Abbott, Director of Public Safety November 8, 2011 Resolution Adopting the Revised 2011 City of Fridley Emergency Operations Plan Staff has completed a thorough review of the current City of Fridley Emergency Operations Plan (EOP) as required every four years to keep it current. The last revision of the EOP took place in January, 2007. Revisions to the EOP reflect changes in federal and state law and follow the guidelines of Homeland Security and Emergency Management. �The revised City of Fridley EOP has been reviewed by the Minnesota Division of Homeland Security and Emergency Management (HSEM) and their Regional Review Committee in accordance with the four-year review cycle. Regional Program Coordinator Gary Peterson from the Division of Homeland Security and Emergency Management, the plan approval authority, approved the plan on April 15, 2010. The final step in the required EOP review process is Council adoption. The summary of revisions is included in the attachment. You may reference the current (2007) EOP to determine the effect of the proposed changes. In addition to individual copies, a public copy of the EOP is available through the City's website. Staff recommends adoption of the revised 2011 City of Fridley Emergency Operation Plan and has provided a proposed resolution for that purpose. 1 RESOLUTION NO. 2011 - A RESOLUTION ADOPTING REVISED 2011 EMERGENCY OPERATIONS PLAN WHEREAS, Staff has completed a thorough review of the current City of Fridley Emergency Operations Plan as required every four years; and WHEREAS, Staff has revised the Emergency Operations Plan as needed to comply with federal and state laws and follows the guidelines of the Minnesota Division of Homeland Security and Emergency Management (HSEIV�; and WHEREAS, T'he 2011 Emergency Operations Plan has been reviewed and approved by the Minnesota Division of Homeland Security and Emergency Management and the Regional Review Committee. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that the City of Fridley Revised 2011 Emergency Operations Plans is hereby adopted. Upon notice or discovery of a hazardous material(s) release, local public safety officials will notify the Anoka County Dispatch Center. The Anoka County Dispatch Center will immediately notify the Public Safety Ilirector, who has primary responsibility and authority for implementing the emergency plan in City of Fridley, plus all other public safety officials designated for similar notification in the plan. 2. Using prepared criteria (Item 4 below), the Public Safety Director, who has responsibility and authority for implementing the emergency plan in the City of Fridley, will determine whether a public notification is appropriate; and, if so, what method is to be used for public notification, what population is to be notified, and what the message shall be (immediate, precautionary, protect-in piace, etc.) 3. The Anoka County Dispatch Center, which controls activation of the emergency warning systems in Anoka County shall immediately carry out such public warning instructions as it may receive from the Emergency Management Director, who has primary responsibility and authority for irnplementing the emergency plan. The Anoka County Dispatch Center can employ several methods of providing emergency warning to the public, including: ❑ Emergency systems: individually, in groups, or all at once. ❑ TV, cable and radio stations. 0 Localized high-speed automated telephone dialing nohfication (certain areas). ❑ Street-to-street locally via police and/or fire department vehicle loudspeakers. ❑ Citizens Emergency Response Team (CERTJ network. 4. Criteria to be used in determining the need for public notification include, but are not limited to the following: ❑ Identification and properties of the hazardous substance released ❑ Approximate amount or extent of the release ❑ Wind speed and direction ❑ Time factors ❑ Size and nature of the target population ❑ Recommendations of designated on-scene authorities Annex B- page - B-3 - B. At a minimum, these facilities are required by law to immediately notify the following in event of an accidental emergency release, and be prepared to state the name of the substance(s) released and the approximate amount: ❑ Dial 9-1-1 (for local emergency notification) ❑ Dial 651-649-5451 (MN State Duty Officer for Greater Metro Area), or ❑ Dial 800-422-0798 (MN State Duty Officer for Greater Minnesota) 5 ❑ Dial 800-424-8802 (National Response Center for federal emergency notification) Annex L- page L-4 (4. Added new section: Emergency Equipment and Facilities Available in the City of Fridiey Within the City of Fridley, and othenuise available to the City, is a variety of specialized equipment and facilities, publicly and privately owned, for use in emergency response, including hazardous materials incidents. The Fridley Fire Department, Police Department, Public Works Department, maintain current lists of