A RESOLUTION ORDERING FINAL PLANS AND SPECIFICATIONS AND ESTIMATES OF
COSTS THEREOF: NEIGHBORHOOD STREET IMPROVEMENT PROJECT NO. ST. 2005-1
WHEREAS, the City Council has retained the services of Short, Elliott,
Hendrickson, Inc. for the design and construction contract administration of
our 2005 neighborhood street improvement project, and
WHEREAS, Resolution No. 2004-39 ordered the preliminary plans,
specifications and estimates of the costs thereof for the improvements in
this project, and
WHEREAS, Resolution No. 2004-40 received the preliminary report and called
for a public hearing on the matter of the construction of certain
improvements for this project, and
WHEREAS, a public hearing was held on September 27, 2004 regarding this
project, a�d
WHEREAS, the City Council has determined a need to reconstruct the streets
to maintain them in a safe condition and at a reasonable cost.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley,
Anoka County, Minnesota, as follows:
1. That the followinq improvements proposed by Council Resolution 2004-
are hereby ordered to be effected and completed as soon as reasonably
possible, to-wit:
Street improvements including qrading, stabilized base, hot-mix
bituminous mat, concrete curb and gutter, storm sewer system, water and
sanitary sewer systems, landscaping and other facilities located as
follows:

In order to be etigible to use our Municipal State Aid System funds on our neighborhood
streets, MI`I rules 8820.1800 requires the City Council request this use by resolution.
The attached resolution requests disbursement of the City's population portion of the Municipal
State Aid System construction funds for the proposed lyeighborhood Street Improvement Project
l`10. ST. 2005 - l.
Recommend the City Council adopt the attached resolution for submittal to the State Aid
Office.

RESOLUTION NO. 2004 -
RESOLUTION REQUESTING MUNICIPAL STATE AID SYSTEM CONSTRUCTION FUNDS FOR
OTHER LOCAL USE
WHEREAS the City of Fridley receives Municipal State Aid System (MSAS) funds
for construction and maintaining 20� of its City streets, and
WHEREAS 22.9 MSAS miles are currently authorized and have been improved to
State Aid standards and are in an adequate condition that they do not have
needs other than additional surfacing, and
WHEREAS the City currently has 88.2 miles of local streets that require
maintenance and upgrade, and
WHEREAS it is authorized by MN Rules 8820.1800 to use part of the MSAS
construction appropriation of our City's State Aid allocation on local streets
not on the approved State Aid system, and
WHEREAS it is proposed to systematically install concrete curb and gutters and
storm sewer system for improved surface water drainage and additional strength
to the streets for traffic survivability, and
_ WHEREAS it is proposed to use a portion of the City's population allocation
funds to upgrade.local streets, and
- WHEREAS the City of Fridley has identified the following streets for inclusion
in its 2005 Neighborhood Street Improvement Project No. ST. 2005 - l, towit:

WHEREAS the majority of these streets have insufficient strenqth and poor
surface drainage, and
WHEREAS the City indemnifies saves and holds harmless the State of Minnesota
and its agents and employees from claims, demands, actions or causes of action
arising out of or by reason or matter related to constructing the local street
as designed, and
WHEREAS the City further agrees to defend at its sole cost any claims arising
as a result of constructing the local street, and
WHEREAS the final approval of the State Aid for Local Transportation Division
is therefore required.
NOW THEREFORE BE IT RESOLVED that the City of Fridley, Anoka County, Minnesota,
requests the release of MSAS funds for the upgrade and reconstruction of City
municipal streets, identified as Neighborhood Street Improvement Project No.
ST. 2005 - 1.

or is presented to the presiding officer at the hearing. The council may, upon such notice, consider
any objection to the amount of a proposed individual assessment at an adjourned meeting, upon such

