The request was tabled at the September 14 City Council meeting at the petitioner's request, to allow additional time to re-word the stipulations to simplify the recording process at Anoka County. Changes were made as follows: 1) Stipulation No. 1 was modified in a manner that eliminated references to specific addresses. The new language requires that an easement be maintained for those needing access; 2) Stipulation No. 2 was re-worded to state that the City will retain an easement for utility purposes; 3) Stipulation No. 3 was eliminated. At such time as the City's utility easement is vacated, the City will have the ability to require a new easement; 4) Stipulation No. 7 was refined to clarify the church's "hold harmless" requirement. The intent is that the church hold the City harmless for injuries or damages sustained during construction; 5) Other chan�es related to the re-orderin� of the eleven stipulations. Councilmember Barnette reminded residents of the SOth Anniversary Task Force meeting scheduled for Thursday, October 8 at 5:30 p.m. on the lower level of the Municipal Center. Burns, City Manager �'�'_ FROM: Barbara Dacy, Community Development Director SUBJECT: Ordinance Declaring Alley to be Surplus Background On October 13, 1997, the City Council approved a vacation request to vacate a 12 foot alley along the rear of three single family residential properties between 6007 and 6017 3�d Street NE. Because a vacation request triggers each half of the alley to accrue to the owners abutting each side of the alley, the City after its vacation approval requested a deed from the Minnesota Department of Transportation to release their interest in the east half of the vacated alley (the alley abuts TH 47). MN DOT has forwarded the deed to staff's attention, and once recorded the City will have ownership of the east six feet of the alley. The sale of excess property ordinance is required for the City to convey the east six feet to the affected three property owners. Once the east half of the alley has been conveyed from the City to the three property owners, the three property owners must initiate a memorialization process on their Torrens Certificates so that the additional square footage is added to their property. FROM: Barbara Dacy, Community Development Director SUBJECT: Approve Resolution Initiating an Alternative Urban Area Wide Review Process for Medtronic Inc. Background On October 8, 1998, staff received a letter from Donn Hagmann, Director of Real Estate and Facilities Planning for Medtronic Inc., requesting that the City of Fridley initiate an Alternative Urban Area Wide Review (AUAR) process for the Fridley Executive Center site at the northwest corner of I-694 and Highway 65. As you know, Medtronic has signed a letter of intent to confirm its interest in the site for acquisition and development of a second corporate campus in the City of Fridley. The State Environmental Quality Board promulgates rules which regulate the AUAR process. An AUAR is different than in an Environmental Impact Statement. Because the nature of this project is such that development will occur over 10 -15 years, and there is some uncertainty to the exact time frame for the final development of the site, both Medtronic and City staff agree that the Alternative Urban Area Wide process is appropriate. Further, given the companies immediate space needs, the AUAR process provides the same amount of review and analysis required in the typical environmental documents, but on a shorter time frame. Finally, this site has been analyzed finrice in 1985 and most recently in 1996, and there is a significant amount of information already prepared. 2.01 Page 2- Resolution initiating an alternative urban area wide review process for Medtronic Inc. Request Adoption of the attached resolution is the first step in a multiple step process to evaluate the AUAR. The City will act as "responsible governmental unit" (RGU) and is ultimately responsible for submitting what is known as the "Environmental Analysis Document" and the "Mitigation Plan" to the appropriate agencies and the Environmental Quality Board. According to the letter of intent recently signed by Medtronic Inc., the company is responsible for obtaining environmental approvals in excess of 750,000 square feet of development. Mr. Hagmann's letter indicates that the long term master plan for the site will include capacity of at least 1 million square feet of office, but will have the flexibility to include as much as 1.6 million square feet of office, depending on future business needs. He also indicates that the size of the phase one building could range between 250,000 to 300,000 square feet in size. Medtronic has hired a team of consultants to prepare the master plan and the environmental review documents. City staff and Medtronic's consultants will be meeting on a regular basis as the appropriate documents are prepared. It is anticipated that the City would distribute the analysis and mitigation plan in mid to late December, with a public comment period ending on January 30, 1999. The City Council would than ultimately adopt the environmental documents by April 15, 1999. In addition to this approval, Medtronic must also obtain an indirect source permit for the site in order to meet the standards established