available pubtic and private resources relative to their individual missions and operational needs. These lists of resources also identify the locations of the resources, the individuals responsible for release of the resources and their 24 hour contact information. In the case of equipment and facilities maintained by the individual city departments, the department head is responsible for its release and use, and shouid be contacted for further specific information. The department head designee serues as an alternate to the department head. The lists can be located in the resource manual located in the Emergency Management Coordinators office. Additionally, the City of Fridley has signed and maintains `mutual aid' contracts with nearby fire and police departments and, as such, atso has immediate access to their resources. The County also provides various emergency response equipment, facilities and services to the City of Fridley, as appropriate, when needed. Anoka County Emergency Management Director and the City of Fridley Emergency Management 1?irector, or their designees, are responsible for the release of their publicly owned emergency resources. Kosluchar, Public Works November 9, 2010 Consulting Services Agreement for 2012 Technical Assistance PW11-074 Attached is a proposed consulting services agreement for GIS services for 2012. GIS Rangers has provided GIS services including data entry and mapping to enable the City of Fridley to analyze and manage data and associated attributes which are spatially referenced. These services are contracted through the Tri-City JPA, with the Cities of Andover, Columbia Heights, and Fridley participating as member cities. � The proposed 2012 contract is the same as the 2011 contract with updated term dates. GIS Rangers has accommodated our budget by holding their hourly rates with no increase for 2012. The amount of the contract is the same as in 2011 for all three cities involved. The proposed Fridley portion of the contract is in accordance with our proposed 2012 budget. We have received excel{ent service and value in the past with this contract and expect that this will continue. Staff recommends the City Council move to approve execution of the proposed contract for GIS services with GIS Rangers of Roseville, MN, for 2012. JPK; jk Attachment 7 CONSULTING SERVICES AGREEMENT This Agreement is made as of , 201_ (the "Effective Date"), by and between GIS RANGERS ("Contractor") and the Tri-City GIS Joint Powers Organization, consisting of the Cities of Fridley, Columbia Heights and Andover, hereinafter "Tri-City." CONTRACTOR and Tri-City are collectively referred to as "Parties" and individually as a"Party." WHEREAS, Tri-City requires services to provide GIS technical assistance to the Cities of Andover, Columbia Heights and Fridley; WHEREAS, Contractor desires to and is capable of providing the necessary services according to the terms and conditions stated herein; NOW, THEREFORE, in consideration of the mutual promises and agreements contained herein the parties agree as follows: 1. TERM 1.1 Term. The term of this Contract shall be from January 1, 2012, through December 31, 2012, unless earlier terminated by law or according to the provisions of this Contract. 2. CONTRACTOR'S OBLIGATIONS 2.1 General Description. Contractor will provide GIS technical assistance to Tri-City which includes the cities of Andover, Columbia Heights and Fridley. Additional work may be contracted as provided in Section 3.4. 2.2 Conformance to Specification. The Contractor will provide the Services as set forth in Exhibit A. 2.3 Limited Warrantv Contractor warrants that the Services will be performed in a safe, professional and workmanlike manner consistent with the applicable industry standards and this Agreement. CONTRACTOR MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND ANY IMPLIED WARRANTY ARISING OUT OF A COURSE OF DEALING, A CUSTOM OR USAGE OF TRADE. 3. PAYMENT 8 7268579v1 3.1 Service Fees The Contractor's fees for Services are set forth below (Service Fees"). Service Fees do not include any taxes that may be due based on the Service Fees, or for reimbursable expenses, for which Tri-City agrees to pay directly or reimburse Contractor. Total Service Fees: $78,969.0-0 to be allocated as follows: Andover-$34,272.0-0 Fridley-$29,702.00 Columbia Heights-$14,855.00 3.2 Invoices. Contractor shall, within fifteen (15) working days following the last day of each calendar month in which services were provided, submit an invoice on an invoice form acceptable to Tri-City. This invoice shall itemize 1) the hours of services rendered listed by classification, 2) the date such services were provided, 3) a general description of the services provided, 4) the name of client receiving services, 5) the amount and type of all reimbursable expenses being charged to the Contract, 6) the dates of the performance period covered by the invoice. 