This letter is an appeal to my property at 6573 Arthur Street N.E., Fridley, Minnesota
55432. I should be exempt from this fee as I ha.ve absolutely no access to this newly
tarred a11ey. I have a front entry driveway on Arthur Street and a fenced in backyazd that
would not allow me to use the newly paved a11ey. I believe as a 30 year plus owner of
this property and have never yet used this alley that I should be exempt from the
proposed $1,422.40 fee. I believe this a11ey should be fee'd to home owners that have
their individual driveways used in the alley. I have absolutely no access to my driveway
through the alley. Once again, I ha.ve NEVER used this alley in my 30 Plus years of
being a Fridley homeowner.
Thank you very much for you consideration of my plea for this very expensive fee of
$1,422.40. Once again, please consider my property for being exempt from this fee. I

Atta.ched is the Public Hearing Notice for the assessment for the 2004 Nuisance Abatement.
The Public Hearing Notice was published in the Focus newspaper on September 16, 2004 as required
by State Statute.
The public hearing is in regard to two abatements done during 2004, in which no payment has been
received for the work that was done.
The first abatement is for the installation of a sump pump line connection located at 7699 Highway
65. This has been set up as a one-year assessment in the amount of $9,717.00
The second abatement has to do with mowing of nuisance weeds. The property is located at 7601

being mailed to all property owners.
Written or oral objections will be considered at the meeting. No appeal may be taken as to the
amount of an assessment unless a signed, written objection is filed with the clerk prior to the hearing
or is presented to the presiding officer at the hearing. The council may, upon such notice, consider
any objection to the amount of a proposed individual assessment at an adjourned meeting, upon such
further notice to the affected property owners, as it deems advisable.
An owner may appeal an assessment to district court pursuant to Minnesota Statutes Section 429.081
by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption
of the assessment and filing such notice with the District Court within ten days after service upon the
Mayor or Clerk.
The City of Fridley has adopted Resolution No. 14-1995 deferring special assessment payments for
senior citizens. The City Council may defer the payment of special assessments for any homestead
property owned by a person 65 years of age or older for whom it would be a hardship to make the
payments.

Subject: Curbside Recycling Contract Extension
INTRODUCTION
On August 9, 2004, the City Council directed staff to further negotiate an extension to the existing curbside
recycling contract for weekly, 2-sort service with a 100% revenue shaxing feature added. The City Council's
decision was a difficult one, because the existing contractor, BFI, had proposed to continue with their current
service at $2.18/household/month, without revenue sharing for the frst year of the extension and only a 2%
annual increase in subsequent years. Both options, with and without revenue sharing, appeared to be very
attractive. Revenue sharing, however, offered an intriguing opportunity that would require further
negotiation.
Following Council's directive, staff further negotiated, and now fully believes that extending BFI's service
contract with the addition of a 100% revenue sharing feature is the most advantageous option available to the
City. Staff recommends that the City Council approve the attached amendment to their Agreement with BFI
for Curbside Recycling Services. This will extend the City's contractual agreement for the existing level of
service, including 100% revenue sharing, for the next five years.
BACKG RO U N D
Staff researched contract rates in Anoka, Hennepin, and Ramsey County communities, and found that the
City's existing contract rate is lower than what most all other communities are paying — even for service that
is only every other week collection. This meant that soliciting requests for proposals from other companies
could actually result in significantly higher prices.
Analysis of BFI's 100% revenue sharing alternative option to extend the contract showed that the City could
potentially obtain significant funds that could be used to provide residents additional recycling services that
the City could not otherwise fund. The revenue sharing option is more costly, at $2.40/household/month,
resulting in about a five and a half percent increase to resident's recycling service fees on their utility bills
each of the next two years. Recycling service rates on utility bills would need to increase from
$6.06/household/quarter to $636/quarter in 2005. This is an increase of $1.20 for the year 2005. Each
subsequent year of the 5-year contract, the fee will be increased by $.OS/household/month ($2.45/hh/mo
[2006], $2.50/hh/mo [2007], etc.).
Should the question on the ballot regarding fees fail on November 2, the City would only be able to increase
the utility billing recycling fee 1.7%. The City would then need to subsidize the Soiid Waste Abatement
Program Fund, which is a special revenue fund, from the General Fund about $8,500 in 2005 to make up the
difference between the contract fees and payments received from residents. Staff believes this is a sound risk
to take considering we have the potential to obtain revenues of about $100,000 per year. The value of the

