RES 2010-91 - 14776RESOLUTION NO. 2010 - 91 A RESOLUTION APPROVING A DEED OF OUTLOT C, SHOREWOOD PLAZA REVISED TO GEORGE APPLEBAUM, SHOREWOOD PLAZA GENERALLY LOCATED AT 1001 EAST MOORE LAKE DRIVE NE WHEREAS, The City held its public hearing on April 18,1988 to vacate the street and amend Appendix C of the City Code; and WHEREAS, The First Reading of this action was held on May 2, 1988 and the second reading was held on June 6, 1988: and WHEREAS, On May 2, 1988 the City Council declared the underlying property from the street vacation as surplus property and passed a first reading of an ordinance to deem the land excess and authorize the disposal of said land; and WHEREAS, On June 20, 1988 the City Council passed the second reading of the ordinance to deem the land excess and authorize the disposal of said land; and WHEREAS, the legal description of the property to be disposed of was as follows: All that part of Lots 16 and 17, Auditors Subdivision No. 88 lying between the east right -of -way line of State Highway No. 65 and a line thirty feet east of said right -of -way of State Highway No. 65 and lying south of the westerly extension of the south lot line of Lot 8, Block 2, Moore Lake Highlands 3rd Addition extended to the easterly right -of -way line of State Trunk Highway 65 and north of the westerly extension of the north right -of -way line of West Moore Lake Drive, as platted in the Plat of Shorewood Plaza, extended to the easterly right -of -way line of State Trunk Highway No. 65 All lying in the South Half of Section 13, T -30, R -24, City of Fridley, County of Anoka, Minnesota; and WHEREAS, In consideration of the fact that back taxes were due and numerous owners of properties were required to sign the Shorewood Plaza Plat; and WHEREAS, The plat required 21 years to actually file, but that work was completed in 2009 after a signature page revision to reflect new owners; and WHEREAS, The legal description on the revised plat filed was simplified to be described as: Outlot C, Shorewood Plaza Revised; and WHEREAS, Outlot C is identical in every other aspect to the property to be deeded by the description on the aforementioned 1988 Plat; and Resolution No. 2010 -91 Page 2 WHEREAS, Council through this action reaffirms the action of the 1988 City Council to Deed the property; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley agrees that the Outlot C, Shorewood Plaza Revised, formerly known as: All that part of Lots 16 and 17, Auditors Subdivision No. 88 lying between the east right -of -way line of State Highway No. 65 and a line thirty feet east of said right -of -way of State Highway No. 65 and lying south of the westerly extension of the south lot line of Lot 8, Block 2, Moore Lake Highlands 3rd Addition extended to the easterly right -of -way line of State Trunk Highway 65 and north of the westerly extension of the north right -of -way line of West Moore Lake Drive, as platted in the Plat of Shorewood Plaza, extended to the easterly right -of -way line of State Trunk Highway No. 65 All lying in the South Half of Section 13, T -30, R -24, City of Fridley, County of Anoka, Minnesota is to be deeded to Shorewood Plaza LLC, 4109 Highwood Road, Orono, MN 55364, a land partnership formerly known as: Shorewood Plaza Partners, 2233 North Hamline Avenue, Suite 220, Roseville, MN 55113 PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 13TH DAY OF DECEMBER, 2010. � , A Nd SCOTT J.
