Notice is hereby given, that the Board of Review of the City of Fridley, County of
Anoka, Minnesota, will meet at the City Hall Council Chambers in said City at 7:00 p.m., on
Monday, April 10, 2006, for the purpose of reviewing and correcting the assessment of said city
for the year 2006. All persons considering themselves aggrieved by said assessment, or who
wish to complain that the property of another is assessed to low, are hereby notified to appear at
said meeting, and show cause of having such assessment corrected.
No complaint that another person is assessed to low will be acted upon until the person so
assessed, or his agent, shall have been notified of such complaint.

I would like to register a concern, a complaint and a suggestion regarding the increased taxes 1
am paying on the two parcels of developed land I own in Anoka County.
1 can understand inflationary increases (About < 2%% annually in Minnesota), but the tax
increase on my combined parcels over the last 6 years of 52.61 %(or 4.60% annually) seems
more than exorbitant. The County's vafuation of the properties has also increased by 69.46°� (or
6.68°� annually).
When property values decreased, I did not see a decrease in my taxes or appraised evaluation.
Increases taxes for additional or improved services would be appropriate. However, I have
observed none of these.
I am a small business owner and several years ago moved my operations out of Anoka Country
partly because of the inequitable tax situation.
I finally rented this location to another small business owner. And quite frankly, he can not
continue to afford the increased expenses of doing business in this county. (I have even
subsidized him by not passing the total real estate tax increases on to him).
I see the county providing financial and other incentives to "new" businesses locating in the
county. Tax increment financing for new business is over $1,800 of my tax bill. BUT isn't it about
time the county started providing incentives (via tax stabilization, improved and increased
services) to the existing business community so they will STAY? Where is my part of my $1,800?
V►.m�i action can I take to further address ihis issue? Tax reaates wili not resolve the problem but
may help to encourage small businesses to remain in the community.
I know that I can no longer afford to live or work here. Is there something my tenant can do to
help himself or do I need to let him move on to a more favorable taxing environment?
Please do not let this letter fall on deaf ears. I �eed to know what you plan to do in the short and
long term to help the small business owners of this county. I grew up in the generation when we
expect answers, maybe not what we want to hear, but at least answers.
And please don't just tell me I should attend the tax hearings. This is a much larger problem than
can be solved during an individual property tax session.
Please let me know if Commissioner Jim Kordiak is my elected representative, so that 1 can
continue to address my issues and concerns with him?

Dr. Burns, City Manager, stated they have received two bids and opened them on March 22.
The low bid was submitted by Concrete Idea, Inc. in the amount of $76,000. The low bid is
within budget and staff is recommending Council award to Concrete Idea, Inc.
THIS ITEM WAS REMOVED FROM THE CONSENT AGENDA AND PLACED ON
THE REGULAR AGENDA.

Dr. Burns, City Manager, stated five bids were opened on March 22, 2006. The low bidder was
Insituform Technology USA, Inc., of Chesterfield, Missouri, in the amount of $78,503. He
believed they had $80,000 budgeted, so it was within the budget. Staff recommends Council
award the bid to Insituform Technology USA, Inc.

3. Resolution Receiving Final Plans and Specifications and Ordering Advertisement
for Bids: Improvement Project No. ST. 2006 — 1.
Dr. Burns, City Manager, said most of this project will occur north and south of Mississippi
Street between Rice Creek Terrace and 63rd Avenue. It also includes work on the east side of
University Avenue between Rice Creek on the south and Fridley Community Park on the north.
Staff recommends Council's approval.

Pertaining to Appointment of Election Judges.

Wolfe.

Councilmember Billings noted the low bidder is Concrete Idea for $76,000 and that Ron Kassa
Construction is ne�t at $81,500. Ron Kassa Construction has been the contractor for a number of
years. A few years ago, a company bid on a project and later realized they were not going to be
able to do it. They had to hire Ron Kassa Constriction to finish the work. He said he would like
to table this item and get something from Concrete Idea, Inc., acknowledging that they totally
understand the concept of what needs to be done.
MOTION by Councilmember Billings to table this item until the next City Council meeting.
Seconded by Councilmember Bolkcom.

10. Informal Status Reports.
Councilmember Bolkcom commented she and the Mayor had the pleasure of attending the

Change Order No. 1— Locke WTP Improvements
PW06-032
Several items have been identified as we began our work on the Locke Water Treatment Plant
Improvements. Maertens-Brenny, our contractor on the project brought these items to our
attention based on their past experience. We have reviewed them with our design consultant and
agree that these changes will provide us with a better, longer lasting product.
First is a change to provide a prefinished metal flashing piece under the farade and over the top
of the existing brick. This will help prevent infiltration of water into the walls at the transition
between these two materials. The cost for this work is $1165.00
Second is to have the contractor clean all of the brick surfaces of the building. We had originally
proposed to clean only those portions having tuck-pointing of the brick done. This has created a
very patchy mottled appearance. The cost for this work is $1533.00
Third is to infill five existing openings in the building. These openings were used for old
equipment that needed venting or exhaust ports. The openings are now simply covered by steel
plates. These plates would be removed and the holes in-filled with brick to provide a uniform wall.
The cost for this work is $3237.00
Fourth is to repair the mortar vertical joints at the recessed brick panels. These joints are cracked
and the mortar is crumbling out. The remaining mortar would be ground out and replaced with a
flexible weatherproof caulk. The cost for this work is $1816.00
The total amount of Change Order No. 1 is therefore $7751.00 for a revised contract amount of
$124,476.00. The budget for this project was $200,000.00
Recommend the City Council approve Change Order No. 1 to the Locke WTP Improvements in
the amount of $7751.00.

RE: Replacement of Video Equipment
The City of Fridley advertised for proposals for the design, installation and purchase of digital
video equipment for the City Council chambers and the control room. This upgrade will
replace almost all video equipment with the exception of two projectors and two cameras in
the chambers and the graphics generator in the control room. All equipment being replaced is
at least 8 years old, with most being 15 to 20 years old. This upgrade does not include audio.
An advertisement appeared in the Sun Focus and the Star Tribune on February 2, 2006.
Contacts were also made by phone calls and through letters to local vendors. Seven
companies requested a proposal packet. Six companies made site visits as required in the
proposal language. In the end, only two companies submitted proposals by the March 31,
2006, deadline. Both companies are qualified. The City of Fridley has done past business with
representatives of both companies, and we are happy with their performances.

