WHEREAS, Public Works services provided in our community are an integr�al part of the
everyday lives of our citizens; and,
WHEREAS, the support of an understanding and informed citizenry is vital to the e�cient
operation of Public Works systems and progr�ams such as water; sewers, streets and highways,
public buildings, and snow removal; and
WHEREAS, the health, safety and comfort of this community gr�eatly depends on these facilities
and services; and,
WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design,
maintenance, and construction are vitally dependent upon the efforts and skills of Public Works
personnel; and
WHEREAS, the e�ciency of the qualified and dedicated personnel who staff public works
departments is materially infZuenced by the people's attitude and understanding of the

PEACE OFFICERS MEMORIAL DAY: May Is� ZOII
WHEREAS, the quality of life in the United States is preserved and enhanced by the diligent efforts of
law enforcement personnel; and
WHEREAS, 700, 000 men and women in the United States, including more than 9, 000 Minnesota peace
offzcers, and 37 Fridley police officers serve their fellow citizens as law enforcement officers; and
WHEREAS, Minnesota has lost 245 law enforcement officers in the line of duty since 1874 and the
national toll is approaching 19, 000 fallen officers; and
WHEREAS, Minnesota lost two peace officers Maplewood Police Officer .Ioe Bergeron and Mahnomen
County Sheriff's Deputy Christopher Dewey in the line of duty in 2010; and
WHEREAS, 152 peace officers across the Nation were killed in the line of duty during 2010; and
WHEREAS, every year, 1 out of every 9 peace offzcers is assaulted, 1 out of every 25 peace officers is
injured, and 1 out of every 4, 400 peace officers is killed in the line of duty; and
WHEREAS, on average nationally, over 59, 000 officers are assaulted resulting in over 16, 000 injuries
annually; and
WHEREAS, on May 1 S, 2011, Fridley police officers will join all U.S. peace officers and the families of
their recently fallen comrades to honor those officers and all others who have made the ultimate
sacrifice:
NOW, THEREFORE, BE IT RESOLVED, that I, Scott J. Lund, Mayor of the City of Fridley, do hereby
proclaim May 1 S through 21, 2011, as National Police Week, and Saturday, May 1 S, 2011, as Peace
Officers Memorial Day in the City of Fridley in honor of Federal, State and local officers killed or
disabled in the line of duty; and

Mary Smith, City Assessor said the meeting was a continuation of the Local Board of Appeal
and Equalization meeting held on April 11, 2011. The purpose of the meeting was to establish
the 2011 estimated market value on four contiguous properties which have three adj oining
buildings.
Ms. Smith said the Board has three possible courses of action that can be taken. To affirm,
reduce or increase the current value based on information presented. If the property owner feels
the Board did not resolve his concerns, he may appear before the County Board of Appeal and
Equalization which will be held on June 13 at 6 p.m.
Ms. Smith said there are four property values in question in regards to the 2011 assessment.
They are:

Ms. Smith said the property located at 7891 — 7893 Elm Street NE consists of a metal framed
and sided building. It is 9,000 square feet and was built on two pin numbers. It is a basic storage
building with no interior finishing. This building is currently being leased as a storage facility.
The property located at 7891 Elm Street NE sits in the middle of 7893 and 7847 Elm St NE. It is
considered just a shell building which can be used for storage or light manufacturing. It consists
of 4,240 square feet. It has no interior finishing. This property is currently vacant.
Ms. Smith said the property located at 7847 Elm Street NE is adjoined to the south end of 7891
Elm Street. It is considered just a shell building which could be used for storage or light
manufacturing. The building consists of 4,200 square feet. There is an office area which has
low quality finishing. This property is currently vacant.
Ms. Smith said that each of these three buildings has a common wall separating them; however,
there is an entrance leading into each of the buildings from the adjoining one. There are no
doors to secure each building alone. After adjustments were made to these properties recognizing
common walls and adjusting the perimeters of each building, it is staffs' recommendation that
the values be adjusted to the following:

Mayor Lund asked if it was typical to do appraisals and if staff felt comfortable the estimate
should be lowered. He also asked if there was any discussion with the County on this issue.
Ms. Smith answered no. Adjustments were done to the perimeters and the office finishing was
removed. After making these adjustments, especially to the perimeter with the common wall and
no security going from one to another, it made a big difference.
Councilmember Bolkcom asked when staff had been in the buildings last.
Ms. Smith said that they had been in the northern building, 7893, quite a few years ago.
Councilmember Bolkcom asked if there was any indication at that time there was a common
wall.

Ms. Smith answered no; looking at an aerial view and from the exterior there is no way anyone
would know it is there.
Councilmember Bolkcom asked why there are two pin numbers.
Ms. Smith answered because that is how it was built.
Mayor Lund asked if the building was sold again if it could become one pin number.
Ms. Smith said it could be combined as one pin number now if the owner desired.
Councilmember Barnette asked what used to be in that location.
Tashitaa Tuffa, Property Owner, said he was happy with the new appraisal and said that Able
Welding was in the building previously.
Councilmember Varichak asked how long Mr. Tuffa owned the property.
Mr. Tuffa said he acquired the property in 2005-2006.

PROCLAMATION:
Poppy Days (May 20 and 21, 2011).
PRESENTATION:
Lona Schreiber introduced herself and said she was the new Met Council Representative for
District 2. There are 16 seats which are all appointed by the Governor. There were 250
applicants and through a competitive process, the seats were appointed and sworn in on March 6.
Representative Schreiber said she will serve on the Transportation and Environment
Committee. She will work on metro waste issues in the environment. Other areas she will be
involved with include regional parks, transit, and the comprehensive plan.
Councilmember Barnette thanked Representative Schreiber for all the work she put forth for
the Northstar Commuter Rail.
Councilmember Bolkcom noted that the bus shelters in Fridley are not taken care o£ There is
trash all over and they are very run down. Also the bus shelter on Mississippi and East River
Road were removed and only a two-week notice was given that they were going to be removed.
She asked how people who use the shelter were notified they were being removed. She said they
just wanted to make is safe for people who use the bus.

