Sec�ion 2. The Tns�ector of Buildings shall, before issuing any
pe�:mi�: for the erec•�ion o� any builc�ing or structure, or for any
addition to any existing building or st-ructure, or for any alterations
or repairs to any existing building or structure, upon application
therefor, require the payment by the a�plicant for such permit of
iees to the amount herein belaw set torth and in the manner herein
�rovided to-wito
2.1. For any such permit for the erection of any fire-proo� building,
ofiher than a garag�, warehouse, factory or grain elevato•r, or for the
erec�ion of any f?re-p�oo� addition, for similar occupancy, to any
existing buildiny shall be at the rate of $1.40 for each one thousand
cubic feet, or fraction thereof, in such cubical contents.
2.2. For any such permit for the erection of any fire-proof garage,
warehouse, factory or grain elevator, or �or the erection of ar�y fire-
proo�E addition, io� similar occu�ancy, to any existing building shall
be at the rate oi $1.25 for each one thousand cubic feet, classi�ied
as "�ireproo�" by �ection 502 of the Minneapolis Building Code.
HOUSES
2.3. For any such permit for the erection o� any non-�ireproof build-
ing other than a garage, warehouse, fac�tory or grain elevator, or any
non-rireproof addiic�.on, for similar occupancy, to any exis�ing building�

GARAGES

SECTION 2. The Inspector of Bui.ldings shall, before isauing any permit for
the erection of any building or structure, or fo.r any addition to any existing
building or structure, or for any alterations or repairs to any existing
building or structure, upon application �herefore, require the payment by the
applicant for such permit of fees to the amount herein below set forth and in
the manner herein provided to-wit:
2.1. For any such permit for the erection of any fire-pruof buildicig,
other than a garage, warehouse, factory oY grain elevator, or for the erection
of any fire•proof addition, for similar occupancy, to any existing building,
shall be at the rate of $1.40 for each one thousand cubic feet, or fraction
thereof, in such cubical contents.
2.2 For any such permit for the erection of any fire -proof garage,
warehouse, factory or grait� elevator, or for the erection of any fire -proof
addition, for similar occupancy, to any existing building shall be at the
rate of $1.25 for each one thousand cubic feet, classified as "fireproof"
by Section 502 of the Minneapolis Building Code.

building, other than a garage, warehouse, factory or grain elevator, or
any non-fireproof addition, for similar occupancy, to any existing building -
permit $1.00 for each one thousand cubic feet.
GARAGES
2.4. For any auch permit for the erection of any non-fireproof garage,
warehouse, factory or grain elevator, or for the eree,tion of any non-fire-proof
addition, for similar occupancy, to any existing building or for each such
building or addition - ninety cents ($0.90) for each one thousand cabic feet
or fraction thereof, in the cubical contents thereof with the minimum of $4.00.

Pursuant to Minnesota Statutes� the City of Fridley, having duly
considered the matter, finds the above described building to be a hazardous
building for the following reasons:
That a fire occurred in the structure approximately 18 months ago.
• The house was more than 50% destrayed by the fire. That despite
repeated requests for removal or repair, no action has been taken
by the defendants. Said property has been inspected by the
F£re Inspector, Electrical Inspector, Plumbing inspector, and
Building Inspector. These Inspectors have issued an Inspection
Department Report for the hazardous building, a copy of which
'is attached hereto, marked Exhibit "A", and made a part of this
Order. Said Inspection Report indicates the present condition
of the building and specifies the changes that are necessary
to bring the property into compliance with the existing Building
Code of the City of Fridley. The City Council finds ttiat the
property in its present condition is a hazard to the public
sufety and welfare of the citizens of Fridley and the surroundi.ng
property owners.
Pursuant to the foregoing and in accordance with Minnesota Statutes,
it is hereby ordered that the above said hazardous building be repaired
and made safe and not detrimental to the public health, welfare and safety
by removing the above described deficiencies and making said house meet
the existin� Code requirements of the City of Fridley or that said structure
be razed or removed� and that said repairs be commenced by obtaining a
building pez�it from the Building Inspector of the City of Fridley within
twenty (20) days of the service of this Ozder, and that said repairs be
' completed within ninety (90) days of the service of this Order� or in the
� alternative� if said repaira are not co�enced� that the property owners
raze or rer�ove said building Within twenty (20) days of the service of this
Order.

unreasonably interferring with the repairs or razing and removal of the '
building, shall Ue removed within twenty (20) days, and, if not so removed
by Yhe owner within said time� they may be removed by the City of Fridley
and sold at private auction.
You are further advised that unless such corrective action is taken;
or an answer is served upon the City of Fridley and filed in the office of
the Clerk of District Court of Anoka County, Minnesota� within twenty (20)
days from the date of the service of this Order upon you, a motion for
summary enforcement of this Order will be made to the District Court of
Anoka County.
You are further advised that if the City of Fridley is compelled
to take any corrective action herein, all necessary costs expended by
the City will be assessed against the real estate and collected as other
taxes.

