replat the Anderson Development plat. The property is generally located in the southwest quadrant of the intersection of Osborne Road and Central Avenue. Site The property is comprised of 11 acres which are predominantly vacant. There is a small trucking terminal located on existing Lot 5 in the southern-most portion of the subject parcel. The property is zoned M-1, Light Industrial, as are properties to the south. The property to the west is zoned C-2, General Business, and the property to the east is zoned both C-1, Local Business and R-1, Single Family Dwelling. Analvsis The proposed replat would vacate the existing lots dedicated on the original plat of 1961. A vacation request is necessary to vacate the easements dedicated in 1961. The petitioner has applied for a vacation to vacate the existing easements. The new plat would be comprised of three lots, Lot 3 which totals 4.11 acres would be for the existing trucking terminal, Lots 1 and 2 total 2.95 acres and 3.98 acres respectively, would be vacant. The petitioner has a potential purchaser for Lot l. The Fridley Bus Company may purchase proposed Lot 1 to relocate its facility from Main Street. We are awaiting site plans to determine whether a special use permit will need to be processed. The original special assessments for sewer and water were waived for a majority of the original plat. Special assessments will need to be paid for Lot 1 for sewer and water laterals. While there is a water main located in Osborne Road, the closest sanitary sewer line is located in Central Avenue. A utility easement will need to be dedicated across the southern lot line of Lot 2 in order to provide sewer access to Lot 1. In addition, the City will request that a maintenance agreement be executed and recorded against both Lot 1 and Lot 2 for the maintenance of the sewer lateral for Lot 1. This will ensure that the owner of Lot 1 will maintain the private sewer lateral crossing Lot 2. In 1961, the record is not clear as to whether or not a park dedication fee was paid at the time of the plat. Staff has calculated park fees for Lots 1 and 2 which will be vacant. Recommendation Staff recommends that the Planning Commission recommend approval of the proposed Anderson Development Replat to the City Council with the following stipulations: 1. � Special assessments of $1,640.25 shall be paid for Lot 1, Block 1, Anderson Development Replat. A park dedication fee of $2,951.10 for Lot 1 and $3,987.16 for Lot 2 shall be paid at the time of the issuance of a building permit. 3. The owner of Lot 1 shall execute and record against both Lots 1 and 2, Block 1, Anderson Development Replat a maintenance agreement which ensures that the owner of Lot 1, Block 1, shall maintain the private sewer line located on Lot 2. 4. Permits for the number and location of driveways shall be obtained from Anoka County prior to issuance of a building permit. Planning Commission Action The Planning Commission voted unanimously to recommend approval to the City Council of the request with an additional stipulation: 5. The maximum number of access points onto Osborne Road shall be three. The Commission also directed staff to work with the petitioner regarding the special assessments and park dedication fee. Staff Update Staff received a preliminary site plan and grading and drainage plan for the proposed Voigt Bus Company. The Engineering Department reviewed the drainage plan and hydraulic calculations. Some minor revisions need to be made and details provided to the Engineering Department. The plan was reviewed for compliance with the zoning code provisions. The building and parking setbacks have been met. The pavement along the west property line will need to be set back five feet. Flora�Public Worlcs Di�ector DATE: qpril 13, 1993 SUB,IECT: 1gg3 Street Reconstruction Program In preparing ou� street projects for 1993, staff had proposed the reconstruction of certain MSA streets. Public meetings were held during January and February to explain the process, the widening of streets to 32 feet and the construction of concrete curb and gutter and placemerrt of no parking signs on one side of the street. It was Council's decision to only assess for the construction of concrete curbing where asphalt berms were being replaced. This assessment cost is not to exceed $8.00 per frorrt foot. During the public meetings, we had requested the residents on the street to sign petitions to obtain a minimum of 5096 support fo� the project. We have received the following petitions ftom the residential properties on the streets supporting the reconstnaction project. The ordinance amendment requires the following items: 1. Adopts best management practices. 2. Requires submission of a grading and drainage plan in conjunction with a building or land alteration permit. 3. 4. Requires submission of a sedimentation control plan, time schedule, and compliance to the proposed Chapter 208. Requires an as-built survey of detention facilities. 