WHEREAS, the quaZity of Zife in the United States is preserved and enhanced by the diligent efforts of
our Zaw enforcementpersonnel,� and �
WfIEREAS, 700, 000 men and women in the United States, including mare than 9, 000 Minnesota peace
o�cers, and 38 Fridley polace officers serve their fellow citizens as law enforcement officers; and
WHEREAS, Mdnnesota has [ast 297 law enforcement officers in the line of dury since 1874 and the
national doll exceeds 19, 000 fallen o�cers,- and
WHEREAS, Minnesota lost two peace officers— St. Louis Park Police Officer Mike Pollitz and Lake Ciry
Police O�cer Shawn Schneider —in the line ofduty in 2011; and
WHEREAS, 68 peace o�cers across the Nation were killed in the line of duty during 2011; and
WHEREAS, every year, 1 out of every 9 peace a�cers is assaulted, 1 out of every 25 peace officers is
injured, and 1 out of every 4,400 peace o�cers is killed in the line of dury; and
WHEREAS, on average nationally, over 59, 000 officers are assaulted resuZting in over 16, 000 injuries
annually; and

CONT]NUATION OF LOCAL BOARD OF APPEAL AND EOUALIZATION MEETING:
Review of Property Located at 230 Craigbrook Way N.E. (Ward 3):
Mary Smith, Assessor, said the first meeting was held on April 9. The purpose of this meeting
is to establish the 2012 estimated market value at 230 Craigbrook Way NE. The Boazd has three
possible courses of action: To affirm, reduce or increase the current value based on information
presented. Staff had been unable to view this property since 2004.
Ms. Smith stated that after review of the property on April 19, it is stafPs recommendation to
lower the estimated market value from $222,100 to $198,000. The decrease in value is based
upon the following:
The effective age, which determines the amount of depreciation, was adjusted downward
to a standard rate based on no updates to the kitchen, bathrooms, exterior, or the
windows.
An upward adjustment was made for a two-lane concrete driveway and a downward
adjustment was made far the number of finished squaze feet on the lower level.
Comparable sales used in the owner's appraisal and comparable sales examined by our
office were also reviewed and reconciled to the revised valuation.

Ms. Smith stated staff recommend to the Board of Appeal and Equalization that the estimated
mazket value for 230 Craigbrook Way NE, Pin No. 03-30-24-43-0037, be reduced from
$222,100 to $198,000.
Councilmember Bolkcom asked if there was contact with homeowner.
Mr. Smith answered yes. Staff has been to the home and viewed it with the homeowner. The
new amount was agreed with the homeowner via email.

Councilmember Bolkcom noted on the bottom of page three, third paragraph from bottom, it
should read want instead of wanted.
Mayor Lund noted that on page 23 during the Public Hearing, Joe Brothers stated he read on the
internet that the RER Developer for the BAE site mentioned a profit of $102,000,000. After the
public heazing was closed Paul Hyde from RER stated that a$1.2M profit was expected
annually. The minutes aze correct but Mayor Lund just wanted to be recorded that the
information stated was not correct.
William Burns, City Manager, said that the rate of return for the developer is part of the
development agreement along with the City's contribution to the project.

1. Approve Amendment to comprehensive Sign Plan for Hiilwind Ofiice Centre,
Generally Located at 941 Hillwind Road (Ward 2).
William Burns, City Manager, said these changes would allow LED lighting and mounting of
signage to brackets. Staff recommends Council's approval.

2. Receive Bids and Award Contract for 2012 Sanitary Sewer Lining Project No. 416.
William Burns, City Manager, stated the low bidder for the 2012 sanitary sewer lining project
was Lametti & Sons, Inc., of Hugo, Minnesota, in the amount of $270,150. Unfortunately this
amount is $75,000 more than the $195,000 we have budgeted for this year. Rather than rebid,
staff is suggesting that we reduce the project scope by eliminating the lining of 660' of 21" pipe
south of I-694 that lies between Main Street and the BNSF tracks. The savings from this
reduction is $48,000. This together with $15,000 in savings from the Georgetown Lift Station
repairs and $15,000 in savings from other sewer line repairs will more than cover the shortage.
Staff recommends Council's approval.
RECEIVED BIDS AND AWARDED CONTRACT FOR THE 2012 SANITARY SEWER
LINING PROJECT NO. 416 TO LAMETTI & SONS, INC., IN THE AMOUNT OF
�270,150.00.
3. Resolution Approving and Authorizing Signing an Agreement with Sergeants of the
City of Fridley Police Department for the Years 2012 and 2013
William Burns, City Manager, asked Council to insert a new page 34 with two minor changes;
31.1c add "and technical" after the word "vocaUonal;' and in 31.2 fourth sentence add (i.e. lab
fees, etc.) after "required fees related to the course."
Dr. Burns said this contract is almost the same as the police patrol contract that Council
approved on April 9. The only difference is that in lieu of the shift differential received by the
patrol, the sergeants aze getting a slightly different wage package. The terms are as follows:
1. Health insurance: Remains the same as for non-union employees.
2. Wages: 2% on January 1, 2012; and 2% on January 1, 2013,
3. Annual Leave Sell-back: This was eliminated. In exchange, the leave cap has been
raised from 240 hours (30 days) to 280 hours (35 days).
4. Holiday Pay: Unused Holiday time (up to 88 hours for 11 paid holidays) will be paid
out at the end of the year.

5. Tuition Reimbursement: Reimbursement level remains at $2,925 per employee.
Payment is to be made at the completion of a course.
6. The estimated cost for 2012 is $9,734, and for 2013 is $9,916.
Staff recommends Council's approval.
Councilmember Varichak noted that on page 10, the second paragraph, should read bring
instead of brine.

