The above quote is for 8' of material. On the sketch, line A B shows you how an 8' elbow would appear. Line C D shows you a 6' elbow. Elbows are measured along the centerline. It was Ken Olson's concern that if leg E A or E C were not long enough it would not effectively produce a change of direction of flow and that the water could possi�ly try to continue along a straight Iine °rom the inlet towards line E A or E C. I would tend to agree with this and suggest you go with the 8' elbow. As I think you know Stoneybrook Creek flows through our property and the city has an easement on same. We have had several conversations with Mr. Solri ak concerning the erosion produced by the culvert being installed at an angle which empties water directly on our bank rather than down the natural water way of the stream. Several engineers with whom I have consulted have indicated it will not be possible for us to to control the erosion on the bank until we are able to divert the water from the culverts toward the more natural direction of the stream bed. I would find it helpful to have a conversation with you and h1r. Sorlriak concerning this erosion prablem. BOX 2fr499 • 3340 REPUBLIC AVENUE ST. �OUIS PARK, MINNESOTA 55426 PHONE: 612-929•7854 December 16, 1977 In answer to your telephone request that I write you a letter pertaining to the two culverts under the road next to your house, I believe called Stony Brook Outfall, my professionaT opinion is as follows: Problem: You will lose the fill or embankment at some future time due to water coming through the culverts in periods of heavy precipita- tion runoff. You have no alternative but to seek some solution to your existing problem. Solution: A) Turning the water down that channel and away from the bank is the best solution. This can be accomplished by elbows on the ends of the pipe. This would decrease the velocity and the'resulting quantity of flow would be reduced a bit also. • This should not be too objectionable. This might also reduce velocities upstream. �i) Protect the bank with a high retaining wall. This is a very e�ensive alternative and could be a continual maintenance problem. You asked for my opinion last summer and these ideas were conveyed to you and the City Engineer, Mr.Richard Sobiech, at that time. I haven't gotten any smarter the last six months so my opinion has also remained unchanged. I imagine everybody in their lifetime has had a water runoff problem and most are corrected inexpensively and some very expensively, but they are corrected. It would be nice if hindsight was equivalent to foresight. Good luck with your meeting with the City of Fridley. Vogel, Attorney at Law SUBJECT; Request on Behalf of Donald and Lois White, 7736 °�'� �� A1den Way N.E. that the City of Fridley construct an elbow extension on its two 54-inch culverts located on the White's property. DATE: January 4, 1978 INTRODUCTION On January 9, 1978 we will appear at the Council's regular meeting for the purpose of requesting that the City construct an elbow extension of the two City owned and maintained culverts which are located on the property of Donald and Lois White at 7736 Alden Way N.E. As presently constructed, these culverts discharge water against the embankment supporting the foundation of the White's home. During the heavy rain which occurred in late June of 1977 substantial damage was suffered by the White's to their property. To prevent such future damage, and to preserve the structural integrity of the White's house, construction of the extension is necessary. According to data received from the City Engineer, Richard Sobiech, the cost to the city of this project can be expected to be approximately $2100.00. SUMIKARY OF THE FACTUAL BACKGROUND OF THIS REQUEST In March of 1977 Donald and Lois White Contracted for the con- struction of a single family dwelling to be built at 7736 Alden Way N.E. (Legally described as: The Southeasterly 25 feet of Lot 13, and all of Lot 14, Block 5, Pearson's Craigway Estates Second Addition.). The site is located on a bluff above and to the Northeast of the Mississippi. Stoneybrook Creek passes across the site to the Northwest. The City of Fridley has an easement on the property for the purpose of carrying the waters of Stoneybrook Creek under Alden Way N.E. These details are contained in the schematic drawing of the site which is attached as Exhibit "A". Construction of the house was completed in September of 1.977 and the White's are presently residing in this home. The Interim Development Regulations for the Mississippi River Corridor Critical Area require, inter alia, that there be a 100 foot setback from the normal high water mark of the river for any buildings constructed within the "critical area." (See Section G, 4, (B,2):of the Interim Regulations.) The White's property is located within this critical area and thus was subject to the requirement noted above. � / ' •� The unusual configuration of the White's lot and its varied ' topography dictated that any house built thereon be located within 55 feet of the normal high water mark of the river. Thus it became necessary for the White's to seek a variance from the Interim Regulations 100 foot setback requirement prior to con- struction. The White's made application for the variance in December of 1976 and a Public Hearing was held on