ALIMIIIISTRATIVE STAFF REVIEW: �e existi� dwelling was built in 1956 with a 35 foot front yard setback. In 1976, the City improved 71� Way and 9 feet of this property was taken for street riqht of way, leaving the existing house 27.9 feet fran the front property line. The proposal is to build a 12 foot deck and front step off the front of the dwelling which would leave a 15 foot front yard. T'he adjacent structures to the east and west are over 100 feet from this addition so this deck should not encroach into their "line of sight". T'here is an apparent problem aver the westerly 10 feet of Lot 32, Auditor's Subdivision #77. The City approved the lot split (L.S.#73-07) in June, 1973. For some reason the transfer of the 10 feet of land was never recorded at the County. Therefore we have tAld Mr. Nielsen that the staff report would be recommending to the Board that his petition be oontinued until proper recording has been accomplished. He stated the petitioner is requesting a�ecial use petmit for oonstruction of a second garage. Mr. Flora stated the original plan was for the petitioner to convert the existing garage into living space, however, he now requests the use of both garages for storage purposes. Mr. Flora stated the Planning Crnmiission has recommended aproval of this special use permit-to allow the construction of a second accessory builaing. - MOTION by Counclman Schneider to concur with the recmamendation of the Planning Caimiission and grant special use penait, SP #82-08 to allow for the construction of a second accessory building at 6271 Jackson Street. Seconded by Councilman Barnette. Upon a v�oioe v�ote, all voting aye, Mayor Nee declared the motion carried unanimously. A gentlenan representing S& R Investment Company stated the variance doesn't really have anything to do with the building permit. ee stated their plan was to have attached garages, which would have been on part of the setback, but then the City decided they would rather have tuck-under garages. He stated they have changed the plan and will have tuck-under garages arx3, therefore, w�ouldn't be on part of the serback. Mr. Flora, Public Works Director, stated a portion of the parking lot would be on the property requested to be vacated, therefore, it would be associater7 with the building permit. Mayor Nee stated, if this is the case, they can't preempt this vacation proceeding. RISHISH: _ ,: QOUNCIL MEE.TING OF JtJI.Y 26 , 1982 PAGE 3 � Mr. Flora, Public Works Director, stated this is a request to reduce the side yard setback for an attached garage framthe required five feet to three feet to allaw the construction of a 22 x 38 foot attached garage at 5312 Altura Road N. E. Mr. Flora stated, during discussions, it was found there was too much square footage on the property and, therefore, the petitioner will remove part of the existing garage, leaving a 12 x 14 foot storage shed for the property. Mr. Flora stated one neighbor objected to this variance, as she felt the roof would be too close to the property line, and result in a devaluation of her property. Mr. Flora stated the Appeals Canmission has recommended approval of the variance with the stipulation that the north wall be a f irewall with 5/8 inch type x gypsum board and any windows on the north wall be fire safe steel mesh. Councilman Fitzpatrick stated the Appeals Commission unanimously recaim�ended approval of this variance in spite of the objection of the affected neighbor. He pointed out the varianoe is only for two feet and is prepared to recatunendation. Councilnan Fitzpatrick stated he believed the person who objected, and the petitioner, were both present his evening. Mrs. Harold Ar�erson, 5342 Altura Road, stated she felt the roof lines w�ould be too close together. She further stated there would be a problem with the snaa and a lot of m�isture in the basement. Mr. Fora stated the plans indicate a roof overhang of 18 inches beyond the wall. Mr. Rishish stated the roof line follaws the existing line so he felt any snaw would either go forward or back and wouldn't build up between the houses. Councilman Barnette asked Mrs. Anderson if she had problens with drainage. Mrs. Anderson stated she had not, but guessed others had problems, and was sure the houses would be too close and would cause water in the base�nnent. Councilman Barnette stated he felt the drainage could be taken care of so water wouldn't drain tawards Mrs. Anderson's house. Mr. Rishish stated the natural drainage pattern now tends to be to the back of the lot. Mr. Nee stated, overall, this looks like a good improvement and this addition voulc3 be built, without a variance, if it was two feet shorter. Mrs. Anderson stated she was aware of this, but two feet was two feet. She stated she felt the improvesnent was an advantage for Mr. Rishish, but not for them. Councilman Schneider asked if Mr. Rishish's contractor indicated any problem with the fence, and Mr. Rishish stated he hadn't noted any problens. Councilman Hamernik suggested possibly adding a stipulation that this addition woulan't disrupt any drainage flow that is currently existing. Mr. Kishish stated this would be satisfactory if they can establish what is cvrrently existing. Ae stated he has never seen water come to the back of his house. Councilman Barnette asked if he ever had water in his basement. Mr. Rishish stated he has because af a cracked foundation, which he hopes to correct, but there was no water in the basement because of the manner in which the water drains.
