BUILDING PERMIT FE� SCHEDULE
SECTION 2. The Inspector of Builditigs shall, before isauing permits for the
erectio� of any building or structure, or for any addition to any existing
building or structure, or for any alteration or repairs to any exis�ixag
building or structure, upoa application therefore, require tfl�e pa��aat b� the
applicant for such permit of fees to the aunouat herein bel� �e� fo��h �a� in�
the manner herein provided to-wit:
'UIVIFORM BUILDING CODE: 1j►pe 1, 2& 4-$2.15 for each oae tlaous�xxd cubic
�eet, or fraction thereof, in such cubical contents. Type 3& 5-$1.�5 €or
e�ch one thousaaxd cubic'�£eet.
ADDITIONAL INFORMATION
For the purpose of computing fees for building permits, the cubical contents
of any building or addition, is determined by �ltiplying t�e ground area
covered from a point six (6) inches below the floo� line of the basement
o� ttae cellar to the averagg hei�hts of the upper suxface or to the average
h�ight of the roof �uxface of the main gable of a pitched roof.
For repaira or alterations to an exicting stzucture, the fee shall be �.t the
rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in
the cost of all proposed work.
Ia no case shall the fee charged for any permit as set forth in Section 2 be
less than $5.00.
VBRIFICATION OF FOUNDAI'ION
NOTE: Permits for construction will be issued a minimum of 24 hours from the
time of application, to allow for proper review of the proposed structure and
of the construction site.
A Certified Survey of the lot, showing the location of the foundatioa, once it
hae been constructed, will be required before proceeding with the framing.
CERTIFICATE OF OCCUPANCY
Application for a Certificate of Occupancy ahall be made ten (10) days prior
to the use or occupancy of �y structure for which a building permit has been
issued; and said structure shall not be used or oc�upied until a Certificate
of Occupancy has been issued.

Mr. Kohlan said the articles about the project had been sent to the Ford Fund
and they were keen on the idea and had submitted the request for funds to
Detroit to get a commitraent. He said the 7tt� District of the V.F.W, are reco�
m�nding a contribution of $5,000 and there are uthers wt�o may take out a loan
fOr contributions on a temporary basis.
Mr. Kohlan said the Foundation may want to approach the Council on an emer-
gency basis for additional funding to meet the purchase cocnnitment for the addi-
tional propexties for the Foundation. He added, if this would be necessary he
would like to make the Council aware of the possibility at the present time.
He said the problem is the short time span allowed to meet the commitment.
The City Manager said a resolution could be brougt�t to the Council the next
Monday evening, May 14, 1973, to dissolve the Islands of Peace Commiztee. He
said if there are any additional funds obtained, they could be given to the City
Treasurer and transfered at that meeting. He said the payment could still be
msde on May 15, 1973.
Mayor L�ebl agreed saying with the date being May 15th, the Council could still
consider the matter on May 14, 1973, and meet the deadline.
MIt, DENNIS DITTMER. 7595 ALDEN WAY:
Mr. Dittmer said he was addressing the Council requesting their codsideration
for placing a street light in front of his home. He said this is a long block
aad there were no lights except at the corners.
ri,ayor Liebl said the lighting program must remain fair and the City only provided
lOp street lights per year and they are placed in the most critical area.
Mayor Liebl continued, if the proper input is made, this may be where one may go.

the Public Hearing opened at 7:57 p.tn. Mayor Liebl read the portioa of the
Public Hearing notice that stated this hearing wae fo� the i.nstallatioa of water
aad sewer cnaias and servicea for properties abuttiag East River Road from 63�
Way N.E. to Rice Creek Way, He added, the east would be $690 for each waCer
service aad $430 for each sewer service. �

Mr. Harold Beckman, 6430 East River Road said when the Road was widened to four
1$ae�s, the property owners were told the stub for the services was to be put
in. He added, this was never done. He said he had recently spent $1,300 for
a new well and his neighbor had also spent a considerable sum on his well.
He added, he had also paid $200 for cesspool repair recently. He repeated
the stubs that were to run across were never installed.
Mayor Liebl asked when this was promised. Mr. Becktnan said at the time East
River Road was wide,ned. Mr. Clark said this was in 1958. Mr. Beckman repeated
tbe procaise that was made t� the property oaaere at that time by Philip Drake
� Sons.
Mx'. Warrea Palm, 6421 East River Road, said he is ia favor of the construction
of the aewer service.
Couacilman Nee said the mentioned amounts of $690 for water service and $430
for sewer service is not the whole picture. There is another substantial charge
for the sewer and water laterals. Mr. Warren Palm said he had already paid this.
Councilman Nee said Mr. Palm had, but Mr. Beckman would be assessed for the lat-
erals.
The Finaace Director said the amounts mentioned are the assessment amounts for
the service line from the main to the property line. He added, the main line
down the middle of the street is charged so much for each front foot. He said
there is a charge to run from the lateral to the property. He added, in this
area the amounts mentioned are the assessments to run from the lateral to the
property line. He said the second part of the assessment is the charge for the
lateral. The Finance Director said in this area there are no Laterals, but
according to the City Ordinance, each property owner is to be charged for the
lateral even if the service is coming from the main. He said the average sewer
lateral assessment was $954 for the year 1972 in the City of Fridley. He said
there is another additional charge for the property owner to run the service
across hia property.
Councilman Nee �sked *4r, palm if the information given about the laterals had
changed his opinion. Mr. palm said no, he would have to do this sooner or later.
Mayor I,iebl asked if there were any questions from the Council. Councilman Nee
said he had hoped to see more people at the hearing. He questioned Mrs. Erna
Slawspa, 6420 East River Road on her opinion of the improvements at this time.
MrB. Slawsoa said she was against the improvements.
MQTI�1 by Councilman Breider to close the Public Hearing. Seconded by Councilman
Starwalt. Upon a voice vote, all voting aye, Mayor Liebl d eclaxed the motion
carried unanimously, and the public hearing closed at 8:17 p.m.