The proposals are very comparable. The Alpha Video proposal uses a Crestron presentation
processor, while the CompView proposal uses a Sympodium presentation system
(Telestrator). The City currently uses a Crestron control system. The Crestron presentation
system is made specifically for Crestron systems. The Alpha proposal also includes a new
Crestron control system (the brains) to replace the outdated system we currently use. Alpha's
proposal also includes two days of system training compared to CompView's proposal which
includes two hours of training. Although neither proposal included a new digital-based
waveform/vector scope (used to set technical settings for cameras and other equipment), it is
recommended one be added for $4,020.
Installation would take place in late May or June. Installation will take about one week and
will be scheduled around our meeting schedule. No City Council meetings will be affected,
but a Planning or Appeals meeting may need to be moved to another room and held without
being video taped.
Staff is recommending that Council award the proposal to Alpha Video with the addition of a
digital waveform/vector scope.

The annual liquor license renewals have been reviewed by staf£ The on-sale liquor license
establishments up for renewal have all provided the necessary insurance, bond, and CPA
statement with supporting documentation pertaining to food to liquor sales as required by City
Code. After reviewing the supplied documentation, it was found all of the establishments
complied with the City Code requirement of 40% food sales and 60% liquor sales.
The police review found no major issues that would prevent most of the establishments from
receiving a renewal on-sale liquor license, with the exception of R.D. Properties, Inc., dba Sha�
Nightclub. Therefore, it was determined that further discussion would be needed and staff
scheduled a public hearing to discuss possible license revocation which will be discussed later in
the meeting.
The police department has provided information for establishment on the number of calls
received, number of police calls per $lOK, calls per service ratio, and whether or not they failed
either of the two compliance checks made in 2005. In addition, the Police Department scheduled
and advertised an Underage Drinking Training Seminar by the Minnesota Alcohol and Gambling
Enforcement Division for all license holders. The only responses received were from the city
owned liquor stores who would have sent 4 to 6 employees, if the snow had not cancelled the
session.
Based on all of the information, staff recommends approval of the following liquor license
renewals, including the 3 On-Sale Club Intoxicating Liquor Licenses and other required licenses,
at this time:

Re: Public Hearing for Revocation of the On-Sale Intoxicating Liquor License and
subordinate licenses for R.D. Properties, Inc., dba Sha� Sports Bar and Nightclub
located at 3720 East River Road.
Staff requests Council hold a public hearing for the purpose of taking testimony, receiving evidence, and
considering the revocation of all liquor licenses currently issued to R.D. Properties, Inc., dba Sha� Sports Bar
and Nightclub. Specifically, the licenses being presented for revocation include the On-Sale Intoxicating Liquor
License, the Sunday Liquor License, and the Late Hour Endorsement, all issued pursuant to Chapter 603 of the
Fridley City Code.
The Fridley Police Department is presenting this issue to Council for their consideration based upon numerous
serious incidents, a lack of management response, and an increasing number and severity of violent acts occurring
on and adjacent to the licensed premise or having significant relevance to the licensed premise. The Police
Department is convinced that serious and fatal injuries have only narrowly been avoided on the licensed premise
during the past 15 months and that serious injury or fatality is likely to occur in the future if the licenses are
retained by the licensee. The attachments will provide our rationale for recommending revocation, including:
Violence: Several violent episodes have occurred at Sha�, including four incidents of shots fired, seven
additional firearms related incidents, felony-level assaults, and a gang-related shooting that was
interrupted by police all indicate a bona fide threat to public safety exists on the premise.
Code Violations: Several observed and alleged violations of City Code are documented. These include
inappropriate entertainment and patrons remaining on the premise beyond 2:30 a.m.
Loss of Control: Sha� ownership and management appears unable or unwilling to restore and maintain
order on their premise. Police department suggestions have gone largely ignored, neither has
management implemented any other measures resulting in restoration of order to the premise.
Necessity for Direct Police Intervention: The police department has twice instituted intensive patrol
and a"zero-tolerance" enforcement campaign in the immediate vicinity of Sha� to restore order and
prevent further violence and injury. This effort requires substantial City resources to maintain and cannot
be sustained indefinitely. Even with increased police presence, violent acts continue to occur.
The following pages and attachments provide further information for your consideration and review during this
public hearing. Staff recommends Council hold the public hearing.
Rationale for Revocation of Sha� On-Sale Liquor License and Additional Subordinate Licenses
Violence
Over the past year, there have been several incidents of increasing frequency and severity of
violence. Of utmost concern is the fact that 11 firearms related assaults or offenses are known to
have occurred at or near Sha�, or with some relationship to the business. In fact, one homicide
and an incident of two people shot, while occurring in Minneapolis, have connections to Sha�.
Alarmingly, 12.5% (8 of 64) of all felony assaults in Fridley in 2005 occurred at Sha�. Many of
these assaults involved patrons being struck with glass barware or glass beer bottles. Additional
felony crimes of assault, shootings, and robbery have occurred on the Minneapolis side of the
border as well.
Fridley Police Officers received information from the Gang Strike Force on March 15, 2006 that
members of the Bloods gang were enroute to Sha� to shoot one or two rival gang members
believed to be in the club at the time. Fridley Officer quickly responded to the club in time to stop
the two suspected shooters in the car described in the information from the Gang Strike Force at
Sha�. Ultimately no weapons were found, and no assault had actually yet occurred, so the suspects
were released. Sha� staff told officers they believed approximately 15 gang members were in the
Club at the time and they had already broken up three skirmishes between them. Sha� staff had
neither ejected these nare-do-wells, nor had they called police to remove them.
In the preceding 15 month period, Fridley Police are aware of 55 criminal incidents at or adjacent to
Sha�. These include 11 firearms incidents, of which four involved shots fired at or toward the
business, staff and patrons. Also included is one case of homicide occurring in Minneapolis,
wherein a 19 year old male shot and killed a 20 year old female moments after leaving Sha�
following closing. This tragedy was followed by another incident four days later involving two
persons shot a mile away in Minneapolis, also shortly after both left Sha� following bar closing. A
total of 12 assaults involving glass bottles and barware, 11 assaults involving fists, hands, or feet, 2
assaults with other weapons, and 19 disturbances and other criminal incidents comprise the
remaining offenses.
These incidents place Sha� as the top location for serious offenses in the City of Fridley. The
Police Department believes it is only a matter of time before someone is seriously injured or killed
at or adj acent to Sha�. And, the insidious nature of violence — particularly firearms assaults —
places everyone in or near the business at risk Sha� staff is perhaps most endangered by this
violence. Anyone can be hit by a bullet and while customers come and go, employees are at the
business whenever it is open. Next, Sharx patrons are in danger. Reports of apparent random firing
at and onto the property demonstrate the risk to all customers. And, our Fridley Police Officers are
placed at risk when they respond to these calls. Finally, passing motorists with no connection to the
business may be hurt by stray bullets or by those fired from across the street onto Sha� property.
Minneapolis Police have voiced their concerns over the past year as many of the incidents arising
from Sha� actually occur in their city (the City boundary line is just south of Sha�' fence, on the
north side of 37th Ave NE). Minneapolis Police have warned Fridley Police that a homicide is
imminent at Sha�. Our own officers warn us that it is only a matter of time until someone is killed
on the premise, and our own analysis reveals it is by chance rather than by design that a homicide
has not already occurred there.
Code Violations
The Police Department is aware of many violations of City Code occurring at Sha�. Violations,
either alleged or observed, include sexually explicit dancing in March of 2005, three incidents of
patrons remaining on the licensed premise past 2:30 a.m., and unproven allegations of underage
drinking. Most disturbing of these incidents is an apparent case of nude male dancers at the Club in
late February or early March of 2005. City Staff reviewed a newspaper article in City Pages (March
2, 2005) detailing nude male dancing including simulated sex acts. Capt. Weierke phoned Mr.
DeFoe and asked him about the dancing, and also warned him about allowing entertainment in
violation of City Code. Mr. DeFoe told Capt. Weierke that the dancers had gone beyond where
they were supposed to without his permission. The Police Department assigned a female officer to
attend the next show at Sha�. While she did not observe violations of ordinance, the announcer
indicated that the show had been altered due to City oversight and a female customer was overheard
talking about the full nudity and fondling occurring in previous shows. A copy of the City Pages