Mayor Lund said recently he has heard complaints about the unsightly shelter on University
Avenue. Council has asked for volunteers to clean it up.
Councilmember Barnette mentioned the chain link fence area. He said it was hard to keep that
up. The City tried to get the fence taken down by the state and was unsuccessful.
Councilmember Bolkcom said MnDOT used to mow the area on University. It would cost the
City around $34,000 to mow that area. The City has less money to work with because there is no
LGA so we do not mow that area and MnDOT does not mow it either.

change orders for several months. This is the final payment.

Parking near Mailboxes and Chapter 901 Penalties (Tabled March 28, 2011)
MOTION by Councilmember Bolkcom to remove this item from the table. Seconded by

Don Abbott, Director of Public Safety, said staff originally presented this issue to Council at
their March 28 meeting. After discussion, Council tabled the item for revision by staf£ Staff is
recommending an ordinance prohibiting parking that obstructs or interferes with the delivery of
U. S. Mail during mail delivery hours.

Chief Abbott said staff originally presented ordinance language prohibiting parking within 10
feet of curbside mail boxes between the hours of 8:00 a.m. and 5:00 p.m., Monday through
Saturday. After hearing from a resident and following discussion, Council directed staff to
research neighboring cities with Code sections that simply prohibit parking that obstructs mail
delivery and excludes legal holidays. Staff contacted representatives from both Blaine and
Spring Lake Park and learned that their Code sections adequately address the issue of missed
mail deliveries due to vehicle parking in their cities.
Chief Abbott said staff drafted new ordinance language which is presented for first reading.
This revised language makes it a petty misdemeanor violation to park a vehicle so that the pickup
or delivery of U.S. mail is obstructed or interfered with during the hours of 8:00 a.m. and 5:00
p.m., Monday through Saturday, exclusive of Federal holidays or other days designated as non-
delivery days by the U.S.P.S. This language would automatically exclude Saturdays from
enforcement should the Postal Service discontinue Saturday delivery at some point in the future.
This language also requires that a violation only occurs when mail delivery is actually
obstructed. Therefore, once mail delivery has occurred for the day, no violation is committed by
parking near or in front of a mailbox.
Chief Abbott said staff recommends the first reading of the ordinance.
Councilmember Bolkcom asked if someone was parked in front of a mail box and they did not
get their mail and the car is still there, if they could call the police and the person could get a
ticket.
Chief Abbott said they would need to have proof that the vehicle was parked there and was the
one that prohibited the mail delivery. Police would have to know through a witness or admission
which vehicle was the one that prohibited delivery. The language is similar to the snowbird
ordinance regarding snow removal.
Councilmember Bolkcom said someone cannot call the police at noon to report a car in front of
the mailbox. The mail has to not be delivered correct?
Chief Abbott said the parked car has to obstruct or interfere with mail delivery. If the postal
carrier walks around the parked car to deliver the mail, it would not be a violation because they
received their maiL Most postal carriers, however, will drive right by and not deliver the mail.
Councilmember Bolkcom said she was comfortable with the new language. It was a nice
compromise. She said she was not sure how this would work If it does not work, the language
may need to be stronger.
Mayor Lund said Council will receive phone calls if the language becomes too restrictive. This
could pose a hardship in some neighborhoods and there are corrections that can be done to make
multiple mailboxes so this would not be so restrictive on some streets.
MOTION by Councilmember Bolkcom to waive the reading of the ordinance and adopt the
ordinance on first reading. Seconded by Councilmember Barnette.

NEW BUSINESS:
5. Consideration of Livestock License Request by Sara Sangiovanni, 1568 Gardena
Avenue N.E. (Ward 2)
Scott Hickok, Community Development Director, said staff received an application request to
allow a chicken coop in a residential property for up to six chickens. The current livestock
ordinance does allow this type of request. This is one of the nicest and complete applications
received to request anything in the animal section of the code. It is important to have the chicken
coop 30' from any property line. In this case the coop is 60 square feet with a small portion for
chickens to stay and the rest is a screened in yard area. The chickens would never be running
free outside of the coop.
Mr. Hickok said this property backs up to the Innsbruck Nature Center and the plot is long
which provides ample opportunity to put up this coop. The application even specified which
type of chickens they want. All the chickens they are considering are breeds that do not make
noise. They do not intend to have roosters. After reviewing the application, all code
requirements are met and staff recommends approving this license.
Councilmember Varichak asked what the maximum number of chickens they could have was.
Mr. Hickok said the ordinance does not list a maximum, but the request is for up to six
chickens. Based on the size of the coop, six is a reasonable number.
Councilmember Varichak asked what would happen if there was a seventh chicken.
Mr. Hickok said there will be no roosters so it is not likely to happen. The license is reviewed
annually, so if there is a seventh chicken, the livestock license would not be renewed.
Councilmember Varichak asked if staff heard from any neighbors.
Mr. Hickok answered no, this variance does not require a mailing because it meets all
requirements. If neighbors do complain and problems arise in the first year, Council may choose
not to renew the license.
Councilmember Varichak asked if there was a chance that critters or other animals would try to
get to the eggs or chickens. She wondered if neighbors would be fearful of other animals coming
into the area.
Mr. Hickok said that the coop is designed to keep the laying area off the ground and is screened
in to keep out unwanted predators.

