Dear Ms. Dacy,
Thank you for your help in this matter. I live at 7514 A1den Way in Fridley. My house is
located on the Mississippi River. i would like to build a water garden in my back yard.
It would be within 40 feet (about l 5 ft) of the b�uffline. Do 1 need a permit to build this
water garden?
The water gazden will have a sma11 fountain or waterfall in it and will be about 80 sq. ft.
(about 10 ft. in diameter�. There wilt be no structures taller than about 4 feet and the
water depth will be no more than two feet. The "pond" wil� have the usual water �arden
plants in it. Current plans include a small bog �arden (about 20 sq. ft.) on the house side
of the "pond", I wauld like to draw water fram the river for the garden. During dry
periods I would like to use water from the gazden to irrigate my vegetable and flawer
gardens as well as my iawn.
I wauld like to be�in construction of the water garden next summer, so there is no rush on
this. Please let me know what I need to do so that I can start constFUCtion next April.

Thank you for your help in this matter. I live at 7514 Alden Way in Fridley. My house is
located on the Mississippi River. I would like to build a stairway from the blut�line doum
to about 20 feet from the high water mark. Do i need a permit to build this stairway?
The bluffline is about 40 feet above the high water mark. The slope is about 40%. I
would like to build this stairway so that when I need ar want to go down to the river ed�e,
I am not causing damage to the slope that will contribute to erosion of the slope.
According to Fridley City Regulations 205.26,08.D.2 "No land with slopes, before
alteration, in excess of ei�hteen percent (18%) will be developed for use except for
necessarv erosion control structures which are in conformat�ce with a11 other guidelines
and standards." I believe a stairway, built above the slope of the bluff, is such a structure
and will cause no damage that would result in erosion to the bluff. It is my intent to build
this stairway without removing any trees and minimizing any visual effect when viewed
from the river.
I arn an avid canoeist and often canoe the Mississippi River from Elk River to our house.
This stairway will add enjoyrnent to my canoeing trips. I would like to b�gin
construction this fall so a timely reply would be appreciated. Thank you.

Thank you for your recent phone conversation about a potential stairway at 7514 Alden
Way in Fridley. I also neglected to ask you one other question that the property owner
had about a water garden in his back yard. Please review his letter of August 18, 1998,
and please advise me as to the DNR requirements for the water garden, and his
request to draw water from the river for his garden.
I have also included his second letter regarding the nature of the stairway construction
on his property. Would the DNR require any special permit regarding the stairway or
the water garden?

Thank you for your letters dated August 18, 1998.
A water garden may be constructed in your backyard and would not be considered a structure,
as long as it is less than two feet deep, contains less than 3,250 gallons of water, and does not
occupy more than 250 square feet of surFace area. A permit is not required to construct the
water garden.
A permit is; however, required to construct a stairway to the Mississippi River. In the past, the
City has not required a permit for stainnrays along the river and have advised owners to contact
the Minnesota Department of Natural Resources for appropriate construction techniques.
However; the building official and I both agree that filing a permit would be app�opriate to insure
proper techniques are used to stabilize the stairway. Tom Hovey from DNR Staff suggested the
"post and stringer" method of construction for the stairway in a zig-zag fashion down the slope.
Mr. Hovey also advised use of water from the river. Mr. Hovey advised that a riparian owner
may use up to 10,000 gallons per day of water from the river, as long as it does not exceed 1
million gallons per year.

Stalrways, stalrway landings and seasonal docks are facilkies that residential and recreational riverfront
landoumers often need to safely and comfortably galn pedestrian access to rivers, Natura! resource managers
have the responsiblUty of protecting our land, water, fish and wtldUfe resources for the use and enjoyment of
present and future generations. Shoreland owners also shaze this responslbWty, wh►le exercising their prtvate
property rights by building stairways and docks ln the river corridor.
The following lnformaHon provides a set of dlmensional and construction design guidellnes that will joindy
achleve our shared river stewardshlp responsIbllitles as well as satisfy the shore oumer's right to water access.
These guldellnes are based on the cumulative experiences of state and local natural resource managers, local
community officlals and many shoreland property owners. They also reflect an effort to cooperaflvely manage
our vast natural resource heritage for the public's bene8t.

Any pro)ect that wlll alter the soils, slopes or vegetation of your property may requlre a local permit from
your community zoning staff; please call them prior to planning or Wtlat3ng any projects near the river.
Any projects that will alter the river bank or change the course, current or cross-section of the river and !ts
bed may require a permlt from the DNA-Dlvtsion of Waters. The appropriate regtonal hydrologist offices are
shown on the back of this brochure. A Ost of common rlver project activities that do not require permits if canted
out according to the listed conditions follows the stairway, landing and dock guidelines in this brochure.

the least steep. Thts can often be accompltshed by staggering the locatton of two or more short staircases doum
