The Regular Meeting of the Fridley City Council was called to order by Mayor Lund at 7:35
p.m.

Make a Difference Day - October 27, 2001
Mayor Lund stated that millions of self-sacrificing individuals have touched and enhanced the
lives of millions by giving where there was a need, rebuilding what had been run down, teaching
where there was a desire to learn, and inspiring others.
RESOLUTION NO. 53-2001 OFFERING SYMPATHY AND SUPPORT IN RESPONSE
TO THE TRAGIC EVENTS THAT OCCURRED ON SEPTEMBER 11, 2001:
Mayor Lund stated that the destruction of the World Trade Center, the damage to the Pentagon
and the airliner crash in Pennsylvania struck a blow at the foundations of our country and the
world. The City of Fridley especially commends and thanks New York Mayor Rudolf Giuliani
for his leadership and gallantry under heart-rending circumstances, thereby enabling all people
throughout the world to begin the healing process.

Mr. Burns, City Manager, stated that the petitioners are seeking to adjust what was
originally perceived as the lot line between their properties. The proposed adjustment of
the rear lot line that separates these two properties corrects the accidental encroachment
of the retaining wall and brings it into compliance. The adjustment can be made without
violating any City Code ordinance. Staff recommended Council's approval with one
stipulation.

Mr. Burns, City Manager, stated staff recommended approval of the appointment of

replacing Carolyn Dreyer who has retired. Ms. Bobick worked as General Manager of

8. FIRST READING OF AN ORDINANCE AMENDING CHAPTER 213 OF THE
• FRIDLEY CITY CODE PERTAINING TO ALLOWING BARBED WIRE
FENCING IN CERTAIN ZONING DISTRICTS:
Mr. Hickok, Community Development Director, stated that this went to the Planning
Commission and received unanimous recommendation for approval. United Defense had
concerns regarding the barbed wire fence. Chapter 214 of the City Code allows exceptions to the
prohibition of barbed wire for certain instances. Council had concerns with having an 8-foot

minimum fence and the Planning Commission concurred. Staff incorporated each of the points
made by United Defense into the revised ordinance.
Councilmember Billings asked if the stipulations that United Defense recommended could be
more broadly revised as during the event of a national emergency when other industries may
have cause to use barbed wire. Number 4 on Page 18 of the agenda states that: "With City
approval during times of national emergency, industries may be authorized additional usage of
barbed wire to include temporary barriers made of barbed wire and barbed wire used to top
temporary security fences." Council would need to have an emergency meeting to act on this but
they recognize that in times of national emergency, United Defense would quite likely be using
additional barbed wire. This allows a broader opportunity for other industries with the same
types of concerns.
Councilmember Billings stated that sometime in the future, there may be some other type of
standard for barbed wire other than on top of a fence. He has noticed that staff has not addressed
the issue that it is on top of the fence rather than in addition to the fence.
Mr. Hickok stated that they felt that the language addresses the 8-foot height plus the bazbed
wire arms. Barbed wire is uniformly about 15 rather than 18 inches high on top of an 8-foot high
fence. Any additional language Council recommends, however, is acceptable.
Councilmember Billings stated that ordinances need to be for now and in the future. He would
have been more comfortable if it indicated that the barbed wire needed to be above 8 feet rather
than below 8 feet. He does not want a future misinterpretation of the ordinance.
Mr. Hickok asked Councilmember Billings if it would solve the dilemma if it was worded: "In
addition to an eight (8) foot fence, up to three (3) strands of barbed wire may be affixed to the
top of an eight foot fence, which is not to exceed 18 inches in height."
Councilmember Billings stated that it sounded close to what he wanted.
Mayor Lund asked if there were any hardships from having this worded the way it is right now.
Mr. Hickok stated that it was standard to have an eight-foot fence with barbed wire on top.
Mayor Lund asked if a variance process would be necessary if something was requested outside
of the proposed ordinance.
Mr. Hickok stated that it would be necessary.
MOTION by Councilmember Bolkcom to waive the reading and approve the ordinance on first
reading with the added language as recommended by Councilmember Billings. Seconded by
Councilmember Wolfe. �

