RES 2003-34 - 00002339Resolution No. 34 -2003 RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT, CPA 02 -01, TO CHANGE LAND USE DESIGNATION FROM PUBLIC /SEMI - PUBLIC TO MULTI- FAMILY RSIDENTIAL IN THE CITY'S COMPREHENSIVE PLAN, GENERALLY LOCATED AT 6160 FIFTH STREET NE WHEREAS, the Planning Commission held a public hearing on Comprehensive Plan Amendment, CPA 02 -01, on September 4, 2002 and recommended approval; and WHEREAS, the City Council also conducted a public review of the Comprehensive Plan Amendment at their September 23, 2002, City Council meeting and denied the amendment at their October 14, 2002, meeting; and WHEREAS, that decision then became the subject of a lawsuit filed against the City on behalf of the Brandes Place Partnership; and WHEREAS, the League of Minnesota Cities Insurance Trust retained outside attorneys to advise and represent the City and those attorneys strongly recommended that the City enter into mediation with the Partnership, in an effort to protect the City from a great risk of substantial financial liability; and WHEREAS, on June 19, 2003, during mediation conducted by former St. Paul Mayor George Latimer, the parties reached an agreement that resolved the litigation and that settlement has been formally adopted by the City Council and by representatives of the Partnership; and WHEREAS, the Metropolitan Land Planning Act (MN Statute 473.851- 473.872) requires that local government units prepare and submit minor amendments to their Comprehensive Plan to the Metropolitan Council; and WHEREAS, a minor amendment is defined as changes to the future land use plan where the affected area is small or where the proposed future land use will result in minor changes in metropolitan urban service demand: changes in the urban service area involving less than 40 acres; change to plan goals and policies that do not change the overall thrust of the Comprehensive Plan; and WHEREAS, the City has determined this to be a minor amendment. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Fridley hereby approves the Comprehensive Plan Amendment, CPA 02 -01.
