ADOPTION OF AGE�NDA:
Mr. Burns, City Manager, asked that a resolution be added in
support of an application for a Minnesota lawful gambling premise
permit to the World Association of the Alcoholic Beverage
Industries.
MOTION by Councilwoman Jorgenson to adopt the agenda with the above
addition. Seconded by_Councilman Billings. Upon a voice vote, all
voting aye, Mayor Pro Tem Schneider declared the motion carried
unanimously.
OPEN FORUM, VISITORS•
PUBLIC NUISANCE ON RICE CREEK ROAD:
Ms. Dolores Kastensen, 1541 Rice Creek Road, stated that she has
contacted City staff regarding junk vehicles at 1530 Rice Creek
Road. She stated that there are trucks parked on this property
which are usually filled with trash or dirt, and they are in view
of her picture window. Ms. Kastensen stated that the owner of

these vehicles runs the trucks which create fumes that pollute the
inside of her.home. She felt that there should be an ordinance to_
- prevent this unsightly poll,uted condition in a residential area.
She submitted pictures and a petition to have these vehicles
�emoved. . �. . ' � � �
MOTION by Councilwoman Jorgenson to receive Petition No. 1-1994.
Seconded by Cbuncilman Billings. Up.on a.voice vote, all voting
aye, Mayor Pro� TEm Schneider declared the motion carried
unanimously. : -
Ms. Kastensen stated �that .this � issue would be goir�g to court on

Ms. Dacy, .Communit��.Qev.elopment� D��rector; stated that �teve Barg,
� . Code Enforcement Offrcer, has contacted�other cities and the League .
of Mi.nnesota Cities � to develop_ a- list of what other surrouriding
communities are doing to prohibit large�comme�cial vehicles on
. residential proper.ty. She stated that the cities of Coon Rapids,
' Blaine, a�nd Columbia Heights have a variety of restrictions and
other communities do not�have any restrictions.
Ms. Kastensen stated that she also did some research, and there are
some ordinances pertaining to this particular issue.
Ms. Dacy stated that she would welcome any information which
Ms. Kastensen has received.
Mayor Pro Tem Schneider asked the City Attorney if there are any
problems in limiting commercial vehicles on residential property.
Mr. Herrick, City Attorney, felt that some form of restriction may
be legitimate, and he felt such an ordinance would be upheld in
court if it is properly written.
Mayor Fro- Tem Schneider thanked Ms. Kastensen for her comments.
He stated that the City would be working on this issue.
INTERFERENCE IN NEIGHBORHOOD BY RADIO OPERATOR:
Mr. George Paquin, 6361 Quincy Street, stated that the property
owner at 6330 Quincy Street has a CB tower and another huge antenna
on his home. He stated that every evening this property owner gets
on the radio and interferes with the telephones, computers, and
electronic toys in neighboring homes. He stated that there were
three direct lightning strikes near this home.
Mr. Paquin stated that he has contacted the FCC and U.S. West. He
stated that it seems the FCC cannot do anything about it, and U.S.
West limits their involvement to technical issues. He asked if
the City could help resolve this problem under the public nuisance

ordinance, as.this is a condition causing danger or annoyance to
the general public. . � � . .
Mayor Pro Tem Schneider stated that equipment used by�a radio
operatcsr is checked by� -FCC� engineers before it is allowed �to �be
sold. He stated that filters. can be purchased that filter out.
interference. �
Mr. Paquin stated that U�. S. West can hook up a f iltering sys�em .
which would cost about $100. � �
May.or Pro Tem Schneider stated that� the qt�estion is__ if�this.
operato��is.operating illegally.� He.felt that the�City does not •
have the.autharity to.answ2r this question. �� . �
M�. I-Ierrick,� City � Atto�ney, � stated he has. been tald that tl�is .
pErson is a licensed ham operator. He�stated tha� he has been in .
contact with an�.attorney�with� the FCC and was advised that in
problems of interference, the FCC has exclus�ive �jurisdictiori'. �.
Mr. Herrick stated that in checking with the attorney at the I�eague �
of Minnesota Cities, he received the same information. He stated
that this information is also substantiated in Minnesota court
cases and, basically, the House Conference Report�clarifies that
the exclusive jurisdiction� over ra•dio frequency interference
incidents lies �aith the FCC. He stated that such matters shall not
be regul'ated �by local or state law, nor shall radio transmitting �
apparatus be subject to local or state�regulation as part of any
effort to resolve a radio frequency interference.
Mr. Herrick stated that he has been advised through Mr. Barg that
the FCC does not have the personnel to enforce their regulations.
He got the impression that they did not intend to do much regarding
this issue.
Mr. Paquin stated that the field officer for the FCC did feel this
warranted an investigation and would review this case.
Mr. Herrick stated that he did not think there was a legal solution
to the problem, and the City should probably wait to see what type
of action is taken by the FCC after it's investigation.
Mayor Pro Tem Schneider asked Mr. Paquin if he has contacted the
property owner regarding this problem.
Mr. Paquin stated that he has contacted him, and he denies he is
causing any problem.
Mr. Herrick felt that this problem may be one that could be solved
through arbitration if all parties were willing to become involved.
Mayor Pro Terr� Schneider felt that filters could be purchased for
under $20, and that may solve the problem.