Councilmember Barnette said this is a similar request to the pigeons on Rice Creek Road. To
date, no complaints or concerns have been made from any neighbors about the pigeons.
Mr. Hickok said that is correct, staff has not received any complaints about the pigeons. The
racing pigeon license is up for renewal and it looks like there was an expansion to the original
building so they may have to bring the building to compliance before that license is renewed.
Councilmember Varichak noted she did not see the word fowl in the code and asked if it
needed to be added.
Mr. Hickok said that fowl is defined in the livestock definition; it further describes that some
animals need an acre per head but that does not include fowl.
Councilmember Bolkcom said she was concerned about the odor and it going into compost.
She wanted to make sure the smell would not be a problem with neighbors.
Sara Sangiovanni, 1568 Gardena Street, said she does not want it to smell either. There will be
proper ventilation and it will be cleaned frequently. The coop is designed with an easy drawer to
open to clean out the droppings. This will be cleaned out frequently to keep the odor away and
the chickens healthy.
Councilmember Saefke asked what the life expectancy was of a chicken.
Ms. Sangiovanni answered two to three years.
Councilmember Saefke asked where the chickens would go after two to three years.
Ms. Sangiovanni said they would go to a processing plant or her father's farm.
Councilmember Saefke asked where the chickens came from.
Ms. Sangiovanni answered a local farm.
Mayor Lund asked Ms. Sangiovanni to be neighborly.
Ms. Sangiovanni said she would and her neighbors will get free eggs.
Councilmember Bolkcom noted that the license needs to be renewed annually and any
complaints will be brought forth to Council.
Councilmember Varichak noted a correction on page 22 under manure removal; "ad will
mulch material" should be changed to "and will mulch material".
MOTION by Councilmember Varichak to approve the Livestock License Request by Sara
Sangiovanni, 1568 Gardena Avenue N.E. Seconded by Councilmember Bolkcom.

6. First Reading of an Ordinance Creating Chapter 205.33 0-8 of the Fridley City Code
Pertaining to Northstar Transit Oriented Development Overlay Zoning District
Regulations.
Scott Hickok, Community Development Director, said at the last meeting Council continued this
reading. Public testimony has been taken and no modifications have been made since the last
meeting. Staff is recommends Council's approval.
Mayor Lund noted that Ms. Reynolds sent an email and he responded. He clearly understands
her concern. Council has heard from enough people who were against this or fearful it would
harm the neighborhood, but others have come forward saying a change is needed and are very
optimistic. There has been zoning in place for the last 30 plus years, and not a lot of
redevelopment has happened to improve the area. We will not know for quite some time if what
we are doing today will be a success or not.
Councilmember Bolkcom said people seemed concerned about the number of rental properties
and a lot of the areas need help. Many landlords are absent from the buildings and there is
concern that more rentals will come into the area. This may not spur rental to change in the near
future, but hopefully will bring about a good change. She appreciates everything that was heard
from the neighborhood; this is a unique neighborhood with special zoning.
Councilmember Varichak cautioned the City to be careful about what kinds of things are
brought to the area as a protection to Hyde Park The City wants good plans and good
development. We need to make sure to take care of what is in Hyde Park and to stay somewhat
true to what the area is.
Councilmember Saefke said this TOD will be beneficial to the City as a whole. There are
places between there and the river that will need some major upgrades and there is no one
coming around to do it. It will be better that the properties are more attractive which will be

better for the clientele who live there. If something can be built with the same amount of density
and make it into townhomes or some other owner-occupied building that would be even better.
Council takes to heart the comments from the public hearings and special meetings. This is
primarily for the benefit of the people in the neighborhood, not for the Northstar Station; that is
secondary. People are afraid of change but had the City not changed through the years, this
would still be a rural area. The reality is we are not going back to that. The metro area has
grown and people want to live close to their jobs, bus, train, light rail etc. where they can walk,
bicycle or use other means of transportation to get to where they need to go.
Councilmember Barnette agreed that this will be a good tool for the city. We have all been
here long enough to see how Fridley has grown. The City needs redevelopment and people need
to trust Council to make good, positive decisions for all of Fridley. In the next few years,
proj ects will happen that will change Fridley in a good way.

7. First Reading of an Ordinance Amending Chapter 11 of the Fridley City Code
Pertaining to General Provisions and Fees.
Scott Hickok, Community Development Director, said the creation of a Transit Oriented
Development (TOD) District will require changes to the fees found in Chapter 11. These
additions include the $1,500 TOD application fee and a$500 fee that may be paid in lieu of
landscaping requirements.
Councilmember Bolkcom said that people have to pay $500 and have a landscape design.
Mr. Hickok said that is correct; the plan has to be reviewed and approved.
MOTION by Councilmember Bolkcom to waive the reading of the ordinance and adopt the
ordinance on first reading. Seconded by Councilmember Saefke.

8. Receive Bids and Award Innsbruck Water Main Lining Project No. 397.
Jim Kosluchar, Public Works Director, said this project is a 12" water main on north Innsbruck
Drive. Three main breaks have happened in this area in the past three winters. Repairs are
expensive due to the large main and concrete street. This is a cooperative project for water main
rehabilitation with the Cities of Golden Valley and Hutchinson. Trenchless cured in place pipe
liners will be installed with a process similar to the sewer main lining. A newer technology will
be used in this area.