recyclable commodity revenues can be used to provide a variety of special recycling drop events or
educational projects at the City's discretion.
In subsequent negotiations for a contract extension agreement with BFI for 100% revenue sharing, staff was
not convinced that the City was obtaining the best possible commodity pricing under the current (at that
time) negotiated agreement. Considering that over $100,000 in annual revenues was at stake, staff hired
commodity experts/contract consultants, R.W. Beck, Inc. The staff of R.W. Beck guided City staff through
final negotiations that have resulted in a more detailed contract amendment (attached), which offers the City
the best possible commodity pricing and establishes a sound foundation of references and indices similar to
what the City of Minneapolis recently negotiated for their recycling contract.
The negotiated amendment also establishes criteria for how the Service Exchange Fund would operate. The
Service Exchange Fund is the fund that will be used to initially accumulate the City's portion of the
revenues. Those revenues then will be used to give additional recycling services back to the community.
Finally, new language was also added to allow the City to collect liquidated damages, if necessary, and to
prevent the contractor from mixing all materials into a single sort without approval from the City.
All parties involved, including the City Attorney, have agreed to the language in the attached contract
amendment. City staff is confident that we have negotiated the best possible recycling service contract
amendment for the City.
RECOMMENDATION
Extending BFI's service contract with the additional 100% revenue sharing option is the most advantageous
option available to the City. Staff recommends that the City Council approve the attached Amendment 2 to
the Agreement with BFI for Curbside Recycling Services and authorize the Mayor and City Manager to sign
the agreement.

Amendment 2 to Agreement for Curbside Recycling Services
This agreement is made on the day of , 2004 between the City of Fridley, Fridley,
Minnesota, ("City") and BFI Waste Systems of North America, Inc. ("Contractor").
WHEREAS, Contractor is in the business of collecting recyclables,
WHEREAS, City desires Contractor to collect recyclables from the City's single family through 12-unit
multiple dwellings in accordance with the terms of an Agreement dated February 22, 1999, with the
following amendments:
NOW, THEREFORE, the City and Contractor agree to replace the following paragraphs in the original
agreement as follows:
1. Contractor/Citv Requirements. This agreement defines the requirements of the City of
Fridley's Curbside Recycling Program to all Certified Residential Dwelling Units (1-4
units) and Multi-Unit Dwelling Units (5-12 units). The City has identified 8,347
Residential Dwelling Units, defined as 1-4 unit buildings. The City has identified 888
Multi-Unit Dwellings, defined as 5-12 unit buildings. The City will re-certify these
numbers in July and December each year or whenever there is a change greater than 20
units. These units will be serviced as specified herein. Additional Residential and/or
Multi-Unit Dwellings may be certified by the City for service under this Agreement. The
Contractor shall also provide weekly collection services to the Fridley Municipal Center,
Springbrook Nature Center, Public Works Garage, and the Municipal Liquor Stores.
3. Method of Pavment. The Contractor shall submit itemized invoices according to the
rates specified in Ezhibit A to the City on a monthly basis. Monthly invoices must
include a Recyclable Commodity Market Value Report according to the format shown in
Exhibit B for the amount of recyclables collected and processed during the previous
month. Invoices so submitted shall be paid within thirty (30) days of receipt by City.
The percentage that each recyclable material represents of the total weight of recyclables
collected each month will be predetermined by the schedule listed in Eghibit C. The
Contractor may not adjust the weight composition of the recyclable materials from the
composition presented in Exhibit C more than once per yeaz without agreement by the
City.
The City shall accumulate credit from the net proceeds of the sale of all recyclables
marketed each month in a Service Exchange Fund. The additional and accumulative total
value of the Service Exchange Fund shall be reported to the City by the Contractor on
each monthly statement or invoice. The City may choose to use the value accumulated in
the Service Exchange Fund in exchange for a variety of recycling services (examples of
which are enumerated in Exhibit D), may request a cash payment of all or a portion of
the total accumulated present value in the Service Exchange Fund, or may apply the cash
value of the Service Exchange Fund as a credit to the City's monthly invoices totals from
the Contractor. Representatives of the City and Contractor will meet annually at least 90
days prior to April 1, the contract anniversary date, to discuss and establish a work plan
which identifies selected services, timeline, and value of services the service exchange
fund will be applied toward in the upcoming contract year. The City has the sole
discretion to obtain competitive price quotes from mutually-agreed upon vendors or
subcontractors. The City may impose liquidated damages of up to $1,000 per incident for
failure to timely implement a service project per the work plan mutually agreed to by
both parties at the annual meeting. The parties agree that the circumstances of
performance on this contract, and any breach thereof, may not lend themselves to an
immediate and determinable measure of damages in the event of Contractor default. The
parties expressly agree that liquidated damages in the amount of one thousand dollars