Mr. Paquin stated that U.S. West felt it would take more than
filters to solve the problem. � _
Councilwoman Jorgenson.felt that the City should�work w.ith the ��.
League of Minnesota Cities to find out if similar complaints have �'� ��
been received and submit them to�Washington. ��� �
: Mr:.Herrick asked how long this �interference.has been a problem.
� Mr. Paquin stated that he noticed�it last spring, and��i.t has'go.tten
progr.essively worse�: � � . �
..Mr. Herrick stated that, �apparently, this persun has .operat�ecl the �
. :ham � radio for .twe�z�ty years. . If there was not a-problem before,. '-
there must be s.ome�electrical or. technical changes that have
� � •occurred. � � .. . . . .. �.
� � � Mr. � Paquin stated that he . knows there has been s�ome changes�� .in . �.
: antennas, but he did not know if this was the problem�•or.not: �� -�
Councilman Billings stated that in this particular case, the FCC
is the only agency that has the power to regulate this situation.
He stated that the next step may be for Mr. Paquin to contact
Senators Wellstone �nd Durenberger and� Representative Grams. He
stated that City�staff or Council would be willirig to coop.erate 'in
any.way they c�n, but he felt the Supreme Court has ruled that the
City does not have any authority in this matter.
Mr. Paquin stated that in the research he has done he is aware'the
Council cannot help him. He wanted some avenue to follow, and
Councilman Billings has given him one. He stated that the FCC
wants full control, and yet they state they cannot help because
they do not have the personnel. He thanked the Council for their
time.
OLD BUSINESS•
1. ORDINANCE NO. 1022 ESTABLISHING A NEW CHAPTER OF THE CITY CODE
OF THE_CITY OF FRIDLEY, CHAPTER 112, ENTITLED "FALSE ALARMS "
AND AMENDING CHAPTER 11, ENTITLED "GENERAL PROVISIONS AND
FEES:"
Mr. Sallman, Public Safety Director, stated that this ordinance was
presented for first reading on November 15, 1993. He stated that
this ordinance relates to false alarms where persons who have an
exces"s -of five false alarms per year would be subject to a user
fee. He stated that over a twelve month period, the Police
Department alone had 1,300 false alarms. He felt that the
ordinance would cut down on false alarms, as the City is spending
about $25,000 a year to respond to these false alarms.
MOTION by Mayor Nee to waive the reading and adopt Ordinance No.
1022 on the second reading and order publication. Seconded by
Councilwoman Jorgenson. Upon a voice vote, all voting aye, Mayor
Pro Tem Schneider declared the motion carried unanimously.

2. ORDINANCE NO. 1023 AMENDING CHAPTER 603. "INTOXICATING
LIOUOR," BY AMENDING SECTION 603.20� AND AMENDING CHAPTER 11,
"GENERAL PROVISIONS AND FEES:" .
Mr. Pribyl,. Finance-�Directoz, stated that this ordinance. had a
first reading on October 18, 1993. It would el�iminate the current
dispensing license and rep.lace it.with a managerial license.
MOTION by Councilman .Billings to waive the zeading and adopt
Ordinance No. 1023 on the second� reading and order publication.

