Second Reading: Snow Removal Ordinance Amendment
PW02-086
An inconsistency was found in the City Code pertaining to overnight parking of vehicles
during the winter months. When the City Council adjusted the overnight parking ban end
date from May 1 to April 1, the change was made to Section 506.04 but not to Section 506.05.
The attached Ordinance corrects this oversight.
Recommend the Ciry Council approve the second reading of the ordinance amendment as
presented.

That Section 506.05 is hereby amended as follows:

506.05 SNOW REMOVAL - VIOLATION AND TOWING
1. During the winter months, commencing on the first day of November of any year,
to and including the first day of �'April of the following year, it shall be a
violation for any person to stop, park or leave standing a vehicle on any street or
highway in such a manner as to impede the plowing and/or removal of any snow,
ice, or waste on such street or highway.

Dissolution of the Human Resources Commission

We have debated the fate of the Human Resources Commission on several occasions. While we
have considered several alternatives, none of them has been viewed as appropriate for this
commission. In view of our discussions and in view of the Commission's perceived absence of a
meaningful role, it would seem appropriate to dissolve the commission. The attached ordinance
serves this purpose.
I have contacted the three current commissioners to let them know that this item is on Monday's
agenda.

Fridley Ordinance 102.01 adopts Minnesota Statute Chapter 419 by reference, which provides for
a Police Civil Service Commission. Chapter 419 was enacted in 1929 and has not been changed
significantly since that time. I believe that the intent of a Civil Service process was to create
standards that would provide for a testing process to insure that police officer positions were not
achieved by simple political appointment. The Civil Service Commission was also used to create
rules that provided for promotion, discharge, and suspension of police officers. This is an
honorable purpose but the law is outdated. State and Federal law provide the requirement to have
strict testing of all candidates and provide for protection against discrimination and favoritism. It
has been argued that the Civil Service Rules actually make it more difficult to diversify the
department. The rules also place us at a competitive disadvantage with other police departments
in hiring due to the extra steps.
Part of the problem is that there is an eligibility list that is established following a testing process.
This list is approved by the Civil Service Commission. The appointing authority then has the
ability to consider any 3 persons (by rank on the list) for any one position. If one of the
candidates is unfit (also defined by the statute and includes such issues as sobriety, etc.) it is
necessary to go back to the commission and have that person removed from the list. This all
takes time and during this time, other departments are hiring the candidates off the list. The other
issue is that definition of being unfit does not deal with competency. There have been several
times in the past when we have been left with 3 candidates that are sober, truthful, and of
reasonably sound moral character, but would are not make good candidates to be police officers
with the City of Fridley. Our option at that time is to test over and wait for that list to expire (at
least one year by law). The net effect is that we have gone long periods short of officers and we
often times lose the best candidates to non-Civil Service Departments.
`' The legislature was approached with the problems and rather than change the law, provided for a
reasonable method by which the City could abolish the Civil Service process. Prior to 1999 the
requirement was to hold a public referendum and require a 2/3 majority of those votes cast to
abolish the commission. In 1999 the Legislature provided for a unanimous vote by the governing
body (City Council in our case) by changing Minnesota Statute 419.16.

The request to abolish the Police Civil Service Commission was placed in this year's
Council/Commission Survey and was approved during that process and discussion. The Police
Civil Service Commission met on July 30, 2002, and unanimously approved a motion to abolish
the Civil Service Commission effective January 1, 2003. It should be noted that this request is
not a reflection on the current members. They have sen�ed in their positions honorably and taken
their responsibilities seriously. They also recognize that the Civil Service Commission is no
longer necessary to achieve the original goals and that it has in fact become an impediment to
recruiting and keeping the best qualified persons possible for the position of police officer with
the City of Fridley.
Staff recommends that Ordinance 102 be amended to remove the Civil Service Commission
effective January 1, 2003.

