STATID iiiDSHIP: °We need mre roan anc1 we need to use socrie of our equity for tax deductia►. We need to add on or mrve to another house ." C. ADr'iIlTISTRATIVE STAFF REVIEW: This lot is very.shallow, less than 100 feet, where narcnal lots are usually at least 120 feet. There is no other directioa that the petitioner can add onto his exi.sting hcme. If the Camussion approv+es this request, staff has no stipulations to suggest. Mr. Clark shawed the Camissioners an aeri]. photo sharing the praperty. He stated the addition would be 20 feet wide and 14 fee deep ich would result in.about a 17 ft. offset fran the rear lot line. He stated there was no roam on either side of the house for an additian, and it was unusual to dd antA the frarit of t1 hause, so the bacac yard was the anly place an addition wuld bplaced; and to do that, a variance was necessary. - Ms. Savage stated there was a ceck on the back of the house naw. ITould the ac]dition replace the deck? ' Mr. Walker stated, yes, it would. They would n4 lger have a deck. He statied the addition would have a full basement. Ms. Savage stated she would like ttye petitioner to better state his hardship. Mr. Walker stated he built the hause 15 years ago. They are vexy happy with the house and with the neighborhood and do not want to mve. The hause is pai.d for. He `,aould like to add onto the house for two reasons: (1) They need a payment and use sare of the interest for a tax 3eduction; 2) TY d like to have a family roan on the first floor. Mr. Barna stated the first reason oould not be onsidered as a hardship. Ms. Savage asked Mr. Walker why he felt he needed extra space- Mr. Walker stated he had two children, aged 17 and 14, and they do not have a family roan an the first floor. Theix living room is not very large, and it gets a little crvwded. They would like a family raom for a more informal, high usage, kind of area. Ms. Savage stated she had loaked at the property, and it seered to her to 1 a little crowded in the back yard• TYe proPertY in back of Mr. Walker was n4t separated by ariy fencing or screening. The petitiorer's hause was fairly large for the lot size, and it just did not look like there was much spaoe i.n back - Mr. Walker stated the depth of the addition would be approxi.mately ttye stne as tlze exi.sting deck, so he would hav+e the same airount of yard space. He did rxt have much yard space, but he liked it that way. . • • APPF.ALS OONA'iISSION N.'TING, APRII, 12, 1988 PAGE 3 Ms . Savage asked y tbe d,eck did not require a vari.anoe . Mr. Clark stated the Code allcws a ceck to protrude 10 feet intA the regui.red rear yard so an uncavered deck in this laation would not requix'e a varianoe. Mr. Wa]ker stated he had spken to all his neic3hbors imnadi.ately ajacent to his prcerty, and they did rot have any proble with the addition. Mr. Clark stated the corner of the prqosed addition at the lo►cest point frcxn the rear lot line rould be about 21 feet. At no point wauld the aaditic meet the 25 ft. rear yard setback ruirnent. Dr. Vos stated he felt tte hardship was mre the shape of tle lot arul the poition of the house an the lot. The shape of the lot forces the hardshi.p. Ms. Savage asked if the petitioner vould use any existing basesnent spaoe for a fami.ly roan. . Mr. Walker stated their existing basenent is oanpletely finished; harever, it is being in a basement. With their addition, they are planning skylights and making it a bright, sunny roon. MOTION by Dr. Vos, secoded by Ms. Savage, to close the public hearing. UPON A VOICE VOTE, ALL Vt7rIlJG AYE, CHAIRPERS] BARNA DDC:IAl THE PUBLIC ARING CIASID AT 8:50 P.M. Dr. Vos stated he did not think the Conmi.ssiori could wnsic3er the hardship as stated by the petitioner, but he felt the harc3ship was the shallaaness of ti lot and the locatian of the hause on the lot. There was not muc else that aould be done with less than 100 ft. lot depth with a front yard setback of 35 ft. The house was built with no varianoes, so he wauld be in fawr of the varianoe as x+eqwested - Ms. Savage stated she disagreed. T'te hardship as it was clefined was not valid at all. In looacing at the property, she thought it wauld be very crowd to adid on to the house. She did not think it wld be in the spirit of tbe Code, which is to provide green areas which enhance the neighborhood. had a lot of smpathy for the situatic, but the petitianer did build the ha on the lot at it's present size. ere just clid not seen to be evidenve of a sufficient hardship, so she would hav to vote against t2ye varianoe request. Mr. Sherek stated he agreed with Ms. Savage. Tt lot oertainly was shallow, whi.ch did oomplicate any kind of additions, but this was a oonditiori ttye pe'titiaer was aQaare of when he built the house. iie did not think a true hardship had been dezronstxated. Mr. Kuchle stated the lot was approximately 9,000 sq. ft., which was the miniman lot size by Code.