5. Requires a storm water detention facility maintenance agreement. The Planning Commission conducted a public hearing regarding the attached ordinance at its February 10, 1993 meeting and voted unanimously to recommend approval to the City Council of the proposed ordinance. Staff recommends that the City Council approve the first reading of the attached ordinance. MM/ d n M-93-193 ORDINANCE NO. - 1993 AN ORDINANCE RECODIFYING THE FRIDLI�Y CITY CODE CHAPTER 205, ENTITLBD ��ZONING" BY AMENDING SECTiON 205.04.04.I The City Council of the City of Fridley does ordain as follows: 4. BOILDING SITE A. No lot sha11 be so reduced or diminished, nor shall any structure be so enlarged or moved, as to reduce or diminish the yards, lot area or open space required in the district in which it is located. No yard or other open space required for any building shall be considered as providing a yard or open space for any other building, and no yard or open space on an adjoining lot or parcel of property shall be considered as providing a yard or open space on a lot where a building is to be erected. � C. Only one (1) principal building shall be located on a buildable R-1 lot. Every lot, in order to be built on, shall have at least one {1) lot line which abuts for not less than twenty-five (25) feet along a street or along a permanent, unabstructed easement of access to the lot from a public street as approved by the City. D. Where no curb elevation has been established, the City shall furnish such elevations. if curb elevations are not available, the City shall approve the elevation of the building and the drainage plan before a building permit is issued. E. Sidewalks or provision for sidewalks will be required on all arterial and collector streets. The City will furnish the elevation for a sidewalk shelf, which is to be put at grade at the time a building is constructed on the property. The sidewalk shelf will provide the owner with an approximate finish grade for a sidewalk. F. Easements for bicycle ways shall be provided on those lots designated along trail corridors as noted in the City's Bicycle Way Plan. The City will designate the required width of easements and elevations for grades at the time a building is constructed on the property. In the case where one of the adjacent properties is vacant, an assumed setback of thirty-five (35) feet will be used. H. In computing the depth of a rear yard for any building where the rear line of the lot adjoins an alley, one half (1/2) of the width of the alley may be included as rear yard depth, provided that the actual rear yard depth on the lot shall not be Iess than twenty (20j feet in any residential district and not less than twenty-five (25) feet in any other district. I. No land shall be altered and no use shall be permitted that results in water run-off causing flooding, erosion or deposits of minerals on adjacent properties. B. A conservation practice may be a permanent or temporary v�etative or structural measure that when applied to the land, will contribute to the control of wind and water erosion and sedimentation. The City may designate the zoning or plannirig director, building inspector, engineer or a designee of the Anoka Caunty Soil arid Water Conservation District to review the conservation plan and time schedule. 2. If the City determines that the conservation plan and time schedule will control erosion and sedimentation, the City shall issue a pernu.t that authorizes the development activity contingent upon the im�lementation and ccn�letion of the conservation plan. If the City det:ermines that the conservation plan and time srhedule do not control erosion and sed�mentation, the City shall not issue a permit for the development activity. The conservation plan arxi t3me sr,hedule shall be re-submitted for appraval before the development activity can begin. 3. A person engaged in a development activity who does not submit a conservation plan and t�me sc.hedule or make satisfactory progress to camplete the plan and schedule is subject to pexialties described herein. 4. Occasionally, erosion control strategies will not be feasible or practical in all in�tances. When this occurs, the City shall take into ac�ount the facts and peculiarities of the specific situation and make a decision given the available information arid overall circ�unstances. 208.06 DESIGN STAtIDAItDS 1. All open Ghannels and ponds shall be designed to prevent damage from a 100-year storm of 24 hour duration. 2. All coriveyance systems shall be designed for the 5-year storm of a minim�nn 20 minute time of concentration. 3. Landscaping, streets, storm sewers, and other drainage and erosion controls shall be installed as early in the construction schedule as is practical. 4. Ground cover shall be established as soon as possible after work is campleted. 16. Developm�nt on slopes aver twelve peroent (12%) in grade shall not be considered. On slopes with a grade between six (6) to twelve (12) percent, development shall be carefully reviewed to ensure adeq�.tiate measures have been taken to prevent erosion, sedimentation and structural damage. 