INFORMATION ON WATER DEPARTMENT:
Jon Haukaas, Public Works Director, gave recognition to the new supervisor, Kory Jorgensen,
who has worked with the City for 20 years. He gave a short overview of the Fridley water
system. It includes three water filtration plants. The main plant is on 61st Avenue. The second

one is at Locke Park near Columbia Arena, and the third is on Highway 65 and 73 '/z Avenue.
There are three water towers and one ground storage reservoir which holds 6 million gallons of
storage, 113 miles of watermain, over 1,000 hydrants, and approximately 8,400 connections.
Five City water workers maintain that infrastructure throughout the year, in addition to helping
with the winter plowing, any other utility repairs, weekend duty, etc. The City's maximum
filtration capacity is 18.2 million gallons a day. In 2005, the City provided 1.22 billion gallons
of water. Of that only 31,000 gallons were not filtered. Fridley has some of the lowest rates in
the area. Blaine is the only neighbor that is lower, but they provide only about 30 percent
filtered water. Fridley's water quality is excellent.
Mr. Haukaas stated over half of Fridley's water is supplied by the Commons filtration plant,
which was the focus of one of the City's major projects this year. Some other small projects
include improvements to the electrical service and generated power for when the City has power
failures. There are six chemical feed systems, and one of them was modified to meet stricter
EPA regulations. They were able to do that without doing maj or renovations. Other upgrades
were done including cleaning up older controls, moving valves out of the way, and painting the
plant to meet AWWA standards. A new control panel controls the entire process. The panel is
automated and can be accessed remotely when necessary.
NEW BUSINESS:
1. Approve 2007 Sixty-Day Agency Action Application Deadlines for the Planning
Commission and the Appeals Commission Meetings.

2. Approve Metropolitan Livable Communities Act Tax Base Revitalization Account
Subgrant Agreement between the City of Fridley and JLT East River Road LLC.
Dr. Burns, City Manager, stated the City has applied for funding through the Metropolitan
Council Tax Base Revitalization Account. The $168,000 the City has received will be used by
JLT to do asbestos removal at the former Tiro Industries plant on East River Road. On June 28,
2006, the Fridley City Council approved the terms of an agreement between the City and the
Metropolitan Council. Since JLT can now receive funds directly from the Met Council, this
agreement is between the City and 7LT. The agreement reiterates the terms the City has with the
Met Council and establishes the responsibility for the subgrantee, JLT. These terms include
providing proof of remediation, accurate accounting, expenditures, etc. Staff recommends
Council's approval.

3. Approve Change Order No. 1 to the Salt Storage Building Project No. ST. 2006-1
Dr. Burns, City Manager, stated the change order accommodates the need to make changes in
the foundation for the building after discovery of poor soils. The cost of the revised foundation
is $5,111, which brings the contract cost with Greystone Construction from $104,910 to
$109,621. Staff recommends Council's approval.

4. Approve Change Order No. 2 to the 2006 Street Improvement Project No. ST.
2006-1.
Dr. Burns, City Manager, stated the change order is due to underground conflicts that were not
identifiable during the design process, including the street design for improved drainage. The
total cost for the changes is $14,949.74. That brings the total contract cost for Park Construction
to $3,154,308.47. Staff recommends Council's approval.

5. Resolution in Support of a Minnesota Lawful Gambling Premise Permit Application
for Minnesota Junior Hockey League, Inc., Located at White Owl Ventures, LLC,
d/b/a Club Array, 7820 University Avenue N.E. (Ward 3)
Dr. Burns, City Manager, stated when Main Event became Club Array, White Owl Ventures,
LLC, terminated its charitable gambling premise permit for the Italian American Club. The City
subsequently received a premise permit application from the Minnesota Junior Hockey League.
They currently have a lawful gambling license with Pasquale's Sports Bar at Northtown Mall.
The City has found no reason to restrict their locating at Club Array. Staff recommends
Council's approval.

6. Approve Renewal of Rental Property License for 190 and 191 Island Park Drive
N.E. (Ward 3)
Dr. Burns, City Manager, stated the problems with the properties have been corrected, and the
owner has paid the rental license fees. Staff recommends Council's approval.

Dr. Burns, City Manager, stated staff recommends the appointment of two new police officers,

OLD BUSINESS:
11. Resolution Revoking Special Use Permit, SP #03-14, and Approving a New Special
Use Permit, SP #06-11, for Central Auto Parts, to Operate a Junkyard in an M-1
Zoning District, Generally Located at 1201 73 �/z Avenue N.E. (Ward 2) (Tabled
August 14, 2006)
Scott Hickok, Community Development Director, stated a grading and drainage plan was
submitted to the Rice Creek Watershed District (RCWD) on Friday, August 25. That plan partly
satisfies the 2004 special use permit requirements. The City/RCWD approval of a plan and the
installation of fence, landscape, and irrigation was due in 2005. Some of those things were taken
care of in 2005. Grading and the storm sewer pipe would need to be completed in 2006 to catch
up on deadlines. Installation of the first phase of the curb and gutter and paving would have to
take place by March, 2007. Finally, the completion of curb and gutter, paving, landscaping, and
irrigation would need to occur by March, 2008.
Mr. Hickok stated staff's recommendation is based on the progress that has been made. The
business owner has demonstrated progress by completing the preliminary grading and drainage
plan. Staff feels that past meetings held no assurances that the property owner supported this
preliminary plan or was committed to completing the other 2003 stipulations. Staff is also not
confident that the property owner would ensure the plan was completed. Since August, the
business owner has agreed to purchase the land from the property owner and they have agreed to
terms. Closing is set for late this year. Staff has not been confident the business owner fully
understood the importance of the timing of the schedule originally outlined in the 2003 special
use permit.
Mr. Hickok stated would recommend revoking Special Use Permit, SP #03-14 and approving
Special Use Permit, SP #06-11 with seven stipulations.
Mayor Lund asked Mr. Haluptzok if he reviewed the proposal from staff.
Jerry Haluptzok, Central Avenue Auto Parts, replied that he had.
Mayor Lund asked if he was in agreement with the proposal.
Mr. Haluptzok said he was.
Mayor Lund asked Mr. Haluptzok is he understood the timeline.

Mr. Haluptzok said he did.
Mayor Lund asked if he was going to be the new owner of the land.
Mr. Haluptzok said he hoped so.
Mayor Lund asked what happens with the stipulations if Mr. Haluptzok does not become the
property owner.
Mr. Hickok replied the special use permit does apply to the land. The special use permit and
stipulations gets filed with the county and becomes part of the land.
Mayor Lund said he wanted to make sure Mr. Buzick was aware of the stipulations.
Mr. Hickok replied this does apply to Mr. Buzick with or without him speaking.
Mayor Lund asked if Mr. Haluptzok had spoken to Mr. Buzick and if Mr. Buzick was aware of
the stipulations to the best of his knowledge.
Mr. Haluptzok replied, yes.
Councilmember Bolkcom stated the stipulations spell out what they needed to do.
Councilmember Billings said Mr. Haluptzok said he hoped to closed on the property. He asked
if there was anything that was subject to negotiations.
Mr. Haluptzok replied, not at all.
Councilmember Billings asked if there was any reason why he would not be able to close.
Mr. Haluptzok replied, no.
Councilmember Billings asked staff if they had sent the stipulations to the fee owner.
Mr. Hickok replied the action taken will be sent to Mr. Buzick. He did communicate with the
petitioner/business owner. Mr. Buzick has not received the resolution.
Councilmember Billings asked if they will be sending the letter indicating what action was
taken to the fee owner and require that the fee owner concur with their actions.
Mr. Hickok replied that is the other hearing process. This process is like a rezoning where the
property owner is entitled to be present and to speak, but Council can decide. Mr. Buzick was at
the last meeting. He knew it was carried over to October 9, and he knew that if he had an
interest in the property he should be present at the meeting.

