Notice is hereby given that the Appeals Commission of the City of Fridley will conduct a Public
Hearing at the Fridley Municipal Center at 6431 University Avenue N.E. on Wednesday, May 8,
1996, at 7:30 p.m. for the purpose of:
Consideration of variance request, VAR #96-07, by Monte Gunia:
Per Section 205.04.05.6 of the Fridley Zoning Code, to allow construction of a 25
foot by 40 foot garage in the front yard on that part of Lots 18 and 19, Auditor's .
Subdivision No. 77, commencing at the northwest corner of Lot 17, Auditor's
Subdivision No. 77, then north 11 degrees 50 minutes east a distance of 99.2 feet to
the south line of Oak Creek Addition, then north 84 degrees 50 minutes west along the
south line of Oak Creek Addition, at a distance of 216.9 feet, then south 11 degrees 50
minutes west 104.8 feet to a point on a line drawn north 85 degrees 37 minutes west
from the point of beginning, then south 85 degrees 37 minutes east 216.6 feet to the
point of beginning, now known as part of Lot 35, Auditor's Subdivision No. 77 Revised,
together with an easement over the following described tract that part of Government
Lot 3 and the northeast 1/4 of the southeast 1/4 of Section 10, Township 30, Range 24,
described as follows from the point of intersection of the center line of the East River
Road and the east and west 1/4 section lines of said Section 10, then considering the
east and west 1/4 section lines to be due east and west, then south 3 degrees 50
minutes west a distance of 486.6 feet, then south 8 degrees 46 minutes west a distance
of 186.8 feet, then north 78 degrees 10 minutes west a distance of 663.1 feet, then
south 11 degrees 50 minutes west a distance of 213.8 feet to the point of beginning of
the tract of land hereby to be described to be used for road easement purposes only,
then north 79 degrees 13 minutes west a distance of 18 feet, then south 10 degrees 47
minutes west a distance of 18 feet, then south 79 degrees 13 minutes east to a point in
the center line of the East River Road, said point being 480.1 feet northeasterly as
measured along the center line of said road from its intersection with the south line of

along the center line of said road a distance of 18.4 feet more or less, to a point 18 feet
measured at right angles from the extension of the last named course, then north 79

DESCRIPTION OF REQUEST:
The p�titioner requests that a variance be granted to allow construction of an accessory stcucture in the
frorn yard. If approved, the pekition�- would construct a 25 foot by 40 foot detached gazage in the front
yard. The petitioner is proposing to convert the existing single family attached garage to living space once
the proposed garage is constructed.
HARDSHII' STATEMENT:
"Because of the irregular driveway entrance from Alden Circle Street, the position of the garage would
allow sd aight access to the garage. This would be a very practical and appealing placemern for a garage
on this lot. I would like to leave the back yard available for future house expansion or a pool and patio
expansion."
SUMMARY OF ISSUES:
Section 204.04.OS.B requires that accessory structures shall be permitted in the rear yard and side yard
only.
Public purpose seivve�l by this requiranent is to provide desired frorrt yard space to be used for green areas
and to add to the attractability of a residential district.
The subject parcel is located at the cornea- of Alden Circle as it turns to the east and ends in a cul-de-sac.
The petitioner has the alternative to attach the proposed garage directly to the dwelling creating an Lr
shaped stiucture and eliminating the need for a variance. The City has not granted a variance to allow
an accessory stiuchu-e in the front yazd.
RECOMII�NDED ACTIONS:
As the City has not grarrted a variance to allow an accessory st�ucture in the front yard, staff recommends
that the Appeals Commission recommend denial of the request to the City Council.

Site Descri�tion/H'istorv
The subject parcel is loca.ted at the northwest corner of Alden Circle as it travels north from 71 1/2 Way and tums
ea.st to end in a cul-de-sac. The subject parcel is 100 fe�t wide by 216 fee�t long. The parcel is laid out in an
east/west direction with the dwelling located approximately in the middle of the lot with the front of the dwelling
facing east. Only the southeast corner of the subject parcel touches the public right-of-way of Alden Circle.
Located on the pazcel is a single family dwelling with an attached single car garage. The dwelling was consttucted
on or before 1957.
Analysis
Section 204.04.OS.B requires that accessory structures shall be pernutted in the rear yard and side yard only.
Public piupose se�ved by this requir� is to provide desired front yazd space to be used for geen areas and to add
to the attractability of a residential district.
It is staff s interpreta.tion that the shorter of the two dimensions of the lot is the frant yard; therefore, the easterly
portion of the parcel in front of the dwelling is the front yard. The petitioner is proposing to constiuct a 25 foot by
40 foot detached garage 10 feet from the east property line. In reviewing the request, staff has deteimined that a
bettex alte�native that would not require a variance would be to attach the proposed garage directly to the dwelling.
The pe�titione�- could e;xxpand the �ting att&ched garage to the dime,nsion of the proposed garage. This option would
also be consistern with the house and garage to the south. The petitioner, however, has indicated a desire to convert
the e}usting single car attached garage to living space. The rear of the gazage addition could be attached to the
dwelling in such a manner to allow construction of a family room.
The City has not ganted a variance to allow an accessory struc�ure in the front yard. Although the proposed location
is not within the site line of the house to the east, anott�ea- leg�timate alternative exists to avoid the ne�d for a variance.