Mr: Pribyl, Finance Director, stated that the change in these fees
� is to recover the�cost of certain fee related activities.
MOTION by Councilwoman Jorgenson to waive the reading and adopt
Ordinance No. 1024 on the second reading and order publication.
Seconded by Mayor Nee. �
MOTION by. Councilwoman Jorgenson•to amend Code 113•, Solid Waste
Programming, by changing the $2.50 figure to $4.00. Seconded by
Councilman Billings. Upon a voice vote, all voting aye, Mayor Pro
Tem Schneider declared the motion carried unanimously.
Councilman Billings asked about the fees for Street Vending and how
these are handled.
Mr. Pribyl stated that the fee for both an industrial/commercial
and residential license is $100. The fee for just an
industrial/commercial license is $50 and $70 for just a residential
license. He stated that by applying for both, it would result in
a lesser fee.
UPON A VOICE VOTE TAKEN ON THE MAIN MOTION, all voted aye, and
Mayor Pro Tem Schneider declared the motion carried unanimously.
NEW BUSINESS•
4. RESOLUTION NO. 1-1994 IN SUPPORT OF AN APPLICATION FOR A
MINNESOTA LAWFUL GAMBLING PREMISE PERMIT TO LIONS CLUB OF
FRIDLEY:
Mr. Pribyl, Finance Director, stated that the Fridley Jaycee's will
be discontinuing their gambling license for Joe DiMaggio's. The
Lions Club is vacating their lawful gambling activities at Maple
Lanes, and they wish to continue this activity at Joe DiMaggio's.

�NVESTMENT, TO ALLOW AN�. INCREASE IN LOT COVERAGE 'FROM

... Ms:. Dacy stated .that .t�is is. a. request. for a spec�,al �use permit' to
. allow an..ihcrease in lnt coverage�f�rom 40 percent�to 49.9 percent
for expansion of. a�building. at.�7770 Ranchers Road. �She stated tY�at
. . the expar►sion is needed to allow for, additi;onal equipment, for: ELO�
. Engineering. She stated that the original request included• two
• expansion areas; one located in the northeast corner of the
building, and the otYier-located in the northwest corner of the
building. � . � �
Ms. Dacy stated that staff inet with the petitioner and his
architect to discuss a revised site plan. She sta�ted that the
areas of expansion did not change, but the peti:tioner agreecl to
remove an existing hard sur.face area adjacent to the�proposed
northwest addition. By doing so, it eliminated the need for the
variances. She stated that the revised plan increases the amount
of green space and resolves previous concerns of staff.
Ms. Dacy stated that a drainage plan has been reviewed by the
Engineering Department. It was determined that the drainage
on-site was adequate, and the petitioner would not need to provide
any further information regarding storm water drainage. She stated
that staff concurs with the Planning Commission recommendation for
approval of this special use permit.
Mr. Owczarzak, the owner of ELO Engineering, stated that his
business has been in Fridley since 1977, and he is trying to stay
.� competitive by automating the company. He stated that they will
be spending around $2 million in new equipment which takes up more
room and gives them less storage space. He stated that this new
equipment will make them more competitive and let them stay in
business.
Mayor Nee stated that he has been impressed with ELO Engineering's
continuing growth over the years, and he wanted to make sure if at
any time in the future Mr. Owczarzak is interested in a new
building, he hopes he will give the City a chance to discuss these
plans.

Councilman Billings stated that there was a similar request before
the Council in 1988, which did not meet the test for a variance,
and the City reviewed the code to allow this lot coverage through
the s.pecial use permit process, rather than the variance procedure.
MOTION by Councilman Billings to grant Special Use Permit Request,
SP #93-16. Seconded by Councilwoman Jorgenson. Upon a voice vote,
all votirig .aye, Mayor Pro Tem Schneider declared the motion carried
unanimously. �

6. ESTABLISH A PUBLIC HEARING FOR JANUARY 18, 1994,. TO CONSIDER
THE 1994 CDBG PROGRAM ALLOCATION:
MOTION�by Councilman Billings to set the public hearing regarding
the CDBG allocation for January 18, 1994. Seconded by Councilwoman
Jorgenson. Upon a voice vote,. all voting aye, Mayor Pro Tem
Schneider declared the motion carried unanimously.
7. RECEIVE BIDS AND AWARD CONTRACT FOR 64TH AVENUE STORM SEWER
PROJECT NO. 260•
Mr. Flora, Public Works Director, stated that fifteen bids were
received for this project, and the low bidder• was Bonine
Excavating, Inc. at $111,611.82. He stated that the amount to be
funded by the City would be $108,230.82, and there are sufficient
funds in the storm sewer fund to cover this cost.