Councilmember Billings asked if the letter that is sent will state that the special use permit runs
with the land and not with the operator or owner of the business.
Mr. Hickok replied that is not a standard part of the letter that goes out but in this particular
case, he would be glad to include the statute that talks about special use permits and their
application to the land.
Councilmember Billings asked that it be sent by mail, return receipt requested.
Mr. Hickok said they will send it that way.
Mayor Lund asked

MOTION by Councilmember Wolfe to adopt Resolution No. 2006-68 and revoke Special Use
Permit, SP #03-14. Seconded by Councilmember Barnette.
UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE
MOTION CARRIED UNANIMOUSLY.
MOTION by Councilmember Wolfe to adopt Resolution No. 2006-68 and approve Special Use
Permit, SP #06-11, for Central Auto Parts to operate a junkyard in an M-1 Zoning District,
generally located at 1201 73 '/z Avenue N.E. with the following seven stipulations:
1. Submit a complete site plan, including parking/storage areas and screening, for
staff review and approval prior to issuance of land alteration permit.
2. Submit a complete landscaping plan, including irrigation plan, for staff review
and approval prior to issuance of land alteration permit.
3. Install first phase of grading and drainage plan (south hal� by June 1, 2007
4. Install screening fence on south side of property by July 1, 2007
5. Install second phase of grading and drainage plan (north half) and any other
required screening fence by October 1, 2007
6. Install landscaping and irrigation by June 1, 2008

NEW BUSINESS:
12. Variance Request, VAR #06-07, by Star Schween, to Reduce the Side Yard Setback
on a Corner Lot from 17.5 Feet to 8 Feet to Allow the Relocation of a Garage,
Generally Located at 6101 Sixth Street N.E. (Ward 1).
Scott Hickok, Community Development Director, stated the petitioner desires to rotate and
move the existing garage closer to the 61st Avenue side of the property and move it so she has
access from Sixth Street. In her hardship statement she said:
At this time my garage faces 61st Avenue and I would like to move my garage so
that it faces the 6th Street driveway. It is hazardous to back out of my garage onto
61st Avenue which is busy with vehicle traffic. However, my other and more
important concern is the sidewalk on 61st Avenue is very busy with residents
going to and from the park on 7th Street. I try to be very careful when backing out
of my driveway, but it really is hazardous and I'm concerned that one of the
children will come down the street so quickly that I will not see them.
Mr. Hickok stated the property is zoned R-1, Single Family Residential, as are all the
surrounding properties. It is located on the northeast corner of Sixth Street and 61st Avenue and
the home was constructed in 1958 and the garage in 1970. A hard surface driveway exists off of
Sixth Street and 61st Avenue to the existing garage location. It is quite a unique situation that it
has two concrete driveways. A 17.5 foot side yard setback is required on a corner. The existing
garage is 27 feet from the yard property line from the south side.
Mr. Hickok stated although City staff had no recommendation on a similar corner lot setback
reduction on Sylvan Lane, staff feels that there was enough significant difference between the
two requests to recommend denial of this request. There are three clear differences as they see
them on these two properties. The current setback of the existing homes along 61st is one of the
key components here. It is clear they would be breaking new ground in putting a structure closer
to 61stAvenue. The garage will have a negative impact on the property at 491 - 61st Avenue. At
the Planning Commission meeting the owner of the property did speak of his concerns about the
impact of this garage in the location being proposed. Finally, the amount of traffic travel on 61st
Avenue, when compared to the University Avenue Service Road is quite different because 61st
Avenue is a collector street, whereas University Avenue Service Road is not. It is a
neighborhood street. All the homes and garages located on 61st Street between Seventh and Fifth
Streets have at least 17.5 feet of setback which complies with City Code. This setback would be
potentially precedent setting for other corner lots.

Mr. Hickok stated the neighboring home is located east of 491 — 61st Avenue and is accessed
from 61st Avenue. Relocating the existing garage 8 feet from the property line, will create a line
of site issue for this property when backing out of their driveway. One of the concerns of the
petitioner is that there is a lot of traffic on 61st and there is a lot of residential foot traffic to and
from the park along that sidewalk and location of the garage would create an additional site line
problem for the folks backing out of 491 - 61st. This would then create a hazardous situation for
the highly traveled 61st Avenue. Before the Commission or Council can grant a variance, it is
the responsibility of the applicant to prove that enforcement of the code will cause undue
hardship.
Mr. Hickok stated City staff has not been able to identify any hardship as defined by law that
would allow them to recommend anything but denial of this request. If the garage is to be
moved, the hardship that may exist currently will change. In reviewing the petitioner's request,
staff applied the legal definition of hardship and developed the following analysis: First, the
property cannot be put to reasonable use if used under the requirements of the code. This
property in its current condition is being used to accommodate the house and garage. The
current garage location is usable and accessible by either Sixth Street or 61st Avenue. The
petitioner could relocate the garage to the northeast corner of the lot which would increase the
usable space in the rear yard without requiring a variance. Petitioner did express a concern about
the utility easement along the east side of the property. The garage could be placed outside of
the easement and even be six feet north of the garage and still set it back an adequate distance to
not cause a visibility problem or change the streetscape along 61st Avenue. You could have a
small turn around in the driveway allowing her to head out onto 61st Avenue. The Planning
Commission had an interesting recommendation and that is to move the garage and set it back
17.5 feet. It would allow for a distance between the house and the garage for maneuvering,
extend the driveway as required, and then remove the existing driveway completely that goes out
onto 61stAvenue.
Mr. Hickok stated second, the need for a variance is due to unique property conditions. There
are no physical characteristics that would deem this site as having unique property conditions.
Petitioner's desire to relocate the garage within 8 feet of the side yard lot line on a corner lot is
not a unique condition. The existing conditions on the site function properly and other options
do exist that do not require a variance.
Mr. Hickok stated finally, the variance will not alter the character of the neighborhood. The
Code does require the side yard setback to maintain a higher degree of traffic visibility and to
reduce the line of sight encroachment into neighboring properties. Relocating the garage to be
within 8 feet of the side yard setback on a corner lot would change the streetscape of the
neighborhood and would affect visibility of motoring traffic. It would also create a hazardous
situation for neighboring properties by limiting their view down 61st and shortening their
reaction time as the driver. Staff recommends denial of this variance because of no undue
hardship, line of sight related to the new location of the garage and the highly traveled roadway
on 61st Avenue, line of site for the neighbors east of the subject property, and granting this
variance would be precedent setting for other properties along 61st Avenue.
Staff recommends if this variance is granted, the following stipulations be attached:

1. Petitioner shall obtain all necessary permits prior to relocating garage.
2. Curb cut on 61st Avenue would be removed and replaced with raised curbing per
City specifications at property owner's expense.
3. Landscape, including boulevard area disturbed by old driveway removal, would
be restored within 30 days of completion of garage relocation.
Mr. Hickok stated that petitioner was not present at the meeting.
Edmond Sworsky, 491 — 61st Avenue, said moving the garage would hinder his site. He said
the Appeals Commission made the right decision.
MOTION by Councilmember Billings to deny Variance Request, VAR #06-07, by Star
Schween, to reduce the side yard setback on a corner lot from 17.5 feet to 8 feet to allow the
relocation of a garage, generally located at 6101 Sixth Street N.E. Seconded by Councilmember
Bolkcom.

