REQUEST
Petitioners, Richazd & Kathleen Kemper, aze seeking two variances. The first variance is to
recognize an existing non-conforming side yard setback from 25' to 13'. The second variance is
to reduce the side yazd setback, on a corner lot, for a proposed accessory building that is 25' from
the common property li.ne, with the home to the rear facing the side street, from 30' to 13'.
SUMMARY OF HARDSHIP
"DownwaYd slope of the reaY yard would YequiYe a lot of fill and there aYe substantial plantings
that would have to be emoved, including a large oak and yew tree. "
- Richard & Kathleen Kemper
ANALYSIS
The property is located on Alden Way. The lot is rectangulaz in shape, with the home being
"squared up" to and fronting on Alden Way. Bellaire Way provides access to the residence. The
existing home and attached garage was built in 1969.
Because the proposed accessory structure location is within 25' from the neighboring property,
who's home opens to the side street, the side yazd setback is to be 30'. ffthe petitioner were to
locate the proposed structure at the required 30' setback, a large amount of vegetation would
need. to be removed and fill would need to be brought into the residence. The petitioners would
also prefer not to remove a large oak and yew tree. City staff has received no comments from
Existing home