The City of Fridley has a long standing philosophy of licensing restaurants to serve liquor, wine or
beer so that patrons can enjoy an adult beverage with their meal. While Sha� has met the ratio of
food to liquor as required by Chapter 603, the actual operation of the business is more like a bar in
many respects. First, the Sports Bar is physically separated from the nightclub in a practical sense.
Patrons wishing to order food need to leave the nightclub side (the northern portion of the building)
and walk through the entryway and pass through another doorway to enter the Sports Bar where
food may be ordered. The patrons may then return to the nightclub area with their food. It is staff's
belief that the Sports Bar enjoys a strong food sales during weekdays and evenings thereby allowing
the nightclub to operate as a bar in the evening. This image is reinforced by the name of the
establishment "Sha� Sports Bar and Nightclub," by the fact that liquor "shooters" are served to
patrons in test tubes, and that the establishment is advertised as a strip club on several websites
(http://www.stripclubdirectory.com, http://www.stripclublist.com, http://nude-clubs.com).
Additionally, the City has no other restaurants or establishments that require patrons to pass through
a metal detector to enter. All of these issues serve to illustrate the difference between Sha� and the
other Fridley restaurants that serve liquor.
Loss of Control
Police Department officials have met and communicated with Sha� management several times
during the past 15 months concerning our concerns over the threat to public safety posed by their
patrons and concerning alleged code violations. Of note, Director Abbott and Capt. Rewitzer met
with Sharx owner Rich DeFoe and manager Jared Lacina in November of 2005 to address the
escalation in serious and violent incidents. After providing Mr. DeFoe and Mr. Lacina with a
summary of serious calls, staff presented several suggestions to help them restore order to their
establishment. These suggestions included a voluntary closure or "cool down" period, during which
time troublesome patrons may find a new establishment to frequent. Other suggestions included
Sha� instituting their own smoking ban on their property, a change in music format, increasing
security, and obtaining video surveillance equipment to cover the parking lot and surrounding areas.
Mr. DeFoe did not feel any of our suggestions, save that of the video surveillance system, held
merit for solving the problems at his establishment. DeFoe agreed to install video surveillance
equipment and erect signs advising all patrons of the presence of the gear on the premises. We have
since learned that Mr. DeFoe has not installed the video gear but has increased lighting in the
parking lot and has recently increased the amount of security on the premises.
During a meeting with Mr. DeFoe and Director Abbott and Capt. Weierke on March 21, staff made
an additional suggestion that Sha� eliminate glass beer bottles and glasses from the nightclub in
favor of plastic bottles and barware in an effort to reduce the levels of assault and injury. Mr.
DeFoe expressed reluctance to this idea and as of March 30 had not implemented this suggestion.
Mr. DeFoe explained that significant expense would be incurred by making such a change.
Staff believes that based upon the ongoing serious incidents, and the apparent escalation of the level
of violence, even though police have been offering assistance to Sha� management that Mr. DeFoe
has lost control of his establishment, his staff, and his premise. Most concerning at present time are
allegations that Sha� has employed gang members on their staff, including those responsible for
working the door, checking identification, and overseeing the operation of the metal detector. It is
apparent that street gang members prone to violence may now regard Sha� as their "tur£" In any
event, violent segment of society now views DeFoe's place as their place, bringing with them
violence and criminal activity.
Need for Police to Restore Order
In an attempt to restore order to Sha� and the immediate vicinity, as Mr. DeFoe appears either
unable or unwilling to do on his own, the Fridley Police Department as twice instituted periods of
directed and significant enforcement efforts around Sha�. The first time was in November of 2005
when officers from Fridley and Minneapolis coordinated efforts to implement a"zero tolerance"
enforcement zone in the area around E. River Rd. and 37th Ave. This effort resulted in numerous
citations and arrests and appeared to have a calming effect in the area. This effort was initiated
again immediately following the attempted `gang hit' on March 16 and is currently operating every
Wednesday — Saturday nights. This enforcement effort, accomplished with police officers working
overtime shifts supplementing the normally scheduled shift officers, is costing the City
approximately $2200 per week Since it's inception on March 16, officers have again issued
numerous citations, made several arrests, and recovered both drugs and weapons. While Sha�
patrons are frequently the subjects of the traffic stops, many motorists who are just traveling past
Sha� are also impacted by the increased enforcement. It is worthy of note that even with this
increased police presence, felony level assaults resulting in injury to Sha� staff and patrons have
still occurred — at times within feet of police officers. We need to emphasize that the department is
not capable of maintaining such an effort indefinitely.
Zero-tolerance enforcement is a recognized police action designed to address trouble areas, zones,
or locations through increased patrols and enforcement of all traffic laws and ordinances, regardless
of seriousness. Citations for vehicle equipment violations, public urination and j aywalking are
examples of citations issued during such efforts. The goal of zero-tolerance enforcement is to
reduce criminal activity, and in this case lessen the likelihood of serious assault and injury, through
highly visible and concentrated police presence. Zero-tolerance works through three methods:
Greatly increased visibility and presence of police — basically, several squad cars are on traffic
stops with lights flashing at all times. It is immediately obvious to any passerby that the area is
saturated with officers enforcing laws. This provides a deterrent to persons considering
committing a crime in that area at that time.
2. Interdiction of criminals, contraband, and weapons — persons not deterred by police presence are
stopped by police for observed violations. During the citation process, warrants, drugs, and
weapons may be (and have been) discovered. Removing those persons and their contraband
prevents them from committing a crime at that time.
3. Creating an "atmosphere of compliance" out of climate of disorder — police officers issuing
citations for minor infractions sends a message that the department has the resources to deal
with minor offenses, imagine what attention we would pay to maj or violations. Adherence to all
laws and ordinances is the expected result.
It is important to re-emphasize that zero-tolerance enforcement and increased patrols are expected
to reduce likelihood of serious or fatal injury, not prevent it. The recent tragic homicide in
Minneapolis' Block E occurred in an area patrolled by 30 cops and such an incident could easily
happen at Sha� even while our increased patrols are present.
Historical Information
The issues currently present at Sha� are not entirely new to the establishment or to Mr. DeFoe. In
fact, a review of Council Resolution 48 — 1997 which suspended Mr. DeFoe's on-sale liquor license
for one week shows that action was taken for many of the same reasons staff now recommends
revocation. A copy of the Resolution and the supporting Staff inemo are attached to this document.
Of special note, Council in 1997 identified glass bottles and glasses as a particular area of concern
at that time. Staff emphasizes, however, that the frequency and severity of issues occurring at Sha�
over the past 15 months exceed those that prompted the 1997 suspension.
Licensee Comparisons
Staff has attached a table comparing offenses known to Fridley Police for all On-Sale Liquor
licensees for each of the six years between 2000 — present. This table illustrates that Sha� stands
alone at the top of the list of felony-level assaults in 2005. As previously mentioned, 8 of the 64
felony assaults known to Fridley Police in 2005 occurred at Sha�. This one location accounts for
12.5% of all felony assaults in the City during that year. The next most frequent location was
University Billiards with three. It is interesting to note that all three of the Billiards' felony assaults
occurred prior to the issuance of their On-Sale Liquor License. A review of the table will also show
that Main Event had 8 reported felony assaults in 2000. That establishment changed owners in
March of 2001, after which serious assaults all but disappeared lending hope and credence to the
assertion that management practices can effectively and drastically effect the occurrence of offenses
on licensed premises.
Conclusion
In conclusion, Staff recommends Council consider the revocation of all On-Sale Liquor and
subordinate licenses (Sunday Liquor, Late Hour Endorsement) issued to Richard DeFoe & R.D.
Properties, Inc., dba Sha� Sports Bar and Nightclub. The ultimate goal of this action would be to
reduce the likelihood of serious injury or death resulting from a climate of disorder and uncontrolled
violence occurring on and immediately adjacent to the licensed premise. Sha� ownership and
management has demonstrated an inability or an unwillingness to restore order to the property,
thereby showing an unacceptable level of responsibility required of a licensee.