6. Informal Status Report:
Councilmember Varichak noted the recycling event was held last Saturday and went well.
People did not have to wait very long, and there was a good turnout.
Councilmember Bolkcom asked if information regarding the project to resurface Highway 65 is
o� the City's website.
William Burns said they are only resurfacing a small portion, but he would be sure the
information gets on the website. The large project will be on East River Road, with an entire
lane closing through most of June.
Councilmember Bolkcom said engineers have been in the Oak Glen area and residents should
be getting another notice for two different dates. Because of a11 the erosion in this area, the
project may be reduced because of cost.
Mayor Lund announced the upcoming StarGazers annual fundraiser is on Saturday, May 19.
This is a dinner and variety talent show. The cost for the show only is $1� for reserved seats and
$5 for a general seat. The dinner/show cost is $25 per person. Dinner is at the Fridley Middle
School cafeteria at 5:30, and the show is at the district auditorium at the High School at 730

Stacy Stromberg, Planner, stated it is no secret that over the course of the last several years, we are
heazing more and more about creating healthy lifestyles, which includes the opportunity to pwchase and
consume fresh, locally grown fruit and vegetables. One way City staff has been able to help with these
efforts has been through helping administer the Statewide Health Improvement Program (SHIP), with
assistance from the school districts and Unity Hospital. The SHIP program helped fund the East River
Road Corridor Project study, which had an emphasis on creating multi-modal transportation along this
corridor within the City. It also helped the City complete a Bikeway/Walkway Study to help identify
where our current walking and biking systems have missing links. It is our hope to eventually receive
grants to help fill in those gaps.
Ms. Stromberg stated City staff has also spent some time brainstorming on other ways to help bring
healthier lifestyle options to our residents. Two options that keep coming up are providing opportunities

for community gardens and local farmers markets. The City already has two community gardens for
residents, one at the City`s Public Works Garage and the other is administered through Unity Hospital. If
there is further interest from residents for other Community Garden opporlunities, the City may want to
fully research what other options it might have to fulfill that need. Unity Hospital conducted a Farmers
Market on their site last summer, which was mainly geared towards employees and was held once a week.
The City has also received inquires from St. Philip's Lutheran Church and Medtronic to have a farmers
market. The Ciry currently does not have any specific regulations allowing Farmers Markets and, as a
result, Fridley's Zoning Code does not permit them.
Ms. Stromberg stated when staff originally started their research, they surveyed some of the surrounding
communities to see what their requirements are. In doing that research they discovered a lot of cities do
not fiave any speci5c regulations for Farmers Markets. Some allow them as a transient merchant, others
allow them through City or Communiry sponsored events and others allow them without any specific
regulations and yet, others require a special use permit be granted.
Ms. Stromberg stated they also contacted the Minnesota Farmers Market Association (MFMA) to see
what kind of regulations they typically see when Farmers Markets operate within a particular community
and received positive feedback from them on our proposed reguiations. MFMA is a non-profit,
membership-based organization dedicated to supporting the growth and development offarmers' markets
across the state ofMinnesota.
Ms. Stromberg stated as a result of their research, City staff has been working on the proposed language
with the City Attomey. We decided that in order to ailow farmers markets to exist in our community
without making it too complicated, yet still be controlled, they would suggest allowing a farmers market
as an accessory use in all zoning districts provided certain regulations can be met They can only be
located on a residentially zoned property, provided it has an institution on it. An institution is defined as,
a public or private institution includes churches, schools, hospitals and medical clinics.
Ms. Stromberg stated the next thing staff did was develop a Farmers Market definition. That definition

Ms. Stromberg stated staff has drafted an ordinance that would allow Farmers Market as an accessory
use in all zoning districts, provided certain regulations can be met. The regulations are listed below, with
the reasons why staff and the City Attomey determined the regulations were necessary in bold.
B. Accessory Uses
Fazmers Market provided it meets the following requirements:
(a) Shall be a member of the Minnesota Farmers Market Association or other similar recoenized
association of farmers markets and meet all of their resuective requirements;

In order for a Farmers Market to be a member of the MFMA, they must meet three
criteria. 1. They need to be a community farmers market that represents three or more
growers. 2. They need to be an established market wit6 by-laws, and a membership dues
struMure. 3. They need to sell a majority of Minnesota Grown agricultural products. By
requiring that the Farmers Market is a member of the MFMA or another similar organized
association ensures that the market members are properly licensed, insured, and inspected.
Requiring this protects the City by knowing that the Association is guaranteeing that its
members are properly managed.
(b) Shall identi a market mana er that facilitates the re uirements of the Ci
According to the MFMA, most established farmers markets will have a designated market
manager that is in control of making sure t6e vendors follow the guidelines or bylaws and
have the necessary permits. Requiring this as a condition will give t6e City oue point
person to communicate with to ensure the market has everything required.
Vice-Chairperson Oquist asked would this person be controlled by the institution, such as Medtronic, or
would it be someone running the market?
Ms. Stromberg replied, most likely it would be the person running the market and in charge of the
gowers.
(c) Shall have General Liabili insurance includin Products and Com leted O erations covera e
with a minimum Limit of Liabilirv of $1 500 000 oer occurrence;
Requiring this provides protection for the C�ty and the market.
(d) Shall have ap�lied for and received all required countv and state licenses and have comalied with
all applicable CiN of Fridley regulations and citv codes;
Requiring this provides protection for the City and the market.
(e) A majoritv of the products sold shall be Qrown or oroduced in Minnesota;
This is a requirement of the Mk'MA and w�ll be subm�tted to the C�ty with the permit form.
Providing MN grown products is what t6e City hopes to achieve by allowing Farmers
Markets wit6in the City, thereby providing fresh, locally grown produce to Fridley
residents.