3.3 Time of Pavment. All invoices are due within thirty days from the invoice date. If Tri-City disputes any portion of Contractor's invoice, then Tri-City will: (a) pay any amount not in dispute by the due date; and (b) within five business days after receipt of that invoice, inform Contractor in writing of the disputed amount and the specific reason(s) for withholding payment. On Contractor's receipt of this, the Parties will work together in good faith to resolve such disputes in a prompt and mutually acceptable manner. Tri-City agrees to pay any disputed amounts within five days after the issues have been resolved. 3.4 Changes to Scope Tri-City shall have the right to request changes to the scope of the Services; however, all such changes are subject to acceptance by Contractor. If any change to the scope of the Services will cause an increase or decrease in the Service Fees, or in the time required for performance, prior to commencing the services required by the requested change, Contractor shall notify Tri-City of such increase or decrease by e-mail. Contractor shall not proceed with performance and shall have no obligation to proceed with performance pursuant to any requested change to the scope of the Services by Tri-City unless and until Contractor has received Tri-City's agreement to such increased or decreased Service Fees or time for performance via e-mail. � 7268579v1 4. COMPLIANCE WITH LAWS/STANDARDS 4.1 General. Contractor shall abide by all Federal, State or local laws, statutes, ordinances, rules and regulations now in effect or hereinafter pertaining to this Contract or to the facilities, programs and staff for which Contractor is responsible. INDEPENDENT CONTRACTOR STATUS Contractor is an independent contractor and nothing herein contained shall be construed to create the relationship of employer and employee between Tri-City and Contractor. Contractor shall at all times be free to exercise initiative, judgment and discretion as to how to best perform or provide services. 6. INDEMNIFICATION Contractor shall indemnify, hold harmless and defend Tri-City, its members, officers and employees against any and all liability, loss, costs, damages, expenses, claims or actions, including attorneys' fees which Tri-City, its officers or employees may hereafter sustain, incur or be required to pay, arising out of or by reason of any negligent or willful act, or negligent or willful omission of Contractor, its agents, servants or employees, in the execution, performance, or failure to adequately perform Contractor's obligations pursuant to this Contract. 7. INSURANCE 7.1 General Terms. In order to protect itself and to protect Tri-City under the indemnity provisions set forth above Contractor shall, at Contractor's expense, procure and maintain policies of insurance covering the term of this Contract, as set forth below. Such policies of insurance shall apply to the extent of, but not as a limitation upon or in satisfaction of, the indemnity provisions herein. All retentions and deductibles under such policies of insurance shall be paid by Contractor. Each such policy shall not be canceled by the issuing insurance company without at least thirty (30) days written notice to Tri-City of intent to cancel. 7.2 Covera�e. The policies of insurance to be obtained by Contractor pursuant to this section shall be purchased from a licensed carrier and shall include the following: A) Professional Liability (1) A professional liability insurance policy covering personnel of Contractor, if any, who provide professional services under this Contract, which shall include the following coverages at a minimum: Personal Injury/Damage: $200,000 per person $600,000 per occurrence B) Workers' Compensation If applicable, Contractor shall procure and maintain a policy that at least meets � 7268579v1 the statutory minimum. 7.3 Certificates. Prior to or concurrent with execution of this Contract, Contractor shall file certificates or certified copies of such policies of insurance with Tri-City. 7.4 Failure to Provide Proof of Insurance. Tri-City may withhold payments for failure of Contractor to furnish proof of insurance coverage or to comply with the insurance requirements as stated above until such time the Contractor complies with the requirements of this Section. 8. SUBCONTRACTING Contractor shall not enter into any subcontract for the performance of the services contemplated under this Contract nor assign any interest in the Contract without prior written consent of Tri-City. 9. DEFAULT 9.1 Inability to perform. Contractor shall make every reasonable effort to maintain staff, facilities, and equipment to deliver the services to be purchased by Tri-City. Contractor shall immediately notify Tri-City in writing whenever it is unable to or reasonably believes it is going to be unable to provide the agreed upon quality of services. Upon such notification, Tri-City shall determine whether such inability requires a modification or cancellation of this Contract. 