($1,000.00) per incident in the work plan or breach is a fair and appropriate means of
calculating losses in this agreement in a manner that would adequately and fairly
compensate the City in the event of any such breach. This figure is not intended to be a
cap of any such damages, and liquidated damages may accumulate in increments of
$1,000.00 beyond that amount to the extent that the occurrences of more than one
incident would justify the imposition of those additional amounts. Uses in addition to
those items listed in Exhibit D for the Service Exchange Funds may be completed by the
Contractor upon mutual agreement on cost and terms by each party. The City shall be
allowed to accumulate revenue value in its Service Exchange Fund for up to twelve
months past the end of each contract year anniversary date, which is April l. Values
accumulated in the Service Exchange Fund must be drawn down to approximately $1,000
each contract year.
Net proceeds is defined as the revenue received from the sale of all recyclable materials
minus processing charges, which are labor and equipment charges made by the
Contractor, which handles the processing for sale and sale of recyclables. The per ton
processing fee and recyclable commodity values will be based upon the indices
enumerated in Exhibit E, attached and made part of this agreement. If any of the market
indicators on Exhibit E become unavailable during the term of the contract, then the City
and Contractor will negotiate a mutually agreeable altemative(s),If the cumulative net
proceeds of all combined recyclable commodities in a given month is a negative value,
the City's Service Exchange Fund will not be deducted from but will receive a credit of
zero for that particular month.
12. Preuaration. The Contractor shall collect recyclables in a 2-sort system as explained to
residents in the annual City/Contractor prepared informational mailer. The Contractor
will not be pernutted to collect recyclables in a single-sort system curbside without a
written request from the contractor and prior approval from the City.
28. Term. The term of this Agreement shall be extended to be April 1, 2005 to March 31,
2010, the date of the signature by the parties notwithstanding. The parties may, by mutual
agreement, cause this Agreement to be extended twice for up to an additional two (2)
years after the forgoing expiration date, subject to the right of either party to terminate for
cause by ninety (90) days written notice as provided in the following pazagraph.
Up to 60 days prior to the contract anniversary date of April 1, each year, during the term
of this agreement, the City for any reason will have the right to renegotiate this
amendment and choose not to accept recyclable commodity revenues under the reduced
costs per household per month listed in Exhibit F upon written notice to the contractor.
Transition to a non-revenue-sharing contract arrangement may only occur on the
anniversary date of April 1. In addition, the City may return to the revenue sharing price
structure under the contract pricing listed in Exhibits A and E upon written notice to the
Contractor up to 120 days prior to the contract annual anniversary date. The City and
Contractor may mutually agree to transition between a revenue or non-revenue shaxing
contract arrangement at anytime during the contract term.

