A RESOLUTION APPROVING SPECIAL USE PERMIT SP# 10 -11
FOR CARLSON PROFESSIONAL SERVICES, GENERALLY LOCATED AT 7011
UNIVERSITY AVENUE NE
WHEREAS, Section 205.09.1.C.(7) of Fridley City Code allows independent living, assisted living,
nursing homes and home for the elderly in an R -3, General Multiple Units zoning district by a
special use permit; and
WHEREAS, on November 17, 2010, the Fridley Planning Commission held a public hearing to
consider a request by Carlson Professional Services, on behalf of the property owner William
Fogerty, generally located at 7011 University Avenue NE in Fridley, legal description attached in
Exhibit B, for a Special Use Permit SP# 10 -11 to allow an independent living, assisted living and
memory care senior living facility; and
WHEREAS, on December 6, 2010, the Fridley City Council approved the stipulations represented
in Exhibit A to this resolution as the conditions on Special Use Permit SP# 10 -11; and
WHEREAS, the petitioner, was presented with Exhibit A, the stipulations, at the December 6, 2010
City Council meeting;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that the
Special Use Permit SP# 10 -11 and stipulations represented in Exhibit A are hereby adopted by the
City Council of the City of Fridley.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 6TH
DAY OF DECEMBER, 2010.

SP# 10 -11 Special Use Permit for an Independent Living, Assisted Living and Memory
Care Senior Living Facility
Carlson Professional Services on behalf of William Fogerty, generally located at 7011
University Avenue NE, Fridley, MN
Stipulations
1. The petitioner shall obtain all necessary permits prior to construction.
2. The petitioner shall meet all Building code, Fire code, and ADA requirements.
3. The petitioner shall comply with all sign code requirements for installation of new
signage on the property.
4. Landscape plan to be reviewed and approved by City Staff prior to issuance of building
permit.
5. The petitioner shall receive Rice Creek Watershed District approvals prior to issuance of
a building permit.
6. City engineering staff to review and approve grading and drainage plan prior to issuance
of building permits.
7. If the proposed development is modified to be used for units other than, independent
living, assisted living and memory care units, a new special use permit will need to be
obtained.
8. Per Section 205 of the Fridley City Code, this Special Use Permit will become null and
void one year after the City Council approval date if work has not commenced or if the
Petitioner has not petitioned the City Council for an extension.
9. The petitioner shall provide a trail for residents to access the park and trail as part of this
project.