BACKGROUND
On August 28, 2006, the City Council tabled the first reading regarding TA # 06-02, a text
amendment initiated by staff. The text amendment was a response to concerns that the City should
clarify in Chapter 6 of City Code a longstanding policy to use Planning Commission members as
substitutes when a quorum was lacking for an Appeals Commission meeting. Such language exists
for Planning Commission substitutes, but not in the Appeals Commission section.
The purpose for this practice of substituting members when a quorum is lacking will allow the City
to meet 60-day action law requirements on land use items and also to provide good customer
service. As we are often struggling, like we are currently, to reach a quorum for meetings with a
vacancy on the Appeals Commission, a substitute plan is necessary.
Questions were raised by Councilmember Billings at the August 28 meeting regarding the potential
need to update other sections of Chapter 6 of the City Code — particularly in language related to
the number of inembers on each commission. Staff has since reviewed the entire Chapter 6 code
sections related to commissions, but has found no other discrepancies that require correction.
RECOMMENDATION
Staff recommends that the City Council continue the text amendment process for the attached
proposed text amendment by removing this item from the table and completing the first reading of
the ordinance at the October 23, 2006, City Council meeting.

INTRODUCTION
Staff noticed several months ago that our procedures and agreement for the disposal of junk
vehicles with Shorty's, the City's contracted towing company, did not match the language in
Chapter 114 of City Code. Staff inet with the City's land use attorney, Fritz Knaak. He
recommended that the code be updated to match our current practice.
Additionally, the current code refers to (1) a code enforcement officer that we no longer have;
and (2) a few State Statutes that need to be more generalized to protect the meaning of the
code when state statute numbers are revised; and (3) a procedure requiring the auctioning of
towed vehicles since staff does follow that procedure.
The proposed text amendment aligns the three procedures described above with staff's existing
operational practices.
PREVIOUS COUNCIL ACTION
The Council held a public hearing, to Amend Ch. 114 Junk Vehicles, on September 25, 2006.

City Staff recommends the Council consider the proposed ordinance TA #06-03, which amends
Chapter 114, Junk Vehicles, of Fridley City Code, to include language that aligns with existing
vehicle towing practices. The first reading of the ordinance will be held at the October 23, 2006,
City Council meeting.

PERTAINING TO ABANDONED JUNK OR UNSAFE MOTOR VEHICLES
The City of Fridley does ordain that Chapter 114 of the Fridley City Code is amended to include
language that aligns with existing vehicle towing practices to read as follows:

CHAPTER 114. ABANDONED JUNK OR UNSAFE MOTOR VEHICLES

114.01. PURPOSE
Abandoned junk and unsafe motor vehicles constitute a hazard to the health and welfare of the
residents of the community in that such vehicles can harbor noxious diseases, furnish shelter and
breeding places for vermin, and present physical dangers to the safety and well being of children
and other citizens. Motor vehicles contain fluids that if released into the environment can and do
cause significant health risks to the community. The condition of vehicles that are junked and
abandoned, junk or unsafe significantly increase the likelihood that these dangerous fluids might
be so released. Abandoned, junk or unsafe motor vehicles and other scrap metals also constitute
blight on the landscape of the city and therefore are detrimental to the environment. The
abandonment and retirement of motor vehicles and other scrap metal constitutes a waste of a
valuable source of useful metal. It is therefore in the public interest that the present accumulation
of abandoned, junk or unsafe motor vehicles and other scrap metals be eliminated, that future
abandonment of motor vehicles and other scrap metals be prevented, t?��t t�� en��r���� �€

useful methods for the disposal of abandoned junk or unsafe motor vehicles and other forms of

114.02. DEFINITIONS
Abandoned Motor Vehicle.
A motor vehicle that has remained outdoors on property within the City for a period of more than
48 hours on public property illegally or has remained for a period of more than 48 hours on
private property without consent of the person in control of such property or in an inoperable
condition such that it has no substantial potential for further use consistent with its usual
functions, unless it is kept in an enclosed garage or storage building. It shall also mean a motor
vehicle voluntarily surrendered by its owner to the City or a duly authorized agent of the City. A
classic car or pioneer car, as defined in Minnesota Statutes, ������-��16��: �� shall not be
considered an abandoned motor vehicle within the meaning of this Section.
2. Unsafe Motor Vehicle.
Any vehicle located outdoors on property within the city in which any systems including
braking, steering, suspension, electrical, lighting, motor, drive train system are not functioning or
a vehicle that cannot legally be driven or is in violation of any state, federal or local vehicle
equipment or safety regulation including, but not limited to Minnesota statutes ?�9.�ti� ��

3. Junk Motor Vehicle.
A motor vehicle that is located outdoors on property in the city that meets any of the following
criteria shall be defined as a junk vehicle:
A. Any motor vehicle that is not in operable condition.
B. Any motor vehicle that is partially dismantled.
C. Any motor vehicle that is a source of repair or replacement parts for other
vehicles.
D. Any motor vehicle that lacks vital component parts.
E. Any motor vehicle that is not currently registered and properly licensed for
operation with and by the State of Minnesota.
4. Vital Component Parts.
Those parts of a motor vehicle that are essential to the mechanical functioning of the vehicle,
including, but not limited to, the motor, drive train and wheels.
Motor Vehicle Definition:
A machine propelled by power other than human power, designed to travel along the ground by
use of wheels, treads, runners or slides and transports persons or property or pulls machinery and
shall include, without limitation, automobiles, trucks, trailers, motorcycles, tractors, 3-wheelers,
4-wheelers and snowmobiles.
114.03. ABATEMENT
The City, or its duly authorized agent, may take into custody and impound any abandoned junk
or unsafe motor vehicle.
A vehicle may be impounded after notice of such proposed impoundment (in a form similar to
that set forth herein) has been securely attached to and conspicuously displayed on the vehicle
for a period of five days prior to such impoundment excluding Saturdays, Sundays and city
holidays for the following reasons:
A. When such vehicle is parked and/or used in violation of any law, ordinance or
regulation; or
B. When such vehicle is abandoned, junk or unsafe.
114.04. VEHICLES IMMEDIATELY SUBJECT TO PUBLIC SALE
When an abandoned motor vehicle is more than seven (7) model years of age, lacks vital
component parts and does not display a license plate currently valid in Minnesota or in any other
state or foreign country, it shall immediately be eligible for sale by a duly_authorized agent of the