2003 City Calendar
Attached is a proposed 2003 City calendar which indicates City Council meetings and holidays.
In addition to the City Council meetings, conference meetings were scheduled during the months
of January, April, May, August and l�TOVember. Budget work sessions were tentatively set for
June 16 and October 20. We added "Meetings with Other Agencies" and scheduled them for
January 31, May 29, July 31 and October i0.
Staff recommends that Council approve the attached resolution and the 2003 calendar of City

RESOLUTION NO.
RESOLUTION DESIGNATING TIME AND NUMBER OF
COUNCIL MEETINGS FOR 2003
WHEREAS, Section 3.01 of the Charter of the City of Fridley requires that the City Council
meet at a fixed time not less than once each month; and
WHEREAS, Section 3.01 of the Charter of the City of Fridley requires that the Council shall
meet at such times as may be prescribed by resolution; and
WHEREAS, it is the intent of the Council to comply with the open meeting provisions contained
in Minnesota Statutes 471.705 as interpreted by the courts;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley that:
l. The Council will hold regular meetings in the Council Chambers of the Fridley
Municipal Center, commencing at 7:30 p.m. on the following Mondays in 2003:
January 6, January 27, February 10, February 24, March 3, March 24,
April 14, April 28, May 5, May 19, June 9, June 23, July 14, July 28,
August 11, August 25, September 8, September 29, October 13, October
27, November 3, November 24, December 8 and December 15.

Estension of the SACCC Joint Powers Agreement
November 1, 2002
At their October meeting (which I missed), SACCC voted to ask their membership to approve an
extension of their Joint Powers Agreement together with a modest increase in member
contributions. Please note the attached letter from Tim Yantos, a resolution providing for the
extension and a copy of the agreement.
I recommend that Council approve the resolution.

SUBJECT: Renewal of Joint Powers Agreement and Values Fi�st and SACCC
Coordinator Services for 2003-2004
At the October2, 2002, meeting of the Southem Anoka County Community Consortium (SACCC),
the consortium recommended that the participating SACCC members consider renewing the
current Joint Powers Agreement by extending the term to December 31, 2004. According to Article
8 of the current Joint Powers Agreement, "This agreement may be renewed for an additional term
of two years each by resolution of all of the governing bodies of the parties hereto, prior to the
expiration date of this agreement." I have attached a sample resolution you may wish to use to
allow for this extension.
The SACCC again recommends that a contract be continued for a 25-hour per week Values
First/SACCC coordinator. The consortium recommends a 25-hour per week coordinator of which
20 hours per week would be dedicated to the community values program and approximately five
hours per week for the SACCC. The consortium recommended that this contract position would
be for two years. The total cost for the position in 2003 would be $36,693 and in 2004, $37,794,

extension of their Joint Powers Agreement together with a modest increase in member
contributions. Please note the attached letter from Tim Yantos, a resolution providing for the

Coordinator Services for 2003-2004
At the October2, 2002, meeting of the Southem Anoka C�unty Community Consortium (SACCC),
the consortium recommended that the participating SACCC members consider renewing the
current Joint Powers Agreement by extending the term to December 31, 2004. According to Article
8 of the current Joint Powers Agreement, "This agreement may be renewed for an additional term
of two years each by resolution of all of the governing bodies of the parties hereto, prior to the
expiration date of this agreement." I have attached a sample resolution you may wish to use to
allow for this extension.
The SACCC again recommends that a contract be continued for a 25-hour per week Values
First/SACCC coordinator. The consortium recommends a 25-hour per week coordinator of which
20 hours per week would be dedicated to the community values program and approximately five
hours per week for the SACCC. The consortium recommended that this contract position would
be for two years. The total cost for the position in 2003 would be $36,693 and in 2004, $37,794,
which represents a three percent increase.
The foRnula used for2000-2002 drew down the budget reserve to hold down ourcosts. If we were
to use #hat same formula, we would be left with approximately $1,500 at the end of 2004. We must
raise ourcontribution to create a small $5,000-$6,000 budget reserve. The formula enclosed would
accomplish this end.

