A. PUBLIC PURPOSE SERVED BY RE UIREMENT•
Section 205.154, 4, allows unoovered porches and steps to building
entrances to extend not more than 10 feet into a required front yard.
Public purpose served by this requirement is to allow for aesthetic
consi8eration to reduce the buildinq "line of siqht" encroachment into
the neighbor's front yard.

"Need a front door and need abave grade deck to use door."
C. ALIMIIIISTRATIVE STAFF REVIEW:
e existi dwelling was built in 1956 with a 35 foot front yard
setback. In 1976, the City improved 71 Way and 9 feet of this
property was taken for street riqht of way, leaving the existing house
27.9 feet fran the front property line.
The proposal is to build a 12 foot deck and front step off the front of
the dwelling which would leave a 15 foot front yard.
T'he adjacent structures to the east and west are over 100 feet from
this addition so this deck should not encroach into their "line of sight".
T'here is an apparent problem aver the westerly 10 feet of Lot 32,
Auditor's Subdivision #77. The City approved the lot split (L.S.#73-07)
in June, 1973. For some reason the transfer of the 10 feet of land was
never recorded at the County. Therefore we have tAld Mr. Nielsen that
the staff report would be recommending to the Board that his petition
be oontinued until proper recording has been accomplished. Mr. tiielson
does have an attorney working on this at this time.
Mr. and Mrs. Donald Nielssn. 115-?1+ Way N.. Fri,dlsy. I1 s+ere pressnt.
Mr. Nislaen barief]y revieWed his variancs requsst. Mr. Clark notad that ths
document that transferred ten feet to the eaat to Mr. Aielsen's property was
recorded on June 10 1982. Chsirxonn Gabel added that they were atill
discusaing Lhe same variance requsat. Chairaoman Gabal ssked about the aize
of the boulevard and Nr. Clark responded that it uss aix feet. An aerial
photograph vas available aa ti+ers current photographs. Mr. N3elsen explained
tisat there is ar existing bick patio 12x14, whiah xould be where t.he proposed

A. PUBLIC PUR'POSE SERVED BY REUIREMENT:
Section 205.053, 4A, requires a front yard setbadc of not less than 35 feet.
Public purpose served by this requirement is to allaw for off-street parking
without encroaching on the public right of way and also for aesthetic
oonsideration t reduce the buildinq "line of sight" encroachment into the
neighbor's front yard.
AND/OR
Section 205.053, 4B, requires a minimum 10 foot side yard adjoining living
area.
Public purpose served by this requirement is to maintain a minimum of 20 feet
between living areas in adjacent structures and 15 feet between garages and
living areas in adjacpnt structures to reduce exposure to conflagration of
fire. It is also to allow for aesthetically pleasing open areas around
residential structures.
B. STATED HARDSHIp;
"Only location where I can build a qarage of the size needed."
C. ADMINISTR.ATIVE STAF' REVIF3T:
This home is located at the end of Jackson Street and there are no other
hoa►es that front on Jackson south of the petitioner. The petitioner wants
to build an attached garage in front of their existing house and have the
access door face north and utilize their existing driveway. They would
also like to keep th eir exis ting garage of which they will be requesting a
special use pexmit. If the front yard varianoe is granted and the special
use permit denied, they will then need to corn►ert their exiting garage to
living area acl they will need a side yard variance for it. If the Board
approves these requests, we would reconmiend that no windows be placed on
the north Wall of the converted garaqe.

MOTION by Counci].man Bamernik to set the public hearing on this vacation
.request for August 16, 1982. Seoonded by Counci].man Scxueider.
A gentlenan representing S& R Investment Company stated the variance
doesn't really have anything to do with the building permit. ee stated
their plan was to have attached garages, which would have been on part of
the setback, but then the City decided they would rather have tuck-under
garages. He stated they have changed the plan and will have tuck-under
garages arx3, therefore, wouldn't be on part of the serback.
Mr. Flora, Public Works Director, stated a portion of the parking lot
would be on the property requested to be vacated, therefore, it would be
associater7 with the building permit.
Mayor Nee stated, if this is the case, they can't preempt this vacation
proceeding. Upon a voice vote on the above motion, all voting aye, Mayor
- Nee declard the motion carried unanimously.