9. RESOLUTION APPROVING THE COMPREHENSIVE PLAN FOR THE CITY
OF FRIDLEY AND AUTHORIZING STAFF TO DISTRIBUTE TO THE
METROPOLITAN COUNCIL:
Mr. Hickok stated that staff recommended approval of the resolution for the 2020
Comprehensive Plan and authorization to distribute the plan to local jurisdictions including the
County of Anoka, the Anoka County Library, adjacent cities and staff inembers. The plan
process started in 1997. The City was divided into seven planning districts with planning
meetings to start the process. Good input was received from neighbors and residents. In 1998
visioning meetings were held for folks to talk about the plan, and give advice as to how the plan
should be worded and how to develop certain elements. Staff took those comments to the
Planning Commission and City Council through the statutory process to a point where a draft
copy of the document was submitted to the Metropolitan Council. The Metropolitan Council
reviewed the document and made minor changes. The draft copy was sent back to the City for
final modifications. The Metropolitan Council has standard language for resolutions for
comprehensive plans. Standard language is that the City put the Comprehensive Plan into effect
with no plan modifications, which may seem contrary to their request to remove references to
Northtown LRT. If there is concern of Council, this plan is made in such a way that
modifications can be made before it is distributed. The stipulations and references for the sewer
chapter are outlined in staff's memorandum. When they talk about us not doing any sewer
expansions or reconstruction, they are talking about resubmitting our sewer chapter as our Tier II
Plan which will satisfy the guidelines. He said that if it is Council's wish to approve the plan,
staff will bring back the sewer chapter with a different resolution and cover memorandum asking
that to be approved as the Tier II Plan.
Councilmember Billings stated that he did not get a chance to review it. He asked if action
needed to be taken this evening.
Mr. Hickok stated that before the next sewer improvement for Stage 2 of the Medtronic Project
is installed, a Tier II Plan needs to be in place. That can be done quickly once the plan has been
approved. We are not anticipating that improvement would be this year, so there still is some
time.
MOTION by Councilmember Bolkcom to table the resolution approving the Comprehensive
Plan for the City of Fridley and authorizing staff to distribute to the Metropolitan Council.
Seconded by Councilmember Barnette.

10. RESOLUTION NO. ESTABLISHING A DECONSTRUCTION POLICY FOR
THE CITY OF FRIDLEY:
Ms. Jones stated that deconstruction is when buildings are systematically dismantled for the
purpose of building materials for reuse. This involves salvaging windows, flooring, timbers,
light fixtures, furnaces, hardware, cabinets, installation, and more. This resolution was

developed through the Fridley Environmental Quality and Energy Commission, which began
discussing this in April of 2000. The Commission gathered information for about a year before
developing into policy. The Commission had speakers come in, researched similar
deconstruction firms, and worked with the Fridley Housing and Redevelopment Authority to do
a pilot test run on a home on East River Road. Based on that information, they developed a
deconstruction policy and forwarded it to the HRA for feedback to see how they felt about this
being used in their Scattered Site Redevelopment Program. The Planning Commission also
reviewed it. After the HRA meeting, they decided to forward this on to the City Council. Staff
converted the policy into a form of a resolution for review. If the resolution is approved, the City
and the HRA would no longer automatically hire demolition companies to redevelop. Staff
would analyze the option of deconstruction for each project. If safety and cost concerns were too
great, then demolition would be used. Staff feels that the added cost of deconstruction would
balance the cost of the materials that could be salvaged. Staff believes this is an environmental
practice good for the City to look into. The resolution does provide for the City to provide
information to the public about salvage options for building materials.
Councilmember Barnette asked how much a deconstruction company would typically get out of
a$100,000 house. Is it worth their time?
Ms. Jones stated that the home on East River Road had over a two page list of items that were
salvaged including a furnace, washing machine, doors, windows, furniture, insulation, maple
flooring, among other things. She does not have the dollar value of those materials.
Councilmember Bamette asked if the deconstruction company guazantees a certain dollar
amount.
Ms. Jones stated that this was for a set dollar amount the City paid them, which was $60.00.
They got to salvage whatever materials they wanted and there was no dollar amount placed on it
at all.
Councilmember Barnette stated that he did not know if this was a really big item.
Councilmember Wolfe stated that sometimes there may be really valuable items to be salvaged
like copper, maple floors, furnaces, and it is amazing what could be there.
Mayor Lund stated that he does not see a down side to this.
Councilmember Bolkcom asked if we incur additional cost by the person we hire to tear down
the property.
Ms. Jones stated that was not our experience, we did not see an increase in the cost.
Mayor Lund stated that he does not perceive that this will be widespread, but it is a good
recycling option rather than sending everything to the landfills.
Councilmember Bolkcom asked if this method would delay any projects.

