Avenue Northeast at 7: 30 p. m on Tuesday, April 12, 1988, for the purpose of :
Consideration of a variance request, VAR #88-02, by James
Walker, pursuant to Chapter 205.07.03, D, ( 3) , a, of the
Fridley City Coc7e to reduce the rear yard setback f rom 26
feet to 17 feet to allaw the addition of a fanily room on Lot

Mr. Clark shawed the Ca�missioners an aeri�]. photo sharing the praperty. He stated
the addition would be 20 feet wide and 14 fee� deep �ich would result in.about a
17 ft. offset fran the rear lot line. He stated there was no roam on either side
of the house for an additian, and it was unusual to ��dd antA the frarit of t1� hause,
so the bacac yard was the anly place an addition wuld b��placed; and to do that, �
a variance was necessary. -
Ms. Savage stated there was a c�eck on the back of the house naw. �I�Tould the ac]dition
replace the deck? '
Mr. Walker stated, yes, it would. They would n4 l�ger hav�e a deck. H�e statied
the addition would have a full basement.
Ms. Savage stated she would like ttye petitioner to better state his hardship.
Mr. Walker stated he built the hause 15 years ago. They are vexy happy with the
house and with the neighborhood and do not want to m�ve. The hau�se is pai.d for.
He `,aould like to add onto the house for two reasons: (1) They need a payment and
use sare of the interest for a tax 3eduction; �2) T�Y ��d like to have a family
roan on the first floor.
Mr. Barna stated the first reason oould not be o�nsidered as a hardship.
Ms. Savage asked Mr. Walker why he felt he needed extra spac�e-
Mr. Walker stat�ed he had tw�o children, aged 17 and 14, and they do not have a
family roan an the first floor. Theix living room is not very large, and it gets
a little crvwded. They would like a family raom for a more informal, high usage,
kind of area.
Ms. Savage stated she had loaked at the property, and it seered to her to 1� a
little crowded in the back yard• TY�e proPertY in back of Mr. Walker was n4t
separated by ariy fencing or screening. The petitior�er's hause was fairly large
for the lot size, and it just did not look like there was much spaoe i.n back -
Mr. Walker stated the depth of the addition would be approxi.mately ttye s�tne as
tlze exi.sting deck, so he would hav+e the same airount of yard space. He did rx�t
have much yard space, but he liked it that way.

yard so an uncavered deck in this laation would not requix'e a varianoe.
Mr. Wa]ker stated he had sp�ken to all his neic3hbors imnadi.ately a�jacent to his
prc�erty, and they did r�ot have any proble� with the addition.

Ms. Savage stated she disagreed. T't�e hardship as it was clefined was not valid
at all. In looacing at the property, she thought it wauld be very crow�d to adid
on to the house. She did not think it w�ld be in the spirit of tbe Code, which
is to provide green areas which enhan�ce the neighborhood. � had a lot of s�mpathy
for the situatic�, but the petitianer did build the ha� on the lot at it's present
size. �ere just clid not see�n to be evidenve of a sufficient hardship, so she
would hav� to vot�e against t2ye varianoe request.
Mr. Sherek stated he agreed with Ms. Savage. Tt� lot oertainly was shallow, whi.ch
did oomplicate any kind of additions, but this was a oonditiori ttye pe'titia�er was
aQaare of when he built the house. iie did not think a true hardship had been

Mr. Ku�chle stated the lot was approximately 9,000 sq. ft., which was the minim�an
lot size by Code. Even with the ac�dition, the area oovered by the entire stnxcture
would still be w�ell within the limits set by C.od�e, so he would be in fawr of

Mr. Barna stated they have discussed lifestyles in the past, and what is a real
hardship? In Mi.nnesota, having a family room in the basen+ent was a h�rdship. People
like to get as muc�i sunlight as possible. Zg�e living area of the house was
840 sq. ft., not aounting the ba.se�ient, so it was not a large home. Howev�er, he
felt the hardship as stated did not meet the ryecessary criteria. Although tivere
was a hardship present, it was not sufficient enough to justify a variance.