City or at public auction and shall not be subject to the notification or reclamation procedures
_
established by this Chapter.
114.05. NOTICE
1. When an abandoned motor vehicle does not fall within the provisions of Section 114.04,
the City shall give notice of the taking within ten (10) days. The notice shall set forth the date
and place of the taking, the year, make, model and serial, number of the abandoned, junk or
unsafe motor vehicle and the place where the vehicle is being held, shall inform the owner and
any lienholders of their right to reclaim the vehicle under Section 114.06 and shall state that
failure of the owner or lienholders to exercise their right to reclaim the vehicle shall be deemed a
waiver by them of all rights, title and interest in the vehicle and a consent to the sale of the
vehicle at a public auction pursuant to Section 114.07.
2. The notice shall be sent by mail to the registered owner, if any, of the abandoned, junk or
unsafe motor vehicle and to all readily identifiable lienholders of record. The notice shall be
mailed to the registered owner at the address provided by the motor vehicle division of the
Minnesota Department of Public Safety or the corresponding agency of any other state or
province. A copy of such notice may be sent to the property owner where the vehicle is found.
If the person mailing the notice has reason to believe that the registered owner of the vehicle, or
one who claims to be the registered owner of the vehicle, is residing or in custody at some
different address, a copy of the notice shall be mailed or personally delivered to such owner or
claimant in a manner designed, as nearly as may be practicable, to give actual notice to him or
her. If it is impossible to determine with reasonable certainty the identity and address of the
registered owner and all lienholders, the notice shall be published once in a newspaper of general
circulation in the area where the motor vehicle was abandoned junk or unsafe. Published notices
may be grouped together for convenience and economy.
114.06. RECLAIM
1. The owner or any lienholder of an abandoned, junk or unsafe motor vehicle shall have a
right to reclaim such vehicle from the City upon payment of all towing and storage charges
resulting from taking the vehicle into custody within fifteen (15) days after the date of the notice
required by Section 114.05.
2. Nothing in this Chapter shall be construed to impair any lien of a garagekeeper under the
laws of this State, or the right of a lienholder to foreclose. For the purposes of this Section,
"garagekeeper" is an operator of a parking place or establishment, an operator of a motor vehicle
storage facility, or an operator of an establishment for the servicing, repair or maintenance of
motor vehicles.
3. To reclaim a motor vehicle impounded pursuant to this ordinance, the owner or
lienholder must pay any costs and administrative fees incurred by the city and must agree to
relocate the vehicle in accordance with local state and federal regulations. The owner or
lienholder reclaiming such vehicle shall sign a"Release of Property" and shall agree to
immediate impoundment without notice if such vehicle again violates this section. In addition,
the City may require a bond to be posted if said vehicle has been subj ect to a prior impoundment.
114.07 HEARING
Any property owner who feels aggrieved by an impoundment of a vehicle under this chapter may
request a hearing before the Hearing Examiner. Such request shall be filed in writing with the
office of the Community Development Director within twenty (20) days after the date of service
of the notice by the City r��'° �'�� r�°m°�+ n���°r The Community Development Director
shall notify the Hearing Examiner who shall notify the property owner of the date, time and
place of the hearing. The hearing shall be conducted no more than twenty (20) days after the
Hearing Examiner receives notice of the request, unless a later date is mutually agreed to by the
Hearing Examiner, the property owner and the City. Both the property owner and the city may
appear at the hearing with counsel and may call such witnesses and present such evidence as is
determined by the Hearing Examiner to be relevant. Within ten (10) days after such hearing, the
Hearing Examiner shall affirm, repeal or modify the order of the City r,,,ao �„�,,,-,.o,�,o„+ n��,.o,-
Notice of the decision shall be mailed to the owner at the address given in the hearing request.
The Hearing Examiner's order shall be accompanied by written findings of fact, and may include
a finding of fact as to the violation of this chapter. Any person aggrieved by the decision of the
Hearing examiner may appeal that decision to the City Council by filing notice of such appeal
with the Community Development Director within twenty (20) days of the mailing of the
Hearing Examiner's decision. At its next available regular meeting following the filing of a
notice of appeal, the Council shall review the decision and findings of fact of the Hearing
Examiner and shall affirm, repeal or modify that decision. If the Council affirms the Hearing
Examiner's decision declaring that a violation of this chapter exists, the City shall proceed to sell
the vehicles after twenty (20) days following the Council's final determination, unless the
property owner obtains a court order to the contrary within said twenty (20) days.
114.08. PUBLIC SALE
1. An abandoned, junk or unsafe motor vehicle taken into custody and not reclaimed under
Section 114.06 becomes the propertv of the duly authorized a�ent of the Citv or shall be sold to
the highest bidder at public auction or sale, following notice published a reasonable time in
advance. The purchaser shall be given a receipt in a form prescribed by the City, which shall be
sufficient title to dispose of the vehicle. The receipt shall also entitle the purchaser to register the
vehicle and receive a certificate of title, free and clear of all liens and claims of ownership.
2. Disposing of unsold vehicles. Abandoned vehicles not sold pursuant to subdivision 1
shall be disposed of in accordance with Minnesota Statutes 1-��R.n� �r.� ��QR n�
3. Disposition of sale proceeds. From the proceeds of the sale under this section of
abandoned motor vehicles, the City shall reimburse itself for the cost of towing, preserving and
storing the vehicle and all administrative, notice and publication costs incurred in handling the
vehicle pursuant to sections 114.01 to 114.09. Any remainder from the proceeds of a sale shall
be held for the owner of the vehicle or entitled lienholder for 90 days and then shall be deposited
in the treasury of the unit of government.
114.09. DISPOSAL AUTHORITY
1. Units of government. The city may contract with others and may utilize its own
equipment and personnel for the inventory of abandoned motor vehicles and abandoned scrap
metal, and if no bids are received, may utilize its own equipment and personnel for the
collection, storage and transportation of abandoned motor vehicles and abandoned scrap metal;
provided, however, that a unit of government may utilize its own equipment and personnel for
the collection and storage of not more than five abandoned motor vehicles without advertising
for or receiving bids in any 120 day period.
114.10. PENALTIES
Any person who abandons a motor vehicle on any public or private property, without the consent
of the person in control of such property, or is otherwise in violation of this Chapter, is guilty of
a misdemeanor and is subject to all penalties provided for such violations in Chapter 901 of this
Code.

Attached is a resolution for the purpose of certifying delinquent utility accounts to the County for
collection with property taxes in the year 2007.
All property owners have been notified that the utility bills are being certified to the County and have
been given adequate opportunity to pay their bill. The penalty shown on this resolution is in addition
to the regular penalties that accrue on the utility bills. The number and dollar value of accounts
varies each year. We cannot be sure of the final count or dollar value until mid-November since
property owners have 30 days after the adoption of the resolution to pay without penalty.

Lions Club of Fridley Application for Premise Permit at Billiard Street Cafe
Inc dba Two Stooges Bar and Grill, 7178 University Avenue NE
Section 30 of the Fridley City Code allows Lawful Gambling by a licensed organization and
limits each organization to two premises within the City. The Twin Cities North Chamber has
been conducting lawful gambling at Billiard Street Cafe Inc dba Two Stooges Bar and Grill
located at 7178 University Avenue NE. They have chosen to discontinue their lawful gambling
and terminated their lease with Two Stooges Bar and Grill effective November 16, 2006. The
Chamber did help recruit the Lions Club of Fridley and they have submitted a premise permit
application. The Lions Club of Fridley currently holds a premise permit at the Shortstop Fridley
(formerly known as Joe DiMaggio's), this would be their second premise.
State law requires a resolution from the City Council approving the premise permit. If approved,
the premise permit would run in conjunction with their current license which expires February
29, 2008. Please find a resolution for the approval of this premise permit.
RESOLUTION NO. 2006 -
RESOLUTION IN SUPPORT OF AN APPLICATION FOR A MINNESOTA LAWFUL
GAMBLING PREMISE PERMIT APPLICATION THE LIONS CLUB OF FRIDLEY AT

WHEREAS, the City of Fridley has been served with a copy of an Application for a Minnesota
Lawful Gambling Premise Permit for the Lions Club of Fridley; and
WHEREAS, the location of the Premise Permit is for Billiard Street Cafe Inc dba Two Stooges Bar
and Grill located at 7178 University Avenue NE; and
WHEREAS, the Lions Club of Fridley., currently holds a state lawful gambling license and
conducts lawful gambling at the Shortstop Fridley which will expire February 29, 2008; and
WHEREAS, Chapter 30 of the Fridley City Code allows a lawful gambling organization to conduct
business at two premises within the city; and
WHEREAS, the City of Fridley has found no reason to restrict the location for the charitable
gambling operation.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fridley approves the
Minnesota Lawful Gambling Premise Permit Application for the Lions Club of Fridley at Billiard
Street Cafe Inc. dba Two Stooges Bar and Grill located at 7178 University Avenue NE for their
current license year expiring February 29, 2008.

