The Anoka County Health Department & City of Fridley deemed the property unfit for human habitation and tagged it as such. A preliminary assessment was performed by West Central Environmental Consultants on 02/20/2009 and showed elevated levels of inethamphetamine contamination on all seven surfaces tested, results included below. Leadens Building Maintenance Inc/ Minnesota Crime Scene Clean up was hired by home owner to remediate the property and remove the methamphetamine and other chemical contamination following Minnesota Clandestine lab Cleanup guidelines published 4/3/2007. The Cleanup was approved in a meeting at the City of Fridley and the remediation took place during the month of May 2009 as outlined below. A walk-through of the property and home was done by LBM Inc prior to cleanup, inspecting area where the lab was. The type of cook method, and where the precursor chemicals used where forward to LBM Inc By Chicago Crime Scene Clean Up who was in charge of removing the lab. Remediation Steps Performed: LBM went over work plan with homeowner, showing pictures to homeowner of home and garage. LBM posted all contaminated areas with emergency response phone numbers on the job site. Local Authorities were invited to come in and inspect cleaning, pack out, washing and scrubbing. Prior to entering the property a11 persons read and signed the Right to Know. The property was ventilated before, during, and after decontamination. A decision was made to utilize fu11-face respirators with GME P-100 cartridges and tyvek suits during decontamination procedures due to contamination levels. No chemical spills were evident in the home or garage. All personal contents, sofi items and hard items of the home were removed, including carpeting and padding, adulterated according to Minnesota guidelines, and disposed of in a sanitary landfill. During the pack out of personal items (soft and hard items) the contractor set aside all items that were cleaned and decontarninated that could. be saved under NIDH guidelines for homeowner. All surfaces were HEPA vacuumed to remove gross contamination and dust. All walls, ceilings, and floors not originally covered by carpeting were scrubbed twice with simple green and rinsed and allowed to dry following state guidelines for clandestine. The floors originally covered by carpeting were HEPA vacuumed a second time. After washing twice with Simple Green and dried another step was done on all surfaces of the structure, including floors, ceilings, and a11 base board heat vent, were sprayed with Meth DepHyze to neutralize chemical contamination and allowed to sit overnight. Information on how Meth DepHyze works is also included below. A Mini Rae PID was brought in to test for the presence of VOC's in the air and drains according to Minnesota guidelines. Home did not have HVAC system. The home has hot water heat with heat pump and was cleaned according to State guidelines. All plumbing drains were inspected and flushed according to Minnesota guidelines. All drains were then tested by extracting a sample of liquid in each and tested with a result of a neutral pH, then treated with Meth DepHyze and allowed to sit overnight. Wipe samples were taken and sent off to Morse Environmental in Washington State for analysis. Outside blank sample recorded a maximum of 0.02 ppm for contrast. Post testing was performed to ensure a11 contaminated areas are below MDH/MPCA. Please see attached test results below and a11 attached copies. After first cleaning all areas were well below NIDH/MPCA, with the kitchen being the highest of 0.51. The south bedroom was still above state guidelines, so another scrubbing of simple green and this room was treated with Meth DepHyze after the 3rd scrubbing. This was not required by State, yet done, so homeowner may have any work under State guidelines performed by Contractor or person of her choice in a safe environment. It was originally developed by Sandia National Labs to combat chemical and biological weapons attacks for the United States Military. The original formula was a three-part mixture that was applied as a foam. It has been redesigned for ease of application through a non-thermal fogger and as a two-part mixture. It is sprayed directly onto a11 surfaces until they are wet. In addition, it fills the air with a fog of product, which treats any airborne conta.mination and will penetrate the entire HVAC system, not just what can be reached. It leaves no residue or odor behind, and begins to biodegrade within eight hours of application. The idea behind Meth DepHyze is to neutralize chemical contamination where it sits, saving time and money on decontamination. It binds with iodine preventing it from sublimating, preventing it from off-gassing; turns hydrochloric acid into a harmless, simple salt; neutralizes anhydrous ammonia, phosgene, chlorine gas, hydrogen sulfide, and formaldehyde, rendering them harmless; and breaks methamphetamine down into harmless compounds, as determined in a recent study by the National Jewish Medical and Research Center that will be published in the near future. Further studies aze underway to determine its effectiveness on solvents. This allows the City to abate such public nuisances from private property in accordance with the provisions outlined in this chapter. A recent inspection of your property at 6520 Able Street Fridley, MN revealed the following condition(s) to which this Code Section applies. Code Section 205.07.6.C, Exterior Storage LP tanks, storage drums, inoperable bicycles, household items, pallets and all miscellaneous items in the front, sides, and rear of home. Also, make certain vehicfe parked in the rear yard is currently licensed, operable, and parked on and approved hard surface of concrete, asphalt, or approve concrete pavers under entire vehicle. Dangerous Excavation. A dangerous excavation exists at the South west comer of the garage. The entrance to the excavation is at grade and approximately 7' in diameter. The opening leads to a 15' vertical drop and subterranean tunnels. A solution must be engineered by a professional excavation contractor. A tunnel is believed to exist below the south west comer of the garage and soil conditions may make movement within the tunnel dangerous if not deadly. This is why a professional engineering/ excavating solution shall be required. Do not ente� the tunnels without reauired exr�ertise. You must respond in one of the three ways fisted below by no later than February 6, 2009 or the Citv will take action to abate the nuisance conditions outlined in this letter. l. Calibaration of the PID was done before the field technician left the office. A fresh air cahbration followed by 100 ppm isobutelyne gas calibration was conducted: The PID is used to analyze for organic compounds that may be used in the manufacture of ineth such as acetone, isopropanol, benzene, toluene, and others. A11 readings in the residence and gara.ge were 0.0 parts pe� million (ppm). WCEC also conducted pH tests throughout the home. Tests were conducted on various surfaces, including the floor, wa11s, and assorteci stored items to determine if any coFrasives used in meth manufacturing were present. Sink drains, bathroom drains, and stovetops were also tested. All pH tests were neutral (6-8). - A visual walk through of the interior of the house showed no signs of inet]� }�roduction. Due to the snow cover, inspections of the exterior were limited and are recommended to be conducted at a later date in the spring. At that rime, the visual inspection would determine if there was any distressed vegetarion resulting from the dumping of the meth- waste products. l J Recommendations On February 23, 2009, analyzed samples indicated a presence of inethamphetamines in the house and garage. The levels foutid in the house were all greater than 1 µg /ft2. Levels in the garage and house fell between 1.46 µg /ft2 and 15.32 µg/ft2. With these determined meth levels, the range of action required is full remediation of occupancy structures with disposal and modified remediation may be allowed in non-occupancy structures per MDH/MPCA Cleanup Guidance Docutnents. Garage Laboratory results from the garage revealed the presence of inethamphetamine. WCEC recommends that any conten�ts of the gara:ge that have any value (ex. tools, lawnmower, etc.) should be professionally and thoroughly cleaned. Any items. in the garage that you think has little or no value should be disposed of. Iterris in the garage that would be ca.pable of absorbing methamphetamine (carpets, couches, curtains, etc.) should also be disposed of. The floor of the garage should be pressure washed of� with a hot, soapy solution of wa.ter. Any counter surfaces in the garage should be washed off with Simple Green or TSP (tri-sodium phosphate) cleaiung solution and a hot, soapy solution of.water. Primary Residence All rooms sampled in the primary residence indica.ted the presence of ineth. The highest levels were found in the upstairs bedrooms and dowastairs bathroom. Due to contaminatinn in the house, an extensive cleaning may have to take place to bring the levels of contamination down to the cleanup standard of <1 µg /ft2. Post cleanup sampling is recommended to ensure that the meth contamination is at or below acceptable levels. . (WCEC) conducted testing and sampling for methamphetamine (meth) concentrations inside the primazy residence and detached garage at the above address. The analytical results of that testing and sampling were received by this office on February 26, 2009 from WCEC. Analyzed sarriples reported are in excess of guidelines according to Minnesota Department of Health (NIDI� Clandestine Drug Lab General Cleanup Guida.nce (2007). Therefore, the following provisions amending the original order are hereby issued to you based on that testing and sampling: 1. AMENDED NO OCCUPANCY ORDER The premises, including both structures, have been vacated as ordered on February 5, 2009. The No Occupancy Order is continued pending remediation, cleaning, final testing and inspection conducted by the City Fire Marshal and Chief Building Official. Any person violating this No Occupancy posting is subject to criminal prosecution. 2. AMENDED ORDER FOR ABATEMENT You must promptly contra.ct with a cleaning and remediation contractor authorized by the Minnesota. Department of Health to conduct and complete on-site clandestine drug lab cleanup tasks, perform remediation testing, follow up testing and further determine that the contamination established by the WCEC report is sufficiently reduced in accorda.nce with Minnesota Department of Health guidelines. As the properry owners, you shall, with your contractor, notify the City of actions you have taken and reach a.n agreement with the City concerning the cleanup schedule. You must notify this office in writing not later than March 13, 2009 that the arrangements described herein have been made. ADDITIONAL PROVISIONS DUE TO ASSESSMENT ANALYSIS REPORT A. Due to analytical results of the WCEC assessment testing performed February 10�', composite sampling.and analysis of soils within the underground excavation neaz the garage shall be performed by a qualified environmental contractor who also possesses the required certification to enter the tunnel area if necessary. Testing shall be completed prior to completing closure work on the excavation as ordered by the City of Fridley Community Development Depariment but not later than March 13, 2009. B. Due to snow and ice cover on February lOth and standing water from snow melt and rain after the law enforcement action, a thorough visual inspection of the property to identify possible dump sites of inethamphetamine waste products was extremely limited. WCEC has recommended and we agree that this inspection may be conducted at a later date in Spring, 2009. Following completion of all required work and a determination that contamination has been reduced to an acceptable level as required by Minnesota Department of Health guidelines, the Public Health Nuisance Declaration and this amended Order for Abatement will be lifted. The residence and affected accessory structures may then be reoccupied. PROPERTY OWNER(S) RESPONSIBLE FOR COSTS As in the original order, the property owner is responsible for.all costs of abatement or cleanup of the site, including contractor's fees, and public costs for services that were performed in association with the clandestine drug lab site. If, after notice, the property owner fails to arrange appropriate cleanup, the City is authorized to proceed in a prompt manner to initiate and complete the onsite cleanup.