that he shared Councilman Billings concern. It is over the amount
targeted for this project, and some other projects may have to be
deferred. He�stated that a large portion of the expense is removal
of the �street sweepings the Ci�ty placed on the lots along Rice.
Creek Road: . � . • .
Mr. Flora stated that_the cost to establish the wetlands along Rice
Creek Road is a little over $29,000, and the $19,000 for design
and engineering costs were not addressed in the original estimate.
Mayor Pro Tem Schneider stated that if $29,000 was eliminated, the
cost to the City for the project would be about $80,000.
Councilwoman Jorgenson stated that the ground water level was
higher than anticipated, and the cost for the piping was higher.
Mayor Pro Tem Schneider stated that the City plans to assess each
owner $1,000 for this improvement, and 41 parcels of property are
involved.
Mayor Nee stated that at one time, the City had collected $800 per
lot for storm water improvements, and then these monies were
refunded.
Mr. Flora stated that he understands that five properties had funds
placed in escrow, and those monies were returned. He stated that
this would be a new assessment to all the properties in the area,
as they have not paid an assessment for storm water.
Mr. Herrick, City Attorney, stated that the funds placed in escrow
were returned due to the time lapse of when they were collected and

the start of the improvement. He stated that this would not have
any effect�on the financing of this proposed project.
Councilman Billings stated that because this project is 180. percent
over what he thought the City would be spending, he would like more
time to review it. .

prepared an application for a Board of Government Innovation and
Cooperation Grant which includes other cities. He stated that if
received, this grant would provide funding for a feasibility study
to determine the merits of jointly addressing building inspection
services.

ASSOCIATION OF THE ALCOHOLIC BEVERAGE INDUSTRIES:
Ms. Reba Whiteoak, repr.esenting the World Association of the
Alcoholic Beverage Industries (WAABI), outlined the organizations
to which WAABI contributes. She stated that some of these include
Sharing and Caring Hands, SACA, Fridley youth sports, East River
Hockey, Scholarships for the high school, Exce1 Program, '49er Days
Celebration,, Fridley Explorer Scouts, and the American Cancer
Society. She stated that in 1993, WAABI gave $61,229 to
organizations�. They turned in.their audit to the City in July and
are in total.comp�iance with what is requi.red.

At the January 3, 1994 council meeting, the Council received bids for the 64th Avenue
Storm Sewer Project No. 260. , The� low bidder was Bonine Excava�ing, Inc. at $111,611.82.
The total cost .for the �project with this bid is $172,715.82, This �includes $19,000 for design
and $41,904 for the storm sewer pipe that has been installed on 64th Avenue.
We propose to assess 41 properties in this sub-watershed area for $1,000 each for a total
amount of $41,000. The County has agreed to participate in the storm water project.in the
amount of $23,285. This leaves a remainder of $108,230.82 to be funded by the City.
When the 64th Avenue project was being proposed in September, 1993, the preliminary
estimate identified a project of $108,000 of which $67,000 would be funded by the City.
Since those estimates were prepared, we have been able to fine tune the specifications and
specifics associated with the storm water detention pond to be constructed off of Rice Creek
Road.
Attached is a summary of the storm water fund including this improvement.
As this area has had numerous complaints with rainfall events, this project is an attempt to
satisfy some of the concerns of this area and should alleviate the normal reoecurring rainfall
complaints.
Recommend the City Council award the contract for the 64th Avenue Storm Sewer Projeet
No. 260 to Bonine Excavating, Inc. at $111,611.82.

1. The form of government established by this Charter shall be

office, removal from the City, removal of a ward councilmember
from that ward, continuous absence from the City for more than

whether before or after their qualification, or by reason of
the failure of any councilmember

meetincts of the Council. In each such case, within thirtv

2. If a vacancy is declared to occur before filinas for the next
election of the office in question are closed, the Council

4. If the vacancy is declared to occur in the fourth year of the
term of office after fi�lings for the office in question are
closed, but before October 1 the Council shall appoint

of the required notice on January 4, 1994. We sent the text to the
newspaper by computer disk. In our format the additions were
shaded. Unfortunately, the newspaper's compz�ter can only•�handle .
underlining, and the shaded.por�ions agpeared.in the notice as if �
they were unchanged�parts of the text. In the future we will have �
to send the newspaper amendments with additions unds�rlined instead
of shaded. '
Since we were not able to comply with the requirement of two weeks
published notice of the public hearing, it will be necessary to
reschedule the hearing. P�lease request the City Council at their
meetirig of January 18, 1993 to set a public hearing on amendments
to Chapter 4 of the City Charter for their meeting of February 7,

CHAPTER 4
NO�iINATIONS AND ELECTIONS
Section 4.01.� GENERAL ELECTION LAWS TO APPLY.
Except as hereinafter provided, the general laws of the State of
Minnesota pertaining to registration of eligible voters and the
conduct of primary and general elections shall apply for all
municipal elections of such officers as are.specified in this
Charter. The Council sha�l, through ordinances duly adopted in
compliance with such state laws and this Charter, adopt.suitable
and necessary regulations for the conduct of such elections. (Ref.

