SUMMARY OF ISSUES: Section 205.08.03.D.(4).(b) of the Fridley Zoning Code requires that the setback for garages and accessory buildings in the year be the same as for the front yard (3 5 feet). Public pwpose served by this requirement is to provide rear yazd space to be used for geen areas which enhance the neighborhood. The petitioner submitted three site surveys showing typical locations for each of the garages. For the property located 7595 Able Street, the setback requested is 7 feet. At this location, the entrance to the garage will be perpendicular to the street. A 12 foot setback with minimal impact to either the garage or the dwelling could be provided. Baker Street is curved in this location, reducing the depth of the property. For the remaining properties, a 15 foot setback is proposed. There is more than adequate space on the subject properties to increase the requested setbacks to 20 feet in order to provide adequate off-street pa�icing on the proposed drive for vehicles. A similar variance request was granted in 1975 to 20.5 feex for the remaining properties on the strcet. SITE DESCRIPTION/HISTORY The subjed properties are located on Able Street from 76th Avenue south to approximately mid-block. Located on each of the subject properties is a duplex constructed in 1963 which is 22 feet by 66 feet. The properties are mostly flat with typical grass and tree vegetation. • Staff Report VAR #96-16, Able Street Garage Variances Page 4 ANALYSIS • Section 205.08.03.D.(4).(b) of the Fridley Zoning Code requires that the setback for garages and accessory buildings in the year be the same as for the front yard (3 5 feet). Public purpose served by this requirement is to provide rear yard space to be used for green areas which enhance the neighborhood. Staff reviewed each of the requests base�l on property surveys submitted by the petitioner and an aerial photograph. Deter�ninations have been made rega�-ding the location of each of the proposed garages. In each case, it appears that the setback could be increased to further reduce the variance requested by the petitioner. 7595 Able Street The garage is to be located in the northeast corner of the properry at a setback of 7 feet. T'he 7 foot setback would be for the side of the wall of the garage with the proposed entrance and drive to be located facing south. The pe�itioner could reduce the proposed setback between the structures to 5 feet; thereby, increasing the setback to 12 feet from the rear property line. The petitioner also has an alternative to attach the proposed garage directly to the dwelling; however, this would eliminate naxural light from entering the living space from the north. If attached, the garage would not require a variance because the setback would be 40 feet. Baker Strcet in this location c�u�ves toward the subject parcel, reducing its overall depth. 7579 Able Street and Remaining Properties The petitioner proposes to locate the garage in the southeast corner of the properties. The gazages could be relocated to reduce the setback between the structures from 11 feet to 5 feet. This would increase the setback from 15 feet to 21 or 25 feet. The petitioner could also locaie the garages closer to the south property lines which would provide a distarice between the sauctures. There is not room on the properties to attach the garages to the dwellings without requiring a variance. In 1975, the City granted a variance to reduce the rear yard setback from 35 feet to 20.5 feet to allow the const�uction of detached two-car garages on Lots 11-22 of the same block The.se garages are located on the southern portion of Able Street. It may be appropriate for the AppeaLs Commission to grant a similar variance to the p�titioner in order to provide a uniform streetscape along Baker Street. Ms. McPherson stated this is a multi-property request for properties on Able Street. Loeated on each of the properties is a duplex which measures 22 feet x 66 feet which were constructed in 1963. The petitioner has submitted three property surveys. These are double fronted lots with Able Street to the west and Baker Street to the east. Baker Street at the north end has a slight curve to the west which shortens the depth of the lots to the north end. Staff has broken the varia�ce request into two parts. The first is for the property at 7595 /�ble Street for which the petitioner ha� requested a varian�e to 7 feet from 35 feet. Staff recommends this b� increased to 12 feet. This will result in 5 feet between the dwelling and the garage and provide adequate space for parking. Ms. McPherson stated the second part of the request is for the remaining properEies. The variance request by the petitioner is to 15 feet from 35 feet and the garage doors would face Baker Street. In 1975, the City did c�rant a similar variance to the properties along the south portion of the street. For that request, the petitioner had requested a variance to 18 feet but the City granted the variance to 20.5 feet. The comment from that petitioner was that 20 feet was a better setback. For the remaining properties, staff recommends a variance to 20 feet for more consistent site lines and for adequate off street parking. Ms. Beaulieu stated staff is recommending that the one property go from 7 feet to 12 feet and the other properties go from 15 feet to 20 feet. Is there room to do that? Ms. McPherson stated yes, especially as you go further south. The lots there increase in width substantially. There is room to move the garages an additional 5 feet. Mr. Kuechle asked for the distance between the property line and the curb. Ms. McPherson stated that distance is 9 feet. There is a garage on one site but she did not know if that p�operty belonged to the petitioner. That garage appears to be at the 20-foot setback. Mr. Chies stated he is looking to extend a line and maintain the same motif. He is trying to upgrade the area. He has no objection to the change. His only concern is that the lot to the north has room for the tenants to park. Dr. Vos stated this would also provide for additional. off-street parking. . Mr. Chies stated each lot has two parking spots there now. He will do whatever the City thinks will look best. MOTION by Dr. Vos, seconded by Ms. Beaulieu, to close the public hearing. Ms. Beaulieu stated she would recommend approval as recommend by staff to 12 feet and 20 feet. She drove down the street and it is noticeable that some havs garages and others do not. She thought it would be a help. Dr: Vos stated the hardship is the double fronted lots. It is difficult to put anything at 35 feet. This is also an improvement. He would vote for approval with 12 feet and 20 feet.
