Requires variance to area requirement. Lot is low (2-3 feet below street grade) and has several feet of peat on top of bearing soil. Established area of smaller home.s is not conducive to expensive home on one lot. Property owners within required distance notified of lot split but did not attend Planning Commission meeting." C. ADMINI5TRATIVE STAFF REVIEW: The lot split request approval was recommended to the City Council by the Flanning Commission on September 26, 1979 that would establish these building sites. This land is on the corner of 76th Avenue and Able Street and both building sites would face onto Able Street. The lots would be 94.20 and 93.88 feet deep with 80 foot frontages and the proposed buildings would meet all of the Code requirements for setbacks. Ms. Schnabel asked Mr. Clark for comments. Mr. Claxk said his main concern was that all lots in Shaffer's AddiCion were the same size prior to this lot being split. But since there were no objections from neighbors, about 2 houses on 1 lot,periiaps that was not a real concern. Ms. Gabel said she understood the nei�hbors had objected to the previous pxoposal of a double bungalow. Mr. Clark stated that was trexe. Ms. Schnabel said she understood Fublic notices were sent out to the neighboxs for the lot split that has already been h�ard before the Planning Commission. Notices axe no� normally sant �ut for lot splits. �x. Clark said the reason was because the lots would be amallar then the rest af the neighborliood. Ms. Schnabel pointed out the neigh�ors were properly notified for both the Plauning Commission and Appeals Com�►ission m�atings and there were no objections. Mxe Plemel asked if these were factaxq built homes. Mr. Ted Holsten, 3213 Townview Ave. N.E., Mpls., said no. He pointed out Che lot wi3ths are 80 feet, but they would not be as deep as usual. Ms. Schnabel asked if the homes would be built at the same time. Mro Hols�en r�p?ied tlze builder, Allan Homes, have one possibly sold at the present time. T.hat one would probably b� built first and then the second one would be buil�. Ms. Schnahel asked what the homes would look like. Mx. Holsten presented a glan of. the homes. They are 23 feet_� 42 �eet, 3 bedrooms, with a detached double �arage. The price, with the garage, should be around $55,000. He pointed out �lie area homes are older, the same size or smaller and there a�e double bungalows across the street. A single home on the one lot w ould be too expen - sive for the area. Ms, Sahnabel asked if the soil would be a problen�. Mr. Holsten said he had no� had soil tests taken, but from what he observed bp digging down 2 to 3 feefi, there should be good fix'xn soil. Some of the tress on the lot will have to be removed to get down to that soil. Chairwoman SchnabeZ asked far further discussian from the co�nission. • Mx. Kemper said this coimnunity needs moxe inexpensive fi ousing and these should help. He. said the petitioner was correct, there was a Catch-22 system here. They thought perhaps staff coul$ draw u ome sort of format for the petitioner to follow. Ms. 6abe1 said she thought when th petitioner fills out the application, staff did not have enough, time to properly view the application at that time. Mr. Clark asked if th The Coumnission said no. staff to put words in the applicant's mouth. Ms. Gabel said some hardships do make sense. For example, "Want to build a 10 x 20 foot addition." What type of ha ip was that. Mr. Clark stated a haxdship would be diffe t for each request. The applicant can afford to build the 10 x 20 foot addition, but ot a new home. M�ney would be the hardship and economic feasibility was not suppose to be cons�dered as � lt�rdshi�. Ms. Schnabel said they have received a memo recently sta ' g that economic feasibility conld be considered. Mx. Kemper asked if the s�aff reads the application imcnediately see if it make sense. Mr. Clark replied not usually. Mr. Kemper said that seems to be the real question then.