9.2 Dutv to Miti�ate• Both parties shall use their best efforts to mitigate any damages which might be suffered by reason of any event giving rise to a remedy hereunder. 10. TERMINATION 10.1 With or Without Cause. Notwithstanding any other provision of this Contract, either Party may terminate this Contract at any time for any reason by giving thirty (30) days written notice to the other. Tri-City shall pay to Contractor the reasonable value of services received from Contractor as of the tertnination date. 10.2 Notice of Default. Either Party may terminate this Contract for cause by giving ten (10) days written notice of its intent. Said notice shall specify the circumstances warranting termination of this Contract. 10.3 Failure to Cure. If the Party in default fails to cure the specified circumstances as described by the notice given under the above paragraph within the ten (10) days, or such additional time as may be mutually agreed upon, then the whole or any part of this Contract may be terminated by written notice. '�1 7268579v1 11. 12 7268579v1 10.4 10.5 Notice of Termination. Notice of Termination shall be made by certified mail or personal delivery to the other Party's Authorized Representative. Notice of Termination is deemed effective upon delivery to the address of the Party as stated in paragraph 12. Effect of Termination. Termination of this Contract shall not discharge any liability, responsibility or right of any Party which arises from the performance of or failure to adequately perform the terms of this Contract prior to the effective date of termination, in accordance with the laws of the State of Minnesota. CONTRACT RIGHTS/REMEDIES 11.1 11.2 11.3 Ri�hts Cumulative. All remedies available to either Party under the terms of this Contract or by law are cumulative and may be exercised concurrently or separately, and the exercise of any one remedy shall not be deemed an election of such remedy to the exclusion of other remedies. Waiver. Waiver for any default shall not be deemed to be a waiver of any subsequent default. Waiver or breach of any provision of this Contract shall not be construed to be modification for the terms of this Contract unless stated to be such in writing and signed by authorized representatives of Tri-city and Contractor. Force Majeure Contractor will not be responsible for the delay in its performance of any obligation under this Agreement caused by acts of God, legal restrictions, or any other similar conditions beyond the control of Contractor. LIMITATION OF LIABILITY. NEITHER PARTY WILL, UNDER ANY CIRCUMSTANCES, BE LIABLE TO THE OTHER PARTY FOR SPECIAL, INDIRECT OR CON5EQUENTIAL DAMAGES IN ANY WAY RELATED TO THE SERVICES, THIS AGREEMENT OR THE TERMINATION OF THIS AGREEMENT. THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH DAMAGES ARE SOUGHT. SEVERABILITY The provisions of this Contract shall be deemed severable. If any part of this Contract is rendered void, invalid, or unenforceable, such rendering shall not affect the validity and enforceability of the remainder of this Contract unless the part or parts which are void, invalid or otherwise unenforceable shall substantially impair the value of the entire Contract with respect to either Party. MERGER AND FINAL AGREEMENT 16.1 This Contract is the final statement of the agreement of the Parties and the complete and exclusive statement of the terms agreed upon, and shall supersede all prior negotiations, understandings or agreements. There are no representations, warranties, or stipulations, either oral or written, not herein contained. DISPUTE RESOLUTION 17.1 This Agreement will be construed and enforced according to the laws of the State of Minnesota, without regarding to its conflicts of law rules. Any litigation regarding this Agreement must be filed and maintained in the state or federal courts of the State of Minnesota and the Parties consent to the personal jurisdiction of such courts. No provision of this Section 17 will preclude either Party seeking injunctive relief to prevent immediate or irreparable harm to it, but the mediation stated in Section 17.3 will otherwise be fully exhausted before the commencement of any litigation. X 17.2 EACH PARTY IRREVOCABLY WAIVES ANY RIGHT TO A JURY TRIAL WITH RESPECT TO ANY CLAIMS OR DISPUTES ARISING OUT OF OR RELATED TO THIS AGREEMENT. Any lawsuit or other action, regardless of form, relating to this Agreement, including, without limitation, an action for breach of warranty, must be commenced within one year after the later of: (a) date on which the breach of warranty or other cause of action occurred; or (b) date on which that Party knew or should have known of that breach of warranty or other cause of action. 