Mr. Kosluchar said there will be minimal disruption. Excavation pits along the main will be
lined. Individual water services require no excavation. The liner is impregnated on-site with
epoxy resin and is then pulled in place through the host pipe. Service connections are reinstated
robotically. This project meets NSF/ANSI Standard 61 and is a stand-alone structural liner.
Mr. Kosluchar said this proj ect was originally bid in August of 2010 and was over budget so the
bids were rejected. The City of Golden Valley completed one segment last fall. The remaining
project segments were rebid in April 2011. Three bids were received and Fer-Pal Construction
USA, LLC, of Taylor, Michigan, was the low bidder. The cost for all segments is $1,174,755.72
and Fridley's project total is $346,057.00. This is $5,000 under budget.
Mr. Kosluchar said the proj ect was completed for the CIPP lining segment for the City of
Golden Valley in the Fall of 2010, and they did provide a positive reference. Fridley's segments
will be done first. A preconstruction meeting will be held next week Construction is likely to
start in May and be complete in late June. Notices will be distributed upon City Council action.
Mr. Kosluchar said Golden Valley is considering this award at their May 3, 2011, meeting.
Staff recommends approval of the award to Fer-Pal Construction USA, LLC of Taylor, MI, in
the amount of $1,174,755.72.
Councilmember Bolkcom asked who Fridley would pay.
Mr. Kosluchar said Fridley would make payments to Golden Valley per the agreement.
Councilmember Bolkcom asked if the amount Fridley will pay should be part of the motion.
Fritz Knaak, City Attorney, said Council can be specific if you want.
Mr. Kosluchar said staff is recommending going ahead with the project at this price and is
comfortable with the contractor.
Councilmember Bolkcom said usually Council reviews and awards a specific amount, this is an
unusual request. The bid came in at $5,000 under budget; she asked if the bid is pretty accurate
and if staff felt comfortable there would not be many change orders.
Mr. Kosluchar said that everything cannot be predicted and staff is aware we are very close to
the budget.
Councilmember Bolkcom said this project is similar to others that have had overruns.
Mr. Kosluchar said a past project where the water main was televised sent cameras out and
robotic to cut the pipe. The robotic cutter did not hit the ratio so the surface had to be dug out.
In this project that allowance was eliminated and the contractor will have to pay if there is a cost
for digging.

9. Approve Cooperative Agreement Between the City of Minneapolis and the City of
Fridley Regarding Bicycle Parking Project.
Jim Kosluchar said the Transit for Livable Communities (TLC) project is to fund bicycle racks
in selected metro cities. The pilot communities were invited to enroll in the BWTC Bike Parking
Program. Rachel Harris, Environmental Planner and SHIP coordinator, attended the enrollment
meeting where the program was presented. The program provides a guaranteed amount of
funding to each eligible community that elects to participate. Fridley is one of 15 eligible
entities ($4,200). Approximately 30 to 40 racks and hardware can be purchased depending on
the types selected.
Mr. Kosluchar said that staff has prioritized eligible locations as follows:
1. City facilities, including parks;
2. Schools;
3. Other government entities (such as the Anoka County Library); and,
4. Private businesses
It appears most of the bike racks, if not all, will be utilized in Categories 1 through 3.
Mr. Kosluchar said if remaining racks are available, candidate businesses will be contacted by
staff. The responsibility for installation is the grantees and must be installed by October 31,
2011. The racks must remain in place for five years.
Mr. Kosluchar said the City of Minneapolis offered to act as the fiscal agent for this project.
The attached agreement authorizes the City of Minneapolis to purchase materials on behalf of the
City of Fridley. This enrolls Fridley in the program.
Councilmember Bolkcom asked what the City had to do if the bike racks needed to be
relocated.
Mr. Kosluchar said Minneapolis would need to be alerted because they have done all the
purchasing. If Fridley has no place for the bike rack they would need to return the rack to
Minneapolis.

Councilmember Bolkcom asked how staff decides how many bike racks are needed and where
they will be located.
Mr. Kosluchar said staff had not looked at specific locations prior to Councils approval.
Councilmember Bolkcom asked what the process is to install the bike racks and to let
Minneapolis know where they are located.
Mr. Kosluchar said that site photos will need to be submitted to Minneapolis along with a
packet. There are needs for bike racks throughout the City of Fridley.
Councilmember Bolkcom asked if all schools will be included or just District 14
Mr. Kosluchar replied all schools will be included. Rachel Harris has contacted the schools.
Councilmember Bolkcom asked who has priority, the parks or schools.
Mr. Kosluchar said city-owned property would be first.
Councilmember Bolkcom noted it says the racks had to be installed within 30 days of receiving
them. She asked if this was enough time to install the racks.
Mr. Kosluchar said there is plenty of time to prep between the time the bike racks are ordered
and received.
Councilmember Bolkcom asked when the bike racks would be delivered.
Mr. Kosluchar said there is a wide range as to when the racks can be ordered.
Councilmember Bolkcom asked if the City would be paying for the prep work at the schools.
Mr. Kosluchar said locations outside of the City are responsible for prep and have to agree to
pay for the prep work before receiving a bike rack.
Councilmember Barnette asked if the schools were aware of this.
Mr. Kosluchar answered yes.
Councilmember Varichak asked what the difference was between the prices of the bike racks.
Mr. Kosluchar said that different racks and styles have different prices. Also some bike racks
work better in certain locations than others.

10. Informal Status Reports:
Councilmember Bolkcom said the recycling drop-off event on April 16 went very well. She
thanked all who helped. There was a record of 630 vehicles dropping off items including 86,700
bulbs and three truckloads of electronics.
Councilmember Varichak appreciated those who came and waited patiently. The next
recycling event is in the fall in October.
Mr. Hickok said the Earth Day litter pick-up was held last weekend. People did a great j ob
cleaning up the parks.
Councilmember Varichak said the StarGazers in Fridley event is on May 7 with dinner at 5:30
and a program at 7:30.
Councilmember Varichak said a waffle breakfast is scheduled for May 1 at the Community
Center as a fundraiser for `49er Days.