this application before the Fridley Appeals Commission on January 11, 1977. A copy of the minutes of that meeting and hearing are attached as Exhibit "B". The minutes reflect that discussion during the Public Hearing focused on the 100 foot setback requirement and its relation to the public purpose which it serves, namely, preser- vation of the river from bank erosion and aesthetic disruption. In this connection the White's indica�ed (page 4 of the minutes) that they were prepared to take the steps necessary to prevent erosion on the river bank. Upon completion of the Public Hearing the Appeals Commission unanimously recommended that the variance be granted. On February 7, 1977 the City Council granted the variance. A copy of the "City Council Action Taken Notice" dated February 9, 1977 is attached as Exhibit ��C". Upon receipt of this notification the White's completed arrangements for the purchase of the proper- ty and construction was undertaken. In addition to construction of the house, and in fulfillment of Stipulation No. 1 of the variance (See Exhibit "C".), the White`s caused the bank of the Mississippi on their property to be pro- tected with rip rap to prevent erosion. (See Exhibit "A".). Furthermore they installed, at their expense, a retaining wall away from the river at the bank of Stoneybrook Creek adjacent to the two 54-inch City owned and maintained culverts which carry the waters of the Creek under Alden Way N.E. (See Exhibit "A".). In late June of 1977 a heavy rain occurred which intensified the discharge from these culverts so as to destroy the retaining wall and cause approximately 15 feet of erosion of the embankment upon which the White home is Iocated. Due to the angle of ihe mouth of the culverts in relation to the embankment this damage will continue in the absence of action by the City to install an elbow extension in such a way as to divert the water passing under Alden Way N.E. back to the normal creekbed of Stoneybrook Creek. Prior to bringing this matter to the attention of the City Council the White's consulted with both the City Engineer and the City Manager. In addition legal counsel for the White's conferred with the City Attorney . During these consultations we learned that construction of the elbow extension is a relatively simple matter expected to cost the City $2100.00 and further that such construction would have to be authorized by action of the City Council. -2- %� . An independent consultation with a private engineer was also undertaken by the White's with Kenneth A. Olson, P.E. In his professional opinion the requested action is the "best solution" to this problem. A copy of his opinion letter to Mr. White is attached as Exhibit "D". Mr. Don Leiverman, 1468 North Innsbruck Drive state e recently built in the area and was told by Mr. ficek, the developer, th the area was protected by the D.N.R. He questioned what was going to ha n to the pond in the area of Block 2. Mr. Harnack stated their concern is to pro ct the resource values that are there. He stated this does not necessarily mean ere wouldn't be any filling. He identified the five lots the D.N.R. is concerned out. Mr. A1 Messerli, 5505 W. Danube R N.E., stated, at the time he bought land in this area, it was clearly point aut that eight of the lots were considered unbuildable. He stated whate r occured between the previaus owner and the present owner he did not know, but ere is reasonable expectation by the City that these lots couldn't be built on ecause of the amount of assessments levied. He didn't feel the Tots could be ilt on and save any of the wetlands. WHITE: Mr. Sobiech, Public Works Director, explaine i a request from Mr. and Mrs. Donald White, 7736 Alden Way, for the City to construct an e7bow extension of the two City owned and maintained culverts which are located on the property or Mr. and Mrs. White. He explained this is requested to help reduce the erosion taking place from run-off on the White's property. Mr. Sobiech felt the realign ment of the flow of water would not affect the property owner to the north. Mr. White stated he talked to this property owner about the possibility of putting on the extension and he was arnazed the way the pipes had been installed in the first plaee. Mr. Howard Vogel, Attorney representing Mr. and Mrs. White, stated because the culvert was misplaced, a private piece of property is being subjected to considerable damage. Mr. Herrick, City Attorney, stated it is a culvert that was established by the City and the stream is used as an outlet for some City storm sewers and he thinks that there is some possibility that, if the property is substantially damaged because of this culvert, there might be some liability on the part of the City. Because of the placement of the culverts, it is directing the flow against private prooerty. Councilman Fitzpatrick stai:ed this request comes from the petitioner and questioned if there was a recomm2ndation from the Engineering Department. Mr. Sobiech stated this .request is a cooperative effort to come up with a solution. As far as a recommendation, they know the elbows will help reduce the problem on the bank, but Mr. White will still have erosion problems. Mr. Sobiech suggested the property owner to the north be contacted to see if he concurs with the request. Mr. Sobiech stated, at