17.3 Prior to commencement of any litigation regarding this Agreement, the Parties agree to voluntary, non-binding mediation to resolve any dispute they may have. The mediation will be conduct by a mutually selected mediator (or if the Parties cannot agree, by a mediator selected by the CPR Institute for Dispute Resolution), in accordance with the CPR Institute's Model Procedure for Mediation of Business Disputes. The Parties will each pay its own attorneys' fees and will share equally the other mediation costs. While this mediation will be non-binding in all respects (except agreements in settlement of the dispute negotiated by the Parties), each Party will appear when directed by the mediator, be fully prepared to work toward the dispute's resolution, and participate in good faith. If the mediation does not result in a mutually satisfactory resolution of the dispute within ninety days after it is begun, either Party may commence an action as permitted under Sections 17.1 and 17.2. NON-DISCLOSURE OF NON-PUBLIC, PRIVATE OR CONFIDENTIAL INFORMATION The parties agree that in order to perform its duties under the terms of this Agreement, Contractor will have access to and may use certain information in the custody of the City that would be categorized as private or non-public data within the meaning of Minnesota law. Any such information or data is confidential and, as an essential and necessary part of this Agreement, Contractor agrees not to disclose, use, or otherwise disseminate any such data or information to any other party or entity other than the City. AND CARL J. NEWQUIST l. Citv Prosecutor Appointment: Carl J. Newquist and his law office, Newquist & Herrick Law Offices, P.C., 6401 University Avenue N.E., Fridley, Minnesota, 55432, are appointed City Prosecutor for the City of Fridley. 2. Term of A�reement: Thirty-six (36) months from and after January 1, 2012, to terminate on December 31, 2014, unless otherwise extended by mutual agreement of the parties hereto. 3. Duties and Resaonsibilities of the Citv Prosecutor: A. Proximity being of the essence hereof, the City Prosecutor shall maintain an office in the City of Fridley. The City Manager may approve an exception to this requirement if the City Prosecutor presents an acceptable arrangement to the City providing for convenient and timely access to the Prosecutor by City Staff. B. Represent the City in all criminal proceedings and cases wherein the City is a party, has jurisdiction, andlor has an identifiable interest therein, except those cases arising under the City's zoning, housing, rental housing and building codes. C. Prepare files for court, including assembling witness lists, preparing and serving subpoenas, copying statutes or ordinances for court trials, etc. Request certified documents, such as driver's records, motor vehicle records, prior convictions, orders for protection, bank records, ordinances and other information required for court directly from the custodians of those records through customary and accepted means. Use of digital data access, retrieval, and transfer methods are encouraged. D. Prepare copies of documents, photographs, video files, and other discoverable items as requested or required for provision to defendants and/or their attorneys. The Prosecutor may charge the requesting person or entity a fee for such copies where not prohibited by law. E. Prepare letters and notices associated with various court trials. These include letters to victims, omnibus hearing notifications, and notices of changes in time, date or place of hearings. F. Maintain records, including the court calendaz, records of formal complaint requests, records regarding the criminal history requests from the BCA, records of officer vacation schedules and court assignment schedules of the prosecutor. � G. Telephone conferences and maintaining correspondence with various agencies including law enforcement agencies, courts, Minnesota correctional facilities, victim/witnesses, defendants/defense attorneys, social workers, psychiatrists, victim advocate representatives, hospitals, banks, insurance companies, etc. Research statutes and/or ordinances for court cases, formal complaints, or as requested by the Fridley Police Department or the City of Fridley. H. Handle requests for disposition of detainer. I. Maintain active files. 3. Advise Council, City staff, and the Police Department of legal questions and issues that relate to official City business. K. Advise and attend education and training programs for City staff and the Police Department as requested by the City Manager and/or the Director of Public Safety. L. Advise and attend such Council meetings and meetings of City commissions and committees as the City Manager and/or Mayor may direct. M. Prepare activity reports, billing information and reports on status of City litigation as the City Manager may direct. N. Defend City employees, when applicable, in suits and claims arising from the performance of official duties as the City Manager may direct. 