Dear Mr, and Mrs. Meyer:
On January 24, 1996, the Fridley Appeals Commission officially approved your request
for a variance, VAR #96-01, to increase the encroachment of a deck in the side yard
from 3 feet to 4 feet 10 inches to allow the reconstruction of an existing deck on Lot 6,
Block 4, Pearson's Craigway Estates, the same being 7868 Alden Way N.E., Fridley,
MN 55432.
You have one year from the date of the Appeals Commission action to initiate
construction. If you cannot begin construction within one year, you must submit a letter
requesting an extension at least three weeks prior to the expiration date. If you have

IVIs. McPherson stated the subject parcel is located at 7868 Alden Way which is at the
irrtersection of Bellaire and Alden Way. The request is to allow a variance to increase the
enc.roadiment of a dedc into the side yard from 3 feet to 4 feet 10 inches. If approved, this
would allow reconstruction of a deck located on top of an underground storage facility.
Ms. McPherson stated the petitioners are in the process of constructing a 6 foot by 24 foot
porch addition onto the rear of the single family dwelling unit with attached garage. The
area of the variance is an open dedc which provides egress from the porch to the side
yard. The underground storage facility was constructed after the dwelling was
constructed. It is not a pa�t of the structure itself. 1# can be accessed only from the
outside. Because the storage facility is c�nsidered an accessory structure, it does meet
the 5 foot setback Therefore� the dedc would also be set back 5 feet as required by c�de;

however, it does encxoach i�to the side by 4 feet 10 inches as opposed to the pertnitted
3 fee�
Ms. McPherson stated the petitioner has one altemative which would to � to shorten the
dedc by 1 foot 10 inches whid� would then leave a portion of the roof of the storage facility
uncovered. It would look aesthetically odd but i# would not adversely impact the dec�CC or
the exit to the side yard. Eliminating the deck altogether is not an altemative. There is a
drastic grade change along the south and west sides of the storage facil"dy so code wouid
require some-type of railing.
Ms. McPherson stated the request is within previously granted requests. Staff has no
recommendation.
Mr. Kuechle asked if the 3 feet they are talking about would normally be 10 feet
Ms. McPherson stated, yes. The side yard setback is required to be 10 fee� The code
allows dedcs in the side yard to encroach 3 fieet as long as they do not come closer than
5 feet. This request meets the 5 foot part of the code but not the 3 foot part.
Ms. Savage asked if staff had received any calls from the neighbors.
Ms. McPherson stated, no.
Mr. Kuechle stated construction is underway. Is this something the City saw that was
added iater?
Ms. McPherson stated consiruction on the porcfa is underway. She did not believe
construction o� the deck portion had commenced. The petitioners were told at the �ime
of applying for the building permit for the porch that they would need a variance for the
deck
Ms. Meyer showed pictures of the existing porch and d�c. The �rc� and deck will be the
same size. They are just repiacing what is there. The wood is rotting so they r�eed to
replace it.
Mr. Meyer stated the railing in question has been there for 29 years and has always
encxoached. They are not increasing the encroachment He understands the need for the
space. Their land and their neighbor's land drops rather abruptly so there is no way an
emergency vehicle could acxess there because of the slope. They could cut back the deck
to 3 feet if necessary: However, they had a stoRn shelter built after the tomadoes� and it
would be ugly if it was not covered by the deck. Ne thought it would be appropriate to
keep it the way it is.
Ms. Savage asked if the neighbors had any problems anrith the request

Mr. Meyer stated they have no problems with the request
Ms. Meyer stated the only one that would s� the deck is the neighbor who has a high
fence to shield their pool.

Ms. Smith stated she was inclined to vote for approval. While it is not necessarily a
hardship, aesthetically it makes sense to extend the deck. The actual amount of increase
in feet and inches in so minimal as to be non-�xistent
Mr. Ku�hle concurred. Although there is not a clear hardship, it would be a hardship to
have to step off the deck on the roof of the storage facility. It is far enough in back of the
house so it does not visually have an impact from the sfreet.
Ms. Savage agreed.