Second Reading of an Amendment to City Code Chapter 506 Vehicle Parking
and Chapter 901 Penalties
This is the second reading of an ordinance prohibiting parking that obstructs or
interferes with the delivery of US Mail during mail delivery hours. Staff originally
presented this issue to Council at their March 28 meeting. After discussion and
deliberation, Council tabled the item for revision by Staff. A revised proposed
ordinance was presented to Council on April 25 and Council approved the frst
reading.
This ordinance will make it a petty misdemeanor violation to park a vehicle so that
the pickup or delivery of US mail is obstructed or interfered with during the hours
of 8:00 am and 5:00 pm Monday - Saturday, and exclusive of federal holidays or
other days designated as non-delivery days by the USPS. This language defines a
violation as occurring only when mail delivery is actually obstructed or interfered
with. Therefore, once mail delivery has occurred for the day, no violation is
committed by parking near or in front of a mailbox. This language would
automatically exclude Saturdays from enforcement should the Postal Service
discontinue Saturday delivery at some point in the future.
This ordinance will take effect 14 days after publication, which typically occurs a
week after the second reading. We anticipate publication on May 19 resulting in an
effective date of June 3, 2011.
Staff recommends the second reading of the ordinance amending Fridley City Code
Chapters 506 and 901.
506.08. STOPPING AND STANDING PROHIBITED
No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other
traffic or in compliance with the law or the directions of a Police Officer or traffic-control
device, in any of the following places:
1. On a sidewalk;
2. In front of a public or private driveway or directly across there from in such a manner as to
impede the access to said driveway;
3. Within an intersection;
4. Within 10 feet of a fire hydrant;
5. On a crosswalk;
6. Within 20 feet of a crosswalk at an intersection or within 20 feet of a mid-block crosswalk
properly marked;
7. Within 30 feet upon the approaching side of any flashing beacon, stop sign or traffic-control
signal located at the side of the roadway;
8. Between a safety zone and the adjacent curb or within 30 feet of points on the curb
immediately opposite the ends of a safety zone, unless the City has indicated a different length
by signs or markings;
9. Within 50 feet of the nearest rail of a railroad crossing;
10. Within 20 feet of the driveway entrance to any fire station and on the side of the street
opposite the entrance to any fire station or within 75 feet of said entrance when properly posted
11. Alongside or opposite any street excavation or obstruction when stopping, standing or
parking would obstruct traffic;
12. On a roadway side of any vehicle stopped or parked at the edge or curb of a street;

Background
At the last Council meeting on Apri125, 2011, the City Council held the first reading for Te�t Amendment
TA #11-03, the Northstar Transit Oriented Development (TOD) District. Although Council made no
changes to the proposed text at the first reading staff has added the date of the TOD District boundary map to
the final version of the ordinance.
Recommendation
Staff recommends that the City Council proceed with the second reading of TA # 11-03, a text amendment to
create a Northstar Transit Oriented Development District. If approved, the text change will be published and
go into effect 15 days following publication.

The City Council of the City of Fridley hereby finds, after review, examination and recommendation of
staff, that the Fridley Zoning Code be hereby amended as follows:
SECTION 205.33 O-8 NORTHSTAR TRANSIT ORIENTED DEVELOPMENT OVERLAY
DISTRICT REGULATIONS
205.33.01. BACKGROUND AND AUTHORITY
The City of Fridley finds that Transit Oriented Development benefits the general health and welfare of the
inhabitants of Fridley by fulfilling existing housing, transportation and employment needs. Therefore, the
City of Fridley implements this overlay district which designates a portion of the City as a Transit
Oriented Development District ("TOD" District) in an effort to support all modes of transportation. This
overlay district is adopted per authority granted by the City of Fridley in Minnesota State Statutes Chapter
462.
205.33.02. PURPOSE
The purpose of this overlay zoning district is to:
A. Implement code requirements that will encourage dense, mixed use, pedestrian-friendly
development within a one-half mile of the Northstar Commuter Rail Station in Fridley.
B. Create multi-modal connections to the Fridley Northstar Commuter Rail Station that allow for
safe access to the station no matter what means of transportation someone uses.
C. Create a neighborhood identity with the Northstar Station that promotes the use of mass transit,
human interactions, safety and livability.
D. Reduce automobile dependency by locating a variety of land uses within a half mile of the train
station.
E. Provide life cycle housing for people of different income levels and housing space needs within
one half mile of the train station.
205.33.03. DISTRICT BOUNDARY
The TOD Overlay District consists of those areas designated on the Northstar TOD District map, which is
on file with the City Clerk and dated Apri122, 2011.
205.33.04. DEFINITIONS
The following words, terms, and phrases, when used in this section, shall have the meanings ascribed to them in
this Section, except where the context clearly indicates a different meaning;
1. Drive-Through Service
A type of service provided by a business that allows occupants of a motor vehicle to receive or obtain
a product or service through a building opening without leaving the vehicle.
2. Mixed Use Structures
A building or development that contains two or more different uses such as, but not limited to, residential,
commercial, industrial, or public facilities.
3. Primary Street
The street adjoining the property which has the highest traffic counts.
4. Zero Lot Line Setback
The location of a building on a lot in such a manner that one or more of the building's exterior edges rest
directly on a side property line.
205.33.05. USES PERMITTED
Permitted uses in the O-8 TOD Overlay District are those uses which are acceptable to the overall
redevelopment plan and specific development plans as approved by the City. Upon approval of the
specific development plans, the City shall determine the specific uses that are permitted within the
development. Mixed use structures do not require a special use permit as underlying zoning requirements
may require.
205.33.06. USES EXCLUDED
A. Uses which may be dangerous, create annoying odors, noise disturbances or be otherwise
detrimental to the general welfare of persons residing or working in the vicinity thereof or may
impair the use, enjoyment, or value of any property.
B. Trucking Terminals
C. Uses whose operation requires the outdoor storage of materials or equipment, including the
outdoor manipulation of said materials or equipment.
D. Uses whose principal operation requires the outdoor storage of motor vehicles, including the
outdoor manipulation of said motor vehicles.
205.33.07. PROCESS FOR TOD PLAN APPROVAL
A. Plans for each individual project or combination of projects in the TOD District must be
submitted upon payment of any required fee as provided in Chapter 11, except plans for
individual, detached, single family housing construction projects in the Hyde Park zoning district,
which are exempt from the TOD plan review process. Project plans will be reviewed by the
Planning Commission, who will provide a recommendation to the City Council. The City
Council shall have final authority to approve all project plans.
B. Project plans submitted to the Planning Commission and City Council shall include the following
minimum criteria:
(1) Scalable site plans, showing the location of buildings, off-street parking, street and utility
locations, auto and pedestrian access to and from the project, any modification to existing
services, grading plans, storm water plans, building exterior finish, lighting and signing and
landscape plans.
(2) Written City staff review on project compatibility to the overall Transit Oriented
Development District.
(3) Review and recommendation to the City Council from the Fridley Housing and
Redevelopment Authority (HRA).
C. Any substantial modification to the plan must be submitted through the Planning Commission
and approved by the City Council.
205.33.08. DESIGN CRITERIA
All new development or redevelopment TOD proposals requiring a building permit after the effective date
of this ordinance must meet the following design criteria standards designed to enhance the pedestrian
scale and safety of the development. Single family construction projects located within the Hyde Park
Zoning Overlay District are exempt from following the TOD design standards. In situations where an
existing building is being partially expanded, the new standards will only apply to the new addition,
except as provided in Section 205.33.08.B, Setbacks.
Dimensional Requirements
A. Lot Coverage
Lot coverage may exceed 40% in cases where vehicle parking is shared, underground, or
structured, provided all landscaping requirements are met. Allowances exceeding the 40% lot
coverage limit will be made in designs that finance the creation and maintenance of public
open space for commuters nearby.
Alternative storm water treatment methods such as permeable pavers, porous asphalt,
vegetated roof areas, especially at the top of structured parking facilities, and other innovative
techniques to reduce stormwater run-off are encouraged.
B. Setbacks
Exceptions to the following setback requirements will be granted to building additions to
structures located on property zoned M-2, Heavy Industrial, at the date of the creation of this
TOD zoning district.
(1) Front Yard
a. Except for individual, detached, single-family homes in the Hyde Park overlay zoning
district, buildings shall be set back no further from the front property line than 15 feet.
b. Corner Lots: On corner
lots, the buildings shall have