 ALIAW NSTRiI(,TION OF A 22' X 38' AZTACHID G1RAGE AT 5312 ALZURA
RQAD N. E., R(JBET G. RISHISH: _

QOUNCIL MEE.TING OF JtJI.Y 26 , 1982 PAGE 3
Mr. Flora, Public Works Director, stated this is a request to reduce the
side yard setback for an attached garage framthe required five feet to
three feet to allaw the construction of a 22 x 38 foot attached garage at
5312 Altura Road N. E.
Mr. Flora stated, during discussions, it was found there was too much
square footage on the property and, therefore, the petitioner will remove
part of the existing garage, leaving a 12 x 14 foot storage shed for the
property.
Mr. Flora stated one neighbor objected to this variance, as she felt the
roof would be too close to the property line, and result in a devaluation
of her property.
Mr. Flora stated the Appeals Canmission has recommended approval of the
variance with the stipulation that the north wall be a f irewall with 5/8
inch type x gypsum board and any windows on the north wall be fire safe
steel mesh.
Councilman Fitzpatrick stated the Appeals Commission unanimously
recaimended approval of this variance in spite of the objection of the
affected neighbor. He pointed out the varianoe is only for two feet and is
prepared to recatunendation.
Councilnan Fitzpatrick stated he believed the person who objected, and the
petitioner, were both present his evening.
Mrs. Harold Arerson, 5342 Altura Road, stated she felt the roof lines
would be too close together. She further stated there would be a problem
with the snaa and a lot of misture in the basement.
Mr. Fora stated the plans indicate a roof overhang of 18 inches beyond the
wall.
Mr. Rishish stated the roof line follaws the existing line so he felt any
snaw would either go forward or back and wouldn't build up between the
houses.
Councilman Barnette asked Mrs. Anderson if she had problens with drainage.
Mrs. Anderson stated she had not, but guessed others had problems, and was
sure the houses would be too close and would cause water in the basennent.
Councilman Barnette stated he felt the drainage could be taken care of so
water wouldn't drain tawards Mrs. Anderson's house.
Mr. Rishish stated the natural drainage pattern now tends to be to the
back of the lot.
Mr. Nee stated, overall, this looks like a good improvement and this
addition voulc3 be built, without a variance, if it was two feet shorter.
Mrs. Anderson stated she was aware of this, but two feet was two feet.
She stated she felt the improvesnent was an advantage for Mr. Rishish, but
not for them.
OOUNCIL IETING OF JULY 26, 1982 PAGE 4
Councilman Fitzpatrick stated he can sympathize with Mrs. Anderson's
objection to having this building close to the property line, however, he
would have to concur with the recomnerdation of the Appcals Catmission.
MOTION by Councilman Fitzpatrick to ooncur with the recommendation of the
Appeals oaQnission to grant a variance to reduce the side yard setback for
an attached garage fran the required five feet to three feet to allow
construction of a 22 x 38 foot attached garage with the stipulation that
the north wall be a firewall with 5/8 inch type x gypsum board and that
ariy windaws in the north wall be fire safe steel mesh windows. Seconded
by Counci]man Schneider.
Counc].man Barnett stated he grew p in Minneapolis where the houses were
close together and doesn't remenber any problems with drainage.
Mrs. Anderson stated the averhang would be right on top of her fence. Mr.
Flora stated the averhang will be 1-1/2 feet inside the property line.
Councilman Schneider asked if Mr. Rishish's contractor indicated any
problem with the fence, and Mr. Rishish stated he hadn't noted any
problens.
Councilman Hamernik suggested possibly adding a stipulation that this
addition woulan't disrupt any drainage flow that is currently existing.
Mr. Kishish stated this would be satisfactory if they can establish what
is cvrrently existing. Ae stated he has never seen water come to the back
of his house.
Councilman Barnette asked if he ever had water in his basement. Mr.
Rishish stated he has because af a cracked foundation, which he hopes to
correct, but there was no water in the basement because of the manner in
which the water drains.
UPON A VIICE VOTE TAKIIV ON IE ABOVE MOTION, all voted aye, and Mayor Nee
declared the mtion carried unanimously. The Council received the minutes
of the Planning Caiuni.ssion Meting of July 14, 1982.

FOR BIACR FORRFST lARZMIIV'I5:
Mr. ¢ieshi, City`Manager, stated the development agreement provided by
the Darrel Farr;Corporation indicates they had a mortgage canitment prior

condacninivan ooizversions.
Mr. Qureshi.` statec] the staff, with the help of Councilman Schneider,
worked with the Farr Corporation to work out certain oonditions which gave
additional cons, ideration to the existing renter.
Councilman Schnei.der stated that State law on .condominium conversions