Section 3. It may make such contracts as the Board deems necessary and advisable to
make effective any power to be exercised by che Board pursuant to the provisions of this

Section 4. It may provide for any of its employees to be members of the Public
Emptoyees Redrement Associacion and may make any required employer contribution to [hat
organization and any other employer contributions which municipalities are auchorized or
required by law to make.
Secdon 5. It shall establish an annual budoet. It may invest or reinvest funds not
needed for curren[ operating expenses, if any, in the manner applicable by law to cities. It

Se�tion 3. At the organizacional meeting or as soon thereafter as may reasonably be
done, the Board shall decermine its procedures, including the time, place, frequency and

Approval of 2002 - 2003 Winter Snow Plan

We held our annual snow season kickoff lunch on 'I'uesday, October 8. We made sure all
personnel were familiar with their required duties and answered any questions.
Attached is the Snow Removal Operations Policies and Procedures with maps. This document
gives an overview of equipment, responsibilities, plowing and sanding policies, districts,
emergency plan reference and the responsibilities of other jurisdictions.
The other attachments include the FIL notice information that is updated during each snow
event, the snowplow district and equipment assignments, Emergency Snow Removal
Procedures policy, assignments and map and the Priorities on Sidewalk Plowing.
We will have some newer employees this year but they will be teamed with experienced
employees for the first several snow events.
To ensure the City has a reasonably defensible snow removal plan, I recommend the City
Council adopt this plan by motion for the 2002 - 2003 winter snow season.

SNOW REMOVAL OPERATIONS POLICIES AND PROCEDURES
The Fridley Public Works Department is engaged in a continuing effort to provide improved snow removal
services, and yet keep expenses in balance with the current budget appropriation. For street snow removal, the
City currently deploys 18 pieces of equipment, 11 major and 7 minor. Each of the 10 snowplow districts plus the
south industrial area has a major piece of equipment dedicated to clearing snow from its roadways. These 11
major pieces of equipment are made up of 5 dump trucks withone-way plows and wing plows, 1 dump truck and 2
pot patcher trucks with one-way plows and underbody plows, and 3 loaders with directional plows and wing
plows. SiY of these trucks are also equipped with sand spreaders for use when ice and slippery conditions exist.
The 7 minor pieces of equipment are used to supplement the major equipment and to clear cul-de-sacs, dead end
streets, improved alleys, municipal parking lots and concrete sidewalks. These 7 pieces are comprised of 5 4x4
pickups, 1 1-ton �s4 truck and 1 sidewalk plow/snowblower.
The Public Works Director and Superintendent of Public Works have overall responsibility for snow and ice
control operations. The Street Supervisor has direct responsibility for supervising the day-to-day operations, such
as determining �vhen to call out manpower, equipment needs, ordering materials, etc. The Street Supervisor, along
with the Superintendent, utilizes weather services and reports, police reports, citizen input and consults with the
Director when necessary to determine when to initiate the snow plowing operation.
Our pol icy is to begin snow removal operations after the snow storm has subsided, normally in the early moming
hours. Ho�vever, if the storm ends in late evening, the crews are called out in an attempt to clear redline collector
routes by morning rush hour. If a storm is predicted to last unreasonably long, or heavy accumulations appear
imminent, full snow plowing operations begin on the redline collector routes in eight districts whenaccumulations
become hazardous for driving. Based on different storm situations and severity levels, the starting time frames are
flexible. For blizzard or high wind storms, plowing does not commence until the storm subsides. For economy
purposes, weekend snow storms will be reviewed for impact and delay in starting times to minimize overtime
costs.
Whenever ice or slippery conditions develop, sanding crews are dispatched to the six sanding districts (see
attachment A- Sanding Districts). Sand and salt mixtures are spread over ice orslippery areas. The sand provides
an abrasive to help melt the ice. We are currently using straight salt in the Melody Manor, Rice Creek Plaza, Rice
Creek Terrace, Sylvan Hills, Hyde Park, Christie and Florence Park neighborhoods. Salt is less effective below 20
de�rees F, therefore, sand may be used to a limited degree in these areas if extreme cold follows an icing
condition. The Public Works "on call" employee upon notification of slippery conditions by the Police
Department is authorized to respond with up to two additional personnel to sand or salt slippery areas. If more
personnel are needed, the "on call" employee will notify the Public Works Superintendent or Street Supervisor of
the need for additional personnel.
When snow removal operations begin, redline collector routes are plowed first. (See Attachment B- Redline
Collector Routes map). It takes approximately 4 to 6 hours (depending upon the snowstorm) to complete these
routes. These streets have been declared redline routes because they allow residents and emergency vehicles faster
and better access to the highways and into all areas of Fridley.
The City is divided into ten snow plowing districts after the redline collector routes are plowed. (See Attachment
C- Snow Plowin� Districts map). In each district, there are four alternaring starting points. After each snow, the
startin`� points will change. It takes approximately 6 to 8 hours to complete snow plowing operations on the
remaining streets. This results in providing clean, safe streets 12 to 16 hours after an average snow storm.
Thrre zre 86 cul-de-sacs and 35 dead-end streets in Fridley. It takes considerable time before the smaller and
specializ_ed eqt�ipment can complete the cul-de-sac areas. A snowplow may complete the regular street and a
portion of the cul-de-sac area. The major portion of the cul-de-sac will be plowed by the special equipment within
the total time of the snow plowing operation.

