A RESOLUTION APPROVING SPECIAL USE PERMIT SP# 12 -03 FOR SAM'S CLUB,
GENERALLY LOCATED AT 8150 UNIVERSITY AVENUE NE
WHEREAS, Section 205.15.01.0.05 of Fridley City Cade allows motor vehicle fuel and ail
dispensing services in an C -3, General Business zoning district by a special use permit if certain
conditions can be met; and
WHEREAS, on June 20, 2012, the Fridley Planning Commission held a public hearing to consider a
request by Carlson Consulting Engineers, Inc., on behalf of Sam's Club, for the property generally
located at 8150 University Avenue NE in Fridley, legally described as Lot 1, Black 1, Walton 2nd
Addition, for a Special Use Permit SP# 12 -03 to allow motor vehicle fuel dispensing services by
constructing a gas station; and
WHEREAS, on July 9, 2012, the Fridley City Council approved the stipulations represented in
Exhibit A to this resolution as the conditions approved by the City Council on Special Use Permit
SP# 12 -03; and
WHEREAS, the petitioner, was presented with Exhibit A, the stipulations for SP# 12 -03, at the July
9, 2012 City Council meeting;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that Special
Use Permit SP# 12 -03 and stipulations represented in Exhibit A are hereby adapted by City Council
of the City of Fridley.

SP# 12 -03 Special Use Permit for Motor Vehicle Fueling Dispensing Services
Sam's Club, Generally located at 8150 University Avenue NE, Fridley, MN
Stipulations
1. The petitioner shall obtain all necessary permits prior to construction.

2. The petitioner shall ensure that all lighting on the property is shielded and downcast, so as to not
extend over the property line or create glare.
3. Signs permits shall be submitted and approved prior to installation on the new canopy.
A code compliant landscape plan shall be reviewed and approved prior to issuance of a building
permit.
5. City Engineering staff to review and approve grading, drainage, and utility plan prior to issuance
of a building permit.