New Compensation Policy and Plan
Staff is recommending the approval of the attached resolution and revised Compensation Policy
and Plan for the Oct. 23, 2006 Council Meeting.
This policy and resolution replaces the 1987 version, which was amended on Jan. 1, 1991 with
few substantive changes. Most of the changes clarify how the plan is administered in terms of
increases, transfers, promotions and reclassifications, which were never addressed in the policy
before.
Summary of Chan�es:
1) Scope
a) Remains the same.
2) Classification
a) The new plan eliminates reference to an outdated evaluation system and does not lock the
City into one system going forward, just in case the methodology needs to be change. It
simply states the positions shall be classified using an approved point factor rating
process.
b) In this new study and going forward, we will use the Job Evaluation System generated by
Riley, Dettmann & Kelsey.
3) Compensation
a) The proposed policy is simplified and restates how the compensation plan is applied but
removes references to the statistical process used, trend lines, other forms of
compensation, and insurance.
b) The proposed policy removes the ability of the City Manager to provide for Merit
Awards, which are difficult to administer consistently and practicably as well as defend.

c) The proposed policy includes new language on administering the compensation policy,
from new hires, transfers, demotions and reclassifications.
This proposed policy has been reviewed by our compensation consultant at Riley, Dettmann &
Kelsey. Staff is recommending the adoption of this new policy and plan.

RESOLUTION AUTHORIZING A NEW
COMPENSATION POLICY AND PLAN
WHEREAS, the Minnesota Pay Equity Act of 1984 requires every political subdivision to establish
"equitable compensation relationships amongst its employees; and
WHEREAS, it is the intention of the Fridley City Council to provide fair and equitable compensation to
Fridley City employees and to comply with the Minnesota Local Government Pay Equity Act and other
applicable federal and state laws; and
WHEREAS, City Council authorized City staff to conduct a Compensation Study and Pay Equity audit
for compliance; and
WHEREAS, an adjustment of employee salaries is warranted to remain competitive in the market place,
WHEREAS, the City Council has reviewed the attached Classification and Compensation Policy and Plan
for City Employees; and
WHEREAS, Section 6.02 (g) of the Charter of the City of Fridley states that it is the duty of the City
Manager "to prepare and submit to the City Council the annual budget;" and
WHEREAS, the following adjustments have been considered during the budget process and fall within
the approved budget for 2006 and proposed budget for 2007; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley that the following
Compensation Policy and Plan be adopted, which supersedes any previously approved resolutions and/or
compensation policies.
BE IT FURTHER RESOLVED that the City Manager be authorized to expend funds necessary to
implement the above mentioned plan effective October 16, 2006.

CITY OF FRIDLEY
COMPENSATION POLICY
(Effective 10/16/2006)
It shall be the responsibility of the Human Resources Director to develop and maintain a
Compensation Plan in accordance with state and federal laws for all applicable positions
within the City, subj ect to review and approval by the City Manager and City Council.
The Compensation Plan provides that employees will be assigned an appropriate pay
range which corresponds to their job classification. Pay ranges carry minimum and
maximum rates of pay (see Compensation Plan). An employee shall not be paid less than
the minimum rate nor more than the maximum rate for their assigned job classification,
except in certain circumstances that may be referenced in this policy.
Scope
The classification portion of this plan applies to all employees of the City of Fridley,
apart from intermittent, fractional, temporary-seasonal employees as determined by
Minnesota Statute.
The compensation portion of this plan applies to all employees of the City of Fridley
except those employees who are members of a bargaining unit as determined by the
Minnesota Public Employees Labor Relations Act (MPELRA). Also, the terms of a labor
agreement arrived at through collective bargaining in accordance with the provisions of
the MPELRA take precedence over the compensation provisions of this plan.
Administration of the Compensation Plan
With the exception of the adjustments approved by City Council on 10/23/2006, the
Compensation Plan will be implemented on 1/1/2007 as follows:
New Hire
New regular full-time and regular part-time employees will generally
be hired at the minimum rate of the appropriate pay range. The Human
Resources Director may recommend a starting salary up to and
including mid-range of the appropriate salary level based on prior
comparable experience and/or changing market conditions. Any
recommendation for a pay rate over the mid-range of the appropriate
salary level requires approval by the City Manager.
�
Merit Increases
Employees who successfully complete their twelve-month
probationary period will be given increases based on satisfactory
performance on the anniversary of the employee's appointment to the
position according to the following schedule: 6, 18, 30, 60, 90 and 120
months.
2. The pay difference between steps will be as follows: 5% for steps 1, 2,
3 and 4; and 3.33% for steps 5, 6 and 7.
If an employee is promoted or hired at mid-range, the increases will be
provided at the increment between steps. For example, if the employee
was hired at step 3, they would receive their next increase at the12-
month anniversary date, which is the difference in time between 18
and 30 months. If the employee was hired at step 4, they would receive
their next increase in 30 months or 2.5 years.
4. A performance review must be completed, signed and authorized prior
to any merit increase being given.
Promotion
Generally, when an employee is promoted they shall receive the
minimum rate for the new job classification. If the employee's current
rate of pay, however, is more than the minimum rate, the employee
shall be paid at the next increment step above their former rate.
2. While it is not guaranteed, it is encouraged to offer a ten (10) percent
increase in pay for a promotion where possible. Any promotion must
be placed on a step and not to exceed the maximum rate for that range.
Additionally, if by being promoted, an employee would lose
monetarily because of a missed merit increase under their old salary
level, the employee will be paid two increment steps above their
former rate, provided there are two steps available in which to move
and the increase does not exceed the maximum of the new pay range.
4. Additional merit increases shall be given on the employee's
anniversary date according to the adopted pay schedule (see Appendix
A).
a-
Upward Reclassification
1. If an employee is in a position which is reclassified upward, they shall
receive the minimum rate for the new classification. If the current rate
of pay is more than the minimum rate for the new range, the employee
shall be paid at the next increment step above their former rate.
2. The date for additional merit increases will follow on the anniversary
date of the adopted pay schedule (see Appendix A).
Downward Reclassification
If an employee is in a position which is reclassified downward and
said employee's salary is higher than the maximum rate of pay for the
new classification, that employee's salary shall be frozen and the
employee will not be eligible for future pay increases (including cost
of living adjustments) until the maximum of the salary range for the
new job classification is adjusted beyond the employee's current
salary.
2. If an employee's salary is lower than the maximum rate of pay for the
new classification, the employee shall be placed at the next closest step
without experiencing a decrease in pay for the new classification.
3. Additional merit increases will occur based on the established
schedule based on the anniversary date of the new classification (see
Appendix A).
Transfers
1. If an employee is transferred to a new position with an equivalent pay
scale, the employee's current rate of pay shall remain unchanged.
2. The date for additional merit increases shall be based on the
established schedule until the employee reaches the maximum rate for
the assigned classification.
Demotion
If an employee is demoted, and their salary is more than the
maximum rate established for the class of the new position, the
employee's rate of pay shall be reduced to the maximum rate or a
lower step of the range of the class to which the employee is demoted.