Farmers Market. That definition again is: A temporary, seasonal, outdoor event that
provides an opportunity for the public to buy Minnesota grown fresN fruits, vegetables,
flowers and iood products directly from farmers, growers, or producers. Locally grawn
products are picked tresh and brought straig6t to the market and sold by the growers
themselves or locally grown products that are prepared or processed according to
guidelines set forth by Minnesota Department of Agriculture's Food & Dairy Inspection
Division in accordance with t6e Minnesota Department of Health. Locally crafted specialty
items are allowable provided they are not mass-produced.
(g) Anv advertisine or directional siens disvlaved either off premise or on premises shall onlv be
disolaved on the dav of the event with the exce�tion of one 4-foot bv 8-foot si�n that can be
dis la ed on the remises for the duration of the farmers market season•
Being speci£�c about what is required for signage for the event will help ensure that the
market is aware of the regulation, therefore providing tor less potential violations.
(h) The location of the event shall have written authorization from the arooertv own ,er•

Property owner consent is something the City requires on permit applications to ensure that
the property owner knows whaYs happening on their property.
(i) An established schedule shall be submitted as to the dates and times of the market;
Requiring this provides t6e City with the schedule of the event, so we know what is
happening on the property.
(j) An tem ora structure used for the farmers market shall be erected and removed on the da of
the event;
Requiring this will prevent temporary tents from sitting o� site when the market is not
running
(k) A site plan shall be submitted showin�tent and vendor locations vehicle circulation and aarking
prior to commencement of event Site olan to be approved bv the CommumN Development
Director;
Staff wants to ensure that traftic patterns and parking are not adversely affected by the
event.
(I) A Farmers Market Event Permit Application shall be com�leted, anaroved and on file with the
Communitv Develoqment Director prior to commencement of event nrovidm¢ oroof that all
above requirements are beins met;
A permit submittal requirement will allow the City to have the proper information
submitted and approved prior to the event.
Commissioner Sielaff asked whether there is any restriction as to how long the Farmers Market season
will be?
Ms. Stromberg replied, they did not put a restriction on that and that is why the City is asking them to
tell us when they want to have it. It is up to the market, so for example if they want to have it open until
November so they can potentially sell squash, pumpkins, etc., that would be up to them.
Commissioner Sietaff stated one of the issues that came up at tfie Minneapolis farnters market is they
extended the season and what they did is bring in produce from outside of Minnesota.
Ms. Stromberg replied, she said staff wanted to keep it a little open ended in case someone wanted to do
something in the fall or early spring but, again, the majoriTy of the products need to be grown or produced
in Minnesota.
Commissioner Sielaff stated it seems to him it should be matched with the growing season in Minnesota
so they do not have produce coming from Califomia for example.
Ms. Stromberg stated that requiring them to be part of the Minnesota Farmers Market Association will
help with that because they also have strict requirements about that.
(m) The Citv reserves their ri�ht to revoke anv Fartners Market Event Permit issued for failure of
com�liance with the above requirements The City will process am such hcense revocat�on
accordin¢ to the procedures listed in Ciri Code Section 11.08.
Providing this regulation allows the City to revake the permit in the event that compliance
of a market is not achieved.
Ms. Stromberg stated staff has determined that the above listed requirements are necessary for a Farmers
Market to work within the City. The above language will be added to each section of the zoning code,

including the residential, commercial, industrial, the "special" zoning districts, such as the S-1, Hype
Park, S-2, Redevelopment, S-3, Onaway, the PUD zoning district and the newly approved TOD, Transit
Oriented Development district. Whe� the TOD language was approved, Farmers Markets were allowed
through a special use permit. If they are proposing to allow Farmers Markets to exist as an accessory use,
with a permit in all other zoning districts, it only seemed appropriate to allow it in the TOD as well.
Ms. Stromberg stated City staff recommends approval of the proposed text amendment to the R-1,
Single Family, R-2, Two Family, R-3, General Multiple Dwelling, P, Public, Gl, Local Business, G2,
General Business, C3, General Shopping, CR-1, General Office, M-1, Light Industrial, M-2, Heavy
Industrial, M-3, Heavy Industrial Outdoor Intensive, M-4, Manufacturing Only, PUD, Planned Unit
Development, S-1, Hyde Park Neighborhoods, S-2, Redevelopment S-3, Heavy Industrial Onaway
Addition and O-8, Transit Oriented Deveiopment Overlay zoning district. These changes will allow
Farmers Markets to exist within the City as an accessory use, provided certain regulations can be met.
These changes will support opportunities for local growers to sell fresh, locally grown produce within our
Community. The proposed text amendment is attached in your packet for your review.
Commissioner Solberg asked about selling items other than produce because oftentimes you go to a
farmers market and you have lots of craft items, eta The language does state locally crafted items are
allowable provided they are not mass produced. Are there any other restrictions on that or is it pretty
much open to people who are making furniture, jewelry, honey butter, etc:?
Ms. Stromberg replied, staff would see a list as part of a submittal of the types of things that are going to
be sold; but if somebody is making the jewelry at their house and they want to sell it, or honey, syrup, any
of those kinds of things would be allowed as long as it is not mass produced. For example, if jewelry that
is made in China and sold here, woulddt be allowed. We dodt want it to tum it into a flea market.
Vice-Chairperson Oquist asked whether the individual people have to belong to the Minnesota Farmers
Market Association or is it the gzoup?
Ms. Stromberg replied, usually it is a group; however, individuals can be members if they are not part of
a group.
Commissioner Sielaff asked who is going to control the rules and regulations of the Minnesota Farmers
Market Association? They have to belong and pay dues to the Association, who controls and enforces
that?
Ms. Stromberg replied, when they apply to the City, they have to show proof that they belong with the
Minnesota Farmers Market Association. Also, that is where the licensing comes in, too. In order to sell a
product in Minnesota, you need to meet regulations set by the Minnesota Agriculture Department.
Vice-Chairperson Oquist asked what if two or three neighbors got together and wanted to have their
own market on their ow� property?
Ms. Stromberg replied, they would not fit the proposed regulations because it would not be an institution
in a residential district. If someone is having a garage sale and they have their own cucumbers they grew,
the Ciry would not get in the middle of that.

