Regulations for the Mississippi River Corridor Critical
Area, Section G, 4, (B,2). to reduce to 70 feet the
requirement that in Urban Developed Districts no
structure or road shall be placed no less than 100
feet from the normal highwater �ark of the River, and
no less than 40 feet from blufflines, to allow an
existing dwelling to enclose part of an existing
deck, on Lot 11, Block 5, Pearson's Craigway
Estates Second Addition, the same being 7806 Alden
Way N.E., Fridley, Minnesota.

b. To yrevent and mi�igate irreversible damage to this state� regional, �
and riational resource; . .
c.' To preserve and enhance its natural, aesthetic, cultural, and
historical value for the gublic use; . ,
d. To pzeserve and protect the river as an essential element in the
� national, state, and regional t�ansportation, sewer and water and

e. To protec.t'and greserve the biological and ecological functions of �

.'in'keeping wi:th the above, the public purpose served by the critical
areas' designation; Section G, 4(b2) states that there must be a 7.00 foot
s�tback from the normal high water mark of the river. _
B. STATED H:�1RD5HIP: • .
"We request a variance to 70 feet from the riississi�pi River reguZation
requiring all buildings to be located 100.feet fro*_:n the river to add an -
addition to the northwest arid southeast corner� of the eaisting house. •

In keeping with Section J3 of the Interim Develo�:►er.t Regulations for
the b7ississippi Ri.ver Corridor Critical Area, th� local unit of goveYn:-nent
may grant a variance from the strict comnliance of the setback of ths
interim xegulatiens after an administrative hearing conducted accordir:g .
to.the reguTations of thaf local unit of gover:u,►ent, and may be gran�ed
on�.y ttYen, after the followir.g findings are made: :
l. The strict eiiforcement of the setback or heignt restrictions will
result in unnecessary hardship. "Hardship'": as used in the consiueration .
of a dimension variance means that the praperty in question can not be
put �o a rr�asonable use under the d�ension �rovision of these In�erim
Aevelo�mcnt Re�ulations.
2. Th�re are exceptional circumstances unique to the property that were
not created by a landcr.,rner af ter April 25, 1975. .
3. The dimension var.iance does IlOt alloca any use that is not a cor.spatible
use in the land use district in which the property is located.
4. The ctimension vari �ice will not alter the essential character of the
l.ac�3lity as establislied by these Interim Devel.op:aent Regulations.

:ir. T.'eterson showed the Co�nission draw:ings of the proposed addit3.ons and
Mr. Moravetz produced some aerial photographs of tfie area. Mr.'Pe�.erson.said
the deck runs the total riverside of the house and the addition will be two
"sto�ies with a little treehouse (loft) on tYie northwest corner and the greenhouse
addition will be on the southeast corner and�will come out even with the end of
the house. He said the windows are the passive solar heating and will all face
south.''He further stated that'aesthetically it will improve the house and help
with the energy bill. Mr. Peterson said the additians will not be any closer
than the existing deck and the sloped roof will match the existing house and