the last meeting, the Engineering Department felt the extension of the elbows would help reduce the erosion, if Mr. White i would put in additional retaining walls. However, there was concern this might involve improvement of other areas along Stonybrook Creek. �. Mr. So6iech stated the proposed agreement calls for the City to extend the culvert, if ero§ion control measures are installed by the property �wrter. Mr. Sobiech stated the property owner to the north of Mr. White was contacted and indicated no objection to the installation of the elbows. . Councilman Fitzpatrick stated the culvert is directing water against someone's property and a statement was made by the Eng9neering Department that they felt the piping shouldn't have been designed the way it was. Mir. Qureshi, City Manager, pointed out that, when the property owner requested the variance, it was made clear there was an erosion problem and he accepted the responsibility of protectinq the banks. Mr. Qureshi stated he would reco�unend against the City entering into the agreement. Mr. White stated the erosion discussed at the Appeals Corrmission was for the MississipRi River. Mr. Qureshi stated there is no question of protection of the river because everyone clearly ur�derstands that it is the responsibility of the ownero He stated he is sympathetic to the problems Mr. White has, but questions whether public func�s should be expended on this property. He felt, if funds were expended at this location, the Council would have a difficult argument to deny the same for other areas.with erosion problems. MOTION by Councilman Fitzpatrick to proceed with negotiating a!� agreement with Mr. and Mrs. White si:nilar to th� one being proposed. Secanded by Councilman Sarnette. j Councilman Namernik stated he has a problem with City taking on full responsi- ' bility in light of the fact that the property owner did agree to handle the erosion problem. Ne stated he was sure the property owner was aware the culvert existed at the time he inspected the property. i Mr. Herrick, City Attorney, indicated he can see the City Manager's point, but 1 has some concern about legal liability. He felt if it were not for the � agreement between the City and the property owner when the property was developed, he would have no hesitation to say there was liability on the part of the City. He felt a different situation is involved where you have a culvert that directs water against a piece of property than a situa�ion ; where water is outletted into a creek and the flow may cause erosion. � ____ . . ___.__ _.. _-- - __ ___ ___--- ___._. � ,� � 290 .. , ; � ; � i � � , REGl1LAR MEETING OF JANUARY 23, 1978 PAGE g He felt, in this case, there was direct erosion caused by the culvert and for this reason, felt the City should expend funds to change the effect of the water running through the culvert. He felt there may be similar situations in the City where money may have to be expended and suggested perhaps the Council or a future Council may have to levy some additional City-wide ex- penditure in order to make some improvements in the streams that serve as an outlet for the City's underground storm water system. He stated he would be particularly concerned about those locations where water flows with a force onto private property. Councilman Barnette felt the City has some responsibility to the property owner 6ecause it is a City culvert that is causing the damage. Mayor Nee stated, in this case, the house was built as a condition of the Cityissuing the variance. Mr. Qureshi stated it is all river bank in the area and there is no creek bank. Mayor Nee felt, if the City hadn't issued the variance to allow the house to 6e constructed, there wouldn't be a problem. Mr. Vogel, attorney representing Mr. and tdrs. White, stated Mr. Sobiech's professional opinion is that the culvert is misplaced which means the City has undertaken some activity that directs the creek, which is not a normal flow. Regarding erosion control, he stated there isn't any evidence which indicates it includes the creek bed. He stated the culvert is misplaced so the City has liability. Mr. Qureshi questioned how the culvert was installed improperty. Mr. Sobiech stated he felt it wasn't in alignment with the creek bed, but didn't know if the culvert was put in by the City or the developer. Mr. White stated the variance they received had nothing to do with City regulations, but was a requirement from the State. Mayor fJee stated the culvert has been there for 25 years and asked if the Whites would be willing to split the cost with the City. Mr. Vogel pointed out there was money expended by the Whites for erosion control to protect their property, but because of the culvert that control � measure was destroyed. Mr. Vogel felt it was the responsibility of the City to make the correction so that the erosion control efforts the Whites under- take will be effective. Mayor Nee asked Mr. Herrick how many votes it would take to pass the motion. Mr. Herrick stated, since it is a vote to expend futtds, it would take 4 affirmative votes of the Council. ,� UPON A R�LL CALL 1lOTE TAKEN ON THE ASOVE MOTION, Councilman 8arnette, Councilman Schneider and Councilman Fitzpatrick voted in favor. Mayor Nee declared t motion failed by a 3 tp 2 vote. � CONSIDERATION OF A REQUEST BY THE FRIDLEY