c. Double Frontage: In cases
of double frontage, buildings
on both fronts may be set
back at 15 feet. On three or
four-sided lots, buildings

Buildings may be set back as close as 15 feet to the property line. On corner lots, the
maximum allowable building setback is 15 feet.
Zero lot line setbacks are encouraged.
(3) Rear Yard
Buildings may be set back as close as 15 feet to the property line.
C. Height
The height limitations of the underlying zoning district shall apply except in the Hyde Park
Zoning District, where a building height of 45 feet shall apply if a development includes
tuck-underorunderground parking.
Building Design
A. Entrance Orientation
Primary building entrances on all new buildings shall be oriented to the primary abutting public
street. Additional secondary entrances may be oriented to a secondary street or parking area.
Entries shall be clearly visible and identifiable from the street, and delineated with elements such
as roof overhangs, recessed entries, landscaping, or similar design features.
B. Fa�ade Articulation
Building widths of 40 feet or less are encouraged. New buildings of more than 40 feet in width
shall be divided into smaller increments, between 20 and 40 feet in width, through articulation of
the fa�ade. This can be achieved through combinations of the following techniques, and others
that may meet the intent of this section.
(1) Fa�ade Modulation — Stepping back or extending forward a portion of the fa�ade
(2) Vertical Division — Using different te�tures or materials, provided materials are
from a common palette)
(3) Storefronts — Division of building
face into distinct storefronts with
separate entrances and display
windows
(4) Roof Lines — Varied roof lines with
alternating dormers, stepped roofs,
gables, or other roof elements to
reinforce the modulation or
articulation interval
(5) Articulation Interval — Placement of
arcades, awnings,
arched windows,
intervals equal to
interval
C. Building Face