Thank you for the opportunity to express my public safety concerns about Sha� Nightclub
located at 3720 East River Road, Fridley Minnesota. The management of large and unruly
crowds, the escalating violence and ongoing disregard for law at Sha� Nightclub is a challenge
not only for Fridley Police Department but also for the officers of Minneapolis Police
Department's Second Precinct.
We respond regularly to the disturbances at Sha� Night Club and are increasingly concerned
that as our calls for service increase during summer months we will be unavailable to assist when
needed. A typical call to the location requires several Fridley squad cars and several
Minneapolis squads to manage the large unruly crowds, triage injuries (and there are often injury
resulting from fights) and make arrests. Not only am concerned about officer safety but also the
safety of innocent victims caught in the wake of violence.

The following represents a timeline of significant Police involvement with
Sharx Nightclub:
March 2, 2005 News article in City Pages refers to male exotic dancers at
Sharx exposing their genitalia.
March 4, 2005 Capt. Weierke contacts Sharx management and warns them
about allowable entertainment.
March 5, 2005 Police Officer Ginny Skyy attends the show at Sharx
undercover and verifies that the entertainment complies with
City Code. The announcer tells the audience that the City of
Fridley had a problem with the show so everyone must
behave. Officer Skyy overhears patrons remarking that the
last show featured nudity and allowed physical contact with
the dancers.
May 21, 2005 First shooting at Sharx (ICR 051 1 1357). Shots are fired toward
Sharx patrons and staff from the Minneapolis side of the
border.
May 22, 2005 On-duty officers are advised to make frequent contacts with
Sharx staff, provide additional presence, and increase
enforcement efforts in and around Sharx.
June 6, 2005 Capt. Rewitzer meets with Minneapolis Police 2nd Pct. Lt. Jeff
Rugel regarding increased Minneapolis Police calls to the
vicinity of Sharx. Discussed coordination of enforcement
strategies.
June 10, 2005 Director Abbott and Capt. Rewitzer meet with Sharx owner
Rich Defoe and manager Jared Lacina. Discussed prior
entertainment issue, complaints received regarding over
capacity crowds, and strategies to ward off future disorder.