2. If the employee's rate of pay of the former class falls within the
new range of pay, the employee's rate of pay shall either remain the
same or shall be adjusted to a lower step, whichever is closest.
Any additional merit increases will fall within the established
schedule, effective from the date of the demotion until the employee
reaches the maximum rate of pay for the assigned classification.
4. Demotions will be determined by the Human Resources Director after
careful consideration, consultation, and review with the Department
Manager and City Manager.
Acting Appointments or Interim Pay
Acting pay for an employee may be requested by the Department
Manager whenever an employee is required to perform all of the duties
and responsibilities of a non-union position in a higher classification.
The appointment is expected to last for a period exceeding two full
consecutive pay periods and continue for a duration of less than six (6)
months, unless a longer duration is approved by the City Manager.
2. The employee in the acting appointment shall be eligible for a
temporary increase of up to five (5) percent of their current wage or at
the minimum step of the higher salary range, whichever is greater. If
approved by the City Manager, the acting pay will be implemented
retroactive to the first day of the acting appointment and continue for
the duration of the assignment.
An employee classified as non-exempt who assumes an acting
appointment which is also non-exempt, shall continue to be eligible for
overtime compensation. An employee classified as non-exempt who
assumes an acting appointment which is exempt, shall not be eligible
for overtime compensation while performing the duties of the acting
appointment.
4. In the event a merit increase or annual adjustment occurs during the
time an employee is working in an acting assignment, the acting pay
would be adjusted accordingly, taking into account any pay increases
the employee would have received during the course of the acting
assignment. When the employee returns to their regular position, they
would be compensated at their old rate plus the amount of any merit
increase or annual adjustment that would have occurred while they
were in the acting assignment.

JOB CLASSIFICATION PLAN
It shall be the responsibility of the Human Resources Director to develop and maintain a
Job Classification Plan in accordance with state and federal laws for all applicable
positions within the City, subj ect to approval by the City Manager and City Council.
The plan shall classify positions using an approved point factor rating process and an
appropriate pay range will be assigned. The process and the factors utilized are intended
to provide a systematic methodology for evaluating all positions within the City.
Position Reclassification
When an employee and his/her immediate supervisor are convinced, and can clearly
document a substantial change in job content, the following steps are required to initiate
consideration for reclassification of the employee's position:
The employee and his/her immediate supervisor should submit the current j ob
description and a revised job description to the appropriate Department
Manager for review, with the content change(s) clearly identified in any of the
following three (3) categories:
a. addition(s);
b. deletion(s);
c. substantial modification(s)
2. If the appropriate Department Manager agrees that there is sufficient reason to
warrant further consideration of a reclassification action, he/she should
forward the current j ob description and a revised j ob description to the Human
Resources Director with a cover memo detailing the reasons for the changes
and requesting a consideration for reclassification. If the appropriate
Department Manager does not agree that a reclassification is warranted, the
process stops at that point.
If the Human Resources Director concurs with the request for reclassification,
he/she and the Department Manager will meet and re-evaluate the position
together to assure its proper classification and pay range assignment. If after a
careful analysis and the reclassification is agreed upon, a recommendation
will be made to the City Manager for final approval and date of
implementation.
4. In the event there is a maj or disagreement in the recommendation, the City
Manager will review the recommendations and criteria and will make a final
determination.

New Position Request
1. If a Department Manager wishes to create a new position, he/she shall prepare
a job description with the assistance from the Human Resources staff.
2. The Department Manager and the Human Resources Director will meet to
conduct the job analysis, assign points to the position and then establish the
appropriate pay range.
In addition, a financial estimate and market comparison will be prepared and a
written request made to the City Manager for final approval.
Market Review and Adjustments
1. It shall be the responsibility of the Human Resources Director to conduct a
comprehensive review of benchmark positions within comparable cities
identified as peers in the market.
2. The review and comparisons of market data is required to be completed no
less than every three years for key benchmark positions.
3. Peer cities are municipalities which are similar in terms of how services are
delivered, the City's population, location, and structure, and are determined by
the Department Managers, the City Manager, and affirmed by the City
Council.
4. Market data will be obtained from the League of Minnesota Cities, direct
requests, and/or legitimate and commonly recognized pay studies where
practicable.
5. Any recommendations for adjustments based on market analysis must be
made to the City Manager for final approval.
6. From time to time, all salary ranges in the Pay Plan may be adjusted
proportionally and collectively through the annual budget process.

II. SCnPE:
A. The classi.fication porti.on of this �lan applies to all empl.oyees of
the City of Fridley, apart f.rc.m fractional part-time employees, as
determined b� Minnesota Statutes.
B. The compensation po.rtion of this plan applies to all employees of the
city of Fridley except those employees who are membe.rs o:f a bargaining

on the applicable Salary Range to which the em�l�yee is assigned under

of the City of Fridley.

Stacy Stromberg, City Planner, presented a request from John Allen of Industrial
Equities who is seeking to replat the property located at 5110 Main Street to incorporate
a portion of property that he's purchasing from Burlington Northern Santa Fe(BNSF).
BNSF has signed off on the preliminary plat application and is in favor of the replat
application. The petitioner is seeking this replat to allow for the redevelopment of the
subject property.
Ms. Stromberg stated that the subject property was originally developed in 1960 as an
office/warehouse for a building supply company. In 1978 an addition was constructed to
the building, which also involved a variance being granted to reduce the side yard
setback requirement from 20 ft. to 10.5 ft. The property has continued to function as an
office/warehouse used to house a building supply company until 2005, when Guardian
Building Supply Company vacated the site.
Ms. Stromberg stated that the petitioner is seeking this replat to allow the combination
of the existing property and the BNSF right-of-way located west of the subject property.
The subject property is 449,849 sq. ft. (10.33 acres) and the additional rectangular piece
of land being acquired from the railroad is 90,593 sq. ft. (2.08 acres). After the replat the
property will be 12.41 acres in size.
Ms. Stromberg stated that City Staff recommends approval of this preliminary plat
request, with one stipulation. Replat will allow for the redevelopment of the property.
City Staff recommends that the following stipulation be placed upon approval of this
request.
1. Petitioner to pay applicable park dedication fees (540,442 sq. ft. x.023 =$12,430.17)
prior to issuance of any building permits.
Commissioner Savage questioned if Mr. Salzburn had anything to add to the Staff
report.
Jeff Salzburn, Industrial Equities, stated that they would like to merge the two parcels
and have three different design concepts in mind. They hope to make the site more
feasible for development.
Commissioner Kondrick questioned if they planned to add a spur on the property to
load and unload trucks.
Mr. Salzburn stated that they currently have a spur on the property on the south side.
One of the designs would add an additional spur.
Commissioner Dunham questioned if they were ok with the stipulations.
Mr. Salzburn answered yes.
Commissioner Oquist questioned if their plan was to take down the existing building
and build a new structure.
Mr. Salzburn stated that is correct.
Commissioner Savage asked if there were any complaints or comments from
neighbors.
Ms. Stromberg stated that they have not received any calls from anyone regarding this
item.
Commissioner Kondrick commented that this will be a quick construction project.
Mr. Salzburn replied that they should complete the project in six months.