Ms. Jones stated that it can delay the project, but it should not be a significant delay. There is
somz coordination of Staff to schedule the deconstruction and demolition companies. A
deconstruction job is typically three days ma.Yimum.
Mr. Burns asked about people who would like to donate their own materials to be re-used by
someone else.
Ms. Jones stated that the City has information available about salvage opportunities and the one
agency, called the Re-Use Center, sells the materials at their store.

Policy for the City of Fridley. Seconded by Councilmember Wolfe.

11. INFORMAL STATUS REPORTS:
Mr. Burns stated that after the Council meeting, he would like to have an informal discussion
with Council regarding the contract for services for the Highway 6� project.
Councilmember Bolkcom stated that she would like to talk about the University Avenue fence
issue again and the winter sand cost. She thanked everyone who participated in the open house
last weekend at the Fire Station. After the tragedy that happened in Hutchinson, she hopes that
everyone has a working smoke detector in their homes.
Mayor Lund stated that he asked the Minnegasco representative about rising gas costs projected
for this winter. He was assured that the gas cost would be down this year and they have adequate
reserves.

INTRODUCTION
City Staff is requesting a text amendment to the City Zoning code that will allow barbed
wire fencing in certain zoning districts. This change will apply to Chapter 213,
Prohibition.
PLANNING COMMISSION ACTION
At the September 5, 2001, Planning Commission meeting, a public hearing was held for
ZTA #O1-07. After reviewing the staff report and hearing from City Staff, a motion was
made to recommend the approval o� the proposed zoning text amendment. The motion
passed unanimously.
Planning Commission had some questions regarding the required fence height and the
allowable number of strands of barbed wire to be used.
The Planning Commission would like the required fence height to be 8 feet for safety
reasons. City Staff supports the Planning Comrnission on this request.
Planning Commission asked how the 3 strands of barbed wire had been derived. Through
investigation conducted by City Staff of various sites, 3 strands of barbed wire are
standard throughout the City of Fridley.

CITY COUNCIL ACTION
On September 17, 2001, City Council meeting, a public hearing was held for ZTA #O1-
07. After reviewing the staff report and hearing from City Staff, a motion was made to
recommend the approval of the proposed zoning text amendment. The motion passed
unanimously. The City Council did have some questions regarding barbed wire fencing.
First, it was asked if an eight-foot fence would be the minimum height required. Eight
feet is the minimum/maximum height that the fence needs to be with barbed wire.
Second, it was asked if the ordinance would be contradictory to other City Codes. Staff
evaluated and determined that there is no contradiction to other language in the Fridley
City Code.
Lastly, there were concerns that the proposed wording was too specific and mainly
focused on United Defense. City Staff has broadened the language of the proposed text.
This change will allow other facilities that could possibly relocate to Fridley to be
included in the language.
At the October 8, 2001, City Council Meeting, a first reading was held for ZTA #O1-07.
After reviewing the staff report and hearing from City Staff, a motion was made to
recommend the approval of the proposed zoning text amendment. The motion passed
unanimously.
PLANNING STAFF RECOMMENDATION

