Public��urpose served by the requirement is to allow for adequate open rear yard areas sho�ld an� of the buildings in a doub7e frontage block face the "rear". B. STATED HARDSHIP: Petitioner states that he 1aid out his proposed garage directly in line with the garages to the south and north of his property so the setback from the house to the garage would °be the same as his neighbors. C. AQMiN�S�'RA�IVE STAFF REVIEW: In June of 1975, Portfolio ReaTty was granted 10 similar front yard variances from 35 feet to 20.5 feet. These garages have been:canstructed. This request is for a garage with an attached porc�i�, that is twiee the size of the neighboring garages and a slightly greater variance. The difference of 20.5 feet to 18.45 feet could be made up by moving the garage closer to the house. The petitioner's garage plans show a three car garage which would increase the lot coverage to 2A��. Staff has no objection to �his variance request, but would 1.ike to encourage the petitioner to move the garage back to a 20.5 foot setback to match the adjacent garages un1ess sor� hardship is involved. C. pDMINISTRATIVE 5TAFF REVIEtni: In Jurie of 1975, Portfolio Realty was granted YO similax front yard vaxiances from 35 feet ta 20.5 feet. These garages h�ve been constructed. This request is for a garage with an attached porch, that is twiee the size of the neighboring garages and a slightly greater variance. The difference of 20.5 feet to 18.l�5 feet could be made up by movi�g the garage closer to-�the house. The petitioner�s garage plans show a three car garage which would increase the lot coverage to 2lt1. Staff feels that there is not sufficient hardship shown to warrant the nariance to ].8.l�5 feet� and that th8 20.5 foot setback should be maintained. The difference of two feet could be made up be�ween the dwelling and the garage i,tsel.�. He said he had no more 9uestions on this at this time� but would like more of the neighbors to come in. NIr. Young asked about the fencing, and if it would be just a verbal commitment. Mr. Kemper said no, it would be in writing. Mrs. Gabel pointed out that they could make that a stipulation when it came before the Planning Commission. ' Mr. Kemper informed the interested parties that they should be sure to get as many of the neighbors as were interested in this to come to the Planning Commission meeting� and he said he would also encourage them to look at the a:tternatives because obviously the o�mers were going to develop this. . He explained that this proposal.would be attractive to the neighborhood and increase the property values� or it could be deve2oped into something which would be more appropriate to the existing zoning such as a warehouse. Mr. Kemper added that he would also suggest they take the time to visit some townhouses. The neighbors asked where they were, and Mr. Hoffineyer and Mr. Swanson gave them directions. Nlr. Barna added that another point to consider would be that there would be more people paying taxes to the City of Fridley. Ghairperson Gabel asked what it would cost the people for the Townhouse Association, and Nlr. Hoffineyer said it would be $28 a month. Mrs. Gabel asked if there was a specific organization these people went to� and Mr. Swanson sai.d they had directors and so forth� �nd had meetings once a month. He explained that a.11 the res3dents were welcome to attend the meetings and object to anything they didn�t like. For instance, he said, if there was inadequate snow removal or the grounds weren't kept up� they could voice their opinions. He said that motorcycles and snowmobiles weren't allowed to drive around on the grounds, and garbage cans couldn't be left outside (they must be in the garage). He explained that this would be a lot neater� than with regular residents. NLrs. Gabel asked if they would become a member of an already established organization, and Mr. Barna said this would be �n individual association. Mrs. Gabel asked if they would have guidelines� and Mr. Hoffineyer replied they would have the bylaws. PRrs. Gabel asked how they were going to form this to get financing, axld Mr. Hoffineyer replied that the people in there didn't determine.this association; it was determined before the project was built. Mrs. Gabe3. asked if the first building was constructed �and the residents paid �he $28 and the snow was very heavy for a month� would tha�t be enough to take care of all of the snow? 1�Ir. Mr. Holden explained that this was a double frontage lot, and all the adjacent properties had also gotten vaxiances. • . • Chairperson Gabel asked if there was some reason he could.not line up his structure with the others, since there was a difference of two feet (the other garages had 20.5' setbacks, and NIr. Mayer was requesting a setback to 18.�5�). He replied he preferred it this way. Mr. Holden explained that when this was measured, Mr. Mayer had measured how close it was to the�house and the code mea.sured from the street. He asked Mr. Mayer if it would be possible for him to move it back two feet, and Mr..Mayer replied he supposed he could. He added that it burned him up that the other garages went up last year and he had never been not3.fied. Chairperson Gabel saa.d he shou].d hae� rece3ved a notice. Mr. Kemper noted that on the survey there was 20' between the garage and. the house� so�if the garage was moved t�ro feet closer to the house there would be 18� between the t�ro strnctures. Mr. Kemper said there were several alternatives: � 1) accept the proposed plan� 2) move the garage back two feet so the street edges lined up, or 3) make the garage the same size as the neighbor's. Mayer objected to the third alternative as he said that wo�.ld be too narrow., Mrs. Gabel said they were talking about the line of sight� and were just asking if it would matter to Mr. Mayer if it was moved back two feet. Mr. Mayer replied he could.do that. Mr. Kemper asked if there were going to be two parking stalls, and Mr. Mayer replied that was correct. He said he was going to put in a 9� door and a 161 door. Mr. Kemper asked Mr. Mayer to show him where the partition would be� and Mr. Mayer drew it in for him. Mr. Kemper noted that there was room for three cars� and asked what tYre piirpose was of ihe 10' x 2l�� area. Mr. Mayer replied he wanted to put an ertended roof over that for a covered patio. He added it could be used for paxking, storing a boat, or whatever. He explained that part would have a roof� but not be�enclosed. Mr. Barna stated that the City had contacted the owner of the business and he had sai.d he tYiought joint parking would create more problems than it was worth, and then the Council approved the request. Mr.'He•lden said the owner had informed him that as far as parking went, there was a pecking order� etc., and the owner had gotten in �ontact with Mr. Burkholder and told him a joint agreement would not be in order.