Section 4.02. REGULAR MUNICIPAL ELECTIONS.
Regular municipal elections shall be held on the first Tuesday
after the first Monday in November, at such place or places as the
City Council may designate by resolution.
3-��;�Regular municipal elections shall be held every even
numbered year. The Council may divide the City into as many voting
precincts as it may from time to time deem necessary. Each ward
shall constitute at least one (1) voting precinct and no precinct
shall be in more than one (1) ward. At least fifteen (15) days'
notice shall be given by the City Clerk of the time and places of
holding such election, and of the officers to be elected, by
posting a notice thereof in at least one (1) public place in each
voting precinct and by publishing a notice thereof at least once
in the official newspaper of the City, but failure to give such

Section 4.06. NOMINATIONS BY PETITION.
The m.ode of nomination of all elective officers provided for by
this Charter shall be by petition. The name of any eligible vote�r
of the City shall be printed upon the ballot whenever a petition
as hereinafter prescribed shall have been filed in that person's
behalf with the City Clerk. Such petition shall be signed by at
least ten (10) registered voters qualified to vote for the office
in question. No elector shall sign '' �

petition for any office for which there is an election. Should
such a case occur, the signature shall be void as to the petition

Section 4.08. CANVASS OF ELECTIONS AND TAKING OF OFFICE.
The Council shall meet and canvass the election returns within
seven (7) calendar days after any regular or special elections, �
shall make full declaration of the results� and
file a statement thereof with the City Clerk,—_ a��Said statement
shall be made a part of the minutes. This statement shall include:
(a) the total number of good ballots cast; (b) the total number of
spoiled or defective ballots; (c) the vote for each candidate, with
a declaration of those who are elected; (d) a true copy of the

other information as may seem pertinent. The City Clerk shall

The 1994 Water Capital Improvement budge� approved by the City Council identified
$40,000 to repair wells 8�and 11. (Well IVo. '1 was sub�tixuted for Well No. `l l�.) �
The notice to bidders was advertised and the specifications and bid forms were sent out to
five well contractors. Five bids were received and opened on Thursday, January 6, 1994 at
11:00 am. Mark Traut Wells, Inc. was the low bid for Well No. 1 at $21,975 and Bergerson
Caswell was low bid fox Well No. 8 at $15,450, for a total of $37,425.
�Mark Traut �nd Bergerson Caswell Well companies have received previous contracts witl�
the City of Fridley� and have completed these contracts in a professional and timely manner.
Recommend the City Council receive the bids and award the Well Repair Project No. 264
to Mark Traut Well, Inc. for $21,975 for Well No. 1 and Bergerson Caswell Well Company
for $15,450 for Well No. 8, for a total of $37,426.

On Thursday, January 6, 1994, at 9:00 am bids were opened for the Sanitary Sewer Repair
Pro�ect No. 263. We �ad two planholders, both of which submitted bids for the project.
The specification was set up with a base bid for relining the sanitary sewer line on 61st
Avenue where it crosses under University Avenue. An alternate bid was also added to the
specification for relining the section of sanitary sewer line on 61st Avenue between 6th
Street and 7th Street. The bid results are as follows: �
Funding for the base project is budgeted in the 5-year Capital Improvement Sanitary Sewer
Fund as $65,000 and the altemate project in 1996 at $60,000. An additional $7,934.40 would
need to be allocated this year in order to line both sections of the sanitary sewer line.
Recommend City Council receive the bids and award the Sanitary Sewer Repair Project No.
263 to Insituform Central, Inc., to include both the base bid and the alternate bid, in the
amount of $72,793.40.

NEW FIRE ENCINE SPECIFICATIONS
This is in reference to the January 18, 1994 City C�uncil meeting at which authorization
will be requested to solicit bids for a new fire #ruck. Major features of #he vehicle are:
Pumping Capacity: . 1500 gallons per minute.
Cab Style: � Four door fully enclosed, low profile, cab over engine, with 5
fireftghfer seating capacity.
Body Construction: Stair�less steel, either. bolted or i�velded assembly.
Color: 3M Emron fire engine red.
Engine: Detroit diesel Series 60 which complies with Environmental
Protection Agency vehicle emission standards.
Transmission: Ai(ison electronic automatic, with "retarder" (assists braking
the truck and reduces wear on brake parts).
Brakes: Antilock braking system (ABS). �
Emergency Warning
Systems:
Meets aN National Fire Protection Association
recommendations and incorporates latest emergency lighting
and siren technology.
