On July 8, 1998, the Fridley Appeals Commission officially approved your request for a
variance, VAR #98-20, to reduce the required front yard setback from 35 feet to 30.4 feet
to allow the construction of a 1,250 square foot addition to the north side of the existing
dwelling on Lot , Block 3, and the south 33 feet of vacated Indiana Avenue lying adjacent
thereto Elwell's Riverside Heights, Plat 2, generally located at 7598 Alden Way, Fridley,
Minnesota, with the following stipulation:
1. The house shall not be converted into a duplex.
You have one year from the date of the Appeals Commission action to initiate
construction. If you cannot begin construction during this time, you must submit a letter
requesting an extension at least three weeks prior to the expiration date.

simple but it does require redoing all the plans. It is not viable. They want to get in this
calendar year.
Mr. Jones asked how deep the garage was.
Ms. Toner stated the garage is 21 feet deep.
Mr. Jones asked how wide the living area was.
Mr. Tatting stated the living area is 30 feet wide. The length is 61 feet with 21 feet
allowed for the garage and 40 feet allowed for the living area. An existing garage pad
would be removed, and they will use an existing driveway.
MOTION by Mr. Jones, seconded by Ms. Beaulieu, to close the public hearing.

Ms. Beaulieu stated the petitioner is restricted with being on the river and by the 40-foot
setback required from the bluff. A garage 21 feet deep does not seem excessive. It
looks like an improvement to the property. She would be inclined to vote in favor of the
request. �
Mr. Jones stated he thought it looked like an improvement to the property. He agreed
that a 21-foot deep garage is not excessive. He has a garage that is 20.5 feet and it is
not that deep at all. It seems to him that the petitioner tned to squeeze it in as tight as
they could. Moving the existing house is not practical. In reality, there is a small corner,
30 square feet, that is within the setback. He would be inclined to vote in favor of the
request.
Mr. Kuechle stated it was not quite that clear to him. It seems to him that the hardships
illustrated or defined are really not very strong in that it seems there is the option to widen
the house and get the same amount of square feet without needing a variance. On the
other hand, he recognizes the fact that there is an 18-foot boulevard there which means
the house, in terms of the spirit of what they are looking for, is still set back quite well.
Additionally, the actual 4.5 feet or the total square footage is actually very low. He does
not want to be picky. He would be willing to vote in favor of the request with the
stipulation that they cannot convert this into a duplex.

DESCRIPTION OF REQUEST:
Ms. Kathleen Toner is requesting a variance to reduce the required front yard setback of
35 feet to 30.4 feet. The variance will allow the petitioner to build an attached garage in
front of a proposed house addition. The address of the site is 7598 Alden Way NE.
HARDSHIP STATEMENT:
We apply for this variance on a hardship basis for the following reasons:
1. We are on the Mississippi River and can go no further back toward the bluff as we need 40 feet
from the bluff to the back of the house.
2. We are further restricted by an 18 foot boulevard before we can measure our 35 foot setback.
Other boulevard setbacks in our area are only 13 feet.
3. The existing structure denies the possibility of moving the addition further south on the
property to alleviate the setback problem.
SUMMARY OF ISSUES:
Section 205.07.03.D.(1) of the Fridley Zoning Code requires a front yard with a depth of
not less than thirty-five feet in the R-1, Single Family District. The proposed attached
garage would be 30.4 feet from the front property line.
The property is over 17,000 square feet in area and has a depth of over 150 feet. The
property is adjacent to Alden Way on the east side and the Mississippi River on the west
side. The buildable area between the two setbacks is reduced to a width of 65 feet. The
buildable area runs diagonally from the northwest to the southeast.
The property is not a perfect rectangle and angles outward from west to east. The
topography and shape of the lot, in addition to the location of the existing house, make it
very difficult to place a building addition on the property and meet all the setback
requirements. The portion of the proposed garage that would extend into the required
front yard is approximately 30 square feet in area.
RECOMMENDED ACTIONS:
Staff has no recommendation due to the fact that his request is within a previously
granted dimension.

Ms. Kathleen Toner is requesting a variance to reduce the required front yard setback of 35
feet to 30.4 feet. The variance will allow the petitioner to build an attached garage in front
of a proposed house addition. The address of the site is 7598 Alden Way NE.
SITE DESCRIPTION/HISTORY
The Toner property is in the Ehvell's Riverside Heights Plat 2, which was platted in 1959.
Originally, Indiana Avenue (or 76� Way) was located to the north of the property. It was
vacated by Ordinance #136 in 1959. The building permit for the original house is not in the
file, but a building permit for a two bedroom addition was given in June of 1959, and a
building permit for an attached garage was given in August of 1959. The garage no longer
exists, but a cement parking pad indicates where the garage used to be located.

The property is 17,904.2 square feet in size. The area of the existing structures is 911.4 square
feet. The proposed house addition and garage are approximately 1,670 square feet. The total
area that would be covered by structures would be 2,581.2 square feet, or 15.1 % of the
property. The lot coverage by structures would be less than the maximum allowable of 25%.
The property is over 17,000 square feet in area and has a depth of over 150 feet. The
property is adjacent to Alden Way on the east side and the Mississippi River on the west
side. The front yard setback is 35 feet. The setback from the river bluff is 40 feet. The top
of the river bluff begins just inside the actual property line. Between the two setbacks, the
area in which a building may be placed is an approximate a width of 65 feet.

The property is not a perfect rectangle and angles outward from west to east. The
topography and shape of the lot, in addition to the location of the existing house, make it
very difficult to place a building addition on the property and meet all the setback
requirements. The portion of the proposed garage that would extend into the required
front yard has been minimized.
The proposed attached garage will be located over 19 feet from the interior property line to
the north. The northeast corner of the garage will be 30.4 feet from the property line
adjacent to Alden Way. Due to the angle of the lot and the angle of the house, only a
portion of the garage will not meet the 35 foot setback. Of the 24 foot width of the garage,
12 feet will not meet the 35 foot setback and the remaining 12 feet will meet the setback.
Therefore, approximately 30 square feet of the garage will be in forward of the required
front yard setback.
The site plan indicates that the new addition will be attached to the existing house by a
narrow hallway. Ms. Toner's mother, Vietta Toner, presently lives at the home. Being that
Vietta's vision is becoming worse, the Toner's have decided to leave the old portion of the
home as is, so that Vietta will not have to learn the floor plan of a new home.
The lay out of the new house would make it easy to convert it into a duplex. The Toner's
have indicated that they will not be using the house in this fashion. If the variance is
approved, a stipulation indicating that the house shall not be turned into a duplex would
seem appropriate.
PREVIOUS COMPARABLE VARIANCES GRANTED
Gail & Edward Ahrens,198 Mercury Dr. (May'9�: They were granted a front yard setback
of 15 feet for a garage addition.
Theodore & Collen Raines, 5221 Fillmore St. (May '95): The were granted a front yard
setback of 30.5 feet for the construction of a garage and great room.
RECOMMENDATION