4. Conflict of Interest: The City Prosecutor shall not represent any individual or party in any civil or criminal matter against the City of Fridley. 5. Comuensation: A. The City Prosecutor shall be compensated on an annual retainer basis, payable in 12 equal monthly installments throughout the term of this agreement. Affirmative Action: Because the City requires and follows a policy of Affirmative Action and will not tolerate discriminatory acts, the City Prosecutor shall not discriminate against any person on the basis of age, sex, religious beliefs, political affiliations, or other protected classifications under federal, state, or local laws or regulations. 8. Work Product: All ordinances, resolutions, correspondence and other documents or materials drafted for the City by the City Prosecutor shall, upon their completion, become the property of the City. 9. Insurance: The City Prosecutor agrees to maintain a valid policy of Professional Liability Insurance for the duration of this agreement. Severabilitv: The City or City Prosecutor may sever the terms of this contract upon sixty (60) days written notice. At this hearing, a rough draft of a policy that would address tree management on City Property in lieu of the ordinance was presented. The City Council had a number of comments. The policy has been revised in accordance with the comments received, and is attached for your review. JPK/jpk Attachment 32 CITY OF FRIDLEY Policv for Tree Mana�ement on Citv-owned Proaertv, Citv Ri�hts-of-Wav, and Citv Easements REVISED 11/9/11 1: Purpose and Definitions It is the policy of the City of Fridley to recognize and preserve existing natural resources of the community and to encourage the greening of the City. The City finds that the preservation of healthy trees and other vegetation, where practicable, is in the best interest of City residents' health and welfare. To that end, the City has found it necessary and desirable to establish a policy to assist the City residents and the City staff in preserving healthy trees throughout the City. For the purposes of this policy, Citv Propertv is defined to include City-owned Property (such as City Park Property), City Rights-of-Way, or City Easements. This policy shall apply to all City Property. For the purposes of this policy, small trees are defined as those which have a mature height of no more than 20'. Medium trees shall have a maximum height of 20'-40', and large trees include those having a mature height of more than 40'. For the purposes of this policy, a tree's location is determined by the location of the tree trunk centerline at ground fevel. 2: Citv Forester Duties A. The City Forester shall make known and enforce regulations and specifications concerning the trimming, spraying, removal, planting, pruning and protection of trees, shrubs, vines, hedges and other plants on Citv-owned Propertv. 33 3: Placement and Care of Trees on Citv Property A. The City Forester shall be notified and give approval for ail planting of trees on Citv Propertv within the City of Fridley. 6. Unless approved by the city forester trees on Citv Propertv shall be planted no closer to each other than: 1) 30 feet for small trees; 2) 40 feet for medium trees; 3) 50 feet for large trees; C. Planting directly over or under utility lines shall be avoided. Only small trees shall be planted on City Propertv under or within 10 lateral feet of any overhead or underground utility. D. Care of Trees on City Property. Trees on Citv Propertv, including City Rights-of-Way and City Easements shall be maintained by the Public Works Department or its designee. Other plantings on City Rights-of- Way or City Easements shall be maintained by the fee owner of the property in conformance with City Code. E. Removal of healthy trees larger than 3" in diameter located on C� Propertv shall be approved by the Public Works Director. Removal of healthy trees on City Park Property larger than 3" diameter will also require that a site plan be submitted to the Parks and Recreation Commission for approval prior to their removal. 4: Minimum Size Requirement for Trees Planted on City Propertv A. Balled and Burlapped shade trees shall be at least 3" in diameter. Balled and Burlapped ornamental trees shall be at least 1%" in diameter. B. Bare root shade trees or container grown trees shall be 1%" in diameter at their base and may only be planted in the spring. c. Though no members of the public spoke on this item there was a discussion that centered around the policy that was proposed and would replace Code Section 510. The Hearing was held open pending the official review and approval of that policy. Both the Park and Recreation Commission and the Planning Commission recommended that there be a policy in place that would replace the Ordinance language of Chapter 510. That policy has been prepared and will also appear on the City Council's November 14, 2011 agenda, prior to this item. Staff recommends that the Council approve the attached