Concurrcnt «�ith the plowing of the streets and cul-de-sacs, the sidewalks, improved alleys and municipal parking
lots are aiso plu���ed. We do not plow bikeways or asphalt paths, we only clear concrete sidewalks.
Cleanup operatiuns begin on the next normal working dayafter the snow removal operations have been completed.
This includes cul-de-sac clearing and hauling, intersection clearing, sidewalks, traffic light areas, bus stops, and
win�rin�� back en boulevards
Thc snu���bird � zhicles parked on streets during a snow storm create problems for snow removal operations. City
ordinance prohibits vehicles from parking on City streets from 2:00 a.m. to 6:00 a.m. and during any snow
removal operation from November 1 to May 1 of each year. There is currently a Zoning Text Amendment before
the City council to change the ending date of the Winter Parking Ban from May 1 to April 1. This ehange will
tal:� ef'fect by �he end of the year if there is no major opposition. Drivers report snowbirds to the Police
Deparmlent. Depending on available police personnel, tickets are issued, if the vehicle is not removed. Vehicles
tha� arc blockir:�r the street are towed away. Snowbirds that are still parked when cleanup operations begin are
to�� ed and impo��nded under the direction of police personnel:
The past nine �: ears, Park Construction, has supplemented the City of Fridley's plow crews in Industrial Districts 2
and =� �vith grad�rs. We will use them again this year.
For a major storm, over 9 inches, our alternate plan comes into effect. The City is sectioned into 9 districts (see
Attachment D- Emergency Snow Removal Plan) and the personnel are established into two 12 hour shift crews.

is oniy one pas� is made down the center of each street initially. Once all streets are opened, the crews then go
bari: anci start clzaring the roads full width. This continues until all the streets are cleared by rotating the crews
throush their shifts.

is black pacement and run teams down the highway as the snow storm progresses.