AN ORDINANCE AMENDING CHAPTER 213 OF THE FRIDLEY CITY CODE
PERTAINING TO ALLOWING BARBED WIRE FENCING IN CERTAIN ZONING
DISTRICTS.
The City Council of the City of Fridley hereby finds, after review, examination and
recommendation of staff, that Chapter 213.03. Fences, of the Fridley City Code be amended to
allow barbed wire fencing in certain zoning districts and hereby ordains the following:
That chapter 213 is hereby amended as follows:
Chapter 213. FENCES
213.03. PROHIBITION
It shall be unlawful for any person to construct and maintain or allow to be constructed or
maintained upon any property located within the limits of the City of Fridley ��e
€er�e; a� any fence of inetal construction or otherwise, which is charged or connected with an
electrical current in such a manner as to transmit said current to persons, animals or things which
might come in contact with same.
In addition to an ei�ht (81 foot fence, up to three (31 strands of barbed wire, affixed to the top of
the (81 foot fence, which is not to exceed ei�hteen (18) inches in hei�ht, mav be used on standard
barbed wire arms, desi�ned specificallv for that pur�ose. These barbed wire anns mav be used in
the P, M-1, M-2, M-3. M-4, C-2, and C-3 districts, under the followingconditions:
l. Barbed wire is necessarv to protect �ublic utilities and defense contractor facilities.
2. Barbed wire mav be used in the side and rear vard of those industries that have approved
outdoor storage areas and on all sides of defense contractor facilities, meeting all code
requirements.
3. Barbed wire mav be used in the side and rear vard of those commercial
Qro�erties that have ap�roved outdoor sales lots, meetin� all code requirements.
4. With City approval durine times of national emer�ency, industries may be authorized
additional usa�e of barbed wire to include temporarv barriers made of barbed wire and
barbed wire used to top temporarv security fences.

UNATTENDED VEHICLES
THE CITY COUNCIL OF THE CITY OF FRIDLEY DOES ORDAIN AS FOLLOWS:
That Section 506.04 is hereby amended as follows:
506.04 Unattended Vehicles
No person shall stop, park or leave a vehicle unattended upon a street or
highway in the City for a period in excess of 24 hours.
2. No person all stop, park or leave a vehicle unattended upon a street or
highway in the City between the hours of 2:00 O'clock a.m. and 6:00
O'clock a.m. between the first day of November of any year, to and
including the first day of-�Wa�y April of the following year.

Attached you will find a resolution amending appropriations for the 2001 budget in
accordance with the City Charter.
The adjustments listed have arisen as a result various donations, unforeseen expenditures and
revenues, and reclassification of account codings. You have informally approved all
adjustments through the Budget reappropriation form. We request that the Council approve
the amendment of the attached budgets.

CERTIFICATION OF DELINQUENT UTILITY SERVICES
October 19, 2001
Attached is a resolution for the purpose of certifying delinquent utility accounts to the County for
collection with the taxes in the year 2002.
All property owners have been notified that the utility bills are being certified to the County and have
been given adequate opporiunity to pay the bill. The penalty shown on this resolution is in addition
to the regular penalties that accrue on the utility bills. Due to the economy and other factors outside
of the City's control, the number and dollar value of accounts has increased over last year; however,
we cannot be sure of the final count or dollar value until mid-November since property owners have
30 days after the adoption of the resolution to pay without penalty.

Subject: Contract with City Attorney
Attached is an agreement between the City of Fridley and Holstad & Knaak, P.L. C., and Fritz
Knaak for the services of City Attorney. The only change in the agreement was an increase in the
monthly rate from $5000 to $5,400, an increase of nine percent. The contract will be in effect for
a period of three (3) years.
Based upon the quality of work being done by Mr. Knaak, staff recommends approval of the
proposed legal services agreement. Thank you for your consideration of this matter.