18. Erosion aricl �tation control m�asures shall be coorrlinated with the different stages of the development; appropriate control ineasures shall be installed prior to developm�nt when necessary to control erosion. 19. The soil shall be restored to the mini.m��n depth of four (4) inches and seed and rnulch worked into the area. 208.07 SF7CCTRITIES Where a conservation plan is requi.red in conjunction with a building permit, i.m�lementation shall be secured by the require�ments of Cnapter 205, Section 205.05.06 A(3) . Where a conservation plan is required in conjunction with a land alteration permit, a letter of credit, performance bond, or certificate of deposit shall be required to insure implementation of the conservation plan. The security shall be five perc�nt (5%) of the value of the work as indicated on the larid altexation permit application. If the aonservation plan is not implemented arid maintained duririg the construction period, the security shall be cashed by the City and u��ed to implemez�t said plan. All legislation prescribing a penalty for violation thereof shall be enacted in the form of ordinances. Section 3.06. EMERGENCY ORDINANCES. An emergency ordinance is an ordinance necessary for the immediate preservation of the public peace, health, morals, safety or welfare in which the emergency is defined and declared, passed by a vote of a majority of the Council, as recorded by ayes and noes. No prosecution shall be based upon the provisions of any emergency ordinance until the same has been filed with the City Clerk and posted in three (3) conspicuous places in the City and twenty-four (24) hours after such filing and posting shall have elapsed or until the ordinance has been published, unless the person(s), firm or corporation charged with violation thereof shall have had actual notice of the passage thereof prior to the act or omission complained of. The initial draft of the policy was written by the City's labor relations consultant, Cyrus Smythe, in November of 1991. It has been compared with.the policies of several other cities, and it has been reviewed by legal counsel, the Fridley Medical Center (Multicare Associatesj, and MEDTOX Laboratories. Medtox Laboratories have agreed to provide trainers and to conduct tours of their facilities in Roseville. I request that you present the attached resolution and drug and alcohol policy to the Fridley City Council for consideration at their meeting of April 19, 2993. DRUG AND ALCOHOL USE The following Drug and Alcohol Policy has been adopted by the City of Fridley (the City) and is effective as of May 1, 1993. Nothing contained in this policy is intended to create a contract between the City and any of its employees. It is the policy of the City of Fridley to provide a drug-free environment. The City's goal is to establish and maintain a healthy and efficient workforce free from the effects of drug and alcohol abuse in compliance with the requirements of the federal Drug-Free Workplace Act of 1988 and applicable state law. The City recognizes drug and alcohol abuse as potential health, safety and security problems. Employees needing help in dealing with drug and alcohol problems are encouraged to make use of the medical resources available through their health insurance plans. Employees are required to report to work on time and in appropriate mental and physical condition for work. No employee shall be under the influence of any drug or alcohol while the employee is working or while the employee is on the employer's premises or operating the employer's vehicle, machinery, or equipment, except to the extent authorized by a valid medical prescription. Unless specifically authorized as part of the employee's work duties, no employee shall use, posses, manufacture, distribute, dispense, sell, or transfer drugs, alcohol, or drug paraphernalia while the employee is working or while the employee is on the employer's premises or operating the employer's vehicle, machinery, or equipment, except to the extent authorized by a valid medical prescription. Off duty employees may use or possess alcohol on City premises such as parks and parking lots when said use and possession is not prohibited to members of the general public. The sale of alcohol as part of an employee's job duty is an exception to this policy. Violations of this policy will result in disciplinary action, up to and including termination, and may have legal consequences. To assist employees in understanding the perils of drug and alcohol abuse, the City has established a Drug-Free Awareness Program. This drug and alcohol policy constitutes the City's drug free awareness program and fulfills the notification requirements of the Federal Drug Free Workplace Act of 1988. The City will use this 1 15B program as an ongoing educational effort to prevent and eliminate drug and alcohol abuse that may affect the workplace. The Program will inform ernployees of the dangers of drug and alcohol abuse, explain the City's