July 10, 2005 Officer Chris Knight meets with Sharx manager Chris Anstett to
discuss Sharx operations. Anstett reports they are adding
Wednesdays as another nightclub sponsored evening in
additional to Friday and Saturday nights. Thirteen bouncers
are in radio contact with each other inside the club as well as
two armed Capital Security guards outside. On Saturday
nights they have two more armed guards outside due to the
larger crowd. Patrons must walk through a metal detector
arch and all persons with loose clothing are patted down and
checked with a hand-held metal detector; purses are hand
searched. Officer Knight points out that several signs posted
in the parking lot describing the requirement to leave at
closing have the old times and two signs are overgrown.
Aug. 8, 2005 Second shooting at Sharx (ICR 05181483). Shots are fired in
the parking lot. Two suspects are arrested.
Oct. 23, 2005 Third shooting at Sharx (ICR 05252684. Shots are fired from an
assault rifle toward Sharx patrons from the Minneapolis side of
the border.
Oct. 27, 2005 Minneapolis Police report that members of a newly formed
gang are frequenting Sharx. Information passed on to Sharx
management to exclude patrons wearing gang colors.
Nov. 10, 2005 Director Abbott and Capt. Rewitzer meet with Sharx owner
Rich Defoe and manager Jared Lacina. Discussed prior
firearms related incidents, gang activity and proposed
strategies to prevent future disorder: change music format;
voluntary temporary closure as a"cooling off" period; no-
smoking policy; and installation of video surveillance outside
the business. Defoe declines to employ the first three
suggestions but is willing to install video surveillance. Discussed
benefit of conspicuously posting that parking lot is under
video surveillance. Agreed that such a system would serve
both as a deterrent to the dangerous criminal incidents
occurring as well as provide necessary evidence to
apprehend suspects engaged in criminal activity. Defoe
indicates that he would have signs installed and would begin
to investigate installation of an appropriate video surveillance
system.

Nov. 1 1, 2005 Over the next three weekends, in an effort to prevent an
escalation in criminal and gang activity, a zero-tolerance
enforcement detail is conducted in the vicinity of Sharx, in
partnership with the Minneapolis Police Department. Several
officers worked overtime shifts and on-duty officers were
involved as call load permitted. Numerous traffic arrests were
made in addition to officer initiated arrests in the Sharx
parking lot for disorderly conduct, narcotics and public
urination offenses.
Nov. 20, 2005 Officers observe at least 100 patrons still in Sharx at 2:30 a.m.
Sharx staff indicated that there was a problem with their coat
check system which caused problems clearing people from
the business. Parking lot not cleared until 3:20 a.m.
Nov. 25, 2005 Sgt. Salo meets with Sharx manager Kurt Just and reminds him
that City Code requires that the property be cleared by 2:30
a.m.
Dec. 1 1, 2005 Sharx bouncer "Lee" accidentally maced by a Capital
Security guard is extremely belligerent to officers handling an
assault - swearing at them and challenging them to fight. Sgt.
Jim Mork requests that Sharx manager Kurt Just take control
of his employee so that officers could focus on dealing with
disorderly patrons. Just is not able to exercise any influence
over the bouncer and officers continued to have problems
with him.
Jan. 21, 2006 Operation NightCAP (nighttime concentrated alcohol patrol)
traffic saturation is held centered on Sharx. Eight officers from
surrounding police agencies as well as the Minnesota State
Patrol participate. One hundred vehicles stopped resulting in
fifty citations for traffic offenses and six DWI arrests.
Jan. 22, 2006 Homicide victim brought to North Memorial Medical Center.
Initial information is that victim was shot and killed at Sharx.
Investigation revealed that while 20 year old victim and 19
year old suspect had both been at Sharx, the shooting
happened in Minneapolis 15 minutes after they left Sharx.
Jan. 26, 2006 Two shooting victims brought to North Memorial Medical
Center. Initial information is that victims were shot at Sharx.
Investigation revealed that victims were shot at Marshall and
Lowry after leaving Sharx.

Feb. 26, 2006 Officers respond to reports of 40 to 50 people fighting in the
southeast corner of the Sharx parking lot at 2:29 a.m. Parking
lot is not completely cleared until 3:31 a.m.
March 9, 2006 Capt. Rewitzer sppeaks with Jared Lacina who calls to inquire
about what recommendation the Police Department will
make regarding Sharx liquor license renewal. Lacina states
that the business has not installed any camera system as
discussed at the meeting four months prior because they
wanted to see what would happen to their license before
making such an investment. Lacina says that additional
lighting has been installed in the parking lot.
Mar. 16, 2006 Sgt. Rick Crestik receives information from the Metro Gang
Strike Force that "Bloods" gang members are enroute to
Sharx to shoot rival gang members. Officers located a vehicle
occupied by gang members in the parking lot. No weapons
recovered. Bouncers inside report three skirmishes between
rival gangs in the bar and estimate that fifteen known gang
members are inside. Manager Kurt Just agrees to close early.
It is strongly believed that a shooting between rival gangs was
averted by this action.
Mar. 16, 2006 Due to the climate of disorder present at Sharx, an overtime
zero-tolerance enforcement detail around Sharx is authorized
for Wednesday, Thursday, Friday and Saturday nights,
extending indefinitely or until such time as official measures
could be taken to abate the threat to public safety created
by the continued operation of the business. Overtime and on-
duty officers, working in partnership with the Minneapolis
Police Department have made numerous arrests for traffic,
narcotics and order violations in effort to create an
atmosphere of compliance. Thus far 144 hours of overtime
have been spent. The impact of this detail on the Police
Department budget is estimated to be averaging
approximately $2,216.24 per week.
Mar. 19, 2006 Sgt. Mike Monsrud observes that Sharx patrons are still exiting
the nightclub at 2:40 a.m.
Mar. 21, 2006 Director Abbott and Capt. Weierke meet with Sharx owner
Rich Defoe and manager Jared Lacina. Discussed apparent
gang activity at business and suggested shift to plastic serving