by the Minnesota Pollution Control Agency regarding carbon monoxide emissions. The HRA will be retaining the services of Linda Fisher, of the Larkin Hoffman Law Firm, and Jim Benshoof, of Benshoof and Associates, to review Medtronic's work on these environmental approvals on behalf of the City. The resolution also assures that the City Council recognizes that all expenditures will be applied as assessments to the Erickson property at a rate of 125% (of the associated costs). The additional 25% is prescribed by Ordinance No. 1021, to assure recovery of administrative expenses. Background As you are aware, Mr. William Erickson, 650 Ely Street, appeared in Court on September 24, 1998. Mr. Erickson was found guilty of violating his probation. As a result, Mr. Erickson was sentenced to 15 days in jail. During those 15 days, Mr. Erickson was to contact his family to schedule a clean up event. He was atso required to have a dumpster delivered to his site. If he failed those benchmarks he would stay in jail for the remainder of a 180-day sentence. If he met those benchmarks, he had until October 28, 1998, to complete his site clean-up to the City's satisfaction. Mr. Erickson failed the first 15-day benchmark. No dumpster was present on site at re-inspection. 3.01 William W. All property owners have been notified that the utility bills are being certified to the County and have been given adequate opportunity to pay the bill. Jorgenson Mayor My name is Lawrence Berg and have lived at 1080 Hackmann Circle for 39 years. Until this summer, we have been able to drive up our driveway to our tuckunder garage satisfactorily. Now we cannot. The back end of my car drags on the street, usually when going up and occasionally going down. At an open forum meeting here last spring, I came prepared to request that my driveway not be shortened due to the steep incline. Before I could approach the Council, we were informed by a person on your platform that we need not worry about the rumors that the street might be made wider. He said the street would be no wider than it is now, just concrete curbs put in and at the same time some new pipelines and other improvements. However, the street is wider. I know that I lost at least 18 inches of driveway which has caused my problem. The vehicle I refer to is my 1997 Chev Lumina. A friend has a 1996 LeSabre which he cannot drive up without dragging. The same for my son's 1996 Dodge Caravan which drags both ways. These are normal automobiles, yet we risk damage by dragging on the street or driveway due to the sharp angle. Because of my health I am also very concerned about the accessibility of my snow plow service. The community looks nicer, the water now drains to the catch basin rahter �i in a puddle in from of my house as it did all those years, but my -���e�vay is totally unsatisfactory, I have talked to the city engineer and to �e assistant administrator but have had no satisfaction. I must have a driveway that is useable without damaging cars. I have tried to wait patiently for a satisfactory solution. I think I have waited long enough. Fridley, Minnesota 55432 SUBJECT: OBJECTION TO THE FULL AMOUNT OF THE ASSESSMENT AGAINST OUR LOT UNLESS TWO DEFECTS IN THE CONCRETE CURB and GUTTER IN FRONT OF OUR HOME ARE CORRECTED. FIRST DEFECT: A 4" long piece of concrete is missing from the top of the concrete curb at a spot near our east lot line. This spot is directly across the street from a point approximately 3 feet west of the east edge of the driveway at 5933 Hackmann Avenue.) The concrete iD this spot is more porous than that in the rest of the curb and has a lot of stone protruding through it - a sign of poor concrete - and this will make it vulnerable to deterioration and failure, especially from the chemicals, etc. that is placed on the streets in winter. Since we noticed this defect soon after the "reconstruction project" was completed, we believe that the concrete curb and gutter installation machine left the curb in this condition or that the concrete was defective at this spot and was broken out by the crews completing the boulevard work. SECOND DEFECT: Asphalt on top of the concrete ug tter in front of our driveway. We were the last home to have asphalt laid in the end of our driveway, so the asphalt crew cleaned out their asphalt laying machine in our drii►eway and since there was not enough asphalt left in the machine to cover the area that was to be covered, they had the asphalt delivery truck back over the gutter and dump asphalt from the truck into the end of our driveway. In doing this some asphalt spilled onto the concrete gutter and then the truck drove over it, leaving several areas covered with asphalt that the workmen apparently were not able or willing to take the time to remove, and we haven't been able to wash it off. We request that the City or the Contractor either remove this asphalt from the concrete or replace the concrete gutter. If this can't or won't be done, we object to paying for the asphalt affected sections of the concrete gutter at the end of our driveway. Jorgenson Mayor Bruce Lester s�� �� c�� r�� Fridtey, Minnesota 55432 Home Phone 612-571-5486 October 11, 1998 Dear Fridley City Council, Approximately 5 to b months ago a neighbor (Roger Kaye} distributed a letter needing the