Drug and Alcohol Policy and the sanctions imposed for its violation, and highlight any treatment, counseling, and rehabilitation referral services that may be available to employees in the City. Nothing set forth in this policy is intended to conflict with state law. As a condition of employment, each and every employee of the City of Fridley must abide by the terms of this policy and must report in writing any instance of the employee's own conviction under a criminal drug statute for a violation occurring on or off work premises while conducting city business. Any such conviction must be reported to the City Manager or to a person designated by the City Manager within five (5) days after the conviction as required by the federal Drug-free Workplace Act of 1988. The City shall notify the appropriate federal agency of such conviction within ten (10) days of receiving notice from the employee. An employee convicted of a criminal drug offense committed in the course of employment will be subject to appropriate disciplinary action and/or required to complete successfully an appropriate rehabilitation program at the employee's own expense unless provided to the employee through insurance coverage. The City, in its sole discretion, shall determine what disciplinary action is appropriate. II. DRUG AND ALCOHOL TESTING A. Purpose: The purpose of this policy is to provide for the testing of employees and job applicants in conformance with the requirements of Minnesota Statutes 181.950 through 181.957. B. Scobe: This drug and alcohol testing policy applies to all employees of the City of Fridley and to all job applicants who have received a contingent offer of employment by the City of Fridley. C. Definitions: For purposes of the Policy, the following definitions will apply: 1. "Alcohol" -- Ethyl alcohol. � 15C 2. "Confirmatory Test" and "Confirmatory Retest" -- Generally a drug or alcohol test that uses a method of analysis allowed under one of the programs listed in Minnesota Statutes 181.953, Subd. l, and which is reliable for providing specific data as to the drugs, alcohol, or their metabolites detected in an initial screening test. More specifically, a"Confirmatory Test" means the second test that will be given to confirm the zesult of an Initial Screening Test. The Confirmatory Test will be performed on the same sample as used in the initial screening test. A"Confirmatory Retest" means an optional third test which may be performed at the request and e�ense of an employee or job applicant for the purpose of the testing procedure. The Confirmatory Retest will be performed on the original sample. 3. "Conviction" -- A finding of guilty (including a plea of "nolo contendere") or imposition of sentence, or both, by any judicial body charged with the responsibility to determine violations of state or federal criminal drug statutes. 4. '�Drug�' -- A controlled substance as defined in Minnesota Statutes 152. 01. , Subd. 4, and/or if required by law, the federal Drug-Free Workplace Act of 1988. 5. "Drug and Alcohol Testing," "Drug or Alcohol Testing," and "Drug or Alcohol Test" -- Analysis of a body component sample according to the standards established under one of the programs listed in Minnesota Statutes 181.953, Subd. 1 for the purpose of ineasuring the presence or absence of drugs, alcohol, or their metabolites in the sample tested. 6. '�Drug paraphernalia" -- An item or items described in Minnesota Statutes 152.OZ, Subd. 18. 7. "Employee" -- A person, independent contractor, or person working for an independent contractor who performs services for compensation, in whatever form, for the City of Fridley during the individual's work hours. 8. "Employer" -- the City of Fridley the City acting through its City Manager or a designee of the City Manager. 9. "Initial Screening Test" -- A drug or uses a� method of analysis allowed programs listed in Minnesota Statutes and which is capable of detecting presence of a drug, drug metabolite, sample. 3 15D alcohol test which under one of the 181.953, Subd. 1, the presumptive or alcohol in a 10. "Job Applicant" -- A person, independent contractor, or person working for an independent contractor who applies to become an employee of the City, including a person who has received a job offer made contingent on the person's passing drug or alcohol testing. 11. "Premises" -- Al1 property and locations in which the City of Fridley is operating or has established a presence. 12. "Positive Test Result" -- A finding of the presence of drugs, alcohol, or their metabolites in the sample tested in levels at or above the threshold detection levels contained in the standards of one of the programs listed in Minnesota Statutes 181.953, Subd. 1. An alcohol test will be considered positive if the testee has an alcohol concentration level of at least 0.04 percent. 13. "Reasonable Suspicion" -- A basis for forming a belief based on specific facts and rational inferences drawn from those facts. 