Commissioner Sielaff asked what happens if the growers do not do what they are expected to do? The
Association is essentially regulating their own members?
Ms. Shomberg replied, yes, they have bylaws, membership fees, etc.
Commissioner Sielaff asked whether the City does anything to make sure they do those things?
Ms. Stromberg replied, ultimately, they are the pros. They know more than the City staff would know
about the farmers market business and that is why staff went to them to get their ideas. However, the City
is requiring that each market submit information so staff can double-check that and make sure the City
has their insurance, their market manager, make sure they are a member, that they have bylaws, etc. The
City is doing the best they can to help regulate them. If the City does have an issue with the Minnesota
Farmers Market Association staff would talk to them about it.
Commissioner Sielaff asked whether the City is putting itself in a position where it is having to make
sure the members follow their own bylaws?
Ms. Stromberg stated the staff would not have time for that and is asking the Association for their help
with making sure all these farmers that come into the community are properly Iicensed because that is
their job. In order to be a member of the Association, they need to be properly licensed.
Commissioner Sielaff stated to him it seems unclear as to where the enforcement would occur.
Ms. Stromberg stated that is where the insurance comes in if something happens and also the City has
the ability to revoke and stop the market from hapgening if there were an issue.

fruit and vegetables. One way City staff has been able to help with these efforts has been through
helping administer the Statewide Health Improvement Program (SHIP), with assistance from the school
districts and Unity Hospital. The SHIP program helped fund the East River Road Corridor Project study,
which had an emphasis on creating multi-modal transportation along this corridor within the City. It
also helped the City complete a Bikeway/Walkway Study to help identify where our current walking and
biking systems have missing links. It is our hope to eventually receive grants to help fill in those gaps in
our walking and biking systems.
Over the course of the last several months, City staff has been researching the concept of allowing
farmers markets within our community. We contacted some of the surrounding communities and the
Minnesota Farmers Market Association, in order to prepare for the creation of this text amendment.
After our research was gathered, we worked with the City Attorney to develop the new code language
that is in the atiached staff report that was presented to the Planning Commission.
PLANNING COMMISSION RECOMMENDATION
At the April 18, 2012 Planning Commission meeting, a public hearing was held for TA #12-01. No one
from the public addressed the Planning Commission on this amendment. After a 6rief discussion, the
Planning Commission made a motion to approve TA #12-01. The motion was approved unanimously.
There has been a slight modification to the Farmer's Market definition. The change simply clarifies the
wording of the original definition as approved by the Planning Commission, it does not change the
substance of what was approved.
STAFF RECOMMENDATION
City staff recommends concurrence with the Planning Commission and that the Council hold

which had an emphasis on creating multi-modal transportation along this corridor within the City. It
also helped the City complete a Bikeway/Walkway Study to help identify where our current walking and
biking systems have missing links. It is our hope to eventually receive grants to help fill in those gaps.
City staff has also spent some time brainstorming on other ways to help bring healthier lifestyle options
to our residents. Two options that keep coming up are providing opportunities for community gardens
and local farmers markets. The City already has two community gardens for residents, one at the City's
Public Works Garage and the other is administered through Unity Hospital. If there is further interest
from residents for other Community Garden opportunities, the City may want to fully research what
other options we might have to fulfill that need. Unity Hospital conducted a Farmers Market on their
site last summer, which was mainly geared towards employees and was held once a week. We have
also gotten inquires from St. Philip's Lutheran Church and Medtronic to have a farmers market. The City
currently doesn't have any specific regulations allowing Farmers Markets, and, as a result; Fridley's
Zoning Code does not permit them.
When we originally started our research, we surveyed some of the surrounding communities to see
what their requirements are. In doing that research we discovered that a lot of Cities don't have any
specific regulations for Farmers Markets. Some allow them as a transient merchant, others allow them
through City or Community sponsored events and others allow them without any specific regulations
and yet, others require a special use permit be granted.
We afso contacted the Minnesota Farmers Market Assoclation (MFMA) to see what kind of regulations
they typically see when Farmers Markets operate within a particular community and received positive
feedback from them on our proposed regulations. MFMA is o non-profit membershrp-
based orgonization dedreated to supporting the growih and development of formers' markets ocross the
state of Minnesota. The Minnesota Farmers Market Association states that their purpose is to provide
service to farmers, growers and producers throughout Minnesota that can benefit by networking to:

• Co-op purchasing of market and vendor liability insurance

• Promote and support acceptance of food assistance benefits such as SNAP, WIC, & FMNP
• Share educational resources and conduct seminars on the varied facets of farmers' markets such
as marketing, vendor procurement, food safety, fiability, market management concerns,
customer service, etc.
As a result of our research, City staff has been working on the proposed language with the City Attorney.
We decided that in order to allow farmers markets to exist in our community without making it too
complicated, and still be controlled, we would suggest allowing a farmers market as an accessory use in
all zoni�g districts provided certain regulations can be met. They may, however, only be located on a
residentially zoned property,if it has an institution on it. An institution is defined as, a public or private
institution includes churches, schools, hospitals and medical clinics.
The next thing we did was develop a Farmers Market definition. That definition is: A temoorarv,
seasonal, outdoor event that provides an opportunitv for the public to buv Minnesota arown fresh
fruits, veRetables, flowers and food qroducts directiv from farmers. �rowers, or producers. Locallv
Rrown products are uicked fresh and 6rou�ht straieht to the market and sold bv the �rowers themselves
or locallv arown products that are prepared or processed accordina to auidelines set forth bv Minnesota
Department of Aariculture's Food & Dairv Inspection Division in accordance with the Minnesota
Deqartment of Health. Locallv crefted specia{tv items are allowa6fe qrovided thev are not mass
nroduced. This definition will be added to the definition section of the zoning code.
We also developed a"Farmers Market Event PermiY', which is attached for your review, and will be
issued and reviewed and approved by City staff.
Staff has drafted an ordinance that would allow Farmers Market as an accessory use in all zoning
districts, provided certain regulations can be met. The regulations are listed below, with the reasons
why staff and the City Attorney determined the regulations were necessary in bold.
Accessory Uses
Farmers Market, provided it meets the followina requirements:
(a) Shall be a member of the Minnesota Farmers Market Association or other similar reco�nized
association of farmers markets and meet all of their respective requirements:
In order for a Farmers Market to be a member of the MFMA, they must meet three criteria. 1.
They need to be a community farmers market that represents three or more growers. 2. They
need to be an established market with by-laws, and a membership dues structure. 3. They
need to sell a majority of Minnesota Grown agriculturel products. By requiring that the
Farmers Market is a member of the MFMA or another similar organized association ensures

that the market members are properly licensed, insured, and inspected. Requiring this
proteds the City by knowing that the Association is guarenteeing that its members are
properly managed.
(b) Shall identifv a market manaaer that facilitates the requirements of the CitY;
According to the MFMA, most established farmers markets will have a designated market
manager that is in control of making sure the vendors follow the guidelines or bylaws and
have the necessary permits. Requiring this as a condition will give the City one point person
to communicate with to ensure the market has everything required.
(c) Shall have General Liabilitv insurance includinR Products and Completed Operations coveraae
with a minimum Limit of Liabilitv of $1,500,000 per occurrence;
Requiring this provides protection for the City and the market.
(d) Shall have applied for and received all required countv and state licenses and have complied
with all applicable Citv of Fridlev re�ulations and citv codes;
Requiring this provides protection for the City and the market.
(e) A maior�tv of the products sold shall be Qrown or oroduced in Minnesota;
This is a requirement of the MFMA and will be submitted to the City with the permit form.
Providing MN grown products is what the City hopes to achieve by allowing Farmers Markets
within the City, thereby providing fresh, locally grown produce to Fridley residents.
(f) The sale of live animals and alcoholic beveraaes is prohibited:
The Famers Market is limited to the sale of the items listed within the definition of Farmers
Market. That definition again is: A temporery, seasonal, outdoor event that provides an
opportunity for the public to buy Minnesota grown fresh fruits, vegetables, flowers and food
products directly from farmers, growers, or producers. Locally grown products are picked
fresh and brought straight to the market and sold by the growers themselves or locally grown
products that are prepared or processed according to guidelines set forth by Minnesota
Department oi Agriculture's Food & Dairy Inspection Division in accordance with the
Minnesota Department of Health. Locally crefted specialty items are allowable provided they
are not mass produced.
(g) Anv advertisin� or directional si�ns disqlaved either off premise or on premises shall only be
disolaved on the dav of the event, with the exception of one 4 ft. bv 8 ft. sian that can be
dispiaved on the qremises for the duration of the farmers market season;
Being specific about what is required for signage for the event will help ensure that the
market is awa�e of the regulation, therefore providing for less potential violations.
(h) The location of the event shall have written authorization from the qrooertv owner;
Property owner consent is something the City requires on permit applications to ensure that
the property owner knows whaYs happening on their property.
(i) An esiablished schedule shall be submitted as to the dates and times of the market:
Requiring this provides the City with the schedule of the event, so we know what is happening
on the property.
(j) Anv temporarv structure used for the farmers market shall be erected and removed on the dav
of the event;
Requiring this will prevent temporary tents from sitting on site when the market isn't running
(k) A site plan shall be submitted showin� tent and vendor locations, vehicle circulation and parkinR
prior to commencement of event. Site olan to be approved bv the Communitv Development
Director;
Staff wants to ensure that treffic patterns and parking aren't adversely affected by the event.
(I) A Farmers Market Event Permit Aoplication shall be comoleted, approved and on file with the
Communitv Development Director orior to commencement of event; providin� proof that all
above requirements are bein¢ met;

A permit submittal requirement will allow the City to have the proper information submitted
and approved prior to the event.
(m) The Citv reserves their ri¢ht to revoke anv Farmers Market Event Permit issued for failure of
compliance with the above requirements. The Citv will process anv such license revocation
accordin� to the procedures listed in Citv Code Section 11.08.
Providing this regulation allows the City to revoke the permit in the event that compliance of
a market isn't achieved.
Staff has determined that the above listed requirements are necessary for a Farmers Market to work
within the City. The above language will be added to each section of the zoning code, including the
residential, commercial, industrial, the "special" zoni�g districts, such as the S-1, Hype Park, S-2,
Redevelopment, S-3, Onaway, the PUD zoning district and the newly approved TOD, Transit Oriented
Development district. When the TOD language was approved, Farmers' Markets were allowed through
a special use permit. If we are proposing to allow Farmers Markets to exist as an accessory use, with a
permit in all other zoning districts, it only seemed appropriate to allow It in the TOD as well.
STAFF RECOMMENDATION
City Staff recommends approval of the proposed text amendment to the R-1, Single Family, R-2, Two
Family, R-3, General Multiple Dwelling, P, Public, G1, Local Business, C-2, General Business, C-3, General
Shopping, CR-1, General Office, M-1, Light Industrial, M-2, Heavy Industrial, M-3, Heavy Industrial
Outdoor Intensive, M-4, Manufacturing Only, PUD, Planned Unit Development, S-1, Hyde Park
Neighborhoods, 5-2, Redevelopment 5-3, Heavy Industrial Onaway Addition and 0-8, Transit Oriented
Development Overlay zoning district. These changes will allow Farmers Markets to exist within the City
as an accessory use, provided certain regulations can be met. These changes will support opportunities
for local growers to sell fresh, locally grown produce within our Community.