AGREEMENT FOR LEGAL SERVICES
BETWEEN THE CITY OF FRIDLEYAND
HOLSTAD & KNAAK, P.L.C.
WHEREAS, the City of Fridley ("City"), a public body corporate and politic operating as a
home role charter city under the laws of the State of Minnesota and Located within the County of
Anoka, desires to have certain attorney services provided; and
WHEREAS, the council of the City selected the law firm of Holstad & Knaak, P.L.C. in
conjunction with Frederick W. Knaak, Esq., ("Attorney") to serve as city attorney and has
authorized a contract between the City and the Attorney;
Now, therefore, it is hereby agreed that this document by and between the City and the Attorney
shall be a binding obligation on behalf of all parties named.
I. Term.
This agreement shall be effective January 1, 2002. It shall be valid through December 31, 2005,
inclusive. It shall, however, be serverable as provided in Section X.
II. Scope of Legal Services
T'he following services shall be provided to the City by the Attorney as a matter of right under
the terms of this agreement.
a. Attendance at all regularly scheduled City Council meetings, and upon request by the
City Council, attendance at all special meetings of the City Council or of any board,
commission, or committee established by the City Council. In addition, the Attorney
shall meet with the Manager, Mayor, City Council or other city official or employee
as required.
b. Drafting and reviewing local ordinances, charter amendments, and resolutions as
requested by the city. Assisting with the codifying of ordinances and maintaining a
current City Code or book of ordinances.
c. Drafting correspondence on behalf of the city as requested.
d. Answering by telephone and e-mail questions of City officials and staff.
e. Meeting with and advising the Mayor, City Council, City Manager, department
managers, Planning Commission, and other designated groups or individuals, on
general legal matters.
f. Provide up to five hours per month of basic legal support services and up to five ours
per month of court time to the Fridley Housing and Redevelopment Authority
�
("HR.A"), including attendance at meetings of the HRA upon request. Additional
services to the HR.A shall be provided as outlined in a separate contract for legal
services between the Attorney and the Fridley HRA.
g. Reviewing municipal contracts, joint powers agreements, and other legal documents
as requested.
h. Representing the City in condemnation and eminent domain proceedings.
i. Representing the City in the acquisition or sale of public property, and the drafting
and assigning of deeds, easements, and other real estate or land-use documents.
j. Researching and submitting legal opinions and interpretations on municipal or other
related legal matters as required, including such topics as PELRA, employment law,
and veterans' preference issues.
k. Briefing City on proposed or newly adopted statues, rules or regulations as well as
any court decisions, agency rulings, or other official ruling or opinions, that could
have an effect on the City or the way it conducts business, and recommending the
appropriate amendments to ordinances, policies or other actions of the City n order to
comply with these changes in law.
1. Defending the City in all litigation, except in those cases where insurance companies
are required to provide defense or where the City chooses to hire specialized legal
talent.
m. Representing the City in workers' compensation proceedings.
n. Review bond and insurance requirements required by or for city contracts or
activities.
o. Preparing reports on the status of City litigation and other legal matters, at the request
of the City Manager.
p. Reviewing documents submitted by bond counsel involving the issuance of debt or
debt related instruments and providing opinions as required.
q. Assisting the City in the enforcement of City ordinances, including the prosecution of
cases arising out of the City's zoning, housing, rental housing and building codes.
r. Meeting with the City Manager on a regular basis, not less than quarterly, to review
all litigation and other pending legal matters of the City and provide a written report
of such litigation or other legal matters.

III. Fees.
The City shall compensate the Attorney at the rate of Five Thousand Four Hundred Fifty and
00/100 Dollars ($5,450) per month for all legal services provided in this agreement. In addition
to this monthly fee, the City shall pay the Attorney at the rate of Sevenry-Five and
00/1/OODollars ($75.00) per hour for each hour after the first ten hours in any one month for any
litigation on a case where the time spent on that individual case exceeds ten hours in the month.
Paralegal time spent on litigation billed at the hourly rate shall be billed to the City at the rate of
Fifty and 00/100 Dollars. For the purpose of billin�, all zoning, housing, rental housing and
building code prosecutions conducted in any one month shall be counted as one case for the
purpose of determining the ten-hour cap.
Matters involving the HRA shall be billed according to the contract between the Attorney and
the HRA except that court time shall not be billed unless the time in court spent on HRA issues
exceed five hours per month. Time spent with the HRA shall not be counted against the ten
hours of general litigation provided for under this agreement.
The flat monthly rate shall include the charges for long distance telephone calls up to Twenty-
Five and 00/100 ($25.00) per month, photocopying up to five hundred (500) pages per month,
and up to thirty (30) minutes of search time on Westlaw. Beyond these limits, billings shall be at
actual cost for long distance telephone calls, twenty-five cents ($0.25) per page for
photocopying, and Eight and 00/100 Dollars ($8.00) per minute for Westlaw seazches. All other
cists such as filing fees, court costs, witness expenses and faxes shall be billed to the City at
actual cost.
Hourly billings for the time shall be rounded to the nearest 1/10 of an hour (six minutes).
The Attorney shall submit a bill to the City on a monthly basis. This bill shall detail all time
spent working on behalf of the City with litigation time being separated from other general
matters. All charges made in addition to the established monthly chazge shall be clearly
documented. The precise format of the billing statement shall be agreed to by the City and the
Attorney.
IV. Responsible Attorney and Staff.
Frederick W. ("Fritz") Knaak shall be the primary attorney for the City. Mr. Knaak shall be
responsible for the performance of this agreement, although he may be assisted by other
attorneys or support staff in the firm. Mr. Knaak shall supervise all work performed on behalf of
the City.
V. Conflicts of Interest.
The Attorney shall not accept any client or project which would knowingly place it in a conflict
of interested with the services to be provided to the City under this agreement. If a conflict of
interest should develop, the Attorney shall be responsible for taking the necessary steps to

