Mr. Fsldorl Schmedeke, Planning Commission Member, said that �}►e zoning ordinance was passed in 1969. Throughout the Planning Com�.ission l�inutes over the past month, he said he has tried to explain what has happened. The Plang��g.,Com- mission has had S- 6 requests for c,hanges in zoning �rhich involve substandard lots. There �re four lots across from Sandee's Cafe which woul'd fit the 20,000 square foot requirem�at but have to be consid�red substandard now. liiey have also had a request just north a# Sandee's Cafe by Mr. Walquist wl�i�h irt- volved only 17,000 squsre feet. At the time the ordinance was adopted, his recommendation was a,minimum of 15,t?00 square feet �hich he felt would be proper, but the requirement was made 25,000 square feet, so the 20,000 squara feet.would be in the nature of a compromise. A suxvey of the 1ot, with the proposed location of the house drawn on it, was shown to the Board. The 1ot is a corner lot and has an odd shape having a frontage of 57.94 feet plua a radius and a back footage of 1fi0 feet. Tize aagle is an the south lot line. The proposed house is 48 feet long plus a 24 foot attached garage. The house will face Alden Way with the driveway possibly exiting onto 79th Way. The driveway would be very close.to the �� intersection having to ex3.t on either 79th Way or Alden Way. Mr. Belisle said the buyer that Mr. Johanson ha� for the lot,_wants the house positi,oned as groposed. To poaition the house this way would s�ve some treea, as this-:is a wooded lot, and would also preserve the back yard. The grade of tl�e':1ot:rais�s.toward the back of the lot. To face the house toward 79th Way, wh�tch could be done without variances, would involve removing part of this bank. To position the house to meet the side yard requirement, while £acing toward A1den Way, would.also require removing part of the bank. There is a vacant lot adjacent to the south, but there would be no problems in building on this lot whether the varia�ce on Lqt 1 was grgnted or not. MOTION by Harju to close the Public Hearing. Seconded by Sondheimer. Upon a voice vote, there being no nays, the motion . carried unanimously. Mr, Harju said the buyer has a specific tloor plan that he wants to build on this;lot and i,t does not constitute a hardship just becaus�e this floor plan will not fit on the lot. Pictures of the complex and a plot plan were ahown to familiarize tbe members of the Board with the project. • Mr. Fuda.li said (in su�rsnary) that the original owners of the land initially conceived this project as a 294 or 295 unit complex. Prio,r to his purchase of the property, he went over all of the minutes of the varioua committees a.nd Council meetings concerning this complex to make sure the property was adequate, as represented to him, to accommoda.te 294 or�295 unfts. .He then read portions of these minutes to the Board, and all the minutes, even as l�te as November of 1970, were covering a 294 or 295 unit complex. The mistake in computing the land area was ma,de by Dolan Engineering who made the site plan for the original owners. When drawing up the site plan they agpare�tly took the acrea.ge from the half section map, which included 1�alf of the East River Road right of way along the west side of the property. 7�ie si:te pla,n dated July 26, 1970 that was submitted by the original awners to the various committees and Council showed a land use schedule which stated "actual land area 17 acres"a This acreage was incorrecC in that it did include the right of way measurement. � � � The error in acreage was discovered when Five Sands Development was filing the plat. Mr. Fudali explained to the Board that a11 of their contracts an@ orders are all signed and ordered for a 295 unit complex. To cancel the contxacts and change the orders, etc., at this time, tv acco�anodate less than 295 units woul,d involve thousands of dollars. � Tize greesx area in this development is a common area for, the whole comglex.