INTRODUCTION
Lary Falck owns the property at 1135 73rd Avenue. He purchased the property in the early 1980's. In
April of 1982 the City approved a Storm Water Management Plan and an Erosion Control Plan. At that
time, the Rice Creek Watershed folks were to review and approve this plan and records show that they
did evaluate and approve the Falck proposal at that time. While Kyle Knutson was a� intern with our
staff in 2009, he observed the outdoor storage at this site and questioned whether a special use permit
would be required and if one had been obtained. After much research it was determined that the Falck
"Plan" came into existence prior to the very specific 1983 Special Use Permit ordinance requirements for
outdoor storage. Therefore, as long as the falck property was developed in accordance with the 1982
approved plan, it would not require an SUP. Though the site was largely compliant, there were fence
line, landscape, and outdoor storage inconsistencies observed in present day site conditions, compared
to the 1982 plan. An agreement between the City and Mr. Falck was created to set forth the conditions
for bringing the property into compliance in a timely and appropriate manner, while avoiding the more
strict standards required by a modern Special Use Permit.
ELEMENTS
The 1982 plan included a smaller fenced area and a smaller more defined area for outdoor storage.
Though the plan was approved in 1982, the project was not completed by Falck's contractors until
several years later. In recent years areas intended for parking had been taken over by materials that
were being stored outdoors. Once corrected, the fence line will have been moved inward to the storage
area, reducing the overall size of the outdoor storage lot. Screening of materials and landscaping were
also required as part of their original plan. A copy of the original plan has been attached for your
convenience. Failure to complete and/or relocate the required landscaping, or to relocate the fence in
accordance with the attached plan will constitute a default to the agreement and be subject to citation

and criminal prosecution. From all indications given to our staff and City Attorney, Lary Falck intends to
comply with the requirements of the agreement and have all items corrected by June 15, 2012.
RECOMMENDATION
Staff recommends that the attached Resolution with accompanying Compliance Agreement between
the City of Fridley and Lary B. Falck, be approved as submitted.

to bring the property into compliance and relocate the fence according to the

WHEREAS, a copy of the approved Compliance Agreement has been attached as
Attachment 1;
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the

COMPLIANCE AGREEMENT
THIS COMPLIANCE AGREEMENT (the "AgreemenY') made this day of
, 20 , is by and between City of Fridley, a body corporate (the "City")
and Lary B. Falck, a single pexson ("Owner").
RECITALS
WHEREAS, Owner is the fee owner of property located at 1135 — 73rd Avenue,
Fridley, Minnesota,legally desccibed as Lots 3 through S,inclusive, Block 2, Centra!
View Manor, excluding road and subject to easements of record, Anoka Counry,
�Llinnesota (the "Property"); and
WHEREAS, the City through its Community Development Department issued
Owner a Notice of Noncompliance relating to alleged violations of the City of Fridley
Code (the "Code"); and
WHEREAS, the City and Owner have now reached an agreement to resolve the
compliance issues and any and all claims that may be made against Owner relating to
said compliance issues; and
WHEREAS, the parties desire to document their agreement in writing i❑
recordable form:
NOW, THEREFORE, in consideration of the mutual agreements and covenants
set forth herein, the receipt and sufficiency of which is hereby acknowledged by each of
the parties, the parties agree as follows:
1. RESOLUTION. The parties acknowledge and agree that the type, style and
condition of the existing fencing is in compliance with and sufficient under the Code
requirements; however, the existing location of the fencing differs from the location of
fencing as indicated and approved on the Stormwater Management and Erosion Control
Plan approved by the City on Apri130, 1982 (the "Plan"). The paRies have further
agreed that Owner will remove the existing fencing in the locations as indicated on
Exhibit A, attached hereto aod incorporated herein, and wi11 install fencing in the
locations indicated on Exhibit B, attached hereto and incorporated herein (the
"Relocation"). When Owner completes the Relocation, Owner agrees to keep the any
outside stocage screened by and behind the relocated fencing (the "Fencing"). With
respect to the Fencing, Owner agrees as follows:
a. The Fencing shall not exceed 7 feet in height.
b. The Fencing shall completely enclose the outside storage and shall
completely screen it from view.
c. No outside storage shall exceed the height of the Fencing referenced in
subsection (a) above.
d. The Fencing shall be maintained in good repair.