signatures of the Rice Creek Terrace residents affected by the creek bank stabilization project. At that time we were shown a map with our estimated footage per resident. My estimated footage was 40 feet. Along with many other neighbors, I thought the entire project wasn't needed and would destroy the natural beauty of the creek setting. However, many of us knew one way or the other it would probably happen so we signed the letter giving approval for the estima2ed footage per resident. The letter also stated an estimated dollar amount per foot not to exceed a certain amount per foot. This gave us all a good idea of what ow possible total assessment would be. Everything seemed to be ready and well organized and the projeci started. During the project every oace in awtule most neighbors would go down to the creek and see how the project was coming. I would do this myself from time to time. They did have a stake at 40 feet on my property and at one point in the project they completed my 40 feet and had the rock laid to the 40 feet. Then roughly 2 to 3 weeks later I walked down to the creek to see how they were doing and noticed they laid rock on my property way beyond the 40 foot stake. I asked the supervisor of the project from Park Construction why this took place and his answer was, "Well, we had extra rock in this area and thought it would blend in here" . He said nothing to the effect that either their engineer or Fridley's engineer decided it would be better for the creek bank to place more rock there. So I just figured that extra footage of rock would not be charged to me due to the fact that absolutely nobody asked me or my wife at all for approval of this extra footage . I guess I was wrong. After the entire project was completed, I got a letter stating my new footage was 97 feet. As soon as I got the letter I called Jon Haukaas and to ask what in the world was going on. He advised me he would check into it. I never heard anything and then I got another Ietter stating my total again was 97 feet and my total assessment value was now doubled from the earlier estimate of 40 feet. I then called Jon Haukaas again and he just kept saying that the 40 feet was only an estimate. Well, I decided at that point to check with every neighbor that was affected by the creek bank project and every single one except for me was given a higher estimate on their footage then what they were finally assessed at. I would of never signed the form if my estimate was at 97. Most of us were right when we thought the project would lessen the beauty of the creek. Now not only am I trying to be assessed at a higher footage which somebody else thought they had the right to decide what I would want for my property, I have to look at these ugly gabian baskets across the creek. I have tived in Fridley 33 years out of my 37 years of life. I am shocked that the employees of the city of Fridley would not get an approval from a resident when they know that the fina! cost value would be more then doubled to that resident. Somebody had to approve the extra 57 feet charged to my property. If it wasn't somebody from the city, then it was somebody from Pazk Construction. Whoever it was should be responsible for this extra assessment value. I would of never approved to add 57 feet when I didn't even want the whole project anyway. I see no dii%rence in this problem then if I were to give you an estimate to install a new furnace and air conditioner, get your approval, instatl a new system and then chazge you more then double of what I estimated it at. The only difference is that I wouldn't be in business too long doing business like that and you can still stay in business. I would understand if they didn't get an approval from me or my wife if the added footage was maybe 10 feet or so but to double my footage which more then doubles my assessment cost is way out of line especially for a city where my taxes pay the wages of the people who are suppose to be working for the residents. Once again I will state that I feel that the city of Fridley or Park Construction should be charged for this e�ra cost of approximately $1 t 40.00 dollars over and above my estimate at approximatety $800.00 dollars since either the city of Fridley or Park Construction were the ones to approve this with out any regard to my rights, thoughts or concerns on the matter. The final assessed cost of the project was $58,753.50 and the proposed assessment for each parcef is based on a rate of $11.50 per front foot. The assessments will be certified for a period of ten years at an interest rate of six and one half (6 1/2) percent. RESOLUTION NO. RESOLUTION ADOPTING ASSESSMENT FOR HACKMANN AVENUE/HACKMANN CIRCLE IMPROVEMENT PROJECT NO. ST 1998-1 WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for the street improvement of Hackmann Avenue and Haclanann Circle. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA: Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January, 1999, and shall bear interest at the rate of 6% percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from he date of this resolution until December 31, 1999. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 'The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoprion of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year.