comport its representation of the City with the Lawyers Code of Professional Responsibility.
The Attorney shall be responsible for any additional costs incurred by the City in obtaining
additional legal representation of such representation becomes necessary due to a conflict of
interest.
VI. Assignment of Services and Agreement.
The Attorney shall not assign any interest or obligation of this Agreement without the prior
written consent of the City; provided, however, that it is agreed that if Frederic W. ("Fritz")
Knaak shall cease to be associated with the law firm of Holstad & Knaak, P.L.C., the City may
assign this agreement directly to Frederick W. ("Fritz") Knaak.
VII. Affirmative Action.
Because the City requires and follows a policy of Affirmative Action and will not tolerate
discriminatory acts, the Attorney shall not discriminate against any person on the basis of age,
sex, religious beliefs, political affiliations, or other protected classifications under federal, state,
or local laws or regulations.
VIII. Work Product.
All ordinances, resolutions, correspondences, and other documents or materials drafted for the
City by the Attorney shall, upon their completion, become the property of the City.
IX. Insurance and Indemnification.
Attorney agrees to maintain a valid policy of Professional Liability Insurance for the duration of
this agreement. The value of the policy shall not be less than the cap for municipal tort liability
as established by Minnesota Statutes.
Attorney further agrees to defend, indemnify, and hold mares the City, its agents and employees
against all causes of actions against the City or any of its agents or employees that arise from or
as a result of the Attorney's actions or advice under the terms of this agreement.
X. Severability.
The City or Attorney may sever the terms of this agreement upon sixty days written notice.
Failure by the City or the Attorney to comply with any of the terms of this agreement shall be
grounds for terminating this agreement, as shall e the City's dissatisfaction with the Attorney's
performance under the agreement. Upon termination of this agreement, the City shall only be
responsible for the monthly fee and any additional billings accrued as of the date of termination.
Further, the City expressly reserves its right to hire independent counsel on matters it determines
requires an attorney with more experience or expertise in a particular field. In such a situation,
the City shall remain responsible to the Attorney for the monthly fee provided under this
agreement along with any billings not related to the matter for which special counsel was

retained. The City shall only be responsible to the Attorney for extra expenses in relation to the
matter for which special counsel is retained if the City names the Attorney as co-counsel in the
matter or otherwise requests the Attorney's participation.
XI. Acceptance.
The terms of this agreement are hereby accepted ad made binding upon and between the City of
Fridley and the law form of Holstad & Knaak, P.L.C. in conjunction with Frederic W. Knaak.

Attached is an agreement between the City of Fridley and Newquist & Ekstrum, Chartered, and
Carl J. Newquist for the services of City Prosecutor. The only change in the agreement was an
increase in the monthly rate from $80.00 to $90.00. The contract will be in effect for a period of
three (3) years.
Based upon the quality of work being done by Mr. Newquist's office, staff recommends approval