ordinance, which will repeal Code Section 510, Tree Preservation. PARK AND RECREATION AND PLANNING COMMISSION REVIEW Both the Park and Recreation Commission and the Planning Commission have reviewed the recommendation to repeal Chapter 510. Both Commissions concur with staff s recommendation to repeal Chapter 510, with a public lands tree removal policy in exchange for having this ordinance. Abbott, Public Safety Director November 7, 2011 School Resource Officer Program Contract This memo is written in support of the City's acceptance of the School Resource Officer Program contract with Independent School District # 14 for the 2011-2012 and 2012-2013 school terms. The School District will fund a portion of the salary and benefits for two licensed police officers assigned as School Resource Officers (SROs). For the 2011-12 school term the amount shall be based on one SRO assigned for the entire term and one SRO assigned for 7/9ths of the term. This amount shall total $79,780. For the 2012-13 school term the amount shall be based on two SROs assigned for the entire term. This amount shall total $89,752. The School District officials and the City of Fridley Public Safety Director shall determine the specific days and hours to be worked under this agreement. The funding specified in the previous contract covering the 2010-2011 school term was $35,540 for one licensed police officer assigned as an SRO. The contract runs through the end of the 2012-2013 school term. The City or the School District may exercise a 30-day cancellation clause at any time. A copy of the contract is attached for review. The contract will be presented to the District #14 School Board for approval at their November 15, 2011 meeting. Staff recommends approval of the School Resource Officer Program contract. 39 SCHOOL RESOURCE OFFICER PROGRAM AGREEMENT BETWEEN THE CITY OF FRIDLEY AND INDEPENDENT SCHOOL DISTRICT #14 This agreement is made the 315t day of October, 2011, pursuant to M.S. 471.59 by and between the City of Fridley (City) and Independent School District #14 (School District). 1. PURPOSE The City and the School District wish to participate in a Schoo) Resource Officer Program. Both the City and the School District agree that a School Resource Officer Program improves understanding and promotes mutual respect between police, school, staff, counselors, parents and students. The purpose of this Agreement is to set forth in writing the terms and conditions of the mutual duties and obligations and to fund the position of School Resource Officer (SRO). 2. FUNDING The School District will fund a portion of the salary and benefits for two licensed police officers assigned as School Resource Officers. The School District agrees to provide adequate office space, telephone and other reasonable clerical support services. Basic assignments will be to the High School and Middle School with occasional support at other facilities as needed. 4. PAYMENT The City shall provide billing to the School District for services provided in this Agreement, and the School District will remit payment to the City on a quarterly basis. 40 1 5. TERM This Agreement shail commence on the 15C day of November, 2011, and shall end on the last day of the 2012-13 school term. Thereafter, it may be renewed on a yearly basis by mutual agreement. Either party may cancel this Agreement with a 30 day written notice. 6. GENERAL PROVISIONS It is expressly agreed that the School Resou�ce Officers are City emplayees and shall not be considered employees of the School District for any purpose including but not limited to salaries, wages, other compensations or fringe benefits, Worker's Compensation, Unemployment Compensation, P.E.R.A., Social Security, Liabitity Insurance, keeping of personnel records, termination of employment, individual contracts or other contractual rights. The City shall assume all liability for the actions taken by the SROs in the performance of their duties as Peace Officers. The SROs shall repart to and be directed by the City of Fridley Public Safety Director or his designee, but wili receive general and daily direction from the assigned school building administrator. Representatives of the School District and the Public Safety Director or his designee shall negotiate resolution of unforeseen problems arising in this program. 7. SCHEDULING The duty hours of the SROs are flexible and will be primarity coordinated with the school day and activities. The SROs will make daily contact with the Police Department for the purpose of keeping abreast of incident reports and other City activity. The SROs may be required to conduct juvenile investigations. During non-school periods, the City will determine the SROs duties and schedule. 8. DISCRfMINATION The City and the School District agree not to discriminate in providing services under this Agreement on the basis of race, sex, creed, national origin, age or religion.