RE�RDING: Dis,position of Fire Damaged House at 5432 Altura Road N.E.
The single family rambler at 5432 Altura Road N.E. was buitt about
20 years ago. The tornado of 1965 damaged it enough to warrant
$1,000.00 worth of re,pairs. In January of 1977 it was gutted by
fire. Criminal cha.rges of axson were charged in relation to this
fire. These charges are still no t settled and may take two years
to �esolve in the courts. Approximately 15 �nths have passed
since the house was vacated and boaxded up.
On Masch 10, 1978, Mr. Ri.ck Tracy of the Anoka County Attorney's
office indicated that the house itself is no longer being held
as evidence in the cri.minal case. We have r�ceived niunerous
related complaints about long grass, dangerous fences, break-ins,
broken glass, negati.ve affects on neighboring property values,
and fi.nally rat infestation.
I suggest that we begin coridemnation proceedings or issue a letter
of intent to the property owner of rec:ord, Mr. Uaniel Baker. Mr.
James Stanton of Stanton Realty may be interested in purchasing
Mr. Baker's interest and repairing the fire damage. I am waiting
for a return ca.11 from Mr. Stanton. The Assessor's office shows
the building to be 49 percent intact immediately after the 1977
f ire .

was heavily damaged by fire and has been left in its damaged condition for
over a year. The Citp has instructed me to commence a Hazardous Building
Action against this property unless prompt and definite arrangements are
made by parties of interest to remedy the eui.sting situation.
I would appreciate it if you would give me a call if you wish to discuss
the matter. If I have not come to a satisfactory agreement by May 20, 1978,
I intend to commence a Hazardous Building Action in the Anoka District

It was noted Mr. Saunders had no objection to the sidewalk, as long as it
was not to be constructed on.his property. .
Councilman Hamernik•'indicated he would not be in favor of constructing the
sidewalk and leaving out the 135 feet south of 63rd Avenus.
Mr. Qureshi, City Manager, stated in discussions with Dr. Hansen, Superin-
tendent of Schools, he felt this sidewaltc was needed for safety reasons.
Mr. Qureshi stated the Council could adopt the resolution for construction
; of the sidewalk on the east side of 7th Street from 61st to 63rd Avenues,
I with construction only on City right-of-way. Councilman Barnette stated
��,, he was prepared to move the resolution on that basis.

MOTION by Councilman Barnette to adopt Resolution No. 55-1978, with the
deletion of the words "135 feet south of". Seconded by Councilman Hamernik.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.
CONSIDERATION OF HAZARDOUS BUILDING ACTION °
MOTION by Councilman Fitzpatrick to approve the order regarding the .
hazardous building, and authorize the Mayor and City Clerk to sign same.

Nee declared the mot9on carried unanimously.

Mr. Qureshi, City Manager, stated about 11 employees used the counseling
se vice last year. He stated the service is available on a voluntary basis,
bu in the case where it is affecting ttie employees' performance on the

Mr. Qureshi explained the program is subsidized 50� by the State. He stated
the reaction of supervisory staff is that the service has been helpful.
Mr. Qureshi stated the Metropolitan Clinic of Counseling. Inc. provides
dia nostic and referral services.

SECTION 2. The Inspector of Buildings shal,l, before issuing permits for the erection
of any building or structure, or for any addition to any existing bui.lding or structure,
or for any alteration or repairs to any existi.ng building or structure, upon application
therefore, require the payment by the applicant for such permit of fees to the amount
herein below set fort� and in the manner herein provided to-wit:
NEW CONSTRUCTION: Single Family Homes and Garages: $4.00/1,000 cubic feet.
PLAN CHECK: 25 percent of.building permit fee.
DRIVEWAY DEPRESSION: (Concrete Curb Streets Only)
Alternate A: Reaioval and replacement of concrete curb and
gutter only; Driveway width plus 6 feet x$14.50
Alternate B: Removal and replacement of concrete curb and
gutter and install a 3 foot wide approach with
� 6 inch depth; Driveway width plus 6 feet x$1?-2�

�For the purpose of computing fees for building permits, the cubical.contents of any
building or addition, is determined by multiplying the ground area covered from a
point s3x (6) inches below the floor line of the basement or the cellar to the
average heights of the upper surface or to the average height of .the roof surface
of the main gable of a pitched roof. . �
For repai.rs or alterations to an existing structure, the fee shall be at the rate
of $3.00 ger each five hundred dollars �($500.00) or fraction thereof in the cost
of a1.1 proposed work.
In�no case shall the fee charged for any permit as set forth in Section 2 be less
than $7.50 plus $.50 state surcharge.

NOTE: Permits for construction will be issued a miniminn of 24 hours from the time
of application to allow for proper review of the proposed structure and of the
construction site. •
A Certificate of Survey of the lot, showing the location of the foundation once it

use or occupancy of any structure for which a building permit has.been issued; and