AND NEWQUIST & EKSTRUM, CHARTERED
AND CARL J. NEWQUIST
City Prosecutor Appointment: Carl J. Newquist and his law office, Newquist &
Ekstrum, Chartered, 6401 University Avenue N.E., Fridley, Minnesota, 55432, are
appointed City Prosecutor for the City of Fridley.
2. Term of A�reement: Thirty six (36) months from and after January 1, 2002 to terminate
on December 31, 200�, unless otherwise extended by mutual agreement of the parties
hereto.
3. Duties and Responsibilities of the City Prosecutor:
A. Proximity being in essence hereof, the City Prosecutor shall maintain an office in
the City of Fridley.
B. Represent the City in all criminal proceedings and cases wherein the City is a
party, has jurisdiction, and/or has an identifiable interest therein, except those
cases arising under the City's zoning, housing, rental housing and building codes.
C. Prepaze files for court, including assembling witness lists, preparing subpoenas,
copying statutes or ordinances for court trials, etc. Request certified documents,
such as driver's records, motor vehicle records, prior convictions, orders for
protection, bank records, ordinances and other information required for court.
D. Prepare letters and notices associated with various court trials. These include
letters to victims, omnibus hearing notifications, and notices of change in time,
date or place of hearings.
E. Maintain records, including the court calendar, records of formal complaint
requests, records regarding the criminal history records from the BCA, records of
officer vacation schedules and court assignment schedules of the prosecutor.
F. Telephone conferences and maintaining correspondence with various agencies
including law enforcement agencies, courts, Minnesota correctional facilities,
victim/witnesses, defendants/defense attorneys, social workers, psychiatrists,
victim advocate representatives, hospitals, banks, insurance companies, etc.
Research statutes and/or ordinances for court cases, formal complaints, or as
requested by the Fridley Police Department or the City of Fridley.
G. Handling requests for disposition of detainer.
H. Maintaining active files.
Advise Council, City staff, and the Police Department of legal questions and
issues that relate to official City business.

Department as requested by the City Manager and/or the Director of Public
Safety.
Advise and attend such Council meetings and meetings of City commissions and
committees as the City Manager and/or Mayor may direct.

as the City Manager may direct.
Defend City employees, when applicable, in suits and claims arising from the
performance of official duties as the e City Manager may direct.
Conflict of Interest: The City Prosecutor shall not represent any individual or party in
any civil or criminal matter against the City of Fridley.
Compensation:
A. The City Prosecutor shall be compensated at the following rates:

B. The City Prosecutor shall be reimbursed for all expenses advances made by him
on behalf of the City such as fees and costs for court transcripts and filing. All
other expenses and costs of overhead such as dues, subscriptions, licenses,
insurance, secretarial services, etc., associated with the performance of legal
services shall be the responsibility of the City Prosecutor.
Assignment of Services and Agreement: The City Prosecutor shall not assign and
interest or obligation of this agreement without the prior written consent of the City.

MACTA Funding Request

The Minnesota Association of Community Telecommunications Administrators (MACTA) has
requested $485.44 from each of its members to assist in lobbying at the State Legislature this fall.
Attached is a letter from MACTA that provides more detailed information on their lobbying
efforts. Local control of cable television franchises has been a matter of great discussion at the
Legislature, with many legislators supporting legislation that would remove local control and
centralize control of cable at the State level. This could result in a loss of our cable television
franchise fee revenues and jeopardize the Institutional Network.
Staff recommends the money be appropriated to MACTA for lobbying efforts. Thank you for

We are writing on a matter of great urgency. The Legislative Committee and the Board
of Directors have determined that we will need to maintain a presence at the Minnesota
legislature for some years to come, and we want to continue to retain Spano & Janecek to
represent us there. The Board is in the process of developing a plan for funding this activity on
an ongoing basis to present to the membership at our annual meeting. In the meantime,
however, we must raise at least $12,000 immediately in order to retain the services of Spano &
Janecek. In order to do this, we are asking each of our members to contribute their fair share
of this amount.
Why do we think it's important to maintain a presence at the Leqislature? Although it is
unlikely that any of the telecommunications legislation introduced in the 2001 session will pass
in their entirety, there is still the strong possibility that their authors will try to move smaller
pieces of the bills. Both the Administration and Senator Steve Kelley remain committed to
centralizing cable franchise administration at the state level, and your franchise fees,
community television obligations and Institutional Networks are at risk. Similar legislation was
passed last year in the State of Florida, and we believe that there will continue to be efforts to
change Minnesota's telecommunications regulations. We believe strongly that the only way to
influence those efforts is to continue to forge relationships with key legislators and state
officials.
Whv not iust relv on the Leaque of Minnesota Cities lobbvists? The League has a small
team of lobbyists who must cover a wide range of issues for an even wider range of municipat
interests. They must necessarily spend the bulk of their time on the three or four issues the
League's membership deems most important. Unfortunately, in their policy development
process, the League's membership have rarely given cable and telecommunications issues a
top priority. As a result, the League staff, while they have been extraordinarily helpful, are
unable to devote the kind of time and attention to these issues that the MACTA membership
feels they deserve. (MACTA would not be the only League affiliate with its own lobbyist. The
Minnesota Municipal Utilities Association, for example, has long employed a lobbyist.)