No blank walls shall be permitted to face the public street, sidewalk, or other public spaces, such
as plazas. Elements such as windows, doors, columns, changes in material, and similar details
should be used to add visual interest.
Buildings shall be designed with a base, middle, and a top, created by variations in detailing,
color, and material. Articulated tops shall be considered in the design of all new buildings. This
articulation may consist of pitched roofs, dormers, gable ends, or cornice detailing. The base of
the building shall include human scale elements, such as doors, windows, projections, awnings,
canopies, and ornamentation.
D. Door and Window Openings
In new commercial, mixed-use and civic buildings, window and door openings shall comprise at
least fifty (50) percent of the length of the main floor of the primary street fa�ade. Window
openings shall be located at a pedestrian sight level.
(1) Windows shall be designed with openings that create a strong rhythm of light and
shadow.
(2) Glass on windows and doors on the primary street fa�ade shall be clear or slightly tinted,
allowing views into and out of the building interior or, as an alternative, used as display
windows enclosed by walls inside the building. Where security needs warrant it, Spandrel
glass may be used in the primary street fa�ade windows subject to City approval in the
plan review process.
(3) Window shape, size and patterns shall emphasize the intended organization of the fa�ade
and the definition of the building.
E. Loading Docks
Outside loading docks shall be located in the rear or side yard and be screened from view from
any public right-of-way. The space needed for the loading dock must be adequate to handle the
loading and unloading needs of the building without obstructing the public right-of-way.
F. Building Materials
All buildings except single family shall primarily be constructed of high-quality materials such as
brick, stone, textured cast stone, EFIS, or tinted masonry units. The following materials are
generally not acceptable: Plain or painted concrete block, sheet metal panels, reflective glass, or
aluminum, vinyl, fiberglass, asphalt or fiberboard siding.
Parking structures shall be constructed with building materials that are architecturally compatible
withthe adjoining structure(s).
G. Refuse/Recycling Storage
Multi-tenant buildings shall share a common refuse/recycling storage area. Refuse/recycling
collection areas must be screened from view form any public right-of-way and are encouraged to
be enclosed inside a building.
205.33.09 Parking Requirements
A. Reduction of Parking
Reduction of the parking stall dimensions and number of parking stalls required in the underlying
zoning district may be allowed due to the nature of the proposed use or agreements in place with
surrounding businesses for shared parking.
(1) The number of required parking stalls may be reduced by no more than 50% of the
minimum required in the underlying zoning district for the proposed use.
(2) The maximum number of parking stalls shall not exceed 120% of the minimum
number of parking stalls required by the use in the underlying zoning district. This
maximum provision shall not apply to park-and-ride or other transit facilities.
(3) Off-street surface parking is not permitted between the front fa�ade and the primary
street. Parking may be located in the rear or side yard.
(4) Bicycle parking shall be provided as a component of all parking facilities as a ratio of
one bicycle space per 20 automobile spaces. Bicycle parking must be provided within
view of each business front entrance. Adjoining businesses may share common
bicycle parking areas.
B. Additional Parking
When the provisions for parking space required are inadequate, the City may require that
additional off-street parking be provided.
C. Drive-Through Service
Drive-through service designs are allowed and will not require a special use permit as underlying
zoning may require.
205.33.10 Landscape and Streetscape Requirements
Landscaping
A. Scope
A landscaping plan shall be submitted according to the requirements of the underlying zoning
district, except for as provided in Section 20533.10.B.L Mixed use projects must have a unified
landscaping scheme. The landscaping requirements in this Chapter will only apply to new
construction projects or projects where existing buildings are expanded to the reduced 15 foot
setback.
B. Plant Materials Substitutions
The landscaping requirements in the underlying zoning district shall apply to properties in the
TOD Overlay District with some exceptions.
1) TOD landscape plans for redevelopment of property located in the underlying Hyde
Park zoning district must follow the landscape requirements for the zoning district
that most closely represents the use proposed.
2) In the TOD Overlay District, one ornamental tree will count as one over-story
deciduous tree. In addition, ornamental trees may exceed 50 percent of the required
trees.
3) Due to the amount of hardscape needed for pedestrian walkways, if the level of open
space for planting restricts the ability to provide adequate growth space for tree roots,
shrubbery planting beds and flower beds may also be substituted for over-story trees
at a rate of 36 square feet per tree.
4) Decorative walkway light poles meeting the TOD design specified for the TOD
district may be substituted at a ratio of one light pole for two trees if the site design
warrants additional walkway lighting.
5) Street-side sculptures, large planters, hanging flower baskets, light pole banners,
clock towers, arbors, seating benches, or similar ornamentation may be considered as
substitution to meet landscaping requirements.
If it is not feasible to meet the landscaping requirements of the underlying zoning district with the
allowed substitutions above, the City may approve a monetary payment per fees established in
Chapter 11 into the TOD Capital Project Fund for the purpose of funding streetscape amenities
within the street rights of ways within the TOD overlay district.
C. Water
Drip irrigation systems are encouraged to reduce water consumption and to prevent wet
walkways. Alternative storm water treatments such as permeable pavers, porous asphalt,
vegetative roof areas and other innovative techniques to reduce storm water runoff are
encouraged.
Streetscapin g
A. Sidewalks
Sidewalks of a minimum five foot width
must be provided on all street frontages.
Sidewalk design detail will need to be
approved by the City in accordance to TOD
streetscape design on public right of ways
adjacent to the proposed development.
Paved connections, also a five foot
minimum width, to building entrances,
crosswalks, and adjacent bus stops must
also be incorporated into any site design. A
colorized pavement pattern connecting the
sidewalk on each side of the driveway shall
be incorporated into driveways, warning
drivers of the sidewalk connection on each
side of the driveway. Such connection shall be accessible.
B. Lighting
Lighting types, styles, and colors shall be coordinated with the overall design of City-installed
lighting in the TOD District. Pedestrian-oriented lighting is required on all streets, trails,
sidewalks, and public gathering places within the district. A lighting plan and fi�ture specification
schedule shall be included in the documents submitted to the City for approval.
C. Signs
Changeable electronic signs will not be allowed in the TOD District. Door and window awnings
are encouraged and will not count towards wall signage percentage allowed on a building face.
D. Fencing
Decorative fencing incorporated into landscape designs shall be of the same color, type, and style
used in the adjacent TOD streetscape or of similar design approved by the City.
E. Outdoor Dining
Outdoor dining areas may be incorporated into the front and side yard setbacks up to five feet
from the property line, leaving five feet for the sidewalk. The dining area shall be designed with
safety protections that reasonably attempt to prevent vehicles from accidentally encroaching into
the dining area. Store locations that serve alcohol must apply for a patio endorsement on their
liquor license, but relaxation of screening requirements may be considered by the City in the
TOD District.
F. Farmer's Market
Parking areas may be used for seasonal weekly open air markets to sell produce, crafts, and
flowers with a special use permit. The special use permit will supersede any underlying zoning
requirements for outdoor sale licenses. In order to qualify for the special use permit, the market
must not interfere with traffic patterns and adequate parking must be available for the other uses
on the site. There must also
be safe separation between
market users and vehicular
traffic. Sale equipment shall
meet all applicable building,
fire, and electrical codes, and
any requirements of the
Anoka County Health
Department and the
Minnesota Department of
Agriculture.
205.33.11 Maintenance
In addition to the maintenance requirements of the underlying zoning district, property owners in the
TOD district are required to maintain the landscape and streetscape abutting their property. This includes
the removal of debris and snow on trails and walkways and at bus stops and the irrigation of planters on
their own private property and those in the public right-of-way adjoining the properiy. Further details of
the maintenance requirements shall be addressed in a development agreement approved by the City.

Background
At the May 9, 2011 City Council meeting, action is being considered on the second reading of Text
Amendment TA # 11-03, the Northstar Transit Oriented Development (TOD) District. If the second reading
of the TOD ordinance is approved, the attached summary ordinance has been prepared for Council's
consideration. The purpose of a summary ordinance is to save publication costs.
Recommendation
Staff recommends that the City Council approve the attached summary ordinance for publication following
approval of the second reading of TA # 11-03, a text amendment to create a Northstar Transit Oriented
Development District.