14. "Safety-sensitive position" -- A job, including any supervisory or management position, in which an impairment caused by drug or alcohol usage would threaten the health or safety of any person. 15. "Under the influence'� -- Having the presence of a drug or alcohol at or above the level of a positive test result. D. Circumstances under which Testing may Occur• Any employee or job applicant of the City may be tested under the following circumstances: 1. 2. Job Applicant A job applicant may be requested or required to undergo drug testing after a job offer has been conditionally made and before commencing employment in the position. Alcohol testing will not be a part of a post-offer pre- employment physical examination. Treatment Program Testing The City may test any employee referred by the City for chemical dependency treatment or evaluation at any time and without prior notice during the period of treatment or evaluation and for up to two (2) years following completion of any prescribed chemical dependency treatment or evaluation program in accordance with Minnesota Statutes 181.951, subd. 6. 4 15E 3. Reasonable Suspicion Testing No employee will be tested for drugs or alcohol under this policy without the person's consent. If, however, the City asks an employee to undergo a drug or alcohol test and the employee refuses, the employee may be subject to disciplinary action. The City of Fridley may request or require an employee to undergo drug or alcohol testing if the employer has a reasonable suspicion that the employee: a. is under the influence of drugs or alcohol as defined in this policy; b. has violated the employer's written work rules prohibiting the use, possession, sale, or transfer of drugs or alcohol while the employee is working or while the employee is on the City's premises or operating the City's vehicle, machinery, or equipment; c. has sustained or caused another person to sustain a work related personal injury; or d. has caused a work related accident or was operating or helping to operate machinery, equipment, or a vehicle involved in a work related accident. 4. Random Testing and Testing without Prior Notice a. Random testing may be given without prior notice during regularly scheduled work hours to those employees who are in "safety sensitive" positions, including any supervisory or management positions, in which an impairment caused by drug or alcohol use would threaten the health or safety of any person. Under the random selection proces, there is an equal probability that an employee in a safety-sensitive position subject to the selection mechanisms will be selected for testing. The City does not have discretion to waive the selection of any employee chosen on a random selection basis. 1.) The City of Fridley declares that all Police Department positions, (including but not limited to sworn, unsworn, union, non-union, supervisory and management positions) are hereby designated as "safety sensitive" positions. 5 15F 2.) The City of Fridley declares that all Fire Department positions, (including but not limited to, union, non-union, supervisory and management positions) are hereby designated as "safety sensitive" positions. 3.) The City of Fridley declares that all Public Works Maintenance Division positions, (including but not limited to, union, non- union, supervisory and management positions) are hereby designated as "safety sensitive" positions. b. Testing without prior notice may be given employees who have been referred by the City for chemical dependency treatment or evaluation or who are participating in a chemical dependency treatment program under an employee benefit plan or have participated in such a chemical dependency treatment program in the prior two years. (see Section II.D.2. above.) E. Criteria for selecting testinQ laboratories• 1. For drug testing: In accordance with Minnesota Statutes 181.963, subd. 1., the City of Fridley shall use the services of a testing laboratory that meets one of the following criteria for drug testing or such other applicable criteria as established under Minnesota law: a. is certified by the National Institute on Drug Abuse as meeting the mandatory guidelines published at 54 Federal Register 11970 to 11989, April 11, 1988. b. is accredited by the College of American Pathologists, 325 Waukegan Road, Northfield, Illinois 60093-2750, under the forensic urine drug testing laboratory program. 