2. Consideration of a Resolution approvinq Climate Protection Aqreement
and work to modify its operational practices, as needed, to meet the
criteria set forth by Climate Protection Aqreement and the attendees of the
2005 Mayors Summit.
Rachel Harris, Environmental Planner, introduced Connie Metcalf and Cynthia
Anderson who were both Fridley residents. They were present at the July 11tn
Environmental Quality and Energy Commission Meeting to present the climate
protection agreements. They will give a brief presentation regarding the Mayors Summit
regarding global solutions.
Connie Metcalf, 860 W. Moore Lake Drive, stated that both herself and Cynthia are
both members of Citizens for Global Solutions. She encouraged citizens to sign on to
the Mayors Climate Protection Agreement. The Global warming is a critical issue for
everyone and we should do what we can to stall, avoid, and improve the situation
regarding global warming. Much of the weather situations are blamed on emission of
gasses. It is up to us as citizens to use non fossil fuels, to avoid production of additional
CO2 gasses. We hope Planning Commission will support the agreement so the Mayor
will sign on to it.
Cynthia Anderson, 5164 Rainier Pass NE, briefly reviewed the Climate Protection
Agreement. It is basically divided into three parts. The first section includes 11
statements as to why it is important. Already people are taking the initiative to reduce
greenhouse gasses. The second section asks Federal and State government to take
measures to reduce greenhouse gasses and it is a United States obligation to do what
we can. The third section lists the kinds of actions Cities may take to meet the Kyoto
targets. The list of suggested items people may take to meet the targets is descriptive
not prescriptive. We know there are priorities, needs and budget for the City of Fridley.
We have just started discussing this agreement and have come up with some great
ideas. Some of those ideas include education and strategies, climate changes at joint
meetings, Cable TV education shows, placing informational sheets in students take
home folder etc.
Ms. Anderson urged the Planning Commission to support their efforts and send a
message of urgency to both the State and Local Government on climate changes.
Commissioner Kondrick commented that this past July was unusually warm and
people were complaining. They soon learned that 75 years ago the heat was greater
than what it is now. Back then we did not keep records. He questioned what we should
do now with information and why we should be acting on this item. This is happening
world wide.
Ms. Harris stated that droughts and floods in the past is a concern now because of the
rate that Antarctic glaciers are melting is faster than in the past. In times that records
were kept, increased rate of inelting has always caused concern.
Commissioner Savage commented on AI Gore's new film has brought out a lot of this
information. She urged people to see his documentary.
Commissioner Kondrick stated that he believed many people may think this is a
political issue, but it is not, it's a Global issue.
Ms. Metcalf stated that many articles have been published on this item and many
scientists say that this is truly happening. There will be a disaster if we don't remedy it
and change our ways. There is a real danger. We encourage Fridley residents to do
what they can to help educate and reduce use of fossil fuels and greenhouse gasses.
Please consider it and send to Council for approval.
Commissioner Dunham agreed that this is a critical issue and we need to do what we
can to conserve.
Commissioner Savage stated that what we do today may not help us but should do it
for the sake of our children and grandchildren. Also we need to keep in mind this is a
Global issue, it goes beyond local parties.

Commissioner Kuechle questioned what was going on in the Hill Top Trailer area, they
have demolished a building.
Ms. Stromberg stated that they decided the building would not work for them and would
cost too much money to renovate it. They demolished the building and are using the
area for a parking lot. There may be something in the future regarding this area.
Commissioner Kuechle asked if Staff has received anything regarding the Lamar site.
Ms. Stromberg replied that nothing has been received.

STREET IMPROVEMENT PROJECT NO. 2005-3
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all obj ections to the proposed assessment for Street Improvement Proj ect
No. 2005-3.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of ten years,
the first of the installments to be payable on or before the first Monday in January, 2007, and shall
bear interest at the rate of 6'/z percent per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2007. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city
treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31
of the year in which such payment is made. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.

RESOLUTION ADOPTING ASSESSMENT FOR THE
2006 STREET IMPROVEMENT PROJECT NO. 2006-2
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all obj ections to the proposed assessment for the 2006 Street Improvement Proj ect
No. 2006-2.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of ten years,
the first of the installments to be payable on or before the first Monday in January, 2007, and shall
bear interest at the rate of 6'/z percent per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2007. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city
treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31
of the year in which such payment is made. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.

Attached you will find the final assessment roll for the 2006 Nuisance Abatement along with the
Resolution to adopt the assessment.
The assessment includes 30 properties at a cost of $27,994.05. The assessment will be certified for 1

I am writing about above stated address, Pin143024410031.
My house is located on a corner, and the length of my
property is roughly 1/2 the length of my street with my
neighbor located at 740 encompassing the other half. My
neighbors across the street(the north side) addressed
785,773,761,and 749 Bennett encompass approximately 1/4 of
the street each.
My reason for the letter concerns the assessments for
street improvements. My misguided impression of the
assessments was that I would be assessed for the frontage
of my property located on the Jackson St. side. The above
said addresses as well as my neighbors located on the
Jackson St. side, are all paying their assessments based on
a figure of 80 - 90 lineal feet of frontage. I am assessed
on 139 lineal feet of frontage. Within this particular area
on the south side of Mississippi, myself, and neighbor
located at 740 are the only ones paying for this additional
footage. I find this discriminatory simply because this is
based solely on which side of the house my mailbox hangs.
I don't receive any other additional benefits because of
this additional assessment.
I would formally like to request a re-evaluation of this
assessment. This would involve a reduction of between $800-
$900. Financially, things are very tight in my household.
For the future look/qrowth of the city I added a driveway
replacement that was very much needed, but not affordable
to me. My wife and I made the decision to bank roll this
through our property taxes, and the adjustment I am
requesting would benefit greatly.
I apologize for the llth hour request, but please don't deem
this any less important. Thank you for your time in this
matter.

Re: Driveway at 206 Rice Creek Blvd
We have lived at this address since 1960. During the recent road project in our area a
portion of the driveway was removed and a new one put in its place. Since that time we
have been having problems with our car bottoming out. We called Dan Belair and he
came to check it out. After much discussion he said he would talk to Jon Haukass and
Layne Otteson and see if something could be done. Next we had a visit from Layne
Otteson. He looked it over and measured and proceeded to tell us that is was exactly the
same as it was before. We just could not believe that. We drive in and out many times a
day (we are retired) and certainly are able to discem if the driveway is different from the
previous one. Never the less Layne was adament and insisted nothing had changed. We
are driving the same car and we ha.ve never had the problem before the work had been
done. It is our belief that a miscalculation was made in the measuring and configuration
of the driveway. Layne observed me backing out and said we had a two inch clearance.
This does not seem sufficient to us. From the beginning we felt the street looked higher
than it had been. When we mentioned this to Dan and Layne they both insisted it was
exactly the same. Now we understand Jon Haukass has indicated the street is
approximately two inches higher. He also said they could not fix our driveway because
they would have to go all the way back to the corner. Does that mean if and when we
have a new driveway put in the problem cannot be corrected without going back to the
corner? It seems obvious to us that a mistake has been made and that could very well be
the cause of our problem. Bob Barnette and Ann Bolkom visited our home on separate
occasions. Each of them observed there is a problem before we had a chance to explain
anything to them. We were relieved simply because the others from city ha11 kept
insisting that it was "exactly the same" and we thought we might be suffering from
dementia. Please believe us - our driveway is not the same. If we had no problem why on
earth would we be going through this process. It is not fun and we have better things to
do with our time. Please reconsider this situation.