In addition, Owner agrees to plant reasonable foliage on the green spaces within the
fenced area as requested by City and consistent with the Plan (the "Landscaping").
1,1 Completioa The parties acknowledge and agree that weather conditions in
Minnesota prevent the Relocation from being sufficiently and properly completed until
al] the frost has left the ground on the Property; therefore, it is agreed that Owner will use
reasonable efforts to complete the Relocation as soon as possible, but in no event shall
the Relocation be completed later than June 15, 2012 ("Completion Date"). The parties
further agree that Owner shall complete the Landscaping by the Completion Date.
1.2 Default. Owner consents and agrees that the following constitute default under
this Agreement, rendering the Agreement null and void and Owner's use of the Property
illegal:
a. Failure to complete that the Relocation, and the Landscaping, by the
Completion Date; and
b. Failure to correct any defect with the Relocation, the Landscaping ar the
Fencing because it is not in accordance with Eachibit B, the Plan or this
Agreement after City provides notice of default and ten (10) days to cure the
noticed default.
Owner acknowledges and agrees that Owner's failuze to complete the Relocation, and the
Landscaping or to cure any defect with the same because they were not in accordance
with Exhibit B, the Plan or this Agreement, after City has provided notice of default as
described herein may 000stitute a nuisance. In the event of any default, the City may
then commence code enforcement against the Owner and the Property, including criminal
prosecution and abatement pursuant to City Code and City Zoning Code.
2. REPRESENTATIONS.
2.1 Provided Owner completes the Relocation and the Landscaping by the
Completion Date and corrects any defect with the same or the Fencing within the cure
period referenced in Section 1.2 after City notifies Owner of the same and does not
violate any other terms and conditions of this Agreement, the City acknowledges,
represents, agrees and certifies as follows:
a. The Property will be deemed a legal non-conforming use for purposes of
outside storage and Fencing as depicted on Exhibit B under the Code;
b. That a special use or conditional use permit for the PropeRy is not
cunently needed for Owner's outside storage and Fencing as depicted o� Exhibit B and
a That any and all existing compliance issues related to outside storage and
Fencing with the Code aze hereby resolved.
Provided Owner completes the Relocation and the Landscaping by the
Completion Date and corrects any defects with the same or the Fencing because they

were not in accordance with Exhibit B or the Agreement, within the cure period
referenced in Section 1.2 after City notifies Owner of said defects, the City represents and
agrees it will not initiate a City Code or City Zoning Code violation or noncompliance
action ielated to the ontside storage consistent with the Plan and Fencing depicted on
Exhibit B, or 6ring or cause to be brought any civil action relating to the outside storage
consistent with the Plan and Fencing depicted on Exhibit B.
2.2 Owner acknowledges, represents and agrees that Owner is not permitted to
expand or increase its legal non-conforming outside storage azea beyond what currently
exists as of the date hereof or Fencing beyond that area and location depicted on Exhibit
B. Any such expansion or increase in the legal non-conforming outside storage area or
Fencing constitutes illegal land use and may result in code enforcement action against the
Owner and the Property including but not limited to criminal prosecution and abatement.
Moreover, Owner acknowledges and agrees that such expansion or increase in the legal
non-conforming outside storage area or Fencing beyond that depicted in Exhibit B
requires Owner to bring the Property into compliance with the City's then existing zoning
code requirements.
Owner acknowledges, represents and agrees that any change in the use of the
Property, whether by Owner or any subsequent owner, may result in the loss of the
Property's legal non-conforming use status under the Code and may require that a special
or conditional use permit be obtained.
23 The parties acknowledge, represent and agree that the Property is located within
the Rice Creek Watershed District ("RCWD") and based on current RCWI� rules, the
Property is not subject to regulation by the RCWD. However, Owner acknowledges and
agrees that, in the event and to the extent that the Property becomes subject to regulation
by the RCWD, Owner must comply with RCWD regulations.
3. CITY APPROVAL. This Agreement shall be approved by the City Council in
and for the City of Fridley and said approval shall be conclusively evidenced by the
signature of the Mayor and City Manager of the City on this Agreement.
4. MISCELLANEOUS.
4.1 Runs With the Land. The covenants and conditions contained in this Agreement
shall run with the land and be binding on the City, Owner and their respective successors
and assigns.
4.2 Recording. The parties agree that this Agreement shall be recorded with the
Anoka County Recorder.
43 Governing Law. This Agreement shall be governed by the laws of the State of
Minnesota.

4.4 Entire Agreement, Modification, Waiver. This Agreement constitutes the
entire agreement between the parties pertaining to the subject matter hereof and
supexsedes all prior and contemporaneous agreements and understandings of the parties,
and there are no warranties, representaUOns or other agreements between the parties in
connection with the subject matter hereof, except as to specifically set forth in this
Agreement. No supplement, modification or waiver of this Agreement shall be binding
unless it is executed in writing by the party to be bound thereby. No waiver of any of the
provisions of this Agreement shall be deemed or shall constitute a waiver of any other
provisions whether or not similaz, nor shall such waiver constitute a continuing waiver.
4.5 Counterparts. This Agreement may be executed in any number of counterparfs,
each of which shall be deemed an original but all of which shall constitute one and the same
instrument.

Award of 2012 Street Rehabilitation Project No. ST2012 - 01

On Friday, May 4, at 9:00 am, bids were opened for the 2012 Street Rehabilitation Project
No. 2012-01. Thirty one sets of plans and specifications were sent out and six bids were
received.
The majority of this project encompasses the rehabilitation of Rice Creek Terrace
neighborhood streets, Fourmies Avenue, and Highway 65 Service Drive (73rd Avenue to the
south). The project also +ncludes rehabilitation of Community Park parking lot, 1,500 feet of
water main replacement, replacement of five hydrants, curb repair, and minor
improvements.
The low bid was received from Midwest Asphalt Inc. of Hopkins, MN, in the amount of
$1,010,327.75. The high bid received was $1,368,371.30. The most recent construction
cost estimate pertormed by the engineering staff was $1,065,000. Please refer to the
attached summary sheet for a more specific breakdown of costs and funding sources,
which aiso compares the preliminary budget to the revised budget.
The project budget in the 2012 CIP is $1,349,000, including five funding components.
Funding for this project is derived from several sources including Municipal State Aid street
funding, special assessments, Parks CIP, and Utility CIP funds.
Special Assessment funding is estimated in the amount of $380,000. Special assessments
were calculated using the City's assessment policy for major roadway maintenance.
Assessments are projected to be in line with the Feasibility Report which estimated a single
family property assessment of $1,950. Final assessment costs will be calculated at the
completion of the project and assessed in the fall of 2012.

