The property is zoned R-1, Single Family Dwelling. REOUEBT• To allow a deck to encroach into the required rear yard setback an additional 2 feet (12 feet instead of 10 feet). ANALYSIS• Section 205.06.A.(3) allows decks to encroach into the required rear yard a maximum of 10 feet. Public purpose served by this requirement is to insure aesthetically pleasing green areas around structures to maintain open space between structures. The petitioner applied for and received a building permit to reconstruct a deck on October 25, 1994 after construction had started. Upon inspection, it was discovered that a portion of the deck encroached into the rear yard setback further than is permitted by code. The new deck has been reconstructed with wider stairs. The lot has an unusual configuration and is only 84 feet deep. Typical lots are 100 feet or more in depth. The lot to the north is occupied by a dwelling. The setback between the deck and that dwelling is approximately 140 feet. An increase in the encroachment would not adversely impact the adjacent dwelling. The requested variance is minimal. Granting the variance does not adversely impact surrounding parcels. The petitioner applied for and received a building pernait in Octtober to reconstruct an original deck after construction had started, Once the inspectors had been out to view the construction, it was noted that a portion of the deck encroached into the rear yard further than what was permitted by code. The ].ot has an unusual confiquration in that it is only 84 feet deep. The typical lots are an average depth of 100 feet or more. There is approximately 140 feet between the deck and the dweiling to the north. An increase in the . encroachment would not adversely impact surrounding structures. The requested variance is minimal and granting the variance would not adversely impact surrounding parcels. The City has not previously received a variance request of this nature. The request is directly related to the depth of the iot and where the existing dwelling is placed. Based on those factors, staff recommends approval of the request as requested. Ms. Savage stated staff normally does not make a recommendation and asked why staff is making a recommendation on this request. Ms. McPherson stated this is an unusual request and there is truly a hardship based on the lot depth. It is a function of the lot depth that the request is being made. Ms. Smith asked, if they approve the request and the petitioner decides to enclose the deck to make a three-season porch, what would happen. Ms. McPherson stated that would require a different type of variance and the petitioner would be back before the Commission. Dr. Vos asked if the deck was raised. Ms. McPherson stated it was off the ground. Mr. Kuechle asked, if we approve the request and in 20 years the deck needs to be rebuilt, will the petitioner need a new request or will the variance cover a rebuild. Ms. McPherson stated the variance would cover a rebuilt deck unless the Commission stipulated the petitioner would need to come back. Normally, a variance continues with the life of the property. If an encroachment is greater than two feet, the petitioner would have to come back. Ms. Snider stated the deck is at a double level. The original deck did not have stairs and she wanted an exit from the original part. That is why the builder put the steps down. The stegs could not be put on the side. Mr. Kuechle stated the deck was already there and the stairs were added which is what caused the probiem. Ms. Snider stated yes.