2. For alcohol testing, the laboratory must be accredited by the College of American Pathologists, 325 Waukegan Road, Northfield, Illinois 60093-2750, in the laboratory accreditation program or meet such other applicable criteria as established under Minnesota law. F. Refusal to Undergo Testing: 1. Job Applicants Job applicants may refuse to undergo drug testing. However, if a job applicant refuses to undergo drug or alcohol testing requested or required by the employer, � 15G G. H. I. 2. no such test shall be given, and the job applicant shall be deemed to have withdrawn the application for employment. Employees Employees may refuse to undergo drug testing. However, if an employee refuses to undergo drug and alcohol testing carried out in conjunction with this Policy the employee may be subject to discipline including, but not limited to, discharge. Tamperinq with the Urine or Blood Sample: If an employee tampers with his or her own urine ar blood sample or in any way deliberately causes a sample to be invalid, the employee may be subject to discipline including, but not limited to, discharge. The City has given the employee an opportunity to participate in, at the employee's own expense or pursuant to coverage under an employee benefit plan, either a drug or alcohol counseling or rehabilitation program, whichever is more appropriate, as determined by the City after consultation with a certified chemical use counselor or physician trained in the diagnosis and treatment of chemical dependency; and 2. The employee has either refused to participate in such a program or has failed to complete the program successfully within a reasonable time as evidenced by withdrawal or a positive test result on a confirmatory test after completion of the Program. Failure to Pass Drug and Alcohol Testing Generally: 1. Initial Screenina Test (Employee) -- The City will not discharge, discipline, discriminate against or require rehabilitation of an employee solely on the basis of a positive Initial Screening Test that has not been verified by a Confirmatory Test. However, the City may temporarily suspend a tested Employee whose test results are positive or transfer the Employee to another position at the same rate of pay pending the outcome of a Confirmatory Test (and, if requested, a Confirmatory 7 15H Re-Test) if the City believes it is necessary to protect the health or safety of the employee, co-workers or the public. An employee who is suspended without pay will be reinstated with back pay if the outcome of the Confirmatory Re-Test is not positive. Requests for such a Re-Test must be made in writing within five (5) days of the employee's receipt of notice of the test results. An employee who receives a positive test result on a Confirmatory Test and does not request in writing a Confirmatory Retest within five working days after notice of positive confirmatory test results, may be subject to discipline including, but not limited to, discharge subject to the provisions of this Policy. 2. Initial Screening Test (Job Applicant) -- The City will not withdraw a conditional offer of employment on the basis of a Positive Test Result on a job applicant's Initial Screening Test. An Initial Screening Test must be verified by a Confirmatory Test (and a Confirmatory Re-test, if requested) before a conditional offer of employment can be withdrawn. A job applicant who receives a Positive Test Result of a Confirmatory Test, fails or refuses a Confirmatory Retest, or does not request in writing a Confirmatory Retest within five days after notice of a positive test result of a Confirmatory Test, may be refused employment and will be notified of the reasons for such refusal. 3. Confirmatory Test -- Discipline for a Confirmatory Test verifying a Positive Test Result on an Initial Screening Test may include discharge of an employee; provided, however, that prior to discharge, the employee is given the opportunity to explain a Positive Test Result and request and pay for a Confirmatory Re-Test on the original sample. If the Confirmatory Re-Test is not positive, no action will be taken against the employee. If the Confirmatory Re-Test is positive, and if it is the first Positive Re-Test Result for the employee, the employee will not be terminated if the employee elects to participate, at the employee's own expense, in a drug or alcohol treatment or rehabilitation program, whichever is appropriate. An employee who either refuses to participate in the treatment or rehabilitation program or who fails to successfully complete the treatment or rehabilitation program (as evidenced by withdrawal from the program before its completion or by a Positive Test Result on a Confirmatory Test during or after completion of the program), may be subsequently discharged. 8 151 J. Rights of Em�lovee or Job Applicant: 1. An employee or job applicant who receives a Positive Test Result on a Confirmatory Test has the right to receive a copy of the test result report and, within three (3) working days of notice of the original positive Confirmatory Test result, to submit information to the employer in addition to any information already submitted to explain that result, or within five (5) working days to notify the employer in writing of his/her intention to obtain a Confirmatory Retest of the original sample at the employee's or job applicant's own expense. 