Information about New Concrete Driveways
The following information will help you maintain your new concrete driveway:
v Do not drive on your new driveway for a minimum of 5 days after it has been constructed.
v It is recommended to spray water on the new concrete every day for 2 weeks starting the day after the
concrete is poured. This will help the concrete to cure and give a stronger resu}t. -
Information about New Blacktop Driveways
The following information will help you maintain your new blacktop driveway:
v You should not drive on your driveway for a minimum of one week after it is constructed.
v It is recommended not to park any vehicle, trailer, motorcycle, bicycle, etc. on it for at least six months
following construction especially when the temperature is above 60 degrees Fahrenheit. In addition, do
not make any sharp turns on the new surface. Parking or making sharp turns on a blacktop driveway in
the first year could permanently damage your driveway.
v Waiting a minimum of three years before applying any sealer to your new blacktop driveway, is
recommended.

Comments:
The conduit and wire for power out to a small garage was cut during the replacement of my
driveway. The cut is located approximately 4 feet from the garage and 8 feet from the house. There
is an accessible electrical box inside the wall of the house in which the power goes out. There is
also a junction box in the garage which the power comes in. I would like a quote to have the wire
rerun from the house to the garage and the conduit repaired or replaced, which ever is more cost
effective. Currently the end of the conduit running from garage to the cut is damaged and is crimped
on to the existing wire on that end. The conduit from the house to the cut is still in good condition
and can probably be reused, I believe. I would like a quote as soon as possible.

1U Steps for Hiring Service Professionais
#1. Confirm the sales person works for the company.
• Verify that the individual with whom you are speaking is an authorized agent of the company that was referred by
ServiceMagic.
#2. Ask for a copy of the company's license.
� Ask the company to provide a copy of their license. It is important that you verify the license is still in good standing.

#3. Ask for proof of insurance.
• Ask the company to provide a copy of their insurance certificate. We recommend that you verify with the insurance
agency or carrier that the po�icy is still in good standing. General Liability insurance generally covers a contractor for
accidents that occur while the contractor is working, however there are exclusions to coverage, and you should
confirm the actual scope of the contractor's coverage directly with the contractor.
We recommend that before working with a service professional, you verify that information presented is still current and/or
acceptable to you. While ServiceMagic may be notified of changes in member service professional insurance coverage
which then was confirmed with insurance agents or companies, we cannot guarantee that insurance information is still
valid at time of presentation so we recommend that you obtain a copy of the service professional's insurance certificate

#4. Finalize the contract before starting on a project.
A good contract...
• Should be written on company letterhead.
• Should contain the company's name, address, phone numbers, and license number (if applicable).
• Should contain the consumer's name, address (where work is to be performed), and phone numbers.
• Is dated when it is written.
• Includes a detailed description of the work that is going to be performed.
• Provides dollar amounts associated with each task included in the project.
• Includes an anticipated start and finish date.
• Provides a payment schedule.
• Includes a termination clause.
• Contains a clause that protects you the homeowner from any potential mechanics liens once you have paid the
contractor in full.
• Clearly states whether permits will be pulled, and who will be responsible for pulling them.
#5. Make payments to the company that was referred.
• Do not pay an individual.
#6. Avoid paying with cash.
• Check and credit cards are preferable, and be sure to get a receipt for all payments.
#7. Withhold final payment until you are satisfied with the project
� Don't pay in full until the project is comptetely finished and you have completed your final inspection.
� If sub contractors were used, be sure to get signed releases from all sub contractors clearly indicating that they have
been paid in full by the general contractor.
� For larger projects, don't make the final payment until you have passed the final building inspection.

Dear Mr. Pogatchnik:
We propose the following electrical work:
We will replace the conduit running from the garage to the house that was tom up by the driveway
contractor. We will have to drill through the existing concrete slab and dig under it to get the conduit into
the garage. We will hand dig approximately 10 feet to the house and connect to the existing junction
box. We will install new wire and tie in the circuits and test them for proper operation.
Price for above work is Three Hundred Fifty Dollars and NO cents ...............................................

Additional Terms and Conditions
All work will be pertormed during normal working hours.
AII Change Orders will be signed by both parties before additional work will be scheduled or completed.
Customer understands that Wessel Electric requires a notification of at least five working days in order to schedule wortc and does
not schedule wak for customers that are not in compliance with contract payment temis and will not be held liable for delays, or
costs caused by delays, due to customers non c�mpliance with the payment terms of this contract
An additional trip charge, as noted above, will be added if it is necessary for WESSEL ELECTRIC employees to make an
additional trip to wire or hang missing items that are to be provided by others and are not on site at the time we are scheduled to
perform the electriql worlc.
Wessel Electric and customer adcnowledge that this bid has been created from plans and speafications, provided by the a�staner,
which may or may not be the most current information available at the time the work actually cbmmences. It is the customers
responsibility to review this proposal to determine if there are any discrepanaes beiween it and their plans and specificatioru. In
cases where there are discrepanaes beiween this proposal, and any plan or speafications, it will be the actual count of the items
installed, at the above noted unit prices, that will prevail.
All material is guaranteed to be as speafied. All work to be completed in a professional manner ac�rding or exceeding standard
industry practices. Any alteration or deviation from the above specifiqtions involving e�ra costs or administration will be executed
only upon written orders, and will become an extra charge over and above the estimate. All agreements are contingent upon
strikes, acadents, or delays beyond our control. Owner is to carry fire, tomado, and other necessary insurance. Our workers are
fully covered by workers compensation insurance and our company is fully licensed, bonded, and insured per legal requirements.
By accepting this proposal the undersigned adcnowledges the responsibility for payment both personally and on behalf of any
company or entity involved. Additionally, no one other than WESSEL ELECTRIC shall perform electriql work on the premises that
this proposal refers to from the time this proposal is accepted until after we have received our final inspection from the authority
having jurisdicGon and payment for all work done, induding extras.

Any additional requirements by any authority having jurisdiction not speafically stated in this proposal shall be extra. Any damage
to finish or frame of structure on which electrical vvorlc is being performed due to said performance of electripl work shall be fhe
responsibility of others to repair and pay for. Any damage to plantings, shrubbery, landscaping, retaining walls, curbs, ECT. Due to
trenching for elechiql work in this proposal shail be the responsibility of others to repair and pay for. All trenching and badc filling
shail be done in a manner so as to cover the wiring ad conduits per the National Electrical Code, any settling or additional work
required to bring the area trenched to the previous state before trenching shall be the responsibility of others to repair and pay for.
Due to the volatility of the metals futures market we are unable to secure priang quotes for wire, steel producLs, and petroleum
based products from our suppliers for the duration longer than one day. While this proposal states that it is good for 30 days, we
reserve the right to change the priang to cover any cost increase when the futures market goes up by 10% or more for c:opper,
aluminum, steel, PVC pipe, or any other material of inetal or petroleum construction. All quotes will need to be re-priced after the 30
day period has expired. Additionally, should a particular product not be available at the time of installation- we reserve the right to
install a different product (i.e. aluminum in lieu of oopper) for the same application so long as it meets the National Electrical Code.