First Year Curbside Recycling Composition
This annual schedule shall be based in part upon the Contractor's past 24-month rolling commodity
average measured for the City of Minneapolis based on composition as collected. Adjustments to these
commodity percentages may only be made annually on the anniversary date of the contract based upon
the most recently prepared 24-month rolling commodity average conducted for the City of Minneapolis.
The "trash contamination" composition estimate shall be based upon the Contractor's audits from similar
residential collection routes. The contractor must provide supporting documentation for the trash
contamination estimated figures from similar routes annually to the City, however, the City must approve
any change to the trash contamination percentage during the term of this agreement. The City reserves the
right to require the Contractor to conduct a City-specific composition analysis, including field sorts, as a
future task paid for by the Service Exchange Fund.

Revenue Sharing Price Schedule
This Revenue Sharing Schedule provides for the contxactual terms for net revenue payments from the
Contractor to the City as agreed by both the City and Contractor. The terminology and methodology
follows generally accepted recycling industry standards, commodity specifications, and pricing protocols
unless otherwise noted. The following definitions shall apply to this Revenue Sharing Price Schedule.
Commodity — Individual material, including specific industrial grade, as defined by this
Agreement.
HDPE — Colored - Plastic bottles made from high density polyethylene resin with pigment or
coloring (e.g., laundry detergent and automatic dishwasher soap bottles, etc.).

RESOLUTION ADOPTING ASSESSMENT FOR THE
2004 STREET IMPROVEMENT PROJECT NO. 2004-1
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all objections to the proposed assessment for the 2004 Street Improvement Project
No. 2004-1.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of ten years,
the first of the installments to be payable on or before the first Monday in January, 2005, and sha11
bear interest at the rate of 6'/z percent per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2005. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city
treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31
of the year in which such payment is made. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal ta�ces.

This project included 15 properties. The assessment will be for 10 years at a rate of 6.5%.

WI�REAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all objections to the proposed assessment for the Alley Paving Project No. 2003-3.
NOW TI�REFORE, BE IT RESOLVED BY TI� CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and sha.11 constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of ten years,
the first of the installments to be payable on or before the first Monday in January, 2005, and sha11
bear interest at the rate of 6'/2 percent per annum from the da.te of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2005. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city
treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31
of the year in which such payment is made. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments sha11 be collected
and paid over in the same manner as other municipal taxes.

WHEREAS: The City of Fridley has operated Springbrook Nature Center for over 29 years;
WHEREAS: The Springbrook Nature Center has provided thousands of people with an
opportunity for rel�ation, education, volunteerism, health improvement, and community
involvement;
WHEREAS: The City Council of Fridley has been asked, and has placed a special levy
referendum on the November 2, 2004 ballot. This vote will determine if the voters of Fridley
want to establish a special tax levy and continue to pay for the Naturalist operations at
Springbrook Nature Center;
WHEREAS: There have been several indications of what the Fridley City Council will do if the
referendum does not pass;
WHEREAS: Several of these indications are merely speculation and "best guess" on the part of
the makers;
NOW THEREFORE BE IT RESOLVED: That the City Council of the City of Fridley shall
make reasonable efforts to maintain a paid, or unpaid, volunteer coordinator for the purpose of
aiding the numerous citizens that wish to volunteer for the many tasks at Springbrook Nature
Center,
BE IT FURTHER RESOLVED: That the City Council of the City of Fridley sha11 make
reasonable efforts to provide public access to the restrooms at Springbrook Nature Center,
BE IT FURTHER RESOLVED: That the City Council of the City of Fridley shall make
reasonable efforts to preserve and maintain the educational displays that exist in the Interpretive
Center.
BE IT FURTHER RESOLVED: That the City Council of the City of Fridley shall make
reasonable efforts to make the Interpretive Center available for special functions and special
occasions.
BEIT FURTHER RESOLVED: That the City Council of the City of Fridley shall make
reasonable efforts to maintain the trails and paths within Springbrook Nature Center for the
benefit of the Citizens.
BE IT FURTHER RESOLVED: That the City Council of the City of Fridley, without
hesitation, states that there are no current or pending plans being considered for a change of use
of any of the acreage at Springbrook Nature Center, other than those pending improvements to
same, and the long range Capital Improvement Strategies of the Springbrook Nature Center
Foundation. �
