The City of Fridley has received a request from a homeowner within the Critical
Area of the Mississippi River. The homeowner's request is for a variance to allow
replacement of an existing dilapidated 10' X 36' deck. A 23', rather than a 40'
setback from the bluff line would be required. If approved, the overall size of the
deck will be reduced to 9' X 36, however, the homeowners do plan to build a
sun/potting room over 162 s.f. (9' X18') of the new deck.
I have attached a copy of the staff report prepared for the Fridley Appeals
Commission. Once you've had an opportunity to review the report, I would
appreciate your official response for inclusion with our staff report to the City
Council. This item will be heard by the City Council on January 5, 1998.

to be a slight improvement over the existing situation. If the variance is granted, we strongly

We are writing in support of Karl and Margaret Schurr's request for a variance to allow a
reduction in the setback required from the bluff line of 40 feet to 23 feet. We can think of
no public purpose that would be served by denying the variance. The situation of the
neighboring houses (7812 and 7824) do not provide for seeing any structure in the back
yard of 7818 from the residence or decks. The bluff is steep and the back yard or deck is
not visible from the river bank or adjoining park land. The only place that the deck is
visible to the public is from the river itself or across the river. Those times of year when
someone is likely to be on the river, the foliage is too thick to see the back yard.
The request of Karl and Marga.ret Schurr is reasonable in that it is compatible with the
layout of their back yard. If any member of the public would have a legitimate issue it
would be from our address (7812) and, as we noted previously, the back yard of 7818 is
not visible from that location. We have a conflict on December 10�`, and do not plan on
attending the Appeals Commission Meeting. If this appears to be a controversial issue,
please let us know and we will rearrange our schedule.
Please make this letter available to the members of the Appeals Commission. Let us

SUMMARY OF ISSUES:
Section 205.25.08.C.(1) of the Fridley Zoning Code requires that all new structures and uses
shall be placed not less than 40 feet from the top of the bluff line overlooking the Mississippi
River.

The Overlay District for the Critical Area of the Mississippi River was adopted in 1977, one
year after construction of the dwelling and existing deck. The Critical Area requirements state
that all structures must be 100 feet from the ordinary high water level and 40 feet from the top
of the bluff of the Mississippi River.
The petitioners' proposal reduces the current impact of the existing deck. The Minnesota
Department of Natural Resources has submitted a letter stating they do not object to the
request; however, they desire additional plantings to screen the proposed construction from
the river and properties across the river. Several neighbors submitted comments and letters of
support.
The proposed request is within previously granted variances. A variance to 5 feet was granted
in 1990 for 7806 Alden Way.
STAFF RECOMMENDATION TO THE APPEALS COMMISSION:
As the request is within previously granted variances, staff has no recommendation for the
Commission. If the Commission approves the request, staff recommends one stipulation.

SITE DESCRIPTION/HISTORY:
The property is located south of 79th Avenue on Alden Way. The property is zoned R-1,
Single Family, as are all the surrounding properties. The property is approximately
21,000 square feet in area. Located on the property is a 75 foot by 80 foot dwel(ing and
a 24 foot by 32 foot attached garage. The dwelling and garage were constructed in
1976. Also, at that time, a 10 foot by 36 foot deck was constructed on the rear of the
dwelling.

for the public use.
d. To protect and preserve the river as an essential element in the national,
state, and regional transportation, sewer and water and recreational
system; and
e. To protect and preserve the biological and ecological functions of the
Mississippi River Corridor.
The petitioner is proposing to construct a finro-level addition with a sunroom on the
upper level and a potting room on the lower level, as well as some additional deck area.
The sunroom has direct access to the family room. The existing deck measures 10 feet
by 36 feet. The dimensions of the proposed construction are 9 feet by 18 feet for the
sunroom/potting room addition, a 9 foot by 6 foot deck to the north of the
sunroom/potting room, and a small 4 foot by 7 foot deck area directly adjacent to the
house which creates an L-shaped deck. This L-shaped deck will provide access to
patio windows for cleaning purposes. The overall impact of the construction will be 27
feet in length and 9 feet in width, somewhat smaller than the existing 10 foot by 36 foot
deck.
The O-2 Critical Areas District was adopted in 1977 after construction of the dwelling.
In order to comply with the district requirements, the petitioners' proposed addition
would need to be moved 25 feet south of its proposed location. This will prevent
access from existing doors and internal family/living room spaces. Any improvement to
the rear of the dwelling would require a variance due to the Overlay District
r.equirements.
The Department of Natural Resources is required to review all variance requests within
the Overlay District. The Department of Natural Resources has submitted a letter
stating that they do not object to the request. They want additional native plant
materials planted along the bluff line to provide additional screening of the proposed
construction from persons on the river or on the opposite bank.
The request is within previously granted variances. A similar request was granted to
reduce the setback to 5 feet at 7806 Alden Way.

Mr. Jones is a resident of the City of Fridley and was recently appointed to the

1. PUBLIC HEARING• CONSIDERATION OF VARIANCE REQUEST. VAR #97-20.
BY KARL & MARGARET �CHURR:
Per Section 205.25.08.C.(1) of the Fridley Zoning Code, to reduce the setback of a
deck from the bluff line of the Mississippi River from 40 feet to 23 feet to allow the
reconstruction of a deck in the rear yard on Lot 9, Block 5, Pearson's Craigway
Estates 2nd Addition, the same being 7818 Alden Way N.E.
MOTION by Ms. Mau, seconded by Mr. Jones, to waive the reading of the public hearing
notice and to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:33 P.M.
Mr. Hickok stated the subject property is located at 7818 Alden Way and is along the
Mississippi River. The request is to reduce the required setback from 40 feet to 23 feet
along the Mississippi River bluff line. The overlay district for the critica( area for the
Mississippi River was adopted in 1977, one year after the Schurrs built their home and
deck.

Mr. Hickok stated the home is on the west side of Alden Way and overlooks the
Mississippi River. The homes on adjacent lots are positioned in such a manner that they
will not have their view impeded by the addition. The addition is located at the rear of the
house, centrally located on the home, and facing toward the River.
Mr. Hickok stated the home to the south is positioned on a curve of the River, and the
owners have positioned their home to take advantage of the view. It is possible that their
view from a window at the front corner of the house will provide a view of the comer of the
addition. The home to the north is set closer to the street. The addition should not be
visible from the neighbor's home to the north.
Mr. Hickok stated the code requires that new structures be placed not less than 40 feet
from the top of the bluff line overlooking the Mississippi River. The purpose of this
ordinance is to protect and preserve the unique and valuable state resource; to prevent
and mitigate irreversible damage to this state, regional and national resource; to preserve
and enhance this natural, aesthetic, cultural and historic value for public use; to protect
and preserve the River as an essential element of the national, state and regional
transportation system; and to protect and preserve the biological and ecological functions
of the Mississippi River corridor.
Mr. Hickok stated that, as constructed, the Schurr's home has a deck which is 22 feet
from the bluff. The deck is now dilapidated and is in need of reconstruction. A new deck,
six inches narrower, has been proposed. As proposed, the deck would have a 22.5 foot
setback. The addition includes a two-level potting/sunroom combination which will
occupy 175 square feet of the 275 square feet of deck/addition combination. The mass
of the two-story building will not be visible from inside the adjacent home to the north and
slightly visible from the home to the south. In the past, variances to 5 feet from the bluff
line have been granted.
Mr. Hickok stated that because the request is within previously granted variances, staff
has no recommendation. If the Appeals Commission wishes to approve the request, staff
recommends the following stipulation:
1. The petitioner shall work with staff to provide additional native plant materials
along the bluff line.
Mr. Hickok stated staff received a letter from Mr. & Mrs. Sallman in support of the request,
a copy of which was included in the agenda packet. Staff also received a telephone call
on December 2 from Mr. & Mrs. Samuelson who indicated the Schurrs are wonderful
people and that they would like to see their request approved.
Ms. Mau stated that it appears the majority of the proposed deck falls within the 40-foot
setback.
Mr. Hickok stated the bluff line curves at the back of the house and is 44 feet from the
south corner of the deck but 23 feet from the north corner. The bluff line falls away from
#he majority of the mass. The new construction at the south comer will be 44 feet from
the bluff line. The north comer of the deck is the point where it falls under 40 feet.
Mr. Kuechle asked if the petitioner would need a variance to simply reconstruct the

existing deck.
Mr. Hickok stated, yes.
Mr. Schurr stated the DNR asked that they provide additional native plant materials. They
have maintained that bluff line and the slope in the same condition for 20 years. They
have added native plant materials to prevent erosion.. He saw no problem in continuing
that approach. This is really not an addition. It is a replacement. It is not practical to
move the deck further to the south to fully comply with the state regulation which passed
a year after they moved in. They then would not have a proper entrances to the home
from the replacement deck.
Mr. Jones stated he stopped by the house and looked at the site. He read Mr. Hovey's
letter about the native plants. It appears as though the bank where it drops off has native
plants already. He was not clear where the native plants should be located. It seems
pretty natural all the way to the River. He also noticed that, from where the doors come
out, the only place for this is where it is proposed. The request seems reasonable.
Ms. Schurr stated she keeps native plants. That is her hobby. She has columbine and
early spring flowers. Today, she saw an eagte again.
Mr. Schurr stated that is something that was not seen 20 years ago but they do see now.
Mr. Jones stated he saw little evidence of erosion. He would think the DNR would be
pleased with the way it is working.
Mr. Schurr stated he did not know if the DNR looked at the site or if this is a standard
response to such a request.
Mr. Hickok stated that when there are proposals along bluff lines, the DNR looks at the
staff report. Quite often they do come out to the site. He thought it was standard to
tequire native plant materials. While this may not be required in the present state,
whenever you do foundation work or any small excavation, you may disrupt a natural
amenity. This stipulation would make sure that the natural state is restored.
MOTION by Mr. Jones, seconded by Ms. Mau, to close the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:47 P.M.
Ms. Mau stated she thought the petitioners have shown they are interested in keeping
that area as natural as they can. This will be an improvement for their neighbors to see
rather than what is existing. She had no problem with approving the request.
Mr. Kuechle concurred. He believed the hardship is that the ordinance came into being
after the deck was built, and with a fairly minor incursion to ask them to not have a deck
there would not be in keeping with the spirit of the code. He would like the stipulation
included. He did not see that the stipulation would create any hardship for the petitioner.
This is something that they want to do and it can be easily worked out.
Mr. Jones concurred.