containers to prevent continued bottle assaults. Defoe wants
to present a plan to maintain the liquor license.
Mar. 24, 2006 Det. McKeen, working the zero-tolerance detail, stops a
vehicle enroute to Sharx. Driver and passenger claim to be
Sharx employees. Passenger is a confirmed gang member.
Mar. 26, 2006 Officer Chris McClish, working the zero-tolerance detail, stops
a vehicle for failing to move over a lane while passing by
Officer Randi Schanus who is out on a traffic stop. Driver Rich
Defoe is cited for the offense.
Mar. 30, 2006 Sgt. Jim Mork meets with Sharx employees regarding liquor
and food sales. Liquor continues to be sold in glass containers
at the nightclub and food can only be purchased on the
Sports Bar side of the business.
Mar. 31, 2006 Director Abbott and Capt. Rewitzer meet with Sharx owner
Rich Defoe. Defoe alleges that the Metro Gang Strike Force is
encouraging gang members to frequent the business. Defoe
presented several ideas that he may be willing to implement
if he is able to maintain the liquor license: restrict customer
ages to 25 and above; mix some "oldies" into the music
playlist; and if the above seemed to work, transition from glass
to plastic alcohol containers. Defoe is served with the Notice
of Public Hearing. Defoe requests copies of police reports
referenced in the hearing notice.
April 3, 2006 Director Abbott and Capt. Rewitzer meet with Metro Gang
Strike Force supervisor Lt. Andy Smith and Officer Kelly
O' Rourke regarding the allegations made by Defoe. Smith
and O' Rourke report their first knowledge of gang activity at
Sharx was on March 16, 2006. Since that time they have
conducted surveillance and have observed known gang
members frequenting the business. O' Rourke denies placing
any gang informants in the business.
April 4, 2006 The police reports that Defoe requested are delivered to
Sharx and accepted by manager Jared Lacina

WHEREAS, Sharx �.s an estab.lishrnent locateci within the City of Fridley,
Minnesota, and operates its business with a l.�quor iicense g.ranted to it
by the City, and
WHEREAS, all l�.quar l.icenses within the City of Fridley are sub�ect to
ongoxng review by the City's staff and are forznally reviewed at least
once a year by the iul.l City Council, and
WHEREAS, as part c�f its rotztine review of liquo.r l�censed
es�ablishmen�s, the Frid.ley Department of Publzc Safety determined that
there had been an unusually high level of incident reports related to
assaults and d�sor.derly conduct associated with Shazx Night Cltab
operations in the City, and
WHEREAS, based on the report of �he �epartment of Ptzhlic Safety, a
revocation hearing was scheduled May 19, 1997, for t�.he purpose of
revzewing the question of whether Sharx should cont.�rnre �o have �t;s
l.�.quor l�.cense, or such other matte.rs and sanc�ians as mx.ght: have been
deemed apprapriate by the C1ty Council in i�s discreta_on, and
WHEREAS, re�resentatives of the City, including zts nepartment of Puk�lic
5afety, met with xe�resentat�.ves of Sharx IJight C1ub for the purpose of'
reviewing the incident reports and problems that had been assoczated
with that establishment, and
WHEREAS, as the result of that extensive review and da.scusszons, the
representat�ves of the City agreed to recommend to the City Council. the
renewal af the liquo� license o£ Sharx Night Club, suh�ect to a
suspensz�n o� same for a period of time, as we1.:� as certazn additio�al
s�rict cond.i.ts.ons and requirements �ha� would have to be c:ampliec� with
by Sha.rx for i� to cantinue �� be able to hold its Iiqt.ior l.icense w�thin
fi.he City, and
WHEREAS, the City Council finds, based on the reports af the Department
oi Public Sa�'ety, that the issues and conce.rns raised are suffic�ent and
appropr�ate to warrant sanctions as severe as those recommendec� by the
staff zepresen�at�ves of the City, as well as the conditions and
adda.t.�.onal procedures recommended.
NOW, THEREFORE, BE IT RESOLVED, by action of l.ts Clty Council that the
City of Fridley, M�nnesota, g.rants to Sharx a renewal o€ �ts liquor
l�.cense f�r a period �f one year, �hrough Apr�l 30, 1998, sub�ect to
the followinq express terms and conditions:
l. Complete suspens.�on of its liquor operations for. a period of �ne
week, at a date ancl t�me to be determined by the C�ty Manager,
which suspension is expressly sta�ed to be a sanr.ti�n for the

safety direc�or that occur on site immediately to the Fridley

3. A notice sha11. be prominen�.ly posted at the entrance ta the Night
Cluk� notifying patrons that any and al.l. par�..ic�a.pant:s .in da.so.rder.l.y
conduct or assaultive behavior will be p.rosecuted to the full
extent of the law.
4. Sharz� management shall undertake aggressive add�tianal �razning of
a1.1. new employees and a1..L ot;her staff on an ongoing basis,
�articularly its wait and hartending pe.rsonnel, on detecting and
dealing with excessa.ve consumpt;ion, ancl patr�ns and stafi shall be

5. In the event that more than two incident:s are repo.r�ed in the next
three months that in any way �nvolve the usa of bottles, the owner

kind.

that will a.fford greater visibility and sectzr�ty �f its patrons

7. The Depa.r�rnen� of Public Safety, as well as other departments in
the City, shall monitor, on an onqoing basis, the compliance by
Sharx with these provisions and sha11 report on that compliance
periodlcal.Ly to the Council. The Director of Public Sa�et-y or hi_s
designee shall regularly meet with the Qwner or ha.s designee, at
tzmes establ�shed by tlze Director. of Publzc Safety, far the
purpose of �eviewing issues of compliance wi�h these conds.t:�.ons
and such other matters as the Director of Public Safety may deem
necessa.ry foz the purpose of assuring c�mp:l�iance with these
condi�ions and the general health, sa�ety and welfare of the City