EMERGENCY SNOW REMOVAL PROCEDURES
��"z differentiate between a"normal snowfall" and what we would call an "emergency
snu�vfall." An "emergency snowfall" is a snowfall of 9 inches or more that is projected to falT
�, i�i;in a 24 hour period.
��"hen there is a projection of an emergency snowfall, the snow plowing procedure will begin
�� hen there is 6 inches of snow on City streets. The Police Department will have the
r��ponsibility for notifying the Public Works Department of the existence of 6 inches of snow
on the streets. �
Once the plowing for an emergency snowfall has been decided, Public Works employees will be
d:vided into two 12-hour shifts beginning at the time they are called out.
Each shift will consist of eight employees who will operate five dump trucks and three front-end
(c�aders. Each group of eight employees will be assigned to one 12-hour shift.
In addition to the eight employees assigned to each shift, another employee shall be assigned as
n�eded to address particular problems. He may, for example, be assigned to digging out cul-de-
sacs, plowing sidewalks, and plowing City parking lots.
7�h� storm and/or any �other circumstances surrounding the storm will dictate the use of any
a�iditional employees. These employees will also be available to assist the Police and Fire
I>epartment with emergency operations (i.e., police calls, medical and fire emergencies).
'Il�e Police Department will take the primary responsibility for responding to questions from
cici�ens. It was agreed that the Police Deparhnent personnel will be updated approximately
e� cry two hours. Personnel will keep maps and be responsible for plotting the progress of the
�now removal crews as reported.
6. 7 he Public Works Superintendenthas the responsibility for updating the recording machine on a
rcmote basis. Paul will provide information indicating the progress and general location of the
City's snowplows to provide callers with information regarding the City's snow emergency
operation.
As the plows are working during a major snowfall, they will make an initial pass in each
direction through redline streets and then residential streets. Efforts toward plowing curb to
curb will not be made until all streets have been opened to traffic. It is understood that there will
bc difficulties with cul-de-sacs and driveways being plowed shut on a number of occasions and

Installation of No Parking Signs

The Police Department has requested the installation of No Parking signs on the Universitv
Avenue East Service Drive through the "S" curve south of Osborne Road. Problems are
occurring through this section of roadway during certain times due to high attendance at
events by the adjacent businesses. The Engineering Department has reviewed the request and
the circumstances and agree with the Police Department's request.
In addition, No Parking signs were installed on one block on the south side of Gardena
Avenue between Tennison Drive and vlatterhorn Drive. This installation came as a result of
the neighborhood meetings regarding parking around Totino Grace High School. This area
was noted as having restricted sight lines that could be improved by removing parking from
this sectiori.
Recommend the City Council approve the installation of these No Parking restrictians.

The attached Chan�e Order No. 1 to 200`? �fiscellaneous Concrete Repair Project No. 344 is for
additional concrete work. Additional work was required due to several major sewer repairs in the
Flanner�� Park neighborhood, deteriorated curb and gutter in this year's sealcoat project area, and
settled concrete panels in the Innsbruck neighborhood.
The se�ver repairs alone in the Flannery Park neighborhood resulted in replacing 408 feet of curb and
gutter.
Engineering identifies and replaces deficient curb p: ior to sealcoating the streets on an annual basis.
:11so, Street Di�-ision personnel had identified curb and gutter that was damaged, missing, or settled
such that it �vas interfering with snow plowing operations. Snow plows can sustain damage due to
deFicient concrete curb.
Engineei�ing and Street Division personnel identified concrete panels needing replacement in the
Innsbruck neighborhood. More concrete panels had settled or had deteriorated than anticipated.
Panels that exhibited the worst conditions were selected for replacement. Other panels in need of
replacement were not selected at this time due to budget restraints, but will be considered next year
under the 2003 contract.
In an attempt to keep this project under budget, Engineering staff kept some of the quantities to a
minimum such as sidewalk replacement. This was decided when it became apparent that the sewer
breaks were resulting in concrete driveways and curb and gutter being replaced.
The City has collected �8,110.30 in escrow for concrete work from property owners. Most of this work
included the replacement of curb and gutter for driveway entrances throughout the City.
The net cost of Change Order No. 1 is � 10,544.06 for a revised contract amount of �74,045.31.
Recommencl the City Council approve Change Order No. 1 in the amount of �10,544.05 to Ron Kassa
Construction.