What will Spano & Janecek be doing? As MACTA's lobbyists, they will continue to monitor
cable and telecommunications legislation, advise the Legislative Committee and the Board on
strategy relating to cable and telecommunications legislation, and then help to influence the
tegislative process by representing our interests to legislators and state officials. Equally important,
they are helping MACTA to develop positive relationships with legislators and state officials so that
we are involved at the beginning and not the end of the legislative process.
We know that you are at the end of your budget year. Nevertheless, we are asking you for
an additional $485.44 to ensure that we can continue to represent your telecommunications and
cable interests before legislators and state officials in St. Paul. Please send your check as soon

WHEREAS, Section 3.01 of the Charter of the City of Fridley requires
that the City Council meet at a fixed time not less than once each
month; and
WHEREAS, Section 3.01 of the Charter of the City of Fridley requires
that the Council shall meet at such times as may be prescribed by
resolution; and !
WHEREAS, it is the intent of the Council to comply with the open
meeting provisions contained in Minnesota Statutes 471.705 as

SUBJECT: Local Law Enforcement Block Grant
The City of Fridley has been selected to receive funds in the amount of $20,313.00 in
connection with the Local Law Enforcement Block Grant Program. This grant has a city
match requirement of $2,257.00 along with the below listed conditions.
1. On Thursday, October 4, 2001, an advisory board consisting of the recommended
agencies met to discuss the use of funds. The group supported the recommendation made
by the Police Department to apply the funds towazds the salary of a Youth Worker who
will work with Fridley High School, assisting the School Resource Officer as a resource
for at risk youth and families.
2. The public hearing notice was submitted for inclusion in the October 4 and 11 issues of
the Focus with the public hearing date scheduled for October 22, 2001. We do not
anticipate a large response to this proposal.
The Police Department has proposed that the expenditures for the 2001 Local Law
Enforcement Block Grant be utilized under Category One of the seven possible categories.
Category One provides partial salary for Law Enforcement personnel. Currently we do not
have any expenditures which would fall under the remaining six categories. Category One
will allow us to continue to have a Youth Worker at Fridley High School and Emergency
Social Service Intervention for the youth and families of Fridley.
Given the limited amount of funds available through this block grant and other grant funding
sources, as well as the completion of two research grants, we felt this was cunently the best "
use of these funds.
Staff recommends that Council hold the public hearing.

Notice is hereby given that the City of Fridley City Council will meet at 7:30 p.m. on October 22, 2001
to consider, and possibly adopt, the proposed assessment for the 2001 Nuisance Abatement.
Adoption by the council of the proposed assessment may occur at the hearing. The following area is
the area proposed to be assessed:

The proposed assessment roll is on file for public inspection at the Finance Office. The total amount
of the proposed assessment is $366.10. Written or oral objections will be considered at the meeting.
No appeal may be taken as to the amount of an assessment unless a signed, written objection is filed
with the clerk prior to the hearing or presented to the presiding officer at the hearing. The council may
upon such notice consider any objection to the amount of a proposed individual assessment at an
adjoumed meeting upon such further notice to the affected property owners as it deems advisable.
An owner may appeal an assessment to district court pursuant to Minnesota Statutes Section 429.081
by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of
the assessment and filing such notice with the District Court within ten days after service upon the
Mayor or Clerk.
The City of Fridley has adopted Resolution No. 14-1995 deferring special assessment payments for
senior citizens. The City Council may approve defeRal of payment of special assessments where the
payment of said special assessments constitute a hardship.

RESOLUTION ADOPTING ASSESSMENT
FOR 2001 NUISANCE ABATEMENT
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all objections to the proposed assessment for the 2001 Nuisance Abatement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of one year,
the first of the installments to be payable on or before the first Monday in January, 2002, and shall
bear interest at the rate of 6'h percent per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2002.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution. If such payment is not made, interest will be
charged through December 31 of the next succeeding yeaz.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.

interest will be charged through December 31 of the next succeeding year.
