MOTION by Dr. Vos, seconded by Mr. Jones, to waive the reading of the public hearing notice and open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:35 P.M. Mr. Bolin stated that the petitioners are requesting a variance to reduce the required front yard setback from 35 feet to 20.5 feet in order to correct an existing nonconformity at 6475 Able Street. The City code does require a minimum front yard setback of 35 feet. The petitioner's home is located near the intersection of Able Street and Mississippi Street. The property is zoned R-1, as are all the surrounding properties. All of the surrounding properties do contain single family homes. This lot was platted in 1947. The home was built sometime prior to 1949. At the time the home was built, the lot went all the way to Mississippi Street. The front yard at the time was Mississippi � , APPEALS COMMISSION M 'ING, SEPTEMBER 22, 1999 PAGE 2 S Street rather than Able Street. In 1971, the lot was split and Able Street became the technical front yard, for this home.. The ftont y.ard setback was only slightly over 20 feet. Mr. Bt�tin.stated the petitioner's hardship states: `The only way to comply with.the setback requirement would be to move the erttire house back 15 €eet. The house was built in 1957 with legal requirements prior to the split.° Mr. Bolin stated staff recommends approval of this variance request because this is a unique situation and prior to the 1971 lot split, Mississippi Street was considered the ftont yard of this home. He stated that granting this varianc� is intended to correct this nonconformity and not set a precedent for future new construction requests similar in scope. Requests for similar unique situations have been granted. Most recently, a front yard setback was reduced from 35 feet to 18 feet at 500 Ironton Street due to the road work that is being done on Ironton and East River Road. Staff recommends that if this vat�ance is granted�'the,following stipulation I�e attached: 1. All necessary permits shall be obtained from the City prior to the construction of an addition. Mr. Bolin stated the petitioner had come in with a proposed 26 feet by 26 feet addition to the rear of the home. The request for the buiiding permit is what triggered this variance request. Before the City issues building permits, they like to correct any non- conformities that are on the properly. The proposed addition does not need any vari�nees afld reaNy isn't par� flf this request. Mr. Bolin stated the petitioner was unable to be present at the meeting tonight, but Mr. Hundt did state that he didn't have any problems with the stipulations placed on the report. The petitioner hopes the Appeals Commission will look favorably upon his request. Mr. Kuechle asked Mr. Bolin if there was any problem with the petitioner not being present at the meeting in the granting of thi$ request. Mr. Bolin stated that it was no problem because he spoke with the petitioner previously and the petitioner has no problem with the stipulation. Mr. Jones asked if any neighbors had any response to this variance request. Mr. Bolin stated that he did not have any response from the neighbors at all regarding this project or any of the other variance requests being considered at this meeting. This request comes as a result of the petitioner inquiring for a building permit. The petitioner would like to put 13-feet by 16-feet additian onto the rear of the home. This addition meets all of the ' code requirements for setbacks and sides. The code requires a minimum side ya setback of 10 feet for living areas. The lot was platted in 1922; the home was built in 948. An addition was added to the home in 1958. This property is zoned R-1, as are t properties to the south, east and west. Staff Report Prepazed by: Pau1 Bolin � ,. 1 1 i � � Ana vsis Gregory Hundt, petitioner, is seeking a variance to reduce the required front yard setback from 35 to 20.5' in order to correct an e�cisting non-conformity at 6475 Able Street NE. Prior to 1949, the year in which Fridley became a City, the petitioners home was built 20.5' from Able Street. At the time the home was built, Mississippi Street was considered, by Code the front yazd of this home. In 1971, the lot was split and a portion of what was the front yard became a new lot for a home to be built on Mississippi Street. This lot split then shifted the Code defined front yard for this home to Able Street as it no longer had access to Mississippi. In order to correct this non-conformity, and in order to obtain a building permit to place a 26' x 26' addition onto the home, a variance to recognize tlus non-conformity is necessary. The petitioner's addition does meet all of the City Codes and is technically unrelated to this variance request. The City's policy has been to correct non-conformities when owners apply for any City permits. It would cause great hardslup to require a property owner to remove their existing home, due to a non-conformity tha.t happened nearly 30 years ago. Therefore, staff recommends approval of this variance request. Staff Recommendation City Staff recommends approval of this variance requests, with stipulationr. The City code does require a minimum front yard setback of 35 feet. The petitioner's home is located near the intersection of Able Street and Mississippi Street. The property is zoned R-1, as are all the surrounding properties. All of the surrounding properties do contain single family homes. This lot was platted in 1947. The home was built sometime prior to 1949. At the time the home was built, the lot went all the way to Mississippi Street. In 1971, the lot was split and Able Street became the technical front yard for this home. The front yard setback was only slightly over 20 feet. Mr. Bolin stated the petitioner's hardship states: 'The only way to comply with the setback requirement would be to move the entire house back 15 feet. The house was built in 1957 with legal requirements prior to the split.° Mr. Bolin stated staff recommends approval of this variance request because this is a unique situation and prior to the 1971 lot split, Mississippi Street was considered the front yard of this home. He stated that granting this varianc�e is intended to correct this nonconformity and not set a precedent for future new construction requests similar in scope. Requests for similar unique situations have been granted. Most recently, a front yard setback was reduced from 35 feet to 18 feet at 500 Ironton Street due to the road work that is being done on Ironton and East River Road. Staff recommends that if this variance is granted, the following stipulation be attached: 1. All necessary permits shall be obtained from the City prior to the construction of an addition. Mr. Bolin stated the petitioner had come in with a proposed 26 feet by 26 feet addition to the rear of the home. The request for the building permit is what triggered this variance request. Before the City issues building permits, they like to correct any non- conformities that are on the property. The proposed addition does not need any variances and really isn't part of this request. Mr. Bolin stated the petitioner was unable to be present at the meeting tonight, but Mr. Hundt did state that he didn't have any problems with the stipulations placed on the report. The petitioner hopes the Appeals Commission will look favorably upon his request. Mr. Kuechle asked Mr. Bolin if there was any problem with the petitioner not being present at the meeting in the granting of this request. Mr. Bolin stated that it was no problem because he spoke with the petitioner previously and the petitioner has no problem with the stipulation. Mr. Jones asked if any neighbors had any response to this variance request. Prior to 1949, the year in which Fridley became a City, the petitioners home was built 20.5' from Able Street. At the time the home was built, Mississippi Street was considered, by Code the front yazd of this home. In 1971, the lot was split and a portion of what was the front yard became a new lot for a home to be built on Mississippi Street. This lot split then shifted the Code defined front yard for this home to Able Street as it no longer had access to Mississippi. In order to correct this non-conformity, and in order to obtain a building permit to place a 26' x 26' addition onto the home, a variance to recognize this non-conformity is nece.ssary. The petitioner's addition does meet all of the City Codes and is technically unrelated to this variance request. The City's policy has been to correct non-conformities when owners apply for any City permits. It would cause great hardship to require a property owner to remove their existing home, due to a non-conformity that happened neatly 30 years ago.