it is staff's apinion that Sharx cannot be allowed to continue operating as it has over the past
year, and it is the staff recommendation that the license be revoked,
In my opinion, the best way for the City Council to get an accurate picture of the conduct at
Sharx is to be able to review the individual reports. Attached is a booklet that includes copies of
ali palice reports for reported incidents at Sharx from March 13, 1996 to March 13, 1997. The
reports involve assaults, disorderly conduct, or apparent excess of alcohoi consumption. I will
reference some of these reports at �he Public Hearing on May 19`h, 1997.
The reports are divided into three categories;
The first category is "Repo�ted Assaults." There are 18 incidents, six of which are felony
assauits.
The second category is "Disorderiv Conduct with Assaultive Behavior." There are 11 in this
category. There are assaults in each of these reports which could/should have been reported
as assauits. In most cases they involved the bouncerslstaff of Sharx assaulting disorderiy
patrons. They were not reported as assaults because in rnost cases the o�cer felt that the use
of force was justified or, in some cases, the victirn did not want action taken, just a report made
so that civil action could be taken at a later date. At issue in this category is, "Why did the
bouncers find it necessary to remove these people and use force?"
The third category is "Disorderlv Conduct and Alcohol Related." It includes various types of
disorderly conduct, and obvious examples of excessive alcohol use (detox, etc.). There are 23
reports in this category. In eight incidents, beer bottles were used as weapons,
The most significant issue that seems to prevail in most of these cases is that the persons
involved had too much alcohol to drink. This may seem to be a non-issue to some. Sharx is in
the business of selling alcoholic beverages. There is a concern, however, with persons driving
after having had too much to drink. (We did not include DUI's which occurred off of Sharx
property,) How many intoxicated persons drove away from Sharx?
As a licensed establishment, Sharx is responsible for the conduct of its patrons, and the level of
intoxication which customers are reaching. There are 11 other licensed establishments in
Fridley, not including beer licenses, By comparison, the combination of reported incidents at the
other 11 establishments would not approach the numbers of any of the categories at Sharx.
Another point worth noting is, who is reporting the incidents? Twelve of the incidents were
reported by Sharx staff (this is being generous because in sorne of these incidents the
., ,
bounGers summoned the officer over after the officer was already in the parking lot and the
incident was in progress), and 38 of the incidents were rep�rted by officers on patrol/detail pr by
the customers, The obvious questi�n is, how many assaults or disorderiy events �ccurred
which were never reported?
It has heen purported that the real �roblem with Sharx is its location In a May 8, 1997 Focus
newspaper article, it was mentioned that the problems are due to the proximity t� North
Minneapolis. A review of the reports wiil show that the participants are from ail over the Twin
Cities Metropolitan area This is not a location issue.
During the period in question, Sharx was the location of abc�ut 2-1/2% of Fridley s reported Part
I(serious) Crimes. The six felony assaults rep�rted represent ab�ut 11 % of Fridley's Part I
assauits. The safety-related concems with the conduct at Sharx are numerous. There is an
obvi�us concern that someone is going to get kilied. It is purely accidentai that ±his has nct
already occurred.
A major concern is that Sharx is only one of 12 licensed establishments in the City of Fridley. If
it is decided that the criminal activity at Sharx is at an acceptable level, would it set a precedent
for other licensed establishments to follow? Fortunately, the other licensed establishments in
Fridley have shown responsible behavior in conducting their business. Liquor establishments
are in the business to make a profit. If this level and type of conduct is shown to be profitable
and permitted, where do current or future licensees end up? The amount of time that the police
department spends dealing with these types of issues takes away from our time to deai with
other crime and safety issues.
If the City Council chooses to renew the liquor license at Shar,c, it is staff's recommendation that
it be done with the following conditions attached:
1. The location, inciuding the parking lot, be posted and aii patrons notified that all
participants of any disorderly conduct or assaultive behavior will be prosecuted to
the fuli extent of the law.
2. Sharx staff will call the Fridley Police immediately on all incidents and participate in
prosecution of all participants,
3. Management wiil make it clear to the Shanc staff that no alcohol wili be served to
obviously intoxicated individuals. Special training for staff wouid be mandated.
4. No beverages will be served in glass bottles.
The police c�epartment will monitor the locati�n closely and report noncompliance ta the Councii
for appropriate action. The number of incidents will be reported to the Councii at appropriate
intervals for consideration of further action, These conditions are difficuft for the police
department due to the anticipated increased number of reports and arrests. it will provide an
accurate accounting of what is occurring at Sharx for future consideration and should have
some effect on the number of safety issues,
As noted previously, however, Staff recornmends the revocation of the liquor license at Sharx.

Who's the Black Private Dick That's a Sex Machine to All the Chicks?

"Who's here to see some dick?" Chocolate Shake shouts into his cordless mic.
Take a look at the distaff mob clad in Enyce tops and Apple Bottoms jeans and you reach a quick answer: Everybady is
here to see some dick. Of course, there are other reasons to be at Sharx on this glacial Saturday evening. The club,
located on the westernmost fringe of Fridley, gleams like a beacan far those who'd rather dirty-crunk to Ciara while
buzzed on Hyponotiq than settle into the cracked, carewom baaths of sleepier Nordeast establishments. Like Gabby's a
few miles down on Marshall, Sharx has unexpectedly become an oasis in the Twin Cities' urban nightlife scene.
Normally, if you came here on a Saturday, you'd see cauples g'd up in immaculate club gear, roving SBFs swinging
designer purses, and packs of guys feib ing nonchalance in the VIP lounge. But tonight, with the exception of a few
Herculean security guards and the event's hosts, the house is packed exclusively with the female of the species. And as
we'll proudly inform you, we're here to see dick.
Tonight's main attraction is "The Chocolate Faatary," an all-male black exotic dance troupe whose spakesman promises
"guys swinging 10, 1 l, 12 inches!" (At $2Q for admission, that comes out to a reasonable 55 cents per inch.) Sha�
hosts male dancers on the first Saturday of every month, but that hasn't dampened anyone's lust for well-hung
professionals. The line for entry is lengthier than one might expect, It snakes out the daor and into the Sharx parking
lot, where impatient club-goers loudly protest any wannabe queue jumpers. It's all evocative of a Muscovite breadline.
The fact that all of us in the crowd are female doesn't lend any levity to the situation, despite the pervasive belief that
women think of male nudity as an amusing distraction. No, mast af these gals aren't fooling around. They gaze
langingly at the club entrance like teenage boys eyeing tYie top shelf at a magazine kiosk. Arguably, these wamen are
more starved for eye candy than any of the sloppy Joes flanking the stage at Deja Vu or Dreamgirls; naked girls are a
dime a dozen, but naked men are a rare delicacy.
Inside, throngs of girlfriends scramble for seating, clutching syrupy cocktails in plastic cups and wearing expressions af
grim determination. One middle-aged woman claims a stool with a choice view and hoists her drinl< triumphantly. "I'm
here with my bowling league," she says, grinning lasciviously. "There was no way we were going to miss this." She
glances furtively around the club, as if a naked man could appear at any moment and vanish like an elusive 10-point
buck,
Across the raam, a drunk girl wanders through the crowd, grinning like a pageant queen, °I'm an'entertainer' myself,"
she volunteers mischievously, clearly pleased to be on the other side of the dallar dance for once.
After some initial tension, the unseen presence of oiled musclemen seems to inspire a degree af camaraderie among the
spectators. As a B96 personality teases the crowd from the DJ booth, we become more restless. "We want dick!" a few
college students chant in unison, stomping the dance floar with their Tims.
Soon, Chocalate Shake, a dancer with the troupe, emerges in a pristine white suit that glows like radium beneath the
black lights. He hypes the crowd expertly, boasting in no uncertain terms about what we're about to witness. The effect
is surprisingly and undeniably erotic, Listening to a sexy man describe ather sexy men's genitals in graphic detail is
almost more than this fervent crowd can bear.
Soon (but not soon enough), Ashanti's latest single rattles the room, the bass groans at bowel-loosening levels, and the
Chocolate Factory is in full effect.
Three dancers emerge in colorful pimp suits and James Brown wigs and do a choreographed, fully clothed routine for
the duration of the song, They're impressive, but the crowd shifts restlessly. They know what they're here for. Hell,