JAYCEE5 TO SPO A SOFTBALL Mr. Richard Young appeared before the Counci egarding his request fpr the Fridiey Jaycees to sponsor a softball to ament, Softball in the Snow, on February 18, 1978. He requested the use of Co s Park and licenses to sell food and beer and asked that the license s be waived. He further requested a waiver of the requirement ta hav police officer on the grounds. He felt this would not be needed b use of the size of the tournament which will be only 10 teams. At the Council meeting a compromise solution was suggested that would require you to help pay for costs associated with the cul- vert extension in addition to the appropriate erosion control methods to protect the river (stream) bank. We are still willing to work with you to solve the problem. It must be emphasized, however, that trie City believes that appro- priate notification and stipulations regarding your respansibility for erosion control associated with your development, were initially discussed and accepted by you. It is this acknowledge- ment of your responsibility for erosion control that puts the City in a difficult position in expending public monies to protect private properties, on not only your property, but other private properties,throughout the City. With this in mind, the City suggests that the culverts could be extended if you share in the cost of the extension. Specifically, the cost that is recommended you share is the cost of the materials to extend the lower 54" CMP eulvert (approximately $850 - 1977 prices from Northern Culvert Co.), which was initially installed by the developer when the Pearson Craigway Estates 2nd Addition plat was dev�loped. At that time, it was suggested that perhaps Mr. and Mrs. White could share in the cost of the cu)vart extension. Since the property owner did not wish to share• in the cost of the extension, the request for the extension was denied by Council. Mr. Sobiech stated, since this time, staff has worked with Mr. and Mrs. White and there has been an agreer�ent regarding the extension of the culverts which is now before the Council for consideration. Mr. Sobiech stated what the agreement covers is that Mr. and Mrs. White would purchase the materials for one culvert extension and the City would provide the materials for the remaining culvert extension and all installation costs. Mr. Sobiech stated it would be a joint effort in trying to solve the problem. The cost to Mr. and Mrs. White would be $£326 and the cost to the City would be $1,309. Mayor Nee stated he was concerned about Item 4.in the agreement where it states that each party reserves their right to make claim for any future damages. Councilman Schneider also indicated his concern and suggested it be deleted. Mr. Sobiech stated the City Attorney had some rationalization regarding that pa rticular clause. Councilman Fitzpatrick felt possibly action shouldn't be taken on the agreement without the City Attorney present. Mr. Qureshi, City Manager, felt the Council could approve the agreement with deletion of Item 4, and if this is not agreeable to the property owner, it wouTd be brought back to the Council. _ MOTION by Councilman Fitzpatrick to amend the agreement by deletion of Item 4. Seconded by Councilman Schneider. Regarding Item 5, Councilman Hamernik questioned if the City is assuming any responsibility for maintaining it. Mr. Sobiech stated this is done with al1 the City's storm sewers. UPON A VOICE VOTE TAKEN ON THE MOTION, all voted aye, and Mayor Nee declared the motion carried unanimously. Mayor Nee stated he also shared Councilman Hamernik's concern regarding Item 5 and questioned if this item shou7d be deleted. At that Council meeting Mr. Don White requested that the City install ex- tensions to the existing storm sewer culvert in an attempt to help eliminate the erosion problem to his property. At that time Mr. White did not want to participate in the extension construction and felt it was the primary res- ponsibility of the City. Subsequent to that meeting, further discussion with Mr. Whte has taken place resulting in the attached agreement. The agreement has been prepared in cooperation with the City Attorney and indicates that the property owner will cost- share in the extension construction. I was calied to the property and requested to initiate action to repair the side slope erosion and the spillway base that has completely eroded away,to the original design by Comstock and Davis that was installed by the City back in 1975/76. I advised Mrs. White that the City policy was not to utilize City forces or f unds on the creeks in the City except �or those pipes and conduits under our streets. Mrs. White indicated an interest in suing the City to initiate repair work. I advised her that she may rather contact the Council and obtain a confirmation of the Creek Maintenance Policy. All of the large ballast material that had been placed in the spillway below the street culvert has eroded away. Had filter fabric been installed and large boulders used initia]ly, this probably would not have occurred. There are two smaller areas on either side of the spillway basin that are eroding. These could be corrected with filter fabric and gabins or large rubble. I would expect Mrs. White to contact Mayor Nee and Councilman Fitzpatrick, or we will be hearing from her attorney.