Subject: Letter of Intent Regarding Lot 4� Block 1, Elwell's Riverside Heights Plat 2
Dear Mr. & Mrs. Lewis:
Please be advised that the City of Fridley, a municipal corporation under the laws of the State
of Minnesota, is interested in acquiring a utility and drainage easement across a portion of your
property described as Lot 4, Block 1, Eiwell's Riverside Heights Plat 2. The e�ct nature and
extent of the easement is described in Exhibit A which is attached to this leiter of irttent and
incorporated herein. The City requests that you acxept the terms of this letter of intent as a
mutual statement of the City of Fridley and Vncent R. Lewis and Mary M. Lewis.
1. De�initions. For purposes of this leiter, the following terms shall have the following
meanings: �
a uCityu means the City of Fridley, a municipal corporation organized under the laws
of the State of Minnesota
b. "Owneru means �ncent R. Lewis and Mary M. Lewis..
c. °Property� means the real property in Fridley, Minnesota, legally described in F�chibit
A attached hereto.
1. prior Negotiation. The City has previously conferred with the Owner that it desires to
obtain an easement for purposes of establishing a u#ility and drainage easement As
discussed, the City has determined that the proposed easement lies within an area
previously dedicated as street right-of-way for the vacated 76th Way. Because the
property is Torrens Property, it is necessary that a proceeding subsequen# be completed
in order to add the vacated street right-of-way to the Owner's adjacent property.
3. Statement of Intent. The City and the Owner agree to proceed in good faith and with
due diligence to complete the proceeding subsequent. The City agrees that any and all
costs associated with this proceeding will be paid for by the City. The Owner authorizes
the City to proceed with the proceeding subsequent and will cooperate with the City in

completing this procedure. The parqes further agree that upon completion of the
proceeding subsequent that they will execute the easement attached hereto as Exhibit A.
The parties further agree that upon execution of this letter of intent that the Owner
authorizes the City to enter on the property described in Exhibit A and to commence
construction of a 6 inch watermain. The City agrees that upon completion of this
construction it will restore the property to its present condition.
4. Consideration. The consideration for this agreement shali be the time and money
expended by the City in completing the proceeding subsequent described above.
5. Title to Property. The Owner warrants that they are the legal owners of the property
described in Exhibit A and that upon completion of the proceeding subsequent that they
have marketable title to the subject property, subject only to mortgages and
encumbrances of record.
6. Atfect of Letter of Intent. Upon the endorsement of this Letter of Intent by both parties,
the effect of this agreement shall� be that the City has the right to enter upon the property
for purposes of constructing a 6 inch watermain and that the Owner agrees to sign the
Easement described in Exhibit A for the consideration described above.
7. Acceptance. The terms of the Leiter of Intent shall be accepted by the Owner by
execution and delivery to the City.

VACATED STRE�I' DIRECTIVC
Pursuant to Minnesota Statutes, section 508.73, subd. 2, I hereby direct the registrar of tides
of Anoka County to memorialize this directive upon the new certiGcate of title for land described in
Certificate of Title No. 43457 and, in future certiCcates for the land described in lhat cerlificate of
title, he is further directed to add the vacated street described below to the land description thereof,
and to omit the memorials oE Ordinance No. 121 and Ordinance No. 136, Cled December 17, 1993,
as documents No. 246409 and 246408, respectively, and also the memorial of this directive.
The south half of that part of vacated INDIANA AVENUE (now known as 76th Way
N.E.), as dedicated in the plat of ELWELL'S RIVERSIDE HEIGHTS PLAT 2, lying
between the northerly extensions of the east and west lines oF Lot 4, Block 1, said
plat.
I further hereby certify as follows:
1. That I have examined the certi�ed copy of Grdinance No. 136, filed with the registrar
of titles on December 17, 1993 as documen� No. 246408, and that instrument evidences the
vacation of portions of INDIANA AVENUE (now known as 761h Way N.E.), as dedicated
in the plat of ELWELL'S RIVERSIDE HEIGHTS PLAT 2.
2. That the above-described �rtians of lhe vacated avenue accrues to the land described
in CertiCcate of Title No. 43457 and should therefore be added to the body of the new
certificate oi title for such land.
3. That the vacation proceeding took place after the title to the land described in the
aforementioned certificates of title was registered.
4. That the vacation proceedin� is legally suCCcient to add that parl of the vacated street

As you are probably aware, this law firm represents the City of
Fridley. We conducted the necessary work to add the vacated street
to your property and filed the Affidavit of Survivorship and
Marriage Certificate upon your Certificate of Title at the County
of Anoka. All the necessary documents have now been filed with the
county and the county will now be issuing a new Owner's Duplicate
Certificate of Title in the name of Mary M. Lewis. Note that the
county is behind in issuing new Owner's Duplicate Certificates of
Title and it may take up to 12 months for them to issue a new
Certificate of Title to you. Therefore, you probably will not
receive the Owner's Duplicate Certificate of Title from the county
until approximately December of 1995.
Even though the new Owner's Duplicate Certificate of Title is not
issued to you until that time, you have the full ability to convey
or mortgage your property as you desire. For this reason, this
should not affect you in your dealings with your property.