they've expressed it repeatedly and without compunction: Bring on the pork swords!
At lang last, a dancer emerges dressed as a ninja and wielding nunchuks. His costume is more than a gimrnick. He
appears actually to be a skilled martial artist, though he c�uld be a white-belt novice for all these ladies care, nnce he
peels off his robe and flexes his bumished pectarals, the screams become deafening. Clad only in black pants, he hoists
a girl out of the crowd, swings her upside down, and buries his face in her crotch, mimicking aral sex. The crowd roars.
A graup af admirers bum-rushes the floor and begins jayfully spanking the dancer, who accepts this unsolicited
affection like an agreeable family dog.
Once he's maneuvered some breathing room, the dancer lawers his pants teasingly. Ka-ching! His manhood is encased
in a purple satin pouch, and swings as frankly as any other appendage might in more palite company. A celebrant
throws herself onto the flaor in ecstasy, and the dancer lawers himself onto her face.
At this point things reach a fever pitch and the dance floor is barely visible frorn any vantage point. This is ladies' night
in the truest sense of the word. On a typical Saturday at t1�e club, these shrieking female predatars would be prey to the
male gaze. But judging by the primal screams in the room, the Chocolate Factory experience is more than a cathartic.

On 3-4-Q5 I was advised by Captain Weierke that there was a possible vialation �f the city entertainment ordinance going �n at Sharx's night
club, Captain Weierke requested that i go to the night club undercover on 3-5-05 tp see if their male strippers were expasing themseives.
There was an article written in the paper fhat staied the male strippers were exposing themseives. I arrived at the �olice department and meet
with Sergeant Mork. Mork provided me with one hundred dollars. I then went to Sharx's with my friend..
We arrived and there was a twenty dollar c�verage charge far both of us. We both had twa alcohol beverages. There was a total of four male
strippers that called themselves "the chocolate factary." During the dances there was no exposure of the male strippers private parts, Furan
did rneet a female in the bathraom that said she was really disappointed with tonight's show. According to this female the last show the male
strippers took everything aff and fhe women were allowed to touch the male dancers and vice versa. The female stated this show was very
baring.
It should he noted that when we first arrived we were provided the rules af the nightclub and for the dancers. The opening announcer also
stated that the City of Fridley has a problem with the show, so everyone had to behave tanight, The announGer also commented that there was
one �r two underc�ver police officers in fhe house. A t�tal of forty-two dollars was retumed ta Sergeant Mork, No further action. Clear.

of the Liquor License for R.D. Properties, Inc., d/b/a Sharx Sports Bar & Nightclub
A revocation hearing will be held to take testimony on the on-sale intoxicating liquor license for
RD properties, Inc., dba Sha� Sports Bar and Nightclub located at 3720 East River Road.
Based on the testimony, staff is prepared to ask for revocation of the liquor license. Attached is a
resolution providing for the revocation of the liquor license.

RESOLUTION OF THE CITY OF FRIDLEY, MINNESOTA, PROVIDING
FOR THE REVOCATION OF THE LIQUOR LICENSE FOR R.D.
PROPERTIES, INC., DB/A SHARX SPORTS BAR & NIGHTCLUB
WHEREAS, R.D. Properties, Inc., d/b/a Sha� Sports Bar & Nightclub (hereinafter "Sha�"), is
an establishment located within the City of Fridley, Minnesota, and operates its business with a
liquor license granted to it by the City; and
WHEREAS, all liquor licenses within the City of Fridley are subject to ongoing review by the
City's staff and are formally reviewed at least once a year by the full City Council; and
WHEREAS, as part of its routine review of liquor licensed establishments, the Fridley Police
Department determined that there had been an unusually high level of incident reports related to
assaults and disorderly conduct associated with Sha�'s operations in the City; and
WHEREAS, the Fridley Police Department provided testimony at a Revocation Hearing
conducted for the purpose of reviewing and acting upon the issue of continued licensure of
Sharx; and
WHEREAS, the testimony was entered into the record in the form of a statement by the Director
of Public Safety for the Fridley Police Department with supporting documentation of numerous
instances of public violence at Sha�, as well as an evident lack of control over the premises by
the owners so as to cause an ongoing issue of public safety, including the presence of gun
violence and a real risk of inembers of the public being severely injured or killed while in the
vicinity of Sha�; and
WHEREAS, representatives of the City, including its Police Department, met with
representatives of Sha� for the purpose of reviewing the incident reports and problems that had
been associated with that establishment, and made a number of recommendations in order to
properly address safety issues at Sha�; and
WHEREAS, Sha� made no meaningful effort to remedy the problems that existed on its site as
recommended by the Fridley Police Department and does not appear to be consistently willing to
do what is necessary to make Sha� a safe establishment within the City; and
WHEREAS, as the result of that extensive review and investigation, the Fridley Police
Department recommends the revocation of the liquor license at Sha� as the only effective means
by which public safety can be assured in the future at that establishment; and
WHEREAS, the City Council finds, based on the reports of the Fridley Police Department, that
the issues and concerns raised are sufficient and appropriate to warrant sanctions as severe as
those recommended by the staff representatives of the City;

NOW, THEREFORE, BE IT RESOLVED, by action of its City Council that the City of Fridley,
Minnesota, revokes the current liquor license in use for Sha� in the City of Fridley; and
BE IT FURTHER RESOLVED, that the City Council accepts as its findings of fact the
foregoing recitation and incorporates expressly into its findings the written reports of the Fridley
Police Department presented by the representatives of that department at the revocation hearing.