Property owners will receive notification of project advancement this spring. A project
information sheet will provide a tentative work schedule, work description and contact
information. During the project, Staff will distribute project updates at key milestones such
as pavement removal and paving in order to minimize disruption to the residents.
Midwest Asphalt, Inc. has completed several past projects for the City including 2008 Street
Rehabilitation Project and several mill and overlays. They have vast experience in
performing similar work. Staff has found their workmanship and attention to schedule to be
acceptable and responsive. Midwest Asphaft, Inc has demonstrated pride in their work and
attention to detail.
Recommend the City Council receive the bids and award the 2012 Street Improvement
Project No. ST. 2012-01, to Midwest Asphalt, Inc. of Hopkins, MN in the amount of
$1,010,327.75.

Award 2012 Water Main Project No. 404 and Jackson Street Improvement
Project No. 413
On Tuesday, April 24, 2012, bids were opened for the 2012 Water Main Project No. 404 and Jackson
Street Improvement Project No. 413. Four responsive bids were received on this project (see
attached tabulation). The bids were reviewed and verified correct. The low bid was received from
GM Contracting, Inc. of Lake Crystal, MN in the amount of $496,699.01. The high bid received was
$602,860.03.
Three separate water main projects and Jackson Street storm sewer project were combined to gain a
pricing advantage as the piping materials and installation methods are similar. The water main
portion of the bid is $409,541.15 and the storm sewer portion is $87,157.86.
2012 Water Main Project No. 40A includes installation of water main pipes located on the streets of
83rd Avenue, Anoka Street, and Fireside Drive. See attached map for specific location. The Water
Main CIP budget identifies funding for the rehabilitation and expansion of ourwater main distribution
system. The proposed water main work is within budget.
Jackson Street Improvement Project No. 413 includes the installation of two storm sewer pipes on
each side of Jackson Street and the connection of private sump pump service lines. This storm sewer
work is funded through property owner assessments and Storm Sewer CIP budget. The assessable
portion is approximately $57,900. All property owners will contribute 50°10 of the storm sewer pipe
and installation costs. The City's portion of the costs will be funded through available Storm Sewer
CIP budget.
The bid format was structured to obtaln service line pricing from the contractor. If a property owner
wishes to connect their existing sump discharge pipe or extend a service line to their property, the
associated costs will be equallv shared by that property owner and the City. Property owner will also
be responsible for costs for running the service line to their house and any connections required.
Property owners will be presented with the service line costs and have an option to select
construction at the contracted rate, or to obtain their own contractor for their portion of the work. The
base assessment for all owners will be approximately $1,315, which is $65 higherthan the estimated
assessment discussed previously. In order to control the costs to owners, we will only install service
stubs when requested. Elective service work will increase their base assessment.

GM Contracting, Inc. has not previously worked in the City of Fridley. Staff requested references and
was supplied with a substantial list of references. Staff contacted 3 metro cities and all responded
favorably with respect to the contractor's workmanship, schedule, and budget.
If awarded, contracts will be executed and staff will schedule a preconstruction meeting. At that time
a schedule of work will be received from the contractor and communicated to the property owners.
The contractor has indicated that they are ready to begin construction immediately. The completion
date for the projects is September 15, 2012. Adjacent property owners will receive project information
after award.
Staff recommends the City Council move to receive the bids and award the contract for the Jackson
Street Improvement Project No. 413 and 2012 Water Main Project No. 404 to GM Contracting, Inc. of
Lake Crystal, MN in the amount of $496,699.01.

SUBJECT: Receive Ptans and Cail for Bids, Municipal Center Roof Replacement Project No.
418
The City of Fridley is proposing to move forward with a project providing replacement of the
Municipal Center Roof. This project will consist of the removal and replacement of the existing
ballasted and fully-adhered EPDM roofing system over the Fridley Municipal Center and Main Fire
Station, as well as replacement of prefinished metal coping system, prefinished metal gravel stops,
prefinished metal fascia, and prefinished metal scuppers at the roof perimeter. The project includes
installation of a new EPDM roofing system with a 20-year warranty. Plans and specifications,
developed in coordination with Engineering and Building Inspections staff, have been received by
the Engineering Division office.
The roof is approximately 25 years old, and has some deficiencies in its original construction that
will be addressed with this project. These include providing adequate sloping and drainage,
improving overflow protection, providing improved bases for HVAC equipment, and new access
walkways. We have been having minor spot roof repairs completed once or twice a year in recent
years to prevent water intrusion into the building. While these repairs have been largely successful,
we have had leakage into the building on a few occasions in the last three years, including one
which caused significant damage to equipment. Some deterioration of the roof is due to the roof
not draining well, and therefore, rehabilitation short of removal and replacement of the existing roof
is not cost effective.
The project is being bid with several alternates, includi�g a white EPDM option, and a
thermoplastic-polyolefin roofing system which will be evaluated for cost-effectiveness prior to
recommendation of award. A mandatory pre-bid meeting will be held onsite, where contractors can
review existing conditions and clarify the bid documents prepared by Stantec, the City's consultant
for this project. Bid opening is scheduled for June 5, and a recommendation should be provided to
the City Council at the June 11 meeting.
Staff requests that the City Council move to receive plans and specifications and call for bids
for the Municipa! Center Roof Replacement Project No. 418.