2. If the Confirmatory Retest is conducted in accordance with rules established by the Commissioner of the Minnesota Department of Health by a qualified laboratory in accordance with Section II. E. above, and if it is not positive, the City of Fridley shall reimburse the employee or job applicant for the actual cost of the Confirmatory Retest in an amount not to exceed $100.00 and no adverse personnel action shall be taken against the employee or job applicant based on the original confirmatory test. K. General Testing Procedures: A11 testing will be performed by a licensed laboratory that certifies its compliance with the requirements of Minnesota statutes 1s1.96 et sea. When the City decides to test for drug ar alcohol use on any of the grounds enumerated in section zI. D. above, the following procedures will apply. 1. Initial Screening Test. a. Acknowledgement. Before the Initial Screening Test the employee or job applicant shall be informed of the City's testing policy and given a form on which the employee or job applicant can acknowledge being so informed. The form shall allow the employee or job applicant to indicate any medication (prescription, signed for, or over-the-counter) that the individual is currently taking or has recently taken and other information relevant to the reliability of, or explanation for, a Positive Test Result. Medical information disclosed on the form shall not be used as the basis for any adverse personnel action. b. If the Initial Screening Test produces a negative result, written notice of such result will be given to the individual who took the test within three ( 3 j working days after the City receives the test result report. The employee or applicant will also be E 15J notified that they have the right to request and receive a copy of the test report. c. The testing laboratory will perform a Confirmatory Test on all samples that produce a Positive Test Result on the Initial Screening Test. 2. Confirmatory Test. If the Initial Screening Test produces a Positive Test Result, a second test (known as the Confirmatory Test) will be conducted by the laboratory. If the Confirmatory Test is not positive, the City will send written notice of this fact to the Employee or job applicant within three (3) working days after receiving the result. If the Confirmatory Test produces a Positive Test Result, the City will take the following four steps: a. The City will send written notice of the Positive Test Result within three (3) working days after receiving it to the employee or job applicant. b. The employee or job applicant will be informed of his/her right to receive a copy of the test result. c. The employee or job applicant will be told of his/her right to explain the positive result. d. The employee or job applicant will be informed that he/she has a right to request a Confirmatory Re-Test of the original sample at the employee's or job applicant's expense. The employee or job applicant has five (5) working days in which to notify the City of this request in writing. 3. Confirmatory Re-Tests. If an employee or job applicant chooses to request a Confirmatory Re-Test, the employee or job applicant has five (5) working days within which to notify the City of this request in writing. Within three (3) days of the receipt of such request, the City will notify the original testing laboratory that it is to conduct a Confirmatory Re-Test or transfer the sample to another certified laboratory for re-testing. If the Cvnfirmatory Re-Test does not confirm the original Positive Test Result, no adverse personnel action will be taken by the City. If the Confirmatory Re-Test is positive, the City may withdraw its conditional offer of employment to a job applicant or terminate an employee if such employee chooses not to participate in a chemical dependency treatment or evaluation program. 10 15K Q M. Data Privacy: Test result reports and other information acquired in the drug and alcohol testing process are private data on individuals as defined in Minnesota Statutes, Chapter 13, and may not be disclosed to another employer or to a third party individual, governmental agency, or private organization without the written consent oF the employee or applicant tested, unless otherwise permitted by Iaw or required by court order. (See Minnesota Statutes 181.954, Subd. 3.) Other Misconduct: Nothing in this Policy limits the right of the employer to discipline or discharge an employee on grounds other than a positive test result in a confirmatory test. For example, possession but not consumption of a controlled substance, the sale of a controlled substance on City premises, or conviction under any criminal drug statute for a violation occurring in the workplace, may by themselves, be grounds for discipline or discharge. Any City employee may be subject to discipline up to and including termination for violation of this Policy or any rules adopted by the City with respect to the manufacture, use, sale, or transfer of drugs and alcohol. Each Department Manager and Supervisor shall be responsible for informing their employees of this Policy. Each employee of the City of Fridley shall be notified of this policy. All deficiencies have been corrected by the contractor. Also, the work for which the City feeis the contractor shoutd receive a reduced price has been agr��d u�on by the contractor.