That Chapter 205 of the Fridley Zoning Code is hereby amended to include a new
overlay district that establishes design criteria which promotes access to mass transit in a
specified area of the City for the purposes of encouraging multi-modal transportation

Background
The proposed Transit Oriented Development (TOD) District code refers to an application fee and an
option for TOD Capital Project Fund payments. Staff has added these fees to Chapter 11 of the Fridley

ANALYSIS
The petitioner, Mr. Dahlberg is seeking to vacate an unimproved portion of 55th Avenue, which is located
north of the vacant property at 5545 6th Street. Vacating this unimproved right-of-way will give the
petitioner the additional land area required to
make the lot buildable.
The petitioner's property is currently 19,200
sq. ft. in size, which is 800 sq. ft. short of
meeting the minimum lot size requirements
for the C-2, General Business zoning district
regulations. Vacating this right-of-way, would
give the petitioner an additional 30 ft. by 166
ft. (4,900 sq. ft) section of land, which would
then increase the size of the lot to 24,100 sq.
ft., therefore meeting the minimum lot size
requirement of 20,000 sq. ft.
Although the petitioner doesn't have plans to
develop the property at this time, he's
seeking this request now so it's ready in the
event that he's approached by a potential
buyer or developer. In order to service this
newly created property, staff has drafted a
stipulation based on direction from the City's
Engineering department to either install a
private driveway or a public road from 7th Street.

PLANNING COMMISSION RECOMMENDATION

Commission meeting. After a brief discussion, the Commission recommended approval.

Since the Planning Commission meeting, the petitioner's surveyor located the placement of that water
main on this site. As a result, an additional stipulation has been drafted to require that the petitioner file
the necessary utility easements at the County to provide the City with the access needed to service the
utilities.

City Staff recommends approval of the attached resolution exhibit for SAV #11-01.

1. Access to 5455 6`" Street shall be through one of the following options, to be determined at which
time the lot is developed and constructed prior to issuance of the certificate of occupancy:
a. Install a public road with an off-set cul-de-sac to the property that complies with
Engineering and Fire Code regulations. Conditions on this option:
i. Private Hydrant installation
ii. Address to be changed to 7`" Street, with proper signage visible from 7`" Street
for emergency purposes
iii. Curb cut will be required to allow access for the lot at 5480 7`" Street (billboard
lot)
iv. Water, sewer, and storm water connection fees shall be paid by
owner/developer prior to issuance of a building permit.
b. Install a private driveway through a license agreement prepared by the City, to the parcel
that complies with Engineering and Fire code regulations. Conditions on this option:
i. Code compliant Fire access to allow proper turnaround

VACATION REQUEST
The petitioner, Mr. Dahlberg is seeking to vacate an unimproved portion of 55th Avenue, which is located
north of the vacant property at 5545 6th Street. Vacating this unimproved right-of-way will give the
petitioner the additional land area required to make the lot buildable.
HISTORY
In 1972, there was a vacation request submitted to vacate 55th Avenue, north of the apartment building
located at 5451 5th Street, which is directly west of the property at 5455 6th Street. That vacation

City's Public Works staff didn't recommend
the vacation in case 55th Avenue were to be
utilized again. In 2001, a vacation request
was submitted by the owners of the
apartment building at 5451 5th Street. Public
Works staff determined at that time there
was no longer a need to keep the right-of-
way and as a result the vacation was
approved.
ANALYSIS
The petitioner is seeking to vacate an
unimproved portion of 55th Avenue NE, north
of the property he owns at 5455 6th Street.
His property is currently 19,200 sq. ft. in size,

Vacating this right-of-way, would give the
petitioner an additional 30 ft. by 166 ft.

The area proposed to be vacated is shown in the crosshatched area in the above aerial and is also in the
attached survey. As stated above, the petitioner would gain a 30 ft. by 166 ft. strip of land and the
remaining portion of the vacated 55th Avenue would be turned back to the City.
Although the petitioner doesn't have plans to develop the property at this time, he's seeking this
request now so it's ready in the event that he's approached by a potential buyer or developer. In order
to service this newly created property, staff has drafted a stipulation based on direction from the City's
Engineering department to either install a private driveway or a public road from 7th Street. At which
time the property is developed, it will be the developer's choice as to how to access the site.
In the case of the 2001 vacation of 55th Avenue, the City required that the northerly 5 ft. of the vacated
street be dedicated back to the City as an easement because there is a water main located directly north
of that property, and the City needed the easement for access purposes. The petitioner's surveyor is
currently locating the placement of that water main and how it may impact this vacation request. As a
result, an additional stipulation may be added to this vacation request, once the surveyor has provided
the necessary information to the City on placement of the water main. The City will have that
information by the time this request goes before the City Council.
STAFF RECOMMENDATION
City staff recommends approval of the street vacation request, with a stipulation.

PETITIONED BY THE PROPERTY OWNER, SCOTT DAHLBERG.
WHEREAS, this portion of SSthAvenue is an unimproved right-of-way and is not used by
the general public; and
WHEREAS, all possible connections to this portion of SSth Avenue have been previously
vacated; and
WHEREAS, City Public Works Staff indicates that there is no longer a reason to keep this
unimproved right-of-way; and
WHEREAS, the northerly 20 feet of the southerly vacated 30 feet of SSth Avenue and an
additiona130 feet north of the vacated 6th Street will be dedicated to the City as a utility
easement; and
WHEREAS, a public hearing was held on this matter by the Planning Commission on April
20, 2011 and the City Council on May 9, 2011.
WHEREAS, the petitioner, Scott Dahlberg, was presented with Exhibit A, the stipulations,
which will be required for compliance, for SAV #11-01, at the May 9, 2011 City Council
meeting;
NOW, THEREFORE, BE TT RESOLVED that the City of Fridley vacate the following:
All that part of 3rd Street (now known as SSth Avenue NE) lying easterly of
the northerly extension of the centerline of Dayton Avenue (now known as
6th Street NE) and lying westerly of the northerly extension of the
centerline of the Alley in Block 9, Hamilton's Addition to Mechanicsville,
Anoka County, Minnesota.
Reserving and subj ect to an easement for utility purposes over the north
20.0 feet of the south 30.0 feet thereof and over the south 30 feet lying
between the northerly extensions of the centerline and the east line of
Dayton Avenue (6th Street NE).
